Plaintiff, the Securities and Exchange Commission (“SEC”), Jennifer Ecklund, the

Court-appointed Receiver (the “Receiver”) for Defendants Thurman P. Bryant, III (“Bryant”)

and Bryant United Capital Funding, Inc. (“BUCF”) (Bryant and BUCF, collectively, the

“Bryant Defendants”) and Relief Defendant Arthur F. Wammel (“Wammel”), Relief

Defendant Wammel Group, LLC (the “Wammel Group”), and Wammel Group Holdings

Partnership (“WGHP”) (together Wammel, Wammel Group, and WGHP, the “Wammel

Defendants”) receivership estates (together, the “Receivership Estate” or the “Receivership”),

and the Wammel Defendants represent to the Court that they have agreed to the entry of a

liquidation of the Wammel Defendants’ assets as detailed in the Agreed Order attached hereto

and as follows:

1. In accordance with 28 U.S.C. §§ 2001 and 2004 and paragraph 50 of the

Amended Order Appointing Receiver [Dkt. No. 48], the Receiver seeks the Court’s approval to

to liquidate or dispose of the following (i) by engaging any auctioneers and/or liquidators that the

Receiver deems necessary to accomplish the liquidation by public or private sale, or (ii) through

private sales to third parties (the “Wammel Liquidation Plan”):

a. the real property located at 4607 Hispania View Drive, League City, Texas

77573, for which the Receiver agrees to work with the current occupant of the

property to allow for removal of personal, non-receivership items;

b. the real property located at 8101 South Humble Road, Texas City, Texas

77565, including but not limited to furniture, fixtures, accessories, firearms

q. the 2015 Rolls Royce Wraith (VIN # SCA665C57F&X85400);4

2. The Receiver further seeks the Court’s approval to incur related reasonable and

necessary costs to liquidate or dispose of the above.

3. The Receiver further seeks the Court’s approval to deposit the proceeds as a result

of the liquidation or disposition of the Wammel Defendants’ assets into the Receiver’s bank

account for use in the ordinary course of the Receivership.

4. The Receiver further seeks the Court’s approval to terminate ongoing leases that

the Receiver deems unnecessary to the Receivership.

5. The Receiver further seeks the Court’s approval to sell any assets of the Wammel

Defendants’ seized by the Receiver valued at less than $10,000, without additional court

confirmation.

6. The Receiver further seeks the Court’s approval to release the funds listed in

Exhibit A attached hereto into the Receiver’s account.

The Receiver respectfully requests that this Court enter the attached Agreed Order. The

Receiver further prays for such other and further relief, general or special, at law or in equity, to

which she may show herself justly entitled.

2. The Receiver is further authorized to incur related reasonable and necessary costs

liquidation or disposition of the Wammel Defendants’ assets into the Receiver’s bank account

for use in the ordinary course of the Receivership.

4. The Receiver is authorized to terminate ongoing leases that the Receiver deems

unnecessary to the Receivership.

5. The Receiver is authorized sell any assets of the Wammel Defendants’ seized by

the Receiver valued at less than $10,000, without additional court confirmation.

6. The funds listed in Exhibit A are to be released into the Receiver’s account.
