PUBLIC Procurement Appeals Authority (PPAA) has ruled that Medical Stores Department (MSD) was right when it rejected a bid whose owner was now challenging the entity’s decision to disqualify them on the grounds that they did not meet tender requirements, TPJ has learnt.

PRIME Minister Kassim Majaliwa has suspended three senior officials of Tanzania Building Agency (TBA), over claims that they were incompetent and has called into question the conduct of its executive director, Architect Daudi Kondoro, TPJ has learnt.

Mr. Majaliwa’s decision came after he inspected construction of the National Electoral Commission (NEC) building at Njedengwa area in the capital amid reports of widespread disquiet in the country over the agency’s performance in various projects in recent times.

“TBA should not be given any more projects to implement because it is not performing and its officials think because it is a public institution it will be left alone,” he said.

A statement issued by the Prime Minister’s Office mentioned the suspended officials as Acting

Director Building Department, Arch. Humphrey Killo, Acting Project Manager, Abdallah Awadh and Acting Director for Consultancy, Arch. Hamis Kileo.

Apparently, the proceedings show, while he considered it illogical that such a large framework contract did not allow joint ventures and consortiums, the act of bidding as a consortium –never mind the care they took to attach two anti-bribery forms and two bid-securing declarations to match the number of companies in the consortium - was deemed by the entity as being contrary to the tender requirements.

The appellant also claimed that MSD did not read out prices of the bids during opening ceremony of the tenders contrary to the tender document, but the entity countered this by stating that all bidders agreed during the tender opening ceremony that prices and items should not be read out as there were many bids.

Other allegations of the appellant centred on the unworthiness or shortcomings of the proposed winners, including that one was a disreputable manufacturer known for making fake and sub-

standard drugs and that they had been implicated in supplying counterfeit products in India and Ghana; that others had annual sales volumes which were not five times the estimated contract value or more, as demanded by the tender document; and that another proposed winner had not quoted the Duty Delivery Paid (DDP), contrary to the instruction to tenderers meaning, they ought to have been disqualified.

On its part, MSD did not address all grievances but stated that the evaluation process was done in accordance with the Public Procurement Act and applicable regulations and that the appellant was disqualified fairly as they did not comply with the tender requirements which spelt clearly that joint ventures, consortium or associations, were not eligible.

In determining the grounds of the appeal, PPAA foremost observed that the tender advert had invited tenders from manufacturers of pharmaceuticals and medical supplies and that the appellant was not a manufacturer but an agent of a manufacturer, which was sufficient to render them ineligible to bid.

Moreover, the Appeals Authority observed that the appellant submitted their bid as a consortium, which was counter to requirements and therefore rendering them ineligible.

Consequently, the Appeals Authority dismissed the appeal and ordered each party to bear its own costs.

taasisi nunuzi za Umma kuweka katika makabrasha ya zabuni za kumtafuta mtaalamu mshauri (Request for Proposal), kigezo cha uwepo wa wataalamu wa kitanzania katika orodha ya wataalamu inayowasilishwa na kampuni inayoleta maombi ya zabuni. Kigezo hiki ambacho hutumika katika uchambuzi wa mapendekezo ya kiufundi (Technical proposal evaluation) huwa kina alama kumi, na kampuni ambayo itathibitisha kuwa zaidi ya 60% ya wataalamu wake ni Watanzania, hupata alama zote. Hii inamaanisha kuwa ili kampuni inayoshiriki katika zabuni ya kumtafuta mtaalamu mshauri iweze kupata alama nyingi katika kigezo hiki, ambazo baadae huchangia katika alama za jumla, ni lazima kampuni ijumuishe katika orodha ya wataalamu wake, wataalamu wa kitanzania kadiri inavyowezekana. Matakwa haya ya sheria yanatoa fursa zaidi kwa wataalamu wengi wa kitanzania kupata ajira katika kampuni (Consultancy firms).

Kanuni ya 35 ya Kanuni za ununuzi wa Umma (2013) inaelekeza taasisi

nunuzi kuhakikisha ushiriki wa kampuni za kitanzania katika mchakato wa zabuni za kutafuta wataalamu washauri unaokusudiwa kufanywa na kampuni za nje ya nchi. Katika kutekeleza hilo PPRA imeweka kigezo cha ushiriki wa kampuni za ndani katika ushirika wa kibiashara (joint venture, association au consortium). Kigezo hiki, ambacho hutumika katika uchambuzi wa mapendekezo ya kiufundi, kina alama 15 na mwombaji ambaye atathibitisha kuwa ushiriki wa kampuni za ndani katika joint venture unafikia walau 15%, hupata alama zote 15, ambazo huchangia katika alama za jumla zinazoamua washindi. Kwa mantiki hii, ushirika wowote unaokusudiwa kuundwa kwa ajili ya kushindania zabuni za utaalamu ushauri, ni lazima zihakikishe kuwa kampuni nyingi zinazounda ushirika kadiri inavyowezekana ni za ndani. Msimamo huu wa sheria na Kanuni za ununuzi wa umma unajenga mazingira wezeshi kwa kampuni za utaalamu ushauri hususan zile ndogo zilizomo ndani ya nchi kuunda ushirika utakaoziwezesha kushiriki zabuni za umma.

HitimishoSheria ya ununuzi wa umma ina

mchango mkubwa katika kujenga uchumi wa taifa. Aidha, sheria imejikita

kuhakikisha kuwa inayainua kiuchumi makundi maalum katika jamii kupitia fursa ya ununuzi wa umma. Makundi haya ni pamoja na wajasiriamali wadogo/kati, akina mama vijana na hata walemavu, Sheria imetoa fursa kwa makundi haya kushiki zabuni za umma kupitia skimu mbalimbali kama vile kupunguza gharama za kushiriki zabuni za umma kwa kuondoa mahitaji ya dhamana za zabuni, fursa ya kuunda ushirika wa kibiashara, zabuni za makundi maalum, ushirikishwaji wa jamii katika ununuzi wa umma, zabuni za upendeleo kimkoa na utaratibu wakuigawa zabuni ili kuwezesha ushiriki wa makampuni madogo ya ndani. Fursazote hizi zipo kwa mujibu wa sheria lakini hata hivyo bado makundi lengwa hayajaweza kufaidika kutokana na uelewa mdogo wa sheria ya Ununuzi wa Umma na kanuni zake miongoni mwa wadau wa sekta ya ununuzi wa umma ila jukumu limebaki kwa wadau ambao ni wafanyabiashara na wajasiriamali kwa upande mmoja na taasisi nunuzi kwa upande wa pili, kila mmoja kutimiza wajibu wake. Yatosha kusema kuwa taasisi nunuzi zinalo jukumu kubwa la kutoa fursa hizi hizi kwa mujibu wa sheria. Aidha, PPRA na Baraza la Taifa la Uwezeshaji, bado wanalo jukumu la kutoa mafunzo ili kufanikisha azma ya Serikali.

Sheria ya ununuzi wa umma inasisitiza usawa, haki, uwazi na uwajibikaji katika zabuni za umma. Hata hivyo, sheria hiyo imejikita pia kuyainua kiuchumi makundi maalum ya kijamii kupitia fursa za ununuzi wa umma. Aidha, kwa kutambua umuhimu wa kuyainua makundi maalum katika jamii kama vile wafanyabiashara wadogo/wa kati, vijana akina mama n.k, Serikali imeweka mazingira wezeshi kupitia sheria ya ununuzi ili makundi haya yaweze kushiriki katika zabuni za umma kama njia ya kuyainua kiuchumi.

Makala hii itajikita katika kubainisha maeneo muhimu katika sheria ya ununuzi ambayo yanajenga mazingira wezeshi kwa makundi maalum ya kijamii katika kushiriki zabuni za Umma nchini kama ifuatavyo:-

A. Fursa ya kutumia Kiapo cha Dhamana ya Zabuni badala ya Dhamana ya Zabuni

Mojawapo ya masharti katika kushiriki zabuni za umma ni pamoja na mwombaji kuambatisha pamoja na maombi yake ya zabuni dhamana ya zabuni (bid security) kwa mujibu wa kifungu cha 23 cha Sheria ya Ununuzi wa Umma. Madhumuni ya dhamana ya zabuni ni kuwezesha ufanisi katika mchakato wazabuni kama vile mwombaji wa zabuni kutoondoa zabuni yake kabla au baada ya zabuni kufunguliwa, kutokataa masahihisho ya kitarakimu katika zabuni yake, kutokataa kusaini mkataba wa ununuzi pindi anapotunukiwa au kukataa kutoa dhamana ya utekelezaji wa mkataba.Hitaji hili muhimu katika maombi ya zabuni linabainishwa katika sehemu ya maelekezo kwa wazabuni katika nyaraka sanifu za zabuni kwa ajili ya kazi za ujenzi. Hata hivyo hitaji la dhamana ya zabuni kama sharti la kushiriki zabuni za umma lilikuwa kikwazo kikubwa kwa wafanyabiashara wadogo na wa kati katika kushiriki zabuni za umma. Hali hii inatokana na ukweli kuwa wajasiriamali wengi wadogo na wa kati wanakabiliwa na tatizo kubwa la mitaji sanjari na rasilmali zitakazowawezesha kudhaminiwa na taasisi za fedha. Kwa sababu hii sheria inaelekeza matumizi ya kiapo cha dhamana ya zabuni (bid securing declaration) kwa zabuni zote ambazo kutokana na thamani yake zimetengwa kwa ajili ya wakandarasi wa ndani pekee (exclusive preference). Kwa mujibu wa sheria mwombaji wa zabuni zilizoko katika kundi hili hutakiwa kuambatisha katika zabuni yake kiapo/tamko la dhamana ya zabuni (tender securing declaration)

badala ya dhamana ya zabuni. Fursa hii inawawezesha wafanyabiashara wengi wadogo na wakati kushiriki na kushindania zabuni za umma ambazo wasingeweza kushiriki vinginevyo kutokana na gharama kubwa za dhamana za zabuni.

B. Fursa ya kugawa zabuni katika mafungu madogo ili kuwezesha ushiriki wa kampuni za ndani

Kifungu 49 cha Sheria ya Ununuzi wa Umma kinaelekeza taasisi nunuzi kuandaa mpango wa mwaka wa manunuzi (Annual Procurement Plan). Mojawapo ya masuala ya kuzingatia katika maandalizi ya mpango wa ununuzi ni kuhakikisha kuwa ununuzi unaunganishwa ili kupata thamani halisi ya fedha sanjari na kupunguza gharama za miamala (transaction costs) za ununuzi. Hata hivyo, ili kujenga mazingira wezeshi ya kuweza kushiriki zabuni za umma miongoni mwa wajasiriamali wadogo, Kanuni ya 42 ya Kanuni za ununuzi wa Umma inatoa mwanya wa kuvunja zabuni katika mafungu madogo inavyowezekana kwa lengo la kuwezesha ushiriki wa kutosha wa kampuni za ndani. Sheria inaelekeza kwamba mafungu hayo kuadaliwa kulingana na uwezo wa kampuni zinazokusudiwa kufaidika na upendeleo wa fursa hiyo ya kushiriki zabuni za umma. Aidha, sheria inaitaka taasisi nunuzi kuwasilisha PPRA maelezo ya zabuni inayokusudiwa kuvunjwa na PPRA kutoa idhini ndani kipindi cha siku saba.

Hata hivyo, sheria haiko wazi iwapo PPRA inaweza kukataa kuidhinisha, wala mazingira yanayoweza kuifanya PPRA ikatae kuidhinisha uvunjaji wa zabuni.

C. Fursa ya kuunda Ubia wa Kibiashara (Joint Venture)

Ushirika wa kibiashara ni ushirika baina ya kampuni mbili au zaidi tofauti wenye lengo kuongeza uwezo sifa ili kuweza kushiriki au kushindania fursa za kibiashara ambazo kimsingi mshirika mmoja mmoja hawezi kuipata kutokana na kupungukiwa sifa za kuingia katika ushindani. Ushirika wa kibiashara ni mojawapo ya mkakati ambao umekuwa ukihimizwa na serikali kupitia taasisi mbalimbali ikiwemo Contractors Registration Board (CRB), wenye lengo la kuwainua wafanyabiashara wadogo kwa kuungana ili kuunda ubia unaowaongezea sifa za kuweza kushindania fursa mbalimbali za ununuzi wa umma. Aidha, PPRA, kwa kuzingatia umuhimu wa kuwainua wafanyabiashara wadogo, imetoa mwanya kwa wafanyabiashara kuunda ubia wa kibiashara baina ya wafanyabiashara wadogo ili kuwaongezea sifa za kushiriki fursa za ununuzi wa umma. PPRA, kupitia kifungu cha 3 cha Maelekezo kwa Wazabuni katika nyaraka sanifu ya zabuni za ujenzi, ambayo inatoa fursa ya

joint venture kushiriki zabuni za umma kupitia aina mbalimbali za ushirika kama vile joint venture, consortium au association.

Licha ya ukweli kuwa joint venture inawawezesha washirika kupata fursa ambayo wasingeipata vinginevyo, mahusiano haya ya kibiashara yanaambatana na changamoto kadhaa, kubwa ikiwa ni washirika katika joint venture kuwajibika kwa pamoja kwa mazuri na mabaya.

Iwapo kuna madhara katika utekelezaji wa mradi, kila upande wowote wa joint venture unawajibika kwa asilimia mia bila kuangalia ni upande upi umechangia madhara hayo. Aidha, kanuni ya 9 ya Kanuni za ununuzi wa Umma, nayo inatoa fursa ya kuunda joint venture baina ya wafanyabiashara, kwa lengo la kupata uwezo na sifa za kushindania fursa za ununuzi wa umma kupitia zabuni.

D. Fursa ya kuunda na kusajili Makundi Maalum (Special groups)

Kanuni ya 12 ya marekebisho ya kanuni za ununuzi wa umma 2016 imeongeza katika orodha ya makundi yanayostahili kupewa upendeleo katika zabuni za umma (Exclusive preference) kundi la makundi maalum (special groups). Makundi haya maalum yanahitajika kusajiliwa na taasisi ambazo zinahusika nayo moja kwa moja (special group supporting entity) ambazo kwa mujibu wa kanuni hizi ni wizara, wakala wa serikali mashirika ya umma, idara zinazohusika na uwezeshaji wa wanawake, vijana, wazee na walemavu. Baada ya kusajiliwa kwa makundi haya, usajili wake unatakiwa kupelekwa PPRA kwa ajili ya kuingizwa kwenye rejista ya mamlaka.Aidha, kanuni hizi zimepinga taasisi nunuzi kutoa zabuni za upendeleo kwa kundi maalum ambalo halijasajiliwa katika rejesta hiyo.

Kanuni ya 30c ya marekebisho ya kanuni za ununuzi wa umma zinaitaka kila taasisi nunuzi kutenga 30% manunuzi yake ya mwaka kwa ajili ya upendeleo kwa makundi maalum yaliyosaliwa na yaliyo katika maeneo yao ya utawala. Taasisi itakayoshindwa kufanya hivyo itatakiwa kutoa sababu na wakuu wa taasisi hizo wanaweza kuchukuliwa hatua za kinidhamu iwapo hawatakuwa na sababu za kutotekeleza matakwa haya ya sheria ya ununuzi. Aidha, kanuni ya 30d ya marekebisho ya kanuni za ununuzi (2016) inaelekeza makundi maalum yatakayopewa zabuni za upendeleo yalipwe mara moja baada ya kukamilisha kazi kama njia ya kuyawezesha hasa ikizingatiwa yanakabiliwa na changamoto ya mtaji. Maelekezo haya ni ya msingi na yana lengo la kuyainua kiuchumi baadhi ya makundi katika jamii kupitia sekta ya ununuzi wa umma nchini.

E. Zabuni za Upendeleo Kimkoa (Regional Preference scheme)

Skimu ya zabuni za upendeleo kimkoa (Regional Preference scheme) chini ya kanuni 40 ya Kanuni za ununuzi wa Umma za mwaka 2013, inaelekeza kuhusu aina na thamani ya zabuni ambazo zinatakiwa kutengwa maalum kwa ajili ya wafanyabiashara waliomo ndani ya Mkoa husika mathalan kazi zote za ujenzi ambazo thamani yake haizidi billion moja na za utaalamu ushauri ambazo hazizidi 200,000,000/= zimetengwa kwa ajili ya wakandarasi/wataalamu washauri waliomo ndani ya mkoa na zinapaswa kutengwa na kutangazwa na taasisi nunuzi kwa ajili ya wakandarasi walioko ndani ya mipaka ya mkoa. Fursa hii ni nzuri kwa wafanyabiashara wadogo na wa kati katika mamlaka zao za kimkoa.Hata hivyo, fursa hii bado haijatolewa na taasisi nyingi nchini na badala yake fursa za zabuni zenye thamani hiyo zimeendelea kutangazwa chini ya utaratibu wa zabuni za ushindani kitaifa (National Competitive Bidding), hali inayotoa wigo mpana wa ushiriki wa wakandarasi wakubwa ambapo matokeo yake wakandarasi wadogo wanashindwa kuhimili ushindani.

Aidha, jambo la kusikitisha ni jinsi wakandarasi hawa wadogo wanavyoendelea kukaa kimya badala ya kudai haki yao, ambayo iko kwa mujibu wa sheria.Yote haya na mengine mengi yameendelea kutokea kutokana na uelewa mdogo wa sheria ya ununuziwa umma miongoni mwa wafanyabiashara wadogo na hata wale wa kati.

F. Fursa ya Ushirikishwaji wa Jamii katika Ununuzi (Community participation)

Chini ya Kanuni ya 168 ya Kanuni za ununuzi ya Umma (2013) (kama zilivyorekebishwa) fursa hii ya ushirikishwaji wa jamii katika ununuzi wa umma inatakiwa kutumika kwa lengo lakujenga miradi endelevu na wakati huo huo kunufaisha jamii husika na fursa za ununuzi wa umma zilizopo. Aidha, utaratibu huu wa manunuzi unasisitiza ushirikishwaji wa jamii au vikundi vya wakulima sajari na matumizi ya teknologia na vifaa kutoka ndani ya jamii husika. Sheria ya manunuzi katika kuweka mazingira wezeshi kwa jamii hizi ili ziweze kushiriki fursa za ununuzi wa umma imeelekeza taasisi nunuzi kuweka taratibu, viwango vya utoaji huduma (specification) sanjari na mafungu ya zabuni (packages) yatakayoakisi mazingira ya jamii husika. Aidha, sheria imetoa jukumu kwa PPRA kuandaa muongozo wa ushirikishwaji wa jamii katika ununuzi wa umma.

1. TANePs ni nini?TANePs ni kifupi cha “Tanzania e-Procurement System” ambao ni mfumo wa kielektroniki wa ununuzi wa umma ulioanzishwa na Serikali kwa mujibu wa Sheria ya Ununuzi wa umma ili kurahisisha michakato ya kufanya ununuzi wa umma. Mfumo huu unapatikana kupitia tovuti ya www.taneps.go.tz.

2. Mfumo wa TANePS umeanza kutumika lini?

Mfumo wa TANePS ulizinduliwa rasmi mwezi Juni, 2018 na ulitumiwa na baadhi ya taasisi nunuzi za umma kwa majaribio kwa ununuzi wa vifaa na huduma mtambuka (CUIS) mwaka wa fedha wa 2018/19. Mfumo huu umeanza kutumika rasmi kwa ununuzi wa aina zote na kwa taasisi nunuzi zote mwaka huu wa fedha wa 2019/20. Hivyo, wazabuni tarajiwa wote wanapaswa kujisajili kwenye Mfumo ili waweze kushiriki katika michakato ya ununuzi inayofanyika kwa njia ya mtandao.

3. Ni zipi faida za Kutumia Mfumo wa TANePS ?

Faida za kutumia mfumo wa TANePS ni pamoja na kuongeza wigo wa wazabuni kushiriki katika michakato ya zabuni kwa ushindani zaidi, kuongeza tija ikiwa ni pamoja na kupunguza gharama na muda wa mchakato wa zabuni, kuongeza uwazi, kupunguza rushwa n.k.

4. Nani anaweza kutumia Mfumo wa TANePS?

Makampuni yennye lengo la kufanya biashara na Serikali pamoja na Taasisi nunuzi zote ambazo zimesajiliwa kwenye mfumo wa TANePS zinaweza kutumia mfumo huu katika kufanya ununuzi au kuuza vifaa na huduma mbalimbali. Pia wananchi wote wanaweza kupata taarifa mbalimbali juu ya michakato ya ununuzi wa umma nchini.

5. Nini mahitaji ya kujisajili kwenye Mfumo kwa wazabuni tarajiwa ?

(i). Namba ya utambulisho wa mlipa kodi (TIN);

(ii). Anuani ya barua pepe (email address); (iii). Ada ya usajili ya mwaka ambayo ni Shil-

ingi 30,000/- (Elfu Thelethini) tu kwa sasa - na ambayo inaweza kufanyiwa mabadiliko.

6. Ni hatua gani za kufuata ili kujisajili kwenye Mfumo wa TANePS

(i). Nenda kwenye tovuti ya www.taneps.go.tz

(ii). Bofya sehemu iliyoandikwa ‘Register as a Supplier’ iliyopo upande wa kushoto;

(iii). Jaza namba yako ya utambulisho wa mlipa kodi (TIN), kwenye sehemu ya pili ya fomu itakayofunguka [ Ingiza namba pekee bila alama yeyote].

(iv). Bonyeza kitufe kilichoandikwa ‘Re-trieve Company Data from TRA’.

(v). Jaza taarifa zako zingine kwenye se-hemu wazi za fomu zilizobakia;

(vi). Bofya sehemu iliyoandikwa ‘Validate and Continue’;

(vii). Sajili aina za biashara zako unazozifanya kwa kutumia mwongozo wa kimataifa (The United Nations Standard Products and Services Code (UNSPSC);

(viii). Fanya usajili wa Mtumiaji Mkuu wa kampuni yako kwenye mfumo (Admin-istrator), halafu bofya kitufe kilicho-andikwa ‘Finish’.

7. Ni namna gani utaiwezesha akaunti yako kufanya kazi ?

Kuiwezesha akaunti iliyosajiliwa, fanya yafuatayo:-(i). Ingia kwenye akaunti yako kupitia se-

hemu ya “log in” iliyoko kwenye uso wa kwanza wa mfumo;

(ii). Utatakiwa kuingiza namba ya muamala (transaction code) ambayo itakuwa im-etumwa na Mfumo kwenye barua pepe yako;

(iii). Ingia kwenye mfumo wa barua pepe yako na utaona kuna barua pepe ime-tumwa toka kwenye mfumo wa TANePS ikiwa na hiyo ‘transaction code’ [na iki-wa haujaipata baruapepe, rudi kwenye Mfumo na bofya kitufe kilichoandikwa ‘Resend Confirmation Code’);

(iv). Kwenye ukurasa wa TANePS ingiza hiyo ‘transaction code’ kwenye kisanduku husika halafu bofya kitufe kilichoandik-wa ‘Submit’;

(v). Soma Makubaliano ya Matumizi ya Mfumo (User Agreement), na bofya kitufe kilichoandikwa ‘Accept’.

8. Namna gani utakamilisha usajili kwenye TANePS ?

Kukamilisha usajili, yakupasa kulipia ada ya mwaka ya shilingi 30,000/- (Elfu Thelathini tu) kwa kufuata hatua zifuatazo:-(i). Ingia kwenye akaunti yako;(ii). Upande wako wa kushoto, bofya se-

hemu iliyoandikwa ‘Supplier Adminis-tration’;

(iii). Chagua njia ya kufanya malipo kwa kubofya ‘Offline Payment’ (kwa kulipia kwa kutumia simu ya mkononi) au “Online Payment’ (kwa kulipa kwa kadi za benki);

(iv). Kama umechagua ‘Offline Payment’, chukua namba ya kulipia yaani ‘Pay-ment Control Number’ ambayo itaoneshwa inayoanza na tarakimu 99165…..;

(v). Lipia kwa kutumia huduma ya malipo kwenye simu yako kwa kuchagua “mal-ipo ya serikali” kisha ingiza “Payment Control Number “ uliyoipata kwenye Mfumo, na fuata maelekezo kutegemea-na na mtandao unaotumia yaani T-pesa, Mpesa, Tigopesa, Airtel Money, Halo-pesa n.k. Unaweza pia kulipia kupitia benki ya NMB, CRDB n.k kwa kutumia Payment Control Number toka kwenye Mfumo;

(vi). Kama umechagua ‘Online Payment’, utapelekwa kwenye ukurasa mwingine utakaokuhitaji kuchagua aina ya kadi pamoja na kujaza taarifa zake, na kufua-ta maelezo ya kulipia;

(vii). Baada ya kufanikiwa kufanya malipo, utapokea risiti kupitia barua pepe yako na hali ya akaunti itabadilika kuwa “completed”;

1. What is TANePS ?TANePS stands for Tanzania e-Procurement System. It is an online system which has been established in line with Public Procurement Laws to facilitate public procurement processes in the country. The System can be accessed at www.taneps.go.tz

2. When did TANePS become operational?

TANePS was officially launched in June 2018 and was operational as a pilot for procurement of common use items and services (CUIS) involving selected Procuring Entities (PEs) in financial year 2018/19. The System is now in full operation starting in this financial year 2019/20, and it is used for all kinds of procurement. Therefore, Suppliers, Consultants and Contractors who wish to do business with the Government are required to register in TANePS in order to be able to participate in online procurement processes.

3. What are the benefits of using TANePS ?

There are many benefits of using TANePS, which include enhancing transparency, efficiency, ceffectiveness and fairness in public procurement processes as well as mitigating corruption in the procurement sector.

4. Who can use TANePS?All Suppliers, Consultants and Contractors as well as Procuring Entoties that are registered in TANePS can use it for procurement or selling of goods and services. The general public can also obtain information on public procurement sector.

5. What are the requirements for registration in TANePS?

(i). Valid Taxpayer Identification Num-ber (TIN);

(ii). Valid email address;(iii). Annual Registration fee which is

Tshs. 30,000/=, at the moment but which may be reviewed from time to time.

6. What are the steps to register in TANePS ?

(i). Go to www.taneps.go.tz;(ii). Click Register as a Supplier [See

highlighted part on Taneps page on Page 4]

(iii). Fill in your TIN number in the sec-ond field of the form;

(iv). Click “Retrieve Company Data from TRA”;

(v). Fill in the remaining fields of the form;

(vi). Click “Validate and Continue”; (vii). Register your business lines(s) using

The United Nations Standard Prod-ucts and Services Code (UNSPSC) .

(viii). Create a Supplier Administrator Account and “Click Finish”.

7. How can the created account be activated?

In order to activate the account, do the following upon login for the first time:-(i). Login to your account;(ii). You will be prompted to enter the

transaction code which has been sent to your email (If you have not received an email, request it again by clicking Resend the Confirma-tion Code button)

(iii). Login into your email system, and look for an email from TAnePS with a “transaction code”;

(iv). Go back to TANePs, enter the trans-action code in the box provided and submit the form;

(v). Read the User Agreement (and if you agree), then click the Accept button.

8. How do I complete registration in TANePS ?

In order to complete a full registration, an annual registration fee of Tshs. 30,000/- need to be paid, using the following steps:- (i). Login to your account (ii). At your left-hand side menus, go to

‘Supplier Administration’ then click on ‘Supplier Management’.

(iii). There are two payment options either offline payment (using Mo-bile Money)-which is mostly used, or online payment (using credit or debit card);

(iv). For the Offline payment option, click on Request Offline Payment button, then refresh the page to get the Payment Control Number which must start with initial five digits as 99165…...

(v). Proceed making payment using the Control Number through your mobile phone by selecting “Govern-ment Payment” in money service of any network operator namely T-pe-sa, Mpesa, Tigopesa, Airtel Money, Halopesa, etc;.

(vi). For the Online Payment option, click on the Online Payment button and you will be redirected to another page where you will be supposed to choose type of the card and fill the relevant payment details;

(vii). After successful payment, the status of the Registration Payment will change from Pending to Complete, and displayed at the bottom of the same page. You will also receive a ticket through your registered email;
