HCPC1801 - Audio Recording Transcription and Additional Services - Clarification Questions-Answers - ALL Bidders - 31Jul18 Please note that the statistics provided in the clarification responses relate to the HCPC only. Please also note that the provision of translations, interpretation and video recording is something the HCPC are planning to introduce, and as such we do not have any data available on past usage or future requirements. 1. There is quite a lot of information in the ITT about the requirement to provide audio recording and transcription services, but there is not very much information about the requirement to provide the other services listed in the Pricing Schedule. Please could you provide more information about these services and the circumstances in which they will be required? Please note that the statistics provided in the clarification responses relate to the HCPC only.

Please also note that the provision of translations, interpretation and video recording is

something the HCPC are planning to introduce, and as such we do not have any data available

on past usage or future requirements.

1. There is quite a lot of information in the ITT about the requirement to provide audio recording and transcription services, but there is not very much information about the requirement to provide the other services listed in the Pricing Schedule. Please could you provide more information about these services and the circumstances in which they will be required? These are optional/additional services that we are interested in and they are not a core part of

the framework. They are likely to be required on an ad-hoc basis to ensure that our hearings are

accessible to all parties.

2. For all the items listed in the Pricing Schedule, please could you confirm that when you are referring to the number of days for the turnaround, you are referring to working days? We are referring to working days.

3. Please could you clarify why pricing items for ‘1 to 3 days attendance’, ‘3 to 5 days attendance’ and ‘More than 5 days attendance’ have been included in the Pricing Schedule for Recording Services and Video Recording Services. If a logger or videographer is required for 5 days, then won’t the price be five times the full day attendance fee? This is to give the supplier the opportunity to adjust the pricing in accordance with the days

required. For example, some suppliers may prefer to be offered lengthier hearings and may

adjust their pricing schedule to reflect this.

4. Please could you clarify what is required for the pricing item ‘more than 5 days attendance’? It is not possible for tenderers to provide a price for an open-ended number of days’ attendance. For example, if a recording technician or videographer is required for 10 days, then this will naturally cost more than if they are required for 6 days. If a recording technician or videographer is required for 10 days, then this will cost 10 times the rate for a full day’s attendance and if they are required for 6 days, then this will cost 6 times the rate for a full day’s attendance. 5. Please could you amend the transcription rate per folio for ‘1 – 2 days’ for both the Transcription Services and the Transcription Services from Video as this is an inexact length of time? We can provide a price for a turnaround of 1 day and we can provide a price for a turnaround of 2 days, but we can’t provide a price for somewhere between 1 day and 2 days. Please consider 2 days where is mentioned 1-2 days. Price schedule was amended to include this clarification.

versions. Depending on recording methods, breaks, etc may also need to be removed from the

audio.

8. Please could you clarify what is meant by ‘Video Files (Edited)’? In what way do the video files need to be edited? Video files may only need to be edited for non-tribunal requests

9. Please could you amend the Video Files (Edited) rate for ‘1 – 3 days’ turnaround and ‘3 – 5 days’ turnaround as these are inexact lengths of time? We can provide a price for supplying the video files from filming an event within 1 day, within 2 days, within 3 days, within 4 days and/or within 5 days. We can’t provide a price for somewhere between 1 day and 5 days. Please see the response to question 5. The price schedule was updated.

10. Please could you clarify what is required in the pricing item ‘Video Files (Edited) - more than 5 days turnaround’? It is not possible for tenderers to provide a price for an open-ended turnaround. This price is set aside for exceptional requests where more than 5 working days may be needed.

It is expected that the supplier would forewarn the contracting authority of this in advance.

11. For braille, do you require uncontracted or contracted braille? We may need either, depending on the requirements of the end-user

12. Please could you clarify why you require a price for a ‘Front Page Colour (charge per A4 page) for braille? Braille is not written in colour. Please feel free to leave this blank

13. Please could you clarify what is meant by ‘Logo on Braille (charge per A4 page)? This should read – ‘Logo in Braille’

14. Please could you confirm how many hours you consider to be in a day for the day rates for Interpreting Services? 8 hours

15. The line items of ‘British Sign Language (BSL) (rate per day)’ and ‘International to English (rate per day)’ do not reflect how interpreting services are priced. The cost of interpreting services varies depending on the language pair required, the type of interpreting service required (consecutive, simultaneous, liaison or whispered), the type of event, accommodation and transport costs, equipment costs, etc. It is not possible to just provide a rate for ‘British Sign Language (BSL) (rate per day)’ or ‘International to English (rate per day)’. Pricing schedule was updated

16. Please could you clarify what is meant by ‘Marketing / Publication’ in the Translation Services section of the Pricing Schedule.

This is for the purpose of non-tribunal requests. Some suppliers may have a set rate for

marketing or publication requests

17. The heading ‘Target Language – International’ and the request to provide one rate for any target language does not reflect how translation services are priced. It is standard to have six pricing bands for different languages depending on complexity/rarity. Rates for translation services also depend on the timeframe for delivery, the technical level of the text and the format of the source file. Please could you amend your pricing schedule to reflect this? See response to question 5

18. Is there any requirement to translate audio recordings of speakers in a foreign language into English transcripts? Generally yes, but our specific requirements will be set out on the order form.

19. Can data be sent outside the EEA for transcription and translation purposes, provided that the supplier ensures the security and confidentiality of the data transfer process? There is nothing to stop the suppliers sending data outside the jurisdiction but HCPC would be

under a duty to inform the individuals whose data was being transferred and this would come at

an administrative cost to HCPC, which HCPC might need to consider in evaluating comparative

bids.

Moreover it would seem inevitably to be the case that the supplier itself would incur

administrative costs in handling the data transfer, including the security aspects. Clearly they

would need to absorb those costs in their bid and not pass it onto to HCPC i.e. they should not

expect HCPC to pick up those additional costs. This should be made clear in any response.

20. Please can you provide a breakdown of the volumes of bookings made for all services on the Pricing Schedule in the past year or any other historic data to give tenderers an idea of the volumes required for each service. Please see the advisory note at the top of this document

21. With regards to translation, please could you provide historic data for the volumes of: - Language combinations required/used - Number of documents translated - Number/Average number of words translated per document - Required turnarounds

22. With regards to interpreting, please could you provide historic data for the volumes of: - Language combinations required/used - Number of bookings for each language combination - Length of interpreting assignments - Location of interpreting assignments

23. Please could you advise when the contracts that the other regulatory bodies currently hold for these services will come to an end? We are unable to publish this information

24. Please could you provide an indication of the anticipated volume of orders for each of the services listed on the Pricing Schedule for each year of the future contract? Please see the advisory note at the top of this document

25. You have stated that the HCPC’s annual spend for recording and transcription services is currently in excess of £490,000 and that you estimate that there will be an annual expenditure of £2,000,000 across the Health Regulators. However, the rebates section of the Pricing Schedule only goes up to £350,000. Please could the rebates section be extended to the maximum value of the contract? The rebates table is an example. The rebates section will be evaluated and scored based on the

total rebate for a turnover of £400.000. The Tenderers should propose the rebates table and

percentages taking in consideration their own pricing model and the other criteria like the annual

estimated value for the framework.

26. The calculations for the rebates section seem very complicated. Would it be possible to simplify the rebates structure, please? For example, it would seem simpler if one reduction applied to the total value of annual turnover, i.e. if the supplier has put forward a rebate of X% for turnover of £120,000, then X% applies to that entire amount. The HCPC considers this model to be adequate.

27. We understand that the evaluation team do not wish to read extensive ITT responses, but the word limits for answering the questions are very restrictive, especially given the length of some of the questions. Would it be possible for any of these word limits to be extended, please? We have agreed to raise the word count on the following:

2 - Method Statement: +200 words

3 - Resources: +200 words

4 - Communication: +100 words

5 - Monitoring: +100 words

The total permissible word count for the following questions is now:

2 - Method Statement: 800 words

3 - Resources: 700 words

4 - Communication: 400 words

5 - Monitoring: 250 words

28. We note that the Service Providers may be required to produce transcripts of historic recordings produced by other (including previous) suppliers. Please could you advise how the audio and log of these historic events will be provided to the Service Providers? Please could you also confirm that the Service Providers will not be held to the same standard service levels as for other transcripts since they will have had no control over the quality of the audio recording and log made by another supplier? We wouldn’t expect the same service standards, however would be determined by the contract authority at the appropriate time.

29. You have advised that the Pricing Schedule will be evaluated by calculating the prices for four model scenarios using the pricing provided in the Pricing Schedule, but this will not be possible for Model Order 4 because 1) you have specified the language pair for the interpreting requirement, but not the kind of interpreting that will be required (consecutive, simultaneous, liaison or whispered), 2) you have not stated the turnaround time required for the transcript, 3) you have stated that the transcript will be 1200 folios long, but you have not said how many A4 pages that will be, so it is not possible to calculate the cost for the Braille translation. Please could you review this?

30. You have advised that the Pricing Schedule will be evaluated by calculating the prices for four model scenarios using the pricing provided in the Pricing Schedule, but this will not be possible for Model Order 3 because you have not stated the turnaround time required for the transcripts. Please could you review this? Standard (between 2-5 days)

31. You have advised that the Pricing Schedule will be evaluated by calculating the prices for four model scenarios using the pricing provided in the Pricing Schedule, but this will not be possible for Model Order 2 because you have stated that the audio recording will be required at an expedited rate, but the term ‘expedited rate’ does not correspond with any of the turnaround times listed on the Pricing Schedule. Please could you review this? Expedited turnaround – 1 day or less. Standard – 2-5 days turnaround

32. You have stated on page 23 of the ITT that ‘payment will not be made for days used to travel to any venue’, but this is in contravention of the ruling made in 2015 by the European Court of Justice that time spent travelling to and from first and last jobs by workers who do not have a fixed office should be regarded as work. The Service Providers will have to pay their workers (recording technicians, videographers, interpreters, etc) for time spent travelling to assignments. How should this cost be reflected in the Pricing Schedule? The ITT approach does not render HCPC in contravention of any EU law or decision. It would be up to the suppliers to deal with their employees’ or contractors’ costs. Presumably their proposed fees would need to reflect/ absorb that extra cost. Alternatively they can say in their bids that they intend to pass on the costs of travel of their employees. We would be grateful if suppliers can confirm (where applicable) that they have factored in the costs of travel of their employees in their pricing.

33. Are the appendices we disclosed as part of the SQ to be consider part of the final bid or should we duplicate where appropriate? Please duplicate where appropriate

34. We have noted a contradiction in the in the appointment guidelines. Would it be possible to

clarify which of the below is correct?

• Section 2.1 intends procure a panel of 4 service providers.

• Section 3.1 up to 4 providers.

The HCPC has the intention of procuring a panel of 4 suppliers as this is our optimum number. This is on the basis that we receive at least 4 compliant tenders.

35. Could you expand on what is meant by the following (as per page 20 of the ITT):

• Video files (Edited)

• Audio files (Edited)

Video files: video recording requested by the HCPC. Requests that are not made for legal

purposes may require editing.

Audio files: audio recordings of the hearing edited for public and private use with the appropriate

redactions made for the former.

36. If there are multiple hearings on one date, would editing of the audio/video be required to

provide HCPC with one specific hearing? Or would it be for the purpose of redacting/editing

out any breaks that are not required on the final recording?

We would require the audio of a specific hearing with breaks etc removed from the recording.

37. If possible, can you provide statistics for the following:

• Hearings: average audio length

• Transcripts: average folio counts

• Braille/Translation/Sign Language services: average order quantity

• Translation: frequently requested languages

Hearings: we are unable to provide reliable data due to the range of hearings we list Folios: we

38. Can you please provide details on potential redaction requirements?

Redaction would typically include the anonymization of patients and service users as well as any

discussions deemed as ‘private’ by the Tribunal Panel. We require a private and public version

of transcripts.

39. Are transcripts ever ordered by anyone other than HCPC (or one of the other Regulators), e.g.

by a complainant?

No, all transcript requests are to be managed by the regulator unless informed otherwise.

40. Are you able to provide details/locations of the hearing centres?

We have a dedicated Tribunal Centre in London. Our external hearings are booked on an ad-hoc

basis at hotels and conference centres. Some of the most common locations include Belfast,

Glasgow, Edinburgh, Cardiff, Manchester and Birmingham.

41. Transcription - Of the various events FTP directorate will hear, what is the typical/average

duration of each event?

8 hours per day

42. Translation services:

Can HCPC indicate the expenditure on such services during previous years? Please see the advisory note at the top of this document

Where it states Non-Technical/Technical English, can you clarify whether Technical refers to medical, legal, or another form of technical? Usually medical or legal

Can you indicate please what the average length of the document to be translated would be? At this stage we cannot say. Please see the advisory note at the top of this document.

43. Video recording:

Does HCPC require a certain quality/resolution level for recordings or specific recording equipment to be used? HD quality will be sufficient

Will multiple camera angles be required in order to capture all speakers? In most cases no, unless stated otherwise

In an average year, how many events are video recorded? Please see the advisory note above

44. Interpreting service - In order to offer HCPC the best value for money, we would advise offering tiers of prices as some languages are more competitive than others. Would it be acceptable to present HCPC with different price tiers/ranges? An updated pricing schedule is attached.

45. Audio/video files - Where it states ‘Audio files (edited)’ and ‘Video files (edited)’, can you please

and our usual approach is to book multiple hearings on a day.

No, usually both formats would be required

69. Can we supply different interpreting/translation rates depending on the language required? The requirements for foreign language services, assuming this is referring to translation services, are not a core service of the Framework and we do not envisage this to be used much. We have updated the pricing schedule to allow the inclusion of the different rates per foreign language or groups.

70. Pricing per folio –please can you confirm the desired delivery for the 1-2 days’ turnaround?

Would this be considered a 48-hour turnaround request, or please can you clarify what a 1-2-

day turnaround would be.

71. If you currently have a contract, or are about to enter a contract with one of the panels in the

list who can use the framework, does this mean that your contract must come to an end before

they can join this framework agreement?

What they are referring to is whether or not the other potential members of the framework,

who are currently under contracts for similar services, are they required to complete their own

contracts before joining this framework agreement and if so do you have the details of when

they would join.

All contracting Authorities may access the Framework Agreement. They are not required to

complete their current contracts but they might decide to do so for commercial reasons,

taking in consideration their current contract provisions.

72. ‘Translation services’ – does this mean written translation of documents or live translation

services at the hearings (in other words, interpretation)

time to time.

80. 2.1 Sub-contractor’s special terms - can you please give examples of what you mean by special

terms, and to what level of detail is required?

The suppliers are to detail any specific terms they may have with subcontractors. The

Framework agreement draft Terms and the Call Off order and Call of terms include

references to Sub-contractors management and requirements.

81. 3.1 Technical features and investments used to improve service - what Investments information

do they require beyond the make and model of the equipment that we use for example do they

want to have a capex figure by type?

Any investments made to new or existing equipment in recent years that have contributed

to an improvement in the service you deliver.

82. Pricing Schedule - non-hearings work - can you please elaborate on the types of work for

example magazines websites, regularity of such work and volumes?

83. How does HCPC envisage allocating the work across the framework?

The suppliers who are awarded a Call Off contract by the HCPC under this Framework are

expected to receive an equal share of the work available.

The other contracting authorities (other regulators) would be able to run a further

competition or direct award a Call Off contract under this Framework Agreement.

84. We assume that TUPE does not apply but please can HCPC confirm this is correct?

That’s correct.

85. We understand from the ITT documentation (2.7) that events are predominantly held at the

HCPC Regulator’s offices or Tribunal Centre in London. What percentage split of events are held

in London compared to the rest of the other regional venues?

As stipulated in the SQ clarification questions:

• % of HCPC hearings in London - 91%

• % of HCPC hearings (outside London) in rest of England – 1.6%

• % of hearings in Scotland - 3%

• % of hearings in Wales - 4%

89. Rates for Foreign language services vary by language. Can the pricing schedule be amended to

allow for this?

The requirements for foreign language services, assuming this is referring to translation

services, are not a core service of the Framework and we do not envisage this to be used

much. We would consider the price schedule to be amended to allow the inclusion of the

different rates per foreign language or groups.

90. Are diagrams excluded or included regarding the maximum word count for answers

Diagrams are included in the word count

91. What editing is required for the audio and video files? Are there guidelines for editing?

Public and private sessions should be available. The same guidelines that apply for written

transcripts apply

92. BSL – there is a range of qualification levels for BSL interpreters and also a range of service fees

associated with BSL interpreters. Can you confirm the qualification levels and minimum

professional standards you require? Do you require NRCPD registered level 6 BSL interpreters?

We require level 6 as a minimum

93. Can you confirm that where you have used the words ‘French translator’ in Model order 4 you

are referencing a French interpretation service, i.e. an interpreter who would attend and

interpret spoken dialogue from French to English/English to French? (Translation generally

refers to words on a page, translating the written word from one language to another.

Interpreting is usually an attendance-based verbal communication service)?

Apologies, this model should be for a French interpreter rather than a translator

94. Can you confirm whether you require consecutive or simultaneous interpreting services?

Consecutive is when one person speaks, then the interpreter speaks, then the person etc.

Simultaneous interpreting requires a booth (which incurs additional fees) and is generally used

for conference style interpreting when the interpretation is layered over the dialogue in real-

time).

Consecutive interpreting will be required

95. The draft agreement references the enhanced Cyber Essentials Plus. Is the regular Cyber

Essentials certification the baseline standard for HCPC, but it is possible that Cyber Essentials

Plus could be requested in additional call offs for other authorities? Please define the regular

HCPC Cyber Essentials requirements.

96. The draft framework agreement references that a copy of the Contracting Authority’s expenses

policy can be provided upon request – can this be issued?

The contracting authority’s expenses policy shall be provided to the supplier upon request

as part of Call off Agreement.

97. Are there any stats regarding the number of cancelled attendance orders?

In 2016 13% of all orders were cancelled. In 2017 the cancellation rate was 10%.

98. Pricing schedule: What are the turnaround times for the required translation services?

We would expect an average turnaround time of 10 working days, but we appreciate it may

vary depending on complexity.

99. Pricing schedule: Interpreting and translation: What are the common languages?

We have not had enough orders to determine common languages.

100. Can you clarify if the methodology proposal (Question 2.1) is restricted to the primary

services and excludes the additional language, audio and visual services due the restricted word

count?

There are no restrictions as such but it would be advisable to focus on the primary services

for this question.

101. Please can you clarify what is meant in Question 3.1 by “the amount of time you

anticipate these personnel will spend delivering the service”?

We would like the answer to this question as a percentage if possible.

102. Can you confirm if there is a limit to the number of personnel who can attend the

interview?

No more than 6 attendees.

103. Please can you clarify the following with regard to the Pricing Schedule - Logo on Braille;

is this printing a logo on pages that are then also brailled?

Yes.

104. What video recording service is needed exactly and for what end use?

We envisage that video recording may be used in a number of ways, but primarily for the purpose of pre-recorded witness evidence.

105. Can you outline how much of the hearing/meeting needs to be documented and video

recorded? For example, in a legal videography capacity, most requirements are only for those

speaking who are being questioned, or those who are giving evidence of some sort. Is this the

same for HCPC requirements?

We have not put this into practice yet but we expect this to be the case.

106. How many people would be speaking who need to be recorded? This may govern

whether it could be a 1, 2, or 3 person job.

At the moment we envisage two, but that would need to be determined on a case-by-case basis.

107. Do you require certification for videography as per videography for legal depositions?

In most cases, yes.

108. Legal video recordings are in most cases not edited because it could be viewed as

doctoring evidence – can you clarify the video editing requirements?

Video editing may be required for non-legal requests.

109. With regard to the KPIs included in the Draft Framework Agreement Terms and

Conditions – are these specific to the HCPC contract, or will they also apply to all future call off

tenders for other listed agencies in the future? Or will subsequent call off tenders specify their

own KPIs?

The KPI’s included in the Draft Framework agreement Terms and Conditions are specific to measure supplier and contract performance between the HCPC the Framework Agreement Authority and the suppliers. The Call Off contract with other contracting authorities (Regulators) may include similar KPI’s and other performance metrics related with the service requirements and the service levels.

110. Please can you provide clarity regarding the Management Charge (page 55 of the draft

agreement), can you please confirm that these 0.5% charges of all charges for services invoiced

only applies when there are issues with the provision of the Management Information as

outlined in clause 18?

The management charge has the meaning given to it in paragraph 6.2 of Framework Schedule 9 (Management Information).

111. Can you confirm that in Model order 4, the requirement is for a French interpreter on

site to interpret the spoken word, not a French translator to translate the words generated

from the transcript?
