Dear Mr. Kealey:

To serve their citizens, the City of St. Maries, Idaho, located approximately 50 miles south of Coeur d’Alene, owns and operates a municipal wastewater collection and treatment system. The City’s Wastewater Treatment Plant is approximately 1 mile west of City center, on both sides of the St. Joe River. It includes primary and secondary lagoons and a land application site. When land application is not allowed, treated wastewater is discharged to the St. Joe River.

The collection system consists of approximately 83,800 linear feet of gravity collection pipe, manholes and 25 lift stations. In 2014, 2015 and 2017 the City had 15,393 linear feet of the collection system video inspected. The inspections showed that the majority of the pipes had major deficiencies, and that manholes are in a deteriorated state. The poor state of the pipes and manholes has caused severe inflow and infiltration (I/I) issues. Left uncorrected, surcharging from (I/I) can reduce treatment efficiency and create sewer overflows that threaten human health and safety.

Environmental Protection Agency inspections over several prior years led to the City signing a June 25, 2018 Consent Agreement with the EPA for violations of the Clean Water Act and paying a civil penalty of $12,500. Subsequently, on September 13, 2018 the City signed a Compliance Order on Consent with the Environmental Protection Agency to “replace approximately 10,500 lineal feet of sewer main collection pipes,” “replace approximately 7,500 lineal feet of lateral service lines” and “repair and replace sanitary sewer manholes….” Further the Order called for securing funding for such work by no later than August 31, 2019 with further specific dates upon which the work must be completed and compliance achieved with effluent limitations.

On May 16, 2017, the citizens of St. Maries, by a 77% positive vote, approved a $1,910,000 revenue bond issue to tax themselves to improve their wastewater system. In November 2018 the City applied for an ICDBG to partially fund improvements and in August 2019 USDA-Rural Development agreed to purchase $1,002,185 of the revenue bond as match in funding that Phase I application for system improvements. That work has been bid and construction has commenced. Over 80% of the Phase I ICDBG has been expended and we are now applying for an additional $500,000 ICDBG to continue addressing the EPA Consent Agreement utilizing the remaining $907,800 of bond authorization.

We greatly appreciate the Department’s consideration to providing $500,000 in ICDBG funds to continue improvements with this much-needed project.

The inspections showed that the majority of the pipes had major deficiencies, and that manholes are in a deteriorated state. The state of the inspected pipes and manholes has caused severe inflow and infiltration (I/I) issues. Left uncorrected, surcharging from (I/I) can reduce treatment efficiency and create sewer overflows that threaten human health and safety.

On May 16, 2017, the citizens of St. Maries, by a 77% positive vote, approved a revenue bond issue to tax themselves to improve to their wastewater system. In his letter of October 30, 2019, Howard Lunderstdt of USDA-Rural Development stated, “USDA Rural Development fully supports the City’s pursuit to improve their sewer system. The city has completed all the requirements for our funding. Funding has been approved and obligated for the City’s Wastewater System Improvement project.”

The benefits Low and Moderate-income persons in St. Maries will receive from this project will be to have a wastewater collection system that will meet DEQ and EPA requirements and be adequate to meet the city’s needs and protect the environment and the community into the future.

Local economic impact will be evident by having a viable wastewater system, which will allow for growth and insure the community’s future. Without the proposed project, the City of St. Maries will continue to be fined by the EPA and expose their citizens to the results of a non-functioning wastewater system. The impact of a successful Block Grant application will be to protect health and safety and to allow the community to continue as one of Idaho’s vibrant rural communities.

E. Administrative Capacity: 1. Applicant Capacity

The City of St. Maries, governed by a mayor and six councilpersons, employs two-dozen persons including two certified wastewater operators. The City Clerk has held her position for seven years, the Treasurer for 13 years and the current Mayor was sworn in on January 8, 2018 having previously served on the City Council. There have been no recall elections and St. Maries has previously had several successful ICDBG funded projects.

2. Grant Administrator

The City has, after emailing Requests for Proposals to three certified grant administrators and notifying PTAC, selected W. M. Steed & Associates of Moscow, an Idaho Department of Commerce certified grant administrator to assist in the mak-ing of ICDBG applications and to provide administrative services for infrastructure projects. The city has also hired, through proper procurement processes, HMH Engineering of Coeur d’Alene, Idaho to create the Facility Plan and Environmental Information Document and to act as project engineer for design and construction. Documentation of each selection process may be found in Appendices 5 & 6 respectively.

F. Fair Housing:

The Fair Housing Resolution was adopted November 13, 2018 and has been published. See Appendix 7.

G. Anti-Displacement Resolution:

The Certification Page has been executed and the City has agreed to comply with Commerce’s anti-displacement and relocation assistance plan.

VII. Project Description and Property:

In 2018 the City applied for and was subsequently awarded a $500,000 Idaho Community Development Block Grant using over $1,000,000 of a 77% approved wastewater revenue bond as match. This application for a second ICDBG will allow the City to further reach its commitments in the EPA Consent Agreement. Specifically, the proposed project will repair and replace an additional 7,660 LF of 8” wastewater mains and 1,050 LF of service laterals (in the right of way) along with rehabilitation and/or replacement of 28 existing manholes. The work will virtually destroy the existing pavement of the streets impacted, so the City, out of its reserves, will repave the streets, which are affected by the projects.

Furthering Fair Housing

As part of the CDBG program, cities and counties are required to further fair housing within your community. In 2016, Commerce and Idaho Housing and Finance Association conducted an assessment to fair housing. The assessment examined policies and practices among Idaho’s cities, counties, and housing industry to determine fair housing issues and contributing factors.

For some of these contributing factors there are steps cities and counties can take to achieve the goal of reducing or mitigating the factors, thereby furthering fair housing.

Contributing Factor #1 - There is the lack of cities and counties providing for the allowance of group homes in designated residential zones or their narrow definitions of the types of group homes allowed (e.g., nursing and rest homes) Why is this a contributing factor? The regulation may treat residents who are disabled, differently. Therefore;

Contributing Factor #2 - Idaho’s fair housing law does not provide protection based on familial status. II. LMI Need and Impact (240 points)

B. Need (80/60/40/20 points):

To serve their citizens, the City of St. Maries, Idaho owns and operates a municipal wastewater collection and treatment system. The City is located at the juncture of State Highways 3 and 5, approximately 50 miles south of Coeur d’Alene, Idaho. The City’s Wastewater Treatment Plant is approximately 1 mile west of City center, on both sides of the St. Joe River. It includes primary and secondary lagoons and a land application site. When land application is not allowed, treated wastewater is discharged to the St. Joe River.

The collection system consists of approximately 83,800 linear feet of gravity collection pipe, manholes and 25 lift stations. In 2014, 2015 and 2017 the City had 15,393 linear feet of the collection system video inspected. The inspections showed that the majority of the pipes had major deficiencies, and that manholes are in a deteriorated state (See photos in Appendix 8). The state of the inspected pipes and manholes has caused severe inflow and infiltration (I/I) issues. Left uncorrected, surcharging from (I/I) can potentially create sewer overflows that threaten human health and safety.

Environmental Protection Agency inspections over several prior years led to the City signing a June 25, 2018 Consent Agreement with the EPA for violations of the Clean Water Act and paying a civil penalty of $12,500. Subsequently, on September 13, 2018 the City signed a Compliance Order on Consent with the Environmental Protection Agency to “replace approximately 10,500 lineal feet of sewer main collection pipes,” “replace approximately 7,500 lineal feet of lateral service lines” and “repair and replace sanitary sewer manholes….” Further the Order called for securing funding for such work by no later than August 31, 2019 with further specific dates upon which the work must be completed and compliance achieved with effluent limitations. Copies of the Consent and Compliance Orders may be found in Appendix 12.

C. Impact (60/40/20/0 points):

1. What benefits will low- and moderate-income persons receive from this project (i.e., reasonable rates, improved property insurance rates, quicker response times, easier accessibility to facilities, reliable infrastructure, etc.)?

The benefits Low and Moderate income persons in St. Maries will receive from this project is a wastewater system that will meet DEQ and EPA requirements, be adequate to meet the city’s needs and protect the environment and the community into the future. Without the proposed project, the City of St. Maries will continue to be fined by the EPA and expose their citizens to the results of a non-functioning wastewater system.

2. What will be the project’s permanent impacts (i.e., meeting compliance order, clean water, energy conservation, service life, improved environmental health etc.)?

Local economic impact will be evident by having viable wastewater system, allow for growth and insure the community’s future. The impact of a successful Block Grant application will be to protect health and safety and to allow the community to remain a vibrant community in Benewah County.

III. Project Categories (260 points):

A. Planning, previous actions and schedule (220 points):

1. Design Professional: In September 2017, the City, following appropriate procurement practices, issued a Request for Qualifications for engineering services. Four firms replied and subsequently HMH Engineering of Coeur d’Alene, Idaho was hired to provide engineering services from a facility plan through design and construction for the project. Documentation of the City Council’s selection can be found in Appendix 6. The contract for engineering services will be sent under separate cover.

2. Grant Administration: The City has, after following appropriate procurement practices, selected W. M. Steed & Associates of Moscow, an Idaho Department of Commerce certified grant administrator, to assist in the making of this application and to provide administrative services for the project. A Request for Proposals had been e-mailed to three certified grant administrators and documentation of the advertisement and rating and ranking can be found in Appendix 5. The contract for administrative services will be sent under separate cover.

3. Plan and studies (30 points):

As part of its underwriting for purchasing the City of St. Maries water revenue bond passed in May 2016, USDA-Rural Development conducted a preliminary sewer rate study to determine eligibility for Rural Development funds. Subsequently, Diane Sauer, of Sustainable Systems Consulting in Osburn, Idaho has completed a rate review of the wastewater system. A copy of her rate study analysis may be found in Appendix 10.

b. Completion of ICDBG financial profile worksheet –

The ICDBG financial profile worksheet has been completed in Chapter 5.

6. Property acquisition (30 points):

a. Capacity to Manage - The City of St. Maries has, over the past 25 years, had several ICDBG grants. All involved projects have been completed satisfactorily with no findings. The City has annual audits with the City Clerk holding her position for seven years, the Treasurer for 13 years and the current Mayor being sworn in on January 8, 2018 having previously served on the City Council. There have not been any elected official recalls or similar issues.

XVI. CERTIFICATIONSI certify the data in this application is true and correct, that this document has been duly authorized by the governing body of the City of St. Maries and we will comply with the following laws and regulations if this application is approved and selected for funding.

Specific CDBG Provisions:

Section 110 of the Housing and Community Development Act of 1974, as amended, by the Housing and Urban-Rural Recovery Act of 1983 and the Housing and Community Development Act of 1987, 24 CFR 570.603, and State regulations regarding the administration and enforcement of labor standards;

It will comply with all parts of Title I of the Housing and Community Development Act of 1974, as amended, which have not been cited previously as well as with other applicable laws;

Conduct and administer its program in conformance with Title VI and Title VIII, and affirmatively further fair housing;

Provide opportunities for citizen participation comparable to the state’s requirements (those described in Section 104(a) of the Act, as amended);

Not use assessments or fees to recover the capital costs of CDBG funded public improvements from low and moderate income owner occupants;

Minimize displacement as a result of activities assisted with CDBG funds by following the Idaho Department of Commerce’s anti-displacement and relocation assistance plan; Uniform Relocation Assistance and Real Property Acquisition Act of 1970, as amended (49 CFR Part 24);

Policy on the Prohibition of the Use of Excessive Force:

It hereby prohibits any law enforcement agency operating within its jurisdiction from using excessive force against any individuals engaged in nonviolent civil rights demonstrations. In addition, it hereby agrees to enforce any applicable state or local laws against physically barring entrances or exits from a facility or location that is the subject of a non-violent protest demonstration.

It further pledges enforcement of this policy within its jurisdiction and encourages any individual or group who feels that it has not complied with this policy to file a complaint.

Civil Rights and Equal Opportunity Provisions:

Title VI of the Civil Rights Act of 1964 (Public Law 88-352), and the regulations issued pursuant thereto (24 CFR Part 1), which provides that no person in the United State shall on the grounds of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be otherwise subject to discrimination under any program or activity for which the applicant received Federal financial assistance and will immediately take any measures necessary to effectuate this assurance. If any real property or structure thereon is provided or improved with the aid of Federal financial assistance extended to the applicant, this assurance shall obligate the applicant, or in the case of any transfer of such property, any transferee, for the period during which the real property or structure is used for a purpose for which Federal financial assistance is extended, or for another purpose involving the provision of similar services or benefits;

The Fair Housing Act (previously known as Title VIII of the Civil Rights Act of 1968) (Public Law 90-284), as amended, administering all programs and activities relating to housing and community development in a manner to affirmatively further fair housing in the sale or rental of housing, the financing of housing, and the provision of brokerage services;

It will comply with the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended, and Federal implementing regulation at 49 CFR Part 24, and the requirements of section 570.496a and it is following a residential anti-displacement and relocation assistance plan under section 104(d) of Title I of the Housing & Community Development Act of 1974, as amended;

Environmental Standards and Provisions:

Its chief executive officer or other officer of applicant approved by the Idaho Department of Commerce:

1) Consents to assume the status of a responsible Federal official under the National Environmental Policy Act of 1969 (NEPA) (42 U.S.C. S 4321 et seq.) and other provisions of Federal law, as specified at 24 CFR 58.1 (a) (3) and (a) (4), which further the purposes of NEPA insofar as the provisions of such Federal law apply to the Idaho Community Development Block Grant Program; and

2) Is authorized and consents on behalf of the applicant and himself/herself to accept the jurisdiction of the Federal courts for the purpose of enforcement of his/her responsibilities as such an official.

It will comply with:

1) The National Environmental Policy Act of 1969 (42 U.S.C.
