COURSE OUTLINE - INTERNATIONAL CRIMINAL LAW
Course description
The course will focus on the four crimes most generally recognized as comprising international
criminal law, namely: genocide, war crimes, crimes against humanity and aggression.
The course will examine the jurisprudence of international criminal tribunals, including the
Nuremberg, Tokyo, Rwanda, and former Yugoslavia tribunals. More recent “hybrid” tribunals
will be examined as will the genesis of the International Criminal Court. The course will
consider the Rome Statute of the International Criminal Court, in particular the crimes set out in
that Statute.
The course will also look at the special elements of international criminal liability including
universal jurisdiction, command responsibility, joint criminal enterprise, duress and superior
orders.
Objectives
At the conclusion of the course, students should be able to:
• Display an understanding of the underlying principles of international criminal law.
• Apply the principles of international criminal law to contemporary issues of concern to
the international community.
Course content
The course structure will include the following topics:

2. The concept of international criminal responsibility including individual responsibility,
joint criminal enterprise and command responsibility
3. Aggression (crimes against the peace)
4. Crimes against humanity

andhavingtakennoteofthereportsoftheSpecialRapporteurforRwandaofthe
UnitedNationsCommissiononHumanRights(S/1994/1157,annexIandannexII),
ExpressingappreciationfortheworkoftheCommissionofExperts
establishedpursuanttoresolution935(1994),inparticularitspreliminary
reportonviolationsofinternationalhumanitarianlawinRwandatransmittedby
theSecretary-General’sletterof1October1994(S/1994/1125),
Expressingonceagainitsgraveconcernatthereportsindicatingthat
genocideandothersystematic,widespreadandflagrantviolationsof
internationalhumanitarianlawhavebeencommittedinRwanda,
Determiningthatthissituationcontinuestoconstituteathreatto

wouldenablethisaimtobeachievedandwouldcontributetotheprocessof
nationalreconciliationandtotherestorationandmaintenanceofpeace,

violationsofinternationalhumanitarianlawwillcontributetoensuringthat
suchviolationsarehaltedandeffectivelyredressed,
Stressingalsotheneedforinternationalcooperationtostrengthenthe
courtsandjudicialsystemofRwanda,havingregardinparticulartothe
necessityforthosecourtstodealwithlargenumbersofsuspects,
ConsideringthattheCommissionofExpertsestablishedpursuantto
resolution935(1994)shouldcontinueonanurgentbasisthecollectionof
informationrelatingtoevidenceofgraveviolationsofinternational
humanitarianlawcommittedintheterritoryofRwandaandshouldsubmitits
finalreporttotheSecretary-Generalby30November1994,
ActingunderChapterVIIoftheCharteroftheUnitedNations,

Decideshereby,havingreceivedtherequestoftheGovernmentof
Rwanda(S/1994/1115),toestablishaninternationaltribunalforthesole
purposeofprosecutingpersonsresponsibleforgenocideandotherserious
violationsofinternationalhumanitarianlawcommittedintheterritoryof
RwandaandRwandancitizensresponsibleforgenocideandothersuchviolations
committedintheterritoryofneighbouringStates,between1January1994and
31December1994andtothisendtoadopttheStatuteoftheInternational
CriminalTribunalforRwandaannexedhereto;
2.
DecidesthatallStatesshallcooperatefullywiththeInternational
Tribunalanditsorgansinaccordancewiththepresentresolutionandthe
StatuteoftheInternationalTribunalandthatconsequentlyallStatesshall
takeanymeasuresnecessaryundertheirdomesticlawtoimplementtheprovisions
ofthepresentresolutionandtheStatute,includingtheobligationofStatesto
complywithrequestsforassistanceorordersissuedbyaTrialChamberunder
Article28oftheStatute,andrequestsStatestokeeptheSecretary-General
informedofsuchmeasures;

Considers
thattheGovernmentofRwandashouldbenotifiedpriorto
thetakingofdecisionsunderarticles26and27oftheStatute;
4.
UrgesStatesandintergovernmentalandnon-governmentalorganizations
tocontributefunds,equipmentandservicestotheInternationalTribunal,
includingtheofferofexpertpersonnel;
5.
RequeststheSecretary-Generaltoimplementthisresolutionurgently
andinparticulartomakepracticalarrangementsfortheeffectivefunctioning
oftheInternationalTribunal,includingrecommendationstotheCouncilasto
possiblelocationsfortheseatoftheInternationalTribunalattheearliest
timeandtoreportperiodicallytotheCouncil;

DecidesthattheseatoftheInternationalTribunalshallbe
determinedbytheCouncilhavingregardtoconsiderationsofjusticeand
fairnessaswellasadministrativeefficiency,includingaccesstowitnesses,
andeconomy,andsubjecttotheconclusionofappropriatearrangementsbetween /...

theUnitedNationsandtheStateoftheseat,acceptabletotheCouncil,having
regardtothefactthattheInternationalTribunalmaymeetawayfromitsseat
whenitconsidersitnecessaryfortheefficientexerciseofitsfunctions;and

thatanofficewillbeestablishedandproceedingswillbeconductedin
Rwanda,wherefeasibleandappropriate,subjecttotheconclusionofsimilar
appropriatearrangements;

DecidestoconsiderincreasingthenumberofjudgesandTrialChambers
oftheInternationalTribunalifitbecomesnecessary;
8.
Decidestoremainactivelyseizedofthematter.
Annex
StatuteoftheInternationalTribunalforRwanda
HavingbeenestablishedbytheSecurityCouncilactingunderChapterVIIof
theCharteroftheUnitedNations,theInternationalCriminalTribunalforthe
ProsecutionofPersonsResponsibleforGenocideandOtherSeriousViolationsof
InternationalHumanitarianLawCommittedintheTerritoryofRwandaandRwandan
citizensresponsibleforgenocideandothersuchviolationscommittedinthe
territoryofneighbouringStates,between1January1994and31December1994
(hereinafterreferredtoas"theInternationalTribunalforRwanda")shall
functioninaccordancewiththeprovisionsofthepresentStatute.
Article1
CompetenceoftheInternationalTribunalforRwanda
TheInternationalTribunalforRwandashallhavethepowertoprosecute
personsresponsibleforseriousviolationsofinternationalhumanitarianlaw
committedintheterritoryofRwandaandRwandancitizensresponsibleforsuch
violationscommittedintheterritoryofneighbouringStates,between
1January1994and31December1994,inaccordancewiththeprovisionsofthe
presentStatute.
Article2
Genocide
1.
TheInternationalTribunalforRwandashallhavethepowerto
prosecutepersonscommittinggenocideasdefinedinparagraph2ofthisarticle
orofcommittinganyoftheotheractsenumeratedinparagraph3ofthis
article.
2.
Genocidemeansanyofthefollowingactscommittedwithintentto
destroy,inwholeorinpart,anational,ethnical,racialorreligiousgroup,
assuch:

Murder;

Extermination;
(c)
Enslavement;

ViolationsofArticle3commontotheGeneva
ConventionsandofAdditionalProtocolII
TheInternationalTribunalforRwandashallhavethepowertoprosecute
personscommittingororderingtobecommittedseriousviolationsof
Article3commontotheGenevaConventionsof12August1949fortheProtection
ofWarVictims,andofAdditionalProtocolIItheretoof8June1977.
These
violationsshallinclude,butshallnotbelimitedto:
(a)
Violencetolife,healthandphysicalormentalwell-beingofpersons,
inparticularmurderaswellascrueltreatmentsuchastorture,mutilationor
anyformofcorporalpunishment;
(b)
Collectivepunishments;
(c)
Takingofhostages;
(d)
Actsofterrorism;
(e)
Outragesuponpersonaldignity,inparticularhumiliatingand
degradingtreatment,rape,enforcedprostitutionandanyformofindecent
assault;
(f)
Pillage;
(g)
Thepassingofsentencesandthecarryingoutofexecutionswithout
previousjudgementpronouncedbyaregularlyconstitutedcourt,affordingall
thejudicialguaranteeswhicharerecognizedasindispensablebycivilized
peoples;
(h)
Threatstocommitanyoftheforegoingacts.
Article5
Personaljurisdiction
TheInternationalTribunalforRwandashallhavejurisdictionovernatural
personspursuanttotheprovisionsofthepresentStatute.
Article6
Individualcriminalresponsibility
1.
Apersonwhoplanned,instigated,ordered,committedorotherwise
aidedandabettedintheplanning,preparationorexecutionofacrimereferred
toinarticles2to4ofthepresentStatute,shallbeindividuallyresponsible
forthecrime.

Theofficialpositionofanyaccusedperson,whetherasHeadofState
orGovernmentorasaresponsibleGovernmentofficial,shallnotrelievesuch
personofcriminalresponsibilitynormitigatepunishment.
3.
Thefactthatanyoftheactsreferredtoinarticles2to4ofthe
presentStatutewascommittedbyasubordinatedoesnotrelievehisorher
superiorofcriminalresponsibilityifheorshekneworhadreasontoknowthat
thesubordinatewasabouttocommitsuchactsorhaddonesoandthesuperior
failedtotakethenecessaryandreasonablemeasurestopreventsuchactsorto
punishtheperpetratorsthereof.

Thefactthatanaccusedpersonactedpursuanttoanorderofa
Governmentorofasuperiorshallnotrelievehimorherofcriminal
responsibility,butmaybeconsideredinmitigationofpunishmentifthe
InternationalTribunalforRwandadeterminesthatjusticesorequires.
Article7
Territorialandtemporaljurisdiction
TheterritorialjurisdictionoftheInternationalTribunalforRwandashall
extendtotheterritoryofRwandaincludingitslandsurfaceandairspaceas
wellastotheterritoryofneighbouringStatesinrespectofseriousviolations
ofinternationalhumanitarianlawcommittedbyRwandancitizens.
Thetemporal
jurisdictionoftheInternationalTribunalforRwandashallextendtoaperiod
beginningon1January1994andendingon31December1994.
Article8
Concurrentjurisdiction
1.
TheInternationalTribunalforRwandaandnationalcourtsshallhave
concurrentjurisdictiontoprosecutepersonsforseriousviolationsof
internationalhumanitarianlawcommittedintheterritoryofRwandaandRwandan
citizensforsuchviolationscommittedintheterritoryofneighbouringStates,
between1January1994and31December1994.
2.
TheInternationalTribunalforRwandashallhaveprimacyoverthe
nationalcourtsofallStates.
Atanystageoftheprocedure,theInternational
TribunalforRwandamayformallyrequestnationalcourtstodefertoits
competenceinaccordancewiththepresentStatuteandtheRulesofProcedureand
EvidenceoftheInternationalTribunalforRwanda.

Nonbisinidem
1.
Nopersonshallbetriedbeforeanationalcourtforactsconstituting
seriousviolationsofinternationalhumanitarianlawunderthepresentStatute,
forwhichheorshehasalreadybeentriedbytheInternationalTribunalfor
Rwanda.
2.
Apersonwhohasbeentriedbyanationalcourtforactsconstituting
seriousviolationsofinternationalhumanitarianlawmaybesubsequentlytried
bytheInternationalTribunalforRwandaonlyif:
(a)
Theactforwhichheorshewastriedwascharacterizedasanordinary
crime;or
(b)
Thenationalcourtproceedingswerenotimpartialorindependent,were
designedtoshieldtheaccusedfrominternationalcriminalresponsibility,or
thecasewasnotdiligentlyprosecuted.
3.
Inconsideringthepenaltytobeimposedonapersonconvictedofa
crimeunderthepresentStatute,theInternationalTribunalforRwandashall
takeintoaccounttheextenttowhichanypenaltyimposedbyanationalcourton
thesamepersonforthesameacthasalreadybeenserved.
Article10
OrganizationoftheInternationalTribunalforRwanda
TheInternationalTribunalforRwandashallconsistofthefollowing
organs:
(a)
TheChambers,comprisingtwoTrialChambersandanAppealsChamber;
(b)
TheProsecutor;and
(c)
ARegistry.
Article11
CompositionoftheChambers
TheChambersshallbecomposedofelevenindependentjudges,notwoofwhom
maybenationalsofthesameState,whoshallserveasfollows:
(a)
ThreejudgesshallserveineachoftheTrialChambers;
(b)
FivejudgesshallserveintheAppealsChamber.

Qualificationandelectionofjudges
1.
Thejudgesshallbepersonsofhighmoralcharacter,impartialityand
integritywhopossessthequalificationsrequiredintheirrespectivecountries
forappointmenttothehighestjudicialoffices.
Intheoverallcompositionof
theChambersdueaccountshallbetakenoftheexperienceofthejudgesin
criminallaw,internationallaw,includinginternationalhumanitarianlawand
humanrightslaw.
2.
ThemembersoftheAppealsChamberoftheInternationalTribunalfor
theProsecutionofPersonsResponsibleforSeriousViolationsofInternational
HumanitarianLawCommittedintheTerritoryoftheFormerYugoslaviasince1991
(hereinafterreferredtoas"theInternationalTribunalfortheFormer
Yugoslavia")shallalsoserveasthemembersoftheAppealsChamberofthe
InternationalTribunalforRwanda.
3.
ThejudgesoftheTrialChambersoftheInternationalTribunalfor
RwandashallbeelectedbytheGeneralAssemblyfromalistsubmittedbythe
SecurityCouncil,inthefollowingmanner:
(a)
TheSecretary-GeneralshallinvitenominationsforjudgesoftheTrial
ChambersfromStatesMembersoftheUnitedNationsandnon-memberStates
maintainingpermanentobservermissionsatUnitedNationsHeadquarters;
(b)
WithinthirtydaysofthedateoftheinvitationoftheSecretary-
General,eachStatemaynominateuptotwocandidatesmeetingthequalifications
setoutinparagraph1above,notwoofwhomshallbeofthesamenationality
andneitherofwhomshallbeofthesamenationalityasanyjudgeontheAppeals
Chamber;
(c)
TheSecretary-Generalshallforwardthenominationsreceivedtothe
SecurityCouncil.
FromthenominationsreceivedtheSecurityCouncilshall
establishalistofnotlessthantwelveandnotmorethaneighteencandidates,
takingdueaccountofadequaterepresentationontheInternationalTribunalfor
Rwandaoftheprincipallegalsystemsoftheworld;

Thecandidateswho
receiveanabsolutemajorityofthevotesoftheStatesMembersoftheUnited
Nationsandofthenon-MemberStatesmaintainingpermanentobservermissionsat
UnitedNationsHeadquarters,shallbedeclaredelected.
Shouldtwocandidates
ofthesamenationalityobtaintherequiredmajorityvote,theonewhoreceived
thehighernumberofvotesshallbeconsideredelected.

IntheeventofavacancyintheTrialChambers,afterconsultation
withthePresidentsoftheSecurityCouncilandoftheGeneralAssembly,the
Secretary-Generalshallappointapersonmeetingthequalificationsof
paragraph1above,fortheremainderofthetermofofficeconcerned.

ThejudgesofeachTrialChambershallelectaPresidingJudge,who
shallconductalloftheproceedingsofthatTrialChamberasawhole.
Article14
Rulesofprocedureandevidence
ThejudgesoftheInternationalTribunalforRwandashalladopt,forthe
purposeofproceedingsbeforetheInternationalTribunalforRwanda,therules
ofprocedureandevidencefortheconductofthepre-trialphaseofthe
proceedings,trialsandappeals,theadmissionofevidence,theprotectionof
victimsandwitnessesandotherappropriatemattersoftheInternational
TribunalfortheFormerYugoslaviawithsuchchangesastheydeemnecessary.
Article15
TheProsecutor
1.
TheProsecutorshallberesponsiblefortheinvestigationand
prosecutionofpersonsresponsibleforseriousviolationsofinternational
humanitarianlawcommittedintheterritoryofRwandaandRwandancitizens
responsibleforsuchviolationscommittedintheterritoryofneighbouring
States,between1January1994and31December1994.
2.
TheProsecutorshallactindependentlyasaseparateorganofthe
InternationalTribunalforRwanda.
Heorsheshallnotseekorreceive
instructionsfromanyGovernmentorfromanyothersource.
3.
TheProsecutoroftheInternationalTribunalfortheFormerYugoslavia
shallalsoserveastheProsecutoroftheInternationalTribunalforRwanda.
He
orsheshallhaveadditionalstaff,includinganadditionalDeputyProsecutor,

Investigationandpreparationofindictment
1.
TheProsecutorshallinitiateinvestigationsex-officiooronthe
basisofinformationobtainedfromanysource,particularlyfromGovernments,
UnitedNationsorgans,intergovernmentalandnon-governmentalorganizations.
TheProsecutorshallassesstheinformationreceivedorobtainedanddecide
whetherthereissufficientbasistoproceed.
2.
TheProsecutorshallhavethepowertoquestionsuspects,victimsand
witnesses,tocollectevidenceandtoconducton-siteinvestigations.
In
carryingoutthesetasks,theProsecutormay,asappropriate,seekthe
assistanceoftheStateauthoritiesconcerned.
3.
Ifquestioned,thesuspectshallbeentitledtobeassistedbycounsel
ofhisorherownchoice,includingtherighttohavelegalassistanceassigned
tothesuspectwithoutpaymentbyhimorherinanysuchcaseifheorshedoes
nothavesufficientmeanstopayforit,aswellastonecessarytranslation

Reviewoftheindictment
1.
ThejudgeoftheTrialChambertowhomtheindictmenthasbeen
transmittedshallreviewit.
Ifsatisfiedthataprimafaciecasehasbeen
establishedbytheProsecutor,heorsheshallconfirmtheindictment.
Ifnot
sosatisfied,theindictmentshallbedismissed.
2.
Uponconfirmationofanindictment,thejudgemay,attherequestof
theProsecutor,issuesuchordersandwarrantsforthearrest,detention,
surrenderortransferofpersons,andanyotherordersasmayberequiredfor

Commencementandconductoftrialproceedings
1.
TheTrialChambersshallensurethatatrialisfairandexpeditious
andthatproceedingsareconductedinaccordancewiththerulesofprocedureand
evidence,withfullrespectfortherightsoftheaccusedanddueregardforthe
protectionofvictimsandwitnesses.
2.
Apersonagainstwhomanindictmenthasbeenconfirmedshall,pursuant
toanorderoranarrestwarrantoftheInternationalTribunalforRwanda,be
takenintocustody,immediatelyinformedofthechargesagainsthimorherand
transferredtotheInternationalTribunalforRwanda.
3.
TheTrialChambershallreadtheindictment,satisfyitselfthatthe
rightsoftheaccusedarerespected,confirmthattheaccusedunderstandsthe
indictment,andinstructtheaccusedtoenteraplea.
TheTrialChambershall

Judgement
1.
TheTrialChambersshallpronouncejudgementsandimposesentencesand
penaltiesonpersonsconvictedofseriousviolationsofinternational
humanitarianlaw.
2.
Thejudgementshallberenderedbyamajorityofthejudgesofthe
TrialChamber,andshallbedeliveredbytheTrialChamberinpublic.
Itshall

Penalties
1.
ThepenaltyimposedbytheTrialChambershallbelimitedto
imprisonment.
Indeterminingthetermsofimprisonment,theTrialChambers
shallhaverecoursetothegeneralpracticeregardingprisonsentencesinthe
courtsofRwanda.
2.
Inimposingthesentences,theTrialChambersshouldtakeintoaccount
suchfactorsasthegravityoftheoffenceandtheindividualcircumstancesof
theconvictedperson.
