Resource Recovery Exemption under Part 9, Clauses 91 and 92 of the Protection of the Environment Operations (Waste) Regulation 2014
The Carbon Mate bentonite compost exemption December 2019
Introduction This exemption:
is issued by the NSW Environment Protection Authority (EPA) under clauses 91 and 92 of the Protection of the Environment Operations (Waste) Regulation 2014 (Waste Regulation); and
exempts a consumer of Carbon Mate bentonite compost from certain requirements under the Protection of the Environment Operations Act 1997 (POEO Act) and the Waste Regulation in relation to the application of that waste to land, provided the consumer complies with the conditions of this exemption.
This exemption should be read in conjunction with ‘the Carbon Mate bentonite compost order December 2019’.
1. Waste to which this exemption applies 1.1. This exemption applies to Carbon Mate bentonite compost that is, or is intended
to be, applied to land as a soil amendment. 1.2. Carbon Mate bentonite compost is any combination of mulch, garden
organics, food waste, manure, paunch and ROBE spent sodium bentonite that has undergone composting at Carbon Mate Organics Recycling.
2. Persons to whom this exemption applies 2.1. This exemption applies to any person who applies, or intends to apply, Carbon
Mate bentonite compost to land as set out in 1.1.
3. Duration 3.1. This exemption commences on 19 December 2019 and is valid until 1
December 2021 or until revoked by the EPA by notice published in the Government Gazette at an earlier date.

4. Premises to which this exemption applies 4.1. This exemption applies to the premises at which the consumer’s actual, or
intended, application of Carbon Mate bentonite compost is carried out.
5. Exemption 5.1. Subject to the conditions of this exemption, the EPA exempts each consumer
from the following provisions of the POEO Act and the Waste Regulation in relation to the consumer’s actual or intended application of Carbon Mate bentonite compost to land as a soil amendment at the premises:
(a) section 48 of the POEO Act in respect of the scheduled activities described in clauses 39 and 42 of Schedule 1 of the POEO Act;
(b) Part 4 of the Waste Regulation; (c) section 88 of the POEO Act; and (d) clause 109 and 110 of the Waste Regulation.
5.2. The exemption does not apply in circumstances where Carbon Mate bentonite compost is received at the premises for which the consumer holds a licence under the POEO Act that authorises the carrying out of the scheduled activities on the premises under clause 39 ‘waste disposal (application to land)’ of Schedule 1 of the POEO Act.
6. Conditions of exemption The exemption is subject to the following conditions: 6.1. At the time Carbon Mate bentonite compost is received at the premises, the
material must meet all chemical and other material requirements for Carbon Mate bentonite compost which are required on or before the supply of Carbon Mate bentonite compost under ‘the Carbon Mate bentonite compost order December 2019’.
6.2. The Carbon Mate bentonite compost can only be applied to land as a soil amendment.
6.3. The consumer must ensure that they do not cause or permit the migration of leachate from the land application site.
6.4. The consumer must ensure that any application of Carbon Mate bentonite compost to land occurs within a reasonable period of time after its receipt.
7. Definitions In this exemption: animal waste means dead animals and animal parts and any mixture of dead animals and animal parts. application or apply to land means applying to land by:
(a) spraying, spreading or depositing on the land; (b) ploughing, injecting or mixing into the land; or (c) filling, raising, reclaiming or contouring the land.
composting means a process of managed biological transformation: (a) to achieve pasteurisation; and (b) for a period of not less than a total of 12 weeks of composting and curing at an
adequate moisture level (>40 % by weight), and/or until an equivalent level of biological stability can be demonstrated.

Composting does not include drying or dehydration processes. consumer means a person who applies, or intends to apply, Carbon Mate bentonite compost to land. corrosive means a substance having properties that may damage or destroy living organisms and components of the soil, including soil organic matter. Commonly this includes strong acids and strong bases, or weak acids and weak bases occurring in concentrated form. drying or dehydration processes are those that use externally supplied energy to heat and ventilate food wastes (or any other compostable waste) in order to rapidly dry the waste material over a short time period (typically 24 to 48 hours), either with or without the addition of an inoculum. This is distinct from those processes of managed biological transformation that use heat generated by the aerobic microorganisms that are responsible for decomposition under moist conditions during pasteurisation and composting, and traditional forced aeration composting methods such as aerated static pile composting. engineered wood products means engineered, painted, treated or composite wood products such as particleboard, oriented strand board, plywood, laminated veneer lumber, glulam or fibreboard that are manufactured with glues, resins, water repellents, fire retardants, fungal inhibitors and/or other chemicals. food waste means waste from the manufacture, preparation, sale or consumption of food but does not include grease trap waste or animal waste, and must not be corrosive. forestry and sawmill residues are untreated and uncontaminated plant materials from forestry operations such as logging, silviculture and sawmilling. Forestry and sawmill residues include materials such as bark, woodchip, sawdust and wood fibre that are collected as a source separated material stream for processing. garden organics means plant material that by virtue of the nature and source of the material poses a risk of the presence of physical and chemical contaminants. Garden organics includes material from kerbside waste collections. Garden organics must not contain asbestos, engineered wood products or preservative treated or coated wood residues. grease trap waste means any grease, oils, solids, water or other matter resulting only from the preparation or manufacturing of food that is collected in a grease trap in the usual course of the operation of the grease trap. This definition includes dissolved air flotation (DAF) units used to treat grease trap waste, but does not include grease trap waste collected from grease traps in hospitals and shopping centres other than those solely from the preparation of food. manure means faecal matter generated by any animal other than humans and includes any mixture of animal faecal matter and biodegradable animal bedding such as straw or sawdust. mulch means plant material shredded and/or screened to a preferred particle size grading for particular applications. Mulch, by virtue of the nature and source of the plant material, must pose minimal risk of the presence of physical and chemical contaminants. Mulch may include urban wood residues and forestry and sawmill residues. Mulch does not include plant material from kerbside waste collections. Mulch must not contain asbestos, engineered wood products, preservative treated or coated wood residues, or physical contaminants, including but not limited to glass, metal, rigid plastics, flexible plastics, or polystyrene. pasteurisation means a process to significantly reduce the numbers of plant and animal pathogens, and plant propagules. Pasteurisation requires that the entire mass of organic material be:

(a) Placed in a free-standing pile with all exposed surfaces covered by at least 300mm of biologically stabilised compost that is aerated by a fan/blower providing air through perforated pipes located underneath the pile to maintain an internal temperature greater than 55°C and an oxygen level greater than 5% for a period of at least 15 days.
(b) An alternative process of pasteurisation that guarantees the same level of pathogen reduction, and the reduction of plant propagules as in (a). Any such alternative process must be clearly defined in writing and validated by a suitably qualified person prior to claiming compliance with this order. A written record of the validation report must be kept for a minimum period of six years.
paunch means the undigested food contained in the stomach of ruminant animals. This is generally considered to include partially digested grass, hay and other feed products such as grain. processor means a person who processes, mixes, blends, or otherwise incorporates Carbon Mate bentonite compost into a material in its final form for supply to a consumer. The processor is Carbon Mate Organics Recycling 132 Ashfords Road Wagga Wagga NSW 2650, Environment Protection Licence 11998. preservative treated or coated wood residues means wood residues that are preservative treated with chemicals such as copper chrome arsenate (CCA), high temperature creosote (HTC), pigmented emulsified creosote (PEC) and light organic solvent preservative (LOSP) and/or coated with substances such as varnish or paint. ROBE spent sodium bentonite means approximate 2,000 tonnes of spent sodium bentonite no longer suitable for stockfeed use stockpiled at Riverina Oils and BioEnergy Pty Ltd 177 Trahairs Rd BOMEN NSW 2650, Environment Protection Licence 13097. urban wood residues mean untreated, unpainted, and uncontaminated urban derived timber and wood material that is collected as a separate material stream for processing. Notes The EPA may amend or revoke this exemption at any time. It is the responsibility of the consumer to ensure they comply with all relevant requirements of the most current exemption. The current version of this exemption will be available on www.epa.nsw.gov.au In gazetting or otherwise issuing this exemption, the EPA is not in any way endorsing the use of this substance or guaranteeing that the substance will confer benefit. The conditions set out in this exemption are designed to minimise the risk of potential harm to the environment, human health or agriculture, although neither this exemption nor the accompanying order guarantee that the environment, human health or agriculture will not be harmed. The consumer should assess whether or not Carbon Mate bentonite compost is fit for the purpose the material is proposed to be used for, and whether this use will cause harm. The consumer may need to seek expert scientific or technical advice. Regardless of any exemption provided by the EPA, the person who causes or permits the application of the substance to land must ensure that the action is lawful and consistent with any other legislative requirements including, if applicable, any development consent(s) for managing operations on the site(s). The consumer should ensure that Carbon Mate bentonite compost containing restricted animal material (RAM) is stored in a location that is inaccessible to ruminants and applied to land in a way that ruminants will not ingest it when accessed. The receipt of Carbon Mate bentonite compost remains subject to other relevant environmental regulations in the POEO Act and the Waste Regulation. For example, a person who pollutes land (s. 142A) or water (s. 120), or causes air pollution through the emission of odours (s. 126), or does not meet the special requirements for asbestos waste (Part 7 of the Waste Regulation), regardless of having an exemption, is guilty of an offence and subject to prosecution. This exemption does not alter the requirements of any other relevant legislation that must be met in utilising this material, including for example, the need to prepare a Safety Data Sheet (SDS). Whilst ‘the Carbon Mate bentonite compost order December 2019’ requires that Carbon Mate bentonite compost must not contain engineered wood products, the EPA recognises that compost may contain extremely low and incidental amounts of engineered wood products. The processor must implement procedures to prevent the presence of engineered wood products in spent sodium bentonite compost. These procedures must be formally documented and their implementation demonstrated. Spent sodium bentonite compost, however, must not contain any asbestos, or preservative treated or coated wood residues. ‘The Carbon Mate bentonite compost order December 2019’ does not require sampling and testing of Carbon Mate bentonite compost for biological stability and maturity. However the EPA strongly encourages the land application of compost that contains stable organic matter content and an absence of phytotoxic compounds and pathogens. Immature and poorly stabilised compost can potentially generate offensive odours, contain viable plant propagules and cause initial adverse impacts on plant growth following land application. Carbon Mate bentonite compost that meets the conditions of this exemption should be applied to land by the consumer within 2 weeks of being received. Where there are extenuating circumstances Carbon Mate bentonite compost should be land applied within 4 weeks. The EPA considers that 6 weeks would be the absolute limit in all circumstances.

Failure to comply with the conditions of this exemption constitutes an offence under clause 91 of the Waste Regulation.

ORDER UNDER SECTION 12 CY PRÈS SCHEME RELATING TO
THE ESTATE OF THE LATE JUDITH CHRISTINE WALSH Section 9(1) of the Charitable Trusts Act 1993 permits the application of property cy-près where the spirit of the original trust can no longer be implemented. The Will of the late Judith Christine Walsh provides that 25% of her estate, after payment of all debts, funeral and testamentary expenses (approximately $100,000), be paid to the “Dr John Holt Cancer Research Unit 0892854000”. Dr John Holt was a doctor who conducted cancer research by radio and microwave therapy. This gift was considered by the Honourable Justice Slattery in re Morrison-Conway [2018] NSWSC 685. His Honour was of the view that the gift is charitable, displays a general charitable intention, and has failed as no such institution exists. His Honour then referred the establishment of the scheme to the Attorney General. The Attorney General proposes the establishment of a cy-près scheme in relation to the Estate of the late Judith Christine Walsh pursuant to section 12 of the Charitable Trusts Act 1993. The scheme provides that the bequest be applied cy-près to the Cancer Centre for Children at the Children’s Hospital, Westmead. Given the original purpose of the gift was for cancer research, and noting that it is evident from the Will that the testatrix was supportive of research at the Children’s Hospital at Westmead and the medical care of children, the Cancer Centre for children at the Children’s Hospital at Westmead appears to be an appropriate recipient of the gift. The executors of the estate have no objection to a scheme applying the funds to the Cancer Centre for Children at the Children’s Hospital, Westmead for its charitable purposes. This is an appropriate matter in which the Attorney General should approve a scheme under s 12(1)(a) of the Charitable Trusts Act 1993. The Solicitor General, under delegation from the Attorney General, has previously approved a recommendation that the Attorney General establish a cy près scheme which would permit these charitable funds to be applied in a manner as close as possible to the original purposes of the trust. Pursuant to section 12 of the Charitable Trusts Act 1993, I hereby order that the funds held by the Estate of the late Ms Judith Christine Walsh may be applied cy-près to the Cancer Centre for Children at the Children’s Hospital at Westmead for its charitable purposes. TRUST ACCOUNT COST CENTRE 430041 Section 9(1) of the Charitable Trusts Act 1993 permits the application of property cy pres where the spirit of the original trust can no longer be implemented. The Western Sydney Local Health District (‘WSLHD’) is trustee of the Special Purpose & Trust Account 430041, or “MTDR Copperfield Cottage” (‘the Trust’). The Trust was established for the purpose of providing funding in support of an aged day care service for the local community of Mount Druitt. The Trust provided funds specifically for the activities of Copperfield Aged Day Service (‘the Copperfield Service’) at Mount Druitt Hospital. The Copperfield Service included individual health assessments, health and wellbeing group programs, health information sessions, music appreciation, and access to nursing and allied health services.

The Copperfield Service ceased operating in December 2017 and, as a result, the purposes of the Trust cannot be met. The Trust is considered to be a charitable trust, with the objects of the Trust being the “relief of aged, impotent and poor people.” The value of the Trust is approximately $23,437.30, being funds primarily from various donations and fundraising activities of patients, carers and other members of the local community of Mount Druitt. The Crestwood Aged Day Service facility (‘the Crestwood Centre’) has been identified as having a similar purpose to the original purposes of the Trust. The Crestwood Centre is at Blacktown Hospital, the closest hospital to Mount Druitt Hospital, and is within the same local government area. The Crestwood Centre provides equipment and the same social support services and group activities as the Copperfield Service. Clients of the Crestwood Centre include registered clients that were transferred from the Copperfield Service. The Crestwood Centre aligns with the original purpose of the Trust, being the provision of social support services to persons aged over 65 years and persons who identified as Aboriginal or Torres Strait Islander aged over 50 years with a chronic, complex and/or age related illnesses or frailty residing in the Blacktown Local Government area. The trustee has proposed to direct the Trust funds toward the Crestwood Centre. This is an appropriate matter in which the Attorney General should approve a cy pres scheme under section 12(1)(a) of the Charitable Trusts Act 1993. I have previously approved a recommendation that the Attorney General establish a cy pres scheme which would permit these charitable funds to be applied in a manner as close as possible to the original purposes of the Trust. Pursuant to section 12 of the Charitable Trusts Act 1993, I hereby order that the funds on Trust are to be applied to the Crestwood Centre at Blacktown Hospital. The Western Sydney Local Health District (‘WSLHD’) is trustee of the Special Purpose & Trust Account 420140 (‘the Trust’). The Trust was established by way of a joint venture between WSLHD and the former University of Western Sydney, now the Western Sydney University (‘the University’), for the purpose of establishing a trust to support the joint running of management courses for clinicians, with those courses being provided by the Western Sydney Area Health Service (‘WSAHS’) and the University. The management courses for clinicians which were provided by WSAHS and the University are no longer offered and, as a result, the purpose of the Trust cannot be met. The Trust is considered to be a charitable trust, with the object of the Trust being the advancement of education. The value of the Trust is approximately $55,390.88, comprising funds contributed by WSAHS and the University, and money accumulated from course fees and interest. It is proposed that the Trust funds be applied cy pres to establish a Nursing and Midwifery Leadership Development Scholarship (‘the Scholarship’). The Scholarship will fund entry into post-graduate courses in clinical leadership and/or management in the areas of health sciences, nursing or education at the University. Registered nurses and midwives who are current employees of the WSLHD and who have at least five years of experience in nursing and/ or midwifery will be eligible to apply for the Scholarship. The recipients of the Scholarship will be determined by the Executive Director of Nursing and Midwifery and Clinical Governance, or such other person(s) nominated by the trustee. The number and amount of Scholarships to be offered will be determined by the trustee. The Scholarship will be offered until the trust funds are expended.

COMBAT SPORTS ACT 2013 Rule: Resuscitation equipment requirements at combat sport contests (Rule made pursuant to section 107 of the Combat Sports Act 2013)
(a) The promoter of a combat sport contest must ensure that a resuscitation kit is at each combat sport contest that contains, as a minimum, the following equipment. i. Guedel (or similar) airway support devices in sizes 3 (80mm), 4 (90mm) and 5 (100mm) of which
there must be at least two (2) of each size; and ii. Nasopharyngeal airways in sizes 7.5mm and 8.5mm of which there must be at least two (2) of each
size; and iii. An oxygen demand valve resuscitator with tubing and at least two (2) re-usable adult size silicone
masks; and iv. At least two (2) adult size non-rebreathing (oxygen therapy) masks with tubing; and v. A Resuscitation Bag/Valve/Mask set which includes size 4 and size 5 masks of which there must be
at least two (2) of each size; and vi. A spacer device for Beta-2 agonists; and vii. An oxygen regulator/flowmeter capable of 0-25 litres per minute (LPM) flowrate, with two standard
diameter high pressure, standard indexed sleeve (SIS) inlet/outlet connections; and viii. An oxygen powered variable vacuum suction unit with suction instrument, hose and tubing; and ix. Two (2) full ‘C-size’ (410 litre) medical oxygen cylinders; and x. A cylinder key wheel to turn on the oxygen cylinder (unless the key wheel is integrated into the
cylinder); and xi. A portable carry case or durable bag sufficient to store and protect the items listed above.
(b) The promoter of a combat sport contest must ensure that the equipment listed in section (a) above:

i. is in a readily accessible location within the contest area near the attending medical practitioner; and ii. has been serviced and maintained in accordance with the manufacturer’s instructions; and iii. is compliant with Australian Standards in place at the time of the combat sport contest.
(c) The promoter of a combat sport contest must ensure that, as a minimum, one (1) person at each combat sport contest is appropriately trained or qualified to use the equipment listed in section (a) above and has ready access to the equipment during the combat sport contest.
(d) The promoter of a combat sport contest must ensure that the equipment listed in section (a) above is checked and tested at the contest location prior to the pre-contest briefing required under cl. 23(k1) of the Combat Sports Regulation 2014, and confirmed by the promoter at that briefing to be compliant with this rule.
(e) The promoter of a combat sport contest must ensure that a combat sport contest does not commence unless this rule is satisfied.
This rule takes effect on Wednesday 11 March 2020 (n2020-37)

SUBORDINATE LEGISLATION ACT 1989 Proposed Community Gaming Regulation 2020
Notice is given in accordance with section 5 of the Subordinate Legislation Act 1989 of the intention to make the proposed Community Gaming Regulation 2020, under the Community Gaming Act 2018. The objects of the proposed Regulation are to:
• prescribe permitted gaming activities and impose certain requirements; • specify which gaming activities require an authority, how to apply for an authority, fees, and other
related matters; • prescribe general requirements such as fairness, rules, prizes, etc; • provide restrictions on advertising; • require audits of gaming activities when annual gross proceeds exceed $250,000; and • allow penalty notices to be issued for certain offences.
It is intended that the Community Gaming Act and Regulation will replace the Lotteries and Art Unions Act 1901 and Regulation. The Community Gaming Act and Regulation will commence in mid-2020. A Regulatory Impact Statement (RIS) has been prepared in relation to the proposed Regulation. The RIS and the proposed Regulation are available online at the 'Have Your Say' portal of the NSW Fair Trading website: www.fairtrading.nsw.gov.au. Details on how to make a submission are in the RIS and on the website. All submissions are generally made publicly available on the Fair Trading website. If you do not want any part of your submission published, please indicate this clearly in your submission.
