BOARD OF MEDICAL EXAMINERS OF THE STATE OF NORTH CAROLINA June 12-16, 1977 The Velvet Cloak Inn Raleigh, North Carolina The Board of Medical Examiners of the State of North Carolina met at Ths Velvet Cloak Inn, Raleigh, North Carolina, June 12-15, 1977 for the purpose of interview- ing applicants for license by endorsement of credentials, conductingother business, and administering examinations for licensure. Drs. Charles B. Wilkerson, Jr. , President, J. Jerome Pence, Jr. , Secretary- Treasurer, David S. Citron, Bryant L. Galusha, Joyce H. Reynolds, E. Wilson Staub and Bruce B. Blackmon were present. Sunday, June 12 ~eO ~m The Board convened for business and reviewing credentials of applicants for license by endorsement. RE: 8 Bo rd me in Dr. Blackmon presented a resolution regarding shortening the agenda at the May Board meetings so that the Board members would be available, if needed, to the members of the Medical Society during their annual meeting. Dr. Citron moved that every effort be made to avoid scheduling meetings of the Board during the hours when the Society House of Delegates is in session during the May meeting, and also eliminate the subcommittee meeting with the Board of Nursing, and cut down as much as possible on the number of applicants scheduled for interviews for license by endorsement of credentials. Seconded by Dr. Pence and duly passed. REs Dr D ek H S ark Santa Maria, California The Executive Secretary advised the Board that Dr. Spark had withdrawn his application for license by endorse- ment in North Carolina. Dr. Pence moved that this be received as information. Seconded by Dr. Citron and duly passed. REs Dr Julita S Olim o, Butner, N. C. The Board reviewed a request for the issuance of a resident's tranning license to cover Dr. Olimpo's work at Cherry Hospital prior to results of the FLEX examination, and if she does not pass, the resident's training license be allowed to continue in force until she can take the next examination, if she makes at least a grade of 70 on the June, 1977 examination. Dr. Galm ha moved that Dr. Olimpo's request for a special resident's training license to cover her staff work not be granted since she has held a resident's training license previously while taking the FLEX examination in December, 1974 and June, 1975, failing the examination both times, and what she is requesting now is tantamount to what she has already done in her residency training. Seconded by Dr. Wilkerson and duly passed. RE: P sician's assistant ro ams County Technical Institute Programs: The President of the Board reviewed for the Board a letter to the AMA Division of Medical Education and a meeting he and the Executive Secretary' had attended regarding the opening of these two programs at the Pitt Technical Institute and the Catawba Valley Technical Institute. Dr. Wilkerson told the Board that both institute spokesmen indi- cated that their institution would fulfill any regulations or qualifications that the Board deemed necessary, and would conform to those regulations. Also present at that meeting were representatives from the North Carolina Association of Assistants to Physicians, who were not in favor of the two programs being started at the county schools, indicating that there were already assistants in the state who were graudates of approved programs, who were having difficulty finding jobs in the state. The feeling of the Board of Education representatives and representatives from the two county institutes was that the programs were already started and should be followed through. In addition, the Board reviewed a letter from Mr. Ervin Lineberger, Dean of Instruction at Catawba Valley Technical Institute inviting the Board to send an observer at the time of the visit of the accrediting committee from the AMA. Dr. Citron moved that the Board respond respectfully declining their invitation to send an observer at the time of the committee visit. Seconded by Dr. Pence and duly passed. Meeting ad)ourned until 9:00 a. m. , Mondayf June 13.

The Board convened for business and reviewing credentials of applicants forlicense by endorsement.

RE: 8 Bo rd me in —Dr. Blackmon presented a resolution regardingshortening the agenda at the May Board meetings so that the Board members would beavailable, if needed, to the members of the Medical Society during their annualmeeting. Dr. Citron moved that every effort be made to avoid scheduling meetingsof the Board during the hours when the Society House of Delegates is in sessionduring the May meeting, and also eliminate the subcommittee meeting with the Boardof Nursing, and cut down as much as possible on the number of applicants scheduledfor interviews for license by endorsement of credentials. REs Dr Julita S Olim o, Butner, N.C. —The Board reviewed a request for theissuance of a resident's tranning license to cover Dr. Olimpo's work at CherryHospital prior to results of the FLEX examination, and if she does not pass, theresident's training license be allowed to continue in force until she can take thenext examination, if she makes at least a grade of 70 on the June, 1977 examination.Dr. Galm ha moved that Dr. Olimpo's request for a special resident's training licenseto cover her staff work not be granted since she has held a resident's traininglicense previously while taking the FLEX examination in December, 1974 and June, 1975,failing the examination both times, and what she is requesting now is tantamount towhat she has already done in her residency training. Seconded by Dr. Wilkerson andduly passed.

The joint subcommittee of the Board of Nursing and Board of Medical Examinersmet to review applications for registered nurses performing medical acts and considera-tion of other business. Dr. Pence, Chairman of the subcommittee, gave the followingreport:

The policy of having orders countersigned within 48 to 72 hours was discussedand the subcommittee recommended that a letter be sent to persons, nurses andphysicians, who were involved in this type of situation, conveying the policy ofthe subcommittee.

Also discussed during this meeting was an application by a nurse to work in analcohol detoxification center in Durham, N. C. The subcommittee was concerned aboutregistered nurses working in these centers, especially when they have had no txaining forthis type of work. The subcommittee recommended that approval be withheld pending asite visit to the center by Dr. Reynolds and Ms. Nagel, with a report back to thesubcommittee at the next meeting.

Dr. Pence reported that a physician had requested the subcommittee to considerallowing a nurse midwife, who had not been certified yet by the American College ofNurse Midwives due to a delay in certification of the examination grades, to go towork before that certification is received to help relieve the shortage in the Lumber-ton area. The subcommittee responded that while they understood the situation withthe shortage, they did not feel they could certify an individual on whom they hadno grades from an examination.

Another topic discussed was prescription pads for physician extendors. The sub-committee felt that all prescriptions should be written on the physician~s prescriptionpad only (or professional association pad), with the registered nurse's name orassistant's name below or to one side of the pad, with their number for prescribingfollowing their name. The subcommittee recommended that this information be includedwith the information that is first provided when an application is requested for aphysician extendor, and the Pharmacy Board be so notified of this.

Dr. Pence also reported that several applications were submitted for approval tothe subcommittee but were returned to the applicants for further information onsupervision, job descriptions, etc. , and they were not approved by the subcommittee.

Dr. Citron moved that the subcommi, ttee report be accepted as presented. Secondedby Dr. Milkerson and duly passed.

RE: Audit Fiscal Year 1 - 6 —Following review of the audit by' the StateAuditor's office, Dr. Galusha moved that the audit be received as information.Seconded by Dr. Citron and duly passed.

Dr. Citron moved that the Board writhe the MA or the Federation of State Medical Boardsto determine if any court has declared acupuncture the practice of medicine, and if ithas been, the Board inform the Attorney General's office of the Board's opinion, and theinformation received. Seconded by Dr. Galusha and duly passed.

Tuesday, June 14

RE: Forei medical aduates —presentation of original documents. TheBoard considered the situation of a foreign medical graduate who has trouble obtain-ing original certification on the application form for license by endorsement fromhis medical school, and who requests the Board to consider accepting his originaldiploma or other official document presented to them in lieu of having the applica-tion form completed. The Board instructed the Executive Secretary that he wouldhave the authority to examine original documents presented by applicants, com-pare them with photocopies of those documents with a notation that he has seenthe originals and the copies are the same as the original, and the Board willaccept this in lieu of retaining the original documents on file.

RE: Visitin Professors —Clarification of Board policy: Dr. Ewald Busse,Dean of Duke University School of Medicine, appeared to discuss with the Boardclarification of the rules and regulations regarding physicians who have beengranted a Certificate of Registration as a Visiting Professor who later wish toapply for a full license in North Carolina, whether by' examination or endorsementof another state license. Dr. Busse was advised that the Board could not, bystatute and policy, refuse to consider an applicationt for full license if he metall the qualifications for it, and therefore, just because a physician held a VIPregistration when he original+came to North Carolina would not automaticallydisqualify him from applying for a full license in North Carolina. The Boardstressed that although the purpose of the Visiting Professor registration was notto let physicians come to North Carolina on a sabbatical at a medical school andobtain a visiting professor registration until they could take the examination,if the physician did come, and decided that he would like to stay here permanently,they could not deny him the privilege of applying for full licensure in the state.The Board urged Dr. Busse to contact them if he saw a trend developing that wouldindicate that foreign physicians are using this registration certificate as ameans of coming to this country until they can take the examination, while stillbeing able to practice medicine in the state at a medical school wihhout havingto go through the standard procedures for either a full license or a resident'straining license. Dr. Busse indicated he would be glad to do so, and thanked theBoard for their time and consideration.

considered by the North Carolina General Assembly to: re-define the definition ofchiropractic; change the requirements for licensing of chiropractors; give chiro-practors the right to have access to hospital records and tests concerning theirpatients; and qualify chiropractors as expert witnesses in court proceedings withincertain guidelines. RE: Dr Sam son Harrell, Durham, N. CD —Application misplaced for Joan A.Lederer at Board meeting. Dr. Galusha moved that Dr. Milkerson review the applica-tion when it is located, and make the proper consideration and recommendation.Seconded by Dr. Pence and duly passed. Application located June 15, 1977, and re-viewed by Dr. Milkerson June 20, 1977: Dr. Milkerson recommended that the appli-cation be returned for documentation of coverage by a back-up physician for theassistant, and be approved if and when this is received; and if there will be noback-up physician, he be written that the assistant is not to function in anymanner when he is out of town, ill, etc. (Dr. Harrell advised of this recommenda-tion by Executive Secretary June 21, 1977)

RE: Dr William R Thornhill, Columbia, N. CD and Dr Malter L Holton,Manteo, N.G ~ —Request to serve as back-up physicians for each other's physician' sassistant, when short absences from their offices are required, but not for vacationor extended leave times. Dr. Holton and Dr. Thornhill have indicated that althoughthey are about 45 minutes away from each other's offices, there is a shortage ofphysicians in that area, and they feel with each other's back-up and use of theirassistants, they could serve the area better. Dr. Galusha moved that this beaccepted on a one-year trial basis, at the end of which time, Dr. Holton andDr. Thornhill will be requested to send a report on the situation to the Board.Seconded by Dr. Citron and duly passed.

RE: Neeti with re re entativ s from the State Attorne General's office-Dr Alan Baughcum, Economist, Ms. Catharine Arrowood, attorney, and Nr. John Silver-stein, attorney, met with the Board to discuss antitrust and constitutional problemswith the statutes and rules and regulations under which the Board operates. They toldthe Board that the Federal government was becoming very interested in occupational andprofessional licensing matters, and in that regard, the attorney' general's officehoped to be able to provide advice in the problem areas for all state agencies deal-ing with licensing procedures.

Dr. Baughcum stated that many of the problems arose from the legislatures invarious states delegating too much authority to the licensing Boards in setting uptheir rules and regulations, and the statutes were too vague in dealing with guide-lines and standards to be set up for licensing procedures. He indicated that theattorney general would work with the Board, help in drafting new legislation andwork for changes in the Medical Practice Act when deemed necessary.

Ns. Arrowood presented a memorandum regarding potential problems in the MedicalPractice Act and some possible solutions and ideas for changing any questionablerules and regulations. Some of the problem areas discussed involved composition oflicensing board membership; delegation of authority by the legislature to theboard regarding accreditation of education of applicants; vague terms such as "goodmoral character", "immoral or dishonorable conduct", and'hnprofessional conduct";citizenship requirements; regulations regarding para-professional groups such asassistants to physicians, registered nurses performing medical acts and emergencymedical personnel. (Copy of this memorandum filed in Board~s office. )

The Board thanked Dr. Baughcum, Ms. Arrowood and Mr. Silverstein for appearing anddiscussing these problems with them, and their suggestions and advice in dealing withthese situations.
