Extreme market volatility has continued despite decisive action locally and globally to stabilise the impact of the credit crunch on financial markets.
Panic selling and price instability has made the last few months extremely difficult for investors.
Domestically, the RBA has taken dramatic steps to support the Australian economy by cutting official interest rates by 3% over the last four months, much of which has been passed on to homeowners.
While it is disconcerting to experience the rollercoaster ups and downs of volatile markets, it’s important to keep the performance of your pension in context. The four years ending 30 June 2007 delivered
bumper performance to Australian investors and super funds — so much so, that we are now used to high double-digit returns. Faced with the shock of negative performance, it’s natural to be disappointed.
The key for sound investing is to understand that negative years are a completely normal part of the investment cycle, even if the current performance is worse than we have been used to in recent years.
Remember, investing your super is a constant trade-off between risk and return. It’s important not to lose perspective and make knee-jerk decisions about your long-term finances, even in retirement.

Negative returns mean that pension accounts invested in our Balanced or Equity Plus investment options have decreased in value this year, instead of growing.
This will have implications on your regular pension payments, because a lower total balance means that your minimum payment limit (and maximum payment limit if you have one) will change.
These limits change regularly because you are drawing down on your pension capital by taking regular payments. The change in your pension payment limit may, however, be more noticeable now than it has been previously and the new limits will mean that your pension payments will be smaller than they would be if your investment options had recorded a positive return.
The personal information that TransPension collects is used to administer and correspond with you in relation to your super account, process your application and request, pay your benefits under TransPension and conduct research about how to improve our services and products.

If salary sacrifice is so good, why doesn’t everyone do it?• For a start, not all employers offer salary sacrifice to
their employees. You should ask your pay office whether salary sacrifice is available and for more details.
• Also, the tax treatment of before-tax and after-tax contributions is different so, in some cases, making before-tax contributions may not suit your investment or taxation strategy. You should seek professional advice.
• The amount and effective rate of super contributions that your employer must make on your behalf (including the required SG amount) may fall after a salary sacrifice unless your employer agrees (through your employment contract), or because the award requires, that contributions are to be made at the pre-salary sacrifice amount. This reduction may occur because the amount of your pay on which super contributions are calculated falls.
So, it is important to confirm that your employer will continue to make super contributions for you based on your pre-salary sacrifice earnings.
• Other benefits that are linked to the amount of your salary (such as annual and long-service leave entitlements) may also be reduced as a result of a salary sacrifice arrangement.
• You should also note that law requires that any contributions you make, whether before-tax or after-tax personal contributions, are preserved, meaning that you cannot generally take these contributions as cash until you reach your preservation age (currently age 55) and permanently retire.
Is there a limit on how much I can salary sacrifice?Yes. The Government imposes a number of restrictions on superannuation contributions. The Government has imposed an annual cap of $50,000 on ‘concessional’ contributions. These include:
• contributions paid by an employer on your behalf;
• salary sacrifice contributions (treated as employer contributions); and
• contributions you make when you are self-employed (or substantially self-employed), for which you have claimed a tax deduction.
Any concessional contributions over the $50,000 cap will be taxed at the highest marginal rate plus Medicare levy. Any amount in excess of the cap will also count towards the separate cap on non-concessional contributions. A transitional concessional cap of $100,000 applies to members aged 50 and older until 30 June 2012.
Note that there may be other limits on how much of your pay can be salary sacrificed (eg award minimum pay rates).

What are my options for making personal contributions?After-tax contributions (Non-concessional contributions)All Transuper members can make contributions from after-tax salary as either a regular deduction from your net pay, as a direct debit from your bank account, by cheque or Bpay®.
Before-tax (salary sacrifice) contributions (Concessional contributions)If your employer agrees, you may be able to make contributions from your before-tax salary. This is also known as making salary sacrifice contributions. Salary sacrifice contributions must be pre-arranged through your pay office as a deduction from your gross (before-tax) pay.
You should contact your pay office to confirm whether salary sacrifice is available and for further details.
Salary sacrifice contributions can increase your take-home pay!The following example assumes an annual income of $48,000 based on 2007/2008 tax rates. Let’s say you are already contributing $200 a month to Transuper from your after-tax pay and you want to know what would happen if you switch to before-tax contributions.
Let’s assume your gross monthly pay is $4,000 and your marginal tax rate is 31.5% (including 1.5% Medicare levy).
As the following example shows, by switching from after-tax to before-tax contributions, you can increase your monthly take-home pay by $63.
How does take-home pay change?
Salary sacrifice can be a tax-effective way of investing more money in your super.What are the key tax differences?
15% super tax versus up to 46.5% income tax!Salary sacrificing means you forego part of your salary in exchange for your employer making additional super contributions on your behalf.
You pay no income tax on these contributions because they are deducted from your gross pay. But you do pay contributions tax of 15% (deducted from your Transuper account).
For most people, 15% contributions tax is a more generous alternative than income tax, which is usually somewhere between 31.5% and 46.5% (including the Medicare levy). Note that you may also need to take into account the tax payable (if any) when you withdraw your super.
Why we need your Tax File Number (TFN)Under the Superannuation Industry (Supervision) Act 1993, your superannuation fund is authorised to collect your TFN, which will only be used for lawful purposes.
These purposes may change in the future as a result of legislative change. The trustee of your superannuation fund may disclose your TFN to another superannuation provider, when your benefits are being transferred, unless you request the trustee of your superannuation fund in writing that your TFN not be disclosed to any other superannuation provider.
It is not an offence not to quote your TFN. However giving your TFN to your superannuation fund will have the following advantages (which may not otherwise apply):
• your superannuation fund will be able to accept all types of contributions to your account/s;
• the tax on contributions to your superannuation account/s will not increase;
• other than the tax that may ordinarily apply, no additional tax will be deducted when you start drawing down your superannuation benefits; and
• it will make it much easier to trace different superannuation accounts in your name so that you receive all your superannuation benefits when you retire.Calculate the difference online!

General Conditions1. Meaning of Expressions - unless inconsistent with the context, the following definitions apply to this Engagement which includes any attachments.
1.1 “Act is the Estate Agents Act 1980 (as amended).
1.2 “Agent” includes any licensed agent or any agent’s representative employed by the Agent.
1.3 “Engagement” includes “agreement” and/or “authority” and the words “appoint” and/or “appointed” shall have corresponding meanings in the same situations.
1.4 “Binding Offer” is an offer on the terms set out in the Particulars of Engagementt which, if obtained in compliance with this Appointment,would (or does) result in a contract enforceable against the Purchaser.
1.5 “Introduced to the Property” means that the person was made aware that the Property was available to purchase irrespective fromwhatever source. Without limiting the foregoing a person shall be deemed to have been introduced to the Property by the Agent if theperson became aware that the Property was available for purchase as a result of viewing, hearing or reading any advertisements ofwhatever nature or medium or any boards, placards, or other literature referring to the availability of the Property that were connected tothe Agents in any way.
1.6 “Person” includes a corporation, institution, unincorporated body, incorporated association and any group of persons and/or any agent orassociate of a person or any person appointed by the original person to take the place of the original person.
1.7 “Price” means the Price at which the Vendor signs a Contract of Sale to sell the Property
1.8 “Professional Fees” are the total of the “Agent’s Commission” and the “Marketing Expenses” (as duly authorised and expended).
1.9 “Property” means “Real Estate” as defined in Section 4 of the Act.
1.10 “Purchaser” means the person to whom the Property is sold.
1.11 “Sale” is the result of obtaining a Binding Offer and “sell” and “sold” have corresponding meanings in the same situations.
1.12 “Professional Fees” are the total of the “Agent’s Commission” and the “Marketing Expenses” (as duly authorised and expended).
1.13 “Property” means the “Real Estate” as defined in Section 4 of the Act.
1.14 “Purchaser” means the person to whom the Property is sold.
1.15 “Sale” is the result of obtaining a Binding Offer and “sell” and “sold” have corresponding meanings in the same situations.
1.16 “Taxes” (define)
2. 2.1 The Agent is irrevocably authorised to deduct from any deposit monies received all Professional Fees properly incurred by the Agent andany State or Federal Taxes required to be deducted by law, including (but not limited to) any goods and services tax or otherconsumption tax. This authorisation may only be modified with the written consent of the Agent.
2.2. If the Property is sold and no deposit is received by the Agent the Vendor will pay the Professional Fees on demand including any Stateor Federal Taxes, including (but not limited to) any goods and services tax or other consumption tax.
2.3. Marketing Expenses will be payable to the Agent upon demand. Upon the conclusion of this Agreement, the Agent will provide the Vendorwith an itemised list of the Marketing Expenses and Taxes expended or payable.
2.4. If this Authority requires the Vendor to pay reimburse or contribute to an amount paid or payable by the Agent in respect of an acquisitionfrom a third party to which the Agent is entitled to an input tax credit (as defined in the GST legislation) the amount for paymentreimbursement or contribution will be the GST exclusive value of the acquisition by the Agent plus the GST payable in respect of thatsupply but only if the Agent’s recovery from the Vendor is a taxable supply under the GST legislation.
4. Agent’s Entitlement to CommissionAgent’s Fees will be payable by the Vendor upon the Sale of the Property by the Agent or where the Agent is the effective cause of the sale bythe Vendor to the Purchaser (but not if another agent holds an exclusive engagement at the time of the Sale and that authority provides that theVendor is liable to pay Professional Fees).
5. The Estimated Selling Price is given in accordance with Section 47A of the Estate Agents Act 1980 and is the amount the Agent or the Agent’sRepresentative believes, on the basis of his or her experience, skills and knowledge, that a willing but not anxious buyer would pay for the realestate. If a price range is give, it is the range within which the amount is likely to fall. The Estimated Selling Price is an estimate only and is not avaluation. If a price range is given, the difference between the upper and lower limits of the range must not exceed 10% of the amount of thelower limit of the range. Nothing in the Act requires the Agent’s Estimated Selling Price and the Vendor’s reserve or asking price to be the sameamount. Penalties apply to an Agent or Agent’s Representative making false representations as to their estimate of the selling price.
6. Making of ComplaintsAny complaint relating to commission or outgoings can be made to the Director of Consumer Affairs Victoria (CAV), Level 3/452 Flinders Street,Melbourne, Victoria, 3000. Telephone (030 9627 6051.
5. If this Appointment is made by a mortgagee for an auction which is cancelled
5.1 Within fourteen (14) days from the date of this Appointment the Vendor will pay the Agent the total of the Marketing expenses and onequarter (1/4) of the Agent’s Fees payable on:
5.1.1 any price set out, or
5.1.2 the amount owing to the Vendor under the mortgage whichever is the higher sum.
5.2 after fourteen (14) days from the date of this Appointment but on or before the Auction Date the Vendor will pay the Agent the total of theMarketing Expenses plus the Agent’s Fees calculated in the manner referred to in sub-clause 5.1
6. At the request of the Vendor, the Agent may sign on behalf of the Vendor, a Contract of Sale which contains the terms of sale agreed to by the Vendor.
Exclusive Engagement
7.1 “Continuing Engagement Period” means the stated number of days (if any) listed as the Continuing Engagement Period in the Particulars ofAppointment which period commences immediately upon the expiry of the Exclusive Authority Period.
7.2 “Exclusive Authority Period” means the stated number of days listed as the Exclusive Engagement Period in the Particulars of Appointmentcommencing from the Auction Date.
7.3 The Vendor reserves the right to refuse any Binding Offer made between the date of this Engagement and the date of the auction by any personto purchase the Property and the Vendor will not be liable for the Agent’s Fees if the Vendor refuses the offer between those dates even if theAgent may have “sold” the Property within the definition of that word.

Agent’s Entitlement to Commission.Agent’s Fees will be payable by the Vendor upon the Sale of the Property by the Agent or where the Agent is the effective cause ofthe sale by the Vendor to the Purchaser (but not if another agent holds an exclusive authority at the time of the Sale and that authorityprovides that the Vendor is liable to pay Professional Fees).
SCHEDULE B - Exclusive Sale and Exclusive Auction Engagements

Agent’s Entitlement to Commission.1. The Agent will endeavour to sell the Property in consideration for which the Vendor agrees to pay the Agent the Agent’s
Commission on the terms of this Authority if the Property is sold.(i) during the Exclusive Authority Period by the Agent or by any other person (including the Vendor or another Agent) for the
Price and upon the above conditions; or(ii) during the Continuing Authority period by the Agent; or(iii) to a person introduced to the property by the Agent before the Vendor signed this appointment; or(iv) within 120 days after the expiration of the Exclusive Authority Period for the Price to a person introduced to the property by
the Agent within the Exclusive Authority Period and to whom, as a result of the introduction, the Property is sold.
Items 1 (ii), (iii) and (iv) shall not apply where the Vendor has incurred a liability to pay Agent’s Commission under any ExclusiveAgency agreement signed by the Vendor with another Agent after the expiration of the Exclusive Authority Period.
Continuing Authority Period.If the property is not sold during the Exclusive Authority Period and a Continuing Authority Period is stated in the Particulars ofAppointment then the Vendor appoints the Agent to sell the property on a Non-Exclusive Agency basis for the period stated in theContinuing Authority Period.
The Vendor may terminate or delete the Continuing Authority Period at any time by written Notice to the Agent. Agents Entitlement to Commission is still applicable to this Authority even if the Continuing Authority Period does not apply or ceases.
In consideration of the Agent agreeing to endeavour to sell the property the Vendor will pay the Agent the Agent’s Commission if theProperty is sold by the Agent for the Price at any time during the Continuing Authority Period except where the Vendor has incurred aliability to pay the Agent’s Commission under any Exclusive Agency agreement signed by the Vendor with another Agent after theexpiration of the Exclusive Authority Period shown in this Authority.
If no Continuing Authority Period is stated in the Particulars of Appointment the Authority lapses (subject to Item 1 (ii), (iii) and (iv)above) at the expiration of the Exclusive Authority Period shown in this Authority.
SCHEDULE C - EXCLUSIVE AUCTION ENGAGEMENTS

RulesThe Vendor agrees the only rules that will apply to the conduct of the auction shall be the Rules set out in Schedule 1 of the Sale ofLand Regulations 2004, or any rules prescribed by regulation which modify or replace those Rules.
Vendor or Dummy BiddingThe vendor acknowledges being made aware by the Agent that it is an offence under the Sale of Land Act 1962 for the Agent or the Vendor, or any other person on behalf of the Vendor, to engage in undisclosed vendor bidding or to procure the services of a dummy bidder.
The Vendor acknowledges the Vendor’s obligations relating to dummy bidding and will not breach these obligations.
Authority PeriodSection 54(1) of the Estate Agents Act 1980 provides that:
If an agreement stating that an estate agent is to act as the sole agent for the sale of any real estate or business does not state whenthe sole agency is to end, the sole agency ends:(a) in the case of a sale by auction, 30 days after the date of the auction.(b) In any other case, 60 days after the date the agreement is signed by, or on behalf of, the seller of the real estate or business.
