Ontario Highway Transport BoardPeriodically, temporary applications are filed with the Board. Details of these applications can be made available at anytime to any interested parties by calling (416) 326-6732.

The following are applications for extra-provincial and public vehicle operating licenses filed under the Motor Vehicle Transport Act, 1987, and the Public Vehicles Act. All information pertaining to the applicant i.e. business plan, supporting evidence, etc. is on file at the Board and is available upon request.

Any interested person who has an economic interest in the outcome of these applications may serve and file an objection within 29 days of this publication. The objector shall:

1. complete a Notice of Objection Form,

2. serve the applicant with the objection,

3. file a copy of the objection and provide proof of service of the objection on the applicant with the Board,

4. pay the appropriate fee.

Serving and filing an objection may be effected by hand delivery, mail, courier or facsimile. Serving means the date received by a party and filing means the date received by the Board.

On September 12, 2008, amendments to the following rules came into force under the Securities Act:

• National Instrument 21-101 Marketplace Operation (NI 21-101); and

• National Instrument 23-101 Trading Rules (NI 23-101) (together, the ATS Rules).

The key aspect of the amendments makes changes to the best execution obligation of dealers and advisers.

1. The Minister of Energy and Infrastructure (the “Minister”) shall preside over a ministry known as the Ministry of Energy and Infrastructure (the “Ministry”).

a) the Minister of Energy, including the powers, duties, functions and responsibilities that were previously assigned to the Minister of Energy under Order in Council O.C. 1691/2003 dated November 19, 2003, as revised by Order in Council O.C. 2355/2006 dated November 22, 2006, except for those powers and duties of the Minister of Energy under sections 8 and 9 of the Ministry of Energy Act, R.S.O. 1990, c. M. 23, insofar as the powers and duties set out in those sections are required to develop and administer the Ontario Ethanol Growth Fund program, that were transferred to the Minister of Agriculture, Food and Rural Affairs under Order in Council O.C. 1477/2005, dated September 21, 2005; and

b) the Minister of Public Infrastructure Renewal, including the powers, duties, functions and responsibilities that were previously assigned to the Minister of Public Infrastructure Renewal under Order in Council O.C. 1487/2005 dated September 21, 2005, as revised by Order in Council O.C. 2355/2006 dated November 22, 2006, except for the powers, duties, functions and responsibilities under the Liquor Control Act, R.S.O. 1990, c. L. 18, assigned to the Minister of Finance,

and such powers, duties, functions and responsibilities are assigned and transferred accordingly.

WHEREAS pursuant to subsection 2(1) of the Executive Council Act, R.S.O. 1990, c. E.25, a member of the Executive Council has been appointed under the Great Seal to hold office as the Minister of Government Services;



1. The Minister of Government Services (the “Minister”) shall preside over a ministry known as the Ministry of Government Services (the “Ministry”).

The Minister shall exercise the powers and perform the duties, functions and responsibilities that are assigned by law to the Minister or that may otherwise be assigned to or undertaken by the Minister in respect of government services, ServiceOntario and any other matters related to the Minister’s portfolio.

3. The Minister shall exercise the powers and perform the duties, functions and responsibilities that had previously been assigned and transferred to the Minister of Government and Consumer Services under Order in Council O.C. 2017/2007 dated November 28, 2007 in respect of government services, ServiceOntario and any other matters related to that portfolio except consumer protection services, and such powers, duties, functions and responsibilities are assigned and transferred to the Minister accordingly, including but not limited to:

a) the powers, duties, functions and responsibilities of the Chair of the Management Board of Cabinet in respect of the following Acts:

i. Cabinet Ministers’ and Opposition Leaders’ Expenses Review and Accountability Act, 2002, S.O. 2002, c. 34, Sched. A;

ii. Courts of Justice Act, R.S.O. 1990, c. C.43 (including the Schedule to the Act, O. Reg. 407/93 and O. Reg. 67/92);

iii. Justices of the Peace Act, R.S.O. 1990, c. J.4 (in particular O. Reg. 319/00); and

b) the powers, duties, functions and responsibilities of the Minister of Consumer and Business Services in respect of the following Acts:

THEREFORE, PURSUANT to subsections 2(2), 5(1) and 8(1) of the Executive Council Act:

Minister to preside over Ministry1. The Minister of Small Business and Consumer Services (the “Minister”)

3. The Minister shall exercise the powers and perform the duties, functions and responsibilities that were previously assigned and transferred to the Minister of Small Business and Entrepreneurship, including the powers, duties, functions and responsibilities in respect of small business and entrepreneurship that had previously been assigned to the Minister of Small Business and Entrepreneurship under Order in Council O.C. 1960/2006 dated October 11, 2006, and such powers, duties, functions and responsibilities are assigned and transferred accordingly.

4. The Minister may exercise the powers of the Minister of Economic Development and Trade set out in sections 6, 6.1, 9 and 11 of the Ministry of Economic Development and Trade Act, R.S.O. 1990, c. M.27, in respect of activities and programs related to small business and entrepreneurship, that had previously been assigned to the Minister of Small Business and Entrepreneurship under Order in Council O.C. 1960/2006 dated October 11, 2006, which powers may also be exercised by the Minister of Economic Development and Trade in respect of activities and programs related to his or her portfolio.

5. All individuals or other persons who have suffered pecuniary or non-pecuniary losses (money or non money damages) as a result of the unlawful activity that was the subject of the forfeiture proceeding are entitled to make a claim for compensation.

Amending O. Reg. 282/98

1. Section 41 of Ontario Regulation 282/98 is revoked. 2. The Regulation is amended by adding the following section immediately before the heading “Assessed Value of Pipe Line in a Right-of-Way or Easement”: 41.2 (1) For the 2009, 2010, 2011 and 2012 taxation years, the assessed value of a pipe line shall be determined as follows: 1. The length of the pipe line in feet shall be multiplied by the applicable rate in Table 11, 12 or 13 of Part X. Table 11

applies to offshore pipe lines. Table 12 applies to plastic field gathering pipe lines and plastic gas distribution pipe lines. Table 13 applies to other pipe lines.

2. The amount determined under paragraph 1 shall be depreciated by reducing the amount by the applicable percentage in Table 14 for offshore pipe lines and in Table 15 for plastic field gathering pipe lines, plastic gas distribution pipe lines and other pipe lines.

3. After the reduction under paragraph 2, $250 shall be added for each connection to an end user. (2) If Table 11, 12 or 13 applies, but the outside diameter of the pipe line is not included in the Table, the applicable rate for the purposes of paragraph 1 of subsection (1) is the rate for the closest outside diameter or range of outside diameter that is included in the Table.

3. (1) Tables 1, 2, 3, 4 and 5 in Part X of the Regulation are revoked. (2) Part X of the Regulation is amended by adding the following Tables:

Amending O. Reg. 400/98 (Tax Matters — Tax Rates for School Purposes)

1. (1) Subsection 9 (1.1) of Ontario Regulation 400/98 is amended by adding the following definition: “new construction property classes” means the property classes described in section 15;

(2) Section 9 of the Regulation is amended by adding the following subsection: (8) For 2007, the annual tax rate for school purposes for the purposes of section 257.7 of the Act for the new construction property classes is the lesser of 0.0160000 and the rate, if any, that applied to the property under this Regulation as it read on April 20, 2008.

(3) Subsection 9 (8.1) of the Regulation is amended by adding the following paragraph: 4. Despite paragraphs 1 and 3, the annual tax rate for the new construction property classes is the lesser of 0.0160000 and

the rate, if any, that would otherwise apply under paragraph 1 or 3.

(4) Subsection 9 (8.2) of the Regulation is amended by adding the following paragraph: 6. Despite paragraphs 1, 2 and 5, the annual tax rate for the new construction property classes is the lesser of 0.0160000

and the rate, if any, that would otherwise apply under paragraphs 1, 2 or 5.

(5) Subsection 9 (8.3) of the Regulation is amended by adding the following paragraph: 3. Despite paragraphs 1 and 2, the annual tax rate for the new construction property classes is the lesser of 0.0160000 and

the rate, if any, that would otherwise apply under paragraph 1 or 2.

2. The Regulation is amended by adding the following sections:

NEW CONSTRUCTION PROPERTY CLASSES 15. (1) In this section, the last revised assessment roll means the last revised assessment roll within the meaning of subsection 37 (1) of the Assessment Act. (2) For the purposes of section 9, the following new construction property classes are prescribed: 1. The commercial (new construction) property class consists of land that would otherwise be in the commercial property

class and with respect to which all of the following requirements are satisfied: i. Improvements to the land have been made pursuant to a building permit issued under section 8 of the Building

Code Act, 1992, if an application for the building permit was made after March 22, 2007 and if the construction of the improvements was first authorized by that building permit.

ii. The improvements consist of one or more new buildings or structures erected on the land or of additions or renovations to existing buildings or structures on the land.

iii. The improvements result in an increase in the assessment of the land that is equal to or greater than 50 per cent of the assessment as set out on the last revised assessment roll before the change.

2. The industrial (new construction) property class consists of land that would otherwise be in the industrial property class and with respect to which all of the following requirements are satisfied:

i. Improvements to the land have been made pursuant to a building permit issued under section 8 of the Building Code Act, 1992, if an application for the building permit was made after March 22, 2007 and if the construction of the improvements was first authorized by that building permit.

3. The office building (new construction) property class consists of land that would otherwise be in the office building property class and with respect to which all of the following requirements are satisfied:




4. The shopping centre (new construction) property class consists of land that would otherwise be in the shopping centre property class and with respect to which all of the following requirements are satisfied:




5. The residual commercial (new construction) property class consists of land that would otherwise be in the residual commercial property class and with respect to which all of the following requirements are satisfied:

(3) The assessment and increased assessment referred to in subsection (2) do not include any assessment relating to land that is classified in the residential property class, the multi-residential property class or the new multi-residential property class.

DETERMINATION OF ASSESSMENT INCREASE FOR FUTURE YEARS 16. (1) This section applies to land on which construction is begun on or after March 22, 2007 and is completed within five taxation years. (2) For the purposes of section 15, the increased assessment of the land shall be determined according to the following rules: 1. Only construction that is begun on or after March 22, 2007 and is completed within five taxation years shall be taken

into consideration in determining the increase. 2. If the construction takes place over a period that includes a taxation year or years before a general reassessment and a

taxation year or years after a general reassessment, the increase shall be determined as follows: i. Determine the assessed value of the land for the taxation year before the year that the construction began.

ii. Determine the increase in the assessed value of the land for the period from the end of the taxation year referred to in subparagraph i to the end of the taxation year before the next general reassessment.

iii. Determine the fraction that the value determined under subparagraph i plus the increase determined under subparagraph ii is of the value determined under subparagraph i.

iv. Determine the assessed value of the land for the taxation year in which the next general reassessment occurs. v. Determine the increase in the assessed value of the land for the period beginning at the end of the taxation year

referred to in subparagraph iv and including any of the three subsequent taxation years during which there is construction on the land.

vi. Determine the fraction that the value determined under subparagraph iv plus the increase determined under subparagraph v is of the value determined under subparagraph iv.

vii. Multiply the fraction determined under subparagraph iii by the fraction determined under subparagraph vi. viii. Deduct 1.00 from the product determined under subparagraph vii and multiply by 100. (3) If portions of a parcel of land are classified in one of the commercial classes and in one of the industrial classes and the increased assessment in those classes on the parcel of land is equal to or greater than 50 per cent of the assessment as set out on the assessment roll for those classes for the parcel of land before the increase, each portion of the parcel of land shall be deemed to have an increased assessment equal to or greater than 50 per cent of the assessment as set out in the assessment roll for each portion of the parcel of land. (4) For the purposes of this section, an increase in assessment made under section 33 of the Assessment Act for the taxation year and either or both of the last two preceding years shall be deemed to have occurred in the first of the taxation years and not in any later taxation year. (5) For the purposes of this section if improvements to the land are made in taxation years in respect of which no general reassessment occurs, the increases in assessment in each year, if any, shall be cumulated arithmetically.

FARM PRODUCTS MARKETING ACT



DESIGNATION — FLOWERS CANADA (ONTARIO) INC.

Interpretation

1. (1) In this Regulation, “association” means Flowers Canada (Ontario) Inc.; “greenhouse floriculture plant” means a plant or propagative material that satisfies the following criteria:

1. The plant or propagative material is grown in whole or in part in a greenhouse or other enclosure under glass, plastic or other transparent or translucent material used for the purposes of controlling temperature and providing protection for the growing plant or propagative material.

2. The plant or propagative material is grown for the purpose of being used for cut flowers, potted plants or annual bedding plants.

3. The plant or propagative material is not grown for the purpose of being used for food or medicinal purposes, or for the production of food, medicines or nursery stock;

“propagative material” means seeds or plant parts, including stems, bulbs, tuberous roots, rhizomes, corms and roots; “year” means the period beginning on July 1 of one year and ending on June 30 of the following year. (2) Nothing in this Regulation applies to a perennial or biennial plant or propagative material that is grown for planting in the ground outdoors and that is grown in whole or in part in a greenhouse or any other enclosure under glass, plastic or other transparent or translucent material used for the purposes of controlling temperature and providing protection for the growing plant. Flowers Canada (Ontario) Inc. is designated as the representative association of producers of greenhouse floriculture plants within Ontario for the carrying out of a program for stimulating, increasing and improving the producing and marketing locally within Ontario of greenhouse floriculture plants by advertising, education, research and other means. Licence fees

3. (1) Every producer who grows 20,000 square feet or more of greenhouse floriculture plants in Ontario in a year shall pay the association an annual licence fee for the following year of $0.02 per square foot of greenhouse floriculture plants grown, to a maximum of $13,000 per year. (2) Fees payable in 2008 shall be calculated based on greenhouse floriculture plants grown between July 1, 2007 and June 30, 2008. Time of payment of fees

4. (1) Subject to subsection 2, on or before July 1 in each year, every producer who is required to pay licence fees under section 3 shall forward the fees to the association. (2) In 2008, every producer who is required to pay licence fees under section 3 shall forward the fees to the association on or before November 1. Use of fees

5. The association is authorized to use the licence fees for the purposes of defraying the expenses of the association in carrying out its objects. Information

Information The Ontario Gazette is published every Saturday. Advertisements/notices must be received no later than 3 pm on Thursday, 9 days before publication of the issue in which they should appear. For weeks including Easter Monday, November 11th or a statutory holiday allow an extra day. For the Christmas/New Year holiday schedule please contact the Gazette at (416) 326-5310 or by email at [email protected]

Advertising rates and submission formats:

1) For a first insertion electronically submitted the basic rate is $75 up to ¼ page.

2) For subsequent insertions of the same notice ordered at the same time the rate is $40 each.

3) Clients may confirm publication of a notice by visiting The Ontario Gazette web site at: www.ontariogazette.gov.on.ca or by viewing a printed copy at a local library.

Subscriptions:

The annual subscription rate is $126.50 + G.S.T. for 52 or 53 weekly issues beginning the first Saturday in January, payable in advance. In-year new subscriptions will be pro-rated for the first year. A new subscriber may order back issues of the Gazette at the single-copy rate as inventory permits.

Refunds for cancelled subscriptions will be pro-rated from 50% or less depending upon date. For subscription information/orders please call (416) 326-5306 during normal business hours.

Individual Gazette copies may be ordered on-line through the website at www.serviceontario.ca/publications or by phone at 1-800-668-9938.
