GENERAL EXPLANATORY NOTE:

ACT To amend the Administration of Estates Act, 1965, so as to fur
ther regulate the duties, functions and powers of the Master, executors and appraisers; to further regulate the liquidation of insolvent deceased estates; to make further provision for the sale of property in an estate; and to replace certain obsolete provisions; and to provide for matters connected therewith.

BE IT ENACTED by the State President and the House of Assembly of the Republic of South Africa, as follows:
1. Section 4 of the Administration of Estates Act, 1965 (hereinafter referred to as the principal Act), is hereby amended by the substitution for subparagraph (iO of the proviso to sub- 5 section (2) of the following subparagraph:
"(ii) in the case of any mentally [disordered or defective] ill person who [is] under the [Mental Disorders Act, 1916 (Act No. 38 of 1916)] Mental Health Act, 1973 (Act No. 18 of 1973), has been received or is detained in any 10 place, jurisdiction shall lie with the Master who, immediately prior to such reception or detention, had jurisdiction in respect of his property under paragraph (a) or (b).".
2. Section 6 of the principal Act is hereby amended by the 15 substitution for subsection (5) of the following subsection:
"(5) Every appraiser shall, in respect of every appraisement made by him, be entitled to a reasonable remuneration which shall be assessed according to a prescribed tariff of fees, and shall in case of a dispute regarding the correct- 20 ness thereof submit his account to the Master for taxation." .
3. Section 7 of the principal Act is hereby amended by the substitution for subsection (4) of the following subsection:
"(4) If the person signing any death notice was not pres- 25 ent at the death, or did not identify the deceased after death, [the Master may call upon any person having any interest in the estate for] such person shall furnish the Master with proof of the death.".
4. Section 18 of the principal Act is hereby amended by- 30 (a) the substitution in subsection (1) for the words pre
ceding paragraph (a) of the following words: "The Master shall, subject to the provisions of sub
sections (3), [(4)] (5) and (6}-";

ALGEMENE VERDUIDELIKENDE NOTA:

WET Tot wysiging van die Boedelwet, 1965, ten einde die pligte, werk
saamhede en bevoegdhede van die Meester, eksekuteurs en taksateurs verder te reel; die bereddering van insolvente bestorwe boedels verder te reel; verdere voorsiening vir die verkoop van goed in 'n boedel te maak; en sekere verouderde bepalings te vervang; en om voorsiening te maak vir aangeleenthede wat daarmee in verband staan.

DAAR WORD BEPAAL deur die Staatspresident en die Volksraad van die Republiek van Suid-Afrika, soos volg:
1. Artikel 4 van die Boedelwet, 1965 (hieronder die Hoofwet W;:siging van genoem), word hierby gewysig deur subparagraaf (ii) van die artJk~~4 van
5 voorbehoudsbepaling by subartikel (2) deur die volgende subpa- Wet van 1965
. ragraaf te vervang:
;, (ii) in die geval van 'n [geestelik gekrenkte of gebrekkige] geestesongestelde per soon wat kragtens die ["Wet op Geestesgebreken, 1916" (Wet No. 38 van 1916)] Wet op
10 Geestesgesondheid, 1973 (Wet No. 18 van 1973), in enige plek opgeneem is of aangehou word, reg~bevoegdheid by die Meester berus wat onmiddellik voor bedoelde opname of aanhouding, kragtens paragraaf (a) of (b) ten opsigte van sy goed regsbevoegdheid be

2. Artikel 6 van die Hoofwet word hierby gewysig deur subar- W;:siging van tikel (5) deur die volgende subartikel te vervang: artlkel6 van

3. Artikel 7 van die Hoofwet word hierby gewysig deur subar Wysiging van artikel 7 van tikel (4) deur die volgende subartikel te vervang: Wet 66 van 1965.
25 ,,(4) Indien die persoon wat 'n sterfkennis onderteken, nie by die sterfgeval aanwesig was of na die dood die oorledene uitgeken het nie, [kan] moet bedoelde persoon aan die Meester [van enigiemand wat by die boedel belang het] bewys van die sterfgeval [verlang] lewer.".
30 4. Artikel 18 van die Hoofwet word hierby gewysig deur- Wysiging van artikel18 van (a) in subartikel (1) die woorde wat paragraaf (a) voorafWet 66 van 1965, gaan deur die volgende woorde te vervang: soos gewysig deur
"Die Meester moet, behoudens die bepalings van artikell van subartikels (3), [(4)] (5) en (6)-"; Wet 15 van 1978
en artikel 1 van Wet 90 van 1981.

(b) the substitution in subsection (1) for the words following on paragraph (f) of the following words: "appoint and grant letters of executorship to such person or persons whom he may deem fit and proper to be executor or executors of the estate of the deceased, or, 5 if he deems it necessary or expedient, by notice published in the Gazette and in such other manner as in his opinion is best calculated to bring it to the attention of the persons concerned, call upon the surviving spouse
• (if any), the heirs of the deceased and all persons having claims against [his] the estate, to attend before him or, if more expedient, before any other Master or any magistrate at a time and place specified in the notice, for the purpose of recommending to the Master for appointment as executor or executors, a person or a 15 specified number of persons.";
(e) the substitution for subsection (2) of the following subsection:
"(2) If the Master has published a notice under subsection (1) he shall, on receipt of [such] the recommendation in question or when it appears that the persons concerned have failed to make any recommendation, [the Master shaUl subject to the provisions of subsection (3) and sections 19, 22 and 23, unless it appears to him to be necessary or expedient to postpone the ap- 25 pointment and to publish another notice under subsection (1), appoint and grant letters of executorship to such person or persons as he deems fit and proper to be executor or executors of the estate of the deceased.";
(d) the substitution for subsection (3) of the following subsection:

"(3) If the value of any estate does not exceed R15 000, the Master may dispense [with a notice under subsection (1) and] with the appointment of an executor and give directions as to the manner in which any such 35 estate shall be liquidated and distributed.";
(e) the deletion of subsection (4); and (f) the substitution in subsection (5) for the words preced
ing paragraph (a) of the following words: "The Master may at any time [without any such no
tice]-".
Amendment of 5. Section 19 of the principal Act is hereby amended by the section 19 of Act 66 of 1965.

"If [at any meeting in pursuance of a notice under section 18 45 (1)] more than one person is nominated for recommendation to the Master, the Master shall, in making any appointment, give preference to--".
Amendment of section 27 of Act 66 of 1965.
6. Section 27 of the principal Act is hereby amended by(a) the substitution for subsection (1) of the following sub
section: "(1) An executor who has been ordered thereto by
the Master or who in terms of section 23 was required to find security, shall(a) within thirty days after letters of executorship have 55
been granted to him, or within such further period or periods as the Master may allow, lodge with the Master an inventory in the prescribed form signed by him in person showing the estimated value of all property in the estate; and

(c) subartikel (2) deur die volgende subartikel te vervang: ,,(2) lndien die Meester 'n kennis~ewing kragtens
subartikel (1) gepubliseer het, stel hy by ontvangs van [bedoelde] die betrokke aanbeveling of wanneer dit blyk dat die betrokke persone versuim het om 'n aanbeveling te doen, [stel die Meester] behoudens die bepalings van subartikel (3) en artikels 19, 22 en 23, tensy dit vir hom voorkom dat dit nodig of wenslik is om die aanstelling uit te stel en 'n ander kennisgewing kragtens subartikel (1) te publiseer, die persoon of persone aan wat hy.geskik ag om eksekuteur of eksekuteurs van die boedel van die oorledene te wees, en reik hy eksekuteursbriewe aan hom of hulle uit.";
(d) subartikel (3) deur die volgende subartikel te vervang: ,,(3) lndien die waarde van 'n boedel nie meer as
R15 000 bedra nie, kan die Meester van ['n kennisgewing kragtens subartikel (1) en van] die aanstelIing van 'n eksekuteur afsien, en opdrag gee aangaande die wyse waarop so 'n boedel beredder en verdeel moet word.";
(e) subartikel (4) te skrap; en (f) in subartikel (5) die woorde wat paragraaf (a) vooraf
gaan deur die volgende woorde te vervang: "Die Meester kan te eniger tyd [sonder so 'n kennis
gewing]-" .
5. Artikel 19 van die Hoofwet word hierby gewysig deur die Wysiging van artikel19 van woorde wat paragraaf (a) voorafgaan deur die volgende woorde Wet 66 van 1965. te vervang:
"lndien meer as een persoon [by 'n vergadering ingevolge 'n kennisgewing kragtens artikel 18 (1)] vir aanbeveling by die Meester benoem word, gee die Meester by die doen van 'n aanstelling voorkeur aan-" .
6. Artikel 27 van die Hoofwet word hierby gewysig deur- Wysiging van (a) subartikel (1) deur die volgende subartikel te vervang: artikel27 van
,,(1) 'n Eksekuteur wat deur die Meester daartoe Wet 66 van 1965.

(b) thereafter, whenever he comes to know of any such property which is not mentioned in any inventory lodged by him with the Master, within fourteen days after he has come to know of such property, or within such further period as the Master 5 may allow, lodge with the Master an additional inventory so signed by him showing the estimated value thereof.";
(b) the substitution for subsection (2) of the following subsection:
"(2) If [any executor bas] in any inventory lodged with the Master [placed upon any property a value] in terms of section 9 or subsection (1) of this section, any estimate has been made of the value of any property which the Master has reason to believe is not [the true 15 value] a reasonably correct estimate thereof, the Master may, at the expense of the estate, [cause the value of] order that property to be appraised by an appraiser or any other person approved by the Master."; and
(e) the deletion of subsection (3).
7. Section 28 of .the principal Act is hereby amended by(a) the substitution for subsection (1) of the following sub
section: "(1) An executor
(a) shall, unless the Master otherwise directs, as soon 25 as he has in hand moneys in the estate in excess of [forty rand] B!QQ., open [an] a cheque account in the name of the estate with a banking institution in the Republic and shall deposit therein the moneys which he has in hand and such other moneys as he may from time to time receive for the estate;
(b) may [with the written permission of tbe Master] open a savings account in the name of the estate with a banking institution or a building society and may transfer thereto so much of the moneys de- 35 posited in the account referred to in paragraph (a) as is not immediately required for the payment of any claim against the estate;
(e) may [with the written permission of the Master] place so much of the moneys deposited in the account referred to in paragraph (a) as is not immediately required for the payment of any claim against the estate on interest-bearing deposit with a banking institution or a building society."; and
(b) the substitution for subsection (3) of the following sub- 45 section:
"(3) No exec~tor who in compliance with a request of the Master under subsection (2), has notified the MaS-I ter of the office or branch of the banking institution or building society with which he has opened an account referred to in subsection (1) shall transfer any such account from any such office or branch to any other such office or branch, except after written notice to the Master." .
8. Section 29 of the principal Act is hereby amended by the 55 deletion of the proviso to subsection (1).
9. Section 30 of the principal Act is hereby amended by the 'substitution for paragraph (b) of the following paragraph:
"(b) thereafter, unless, in the case of property of a value not exceeding [five hundred rand] .Ei.Q,QQ, the Master or, in the case of any other property, the Court otherwise directs, " .

(b) daarna, wanneer hy van enige sodanige goed te wete kom wat nie in 'n inventaris deur hom by die Meester ingelewer, vermeld word nie, binne veertien dae nadat hy van daardie goed te wete gekom
5 het, of binne die verdere tydperk wat die Meester toestaan, by die Meester 'n addisionele inventaris deur hom aldus onderteken, inlewer waarin die skatte waarde daarvan aangegee word.";
(b) subartikel (2) deur die volgende subartikel te vervang: ,,(2) Indien ['n eksekuteur] in 'n inventaris by die
Meester ingelewer lop enige goed 'n waarde gestel het] ingevolge artikel 9 of subartikel (1) van hierdie artikel, 'n skatting gemaak is van enige goed waaromtrent die Meester rede het om te vermoed dat dit nie [die werk
15 like waarde] 'n redelik korrekte skatting daarvan is nie, kan die Meester op koste van die boedel gel as dat daardie goed deur 'n taksateur of 'n ander deur die Meester goedgekeurde persoon [laat waardeer] gewaardeer word."; en
(c) subartikel (3) te skrap.
7. Artikel 28 van die Hoofwet word hierby gewysig deur- Wysiging van (a) subartikel (1) deur die volgende subartikel te vervang: artikel28 van
Ek Wet 66 van 1965, " (1) ' n sekute~r- S005 vervang cleur
(a) moet, tensy dIe Meester anders gelas, sodra hy artikel3 van meer as [veertig rand] RlOO aan boedelgelde voor- Wet 79 van 1971.25 hande het, by 'n bankinstelling in die Republiek 'n [rekening] tjekrekening op naam van die boedel open, en die gel de wat hy voorhande het daarin stort, asook die ander gelde wat hy van tyd tot tyd vir die boedel ontvang;
(b) kan [met skriftelike verlof van die Meester] by 'n bankinstelling of 'n bouvereniging 'n spaarrekening op naam van die boedel open, en kan soveel van die gelde gestort in die in paragraaf (a) ver
35 melde rekening as wat nie onmiddellik vir betaling van 'n vordering teen die boedel nodig is nie, daarin oorbetaal;
(c) kan [met skriftelike verlof van die Meester] ~ van die gelde gestort in die in paragraaf (a) vermelde rekening as wat nie onmiddeIlik vir betaling van 'n vordering teen die boedel nodig is nie, by 'n bankinstelling of 'n bouvereniging in rentedraende deposito plaas."; en
(b) subartikel (3) deur die volgende subartikel te vervang: 45 ,,(3) 'n Eksekuteur wat ter voldoening aan 'n ver
soek van die Meester kragtens subartikel (2), die Meester in kennis gestel het van die kantoor of tak van die bankinstelling of bouvereniging waarin hy 'n in subartikel (1) vermelde rekening geopen het, plaas so 'n rekening nie van enige sodanige kantoor of tak na 'n ander sodanige kantoor of tak oor nie, behalwe na skriftelike kennisgewing aan die Meester." .
8. Artikel 29 van die Hoofwet word hierby gewysig deur die WY5iging van voorbehoudsbepaling by subartikel (1) te skrap. artike129 van
Wet 66 van 1965, 5005 gewysig cleur artikel 2 van Wet 15 van 1978.

Substitution of 10. (1) The following section is hereby substituted for section section 34 of 34 of the principal Act: Act 66 of 1965, as amended by "Insolvent section 4 of deceased Act 15 of 1978. notice referred to in section 29 the executor shall satestates.
isfy himself as to the solvency of the estate and, if the estate is found to be insolvent then or any time before distribution under subsection (12) of section 35, he shall forthwith by notice in writing (a copy of which he shall lodge with the Master) report the position of the estate to the creditors, informing them that unless the majority in number and value of all the creditors instruct him in writing within a period
, specified in the notice (not being less than fourteen days) to surrender the estate under the Insolvency Act, 1936 (Act No. 24 of 1936), he will proceed to realize the assets in the estate in accordance with the provisions of subsection (2): Provided that(a) no creditor whose claim amounts to less than
RIOO shall be reckoned in number; (b) any creditor holding any security which a trustee
would under section 83 of the said Act have been authorized to take over if the estate had been sequestrated, shall, if called upon to do so in writing by the executor, place a value thereon within the period specified by the executor, and shall be reckoned in respect of the balance of his claim which is, according to such valuation, insecured; and
(e) if any creditor fails to place a value on any such security within the said period, he shall not be reckoned as a creditor for the purpose of this subsection.
(2) If after the expiry of the period specified in the notice under subsection (1) the executor has not in accord;mce with such notice been directed to surrender the estate, he shall, after the creditors have bee notified in writing, for a period not being less than fourteen days, of the manner and conditions of the intended sale of the assets, sell the assets in the estate.
(3) A creditor may at any time before the sale 0
an asset lodge with the executor an objection to the intended sale of that asset, and shall send a copy 0
that objection to the Master.
(4) After considering the objection, any comment the executor may have made regarding the objection and the further particulars wfiich the Master may have required, the Master shall order the executor to proceed with the sale or give any other order regarding the sale of the asset as he thinks fit.
(5) In so far as a date of sequestration is relevant for the purposes of the distribution of an estate under this section, such date shall be deemed to be the date immediately following the date on which the period specified in the notice given in respect of the estate in question under subsection (1), has expired.
(6) If any creditor has under paragraph (b) of the proviso to subsection (1) placed a value on any security, the executor may at any time within six weeks thereafter deal therewith mutatis mutandis in the manner provided in section 83 of the Insolvency Act'l 1936.

(a) geen skuldeiser wie se vordering minder as RlO bedra, in getal gereken word nie;
(b) 'n skuldeiser in be sit van 'n sekuriteit wat 'n kurator, as die boedel gesekwestreer was, kragtens artikel 83 van gemelde Wet gemagtig sou gewees het om oor te neem, binne die deur die eksekuteur vermelde tydperk 'n waarde daarop moet stel indien hy skriftelik deur die eksekuteur aangese word om dit te doen, en gereken word ten opsigte van die gedeelte van sy vordering wat volgens bedoelde waardering onverseker is; en
(c) indien 'n skuldeiser versuim om binne gemelde tydperk op so 'n sekuriteit 'n waarde te stel, hy by die toepassing van hierdie subartikel nie as 'n skuldeiser gereken word nie.
(2) Indien na verloop van die tydperk vermeld in die kennisgewing kragtens subartikel (1) die eksekuteur nie ooreenkomstig bedoelde kennisgewing gelas is om die boedel oor te gee nie, moet hy die bates van die boedel verkoop nadat aan die skuldeisers 'n tydperk van minstens veertien dae skriftelik kennis gegee is van die wyse en voorwaardes van enige voorgenome verkoping van die bates.
(3) 'n Skuldeiser kan te eniger tyd voor die verkoop van 'n bate by die eksekuteur 'n beswaar teen die voorgenome verkoping van daardie bate indien en moet 'n afskrif van daardie beswaar aan die Meester stuur.
(4) Na die oorweging van die beswaar, enige kommentaar wat die eksekuteur betreffende die beswaar mag gelewer het en die nadere besonderhede wat die Meester mag vereis het, gelas die Meester die eksekuteur om met die verkoop voort te gaan of gee hy na goeddunke enige ander opdrag in verband met die verkoop van die bate.
(5) Vir sover 'n datum van sekwestrasie by die verdeling van 'n boedel kragtens hierdie artikel ter sake is, word sodanige datum geag die datum te wees wat onmiddellik volg op die datum waarop die tydperk vermeld in die kennisgewing kragtens subartikel (1) ten opsigte van die betrokke boedel gegee, verstryk het.
(6) Indien 'n skuldeiser ingevolge paragraaf (b) van die voorbehoudsbepaling by subartikel (1) 'n waarde op 'n sekuriteit gestel het, kan die eksekuteur te eniger tyd binne ses weke daarna mutatis mutandis daarmee handel op die wyse in artikel 83 van die Insolvensiewet, 1936, bepaaL

(7) (a) An executor shall, as soon as may be after the expiry of the period specified in a notice referred to in subsection (1), but within(i) six months after letters of executorship have
been granted to him; or Oi) such further period as the Master may in
any case allow, submit to the Master an account in the prescribed form, supported by vouchers, of the liquidation and distribution of the estate.
(b) Such account shall provide for the distribution of the proceeds in the order of preference prescribed under the Insolvency Act, 1936, in the case of a sequestrated estate.
(8) The Master may at any time in any case i which he has exercised his powers under subsection (7) (a) Oi) or in which an executor has funds in han which ought, in the opinion of the Master, to be distributed or applied towards the payment of debts, direct the executor in writing to submit to him within a specified period an interim account in the prescribed form, supported by vouchers.
I (9) The provisions of subsections (3) to (11), in
clusive, of section 35 shall mutatis mutandis appl with reference to any account referred to in this section.
(10) When an account has lain open for inspection and(a) no objection has been lodged; or (b) an objection has been lodged and the account
has been amended in accordance with the Master's direction and has again lain open for inspection and no application has been made to the Court to set aside the Master's decision; or
(e) an objection has been lodged but has been withdrawn or has not been sustained, and no such application has been made to the Court within the said period,
the Master shall confirm the account and his confirmation shall be conclusive save as against a person in whose favour the Court may, before a dividend has been paid out in accordance with the account, have granted an order to reopen the account.
(11) When an account has been confirmed by the Master, the executor shan forthwith pay the creditors and distribute the estate among the heirs, if any, in accordance with the account, and lodge with the Master the receipts and acquittances of the creditors and heirs, if any: Provided that a cheque purporting to be drawn payable to a creditor or heir in respect of any claim or share due to him and paid by the banker on whom it is drawn, may be accepted by the Master in lieu of any such receipt or acquittance.
(12) The executor shall not later than two months after the estate has become distributable in terms 0
subsection (11), pay to the Master for deposit in the guardian's fund on behalf of the persons entitled thereto, all moneys which he has for any reason been unable to distribute in accordance with the account.
(13) The provisions of this section shall not prevent the sequestration of any estate in terms of the Insolvency Act, 1936.".
~ (2) If before the commencement of subsection (1) an executor has reported to the Master that an estate is insolvent, that estate shall be dealt with as if section 34 of the principal Act had not been substituted by subsection (1).

(7) (a) 'n Eksekuteur moet, so spoedig doenlik na verloop van die tydperk in 'n in subartikel (1) bedoelde kennisgewing vermeld, maar binne(i) ses maande nadat 'n eksekuteursbrief aan
hom uitgereik is; of (ii) die verdere tydperk wat die Meester in
enige geval toestaan, aan die Meester 'n rekening in die voorgeskrewe vorm voorle, gestaaf deur bewysstukke, van die bereddering en verdeling van die boedel.
(b) Sodanige rekening moet voorsiening maak vir die verdeling van die opbrengs volgens die voorkeurvolgorde ingevolge die lnsolvensiewet, 1936, in die geval van 'n gesekwestreerde boedel voorgeskryf.
(8) Die Meester kan te eniger tyd, in enige geval waarin hy sy bevoegdhede kragtens subartikel (7) (a) (ii) uitgeoefen het of waarin 'n eksekuteur fondse voorhande het wat na die mening van die Meester verdeel of ter betaling van skulde aangewend behoort te word, die eksekuteur skriftelik gelas om binne 'n bepaalde tydperk 'n tussentydse rekening in die voorgeskrewe vorm, gestaaf deur bewysstukke, aan hom voor te Ie.
(9) Die bepalings van subartikels (3) tot en met (11) van artike135 is mutatis mutandis van toepassing ten opsigte van enige rekening in hierdie artikel vermeld.
(10) Wanneer 'n rekening ter insae gele het en(a) geen beswaar ingedien is nie; of (b) 'n beswaar ingedien is en die rekening oor
eenkomstig die Meester se opdrag gewysig is en weer ter insae gele het en geen aansoek by die Hof gedoen is om die Meester se besluit tersyde te stel nie: of
(e) 'n beswa11r ingedien maar teruggetrek is of nie gehandhaaf is nie, en geen sodanige aansoek binne genoemde tydperk by die Hof gedoen is nie,
moet die Meester die rekening bekragtig en is sy bekragtiging afdoende behalwe teenoor iemand ten gunste van wie die Hof, voordat 'n dividend ooreenkomstig die rekening uitbetaal is, 'n bevel toestaan om die rekening te heropen.
(11) Wanneer 'n rekening deur die Meester bekragtig is, moet die eksekuteur onverwyld, ooreenkomstig die rekening, die skuldeisers uitbetaal en die boedel onder die erfgename, as daar is, verdeel, en die kwitansies en kwiterings van bedoelde skuldeisers en erfgename, as daar is, by die Meester inlewer: Met dien verstande dat 'n tjek wat so getrek heet te wees dat dit aan 'n skuldeiser of erfgenaam ten opsigte van enige vordering of aandeel aan hom verskuldig, betaalbaar is en deur die bankier op wie dit getrek is, betaal is, deur die Meester in pIa as van so 'n kwitansie of kwitering aanvaar kan word.
(12) Die eksekuteur moet binne twee maande nadat die boedel ingevolge subartikel (11) verdeelbaar geword het, aIle gelde wat hy om die een of ander rede nie ooreenkomstig die rekening kon verdeel nie, aan die Meester betaal om ten behoewe van die persone wat daarop geregtig is, in die voogdyfonds gestort te word.
(13) Die bepalings van hierdie artikel verhinder nie die sekwestrasie van enige boedel kragtens die Insolvensiewet, 1936, nie.".
(2) Indien 'n eksekuteur voor die inwerkingtreding van subartikel (1) aan die Meester verslag gedoen het dat 'n boedel insolvent is, moet met daardie boedel gehandel word asof artikel 34 van die Hoofwet nie deur subartikel (1) vervang is nie.

(3) Subsection (1) shall come into operation on a date fixed by the State President by proclamation in the Gazette.
11. Section 35 of the principal Act is hereby amended by(a) the substitution for subsection (1) of the following sub
section: "(1) An executor shall, as soon as may be after the
last day of the period specified in the notice referred to in section 29 (1), but within(a) six months after letters of executorship have been
granted to him [if the gross value of the estate exceeds five thousand rand]; or
[(b) three months after letters of executorship have been granted to him if the gross value of the estate does not exceed five thousand rand; or
(e)] (b) such further period as the Master may in any 15 case allow,
submit to the Master an account in the prescrib~d form, supported by vouchers, of the liquidation and distribution of the estate."; and
(b) the substitution for subsection (2) of the following subsection:
"(2) The Master may at any time in any case in which he has exercised his powers under paragraph [(e)] (b) of subsection (1) or in which an executor has funds in hand which ought, in the opinion of the Mas- 25 ter, to be distributed or applied towards the payment of debts, direct the executor in writing to submit to him an interim account in the prescribed form, supported by vouchers, within a period specified.".
12. Section 42 of the principal Act is hereby amended by the substitution for subsection (1) of the following subsection:
"(1) Except as is otherwise provided in subsection (2), an executor who desires to have any immovable property registered in the name of any heir or other person legally entitled to such property or to have any endorsement made 35 under section 39 or 40 shall, in addition to any other deed or document which he may be by law required to lodge with the registration officer, lodge with the said officer a certificate by [the Master] a conveyancer that the proposed transfer or endorsement, as the case may be, is in accordance with the liquidation and distribution account.".
13. The following section is hereby substituted for section 47 of the principal Act:
"Sales by 47. Unless it is contrary to the will of the deexecutor. ceased, an executor shall sell property (other than
property of a class ordinarily sold through a stockbroker or a bill of exchange or property sold in the ordinary course of any business or undertaking carried on by the executor) in the manner and subject to the conditions which the heirs who have an interest therein approve in writing: Provided that(a) in the case where an absentee, a minor or a per
son under curatorship is heir to the property; or (b) if the said heirs are unable to agree on the man
ner and conditions of the sale, the executor shall sell the property in such manne and subject to such conditions as the Master may approve.".

11. Artikel35 van die Hoofwet word hierby gewysig deur- Wysigingvan (a) subartikel (1) deur die volgende subartikel te vervang: artikel35 van

[(b) drie maande nadat 'n eksekuteursbrief aan hom uitgereik is, as die bruto waarde van die boedel nie meer as vyfduisend rand bedra nie; of
(e)] (b) die verdere tydperk wat die Meester in enige 15 gi;aI toestaan,
aan die Meester 'n rekening in die voorgeskrewe vorm voorle, gestaaf deur bewysstukke, van die bereddering en verdeling van die boedel."; en
(b) subartikel (2) deur die volgende subartikel te vervang: ,,(2) Die Meester kan te eniger tyd, in enige geval
waarin hy sy bevoegdhede kragtens paragraaf [(e)] (b) van subartikel (1) uitgeoefen het of waarin 'n eksekuteur fondse voorhande het wat na die mening van die Meester verdeel of ter betaling van sku Ide aangewend

12. Artikel 42 van die Hoofwet word hierby gewysig deur sub- Wysiging van artikel (1) deur die volgende subartikel te vervang: artikel42 van
,,(1) Behalwe soos in subartikel (2) anders bepaal, moet ~~~ ~~r:~~~~C;;~r 'n eksekuteur wat verlang om onroerende goed op naam artikel19 van van 'n erfgenaam of ander persoon wat regtens op sodanige Wet 102 van 1967. goed geregtig is, te laat registreer of om 'n aantekening in
35 gevolge artikel 39 of 40 te laat aanbring, benewens enige ander akte of stuk wat hy volgens wet by die registrasiebeampte moet inlewer, 'n sertifikaat deur [die Meester] 11 transportbesorger dat die voorgenome transport of aantekening, na gelang van die geval, in ooreenstemming met die likwidasie- en distribusierekening is, by gemelde beampte inlewer." .
13. Artikel 47 van die Hoofwet word hierby deur die volgende Ve:vanging van artikel vervang: arttkel47 van
Wet 66 van 1965. " Verkopings 47. Tens dit met die testament van die oorledene deur
strydig is, moet 'n eksekuteur goed (behalwe goed 45 eksekuteur. van 'n soort wat gewoonlik deur 'n effektemakelaar verkoop word of 'n wissel of goed wat verkoop word in die gewone loop van 'n besigheid of onderneming wat deur die eksekuteur voortgesit word) verkoop op die wyse en onderworpe aan die voorwaardes wat die erfgename wat 'n belang in die goed het skriftelik goedkeur: Met dien verstande dat(a) in die geval waar 'n afwesige 'n minderjarige
of 'n persoon wat onder kuratele is, 'n erfge55 naam van die goed is; of
(b) indien gemelde erfgename nie kan ooreenkom oor die wyse en voorwaardes van die verkoping nie,
die eksekuteur die goed verkoop op die wyse en onderworpe . aan die voorwaardes wat die Meester goedkeur." .

14. Section 51 of the principal Act is hereby amended by the substitution for subsection (4) of the following subsection:
"(4) An executor shall not be entitled to receive any remuneration before the estate has been distributed as provided in section 34 [(4)] (11) or 35 (12), as the case may be, 5 unless payment of such rei'i1uneration has been approved in writing by the Master. ".
15. The following section is hereby substituted for section 53 of the principal Act:
"Absence'of 53. An executor shall not be absent from the Re- 10 ~xecu~r b public for a period exceeding 60 days unlessIi~m cpu - (a) the Master has before his departure from the
Republic granted him permission in writing to be absent;
(b) he complies with such conditions as the Master may think fit to impose; and
(c) he has given such notice of his intention to be so absent as the Master may have directed.".
16. Section 54 of the principal Act is hereby amended by

(a) the deletion of subparagraph (i) of paragraph (a) of 20 subsection (1); and
(b) the substitution for subparagraph (ii) of paragraph (b) of subsection (1) of the following subparagraph:
H(ii) if he fails to comply with a notice under section 23 (3) within the period specified in the notice or 25 within such further period as the Master may allow [and was, prior to the issue of such notice, under an obligation to find security for the proper performance of his functions]; or".
17. Section 73 of the principal Act is hereby amended by- 30 (a) the substitution in subsection (1) for the words preced
ing paragraph (a) of the following words: "The Master may, subject to the provisions of sub
sections (2), [and] (3) ~"; (b) the substitution for paragraph (b) of subsection (1) 35
of the following paragraph: "(b) in any case in which it would, in terms of the pro
viso to [subsection (1) of section sixty·twp of the Mental Disorders Act, 1916 (Act No. 38 of 1916)] section 56 (1) of the Mental Health Act, 1973 (Act 40 No. 18 of 1973), be competent for a judge in chambers to appoint a curator; or";
(c) the substitution for subsection (2) of the following subsection:
"(2) Subsections (2), [(4)] (5) and (6) of section 18 45 shall mutatis mutandis apply with reference to tutors and curators: Provided that for the purposes of the application under this subsection of the said subsection (2), the reference to section 18 (3) and to section 19 shall be deemed to be omitted. "; and
(d) the addition of the following subsection: "(4) The Master may, if the value of the property of
any minor or absentee or other person referred to in subsection (1) does not exceed R5 000, without any notice under that subsection, appoint and grant letters of tutorship or curatorship to such person or persons as he deems fit and proper as tutor or tutors or curator or curators, as the case may be.".

14. Artikel 51 van die Hoofwet word hierby gewysig deur subartikel (4) deur die volgende subartikel te vervang:
,,(4) 'n Eksekuteur is nie op vergoeding geregtig nie alvorens die boedel volgens die bepalings van artikel 34 [(4)] i!1l.0f 35 (12), na gelang van die geval, verdeel is, tensy betaling van sodanige vergoeding skriftelik deur die Meester goedgekeur is." .

15. Artikel 53 van die Hoofwet word hierby deur die volgende Vervangingvan artikel vervang: artikel53 van
Wet 66 van 1965.
"Afwesigheid 53.'n Eksekuteur rna nie vir 'n tydperk van lang-van eksekuteur er as 60 dae uit die Republiek afwesig wees nie, tenuit sy-Rcpublick. (a) die Meester aan hom voor sy vertrek uit die Re
publiek skriftelik veri or verleen het om aldus afwesig te wees;
(b) hy voldoen aan die voorwaardes wat die Meester wenslik ag om op te Ie; en
(c) hy van sy voomeme om aldus afwesig te wees, die kennis gegee het wat die Meester mag gelas heL".
16. Artikel 54 van die Hoofwet word hierby gewysig deur(a) subparagraaf (i) van paragraaf (a) van subartikel (1) te
skrap; en (b) subparagraaf (ii) van paragraaf (b) van subartikel (1)
deur die volgende subparagraaf te vervang: ,,(ii) indien hy versuim om aan 'n kennisgewing krag
tens artikel 23 (3) gevolg te gee binne die tydperk in die kennisgewing vermeld of binne die verdere tydperk wat die Meester toelaat [en voor die uitreiking van die kennisgewing onder 'n verpligting gestaan het om sekerheid vir die behoorlike verrigting van sy werksaamhede te stell; of".
17. Artikel73 van die Hoofwet word hierby gewysig deur(a) in subartikel (1) die woorde wat paragraaf (a) vooraf
gaan deur die volgende woorde te vervang: "Die Meester kan, behoudens die bepalings van subartikels (2), [en] (3) en (4) -";
(b) paragraaf (b) van subartikel (1) deur die volgende paragraaf te vervang:
,,(b) in enige geval waarin 'n Kamerhof luidens die voorbehoudsbepaling by [subartikel (1) van artikel twee-en-sestig van die "Wet op Geestesgebreken, 1916" (Wet No. 38 van 1916)] artikel56 (1) van die Wet op Geestesgesondheid, 1973 (Wet No. 18 van 1973), bevoeg sou wees om 'n kurator aan te stel; of";
(c) subarUkel (2) deur die volgende subartikel te vervang: ,,(2) Subartikels (2), [(4)] (5) en (6) van artikel 18 is
mutatis mutandis van toepassing met betrekking tot voogde en kurators: Met dien verstande dat by die toepassing kragtens hierdie subartikel van genoemde subartikel (2), die verwysing na artikel 18 (3) en na artikel 19 geag word wegge1aat te wees."; en
(d) die volgende subartikel by te voeg: ,,(4 Die Meester kan, indien die waarde van die
goed van emge mm efJange, a eSlge 0 an er persoon in subartikel (1) verme1d nie meer as R5 000 bedra nie, sonder enige kennisgewing kragtens daardie subartikel, die persoon of persone wat hy geskik ag as voog of voogde of as kurator of kurators, na gelang van die geval, aanstel en 'n voogdybrief of 'n brief van kuratele aan hom of hulle uitreik.".

18. Section 77 of the principal Act is hereby amended by the substitution for subsection (1) of the following subsection:
"(1) Every person appointed or to be appointed tutor or curator as provided in section 72 (1) (d) or (2) or under section 73 or 74, shall, before letters of tutorship or curatorship are granted or signed and sealed, or any endorsement is made, as the case may be, and at any time thereafter when called upon by the Master to do so, find security or additional security to the satisfaction of the Master '""li1iii amount determined by the Master, for the proper performance of his functions.".
, 19. The following section is hereby substituted for section 87
of the principal Act:
"Moneys in 87. The moneys in the guardian's fund shall be guardian's deemed to be deposits for the purposes of the Public fund to be Debt Commissioners Act, [1911] 1969 (Act No.2 ofdeposits for purposes of 1969), and the Master may from time to time payout Act 2 of of any working balance retained at his disposal under 1969.
the said Act, any amounts due and payable out of the said fund.".
20. Section 90 of the principal Act is hereby amended by the substitution for the proviso of the following proviso:
"Provided that, subject to the terms of any such will or instrument, the aggregate of the payments made in the case of any minor or other person for purposes of maintenance, education or other benefit shall not, without the sanction of the Court, exceed [four thousand rand] RIO 000 of the capital amount received for account of the minor or other person concerned.".
21. The following section is hereby substituted for section 91 of the principal Act:
"Publication 91. The Master shall in the month of September of of list of each year cause to be published in the Gazette a list unclaimed of all amounts of [twenty rand] RlOO or more in the moneys.

lic shall in the month of January in each year prepare in the prescribed form and publish in the Gazette [separate] a detailed [statements] statement in respect of all amoii'nts of one rand or more [but of less than twenty rand and all amounts of twenty rand or more] which were held by him or by any agent on his behalf in the Republic on the thirty-first day of December of the immediately preceding year and which were not his property or subject to any valid lien, but at the time of the preparation of the said [statements] statement have remained unclaimed for a period of five years or more by the rightful owners. ";
(b) the substitution for subsection (2) of the following subsection:

18. Artikel 77 van die Hoofwet word hierby gewysig deur sub- Wysiging van artikel (1) deur die volgende subartikel te vervang: artikel77 van
,,(1) Iedere persoon wat volgens die bepalings van artikel Wet 66 van 1965.
72 (1) (d) of (2) of kragtens artikel 73 of 74 as voog of kurator aangestel is of moet word, moet, alvorens 'n voogdybrief of 'n brief van kuratele uitgereik of onder ampseel onderteken word of 'n endossement aangebring word, na gelang van die geval, en te eniger tyd daarna wanneer deur die Meester daartoe vereis, tot bevrediging van die Meester sekerheid of verdere sekerheid stel tot 'n bedrag wat die Meester bepaal, vir die behoorlike verrigting van sy werksaamhede." .
19. Artikel 87 van die Hoofwet word hierby deur die volgende Ve~vanging van artikel vervang: arttkel87 van
Wet 66 van 1965. "Ge\de in 87. Die gelde in die voogdyfonds word by die toevoogdyfonds passing van die ["Openbare Schuld Kommissarissen is vir Wet, 1911"] Wet op die Staatskuldkommissarisse, doeleindes van 1969 (Wet No.2 van 1969), geag deposito's te wees, Wet 2 van en die Meester kan van tyd tot tyd uit enige be1969 deposito's. dryfsaldo wat kragtens gemelde Wet tot sy beskik
king gehou word, enige bedrae uit bedoelde fonds verskuldig en betaalbaar, uitbetaal.".
20. Artikel 90 van die Hoofwet word hierby gewysig deur die Wysiging van artikel 90 van voorbehoudsbepaling deur die volgende voorbehoudsbepaling te Wet 66 van 1965. vervang:
"Met dien verstande dat, onderworpe aan die bepaHngs van so 'n testament of geskrif, die totaal van die betalings in die geval van 'n minderjarige of ander persoon vir die doeleindes van onderhoud, opvoeding of ander bevoordeling gedoen, nie sonder goedkeuring van die Hof meer bedra nie as [vierduisend rand] RIO 000 van die hoofsom ontvang vir rekening van die betrokke minderjarige of ander persoon.".
21. Artikel 91 van die Hoofwet word hierby deur die volgende Vervanging van artikel vervang: artikel91 van
Wet 66 van 1965.
,.Publikasie 91. Die Meester moet elke jaar in Septembervan Iys van maand in die Staatskoerant 'n Iys laat publiseer van onopgeeiste aile bedrae van [twintig rand] RIOO of meer in die gelde.

22. (1) Artikel 93 van die Hoofwet word hierby gewysig Wysiging van artikel 93 vandeur-Wet 66 van 1965,
(a) subartikel (1) deur die volgende subartikel te vervang: soos gewysig deur ,,(1) Iedere persoon wat in die Republiek besigheid artike14 van

(b) subartikel (2) deur die volgende subartikel te vervang: ,,(2) Iemand wat gemelde [state] staat vir publikasie

Short title.

(e) the substitution in subsection (3) for the words preceding paragraph (a) of the following words: "After the expiration of three months from the date of publication of the said [statements] statement, such person shall forthwith transmit a statement and affidavit in the prescribed form-" .
(2) Subsection (1) shall come into operation on a date fixed by 10 the State President by proclamation in the Gazette.
23. Section 102 of the principal Act is hereby amended by the substitution for paragraph (g) of subsection (1) of the following paragraph:
"(g) contravenes or fails to comply with the provisions of 15 section 9 (1) or (3), 13, 27 (1) [or (3)] or of the lastmentioned section as applied by section 70 (2), section 35 (13), 47, 57, 65 (1), 71, 78, 83, 93 (1) or (3), or with any notice under section 9 (2) or any order under section 58 (1), or hinders or obstructs any accountant 20 nominated by the Master in terms of section 65 (1) (a) in the execution of his duty; or".
24. This Act shall be called the Administration of Estates Amendment Act, 1983.
