At 4:00 p.m., Deputy Speaker Giorgidi B. Ag-

gabao called the session to order.

NATIONAL ANTHEM AND PRAYER

Pursuant to Section 73, Rule XI of the Rules of the

House, the Members sang the National Anthem, and

thereafter Representative Abigail Faye C. Ferriol de-

livered the invocation.

DEFERMENT OF ROLL CALL

AND APPROVAL OF THE JOURNAL

On motion of Rep. Joseph “Ace” H. Durano, there

being no objection, the Body deferred the calling of

the Roll and the approval of the Journal of the previous

session.

On motion of Rep. Durano, there being no objec-

Whereupon, on motion of Rep. Gonzales, there

being no objection, the Chair submitted to a vote the

Conference Committee Report on the disagreeing

votes on House Bill No. 4968, entitled: “AN ACT AP-

PROPRIATING FUNDS FOR THE OPERATION OF

ON HOUSE BILL NO. 5237

On motion of Rep. Gonzales, there being no ob-

jection, the Body resumed consideration on Second

Reading of House Bill No. 5237, as embodied in Com-

mittee Report No. 513 and reported out by the Com-

mittee on Appropriations.

Upon direction of the Chair, the Secretary General

read the title of the Bill, to wit:

“AN ACT APPROPRIATING THE SUM OF

TWENTY-TWO BILLION FOUR HUN-

DRED SIXTY-SEVEN MILLION SIX

HUNDRED EIGHT THOUSAND PESOS

(P22,467,608,000) AS SUPPLEMENTAL

APPROPRIATIONS FOR FY 2014 AND

FOR OTHER PURPOSES.”

MANIFESTATION OF REP. OCAMPO

At this point, Rep. Rosenda Ann Ocampo sought

recognition from the Chair and manifested her desire

to rise on a question of personal and collective privi-

lege.

REMARKS OF REP. GONZALES

With the permission of the Chair, Rep. Gonzales

appealed to Rep. Ocampo to hold in abeyance her

question of privilege after the Body has finished its

consideration of House Bill No. 5237.

Rep. Gonzales thereupon stated that the parlia-

mentary status was that the Body had terminated the

period of amendments on House Bill No. 5237.

APPROVAL ON SECOND READING

On motion of Rep. Gonzales, there being no ob-

jection, the Body approved on Second Reading,

through viva voce voting, House Bill No. 5237, as

amended.

APPROVAL ON THIRD READING

OF HOUSE BILL NO. 5237

On further motion of Rep. Gonzales, there being

no objection, the Body approved on Third Reading

House Bill No. 5237, a certified urgent measure, pur-

suant to Section 26(2), Article VI of the Constitution.

Upon direction of the Chair, the Secretary General

read the title of the Bill, to wit:

“AN ACT APPROPRIATING THE SUM OF

TWENTY-TWO BILLION FOUR HUN-

DRED SIXTY-SEVEN MILLION SIX

HUNDRED EIGHT THOUSAND PESOS

The Chair then directed the Secretary General to

call the Roll for nominal voting. Thereafter, pursuant

to the Rules of the House, a second Roll Call was

made.

MANIFESTATION OF REP. BAGATSING

At this juncture, Rep. Amado S. Bagatsing sought

recognition from the Chair. The Chair however re-

quested that the result of the voting be announced first

before he recognizes Rep. Bagatsing.

Rep. Bagatsing said that before the announcement

of the result, he would like to ask how his vote was

recorded, to which the Chair replied that the Secretar-

iat has not yet recorded his vote.

With 183 affirmative votes, 12 negative votes and

no abstentions, the Body approved on Third Reading

House Bill No. 5237.

EXPLANATIONS OF VOTE

The following Members explained their votes:

1. Recognized by the Chair, Rep. Bagatsing

voted “yes” to House Bill No. 5237. He how-

ever pointed out that in the recently approved

conference committee report on the proposed

2015 General Appropriations Act (GAA),

only P50 billion, and not P87 billion, of the

country’s P2.6 trillion budget for 2015 was al-

located for health services because the P37

billion allotted for PhilHealth will be funded

by the proceeds from sin taxes.

At this juncture, Deputy Speaker Aggabao relin-

quished the Chair to Deputy Speaker Sergio A.F.

Apostol.

Although the Constitution mandates that the

Department of Education (DepEd) should be

accorded with the highest budget allocation,

he opined that the Department of Health

(DOH) should receive the second biggest

budget allocation. He lamented that the sup-

plemental budget did not have allocation for

health services and expressed hope that in the

future, the House leadership would take cog-

nizance of the plight of the health of the poor,

especially those in the rural areas.

PARLIAMENTARY INQUIRY

OF REP. ATIENZA

To the initial query of Rep. Jose L. Atienza Jr., the

Chair replied that 183 Members voted in favor of

House Bill No. 5237 or the proposed supplemental

budget for 2014; 12 against; and no abstention.

Considering that there were 198 Members who re-

sponded to the Roll Call and only 195 Members voted

on the Bill, Rep. Atienza asked whether the three

Members who were not able to vote have already left

the floor. The Chair replied that only 195 votes were

recorded because three of the Members did not vote.

On whether the three lost votes were considered

votes of abstention, the Chair replied that those who

did not register their votes were not considered as ab-

stentions.

Rep. Atienza said that he would like to further dis-

cuss the matter in the new set of House Rules so that

the voting procedure would be clear.

EXPLANATIONS OF VOTE

2. Rep. Luzviminda C. Ilagan voted “no” to the

supplemental budget for the same reason that

she voted “no” to the 2015 General Appropri-

ations Act last October which was on the

ground that the present Administration was

using the misery of the poor to invent various

projects to accumulate funds that would any-

way perpetuate pork barrel and patronage pol-

itics.

She stated that with the substantial amount of

funds that had been made available for the ca-

lamity victims, the government agencies can

only provide 1,595 of housing units out of the

required 205,000 and about 20 percent to 30

percent accomplishment for the resettlement

program of the victims.

Rep. Ilagan stressed that her “no” vote is cor-

roborated by the “double appropriations” in

the 2015 National Budget and in the 2014 sup-

plemental budget for the rehabilitation of

MRT-3 and LRT Lines 1 and 2; the DENR’s

National Greening Program; the Bureau of

Treasury’s Single Account; the BFP’s pro-

curement of fire trucks; and the P2.8 billion

appropriations for the PNP Operational Trans-

formation Plan. She likewise expressed the

opinion that the supplemental budget comple-

ments a crime – the financing of projects that

had been previously funded by the DAP and

PDAF that had been declared unconstitutional

by the Supreme Court – and are thus deemed

outside of the doctrine of operative fact.

3. Rep. Fernando “Ka Pando” L. Hicap, in ex-

plaining his “no” vote, maintained that House

Bill No. 5237 is essentially a “supplemental

pork for the coming elections” that will not re-

sult to greater good considering the failure of

the government to take full account of the dis-

bursement of appropriations for the victims of

Yolanda and the numerous other natural ca-

lamities and to provide for the rehabilitation

and reconstruction programs to help the vic-

tims.

4. Rep. Terry L. Ridon voted against the Bill as

he claimed that the supplemental budget con-

stitutes “double helpings of pork barrel funds”

resulting to criminal waste of public funds, the

use of hidden supplemental budget for the

coming presidential elections, and the legali-

zation of savings under the DAP which the

Supreme Court had declared as unconstitu-

tional. He further pointed out that the approval

of the supplemental budget is illegal and

highly irregular inasmuch as Congress does

not have any authority to consider and ap-

prove two appropriations measures in a single

day.

At this juncture, Deputy Speaker Apostol relin-

quished the Chair to Deputy Speaker Aggabao.

5. Rep. Jonathan A. Dela Cruz substantiated the

basis of his “no” vote on the failure of the

Committee on Appropriations to further clar-

ify and provide a clear basis for the specific

projects and programs and amendments

thereon, specifically the PNP Operational

Transformation Plan, the supplemental

budget for the victims of typhoon Yolanda and

other victims of natural calamities, the MRT-

3 rehabilitation and capacity extension fund

and the updating of the National Household

Targeting System for Poverty Reduction that

had already been provided appropriations in

the 2013 and 2014 GAA.

TRANSMITTAL TO THE SENATE

OF HOUSE BILL NO. 5237

Thereupon, on motion of Rep. Jorge “Bolet” Ba-

nal, there being no objection, the Chair directed the

Secretary General to immediately transmit to the Sen-

ate a copy of House Bill No. 5237 that had been ap-

proved on Third Reading.

Rep. Banal subsequently moved for the recogni-

tion of Rep. Rosenda Ann Ocampo on a question of

personal and collective privilege.

REMARKS OF THE CHAIR

Before acting on the motion, the Chair however

informed the Body of certain important revisions

which were included in the recently approved Rules of

the House of Representatives for the 16th Congress, to

wit: the suspension of privilege speeches five days be-

fore the adjournment of session; and questions of per-

sonal and collective privilege taking higher prece-

dence over all other motions that can be availed of af-

ter important legislative matters had been disposed of

by the Body. He cited as example House Bill No. 5237

which is a certified urgent measure.

Thereupon, the Chair recognized Rep. Ocampo on

a question of personal and collective privilege.

QUESTION OF PRIVILEGE

OF REP. OCAMPO

Rep. Ocampo informed the Body of her advocacy

to promote government employees’ welfare and bene-

fits, in particular, how this had been affected under the

2015 General Appropriations Act by the provision

therein, legislating a decrease in the minimum net

take-home pay of a government employee to P3,000

monthly in contravention of the collective will of the

Members to provide benefits to government employ-

ees and the President’s budget proposal for a P4,000

net take-home pay.

She explained that the meager amount resulted

from the “bartering” by Members of the Senate with

certain vested interests during the Conference Com-

mittee deliberations. She lamented how the House

conferees had failed to defend the position of the

House and the welfare of civil servants. She also ques-

tioned Senator Francis Escudero for contesting the in-

crease in the workers’ net mimum take-home pay by

maintaining the level of P3,000 monthly.

Rep. Ocampo said she agreed with the request of

the Speaker and the Majority Leader to call for a vot-

ing on the ratification of the conference committee re-

port on the 2015 national budget to unite the leader-

ship. She however urged the chair of the Committee

on Appropriations to call for an investigation on the

malpractice of automatic payroll deduction for loans

incurred by government employees from private lend-

ers. She hoped to get the support and commitment of

the leadership to change the situation of the govern-

ment employees whose salaries had remained the

same despite the four-step increases provided for un-

der the latest Salary Standardization Law.
