MEETING OF THE BOARD OF MEDICAL EXAMINERS OF NORTH CAROLINA Carolina Hotel, Pinehurst, North Carolina May 1- 4th, 1955 The Board of Medical Examiners of the State of North Carolina convened at the Carolina Hotel, Pinehurst, North Carolina, Sunday, May 1st, 1955 at 10 A. M. The meeting was called to order by Dr. Amos N. Johnson, Pre- sident. Drs. Newsom P. Battle, Joseph J. Combs, Secretary-Tre as- urer, L. Randolph Doffermyre, Clyde R. Hedrick, G. l4estbrook Murphy and Heyward C. Thompson were present. Dr. Murphy was excused to attend to other business of the State Medical Society. RE: D Pa M Bu - The matter of Dr. Burd, who is apply- ing for a limited license to come across the borders from Virginia to practice, was discussed. Dr. Burd was declined the privilege of taking the written examination of the Florida Board of Medical Exam- iners because he declined to swear allegiance to the United States flag due to his religious belief. VERDICT: Dr. N. P. Battle moved that Dr. Paul M. Burd appear before the board. This motion was duly seconded by . Dr. L. R. Doffer- myre and passed. (See page 25 these Minutes) .) RE: Dr N R St v n (See p 47 these Minutes) Dr. Joseph Stevens of Greensboro appeared on behalf of his brother looking toward a special limited license to the Cone Memorial Hospital in an effort to rehabilitate him. He stated that he was graduated by the Medical College of Virgn ia in 1940, was licensed in Virginia and liest Virginia and practiced in %Jest Virginia before going into the Navy. That he volunterred for the Marines and was in the Pacific over two years in combat; that he returned home and found his wife had divorced him; that he married a girl in California almost as soon as he landed. That he was sentenced in Criminal Court in McDowell County, Nest Virginia for second degree murder and sentenced to five to eighteen years. That he was found by the psychiatrists to be mentally ill. That he was treated: at the teston State Hospital for mental illness, received shock therapy and his mental condition cleared up. Dr. Stevens related that his brother, Dr. N. R. Stevens, was paroled to his custody in December, 1954, and he has been employed at Cone Mills in Greensboro, with a good work record. Dr. Stevens stated there was no question of any drugs nor alcohol at any time. He said he would be on parole until October, 1957. Dr. Stevens stated that he had talked with officials at Cone Mem- oriall Hospital and they will give him a residency there if he can obtain license. He also stated that Dr. Graves, Secretary of the Virginia Board of Medical Examiners, had told him that Dr. N. R. Stevens could be re- instated there in June. Dr. Stevens left transcript of medical testimony given at the trial of Dr. W. R. Stevens and evidence of parole to North Carolina. RE: D Pa M Bu - The matter of Dr. Burd, who is apply-ing for a limited license to come across the borders from Virginiato practice, was discussed. Dr. Hedrick: He is applying for reinstatement of original Virginialicense, should he get that would he then want to transferto North Carolina or could under his parole?He would probably apply for reciprocity to North Carolinaand if that is granted might stay in the state. The chancesare he can transfer to Virgi nia if the North Carolina ParoleBoard approves of it and if Nest Virginia says he can do it.He has to have permission of both states'

Dr. Johnson: Dr. N. R. Stevens is in a non-medical job at Cone Mills.

Dr. Joseph Stevens was advised by the president that the board woulddiscuss this further and advise him.

RE: H b t I Ho owitz appeared with incomplete credentials,applying for special limited license to Rex Hospital. He stated he isin the United States Navy, stationed at the Recruiting Office in Raleighand has two nights a week opens

VERDICT: Dr. Herbert I. Horowitz was approved for special limitedlicense to Rex Hospital if and when, his credentials are completed andapproved by the secretary.

RE: Dr J J Crumb e Jr - See previous Minutes - Dr. Crumbleyhas requested the privilege of appearing before the board on May 2nd '

Dr. Crumbley, at the request of the Board of Medical Examiners vol-untarily surrendered his medical license in June, 1952 due to the factthat he failed to establish a permanent practice in this state. (Seep 45 these Minutes)

RE: D Si n 0 n k — Dr. J. Lamar Callaway appeared on behalfof Dr. Olansky with reference to medical licensure in this state.

Dr. Olansky was graduated by the Anderson College of Medicine,Glasgow, Scotland, and given the M. D. degree by the Scottish ConjointBoard of Glasgow, Scotland in 1940. This medical school is not approvedby the Council on Medical Education of the American Medical Association.

Dr, Callaway stated he would like to have Dr. Olansky corre to Dukeas a permanent member of the Department of Dermatology and asked that hebe permitted to take the examination of the board; that Dr, Olansky waswell trained and had done extraordinarily well in everything he had done.(See file for complete details) Dr. Olansky was advised by the boardthat native North Carolinians who were graduated by grade B schools werenot eligible for medical license in this state.

VERDICT: Dr. Clyde RE Hedrick moved that the Board of Medical Exam-iners would consider Dr. Sidney Ol ansky for licensure if and when he pre-sents to this board an M. D. degree from a grade A medical sch ool inthe United States. This motion was duly seconded by Dr. L. R. Doffermyreand passed.

RE: Dr Cecil Hou ie graduate of the University of Manchester,England, in 1946, with the M. B. degree appeared petitioning for the pri-vilege of taking the written examination for medical license. Dr. Hougiehas a position as instructor in Pathology at the University of NorthCarolina School of Medicine.

Dr. Fortin was granted special limited license to the Universityof North Carolina School of Medicin: October 4th, l954, at which time heappeared.

VERDICT: Dr. Clyde R. Hedrick moved that Dr. John N. Fortin begranted the privilege of taking the written examination in June. Thismotion was duly seconded by Dr. N. P. Battle and passed unanimously.

RE: ~01'I B~Str nd, Durham, North Carolina - The secretary re-ported to the board that Dr. Stroked was indicted in Burham County forviolation of the State Narcotic Law and was convicted at the April,l955 Term of Court of Durham County, North Carolina. That he was sen-tenced to the Central Prison on three counts, judgment suspended, and plac-ed on probation for five years. Whereupon the Board of Medical Examiners,

VERDICT: Resolved that charges be presented. . against Dr. N. A. Strowdbased upon his alleged violations of the State Narcotic Act and any otherviolations which may come to the attention of the secretary and that hebe notified of such charges by the secretary in accordance with |:he regu-lations of the board and given an opportunity for hearing upon such chargesat the meeting of the board to be held in June, l955 and for such actionby the board following the hearing as may be warranted.

ed that he had received a report of investigation on Dr. Hyatt bythe State Bureau of Investigation, and that according to newspaper re-port on April 29th, l955 Dr. Hyatt had been indicted by the Grand Juryfor violation of the Narcotic Law.

VERDICT: The above information in regard to Dr. A. L. Hyatt wasaccepted as a report and the matter was continued until the June, l955meeting.

RE: D R H H ck r, Washington, North Carolina — The secretaryreported that he had received a report of investigation from the StateBureau of Investigation giving evidence on a known addict selling nar-cotics; that there was evidence that the addict obtained his supplyfrom the Tayloe Drug Company in Washington, North Carolina on prescrip-tions signed by Dr. R. H. Hackler; that all prescriptions were type-written on the drug store's blanks. That on January 31st, l955 theState Board of Health upon inquiry from the secretary advised that noreport was found since August l0th, l954, where this addict had been re-ported as such by Dr, Hackler.

VERDICT: Dr. N. P. Batti. e moved that Dr. R. H. Hackler be request-ed to appear before the board at its next meeting with regard to the re-port of the State Bureau of Investigation. This motion was duly second-ed by Dr. L. R. Doffermyre and passed unanimously.

RE: Dr. J. N. Robertson, Fayettevil)e, North CarolinaD H A E drid g Dunn, North Carolina

The secretary reported that he had received a report of investigationfrom the State Bureau of Investigation that the above physicians had beensigning prescriptions for narcotic drugs in blank. The board took cog-nizance that these physicians had violated the law, however, that theyhad not maliciously sold the same and were not using narcotics themselves.

Dr. N. P. Battle moved that the secretary be directed to write aletter to Dr. J. N. Robertson and Dr. H. A. Eldridge stating that theirirregularities in writing of narcotic prescriptions had been called tothe attention of the Board of Medical Examiners by the State Bureau ofInvestigation. That these doctors be notifed that if further violationsbe called to the attention of the board that they will be subpoenaedto appear before the Board of Medical Examiners with the question in mindof revoking their licenses. This motion was duly seconded by Dr. JosephJ, Combs and passed unanimously.

The meeting was adjourned.

RE: Dr J F R~it, Bryson City, North Carolina — The secretaryreported that he had received report of investigation from the StateBureau of Investigation in regard to narcotic addiction of Dr. Riter,who is about 77 years of age, which report revealed that he had pur-chased on his government order form a large amount of narcotic drugs.That upon interview April 21st, l955, Dr. Riter stated he had no recordsof dispensing narcotics; that he had taken all the narcotic drugs orderedby him himself. It was stated in the report by the agent that from ob-servation, Dr. Riter is not able to practice medicine.

VERDICT: The secretary was directed by the board to confer with theState Bureau of Investigation and with their approval, refer the informa-tion regarding Dr. J. F. Riter to the Federal Narcot ic Bureau and askthat their agent in this area give us a report before June 20th, l955.

RE: ~D Geor e W Jo ner, Asheboro, North Carolina — The secretaryreported that he had received report of investigation from the StateBureau of Investigation in regard to narcotic addiction of Dr. Joynerdated April, l955. It was stated that at that time Dr. Joyner was apatient in a hospital undergoing treatment for addiction to narcoticdrugs. That investigation revealed that he had been obtaining narcotic

"gs for himself using the name of former patients. That he admittedthis in the presence of the Chairman of the Board of Directors, theChairman of the Medical Staff and the hospital administrator. Dr. Joynerwas suspended from the hospital staff and requested to take treatment atsome recognized institution for a period of four and one-half months,effective February 7th, 1955, which suspension was accepted by Dr. Joyner.

VERDICT: Dr. L. R, Doffermyre moved that Dr. George W. Joyner beasked to appear before the Hoard of Medical Examiners at the June, 1955meeting. The motion was duly seconded by Dr. Clyde R. Hedrick and passed.

The secretary reported that Dr. Jessner advised April 22nd, 1955 thatshe had become a permanent resi dent of |he State of North Carolina and astaff member at Memorial Hospital; that he had written Dr, Jessner thatshe had complied with the requirements of the Board of Medical Examinersand that she was duly Licensed to practice medicine in this state.

VERDICT: The secretary was instructed by the board to write Dr.Beatrice Enson that she might appear before the Board of Medical Exam-iners on Sunday, June 19th, and petition for the privilege of takingthe written examination due to the fact that she plans to remain in thestate for one year.

RE' Minutes: The president instructed that the reading of the Januaryand February, 1.955 Minutes be postponed and read with the May, 1955 Min-utes at the June meeting.

RE: Dr Au tin Taber H d Jr was granted limited license toDuke University School of Medicine July 30th, 1954. He is applying forconversion of limited license to full license and stated that he plann-ed to locate in Rufherfordton, North Carolina with Dr. J. G. Mebane.

VERDICT: Dr. Austin Taber Hyde, Jr. was approved for conversionof limited license to full license if and when his credentials arecompleted and approved by the secretary.

RE: D Wi ard W G s who has been under the surveillanceof the board, was discussed by Dr. H. C. Thompson. He stated thatDr. Griggs wanted to appear before the board in June to request re-commendation to the Narcotic Bureau for reinstatement of his narcoticlicense.

VERDICT: The secretary was instructed to request narcotic investi-gation and to remind Dr. Thompson to obtain a specimen of urine to be ex-amined for narcotics and barbiturates.

The meeting was adjourned.

A.What is the involvement about the driver's license?It was a little unfortunate accidents I was in a hurryto get back to the hospital on e afternoon and I had mylicense suspended.

75 miles an hour?That's right. I was on duty and I was late.

That is thereason I have been doing only a couple of hours teach-ing and Dr. Anderson suggested that I get my NorthCarolina license so that I could more or less work asa preceptor under him for the next two or three years.

What do you plan to do after the two or three years?I may go back to what I had originally planned. I hadstarted on a medical missionary in the Belgian Congo,but I understood I would have to have regular NorthCarolina license to work.

The question of a limited license was discussed and explained toDr. Beckner. Dr. Beckner said his status was not a resident.

stated he was considering a position with 'the Atlantic Coastline Railroad.He said that he has a medical license on the basis of written examinationin North Dakota.

Dr. Shannon was advised to communicate with the secretary if he is go-ing to Rocky Mount. The president informed him that citizenship was aprerequisite for full, license in this state, but that limited licensemight be granted; that if he then left the Coastline to go with some otherorganization, he would have to apply for change in the limitation of L ic-ense.

Dr. Shannon said he intended to apply for citizenship; that his wifeis a South Carolinian.

It was explained to Dr. Shannon that if limited license were grantedunder these conditions that six years would be allowed to obtain citizen-ship; that by law it takes five years to become naturalized, and one yearof grace allowed; that if citizenship were not obtained in six years, hewould no longer be eligible to hol. d license in North Carolina.

RE: Erne t Jone , colored, Milton, North Carolina — The secretaryreported that a physician from Halifax County, Virginia, which bordersthe North Carolina line, had reported that Ernest Jones bore the reputa-tion of practicing medicine without a license. That the State Buze au ofInvestigation had been asked to make an investigation, but insufficientevidence was found on said investigation to warrant indictment.

VERDICT: Dr. L. R. Doffermyre moved that a copy of the group photo-graph be ordered and sent to the executive office of the State MedicalSociety. This motion was duly seconded by Dr. N. P. Battle and passedunanimously.

RE: ~Dr J hn Char Casa . (See previous liinutes) appeared topetition for the privilege of taking the written examination for medical.licensure. Dr. Cassel is on the faculty of the School of Public Health.He is a graduate of the University of Witwatersrand, .'South Africa in 1946and has come here highly recommended. He received the Master's Degree inPublic Health at the University of North Carolina. He stated upon inquirythat he expected to become an American citizen, and was advised that hewould be required to obtain citizenship before he would be granted a fulllicense, provided he took and passed the written examination. It was ex-plained to Dr. Cassel that if limited license is granted under the condi-tions that six years would be allowed to obtain citizenship; that by lawit takes five years to become naturalized, and one year of grace allowed;that if citizenship not obtained in six years, he would no longer be eli-gible to hold license in North Carolina. It was al. so explained to Dr,Cassel that his license would be l. imited to place, if he made a change,he should apply to have the limitation changed.

VERDICT: The board reso). ved that Dr, John Charles Cassel. be grantedthe privilege of taking the written examination.

VERDICT: Dr. H. C. Thompson moved that Dr. W. R. 'Stevens be per-mitted to appear before the board in June. This motion was duly second-ed by Dr, L. R. Doffermyre and the motion carried.

RE: Dr David E P.umm r — It was reported to the board that Dr.Plummer had "bluegrassed" himself since his last appearance before the boardand had been discharged from the hospital in March, 1955.

VERDICT: The secretary was instructed by the Board of Medical Exam-iners to investigate and if Dr. David E. Plummer had violated his proba-tion under the ruling of the board of July 30th, 1954; that the necessaryprocedure be followed.

RE: S c et i n — Dr. N. P. Battle moved that the extra ex-p enses for secretarial assistance for this meeting be approved. This motionwas duly seconded by Dr. H. C. Thompson and the motion carried.
