Managing Director STEVTA presented the implementation status of decisions made in 25 th meeting ofSTEVTA Board held on 25 th Oct2019. lIe informed that the matter of deceased quota appointment was forwarded to SGA&CD / Law Department as decided by Board. Accordingly, Law Department endorsed appointments under deceased quota and found no impediments to release of salaries to the appointees. SGA&CD desired to proceed into the matter in accordance with policy / rules. I-Ie further apprised that since, all procedural requirements were already completed / approved by Board being appointing Authority, therefore, salary for the month of [an 2020 is released. 2. The meeting started with the recitation from the Holy Quran. The Chairperson STEVTAin his opening remarks welcomed the participants and thanked them for sparing theirvaluable time from their busy schedule.

3. Managing Director STEVTA presented the implementation status of decisions made in25th meeting ofSTEVTA Board held on 25th Oct2019. lIe informed that the matter of deceasedquota appointment was forwarded to SGA&CD / Law Department as decided by Board.Accordingly, Law Department endorsed appointments under deceased quota and found noimpediments to release of salaries to the appointees. SGA&CD desired to proceed into thematter in accordance with policy / rules. I-Ie further apprised that since, all proceduralrequirements were already completed / approved by Board being appointing Authority,therefore, salary for the month of [an 2020 is released. Managing Director apprised the Board that SindhTEVTA and Family Education Service Foundation(FESF) are partnering for imparting vocationaltraining to Deaf under an MoU. He referred theapplication of FESF (as reproduced below)requesting to hand over Govt. MonotechnicInstitute (GMI), Gulistan-e-Iauhar, Karachiremaining portion of building for expansion ofskills training program / facilities for Deaf Reach:

"To meet the public demand to scale up, DR needsmore space. We would like to request STEVTJl toplease consider handing the entire building locatedat GM! Gulstan-e-Johar, Karachi currently beingunderutilized. He further informed the Board that existing GMI[ohar will be shifted to a nearby GPI Sachal Goth(around 6KM away). The Chairman STEVTAendorsed the request of FESF and appreciated thequality training provided to deaf of Sindh. Rep. ofEducation Department also endorsed thecontribution of FESF in general education andother sectors. Rep. of U&B inquired that if theprovision of building to a partner is coveredunder law, then we may extend our support orotherwise seek guidance from Law Department.Mr. Suhail Wajahat suggested to sign a rentalagreement @ Re. 1/- to secure ownership of thebuilding if deemed appropriate or otherwise bythe STEVTA Rep of Mehran University, desiredthat existing batches at GMI Gulstan-e-Johar maybe continued and fresh admissions may beconducted at GPI Sachal Goth.

Mr. SuhailWajahat appreciated the initiative andemphasized such practice should have been doneearlier. Rep. of U&B inquired the financial andavailability of funds for such allowance. liefurther asked as to where the existing personsoccupying the posts of RDs and Principals will beadjusted. Managing Director apprised that theexpenditure will be met out from single-line grantand sufficient provision thereof is available.Regarding, adjustment of present personsholding the posts of RDs and Principal selectedinstitutes (as identified by Interview Panel), heapprised that they will also be given chance toprove their position before proposed InterviewPanel. 1. Bank Accounts and Cheque SignatoriesDirector Finance STEVTA apprised that Rule 7(2)of STEVTA (Finance, Accounts, Works &Property) Rules 2013 envisages to make allpayments by cheque duly signed by ManagingDirector or any officer authorized in this behalfbythe Board. Several accounts are maintained bySTEVTA office / institutes for day-to-day affairs /eouceuon of fClOS under dll'f'oront tr lntrigprograms. lIe therefore proposed that the Boardmay like to delegate its power upon ManagingDirector to authorize any officer as chequesignatories and opening of bank accounts.

2. Constitution of Institute ManagementCommittees (IMCs)

The Director Finance further apprised the Boardthat in order to strengthen and operationalizeTVET institutes in close collaboration with theprivate sector and industry extended autonomyin managing affairs of institutes InstituteManagement Committees (IMCs) are constitutedunder IMC (Conduct of Business) Rules 2015.However, several powers under IMC rules likeformation of IMCs, appointment / acceptance ofresignation of a member ctc require to bedelegated. Since, the matter being a routine,requires speedy disposal. Therefore, the Boardmay like to delegate upon Managing Director thepowers to constitute IMe:, appoint and acceptresignation of members of IMCs.L- L- -L __ ~~ ~ _

Discussion / Observations

Managing Director appraised 12 residentialcolonies (located inside various institutes) weretransferred to STEVTA along-with other assets inaccordance with STEVTA Act. In order to properlymanage / allot the official residence on merit /with transparency he presented a policy forallotment of residence (60% institute itself, 20%STEVTA Offices and 20% other STEVTAInNtltutoll). Rap. of lJ&.13 fldvlsCld eo followGovernment Rules for allotment of officialresidence. He further proposed that threeexisting vacant residences may be converted intoofficial guest houses and be used for officialpurpose @ rates as proposed under workingpaper. Mr. Suhail Wajahat inquired that whatsteps have been taken for vacation of residencesillegally occupied. Director Admin STEVTJ\responded that several residences are occupiedby outsiders / private persons / officials of othergovernment departments and recently fewresidences have been got vacated through court.

Review ofSTEVTAOrganogram

Director Finance STEVTA apprised that inaccordance with Rule 17(2) of STEVrA (APT)Rules 2012, all employees of Authority areentitled for such Leave, Medical Facility,Travelling Allowance, Daily Allowance, GeneralProvident Fund, Pension and Gratuity or anyother benefit in accordance with rules applicableto regular government employees. Accordingly,deductions on account of provident andInsurance func.iH arel m ag frorn tho monthlysalaries of employees and benevolent be made inaccordance with Government Rules. lierequested the Board for formation of Provident,Pension, benevolent, and group insurance fundsand opening of separate bank accounts for suchfunds in Sindh Bank.

Responding to a query of Rep. of U&B, DirectorAdmin apprised that all rules for regulargovernment employees are applicable forSTEVTA employees in accordance with Rule17(2) ofSTEVTAAPT Rules.

Therefore, inorder to streamline and rationalize the number ofposts in each wing / section based on theworkload necessary revisions (i.e. several newcreations / merger / shifting of existing posts toother sections/wings) in the existing organogramof STEVTA HQs and Regional Directorates areessentially required.

(1) Appointing AuthoritiesThe Managing Director apprised that inaccordance with Rule 5 of STEVTA APT Rules,STEVTA Board is appointing authority in respectof all posts. Further, under Rule 5(2) of STEVTAAPT Rules, 2012, the Board may authorize anyofficer to exercise its powers of AppointingAuthority. In this regard, it is proposed that Boardmay like to delegate its powers upon following asAppointing Authorities:

.. SPPRA approved an allowance similar to projectallowance revised by Government from time totime. In order to attract and retain career officersfor the post of Managing Director, he proposedthat Board may approve pay & emoluments forthe post of Managing Director as "Last pay drawnand regular allowances admissible in STEVTAplus Authority Allowance equal to (BPS-20: Rs.260,000/- and BPS-21: Rs. 280,000/-)" per monthon the analogy of SPPRA. The Chairman furtherrequested the Board to revise & fix the salary ofpresent incumbent w.e.f the date of his joining,accordingly.

As porterms of hls offer of appointment, the petitionerfailed to join within 10 days stipulated time.However, after four years he submitted anapplication on 22/11/2008 to SecretaryEducation for allowing him to join the post, whichwas regretted by Secretary Education as timebarred case. The petitioner upon' refusal byEducation Department approached honorableSindh High Court for seeking relief on the analogyofMrs, Uzma Kashif (a batchmate of petitionerwho was allowed to join her post on 18/6/2(09).The court very kindly ordered to initiate the caseof petitioner in same way as of Mrs. Uzma Kashifon the written statement of Legal Counsel ofSTEVTA (who submitted the statement beforecourt on his own as no such consent was soughtfrom STEVTA Board / Appointing Authority).

The Managing Director apprised the membersthat in order to functionalize the Authority, SindhTEVTA hired the services of various officialseither on contract or contingent basis in tomanners i.e. 1) competitive selection process(advertisement, selection committee, interview /test) against sanctioned posts, and 2) directhiring from contingent budget (non-sanctionedposts). In order to retain the services of officialshired through competitive selection process,STEVTA Board in its 9th meeting approvedregularization of those officials meeting theIwlLtil'l t!jUhH'~11l1 ~11l'~~HtI1tHlIiHHI~I~lv~1 tll'tH!lIUII,advertisement, interview / test). Accordingly, allthose meeting the criteria were regularized. Ms.Amna Abro since she was engaged directlywithout any advertisement as temporary /contingent paid staff was not considered forregularization. However, the then DeputyDirector Admin-I by misuse of his authorityissued an illegal notification of her regularization.However, the department did not implement theimpugned notification being violative of law /illegal. He further informed the Board that Ms.Amna Abro filled a petition in Sindh High Court,Sukkur for her regularization and release ofsalary. He requested the Board to decide thematter in accordance with the rules.---t------------------t------------------------------------------j------------The Managing Director submitted to the Boardthat the tenure of one Legal Advisor (engaged forLarkana / Sukkur regions) out of three, iscompleted in [an 2020. Since, a large number ofcases / petitions are pending in Larkana andSukkur High Courts, therefore it is proposed thatin place of outgoing advisor, a Legal Advisor fromopen market through competitive selectionprocess may be engaged at the rates earlierapproved by Board thereof. 1) Pay Package for the Post of ChairpersonSTEVTA.

The Managing Director apprised the Board thatthe post of Chairperson STEVTA is filled by theGovernment in accordance with STEVTA Act. Inorder to decide the matter of pay & emolumentsfor the position of Chairperson, HR Committee ofSTEVTA Board in its meeting held on 14/03/2009recommended that the Chairman, subject toapproval of the Government, be entitled to thestatus and perquisites admissible to an officer ofManagement Position-l (MP-I) scale. Therecommendations of HR Committee wereapproved by STEVTA Board in its 4th meeting heldon 8/8/2009, however, for the then Chairperson,Board approved payment of Rs.l00,OOO/" permonth as an honorarium.

Board endorsed grantof MP-I scale forChairperson STEVTAas alreadyrecommended by I1RCommittee. Boardfurther desired that asummary for thereason be moved toChief Minister Sindh(through FinanceDepartment) beingappointing authority ofthe ChairpersonSTEVTA.

2) Payment of Authority Allowance to CivilServants posted at STEVTA HQs.

Chairman and Managing Director STEVTAapprised the Board that public servants posted atSTEVTA HQs are drawing Authority allowance @rate approved by Board. Since, salary ofemployees of two directorates i.e. Admin andOperations being civil servants is paid through AGOffice, therefore the allowance is not being paidto them. He requested the Board to approvepayment of Authority Allowance to Civil Servantsposted on sanctioned posts of Directorate ofAdmin and Operations out of single line grant.

The meeting ended with a vote of thanks to and from the Chair.

The Board deferred theitem with direction toprepare and propose asubstitute, likehonoraria in lieu ofAuthority Allowance tocivil servants postedagainst sanctionedposts of STEVTA IIQsin its next meeting.
