HB14-1102 Gifted Education Programs This bill makes clarifications and adds specificity to statutes concerning the education of gifted students. Each Administrative Unit (AU) shall adopt a gifted education program that can be implemented within available resources. The program plan must be submitted to and reviewed by CDE. Each AU must make a good faith effort to hire and retain at least one qualified person in gifted education to administer the program plan. Each AU is strongly encouraged to conduct a universal screening of enrolled students at a grade level no later than second grade to identify gifted children and a second screening in conjunction with the creation of individual career and academic plans. Administrative units will be reimbursed for universal screening and employment of a qualified person in gifted education (up to .5 FTE) subject to receipt of a grant application and the available grant appropriation provided by the state for a given fiscal year. SBE must update and expand the rules for gifted education programs. The bill codifies the State Gifted Education Advisory Committee, modifies the committee’s composition and permits members to be reimbursed for expenses. Rules shall include, but not be limited to: procedures for identification of gifted children and collection of data on their areas of giftedness; required contents of an advanced learning plan and procedures for creating the advanced learning plan; criteria and procedures to ensure accountability for academic achievement, growth and evaluation of gifted programs; procedures for family engagement and communication; and, procedures to resolve disagreements with parents. To assist an administrative unit in implementing its program plan, each AU is strongly encouraged to establish a local advisory committee. HB14-1118 AP Incentives Pilot Program

This bill creates the Advanced Placement Incentives Pilot Program. • Only school districts identified as rural by CDE may participate and total participation is capped at 475 annually. • To participate a rural school district must require that all tenth graders take a pre-collegiate entrance exam; have an existing AP program

offering at least one AP course; and designate an on-site mentor to support students enrolled in online AP courses.

• Participating schools or districts receive $500 for each student who completes an AP course and takes the AP exam. Funds must be used to implement a school- or district-wide AP program, provide professional development, pay the AP exam fee, or provide teachers and mentors with bonus payments of $50 for each student.

• The Pilot program is repealed July 1, 2018.

HB14-1156 Eligibility Age School Lunch Protection Program

This bill expands the eligibility of students that qualify for the elimination of the reduced-price co-pay of $0.40 per lunch meal. Currently eligibility is only Pre-kindergarten through second grade. Eligibility will now include Pre-kindergarten through fifth grade.

HB14-1182 Public Education Accountability 2015-16 School Year

For the 2015-16 school year, the bill authorizes the Colorado Department of Education (CDE) to assign accreditation ratings and recommend performance plan types based on the school district's, State Charter School Institute's, or public school's: • accreditation rating or type of performance plan for the preceding school year; • compliance with the accreditation contract for a school district or the institute; • participation in statewide testing; and • performance in meeting the Colorado academic standards and local performance targets. Under current law, if a public school is required to implement a priority improvement plan or turnaround plan for five consecutive school years, the State Board of Education (SBE) must recommend that the public school, the school district, or the Charter School Institute take one of several actions specified in statute with regard to the public school. For the 2015-16 school year only, the bill authorizes the SBE to recommend an action that is not specified in statute but that has comparable significance and effect.

HB14-1190 School District Financial Capacity Capital Construction Grants

This bill adds two factors of consideration to existing law in order to determine how much matching money to require a school district or board of cooperative services (BOCES) to provide when applying for financial assistance under the Building Excellent Schools Today (BEST) program. These factors include: (1) a school district's available bond capacity or the average available bond capacity of participating members of a BOCES; and (2) a school district's unreserved fund balance as a percentage of its annual budget or the average unreserved fund balance of the annual budget of the participating members of a BOCES.

HB14-1202 Standards and Assessment Task Force

HB14-1202 creates a Standards and Assessment Task Force to study the implications of the statewide assessment system for school districts, public schools, educators, and students. The 15-member Task Force must begin its work by July 15 and present recommendations to the Joint House/Senate Education Committees no later than January 30, 2015. HB14-1204 Flexibility for Rural School Districts

This bill modifies the following accountability requirements for small and rural school districts: • Under current law, districts accredited by the state in the top two accreditation categories must submit a performance plan to the CDE annually. This bill allows small and rural districts that are accredited or accredited with distinction to submit performance plans biennially. An individual school in a small and rural district is given similar flexibility so long as the school is required by the State Board of Education (SBE) to adopt a performance plan. • Under current law, a district enrolling one thousand students or less may submit a single plan to satisfy both the district and school performance plan requirements. This bill allows a small rural school district that exercises the flexibility to submit district performance plans biennially to submit a single district and school plan on the same schedule. • The bill authorizes a small rural school district to purchase the services of a literacy specialist from a Board of Cooperative Educational Services (BOCES) in order to provide educator professional development in literacy education. • A BOCES may apply for a grant from the Early Literacy Grant Program to provide instructional support in literacy to small rural school districts that are members of that BOCES.

HB14-1208 Authorizing Multi-District Administrative Units

Under previous law, an "administrative unit" was defined as a school district, a Board of Cooperative Educational Services (BOCES), or the State Charter School Institute (CSI), when these entities are providing special education services pursuant to the Exceptional Children's Educational Act. This bill amends the definition of "administrative unit" to include a multi-district administrative unit. A multi-district administrative unit is defined as a group of school districts that did not form a BOCES, but were parties to an agreement existing on January 1, 2011, to jointly provide special education services, and were recognized by the department as an administrative unit as of January 1, 2011.

HB14-1287 BEST Money for Disaster Damaged Public Schools

This bill clarifies that the first $40 million in revenue collected annually from the excise tax on retail marijuana will be deposited into the Public School Capital Construction Assistance Fund. It requires the Division of Public School Capital Construction at CDE to take certain actions after the Governor declares a disaster emergency including conducting an outreach assessment for damaged school facilities. Finally, the bill allows the Capital Construction Assistance Board to use up to ten percent of the moneys in the fund for disaster assistance and requires the board to waive the funding match requirement for any recipient of emergency.

HB14-1292 The Student Success Act As introduced, the Student Success Act contained a number of different provisions to increase funding to districts and new requirements. The final version of the Student Success Act included a $110 million dollar reduction in the negative factor, $18 million for the READ Act, funding for charter school capital construction, a clean-up of the statutory language around automatic waivers for charter schools, appropriations for the ASCENT program and a much-negotiated version of fiscal transparency.

HB14-1376 Analysis of Student Opportunity Gaps

Using data that is already being collected from districts, CDE will create a draft core course level participation and student achievement report by November 1, 2014 for sharing and feedback with districts. Core courses are English, math, science or social science and level indicates the degree of difficulty or complexity of the course. The report will examine how students enrolled in various courses perform on the state’s summative assessments. The aim of the report is to help districts identify those courses that have the greatest likelihood of helping students achieve proficient and above scores on the state’s summative assessments. The report will also be disaggregated by student subgroups so that districts can see patterns of student placement in different courses. The report will be refined from 2014-2016 with input from the field. Beginning with the 2016-2017 academic year, schools and districts must use the data in the report when preparing their unified improvement plan. School and district reports must be posted on the CDE website.

HB14-1382 K-12 On-line Education

This bill has three major components. • It updates definitions and clarifies and adds requirements for documenting student attendance and participation. • It establishes a task force to be appointed by the Commissioner of Education to review best practices and policies for authorizing and

administering multi-district on-line schools and to recommend to the State Board and the legislature the regulatory and statutory changes that are necessary to certify authorizers of multi-district on-line schools.

• It creates an on-line pilot program the parameters of which are to be determined by CDE working with the Task Force. The pilot program is only to be implemented if funding is provided. The bill does not provide that funding.

This bill creates an academic growth award to recognize public high schools that achieve high levels of academic growth. The awards must be in the form of trophies that resemble the trophies presented for athletic accomplishments and are awarded to the public high school achieving the highest growth in each of the school groups established by CHSAA for the sport of football.

SB14-150 School Counselor Corps Grant Program

This bill updates the School Counselor Corps Grant Program that was created in 2008. It redefines secondary school to include any school with grades 6-12 and requires that the remediation rates and the percentage of first-generation potential college students be considered as part of the grant application process. Additionally, CDE is specifically tasked with providing support to secondary schools to train principals on the most effective use of the program.

SB 14-165 K-12 Academic Growth Performance Evaluation 2014-15

Under current law, local school boards are required to establish an evaluation system for licensed educators that bases at least 50 percent of the educator's annual evaluation on student academic growth. For the 2014-15 academic year only, this bill allows a local board to determine what percentage, if any, of the educator's final evaluation rating must be based on student academic growth. All other components of the licensed personnel evaluation system in current law must be implemented in the 2014-15 academic year.

SB14-215 Disposition of Legal Marijuana Related Revenue

This bill allocates $24.5 million in sales tax dollars from recreational marijuana sales. The $24.5 million in this bill is about half of the projected annual sales tax collections. Within CDE, the bill establishes the School Health Professional Grant Program for $2.5 million. It is a matching grant program designed to increase the presence of school health professionals in secondary schools to provide substance abuse and behavioral health care to students.
