9. FISCAL MATTERS 9.3 Contracts/Agreements/Memoranda of Understanding

The Administration recommends approval of the following items subject to the final review of the Interim Chief Financial Officer and Business Administrator and District Solicitor:

9.3A New Story School – approve a contract with New Story Schools to provide educational services required by a student IEP and not performed by the School District at the costs listed in the contract for the 2015-16 fiscal year.

9.3B Overbrook School for the Blind – approve a contract with Overbrook School for the Blind

to provide educational services required for students who are residents of Harrisburg School District and must be accommodated in a recommended program at a cost of $30,000 per student for the 2015-16 fiscal year.

9.3C Pinnacle Tax Forgiveness – approve the forgiveness of taxes for properties owned by

Pinnacle Health System that were previously covered by the Payment in Lieu of Taxes (PILOT) agreement approved by the Board in November, 2014. Mr. Cooper will confirm that these properties were included in the original agreement.

9.3D E-Signature Resolution–authorize Danielle Robinson, Board President, to provide an

electronic signature to approve documents on behalf of the Harrisburg School District that are required by the Pennsylvania Department of Education.

RESOLUTION

The School District of the City of Harrisburg, PA

BE IT RESOLVED, by authority of the Harrisburg School Board of Directors of the Harrisburg School District, LEA, a public school district, and it is hereby resolved by authority of the same, that Danielle Robinson, who is the President of the above named body is authorized and directed to sign any and all contracts, agreements, grants and/or licenses collectively referred to as contract(s)) with the Pennsylvania Department of Education (Department); and

BE IT FURTHER RESOLVED, that the body consents to the use of electronic signatures by the above named individual and that no handwritten signature from the above named individual shall be required in order for any contract with the Department to be legally enforceable and that by affixing his/her electronic signature to an electronic file of the contract via the Department’s e-grants system, the above designated authorized individual shall have effectively executed and delivered the contract, binding the Harrisburg School District to comply with the terms of said contract; and

BE IT FURTHER RESOLVED, that no writing shall be required in order to make the contract valid and legally binding, provided that the Department and all other necessary Commonwealth approvers affix their signatures electronically and an electronically-printed copy of the Contract is e-mailed or is otherwise made available to the body by electronic means; and BE IT FURTHER RESOLVED, that the body will not contest the due authorization, execution, delivery, validity or enforceability of the electronic Contract under the provisions of a statute of frauds or any other applicable law. The Contract, if introduced as evidence on paper in any judicial, arbitration, mediation, or administrative proceedings, will be admissible as between the parties to the same extent and under the same conditions as other business records originated and maintained in documentary form and the admissibility thereof shall not be contested under either the business records exception to the hearsay rule or the best evidence rule; and

BE IT FURTHER RESOLVED, that the body will notify the Department’s Bureau of Management Services promptly in the event that the above named individual is no longer authorized to execute agreements on behalf of the body electronically and that the Department shall be entitled to rely upon the above named officer’s authority to execute agreements electronically on behalf of the body until such notice is received by the Department’s Office of Chief Counsel. 9. FISCAL MATTERS 9.3 Contracts/Agreements/Memoranda of Understanding

The Administration recommends approval of the following items subject to the final review of the Interim Chief Financial Officer and Business Administrator and District Solicitor:

9.3E Shippensburg University Affiliation Agreement – approve the affiliation agreement between Shippensburg University and the Harrisburg School District for the University to provide student mentors and student teachers based upon the attached contract for the 2015-16 fiscal year.

9.3F STS Contract – approve the contract with Substitute Teacher Service (STS) to provide

temporary employees where needed in the district at the rates listed on the attached contract for the 2015-16 fiscal year.

9.3G Camelot Schools Amendment – approve an amendment to the July 1, 2015 contract with

The Camelot Schools of Pennsylvania to increase the number of K-5 students served from the current 24 to 48 students at the cost cited in the contract.

9.3H Camelot School of Pennsylvania – approve the first amendment to the Education Services

Agreement with Camelot School of Pennsylvania for the addition of two (2) additional K-5 classes at the Hamilton School site for students assigned by the School District.

9.3I Fruhauf Uniforms, Inc. – approve the bid for 150 Band Uniforms to Fruhauf Uniforms, Inc.

in the amount of $79,638.00 whose low bid met the specifications of the bid.

9.3J PNC Revolving Line of Credit – approve the district entering into an agreement with PNC Bank, N.A., to provide a revolving line of credit (LOC), if necessary, of an amount not-to-exceed $20 Million, at rate of 5 basis points if/when LOC is engaged, plus 67% of Daily LIBOR plus 1.4%.

9.3K MOA with City of Harrisburg – approve the Memorandum of Agreement with the City of

Harrisburg to apply for a federal Promise Zone (PZ) designation to achieve identified resident empowerment and community development goals.

9.3L Contract with Wolf Bus – approve a contract with Wolf Bus Company for charter buses

for field trip to Washington, DC for seventh/eighth graders from Marshall School on May 9, 2016 at a cost of $7,000. The trip will be paid by the 190 students participating in the event.
