Small Business Owners Left Behind by NY State Lawmakers Blind Loyalty to ACAOnce again, New York State small business owners will suffer as a result of political alliances and New YorkState's vow to resuscitate the Affordable Care Act.
The latest move by NY Attorney General Barbara Underwood, positions NYS to oppose the executive order toallow Associations to negotiate as collective members to purchase health care affordably. Currently, NY does notallow small businesses to act in unison when purchasing health care coverage, subjecting all small business owners to severe restrictions, limited access to networks and plans, and higher pricing. The Trump Administration'sattempt to remove these strangleholds on small businesses by allowing them to band together as an industry as-sociation in good standing, is being thwarted by New York State's opposition and commitment to file suit againstthe Trump Administration on this executive order.
AG Underwood claims her motivation is to protect small business in her latest move to support the ACA. However, consider this: New York State is still allowing insurers, like Oxford, to interpret laws to benefit the insurer. For example, regardless of whether employees have legitimate coverage elsewhere, Oxford will not allow only anowner and spouse to enroll in coverage. Oxford is forcing small business owners with employees waiving coverage, to the individual market, where coverage is more expensive, and networks are more restrictive. Eventhough formal legal complaints have been filed regarding this issue, New York State does not see the inequity anddiscrimination in this practice and will not support small business by overturning this unfair underwriting practiceby insurers, nor will NYS allow owners to join together under their association to negotiate with insurance companies. Who, then, are NYS politicians really representing?
From these most recent examples, to the disruption and heartache of the past 7 years, where we have had insurers shut down in the State of NY, causing small businesses to have to scramble for coverage, even whenamidst medical care, isn't is time we spoke out against this unfair practice against small employers in NYS?There is no freedom of choice, and no voice of the small business owner, since the passage of the Affordable CareAct, and it is getting worse.
This letter was composed by Christine Wilson, of Wilson Benefit Management Associates, Inc. Christine is thehealth insurance broker for the LIGRA association.
Whatever your political affiliation, I am urging everyone to consider sending this letter to Governor Cuomo tellinghis you are opposed to his Attorney General position on this matter. That you want the freedom to choose thehealth care that is right for you and your family. As you cast your vote, consider who is protecting your business, and your family.
PLEASE go to the LIGRA.COM web site to down load this letter to add your name to it and mail it to theGovernor.

If you pay all or part of a commercial real estate tax bill, youknow that the numbers can be staggering and certainly im-pact the bottom line. What you may not know is that under
New York state law, there is a right to challenge the propertytaxes as being excessive. The result of a challenge can be a re-fund, savings going forward, or both.
Many proprietors ask whether only a property owner has theright to pursue a tax reduction, or can tenants pursue this aswell. The answer is that it depends on the lease and the land-lord-tenant relationship. If the tenant’s lease provides the rightto pursue property tax reductions, then it is clearly within hispurview. However, even if the lease is silent on the issue, thetenant may still have the right. For instance, a triple net tenantwill be paying 100% of the taxes. Even if that triple net lease issilent on the issue of property tax challenges, the tenant has the
LEGISLATIVE UPDATEA Primer on Grieving Your Real Estate Taxes DOUGLAS W. ATKINS
right to pursue them as he is an aggrieved party under thelaw.
The instances where a tenant would not have the right toproperty tax challenges is where his lease specifically pro-hibits it or he doesn’t pay at least a majority of the taxes. In any event, even if a tenant does not have the right topursue tax challenges, he should ask his landlord whetherit is being pursued on the landlord’s behalf.
Attorneys who handle property tax challenges do so on acontingent fee, meaning there is no upfront cost and norisk to the client. Thus for every commercial property, ei-ther a landlord or tenant should be consulting with a prop-erty tax attorney to ensure that the tax bill is not excessive.
