9. The Director of Administration reported that for developmentpurposes the above land had always been regarded as inseparablefrom the adjoining 28.6 acres. The two parcels of land receivedplanniri. consent for residential development under referenceROC/228/73/l. The road pattern provided for an access fromRectory Road and another from Ashirigdon Road. The Hawhwell EastWorking Party were recoimnending that the first phase of the

development which was to take place on part of the 28.6 acresshould receive approval by the Ivelopment Services Connittee forconsent to details. However the Developers could not reachagreement with the uwners to purchase the 4.84 acres and inconsequence could. not provide the access to .Ashingdmi Road anddevelop the 4.84 acres, althon they remained willing to providethe access if the lend could be made available.

It was, in the view of the Panel, imperative for the 4.84 acres tobe developed in conjunction with the 28.6 acres and desirable forthe access to Ashingdon Road to be provided. Moreover, the landwas included within the 30.89 acres listed as Site 7 in the RollingProgramme approved by the Council under the Community Land Act.Per these reasons the Hawkwell :Elast 'Working Party were requestingthat consideration be given to the possibility of using compulsorypurchase powers under the Community Land Act to assist the develoint3ntby the acquisition of the 4.84 acres.

BECOMMENDRO That4 if necessary, subject to the submission to andapproval by the Department of the Thaviromnent of a financial profile,and in accordance with Section 15 of the Community Land Act 1975, andsubject to authorisation by the Secretary of State, a CompulsoryPurchase Order be made in respect of 4.84 acres of land to the westof Ashingdon Road, Hawkwell, commonly laiown as Saucer Field. 13. The Director of Finance reported that information regarding the

changes in the method of distribution of the needs element of thtrate support grant had now be received from which it was apparentthat although the needs element to be re—distributed was 5.Sp,the foiwula used by the Government to effect the re—distri'bu.tionpenalised Rochford as a low spender in past years and that it wouldtherefore be necessary for the target set for the District ratefor 1979/80 to be revised to I2. 85p.

Whilst reqogeising that this rate wcnild still be lower than thatfor 1978/79, Members were annoyed that the method of re—distributionchosen by the Goverient should penáliae careful low spendingCouncils such as Rochford and not impose penalities upon free—spending Authorities.

BECOMMENDRD (1) That the target for the District Rate for1979/80 be revised to 12.85p.

(2) That representations be made to the Associationof District Councils regarding the distributive method used byHJ€. Government to effect the re-distribution of the needs elementof the rate support grant. (759)

The Comnittee considered the private and confidential reportsof the Directors of' Ainistration and Technical Servicee,circulated to Members only, upon the tenders received forthis contract, upon the outcome of the arithmetical checksof the tenders and the subsequent negotiations with the lowesttenderer. It was pointed out that to accept the lowestnegotiated tender of George Wimpey & Conparry L5mited wouldrequire waiving Pinancial Standing Orders, in accordancewith Order No. 42. The Co!mnittee accepted that in thecircumstances it was necessary to make such an exception.

Report of the Director of Administration

At the December Health and Ri&iways Meeting and subsequently,Xembers raised.queries about the duties and responsibilities of the Council asking how itspowers could or should be exercised to overcome problns now being reportedby residents near the premises. The interest is re than purely local andthe principles involved affect other premises to a 'eater or lesser deceeso it was thou&it that a synopsis would be of assistance to MSbers. Thefofloviug may not cover all points but will answer some.

1,1 In June 1976 a planning application was received to change a oa'r show-rocninto a Restaurant (later a Public House) arid Nightclub. As originallyproposed the concept was acceptable to Members but they wished to see thepremises restrioted to bona fide club members only and speciflcafly expressedconcern that it should not become a discotheque attracting large numbers ofyoung people. This was the reasoning behind the plaaming conditions limitingentry to over 25 yer old club members. These conditions, angst others,were challenged but the appeal has never been heard so it is still not knottether they would have been upheld..

1,2 There were problems both of principle and detail and some were unresolvedwhen EL Padrino, as it was then known, opened in late 1977. Further questionsarose and ach time and effort was expended but it was financial difficultieswhich brought matters to a head and the premises were acquired by Mr. AntonJohnson in Nay/Jtme 1978. He changed the nightclub name to lt(5ct9It j thepublic house name to ttme Thading Pcat.

1.3 In July 1978 Mr. Johnson, with his Solicitor, met Officers when he outlinedhis proposals for what he called a 'Tbroad speotrwn fatally entertairuent ocunpiex"and was advised that p1ming pemission would be needed for the proposedchanges. At this and subsequent meeting your Officers advised the owner andhis Agents of the likely opposition of the local plataing authority to 200 aai,discos.

1.4 In the event it was necessary for the Director of Mmin{stration to take atim line and apply considerable pressure to obtain the applioation for

2.0 The Present Position

2.1 Although there were other problems, EL Padrino oansed no complaints byresidents • The club membership requirement, although apparently not strictlyobserved, and the entertainment offered meant an adult patronage but the newowner appears to have set out to attract the teenage disco element.

2.3 There is specific p.auning permission for a nightclub and that cannotbe revoked without art expensive Diacentinuance Order. It is open tothe owner sDtorIxxiify his activifles as to be able to contend it is anightclub.

3.0 The Complaints

3.1 Specific complaints have been received from 1, 5, 7a and 9 Bull Laneand are all about patrons leaving in the early hours. Coaches andcars parked an Bull Lane and Hlghfield Crescent and noise, abuse andvandalism are reported as common.

3.2 Cars are also left in the Council Offices and Market car parks andcustomers take a short cut by climbing along the boundary wall betweenthe Council car park nd the f4irst house in Bull Lane caising moredisturbance and vandalism, This was one of the problems considered by theHealth and Highways Comnittee, I

3.3 It has also been said that closing time at Crocts is noticed over a widearea as revellers progress on foot.

4.0 The flnnftg Situation

4.1 ROC/ll0l/78 for "Change of use to dance hail" is scheduled to be submittedto the next Conservation Panel — 22nd February and, subject to any decisionsthen taken, to Develouent Services — 6th March. Sce replies toconsultations are still awited and no recommendation can be formulated as

yet. There are precedents for applications to go direct to the DevelonentServices Conitte and if the Chairman of that Coittee is agreeable bothapplications can go direct to the Ivelopment Services Meeting on 6th

February.

4.2 At the time of writing objections have been received, on broadly the saegrounds as the coxap]aint refened to above, from 1 and 7a Bull Lane, 2bHighfield Crescent an4 4 High Street.

5.0 Licences

5.1 (a) for Drinks

The annual renewal application for Croct s and The Trading Post will beheard 7th February at 10.00 a.m. Objections can be made in writing orin person at the Hearing but if objections are made other than in writingand in time for the applicant to have considered them, the applicantcan ask for an ad.jouranent of the Hearing.

5.2 The Justices may grant a licenc for normal public house opening timesi.e., up to 10.30 p.m. but the application will also be for a SpecialHours Certificate under Section 77 of the Licensing Act 1964. There

are provisos but in jtractt c, all other onditione being met, if there isa Music and Dancing Licence and if the premises are suitable, the Justicesshall grant the application and this allows drinking up to the hour peitte&in the Mimic and Dancing Licence.

5.4 The Director of .Atinistration advises that, since a renedy already liesin the bands of the Council as local planning authority and as the authorityfor Music and Dancing Licences, the Licensing Court is not the best placeto pursue any complaints..

In broad terms if the general public pay, in any way, for entry and musicand/or dancing is provided a licence is needed from the District Council.These licences are all subject to standard conditions and some haveindividual conditions. All Mizaio and Dancing Lioences expire at midaziitunless them is a specific relaxation by the Council and the wording ofthe necessary special condition is to the effect that, if there is aSpecial Hours Certificate in force under the 1964 Licensing Act, thenmusic and dancing can continue until 2.00 a.m. Note that there must beboth a Special Hours Certificate arid a Music and Dancing Licence • Withoutone there is ueither

5.6 Authority to issue Public ttertaimaent Licenoes is delegated to theDirector of Athninistration who takes advice on technical aspects from theDirector of Health and Housing, The Director of AdrnThlstration may notrefuse a licence. If there are objections tich he cannot resolve thematter imast be referred to the Music and. Inaing Licencin.g Panel comprisingthe Chairnan and. Vice—Chairman of the Health and Hiways Consiittee plusCounciflor S.B.H; fletcher, The Panel has power to hear objections andmake decisions on contested application (Minute 544/76).

5.7 An Appeal from th Panel lies to the Crown Court but this has not yetbeen pursued in any of the three cases in which the Panel has acted. However,the Rules of Natural. Justice and the possibility of such an Appeal demandsthat the credibility and inpartiality of the Panel shall in no way bedisturbed or brou&it into question. The proceedings of the panel are

quasi-judicial and every care must be taken to ensure fairness.S 5 • S For these reasons the Director of Adninistration advises that Members of

the Panel shouldt take part in any discussions or debates and should.

withdraw from any Meetings where questions am raised about this or anyother application that is to come before them as a Panel.

6.0 The Possibilities

6.1 4) Waiting Restrictions (See Mi t.745j7L— The Police say they would"probably" support a 24 hour waiting restriction in Bull lane and if theydid then the Highway Authority would likely relax their opposition toTraffic Regulation Orders on amenity grounds and make such an order.Note that it would be necessary to erbend present restrictions which nowrun only from Websters Way to the junction with Hi&ifield Crescent soas to include the whole of Higbfleld Crescent and. all of Bull lane toits junction with Stile Lane. If this line were pasted the Order Makingprocess allows for residents to express their views and they would be ableto say whether the present nuisance is greater or less than the nuisance of

their not being alile to park outsid± th?ir own houses.

6.2 Th) The Car PJSee Minute 74/7B) — The Director of Technical Serviceshas put in hand ths ez':tion of a gate across the narrow part leading tothe "lower" Council caz park and hopefully this should dissuade the takingof the short cut.

6.3 (q)NusicandDanoinLicence — Using the precedent of and. the pro cedureadopted for "The Anchor't, South Pambridge, the Director of Mni.nistrationhas issued the Public Entertainment Licences for three months only insteadof the usual twelve and in that three months, on February 14th at 2.30 p.mthe ltasic and Dancing Licensing Panel will meet to hear the application forrenewal and any objections thereto.

6.4 The Pane]. can:—

1. Renew the Licence for 12 months with a 2.00 a.m. extension2. Renew the Licence for 12 months without the 2.00 a.m. extension3. Renew the licence for a trial period onlyEach with or without any other conditions that properly relate to theMusic and Dancing Lioences.4. Refuse the application completely.

6.5 If the application is refused completely or if any conditions are tm—acceptable to the applicant he can appeal to the Crown Court but thereis no statutory appeal against a refunal to grant an extension aftermidniat. However, an action mist well lie if the Cotmcil were seento be acting arbitrarily or agaiast the evidence.

7.0 The Position of the_CouncilP

IPIOYMFINT AND ECOIQMIC INITIATIVES IN ESSEX

29 • The Committee considered the previously circulated report of theDirector of Technical Services.

Resolved (i) that the County Council be infomed that:—

(i) Eocbford. Council has expressed its full support for employmentpromotion on several previous occasions and welcomes the positivesteps being taken by the County Council to put this into effect.

(ii.) With changes in Government policy ath inner city policy art withthe decision on the D.S.P.S.E. still to be considered, employmentpolicy foraulation in Essex as hindered. Some guidance is there-fore needed to prevent wasteful competition between Districts Srithe County and between Counties in the region for the obviouslylimited amount of new employment that can be attracted or generated.

(iii)The division of functions between the County and Districts assuggested. in the report is endorsed, but where District Councilsare taking positive action to promote industry it is hoped. thatthe County Council will be more flexible in allowing departuresfrom the existing Development Plan and in allowing the Districtsto detenaine what land would be appropriate for development forindustrial purposes by way of Local Plans.

(iv) The resources which this Council would be able to devote toemployment promotion are limited unless it were to embark on apro'amme of land acquisition for industrial and commercialdevelopment under the Community lend Act, as in the Council' srecent first steps in the Lascelles Gardens Scrapyard site. TheCouncil does not own any land suitable for industrial development,although one or two sites in its ownership may be considered forcommercial purposes.

(v) With reference to the summary of the report, it is considered thatthe County Council should only undertake activities (8) to (11)in the event that the County Council is fornally advised by aDistrict Council that it will not be taking positive steps tobecome involved in them.

(vi) Bearing in mind that the Location of Offices Bureau considersInner london as the only viable area f or office develcpment in thesouth—east, and the advice that Local Government' s attentionshould be concentrated on boosting the manufacturing sector, theremust be some doubt as to whether offices will be the more likelysource of new employment as is suggested in the Draft Structure Plan.

(vii)In order to stimulate the creation of new jobs, it is consideredthat local Goverrmient should concentrate on assi.sting rew btçinessor "the small man" as these are likely to be more labour intèiwiveinitially.

(viii)The Council welcomes the proposed publication of a new booklet tobe made available in response to enquiries on commercial andlndustrial development and it is hoped that the Districts will beconsulted on the draft.

(4 That this Council agrees with other District Councils in Essexthat the County has suffered from an inadequate transportinfrastructure for many years and emphasises the need forimprovements In the existing road pattern and. the need for newand better road aix]. rail conniications if employment potentialis to be realised.

Officers recommended that the Council should declare a policy on tetheror not is was in favour of oharges being made for the collection ofcommercial, refuse.

If complete or partial abolition of charges was desired then a surveyshould be undertaken of commercial premises toBstablish the possibleeffects of that action, and any decision on reducing or elinina.tingcharges should be deferred until the study of the refuse collection roun4shad been completed and agreed.

Bayleia, Sweyne School, Surface Water sewer extension — Cost £25,700.Flooding of School Buildings occurs periodically as a result of over-loading of the surface water system m the vicinity. The problem canbe overcome by extending the surface water sewer laid in Cheapside Westas part of a scheme completed in 1976. Thin scheme was originallyincluded as part of the Western Area Surface Water Thase II propcsals.

Rayleit, Spring Gardens, Surface Water Sewer — Cost £58,500.Existing sewer inadequate to deal with upstream catobment and shouldbe supplemented or replaced. This scheme was originally includedas part of the Western Area Surface Water Phase II proposals.

Irrv'estigations are continuing into the oapacity of the surface waterdrainage system of Central Reylei and the provision of a fouldrainage system at Eastwood Rise, Sandhill Road, Eastwood.

The Director of Technical Services reported that notification had beenreceived from the Department of Transport (Circular ROADS 27/78)concerning arrangements for the identification of dangerous goods, thehazards to which they gave rise and for the summoning of assistance todeal with an emergency.

The law relating to transport of dangerous goods required:-

(i) Certain vehicles carrying specified inflarable liq,uide,corrosives or- organic peroxides to dispisy diamond shapedlabels indicating the nature of the substance.

(ii) Containers c-arrying prescribed dangerous substances toindicate the name snd address of the manufacturer, theimporter, the wholesalers or supplier of the substancein some instances.

(iii) Tank vehicles and tank containers carrying specifiedsubstances to bear hazard warning panels which has anorange background and contains the following information:—

(a) 1JI diamond-shaped hazard warning siga. This showsthe primary hazard, e.g. inflammability, toxicity, etc.

(b) bnergenoy Aotion Circle. This is intended for the useof the emergency services and gives information, onsuitable fire—fiiting media, type of personal protecticnrequired, whether it must be contained or can be diluted andwashed bito sewers, etc. if evacuation of the public from thesurrounding area should be considered.

(c) The Substance Identification Number. This is specificto the substance and is used for identification purposes.

(d) Specialist Advice Telephone Number.

The Director of Technical Services repbrted that Section 7 wouldbe implemented on 1st October, l9aO, its' 'effect prohibiting allpaa±ecing (wholly or partly) on verges, central reserv.tions andfootways of urban roads, (dafined as roads with a speed limit of40 m.p.b or less). Heavy ooimaeroial vehicles were alreadyprohibited from such patting on any road and waIting restrittionssiiified by yeflqw line markings usually applied to the fullwidth of the hiiway inclncl,1 ng the Tootway or verge óiring the hoursthey are in operation. Authorities had power to make orders toexempt particular roads Oz stretches of road. from the generalprohibition to be introduced. I

The Department of Tvansport had. issued advice to Authorities onthe procedure and criteria to be applied ten considering and makingexemption orders (Circular ROADS 18/78), as follows:—

(i) Exemption Orders oom within the scope 'of the existingTraffic Order (Procedure) Regulations.

(2) Certain classes of vehicles will be exempt from theprohibition.

(3) The prohibition will improve safety and conditions generallyfor pedestrians. It Should reduce footway damage andconsequent maintenance expenditure.

Exemption orders should only be where it can be shown that footwayparking is essential and them Is no other practicable way ofaccommodating the vehicles consented, i.e. where residents of anarrow rothl have no off-street parking facilities; or in streetswith heavy traffic flows and ample footways.

Exempted footways and verges would represent free pattingspace and, exemption would not be appropriate in controlledpatting zones. Exemption should also be made only exoep-.tionafly in fringe areas around controlled arking zones.

Roads to be exempted would usually be those where footpathpni$cng is already conn practice and authorities should becautious aboit exempting roads where additional structural.wotts might e needed to provide for footwsy patting. In somecases it might be more desirable to re—alige the kerb to provideon—street parking space. fl;

In the interests of road safety, lengths of road in the vicinity ofjunctions should bot be exempted if visibility will be obstructed byparked vehicles.

(4) If a local authority proposed exceptionally to permit footwayparking on roads subject to yellow line waiting restrictions,it is possible to resolve the conflict between the exemptionorder and the existing waiting restriction order.

(5) Part time exemptions can be made but they should be avoided•wherever possible.

(6) Parking on the footway for the purpose of loading or unloadingwill be pernissable.

(7) foroement of the prohibition can be done by local. authorityofficers.

The ssex County Council have drawn attention to the Circularand have requested certain information and action.

(A) The preparation of a list of roads that could be the subjectof exemption orders.

(B) Does the Council wish its staff to enforce the prohibitions againstparking? If so, can enforcement be undertaken within the Council' sexisting resources.

(E) ihilst it is understood that those Districts with hitwayagency responsibilities will undertake the necessary legalprocednree, it is important that the County Hiiwsys Traffic andRoad Safety Sub-Conittee is fully acquainted at an early stagewith financial. implications, any staffing difficulties and anyother problems which nit arise.

47. The Director of Administration reported that further consideration hadbeen ven to the possibility of achieving a three-stand Hackney Carriagerank in the Market Square. Lack of finance had so far precluded actionbeing taken in this matter but local taxi proprietors were pressing for improvedfacilities for the following reasons:—

1. Proper ranking is impossible with the two standscurrently available, i.e. the public d.o not know whichtaxi is first on the rank.

2. Taxis must either reverse onto or off both existings taMe.

3. There is no protection for the sides of taxis from vehiclespatting in adjacent patting bays and, indeed, there havebeen recent instances of taxi doors and side panels beingdamaged by careless parking.

4. There is need for more taxi stands in the Rochford part ofthe District particularly the Market Square.

A scheme had been 'epared for a three'-istand taxi rank includingelimination of the existing central island and replacement by alarger island. The estimated cost of establishing the proposednew taxi rank including reconstruction of the highway and thenecessary white lining was approximately £710. The Rochford TaxiDrivers Association were in aupport of the proposal.

The Director of Technical Services reported the present position in relationto the Manual Workers tzdu.strial aotion affecting refuse collection andhiiway maintenance and stated that a daily bulletin was issued for thebenefit of persons enquiring of the position. In addition a press noticewas being issued advising the public how to deal, with domestic refuse.

The Chairmian of the Council expreSsed concern that local people wouldsuffer inconvenience because refuse would not be collected and roadswould not be rittpd. during the period of the strike. In the event of theindustrial action continuing, he, together with other menbere was particularlyainious to avoid exposing local, residents to health hazards arising froanhouseholders being unable to store their refuse satisfactorily and to the dangerof road accidents on the hills within the District which become dangerous tencovered with ice and snow.

Resolved that further consideration of this matter be deferred until membersof the public and representatives of the press have been excluded from themeeting.

The Director of Technical Services reported that an approach had beenreceived from the Education Officer of the Essex County Council inrelation to joint use provision at the proposed West Hocicley PrirySchool which would cater for 300 pupils. The programme for the buildingof the school was uncertain but 'a start might be made in 1980/al. Itwas intended to include 10 olass bases, a ball, an autio-.vieual aidsroom and 2 group rooms. The school site whilst slightly in excess ofthe minimum requirements laid down by the Standards for School PremisesRegulations 1972, had parts that were sterilised by the presence ofpublic sewers and proposals for joint use could be affected.

Bearing in mind the possibility of site limitations, that the schoolwas a Primary School and the Recreation facilities which this Councilwas providing at Clement a Hall Sports Centre, it was considered thatthere was no need for the Council to provide facilities at this sitsfor Recreational purposes.

58. The Director of Technical Services reported that one of the facilitiesat the Playing fleld was an area. of Hard Tennis Courts which tad alsobeen used for netbafl since the construction of the Sports Centre.

The area was not used to its full capacity especially in the wintermonths. This could be overcome by the provision of floodlightingat a cost of £4,500, for which estimate provision had alreaôy beenmade, which would enable the demand for nstball facilities to besatisfied. In addition since the opening of the Centre there had beenand was a demand for team games training facilities which could. not bemet by the Centre as a result of demands from other sports. flood-lighting would enable the transfer of teams from the Centre givingadditional space for indoor sports.

The area was sited 14 and 40 metres from the rear of properties inCoronation Close suit Eigt Street respectively awl 150 metres approximatelyto the east of the Centre. The proposals for lighting involved theprovision of 6 x 10 metre colunnis each having 2 No. 1000 watt lights.The standard of lighting would be such as to enable club tennis to beplayed.

The provision of lighting anti the resultant additional usage of theareas would mean that the residents of adjacent property would suffersome additional nuisance from noise and light. In the latter case, theproperties and rear gerdens although not directly lit would be visibledue to the effects of reflected light and silhouetting. Having lit thebard court area it would be possible in the future to provide a trimtrail, with 4 exercise areas (estliinte& cost 7,ooo) between the SportsCentre and the hard court area with similar resultant effects to theamenities of residez',ts of High Street.

If it was considered that the benefits of increased usage of the hardcourt area and proposed trim trail were outweighed by the effects onthe adjacent residents then a similar scheme could be provided at amuch greater cost behind the Sports Centre in the middle of the field.Such a scheme would involve the re—arrangement of the football pitchesand the addition of a further floodlit hard court area to the north ofthe Sports Centre. The estimated cost of such a scheme would be£31,000.

59. Consideration was given to the report of the Director of TechnicalServices 'which indicated that the Courts were ncc w fully integrated intothe programme.

Beginners were constantly enquiring about coaching and although someoff-peak arid week—end sessions could still be used, peak time courtscould be booked several times. The use of off—peak courts had nowbecome the foremost priority anti coaching was being encouraged daring athis time.

The squash court provision had added to the Centre and dands for otherfacilities had not been affected. Wvidence showed that players whoinitially caine to the Centre to play squash were now mrticipating inother activities available at the Centre.

Certain minor problems bad been experienced with the squash courtbuilding ceiling and these had been taken up with the contractor. (6006)

Officers drew attention to the fact that the terns of the lease to theThiflbridge Sports arid Social Club for 19 acres of laid off CoventryHill was nearing finalisation, including the developmarrb programme whichthe Club were bound to submit under the tens of the lease. Part ofthis programme envisaged the establishment of a pavilion with a tar.From a planning point of view it would be necessary to site thispavilion away from the residential area 'which would increase the access,new drainage and parka..ng costs by some estimated £20,000.

Members were further advised that it would appear from discussion theDirector of Finance had lad with Officers of the Club tint they wereable to finance their capital progranune to the extent of £22,000 butthe extra cost of the sewer and access way the pavilion would addan intolerable burden. The Officers souit guidance from Members asto whether they would be prepared. to assist fnnncia1ly the Club eitherby way of loans or grant so as to ensure the viability of the project.

The Committee were favourably impressed from reports by Off Icera andMembers on the enthusiasm and competence of the club arid were convincedthat it was in the interests of the District, and in particular theresidents of Thallbridge for the Council to give every poe sible supportto the project to the extent, if necessary, of loans or grant.

HCMENL That this Council fully supports the efforts of theHu.llbridge Sports and Social Club to establish a sports ground offCoventry Hill aid are prepared to approve in principle the making ofloans or grants in furtherance of auoh proj sot, but that a finaldecision both on the principle and the amount of any loans or grant bemade when Officers submit further and detailed reports to a meetingof the appropriate Conaittee.
