When switching on electric motors streams arise, which can be up to six times higher than the rated current. Thus it comes to releasing safety devices. Remedy creates the electronic starting current limiter ESB, which puts only a small tension to the attached consumer during the moment of start-up at the disposal. The volt-age increases thereafter gently and steplessly to 230 V. By the gentle approach without jerking of the limiter bearings and transmissions of the attached fans are preserved - life span of your machine is extended thereby. Since the product is all-electronic equipment without relays or switches, it is maintenance-free and has a long life span. The starting current limiter is attached simply to the house plug socket or the generator set and the power supply plug of the operated machine is put into the plug socket of the starting current limiter. Because of its durable, splash-proof plastic housing and plug sockets it is suitable for heavy duty for machines to approx.. 2700 W - also for our fans with condenser engines.

Speed Controller

With the controller GEFITRON each desired number of revolutions can be stopped by alternating-current motors. The adjusted number of revolutions remains almost constant, - also under large load. The GEFITRON has a switch for the change-over of the rule strength of strong on weak. In the position the GEFITRON becomes "weak" the achievement plate, i.e. the output voltage can be varied. Thus also the number of revolutions is changed by machines, which does not remain constant however under load. In the switching position "weakly" the GEFITRON is suitable for the achievement weakening or for the number of revolutions price increase of engines, which are not exposed to a variation in load. High performance machines, with which in the start-up torque often release the household safety device, can become "raised" by means of the rotary button from the stop to the maximum number of revolutions (achievement) by hand.

Operation of fans with power generator

When switching on electric motors streams arise, which can be up to six times higher than the rated current. Next to this basic electric problem fans have a relatively high square start-up moment. This causes a very high tension to the drives until the nominal speed is reached. This effect is not of importance running a fan plugged at the electric supply system—provided that fuses are dimensioned correctly acc. to electric standards. But running the fan directly with a power generator following points have to be considered: 1. The generator must be supplied with heavy-duty start-up. 2. Electronically controlled generators try to even Voltage- and Current peaks. Therefore

the high start-up current must be programmed in the control systems. 3. We recommend Eisemann® and Geko®-generators of Metallwarenfabrik

Gemmingen. These generators are developed and tested with our fans.

The difference between Axial and Radial fans

These two, our preferred designs, offer everyone their special advantages which should be used dependent on the targeted application. An axial flow fan (VL and VM series) transports air along ist drive axle and offers 1. compact design 2. high volume flow 3. Simple construction, which is cheap especially with low pressure differences. Opposite of these points you find: 1. high sound pressure level 2. Small stable area on performance curve which can be used . This means with the use of long hose distances a high risk: Several elbows in the line lead the operating point to the tearing off area. In this unstable condition the fan―pumps― and produces only a fraction of ist maximum power. This fact leads to the strength of the radial fans (MWM series), which suck the air in in axial direction and blow out radially: 1. big stable area on performance curve 2. High pressure possible—this allows long hose distances 3. Resistant against dust in the medium The disadvantages: 1. More complex design 2. Bigger casing and detour in flow. Please take care of these points when you select your fan model!

Conditions of Supply and Payment

I. Scope of conditions

1. These terms and conditions of business have precedence over any deviating terms and

conditions of the purchaser, unless we have recognised the latter in writing.

II. Type and scope of performance

1. Our written order acknowledgement or, if such is not in existence, our tender is

definitive for the content of the contract, i.e. parts, accessories, services or ancillary

works that are not listed in the tender or order acknowledgement are not included in the

scope of our supply. Oral understandings are only valid when we have confirmed them

in writing.

2. All agreements that our representatives reach for us must be confirmed by us to the

purchaser in writing in order for them to be effective.

3. Documents pertaining to the tender – such as drawings, illustrations, and details of

weights and dimensions etc. – are only relevant approximately unless they have been

expressly designated as legally binding.

4. All copyrights and rights of ownership in the tender and all documentation remain

reserved. Neither the tender nor the documents may be passed on, published or

duplicated without our approval, nor may they be used for any purpose other than the

purpose that has been agreed.

5. The tender is submitted on the assumption that the media used in operating the plant

(water, air and so on) have no hostile qualities.

6. No ancillary works (such as masonry, chisel work, plasterwork, carpentry, excavation,

electrical, or decorating work) are included in the tender. If such works are carried out

by us they must be remunerated separately.

7. Assembly work that has to be carried out and/or repeated for reasons for which we are

not answerable must be remunerated separately.

8. Changes that have to be made on the purchaser‘s request once the order

acknowledgement or our tender is in existence are invoiced separately.

9. If unforeseen circumstances arise for the purchaser that necessitate any additional

expenditure going beyond the original scope of the order, then such additional

expenditure must be remunerated by the purchaser, if it was necessary for fulfilling the

contract and if the purchaser did not contradict our advice in this respect immediately.

10. Individual details and details of weights do not constitute promised properties.

Deviations do not justify claims for compensation in damages or price corrections.

11. The admissible building tolerances in dimensioned drawings are those in DIN 7168.

12. The balance qualities of the fan impellers and other turning parts are covered by VDI

2060 and/or DIN ISO 1940 Part 1.

13. The judgement scales for conditions in terms of vibrations are covered by VDI 2056

and/or ISO 2373

III. Prices and payment

1. The prices in the tender only apply if all parts are ordered.

2. For supplies and services that are provided more than 4 months after the contract has

been entered into we may charge any wage and/or materials price increases that may

have arisen since submitting the tender by applying an appropriate overhead

surcharge.

3. The prices detailed are ex-works EURO prices, unless something else has been

explicitly agreed. The purchaser bears the freight, duty and any other necessary

additional charges. Value Added Tax is charged additionally at the rate applying at the

time the tax concerned becomes due.

4. Unless something else has been agreed the following terms of payment apply within

the Federal Republic of Germany:

In the case of supplies (only): within 10 days of the invoice date with 2% cash discount,

or within 30 days of the invoice date in cash, without any deduction. In the case of

delivery and assembly: within 30 days of the invoice date without deduction for the

delivery and within 10 days of receipt of the invoice for the assembly without deduction.

In the case of orders having a value of more than €25,000 the purchaser must make

appropriate advance payments at the time the order is confirmed and at the time

readiness for shipment is notified. The level of the advance payments is laid down

separately at the time of entering into the contract.

5. In the case of supplies and services outside the Federal Republic of Germany 1/3 of

the agreed order sum must be paid at the time of entering into the contract, and 2/3 by

commercial letter of credit at the time the order is ready to ship, unless something else

has been agreed. Despatch shall not take place until the bank has confirmed in writing

that the commercial letter of credit is in place.

6. Any possible rights of retention or rights to refuse performance on the part of the

purchaser on the basis of complaints about defects are excluded. Likewise excluded is

setting off against the purchaser‘s claims on us, unless such claims are uncontested or

established with legal force.

7. If, after the contract has been entered into, circumstances arise that put the purchaser‘s

ability to pay into question then we may withdraw from the contract unless the

purchaser provides us with appropriate sureties. We must inform the purchaser in

writing of the intention to withdraw along with the reasons that have become known to

us, and we must grant it an appropriate period of grace within which to eliminate the

obstructing circumstances or to lodge appropriate sureties. We are not entitled to

withdraw from the contract until the period of grace has expired, fruitlessly.

8. If the purchaser finds itself in arrears of payment, arrears interest at 8% above the

basic rate of interest at the time (§ 247 of the German Civil Code) is charged. We are

not obliged to accept bills of exchange. Cheques and bills of exchange only count as

payment on the day they are honoured. The purchaser bears the cost of discounting

them and any charges arising.

IV. Delivery period

1. The period for delivery begins at the earliest when the order acknowledgement is sent

off, but not prior to the point in time at which clarity and agreement on all the technical

details and contract conditions has been achieved between the purchaser and us, and

not before the arrival of any agreed advance payment. If the purchaser wants to make

subsequent changes, then the delivery period extends correspondingly. We detail

delivery deadlines according to the best of our judgement, but without legally binding

force.

2. It is a prerequisite for timely delivery that the purchaser provides the approvals and

documents necessary for executing the order and for the operation of the plant in good

time, and at its expense. If we provide assistance in this respect, then the purchaser

also bears the costs arising in that connection.

3. The delivery period is complied with if the delivery has left our factory or if we advise

that it has been made ready for despatch by the time the period has expired.

4. Unforeseen obstacles that lie outside our sphere of influence, such as factory

disruptions, lock-outs, the state of being excluded, delays in the delivery of vital

materials and other inward deliveries – no matter whether they occur in our own factory

or with our subcontractors – shall extend the delivery period accordingly, provided such

obstacles can be shown to have considerable influence on producing or delivering the

goods to be delivered within the period concerned. We will inform the purchaser in

writing as soon as possible after we become aware of the beginning and of the end of

such obstacles. We do not have to answer for the circumstances described above,

even if they come about during a period of delay that was already in existence.

5. If some loss arises for the purchaser, demonstrably, owing to some delay that has

arisen for reasons other than those mentioned above as a result of intention or gross

negligence for which we have to answer, then it has the right to demand some

compensation for delayed performance, to the exclusion of other claims. It shall

amount to 1.2% of the value of that part of the overall delivery that - because of the

delay - cannot be put into use in good time or cannot be used as per contract, for each

full week of the delay, but at the most to 5.0% of the value.

V. Shipment and passage of risk

1. Risk passes at the latest when deliveries are sent off to the purchaser, and indeed

when part deliveries are made or when we have assumed shipping charges or have

taken over carriage and setting up operations

2. If shipment is delayed as a consequence of circumstances for which we do not have to

answer, then the risk passes to the purchaser as soon as readiness for shipping has

been notified to the purchaser.

3. If shipment is delayed because the purchaser wishes that, then – beginning one month

after notification of shipment – we reserve the right to charge the costs arising from

storing the delivery at the purchaser‘s risk, and in the case of the delivery having been

stored at our factory, at a rate of at least ½% of the invoice amount for each month.

We have the right to dispose of the goods to be delivered in some other way, and to

supply the purchaser within an appropriately extended period for delivery, if calling off

the delivery bas not been made within an appropriate period of grace set by us.

VI. Assembly

Unless something else has been expressly agreed assembly takes place on our

assembly conditions and at our assembly rates, which form part of the contract.

VII. Retention of ownership

1. We retain ownership of all goods delivered until payment in full of the purchase price

and fulfilment of all claims to which we are entitled, including claims arising from

purchase contracts and contracts for work, and including all supplementary claims.

This applies even if individual claims are taken up into an on-going account, and the

balance is calculated and recognised.

2. If the retention of ownership expires owing to treatment to or processing of the goods,

or linking them to or mixing them with other goods, then we become the direct owners

or co-owners of the new goods that have arisen in accordance with § 947 and/or § 950

of the German Civil Code, according to the value of our goods in proportion to the

value of the new goods. The processing or re-organisation is made on our behalf. The

purchaser safeguards the new goods for us with the diligence of a prudent business

person. The purchaser commits itself, furthermore, to assigning to us any claims or

new co-ownership that arises for it as a result of the demise of our retention of

ownership. In so far as what has been delivered has become an essential component

of the property, the purchaser commits itself – in the case of non-compliance with the

agreed dates for payment – to allowing us to dismantle whatever equipment can be

taken out of the fabric of the building without substantial detriment to it, and to

transferring back to us ownership of the equipment. If the purchaser encroaches on

our rights specified above, then it is committed to reimbursing loss. The dismantling

and other costs are for the purchaser‘s account.

3. No pledging or collateral assignment is permitted until all claims have been paid in full.

Any onward disposal is just re-sale in the course of normal business outside a current

account relationship, and is only permitted on condition that the re-seller receives

payment from its customer or makes the reservation that ownership only passes over to

the customer when the re-seller has fulfilled its payment obligations completely.

4. The purchaser has the right to process and dispose of the goods that have been

delivered. The claims on third parties that have arisen as a result of onward disposal

are herewith assigned to us by way of security without it being necessary to have any

special agreement in individual cases. .

5. As long as the purchaser is complying with its payment obligations to us, it is

empowered to collect the assigned claim on trust, for our account. The proceeds must

be remitted to us promptly. The purchaser empowers us here and now to notify third

party debtors of the assignment.

6. We commit ourselves to releasing the sureties to which we are entitled to the extent

that their value exceeds our claims requiring security – in so far as these are not yet

settled – by more than 25%.

7. The purchaser must notify us immediately of any third party impacting on the goods or

the installation, or on the claims created by their onward disposal, especially as a result

of pledging. Rights arising from insolvency proceedings remain unaffected. Onward

sale in the course of insolvency or settlement proceedings is prohibited.

8. If the purchaser falls into arrears in fulfilling claims arising from the business

connection existing against it, then we have the right to take the goods subject to

retention of title into our keeping. Demanding release of the goods or taking them into

our keeping does not represent any withdrawal from the contract. We have the right to

Page 38: Gesamtkatalog - ruwu.de · The radial fan type MWM with A.C. motor is the perfect fan for use together with a small generator. Also you can run it at standard plugs with 230 V

Page 38

´exploit the goods subject to retention and, by off-setting, to use the proceeds to settle outstanding claims.

9. All goods subject to retention of ownership must be insured against fire, water damage and theft. All claims on the insurer in respect of goods subject to retention of ownership count herewith as assigned to us.

VIII. Liability for defects in goods supplied

1. We are responsible to the purchaser for the goods ordered not being, at the time at which risk passes to it, beset with defects that run counter to or diminish the value or the fitness of the goods for their normal purpose or for the use presupposed for them under the contract. Any slight diminution of value or of suitability is left out of consideration. We do, though, warrant that the goods have the qualities promised at the time of the passage of risk.

2. Defects established must be notified immediately, not later than one week after the goods are handed over. Obvious transport damage and complaints on account of incomplete delivery must in addition be reported to the forwarding agent immediately after receipt of the goods. Defects that were not visible must be reported in writing within one week of their discovery.

3. In the case of straight delivery the period of limitation for claims under guarantee is 8,000 operating hours from the day of delivery, but at the most 2 years from acceptance; in the case of deliveries involving assembly it is 6 months from the day of acceptance for movable parts, and 2 years for immovable parts. Should there result any delay between delivery and start of assembly through no fault on our part, or should there be some interruption in the assembly for which we do not have to answer, the day of the completion of our performance foreseen under the contract counts as the beginning of the period of limitation.

4. To the exclusion of claims going further than this we are liable for defects in supply or service to the extent that we rectify or replace – at our option - all parts that we deliver or install that are defective on account of poor materials, defective construction or finish and where the defect already existed at the time of delivery or acceptance but was not known. Parts replaced become our property. We may decline to remove a defect, even if we have to answer for it, if the costs associated with that are disproportionately high compared with the total value and the reduction in value of the supply or service. The purchaser may demand abatement of the purchase price in lieu of that. The same applies if rectification work is not possible or comes to nothing.

5. Warranty claims may not be asserted if the damage or impairment has one or more of the following causes:

a) Natural depreciation or wear and tear as a result of abrasive pumping media.

b) Imbalances and vibrations as a result of caking elements in the pumping media.

c) Defective and/or negligent assembly or maintenance on the purchaser‘s part.

d) Non-observance of the prescribed relubrication intervals.

e) Unsuitable operating materials.

f) Excess loading.

g) Unsuitable foundations.

h) Changed operating conditions, unknown to us.

i) Ventilators and equipment improperly finished by the purchaser.

6. If what has been supplied has to be mounted, then we are liable for the promised qualities only if the mounting is undertaken by our assemblers.

7. Promises on function or efficiency apply with the proviso that the prerequisites necessary for their attainment and to be provided by the purchaser contractually are fulfilled.

8. For important outside manufactures our liability is limited to the assigning of any liability claims on the supplier of the outside manufacture to which we may be entitled.

9. In the case of supplies on the basis of outside specifications of work, we warrant for the services requested in the specification of works and for the function of the individual unit to the extent mentioned above, but not for the accuracy and appropriateness of such data in the context of the overall planning.

10. In order for us to undertake whatever repairs and replacement delivery appears, according to our proper discretion, necessary the purchaser must, following agreement, give us the necessary time and opportunity for that. The purchaser has the right to eliminate the defect itself or to have it eliminated by third parties, and to demand appropriate reimbursement of its costs from us only in urgent cases where operational safety is threatened, and of which we must be advised immediately, or if we are behind with the elimination of the defect. We assume neither liability – however it might be presented – nor costs of any kind whatsoever for work involving change or repairs undertaken by the purchaser or by third parties for other reasons without our prior consent.

11. For replacement units and rectification work we warrant in the same way as for the original delivery, but at the longest until the expiry of the guarantee period concerning such units and work.

12. There is no liability on our part for any possible outside manufactures contributed by the purchaser and in respect of which we have no duty of inspection.

13. Other claims by the purchaser on us and our subcontractors and vicarious agents, especially for compensation for damage that has occurred not to the delivered items themselves are, in so far as permissible by law, ruled out. Furthermore claims arising from culpable violation of property rights (manufacturer‘s liability) are ruled out, unless such violation was wilful or grossly negligent. The exclusion and limitation of liability also does not apply if there is liability for violation of life, the body or health.

14. The conditions of the electrical industry apply to electric motors.

IX. Production according to the customer’s instructions

1. In the case of production according to customers‘ drawings, samples and other instructions we assume no warranty and liability for the functional suitability of the product nor for other defects, in so far as such matters depend on the customer instructions. The customer indemnifies us from any possible third party claims and also claims arising from product liability on us on account of damage caused by the goods, unless we have caused the damage wilfully or through gross negligence.

2. The tools and construction documentation produced by us to execute the order are exclusively our property. The customer is not entitled to any claims to them, even if it participates in the costs of manufacturing the tools and preparing the construction documentation.

X. Withdrawal from contract

1. The purchaser may withdraw from the contract if the entire performance in the end becomes impossible for us prior to passage of risk. It may also withdraw from the contract if, in the case of any order for same goods the execution of a part delivery becomes – according to the numbers – impossible and the purchaser has a justified

interest in declining a part delivery. If that is not the case then the purchaser may reduce its counter-performance accordingly.

2. If there is a delay in performance as defined in clause IV (Delivery period) above and if the purchaser sets us an appropriate period of grace with an explicit statement that it will refuse to accept the performance once that period has expired, then the purchaser has the right to withdraw if we have not provided the supply and/or service within the period of time set.

3. If performance becomes impossible in the course of delay in acceptance or as a result of fault on the part of the purchaser, then the latter remains obliged to counter perform.

4. Finally the purchaser has a right of withdrawal if we have allowed an appropriate period of grace set for us for the elimination or remedy of some defect for which we have to answer within the terms of the supply conditions to elapse fruitlessly.

5. If unforeseen events as defined in clause IV (Delivery period) occur for which neither we nor the purchaser have to answer, and if the delivery or service incumbent on us because of that becomes wholly or partially impossible, then we in turn have the right to withdraw, wholly or partially, from the contract. In any such case the purchaser‘s obligation to pay the agreed purchase price lapses; in the case of partial impossibility and partial withdrawal the purchaser‘s counter performance is reduced proportionately. The purchaser has no claims for compensation in damages on account of withdrawal for such reasons. After identifying the implications of the event that has occurred we have immediately to make known to the purchaser the intention to withdraw from the contract for the reasons specified. This applies even when just an extension of the delivery period has been agreed with the purchaser for the time being.

XI. Changes / supplements / ineffectiveness

1. Changes and/or supplements to the contract must be in writing.

2. In the case of legal ineffectiveness of individual points the contract remains legally binding in its other parts. That shall not apply if sticking to the contract would represent an unreasonable hardship for one of the contracting parties.

XII. Place of fulfilment and jurisdiction

1. Meitingen is the place of fulfilment and Augsburg the place of jurisdiction. The contract is subject to German law.

XIII. Performance guarantee

1. The listed ventilator types have been tested on the M+W-Zander test bench in an acceptance trial under DIN 24163 Sheet 1 & 2 for the purpose of proving the warranty. The performance data correspond with the ―Technical delivery conditions for ventilators‖ requirements under DIN 24166.

2. In the case of the specification of a ventilator and/or of the type of ventilator being stipulated the test bench curve should not be accepted without correction. If, for example, a ventilator is built into an installation the ideal flow conditions that existed at the standardised test bench when measuring the ventilator‘s curve no longer exist, because additional pressure losses (installation losses) reduce the increase in pressure created by the ventilator, and thus reduce the installation flow volume. The installation planners must observe these components of the specification and take them into consideration in each case.

3. The tolerances according to the precision classes given in DIN 24166 ―Technical delivery conditions for ventilators‖ apply to all ventilation details.

XIV. Sound guarantee

Our soundproofing calculations apply only for free (sound) field conditions, related to the nominal point (NP) of the ventilator at constant rotational speed, in line with DIN 45 635 Sheet 1 'Measurement of machinery noise‖ and/or DIN 45635 Sheet 38 "Measurement of ventilator noise‖. Resonances and air column fluctuations of the plant system, installed parts, additional sound paths (such as pipe work), mounting influences and other outside sources of noise are excluded from our guarantee.

The tolerances for all soundproofing details according to the classes of goods given in DIN 24166 ―Technical delivery conditions for ventilators‖ apply – for instance:

Threshold performance PW > 50 kW ==> Class 1 ==> + 3 dB

Threshold performance PW < 50 kW ==> Class 2 ==> + 4 dB.

Such optimal conditions are, however, in practice not usually present, i.e. the sound figures measured under operating conditions at the installation phase differ from those in echo-free spaces more or less, and from each other, which is why the plant planners must undertake an acoustic plan calculation with the figures detailed by us.

XV. Documentation

Supply includes

1. Two hard copies of service, maintenance and assembly instructions

2. Fact sheet, curves, dimension sheet for the complete ventilator

3. List of spare parts, manufacturer‘s declaration and/or declaration of conformity.

Documentation going beyond the above and special versions in other languages are only available against payment.
