GuardianshipsTEMPORARY (EMERGENCY)

GUARDIANSHIPPursuant to NRS 159.0523 and/or 159.0525, a petitionermay request that the Court appoint the Washoe CountyPublic Guardian's Office as Temporary Guardian for theproposed ward or a referral for temporary guardianshipmay be made directly to the Washoe County PublicGuardian. The procedures for referral and assessments inpermanent guardianships apply to temporary guardian-ships on an expedited basis. In addition to the findingand conclusions normally required for a permanentguardianship, the Public Guardian or the Public Guardian'sdesignee must also determine:

Whether the proposed ward faces a substantial andimmediate risk of physical harm, needs immediate medicalattention, and/or faces a substantial and immediate risk offinancial loss ;

Whether the proposed ward lacks capacity to respond tothe risk of loss or harm or to obtain the necessary medicalattention, and;

Whether reasonable efforts have been made to secure acertificate signed by a physician licensed to practice inNevada which states the proposed ward is unable torespond to a substantial and immediate risk of physicalharm, to a need of immediate medical attention, and/orrisk of financial harm.

If the Public Guardian's designee is unable to secure amedical certificate, the Public Guardian's designee willexecute an affidavit stating why the medical affidavit is notimmediately available.

GENERAL (PLENARY) GUARDIANSHIP

Pursuant to NRS 159.054, a Court may appoint theWashoe County Public Guardian's Office as GeneralGuardian upon a determination that the Proposed Wardrequired the appointment of a General Guardian. Uponappointment as General Guardian, the Public Guardian orthe Public Guardian's designee should determine the factsand circumstances warranting the appointment of aGeneral Guardian and ensure the least restrictive alterna-tives are considered when performing assessments,preparing care plans, and reports on the condition of theward.

SPECIAL (LIMITED) GUARDIANSHIP

Pursuant to NRS 159.054, a Court may appoint theWashoe County Public Guardian's Office as SpecialGuardian upon a determination that the Proposed Wardpossesses limited capacity. Upon appointment as SpecialGuardian, the Public Guardian or the Public Guardian'sdesignee should determine the special circumstances war-ranting the appointment of a Special Guardian and ensurethe special circumstances are considered when performingassessments, preparing care plans, and reports on the con-dition of the ward, ensuring the supervision exercised isleast restrictive of the ward's personal freedom consistentwith the need for supervision and protection.

NOTE: It is the policy of the Public Guardian's office toexert only as much control over a case as is necessarygiven the circumstances, regardless of the type of legalrelationship.

TERMINATION OF GUARDIANSHIP

It is the philosophy of the Public Guardian's office to regu-larly monitor and evaluate the continuing necessity andappropriateness of the guardianship. If a guardian is nolonger appropriate, the guardian will assist in gathering theevidence necessary to petition the Court for discharge.

Medicare is our country’s health insurance program forpeople age 65 or older. Certain people younger than age 65can qualify for Medicare, too, including those who have

disabilities,permanentkidney failureor amyotroph-ic lateral scle-rosis (LouGehrig’s dis-ease). Theprogram helpswith the costof health care,but it does notcover all med-ical expensesor the cost ofmost long-term care.

Medicare isfinanced by aportion of thepayroll taxespaid by work-

ers and their employers. It also is financed in part bymonthly premiums deducted from Social Security checks.

The Centers for Medicare & Medicaid Services (CMS) isthe agency in charge of the Medicare program. But youapply for Medicare at Social Security, and obtain generalinformation about the Medicare program.

Medicare has four parts:• Medicare Part A (Hospital Insurance) - Helps coverinpatient care in hospitals, and services in skilled nursingfacilities (following a hospital stay), hospice, and homehealth care.

• Medicare Part B (Medical Insurance)- Helps cover doc-tors' services, hospital outpatient care, and home healthcare. Helps cover some preventive services to maintainhealth and to keep certain illnesses from getting worse.

• Medicare Advantage Plans (Part C) are health plansrun by Medicare!approved private insurance companies.Medicare Advantage Plans include Part A, Part B, andusually other coverage like Medicare prescription drugcoverage (Part D), sometimes for an extra cost.

Medicare Part B ( Medical Insurance)

Preventive servicesBeginning in 2011, your co-payment for most pre-ventive services (Pap tests, flu shots, and screeningmammograms) is covered. That includes tests likecolonoscopies, bone density tests, prostate cancerscreenings, and diabetes tests. It also includes anannual “wellness exam.” You will, however, have topay your share of any doctor or hospital services forall tests except the wellness exam.

Medicare Advantage Plans ( Part C)

If you have Medicare Parts A and B, you can join aMedicare Advantage plan. Medicare Advantageplans are offered by private companies andapproved by Medicare. With one of these plans, youdo not need a Medigap policy, because MedicareAdvantage plans generally cover many of the samebenefits that a Medigap policy would cover, such asextra days in the hospital after you have used thenumber of days that Medicare covers.

If you decide to join a Medicare Advantage plan,you use the health card that you get from yourMedicare Advantage plan provider for your healthcare. Also, you might have to pay a monthly premi-um for your Medicare Advantage plan because ofthe extra benefits it offers.

People who become newly entitled to Medicareshould enroll during their initial enrollment period(as explained under Signing up for Medicare) orduring the annual coordinated election period fromOctober 15 – December 7 each year. The effectivedate for the enrollment is January 1 of the upcom-ing year. There also will be special enrollment peri-ods for some situations.

Medicare Prescription Drug Coverage ( Part D)

Anyone who has Medicare hospital insurance (PartA), medical insurance (Part B) or a MedicareAdvantage plan (Part C) is eligible for prescriptiondrug coverage (Part D). Extra Help for some low-income peopleIf you cannot afford to pay your Medicare premiums andother medical costs, you may be able to get help from yourstate. States offer programs for people who are entitled toMedicare and have low income. The programs may paysome or all Medicare premiums and also may pay Medicaredeductibles and coinsurance. Individuals eligible for Medicare may qualify forbenefits from the Medicare Beneficiaries program.Coverage provided by this program is different thanother Medicaid groups as it does not provide thefull scope of medical benefits. The five categoriesdescribed below may be eligible for MedicareBeneficiaries coverage:

• Qualified Medicare Beneficiaries (QMBs): areMedicare recipients with income at or below 100%of the federal poverty level. Medicaid pays for theirMedicare premiums, co-insurance and deductibleson Medicare covered services. Eligibility begins themonth following the month the decision is made.

• Special Low Income Medicare Beneficiaries(SLMBs): are Medicare recipients with incomebetween 100% - 120% of the federal poverty level.Medicaid pays the Medicare Part B medical insur-ance premium. Eligibility begins with the applica-tion month with three (3) months of prior medicalcoverage available.

• Qualifying Individuals 1 (QI-1s): are Medicarerecipients with income of at least 120%, but lessthan 135% of the federal poverty level. Medicaidpays the Medicare Part B medical insurance premi-um. Eligibility begins with the application monthwith three (3) months of prior medical coverageavailable. However, this program is 100% federallyfunded and ends if the state allocation is used.

• Qualifying Individuals 2 (QI-2s): are Medicare recipi-ents with income of at least 135%, but less than 175% of thefederal poverty level. Medicaid pays for the portion of theMedicare Part B premium attributable to the shift of somehome health benefits from Medicare Part A to Part B.Payments are made in December for the calendar year.Eligibility begins with the application month with threemonths of prior medical coverage available. However, thisprogram is 100% federally funded and ends if the state allo-cation is used.

• Qualified Disabled Working Individuals (QDWIs): areMedicare recipients with income less than 200% of the fed-eral poverty level. Adult Day Care provides respite care or short-termbreaks for informal caregivers, and allows adults inneed of daily care an opportunity to spend time ina less restrictive environment other than skilledcare. Adult Day Care is defined by NevadaRevised Statute “NRS 449.004,” as a “Facility for thecare of adults during the day,” meaning an estab-lishment operated and maintained to provide care,on a temporary or permanent basis, for aged orinfirm persons. Adult Day Care can be offered ina social and health care setting. The social modeloffers nonmedical services that include supervisionor assistance with activities of daily living (ADL’s),social activities, a meal or snacks, and socializationwith peers. Adult Day Health Care provided in ahealth care facility can be based on a medicalmodel offering rehabilitative and social services toadults with physical or mental impairments. Thecenters are ideal for physically, mentally or func-tionally impaired people who wish to maintain orimprove their level of functioning to avoid skillednursing home care.

Adult Day Care provides assistance either half-dayor full-day, five or six days a week. Transportationto and from the center is often made available bythe local paratransit. Adult Group Care/ResidentialGroup Care/Assisted Living

Adult Group Care, Residential Facilities for Groups (RFG)or Assisted Living (AL) is a residential alternative thatpromotes maximum independence through a combinationof supportive services and assistance. Services and costsvary depending on the facility, which may also vary insize, style, and optional services. Small family style liv-

ing or larger complex units may be co-located or affiliatedwith a hospital or nursing facility. An RFG/AL facility isrequired to provide assistance with daily living activities(ADLs), which include eating, bathing, dressing, and per-sonal hygiene; three meals a day; supervision of self-administration of medications; laundry service includingpersonalized laundry; housekeeping and 24 hour staffing.

Group Care facilities represent the largest number of healthcare facilities licensed by the Nevada Bureau of Health CareQuality and Compliance. In 2006, the bureau licensed 311RFG’s statewide ranging in size from three to 150 beds,some licensed for additional endorsements. The bureaualso regulates smaller Homes for Individual Care (HIC)serving two people or less.

Adult day services are perfect for familieswho are caring for an aging loved one intheir home, who need time to work, per-

form errands, or respite from caregiving responsi-bilities. Adult day care can provide their lovedone with a safe environment outside the homethat includes socialization, support, and/or super-vision during the day. Most adult day care centersoperate Monday through Friday, to accommodatethe working family. Some offer additional hourson the weekend.

Healthcare Centers offer different care to meetyour loved ones needs. Adult day care is providedin a group care setting that is based on a socialmodel featuring socialization, activities, and sup-port. Social activities seek to enrich the partici-pant’s life through a variety of activities such as

arts and crafts, exercise, musical entertainment,games and movies. Daily activities include anutritious lunch and snacks, and assistance withactivities of daily living.

Adult day healthcare is a medical model and isoffered in a group care setting that is safe, sup-portive, structured and therapeutic, providing awide spectrum of services under the supervisionof a qualified registered nurse. It is designed foradults who are frail and/or physically, cognitivelyor emotionally impaired with conditions such asstroke, Alzheimer’s, Parkinson’s and dementias.The program can provide the level of care thatfamilies seek as an alternative to institutional care.The site is secured with the capability to handlepeople with behavior problems or wandering ten-dencies. The program provides assistance withpersonal care and other activities of daily living.
