Deputy Chief Veterinary Offi cers

I, RICHARD FREDERICK SHELDRAKE, Director-General of the Department of Industry and Investment, for the purposes of the Animal Diseases (Emergency Outbreaks) Act 1991 (“the Act”), hereby:

1. pursuant to section 66 (1) of the Act revoke the following appointments:(a) revoke the appointment of Bruce Morgan CHRISTIE

as Chief Veterinary Offi cer dated 27 October 2005 and published in NSW Government Gazette No. 137 on 4 November 2005 at page 9335; and

(b) revoke the appointments of Graeme Walter EGGLESTON, Ian James ROTH and Stephen Elliot DUNN as Deputy Chief Veterinary Offi cers dated 3 August 2006 and published in NSW Government Gazette No. 103 on 18 August 2006 at page 6362; and

(c) revoke the appointment of Peter John McGREGOR as a Deputy Chief Veterinary Officer dated 25 September 2007 and published in NSW Government Gazette No. 131 on 26 September 2007 at page 7322, and

any appointment revived as a result of these revocations;

2. pursuant to section 66 (1) of the Act appoint Ian James ROTH as Chief Veterinary Offi cer;

3. pursuant to section 66 (1) of the Act:(a) appoint Therese Margaret WRIGHT as a Deputy

Chief Veterinary Offi cer;(b) appoint Marilyn EVERS as a Deputy Chief Veterinary

Offi cer; and (c) appoint the person who from time to time occupies

the position of Manager, Animal Health Programs and Field Veterinary Services within the Department of Industry and Investment, as a Deputy Chief Veterinary Offi cer;

4. pursuant to section 66 (2) of the Act the persons appointed as Deputy Chief Veterinary Offi cers pursuant to paragraph 3 of this instrument of appointment may exercise the powers and perform the functions of the Chief Veterinary Offi cer on all terms and in all circumstances.

CHARITABLE TRUSTS ACT 1993Notice under section 15 proposed Cy-Pres Scheme

relating to the estate of the late Thomas Moore

SECTION 9(1) of the Charitable Trusts Act 1993 permits the application of property cy-pres where the spirit of the original trust can no longer be implemented.

Thomas Moore wrote a will in February 1839. The application at issue concerns only the outstanding residue of the estate. The will divided the residuary of the estate into four parts, all for purposes relating to the Uniting Church of England and Ireland, the successor of which is now the Anglican Church of Australia.

The Trustees submit that over time, the real value of the corpus of the estate has diminished in size and no longer provides suffi cient income to meet the charitable purposes set out in the will. The fi nancial records provided by the Trustees support this conclusion.

The Trustees have applied to the Attorney General for a cy près scheme for the future distribution of the trust funds, subject to two additional variations proposed by the Trustees. One variation concerns the part of the will providing an annual sum for the maintenance of widows of clergymen, seeking to remove the requirement that the widows must live ‘chastely and unmarried’. The other amendment would remove certain monetary limits on support for widows and necessitous persons which, due to infl ation, allow only very modest amounts to be paid to each individual recipient.

The major societal changes in NSW since 1839, and the effects of infl ation, support the view that these original conditions have ceased to provide a suitable and effective method of using the trust property.

The Solicitor General, as delegate of the Attorney General in Charitable Trusts Act 1993 matters, has determined that this is an appropriate matter in which the Attorney General should approve a cy-pres scheme under section 12(1)(a) of the Charitable Trusts Act 1993. The approved scheme would enable the corpus comprising the trust to be distributed in substantially the same manner as is currently provided for the distribution of income from its investment, subject to the two variations sought by the Trustees.

PRACTICE NOTE DC (CIVIL) NO. 8

Early Return of Subpoenas

THIS Practice Note supersedes and replaces the previous Practices Notes referable to early return of subpoenas.

1. INTRODUCTION1.1 The issuing of subpoenas and the inspection of

documents is vital to the proper preparation of cases. The Court provides a system for the early production of documents so that parties can meet the standards imposed by Practice Notes.

1.2 The power to deal with subpoenas is delegated to the registrar by a direction under section 13 of the Civil Procedure Act 2005.

2. SYSTEM FOR EARLY RETURN OF SUBPOENAS2.1 The Court aims to allocate a return date within 6

weeks of the issue of a subpoena for production.

2.2 The Court has adopted the following system for the early return of subpoenas and access to documents to give effect to the powers in rule 33.9 of the Uniform Civil Procedure Rules 2005: (a) The issuing party will obtain a return date from

the registry and endorse it on the subpoena. In Sydney, the return date will be on a Monday at 11am before the registrar.

(b) The issuing party must complete and attach the approved form of subpoena notice and declaration (Form 28) to the front of the subpoena. The issuing party is also required to indicate a proposed access order in the subpoena notice and the addressee (subpoena recipient) is required to complete the attached declaration as to whether the documents produced are copies of documents, original documents or a mix of copies of documents and original documents. If the material produced is declared to be copies of documents the Registrar may, without further notice to you, destroy the copies after the expiry of a period of 4 months from the conclusion of the proceeding or, if the documents become exhibits in the proceeding, when they are no longer required in connection with the proceeding, including on any appeal. If the material produced is declared to be original documents or a mix of original and copies

of documents the Court will return all of the material to you at the address specifi ed in the declaration. If the issuing party does not propose an access order the following access order will apply:“The issuing party to have fi rst access for 7 days; thereafter, in the absence of further application, access to all parties.”Where a different proposed access order is sought the issuing party must state his or her reasons in the notice. If there is a dispute over the proposed access, the parties must appear on the return date.

(c) The issuing party must serve a copy of the subpoena and notice on all other parties who have an address for service within 7 days of issue. If the return date is less than 2 weeks away, the copy and notice must be served within 24 hours.

(d) The issuing party must appear on the return date if it has not notifi ed all parties of the issue of the subpoena. All other parties must attend on the return date unless the issuing party has obtained consent to mention the matter for all parties. The Court may make costs orders against parties who have not complied with the rules and this practice note.

(e) Any party, or the producer, may object to the issuing party about the proposed access order. The issuing party must notify all other parties of the objection. Parties who wish to contest the proposed access order must appear on the return date and argue the question before the registrar.

(f) If there is no appearance on the return date, the Court will generally make the proposed access order. There is no need for the parties to appear on the return date if all parties consent to the order sought.

(g) If the subpoena has not been served, the issuing party should appear on the return date and ask the registrar for a new return date.

(h) If documents have not been produced, any party may obtain a further return date from the registry. That party must inform all other parties of the new return date.

3. ACCESS TO DOCUMENTS3.1 When the proposed access order takes effect, parties

may inspect documents in the registry in accordance with that order. The other parties may inspect the documents produced as soon as the fi rst access order has expired.

3.2 Practitioners should be aware that, if the party with fi rst access does not inspect documents in accordance with the proposed access order, other parties may inspect privileged documents and the privilege may be lost.

3.3 The Court has broad discretionary powers under rule 33.8 of the Uniform Civil Procedure Rules 2005 with respect to access to and copying of documents.

SUBORDINATE LEGISLATION ACT 1989

Children’s Services Amendment Regulation 2010

IN accordance with section 5 of the Subordinate Legislation Act 1989, notice is given of the intention to amend the existing Children’s Services Regulation 2004, as set out in the Children’s Services Amendment Regulation 2010.

The Children’s Services Regulation 2004 sets out requirements for the operation of children’s services, including areas such as the staff who work in services and their level of qualifi cation, the size of a service and the ratio of staff to children, physical requirements of building spaces and equipment, health and safety and administrative requirements.

A Regulatory Impact Statement (RIS) has been prepared in accordance with the Subordinate Legislation Act 1989. The RIS considers the costs and benefi ts of the proposals and options under consideration for the implementation of the above proposals.

The proposed Amendment Regulation and RIS are available on the Community Services NSW website at www.community.nsw.gov.au/review

Explanatory NoteProvision of ambulance services in New South Wales is restricted to the Ambulance Service of NSW and the entities

listed under section 67E (3) of the Health Services Act 1997. This Order prescribes the rates applicable for Ambulance services to an injured worker for which an employer is liable being the fees prescribed under section 67D of the Health Services Act 1997, applicable from 1 July 2010.

1. Name of OrderThis Order is the Workers Compensation (Ambulance Services Fees) Order 2010.

2. CommencementThis Order commences on the date on which it is published in the New South Wales Government Gazette.

3. Application of OrderThis Order applies to ambulance services provided on or after the date of commencement, whether it relates to an injury received before, on or after that date.

4. Fees for ambulance servicesThe fee amounts for which an employer is liable under the Act for provision of ambulance or paramedic services to an injured worker are listed in Schedule A for primary and interhospital services, being the fees prescribed under section 67D of the Health Services Act 1997.

5. Scope of Order (Additional Information)(a) The fees in Schedule A do not apply to treatment at the scene of the accident, or transport for hospital admission

for workers injured in motor vehicle accidents.Note: These are to be paid by the Motor Accidents Authority (MAA) Bulk Bill arrangement.

(b) The fees in Schedule A are payable only to:• The Ambulance Service of New South Wales;• St John Ambulance Australia (NSW);• The Royal Flying Doctor Service of Australia (NSW Section);• The mines rescue company within the meaning of the Coal Industry Act 2001 in the exercise of mines rescue

functions;• A member of the New South Wales Mines Rescue Brigade established under the Coal Industry Act 2001;• Any person (or class of persons) prescribed by regulations made under the Health Services Act 1997.

6. Goods and Services TaxNo GST is payable on the fees in Schedule A.

7. Defi nitionsIn this order:GST has the same meaning as in the New Tax System (Goods and Services Tax) Act 1999 of the Commonwealth.

Ambulance services means the conveyance of an injured worker to or from a medical practitioner or hospital.

Ambulance Service provider is the Ambulance Service of NSW or the entities listed in clause 5 above.

New Tax System Price Exploitation Law meansa. the New Tax System Price Exploitation Code as applied as a law of New South Wales by the Price Exploitation

Code (New South Wales) Act 1999, andb. Part VB of the Trade Practices Act 1974 of the Commonwealth

The Act means the Workers Compensation Act 1987.
