Information Session on Tier 3 Technical Rules and Guidance

Scott attended MNR and MOE’s Information Session on Tier 3 Technical Rules and Guidance in Vaughan. At the session information was presented on an alternative approach to assign local area risk levels and on the Orangeville, Mono and Amaranth Pilot Tier 3 Water Budget and Local Area Risk Assessment. Ontario Centre for Climate Impacts and Adaption Resources’ (OCCIAR) Climate Change Workshop

Scott and Charley attended the Ontario Centre for Climate Impacts and Adaption Resources’ (OCCIAR) Climate Change Workshop for Northern CA’s in Sudbury. This session included many interesting speakers including Kathy Zaletnik Hering of the MOE who presented information on what may be included in their Source Protection Climate Change discussion paper that should be released in March or April. Answers from the MOEThree main questions arose from the Assessment Report Public Consultations Teleconference on February 4. Below are the questions and the MOE responses (two responses because two people were asked):

1. When an SPR/SPA notifies landowners that they may pose a significant threat to municipal sources of drinking water, do landowners need to be informed about which of the 21 prescribed threats they fall under?

Response 1:

Section 15 2(c)(iii) of O. Reg. 287/07 states that “As soon as reasonably possible after publishing the draft on the Internet, the source protection committee shall, give a copy of the notice referred to in clause (a) to, (iii) every person known to the source protection committee (SPC) who is engaging in an activity listed under subclause 15 (2) (g) (i) of the Act that is or would be a significant drinking water threat (SDWT).

The intent of this notification is to inform the person engaged in the SDWT of the actual threat(s) the SPC believes they are engaged in; therefore, the notice is expected to describe the threat(s) in some way (plain language or otherwise, as determined by local SPC).

Response 2:

Yes, they do. That was always the intent in the regulation. This language has been made explicit in the regulatory amendment package.

2. What about due diligence in notifying landowners? What happens if, for some reason, a landowner who poses a significant threat doesn’t receive the notification letter sent by the SPR/SPA? For some SPR/SPAs notifications can involve hundreds, even thousands, of letters and in some cases already letters have been returned.

Response 1:

Section 15 2(c)(iii) of O. Reg. 287/07 requires that a notice is given to every person known to the source protection committee that is engaging in an activity that is or would be a significant drinking water threat. The key is the person “engaging” in the threat. That person could be an occupant/tenant or it could be an owner - it all depends on the property information available to the SPC (i.e. MPAC data, local knowledge, or windshield survey). In order to meet the notification requirement of Section 15, the SPC should keep accurate records which should include the mailing list, mailing date, if returned, the date it was returned, etc. To further clarify - Section 15 2(c)(iii) says "give a copy to" not "serve". Therefore, providing a notice to individuals via the Canada Post general mail delivery service is sufficient. The use of registered mail or courier would be considered “serving” and is above and beyond the requirements of this section of the legislation.

They have done their best and have shown due diligence. These landowners will have also been the subject of the general newspaper notification as well.

3. Can you provide some guidance about whether notification letters should be addressed to landowners or business owners on a properties that present a significant threat to drinking water?

Response 1:

SPCs and communication staff are encouraged to examine all the information available to them (eg., MPAC data, local knowledge, etc) in determining who to notify and to track their due diligence efforts formally in some way, for reference purposes. If after the initial notifications are sent additional persons become known to them that were inadvertently left off the list, then some form of notice can still be provided by the SPC/CA at that time.

Response 2:

The regulation speaks to those persons engaged in activities. This would usually be the business owner who may also be the landowner. But in circumstances where the business owner is a tenant then it does not hurt to notify the landowner as well.

RES #166/10 - Draft CLOSPA Assessment Report. Approval of the Draft CLOSPA Assessment ReportApproval of the Draft CLOSPA Assessment Report

THAT the CTC SPC accepts the recommendations of the CLOSPA Assessment Report Working Group (WG) as follows:

THAT the Draft Assessment Report: CLOSPA version dated (April 06, 2010) be accepted by the CTC SPC and released for public consultation (Attachment 1);

THAT staff be directed to take the necessary steps to comply with the consultation requirements of subsection 15.1 of Ontario Regulation 287/07 under the Clean Water Act 2006;

THAT the CLOSPA Assessment Report Working Group be directed to consider the comments received during the consultation on the Draft Assessment Report and advise the CTC SPC on the revisons that they recommend to finalize the Proposed Assessment Report: CLOSPA at the SPC meeting to be held on June 1, 2010.

THAT the CTC Source Protection Committee (SPC) authorizes the formation of an Ad Hoc Working Group composed of up to 9 CTC SPC members representing the three committee groupings (municipal, economic sectors and general interest) to review in detail the Draft Assessment Report: TRSPA and recommend to approve or identify any key required changes to the document prior to public consultation on the draft assessment report;

THAT the members who wish to be considered as members or Chair of the TRSPA Assessment Report Working Group advise Chair Susan Self by April 15, 2010;

AND FURTHER THAT Chair Self appoints the TRSPA Assessment Report Working Group members and advise the SPC as a whole of the appointments.

BACKGROUNDThe formation and composition of the CLOSPA Assessment Report Working Group was authorized by the CTC SPC by RES.#156/10 at the SPC Meeting #2 held on February 22, 2010, to carry out a detailed review and make recommendations on acceptance of this Assessment Report to the SPC at Meeting #3/10. The initial Draft Assessment Report (not including Chapter 1 - Introduction and the Executive Summary) was distributed to the CTC SPC and WG members March 5, 2010 for their review and approval. The WG met on March 19, 2010 and directed the staff to make a series of revisions to clarify the findings and conclusions

and to improve the detailed text in a number of areas. A second draft of the entire report was provided electronically to all SPC and WG members on Friday March 26, 2010.

The WG met again on March 30, 2010 and reviewed the report and directed staff to make final edits. The revised report (Attachment 1) is being provided under separate cover via the webportal. Hardcopies will be available to SPC members on April 6, 2010.

The WG agreed that the report should be recommended for acceptance by the CTC SPC at their Meeting #3/10 to be held on April 6, 2010 following completion of the edits. Staff was directed to circulate the revised report to the CTC SPC members as soon as possible prior to this meeting.

Working GroupThe Chair and members of the working group were appointed by Chair Self from those SPC members who expressed an interest in taking on this assignment to reflect the three committee groupings (municipal, economic sectors and general interest). The CLOSPA Ad Hoc Working Group is comprised of the following members:

The Draft Assessment Report: CLOSPA was prepared by staff of the Central Lake Ontario Conservation Authority and revised based on recommendations by plain language editors who have been retained to edit each of the CTC Draft Assessment Reports to facilitate consistency across the SPR. Technical staff of the Region of Durham was provided an opportunity to review the report. The Ministry of the Environment Liaison Officer also provided advisory comments. Members of the CLOSPA Board were briefed on the report's major findings and proposed public consultation on March 23, 2010.

Assessment Report ContentThe Draft Assessment Report: CLOSPA is designed to meet the content requirements outlined in O. Reg. 287/07 and the Technical Rules: Assessment Report Clean Water Act, 2006 herein referred to as ‘the Technical Rules’. The Draft Assessment Report: CLOSPA has been prepared as a summary document with key information on source water protection including vulnerable area maps and documentation of the general methodologies used during the vulnerability assessment. This document is not a collation of all the technical study reports. CTC staff has endeavored to ensure that all requirements including analyses, maps, text, symbology as well as consistency standards have been met.

The technical results presented in the Draft Assessment Report: CLOSPA, with the exception of the Highly Vulnerable Aquifer (HVA) delineation, have been previously reviewed and accepted by the SPC. Agenda Item 6.3 of this agenda deals with the recommendation of the Ad Hoc Technical Working Group dealing with groundwater vulnerability studies to accept the HVA mapping for the entire CTC. The HVA maps in the CLOSPA AR are the same as the ones recommend by the Ad Hoc group.

A standard table of contents was utilized in consultation with the province and several Source Water Protection Regions to ensure that the work covers the requirements of the Director’s

ESTABLISHMENT OF TRSPA ASSESSMENT REPORT WORKING GROUPThe turn-around time for review and approval by the CTC SPC of the Draft Assessment Report: TRSPA prior to distribution to the public is anticipated to be extremely tight. Staff will have very little time to make any revisionsand recommend that the SPC establish a TRSPA Assessment Report Working Group to review the Draft Assessment Report: TRSPA to provide a thorough review and to provide specific recommendations on suggestions or corrections (wording changes) to the CTC SPC. Based on the review of the Draft Assessment Report: CLOSPA it is anticipated that 4 meetings of this group will be required for the Assessment Report: TRSPA. Review is anticipated to begin in May 2010 depending on the receipt of outstanding technical work.

NEXT STEPS TRSPA Assessment Report Working Group

SPC members interested in joining the TRSPA Assessment Report Working Group are to inform Chair Susan Self by April 15, 2010.A meeting of the TRSPA Assessment Report Working Group will be set as outstanding technical work is received.

Draft Assessment Report: CLOSPA Upon approval of the Draft Assessment Report: CLOSPA by the CTC SPC, staff will take the following actions to undertake consultation on the report as required under subsection 15.1 of Ontario Regulation 287/07 under the Clean Water Act, 2006. Attachment 2 of this report provides a summary of the key dates for consultation and approval of the CLOSPA Assessment Report.

BACKGROUNDOn January 25, 2010 the province posted notice on the Environmental Bill of Rights registry (EBR Registry Number 010-8766) of public consultation for proposed amendments to O. Reg. 287/07 under the Clean Water Act, 2006. These amendments, if passed, direct source protection committees and authorities on what is required to complete source protection plans. The regulation is based the comments received on the Source Protection Planning Discussion Paper which was released for comment on June 25, 2009 under EBR Registry Number 010-6726.

At SPC Meeting #2/10 the CTC SPC authorized staff by Res.#157/10 to prepare and submit Draft comments on behalf of the CTC SPC in response to EBR posting #010-8766. Staff were directed to seek SPC endorsement of these comments at SPC Meeting #3/10 and provide any revisions to the Ministry of the Environment (MOE) as soon as possible.

BACKGROUNDAt SPC Meeting #1/10 on January 18, 2010 by Res.#A147/10 the SPC authorized the Ad Hoc Technical Working Group (WG) to review and accept well head protection area (WHPA) delineation and vulnerability scoring on behalf of the CTC SPC. Further, the WG was authorized by the CTC SPC at SPC Meeting #2/10 on February 22, 2010 by Res.#158/10 to review and provide recommendations on the acceptance of the delineation of HVAs and vulnerability assessment of SGRAs in the CTC Region.

On March 24, 2010 the WG met to consider the following matters:Delineation of Highly Vulnerable Aquifers for the entire CTC Source Protection Region (See Recommendation section below)Vulnerability scoring within Significant Groundwater Recharge Areas previously delineated for each source protection area based on the HVA analysis (See Recommendation section below)WHPA delineation and vulnerability scoring for Regions of York and Peel wells located within the TRSPA (See Update on Decisions section below).

Attachment 1 (Summary Table of Status of CTC SPR Technical Studies) of this report provides an update on all the technical work being completed within the CTC Source Protection Region. This table will continue to be updated and provided to SPC members until the completion of the Assessment Reports for each of the CTC's source protection areas. The Work In-Progress section of this report provides some additional details on the work still to be considered by the WG.

RECOMMENDATIONHighly Vulnerable Aquifer Delineation and Vulnerability Scoring in Significant Groundwater Recharge AreasAt their meeting #2/10 held on March 24, 2010, the WG reviewed the proposed HVA delineation and SGRA vulnerability mapping for the entire CTC Source Protection Region. The WG received a presentation from Dr. Rick Gerber who carried out the analysis, outlining the rationale for the selected approach, how the analysis was done and the limitations and uncertainties. WG members had a discussion with the external peer reviewer on his assessment of the approach. Technical staff from each of the municipalities were also invited to attend and participated in the review discussions. Based on these considerations, the WG is recommending that the CTC SPC accept the HVA delineation and SGRA vulnerability scoring as per Attachments 2 - 5 to be provided to SPC members at the meeting.

The recommended mapping has been prepared using the Aquifer Vulnerability Index (AVI) approach, one of the accepted methods under the Technical Rules: Assessment Report, Clean Water Act, 2006 November 16, 2009. As a future action, staff will work to further assess how transport pathways within HVAs and SGRAs should be assessed in determining any increase to vulnerability scoring as part of an amended Assessment Report for each source protection area

HVA delineation and SGRA vulnerability assessment for the entire CTC Source Protection Region was prepared by staffs of the Conservation Authorities and subject to peer review by the consulting firm S.S. Papadopulos and Associates. The CTC Source Protection Committee previously accepted Significant Groundwater Recharge Area delineation for each of its 3 source protection areas (CVSPA, TRSPA and CLOSPA) by Res#A136/09 at SPC Meeting #7/09 on October 22, 2009.

After a fulsome peer review the consulting firm recommended that the WG accept this work. The summary recommendation from the peer reviewers regarding acceptance of the WHPA delineations was:

Conestoga-Rovers & Associates recommends that the SPC accept the delineation of the wellhead protection areas for the following wells: Kleinburg #2, #3; King City # 3, #4; Nobleton #2, #3, #4; and Stouffville #1, #2, #3, #5, #6.

The summary recommendation from the peer reviewers regarding acceptance of the vulnerability assessment was:

Conestoga-Rovers & Associates recommends that the SPC accept the vulnerability scoring using the modified Surface-to-Well Advection Time (SWAT) approach, with assumed zero travel time from ground surface to the water table.

Staff is working with staff from the Regions of York and Peel to confirm the names of property owners and their addresses for properties within areas of the approved WHPAs with vulnerability scores of 4 or higher to send Stage 1 consultation information. If a property is wholly or partially within an area scored 4 or higher they will receive a letter.

The WG is scheduled to meet next on April 19, 2010 to review and consider work in progress which is ready for acceptance.

BACKGROUNDIn February 2010, the CTC Stewardship Staff secured $587,415 in funding through the Ministry of the Environment’s Ontario Drinking Water Stewardship Program (ODWSP) to assist eligible landowners with projects that protect municipal drinking water sources in 2010.

The funding received is comprised of two allocations, Early Actions Project Grants and funding for management and delivery of the ODWSP. A total of $86,415 is being shared by Credit Valley Conservation and Toronto Region Conservation Authority to promote and administer the grant program. There are no ODWSP funds allocated for the Central Lake Ontario Conservation Authority as 100% of the area’s municipal drinking water comes from Lake Ontario and is not eligible for the program.

The Ministry of the Environment has allocated $501,000 for grants that will go directly to landowners who complete approved projects on property located within a municipal council approved “two year time of travel” area near municipal drinking water wells. The municipalities of Peel, York, Durham, Erin and Orangeville have accepted two-year-time-of-travel zones for the purposes of ODWSP funding. The two-year-time-of-travel zone for the Region of Halton wells in the CVSPA are still being delineated and stewardship staff will work with municipal partners to conduct outreach efforts if these zones are approved by Regional Council in time.

In order to qualify for funding, all projects must be completed and paid in full with documentation submitted to Conservation Authority staff no later than December 31, 2010. Retroactive funding is also considered for eligible projects completed after September 19, 2006. All funding is allocated on a first come, first served basis.

NEXT STEPSConservation Authority staff, in partnership with their municipal partners will be conducting meetings and targeted mail-outs to landowners within the eligible funding areas. Stewardship staff has drafted a letter to update the local and regional councillors in the CTC Region to notify them that 2010 funding is available.

In addition, stewardship staff has prepared a second letter outlining the funding available to all landowners within the two year time of travel. We are currently exploring the opportunity for the landowner letter to be mailed out on various municipal letterhead. The landowner letter also includes a new attachment entitled Steps to a Successful Grant Application (Attachment #1).

Early Actions Funding has been allocated for an information session that will be hosted in the Region of Halton. This information session will be similar to sessions held in York and Peel under the 2009 allocation. CVC staff are also designing custom postcards for a targeted mailing to the communities of Halton Hills, Erin, Orangeville and Mono.

Information regarding stewardship projects in the CTC Source Protection Region is provided on the CTC website (www.ctcswp.ca) and has been recently updated. We encourage all landowners to refer to the website for the maps outlining the eligible “2 year time of travel” areas, details regarding the funding categories and the application forms.

STEP 5: Ensure the contractor is aware of the December 31st, 2010 deadline and that they provide you with an estimated project completion date (to be submitted with your application). The review committee will be considering completion dates during the approval process, so you are encouraged to complete your project as soon as possible. Funding cannot be provided until all work is completed and paid in full.

BACKGROUNDCTC communications staff continue to conduct general outreach to educate residents of the CTC Source Protection Region on the importance of the Clean Water Act, 2006 and the work of the CTC Source Protection Committee. The information below provides an overview of some of staff's ongoing communications activities.

Stage 1 ConsultationAt SPC Meeting #8/09 the committee approved the Stage 1 Consultation outreach by Res.#A134/09. Staff are working with municipal partners in the Regions of Peel and York to begin Stage 1 consultation for the wells within the TRSPA which have been reviewed and accepted by the Ad Hoc Technical Working Group (Agenda Item 6.3). Staff are currently preparing this mailout and anticipate sending the outreach materials to York and Peel Region residents within the TRSPA in mid-April, 2010.

Staff will continue to move Stage 1 consultation forward as vulnerability assessment for the remaining well systems are accepted by the Ad Hoc Technical Working Group.

Stage 2 ConsultationAs directed at SPC Meeting #8/09 by Res.#A134/09, staff and the COWG have developed a plan for Stage 2 consultation which exceeds the minimum public meeting requirements (one public meeting in each Source Protection Area) of the Clean Water Act, 2006. The approved communications was based on the acceptance of the Assessment Reports for all three CTC source protection areas within the CTC at SPC Meeting #3/10. Due to ongoing delays in the completion of technical studies in CVSPA and TRSPA public consultation of these Draft Assessment Reports will not proceed at the present time.

All technical studies within CLOSPA have been completed and the CTC SPC is asked to accept the Draft Assessment Report: CLOSPA by agenda item 6.1. Agenda item 6.1 contains details of public consultation for CLOSPA.

E-Learning Water Budget ModuleAt SPC Meeting #2/10 staff presented the initial draft of an online e-Learning module on the Water Budget technical work. Incorporating comments of the CTC SPC staff are finalizing the module to provide the interested public with an on-line self-directed learning opportunity to understand more about water budgets. The module is currently having audio narration finalized and will be available to the public with the Draft Assessment Report: CLOSPA. The module can be found on-line at http://www.exodevelopment.com/trca/waterbudget/.

CTC staff are also working to complete a similar e-learning module to educate public stakeholders on the Wellhead Protection Area delineation, Vulnerability Assessments and Threats and Issues Assessment work. The target completion will be to support public

BACKGROUNDCommunications staff has worked with staff of the Credit Valley Conservation Authority to develop an online tool which will assist the interested public in self-identifying their source water protection vulnerability score. The key benefits of enabling landowners to self-identify their vulnerability score are:

the tool will show landowners their highest vulnerability score and offer them property 1.specific advice on their suggested level of involvement in the source protection plan developmentthe tool will offer staff the ability to conduct more in-depth, property specific, discussions 2.with landowners. By linking these discussions with the Upper Thames Threats Database staff will be able to more accurately provide details about the types of activities which may be drinking water threats on a resident's property.

Currently this module is at the 'beta' stage, i.e. undergoing testing and review to ensure the information is correct and that the program functions properly.

Once completed this mapping tool will be made available on the CTC Source Protection Committee's website (www.ctcswp.ca) and will be part of the interactive displays planned for Stage 2 public consultations and at other public events. The work will be also be shared with other source protection regions through Conservation Ontario.

The 'beta' version of the Vulnerability Assessment Mapping Tool will be presented to SPC members at SPC Meeting #3/10 held on April 6, 2010.

Next StepsCTC staff will incorporate feedback from the source protection committee and continue work to finalize the online Vulnerability Assessment Mapping Tool with vulnerability scoring for Highly Vulnerable Aquifers and Significant Groundwater Recharge Areas for release to the public in parallel with Stage 2 public consultation in CLOSPA beginning April 28, 2010.

CTC staff will work to incorporate this vulnerability scoring for Wellhead Protection Areas as the technical studies are completed in CVSPA and TRSPA.
