DECISION (ON THE PAPERS) This is an application by Harris Estate Limited for renewal of an Off-Licence endorsed under Section 40 for remote sales in respect of premises situated at 6 Anzac Street, Waipara, known as "Harris Estate". No changes to the conditions of the licence have been sought by the applicant. The licensee advised there might be a change of company directors within the next few months. He was informed of the requirement to notify these changes to the Licensing Authority, including the timeframes involved. He was also reminded about timeframes for submitting renewal applications, as the last two renewals have been received very near to expiry and only after several reminders. The application was duly advertised and no objection or notice of desire to be heard has been received. In their reports, the Police, Medical Officer of Health, and District Licensing Inspector have raised no matters in opposition to this application, however the Medical Officer of Health made comment: ‘… a view of the applicant’s website shows that the premises are being made available for BYO events to which the applicant offers to arrange to supply wine. In order to maintain his suitability, I believe that the applicant should seriously consider applying for an on licence.’ The Inspector discussed possible compliance issues and the website with the applicant and another website check will be made two weeks after the licence issue to ensure amendments have been made. We are satisfied as to the matters to which we must have regard as set out in s.131 of the Act. We renew the licence on the existing terms and conditions until 20 February 2021, that being the anniversary date of the licence and three years from the most recent date of expiry. The importance of this was discussed with the applicant and it was confirmed that there is only one company director, Peter Parish, and that the shareholders are as shown on the Companies Office register. One of the shareholdings is a Trust which usually shows on the register as being in the names of the parties to the trust, rather than the name of the trust. The applicant advised the website is currently being re-developed by a new web designer and will be operational in approximately one month. This will include all the required information. DECISION (ON THE PAPERS) This is an application by Charles Wiffen Wines Limited for an off-licence in respect of premises situated at 1639 Parnassus Road, Parnassus, known as “Charles Wiffen Wines Limited“. The general nature of the business to be undertaken is that of a Winery endorsed under Section 40 as Remote Sales only. A remote sale of alcohol can be made at any time on any day but is subject to the restrictions on delivery imposed by sections 48 and 59(1). Charles Wiffen Wines Limited has held an off-licence since 1999 to make remote sales, however the licence was not renewed by the expiry date of 21 November 2017. The applicant was therefore required to lodge an application for a new off-licence. The application indicated that the company had two directors; however the Companies Office register indicated that Arthur George Charles Wiffen (Charles) is the sole company director. The shareholders are Charles and Sandra Wiffen and their trusts. A change was made in January 2017 when the former trustee died, and subsequently, the trustee company became a shareholder on behalf of the Wiffen’s trusts. The application was duly advertised and no objection or notice of desire to be heard has been received. In their reports, the Police, Medical Officer of Health, and District Licensing Inspector have raised no matters in opposition to this application. A comprehensive Alcohol Management Plan (AMP) has been submitted as part of the application. The AMP provides guidelines for event security, provision of a safe area for patrons, the briefing and pre-event training of staff, and guidelines for how event staff will respond to managing patron behaviour and prohibited persons. The event will be overseen by a team of approximately 40 people, with a core security team of 20. The team will include at least seven approved crowd control security staff. The bar staff will have no other duties beyond serving drinks. There is a band booked and there will be amplified music until 12 midnight/1.00am.
