    Were approaching February already a period we often associate with blahs, but also a month worth celebrating, given that its the shortest of the year, and March and spring soon follow. And while the deadline for 2012 Registered Retirement Savings Plan contributions isnt until March 1, and April 30 for ling your 2012 income tax return, perhaps we need to start thinking of February in a different light altogether.

    Indeed, coming up in our two February issues is our Tax Matters content; the idea was to explore this topic in advance of ling deadlines, to help readers learn about opportunities to take advantage of while they still can.

    But, heeding the advice of experts, perhaps tax time should instead be a year-round task. From making regular RRSP contributions to comparing RRSPs and tax-free savings accounts to learning of the various credits available, tax planning for some is as necessary as the inevitable taxes themselves.

    Preparing as best you can throughout the year might help minimize the sting come deadline time and help you learn to embrace the opportunities to save, not just fear what you have to pay.

    One Of the mOst seriOus issues facing a homebuyer and it doesnt matter whether you buy a house, apartment, townhouse, new or resale, is the Agreement of Purchase and Sale or Offer. Over the last few months Ive had a number of people bring me their Offer long past the time when they can have a lawyer comment on it, and they were stuck with the terms and extra expense. Lets review a couple of things.

    CondoMiniuMS The Condominium Act provides that you have 10 days from the date you receive the disclosure state-ment and the date you receive an Agreement of Purchase, executed by the builder, to rescind the deal. This gives you an opportunity to see your lawyer, get suggestions, changes and explanations, and then within the 10 days, return to the sales office and negotiate for those important items that are usually left open.

    new freehoLd hoMeS, reSaLe hoMeS and reSaLe CondoS No time is allowed after you sign, unless you have ensured that there is a schedule or clause making the transaction conditional for a given period of time on your lawyers review and approval, or other conditions.

    Here are a number of items, primarily for new homes, to look out for so you have an idea, but recognize this is not a comprehensive list, just a sampling:

    01. Hydro and water installation and subdivision charges get written maximums put in;

    02. Development charges and levies get deleted or written maximums;

    03. The vendors lawyers Law Society Levy get it deleted you pay yours, they can pay theirs;

    04. Driveways they say it is paved, does that mean base and finish coat or only a base coat?;

    05. Damage deposits get a maximum and make sure there is a process for obtaining a refund;

    06. Mortgage clauses are you stuck with the builders mortgage and terms? is there a clause requiring you to accept the builders

    lawyers undertaking to discharge the mortgage without a discharge statement or direction to pay funds to the lender?

    is the builder trying to make you pay to obtain partial discharges of a blanket mortgage;

    07. Condos do you own your parking and storage locker or is it only exclusive use?;

    08. Ensure you get a chance to review the status certificate and any reserve fund issues;

    09. Survey who pays? When do you get it?10. Extensions how long? Have you selected your option

    under Tarion for new homes?11. Title is there a clause that says you have to accept

    the builders undertaking to give you a deed if one is not available on closing;

    12. What about home inspection and inspections prior to closing?;

    13. Ensure you are getting the appliances and fixtures you think you are.

    There are many more issues that arise in an Agreement of Purchase and Sale or Offer. This document is the most important in the whole process because it sets the rules for you and the vendor. This becomes critically important when you realize that you need independent legal advice that will properly help you deal with this document. Only a lawyer can do this.

    I often say that thIs Industry is the glue that keeps our provinces economy together. I truly believe it has been one of the strongest economic con-tributors over the last decade, if not longer. I was pleased to see the latest employment numbers released by Statistics Canada, pointing to the construction industry as a major contributor to the fourth job increase in five months.

    According to a Statistics Canada report, employment rose by 40,000 across the nation in December, and the declining employment rate is at its lowest in four years. Construction jobs rose by 18,000 in December across Canada, the report states, and the industry has shown steady growth throughout the year.

    In Ontario, specifically, the number of full-time jobs increased across a number of industries, but the Statistics Canada reports point directly to the construction industry as a top employer.

    We are awaiting final 2012 numbers, but we know that in 2011, there were

    193,000 jobs created in new home construc-tion, renovation and related fields in the GTA. Those jobs generated $10 billion in wages that later appeared as purchases across the local economy.

    I would argue that this number doesnt take all of the spin-off jobs into account, which are difficult to calculate. The analysis is complicated by the fact that the type of construction project from a home renova-tion to a townhome complex to a 400-unit condominium community will produce a different economic ripple effect.

    With a home renovation, economic impact is greatest within about a 100-ki-lometre radius, since most businesses operate locally and buy equipment and product locally as well. In the lowrise sector of our industry, typically 200 people will work on a single home, and in the highrise sector, each crane represents 300 to 500 jobs for about four years. You probably have neighbours, friends or family in the indus-try, because many fields of work bring a home from plan to reality.

    All of this to say that our industry meets the demand of selling and building an average of 35,000 to 40,000 new homes annually, so that the 100,000 people who come to the GTA every year have a place to live.

    The provincial forecasts tell us that by 2031, well have 3.7 million more people living in the Greater Golden Horseshoe and we will have to accommodate 1.8 million more jobs. Our industry is meeting this challenge by planning, designing and building complete communities where people can live, work and play. It takes a lot of people to make it happen and its a lot of hard work, but were up to the task.

  • In mId-2012, I was Introduced to Omar Ales, national sales manager of Yamaha Canada Music Ltd. (yamaha.ca). Following a very interesting conversation about the home entertain-ment industry, I consulted with interior designer Bryon Patton, to incorporate a digital piano into one of our three new model homes we were working on in The Village at Sally Creek adult lifestyle community in Woodstock.

    People of all ages and at all stages of life are purchasing digital pianos for their homes, and we felt this was the ideal opportunity to demonstrate how easily the new Yamaha models can blend like furniture pieces into homes designed for downsiz-ing buyers. What also struck me as unique was the fact that they actually function as a complete music entertainment system, one that does not require tuning or regular maintenance and is not sensitive to humidity and temperature fluctuations as a tra-ditional acoustic piano.

    People today want their home entertainment products to be both multi-functional and aesthet-ically pleasing which has greatly affected our in-dustry, says Ales. He pointed out options such as playing CDs, onboard music lessons, karaoke and recording functions as ways the company has aug-mented its digital pianos.

    We discussed the challenges builders face to design new homes and condominiums that make the most efficient use of space. When people move

    from a larger home into a smaller space, they dont want to compromise their lifestyle. He explained that Yamaha is addressing this trend by introduc-ing models that can be accommodated in modest room sizes. Our Arius, Clavinova and MODUS lines have slimmer, sleeker models designed to fit into smaller living spaces and some models even transform into a table surface when not in use. The addition of multi-function features has gener-ated a broader base of interest.

    When we discussed prices, I expected to hear that buying a new digital piano could be a sizeable investment, but was happy to learn that the prices are quite affordable: the least expensive, which has 88 fully weighted keys like an acoustic piano, actually starts at less than $700. Of course, if one has the inclination and the bank account to match, Yamahas top of the line models with all the bells and whistles can be purchased for $250,000.

    Just as a new-home buyer benefits from pur-chasing from a builder with years of experience behind them, so does the consumer who chooses a product from a company with 125 years in man-ufacturing pianos, researching and developing home audio systems, stereos and other electronic and digital components.

  • Skyline international Development inc. haS announced it will acquire a strategic retail and land develop-ment interest in Blue Mountain Village.

    Skyline, a leading Toronto-based developer of hospitality properties and destination communities, has entered into a binding agreement of purchase and sale and will be investing $20 million to acquire both retail and undeveloped residen-tial land interests in and adjacent to Blue Mountain Village. The Village is at the base of Blue Mountain Resort which offers ski, golf and lodging.

    Under the agreement, Skyline will acquire 50 per cent of existing commercial retail space within Blue Mountain Village from current owner Intrawest ULC.   • The minisTer of finance and The Bank of Canada have both expressed concerns over the amount of debt Canadians have been carrying. Indeed, a predict-able result of an economy wherein the government is forced to keep interest rates low for an extended period is that consumers will find it hard to resist the temptation of borrowing beyond their means. Although there is an increased trend among Canadians accessing equity in their homes, it is important to note there are two differ-ences between those who borrow to support lifestyle and those who leverage to increase wealth.

    Over the past few years, the number of Canadians who have taken out a line of credit on their home for anything from home improvements to vacations has increased to the point that the government has raised a red flag. Real estate investors need to be aware of who the government is really targeting and that is the homeowner who is using his home equity to subsidize his current lifestyle. This is a valid issue, and the government should be concerned about this behaviour. However, this should not be confused with the prudent investor who uses home equity to increase his net worth.

    While the government worries over the lifestyle subsi-dizer, the savvy real estate investor recognizes that this extended period of historically low rates creates a unique opportunity to leverage home equity into wealth, creating real estate investments. Investors understand that in order to purchase cash-flowing rental properties, they will need to either come up with the down payment themselves or attempt to put together a joint venture partner. The simplest and least expensive source of capital (outside of cash on hand) is home equity. As such, it is common for almost every investor to set up a line of credit on their home in addition to their mortgage as a way of converting home equity into increased net worth. But what a lot of investors dont un-derstand is that not all lines of credit are created equal.

    There two different types of lines of credit (LOC) in

    the Canadian mortgage market and it is critical for a savvy real estate investor to understand the difference. One is a traditional static LOC and the other is a re-advance-able mortgage LOC combination. On the surface, they may appear similar, but what makes them different is critical to the savvy real estate investor.

    A static LOC is the LOC that most homeowners are familiar with and one that the majority of banks and lenders have been offering up for years. It is, quite simply, a line of credit that is placed behind the first mortgage. If a homeowner has more than 80 per cent of equity in their home they can apply to access that home equity (up to 80 per cent) in the form of a line of credit. The chal-lenge with a static LOC also known as a Home Equity LOC or HELOC is that it is static, meaning that if the amount of equity you have in your home were to increase over the course of the mortgage, the maximum amount of money that you would be able to draw out would remain the same, regardless of how much you may have reduced the original mortgage amount by. For example:

    Home Value = $400,000 Mortgage Amount = $250,000 80% of Home Value = $320,000 Amount of accessible Home Equity = $ 70,000

    In the above example, a HELOC can be arranged for $70,000. This in itself is a fairly straight-forward transaction and one that the majority of Canadians undertake when arranging for a LOC. However, lets assume that the hom-eowner in the above example took advantage of every pre-payment privilege available and also had excess cash avail-able through employment bonuses or commissions. Lets further assume that this homeowner was able to pre-pay as much as $50,000 of their mortgage over the next two years and were now at a point where they wanted to access some of the additional $50,000 in built-up equity to purchase an

Unfortunately, for our investor, since the product they chose was a static HELOC, the major-ity of lenders would need them to re-apply to have the limit on their HELOC increased. Aside from the inconve-nience of a new application process, which could be declined if there were any changes in employment (such as shifting from an employee to being self-employed, or simply having a spouse go on maternity leave) our inves-tor would also be subject to additional legal and appraisal costs. All this because they didnt get the right advice in the first place.

    What they should have arranged is a re-advanceable mortgage/LOC combination. The difference is simple and obvious, but unfortunately many Canadians are still not familiar with the fact that they exist. As the name would suggest, a re-advanceable mort-gage is created in such a way that every dollar of equity that is created by paying down the mortgage portion of the loan, is re-advanced to the line of credit.

    In the above example, the $50,000 that was used to reduce the mortgage would be automatically re-advanced to the client and made available to them in their line credit.

    The original mortgage would be struc-tured exactly the same with $250,000 set up as a mortgage amount and $70,000 made accessible in the LOC. The difference with the re-advance-able mortgage is that as the $50,000 of equity is paid off the mortgage, the

    accessible equity in the line of credit is increased by that same $50,000. In other words, every dollar of equity that is paid off your mortgage is auto-matically re-advanced to your line of credit. There is no need to re-apply to have it re-advanced it is done so automatically. And the best part is that any time you use money from your line of credit for an investment that has the intention of making money the interest on the line of credit is tax de-ductible a process that is commonly referred to as the smith Manoeuvre.

    The proper use of this product is critical for the savvy real estate inves-tor as it addresses two critical areas. The first and most obvious is the fact that access to money for down payments is one of the biggest obstacles to the real estate investor. Using a re-advanceable mortgage/LOC allows an investor to build up funds toward their next down payment simply by making their mortgage payment every month and allowing it to accumulate in their LOC over time. The second less obvious advantage of this product is that it should forever eliminate the argument among couples over whether they should use a particular lump sum of money to pay down their mortgage or invest. Proper utilization of this product will allow them to do both. simply apply the excess cash onto your principal residence mortgage, thereby reduc-ing your immediate mortgage costs, and then have those same funds re-advanced to your line of credit where it can remain indefinitely available to you until such time t
