WHEREAS it is provided by section 49 of the Constitution of Malta that whenever the holder of the office of President is absent from Malta the functions conferred upon her by the said Constitution shall be performed by such person as the Prime Minister, after consultation with the Leader of the Opposition, may appoint;

AND WHEREAS the President is absent from Malta;

AND WHEREAS on the 15th day of January, 2019, the Prime Minister appointed me Acting President for such time as the President is absent from Malta;

AND WHEREAS I have duly taken and subscribed the oath of office as prescribed by section 50 of the said Constitution;

NOW, THEREFORE, I, DOLORES CRISTINA, do hereby notify and proclaim that I have this day under the said Constitution assumed the functions of President of Malta.

BIL-GĦAN li jitnaqqas l-użu ta’ kontenituri tal-plastik li jintużaw għall-ibbottiljar tal-ilma, il-Ministru għall-Finanzi qiegħed iniedi din l- għotja fuq xiri u installazzjoni ta’ apparat li jippurifika l-ilma fid-dar permezz ta’ reverse osmosis jew proċessi oħra.

1. Tifsir

F’din l-iskema, kemm-il darba r-rabta tal-kliem ma teħtieġ xorta oħra:

‘applikant’ tfisser persuna residenti f’Malta li għandha tmintax-il sena;

‘data effettiva’ tfisser l-1 ta’ Jannar, 2019;

‘Malta’ tfisser il-gżejjer Maltin;

‘persuna’ tfisser persuna fiżika u ma tinkludix xi entita’ organizzativa;

MINISTRY FOR FINANCE

Grant on the Purchase and Installation of Water Purifying Equipment

IN ORDER to reduce the use of plastic containers utilized for bottling water, the Minister for Finance is launching this grant on the purchase and installation of equipment to purify water at home by reverse osmosis or other processes.

1. Interpretation

In this scheme, unless the context otherwise requires:

‘applicant’ means any person who is a resident in Malta and is eighteen years of age;

‘effective date’ means 1st January, 2019;

‘Malta’ means the islands of Malta;

‘person’ means a natural person and does not include any organisational entity;

‘person residing in Malta’ means a natural person who holds a legally valid identification document issued in terms of the Identity Card And Other Documents Act (Cap. 258) or who has a residence permit or equivalent documentation issued by a competent national authority;

‘fiscal receipt’ means a receipt as defined in the Thirteenth Schedule to the Value Added Tax (Chap. 406), as subsequently amended, and also includes any regulation made by the same Act;

‘Water purifying equipment’ means equipment that filters or purifies water in the home through reverse osmosis or other means, intended to make water suitable for domestic use and drinking.

‘purchase price’ means the total purchase price of the equipment including VAT and which purchase price has been paid in full by the applicant prior to applying for this grant.

‘domestic use’ means the use made of a system/ equipment at a residential property, which property is used by an applicant for residential or habitation purposes;

‘Members of the same household’ means those persons who ordinarily reside in the same residence, whether related or not.


2. Applikabilità

Din l-iskema tapplika għall-infiq li jsir darba biss fuq il-valur tax-xiri u l-installazzjoni tal-apparat li jippurifika l-ilma għal użu domestiku mill-applikant, liema apparat ikun inxtara mill-applikant fid-data effettiva jew wara, matul it-terminu tal-iskema. L-Għotja hija eliġibbli biss għal individwi privati (persuna fiżika) li jixtru apparat li jippurifika l-ilma għall-użu fuq il-proprjetà residenzjali tagħhom.

Apparat installat f’caravans, dgħajjes, boathouses jew bini li m’huwiex intenzjonat għal użu residenzjali m’huwiex eliġibbli taħt din l-iskema.

Persuni u d-djar li diġà bbenefikaw minn din l-għotja mhumiex eliġibbli għal għotja oħra maħruġa taħt din l-Iskema. Bl-istess mod, membri oħra tal-istess dar li diġà bbenefikat minn din l-iskema mhumiex eliġibbli għal din l-għotja.

3. L-infiq li għandu jiġi rraportat

L-infiq li għandu jiġi rraportat huwa dwar il-valur tax-xiri u l-installazzjoni ta’ apparat li jippurifika l-ilma fid-dar kif huwa deskritt f’sezzjoni (1) hawn fuq.

4. Kif wieħed japplika u dokumenti li għandhom jiġu pprovduti

Applikazzjonijiet taħt din l-iskema għandhom isiru biss permezz ta’ portal/s elettroniku/ċi uffiċċjali li jistgħu jiġu indikati għal dan l-iskop minn żmien għal żmien.

Għal dan l-iskop, l-applikant għandu jagħti d-dettalji tal-fatturi/l-irċevuti fiskali u kull dokumentazzjoni oħra meħtieġa hekk kif meħtieġ fuq il-portal indikat. Iżda, l-irċevuti fiskali oriġinali/fatturi u dokumentazzjoni relevanti għandhom jinżammu mill-applikant għal perjodu ta’ mhux anqas minn sentejn mid-data tal-applikazzjoni u jiġu preżentati lill- Uffiċċju tal-Kummissarju tat-Taxxi meta mitluba għal skop ta’ verifika.

F’każ fejn d-dokumenti ma jiġux preżentati meta mitluba l-applikant ikun obbligat li jirrifondi l-ammont li jkun ingħata taħt l-iskema u f’każ ta’ applikazzjoni frawdolenti tittieħed azzjoni kriminali kontra l-applikant skont il-Kodiċi Kriminali (Kap 9).

Fil-każ ta’ apparat li jippurifika l-ilma mhux mixtri minn Malta jkun meħtieġ li dawn id-dokumenti kif ġej jinżammu mill-applikant għall-perjodu kif indikat iktar il-fuq. Id-dokumenti meħtieġa huma fattura oriġinali maħruġa mill-fornitur tal-apparat flimkien mad-delivery note, id-dokument oriġinali li jikkonfera li l-ħlas komplet sar, u fejn ikun meħtieġ awtorizzazzjoni mil-Malta post/Dipartiment tad-

2. Area of applicability

This scheme applies to expenditure incurred once only on the purchase price and installation of purifying water equipment for domestic use by the applicant, which equipment is purchased by the applicant on the effective date or after, during the duration of this scheme. The Grant is only eligible for private individuals (natural person) that purchase water purifying equipment for use on their residential property.

Equipment installed in caravans, boats, boathouses or buildings not intended for residential use are not eligible under this scheme.

Persons and households that have already benefitted from this grant shall not be eligible for another grant issued in terms of this scheme. Likewise, other members of the same household that has already benefitted from this scheme shall not be eligible for this grant.

3. Expenditure to be reported

The expenditure to be reported is in respect of the purchase price and installation of equipment to purify water at home as defined in section (1) above.

4. Manner of application and supporting documents

Applications under this scheme shall be made only via the official electronic portal/s which may be indicated from time to time for this purpose.

For this purpose, the applicant shall furnish the details of the invoices/fiscal receipts and any further documentation required to be submitted as required on the indicated portal. Provided that, the original fiscal receipts/invoices and relevant documentation shall be kept by the applicant for a period of not less than two years from the date of application and produced upon request to the Office of the Commissioner for Revenue for verification purposes.

Failure to produce any such documents upon request the applicant will be obliged to refund the amount paid under the scheme and in the case of a fraudulent application criminal action in terms of the Criminal Code (Cap 9) will be taken against the applicant.

In the case of water purifying equipment not purchased from Malta the original invoice issued by the supplier indicating the type of equipment purchased, together with the delivery note, the original documentary proof that final payment has been effected, and clearance from Maltapost/Department of Customs Malta as may be required, must be retained by the applicant for a period as stipulated above.

These documents must confirm that the water purifying equipment was really purchased; that the purchase price of the equipment which price includes duty and VAT as may be required was really paid in full; that such a purchase was effected by the applicant for the applicant’s use; and that the water purifying equpment was delivered to the applicant’s residence. The purchased water purifying equipment must also have a certificate of conformity with EU standard safety regulations, as may be required.

Only those applications that are found to conform with the provisions of this scheme shall be eligible for payment of the grant referred to in section 5 of the scheme.

Applications under this scheme, including the details of the documents required, should be submitted by not later than three months from the purchase of the water purifying equipment.

Applications received ‘late’, that is after the three month period, shall be demed to be invalid applications.

5. Grant payable under this scheme

Eligible applicants may apply for a once-only grant of 15.25% on the purchase price and installation of equipment to purify water at home subject to a maximum grant of €70.

6. Payment of Grant

The grant will be credited to the applicant, in the bank account that is indicated in the application.

7. Validity of application

An application shall not be deemed to be valid unless:

it is full and complete in all material aspects; it is accompanied by all the relevant documentation or

details as required; it is not submitted to the Office of the Commissioner for

Revenue via the official electronic portal by not later than three months from the date of purchase of the equipment to purify water at home as is stipulated in Section 4 of this scheme.

8. Duration of the scheme

This scheme has a definite duration and will start as from the 1st January 2019, and end on the 31st December 2019, unless this scheme is not modified/terminated by means of a Notice in the Government Gazette and shall be renewed as deemed necessary by the Minister for Finance and as such shall be thus published in another Notice in the Gazette.

Applikazzjonijiet taħt din l-iskema, inkluż id-dettalji tad-dokumenti meħtieġa, għandhom isiru sa mhux aktar tard minn tliet xhur mid-data tax-xiri tal-apparat li jippurifika l-ilma.

Applikazzjonijiet milqugħa ‘tard’, jiġifieri wara dawn it-tliet xhur jiġu kkunsidrati bħala applikazzjonijiet invalidi.

5. Għotja li titħallas taħt din l-iskema

Applikanti li jikkwalifkaw jistgħu japplikaw għall-għotja ta’ darba biss ta’ 15.25% fuq il-valur tax-xiri u installazzjoni ta’ apparat li jippurifika l-ilma fid-dar, sa għotja tal-valur massimu ta’ €70.

6. Ħlas tal-għotja

L-għotja titħallas lill-applikant, permezz ta’ kreditu dirett fil-kont bankarju indikat fl-applikazzjoni.

7. Validità tal-applikazzjoni

Applikazzjoni ma tkunx meqjusa valida jekk:

ma tkunx sħiħa u dettaljata f’kull aspett materjali tagħha;ma jkollhiex inklużi magħha d- dokumentazzjoni jew

dettalji kollha relevanti;ma tkunx sottomessa lill-Uffiċċju tal-Kummissarju tat-

Taxxi permezz tal-portal elettroniku uffiċjali fi żmien tliet xhur mid-data tax-xiri tal-apparat li jippurifika l-ilma fid-dar kif stipulat f’Sezzjoni 4 ta’ din l-iskema.

8. Tul ta’ l-iskema

Din l-iskema għandha tul definit u tibda’ mil-1 ta’ Jannar 2019, u tispiċċa fil-31 ta’ Diċembru 2019, sakemm din l-iskema ma tiġix modifikata/mitmuma permezz ta’ Notifika fil-Gazzetta tal-Gvern u tiġġedded skont kif jaħseb li hemm il-ħtieġa il-Ministru għal-Finanzi, u kif tiġi hekk ppubblikata permezz ta’ Notifika oħra fil-Gazzetta.


9. Amendments to the scheme

The Minister for Finance reserves the right to make any amendments to this scheme by the publication of the said amendments in the Government Gazette.

10. Transitory provisions

Applications made under this scheme relating to the expenditure on the purchase price and installation of equipment to purify water at home and which purchase and installation was carried out between the effective date and the date of publication of this notice shall be deemed to be valid applications under this scheme, provided that the applications satisfy all the conditions stipulated in this notice. In such cases applications shall be submitted within three months from the date of publication of this Notice.

ORDERED the attachment in the hands of third parties in general of all moneys and other movable or immovable property due to or pertaining or belonging to ABIDEMI ABIGAIL ABORISHADE and prohibits the said accused from transferring, pledging, hypothecating or otherwise disposing of any movable or immovable property and this according to Section 22A of the Dangerous Drugs Ordinance, Cap. 101 of the Laws of Malta, and Section 23A of the Criminal Code, Cap. 9 of the Laws of Malta.

Any person who acts in contravention of the court order mentioned in Section 22A and Section 23A referred to above shall be guilty of an offence and shall on conviction be liable to a fine (multa) not exceeding eleven thousand and six hundred and forty-six euro and eighty-seven cents (€11,646.87), or to imprisonment for a period not exceeding twelve months, or to both such fine and imprisonment.

Any transfer or other disposal of any immovable property made in contravention of the said Court order shall be null and without effect at law.

By means of a decree given by the Court of Appeal (Appeals Environment and Planning Authority) on the 21st November, 2018, in the records of the Application in the names Fathi Abdelraham vs The Planning Authority et, Application Number 62/18 MCH, the following publication was ordered for the purpose of service of the respondent Fathi Abdelraham, in terms of Article 187(3) et sequitur of Cap. 12.

By means of an Application, presented in the Court of Appeal, following the decision given by the Environment and Planning Review Tribunal, on the 2nd October, 2018, with reference to application number PA/07754/17 and Appeal 004812/17, in the names Abdelraham Fathi vs The Planning Authority and the party called into the suit Reuben Abdilla, on the 19th October, 2018, the applicant Reuben Abdilla (ID 133876M) respectfully pleaded:

1. That on the 19th February, 2017, the interpellant brought forward the planning application with reference number PA/07754/17, whereby he asked ‘To sanction penthouse as built and to propose alterations to PA4494/15’ related with the premises or rather block of apartments which bears the name ‘Diamond Flats’ in Triq is-Swieqi, Swieqi, Malta.

2. On the 27th November, 2017, the same Fathi Abdelraham, who resides in one of the apartments which are found in ‘Diamond Flats’, appealed from this decision of the Authority on the premise that ‘as an owner of an undivided share of the common parts of the same block of buildings and this because the applicant is the owner of the entire flat numbered 2, Diamond Flats, in Triq is-Swieqi, Swieqi, he has already objected by letter dated 5th October, 2017, limited to the installation of the lift since the proposal in question consists of alterations and changes in the common

parts of the same and this prejudices the right of the appellant as being part owner of the same property upon which the applicant has made his application.’

3. For this appeal the interpellant filed his reply and asked that this appeal be rejected for three (3) reasons: i) The Tribunal was not the competent forum to decide a dispute which revolves on an alleged right of third parties or rather right of property on the common parts of the block Diamond Flats; ii) Subsidiarily and without prejudice to the first point, the consent of Fathi Abdelraham to the installation of a proposed lift had been acquired much before the permit was submitted from which the same Fathi was objecting; iii) Without prejudice to the points raised, the consent of Fathi Abdelraham was not necessary since in the circumstances there applies Article 8 of Cap. 398 of the Laws of Malta.

4. By means of a decision given by the Tribunal of Revision of the Environment and Plainning, later on referred to as ‘The Tribunal’ the appeal of Fathi Abdelraham was upheld in part and this as the same confirmed that part of the permit in virtue of which the interpellant asked that there be sanctioned that part of the permit in virtue of which the interpellant asked that there be installed a lift in the common part of the block of apartments.

6. The interpellant here appellant, felt aggrieved by that part of the decision of the Tribunal which upheld the appeal of Fathi Abdelraham, limitedly to the installation of the lift in the common parts of the block Diamond Flats, Triq is-Swieqi, Swieqi, and confirmed the rest of the decision and namely that part which refers to the sanctioning of the penthouse.

7. The grievances of the interpellant are the following:

a. The Tribunal based its decision on the alleged civil rights of the objector and thus acted beyond the parameters of his functions.

b. There is no proof that Fathi Abderaham has any rights on the site where it was proposed that there be installed a lift.

c. In any case the Tribunal interpreted the requisite of consent badly in such a manner that it did not consider all the laws applicable as regards this.

… omissis … Conclusion

34. In the manner how the Tribunal proceeded and namely by first deciding points of civil law and then decided

parts of the same and this prejudices the right of the appellant as being part owner of the same property upon which the applicant has made his application.’

Għal dan l-appell l-esponenti ppreżenta r-risposta tiegħu u talab li dan l-appell jiġi miċħud għal tliet (3) raġunijiet: i) It-Tribunal ma kienx il-forum kompetenti sabiex jiddeċiedi kwistjoni li tiċċentra fuq allegat dritt ta’ terzi ossija dritt ta’ proprjetà fuq il-partijiet komuni tal-blokka Diamond Flats; ii) Sussidjarjament u mingħajr preġudizzju għall-ewwel punt, il-kunsens ta’ Fathi Abdelraham għall-installazzjoni tal-lift propost kien ġie miksub ferm qabel ma ġie sottomess il-permess li minnu kien qiegħed joġġezzjona l-istess Fathi; iii) Mingħajr preġudizzju għall-punti sollevati, il-kunsens ta’ Fathi Abdelraham ma kienx meħtieġ stante li fiċ-ċirkostanzi japplika l-Artikolu 8 tal-Kap. 398 tal-Liġijiet ta’ Malta.

4. Permezz ta’ deċiżjoni mogħtija mit-Tribunal ta’ Reviżjoni tal-Ambjent u l-Ippjanar, aktar ’il quddiem imsejjaħ ‘it-Tribunal’, l-appell ta’ Fathi Abdelraham ġie milqugħ in parte u dan billi l-istess ikkonferma dik il-parti tal-permess li bih l-esponenti talab li tiġi sanzjonata l-penthouse filwaqt li ċaħad dik il-parti tal-permess li bih l-esponenti talab li jinstalla lift fil-partijiet komuni tal-blokka ta’ appartamenti.

6. L-esponenti hawn appellant ħassu aggravat minn dik il-parti tad-deċiżjoni tat-Tribunal illi akkoljiet l-appell ta’ Fathi Abdelraham, limitatament għall-installazzjoni tal-lift fil-partijiet tal-blokka Diamond Flats, Triq is-Swieqi, Is-Swieqi, u jikkonferma l-bqija tad-deċiżjoni u ċjoè dik il-parti li għandha x’taqsam mas-sanzjonar tal-penthouse.

7. L-aggravji tal-esponenti huma s-segwenti:

a. It-Tribunal ibbaża d-deċiżjoni tiegħu fuq allegati drittijiet ċivili tal-oġġezzjonatur u hekk aġixxa lil hinn mill-parametri tal-funzjonijiet tiegħu.

b. Ma hemmx prova illi Fathi Abdelraham għandu xi drittijiet fuq is-sit fejn ġie propost illi jiġi installat il-lift.

c. Fi kwalunkwe każ it-Tribunal interpreta r-rekwiżit tal-kunsens b’mod ħażin b’tali mod illi ma kkunsidrax il-liġijiet kollha applikabbli dwar dan.

Konklużjoni

34. Bil-mod kif mexa t-Tribunal u ċjoè billi l-ewwel iddeċieda kwistjoni ta’ dritt ċivili u mbagħad iddeċidiha

in such a manner that it ignored the special law that regulated the principles of law applicable in this case, it created an anomalous situation whereby the applicant Reuben Abdilla can, with an apposite action or by defending a cause, satisfy the Court that there exist all the elements according to Article 8(5) of Cap. 398 to carry on works because it does need any consent (it has the consent of the law) and on the other part it has a decision of a Tribunal which is supposed to decide as regards planning matters, which told him that without the consent of Fathi Abdelraham he could not proceed. Had the Tribunal always proceeded in this manner, it will mean that its decisions can stultify the law which is there purposely to regulate the consent which is necessary and where it is not, the decision in this sense can create huge problems.

35. Truly this is not a hypothetical situation but one which the interpellant is living today.

36. This confusion was created due to the ultra vires behaviour of the Tribunal and from its decisions to interpret civil principles in an incomplete manner.

37. It is stated in conclusion that The Tribunal not only should not have entered in questions of civil law (because for the requiste of consent, the law provides clear pleas and set up, that it is only the Court which is competent to consider) but if ever once decided to enter in these principles it still should have verified whether the root of the right alleged is truly a title which exists (that is whether Fathi Abdelraham is the owner of part of the common parts) and then see all the civil laws above all those that are there purposely to regulate the matter applicable in the case.

For these reasons the appellant humbly prays that this Honourable Court change the decision of the Tribunal by confirming that part of the decision of the Tribunal which upheld the permission of Reuben Abdilla, as regards the sanctioning of the penthouse, and revoke that part of the decision of the Tribunal where it upheld limitedly the appeal of Fathi Abdelraham, for the cancelling of that part of the permit which authorised Reuben Abdilla to carry out works and develop the common parts of the block with the address Diamond Flats, Triq is-Swieqi, Swieqi, and give those orders and directions considered opportune including thus that it sends back the records to the Tribunal to decide again or by confirming in whole the decision of the Planning Authority Board of the 30th October, 2017.

Whereas the procedures in writing in the cause before the Court of Appeal, between Abdelraham Fathi vs the Planning Authority and the party called into the suit Reuben Abdilla, have been closed, the Court fixed the hearing of this cause on Wednesday twenty-first (21) November, 2018, at 9.00 a.m. and deferred to the 17th January, 2019, at 9.00 a.m.

Kieku t-Tribunal jimxi dejjem hekk, ikun ifisser illi d-deċiżjonijiet tiegħu jkunu jistgħu joqtlu l-liġi li proprju qiegħda hemm biex tirregola fejn il-kunsens hu meħtieġ u fejn ma huwiex. Id-deċiżjoni f’dan is-sens kapaċi toħloq problemi kbar.

35. Tabilħaqq din mhijiex sitwazzjoni ipotetika imma waħda li qed jgħixha llum l-esponenti.

36. Din il-konfużjoni twieldet mill-aġir ultra vires tat-Tribunal u mid-deċiżjoni tiegħu illi jinterpreta prinċipji ċivili b’mod inkomplet.

37. Jingħad in konklużjoni illi t-Tribunal mhux biss ma messux daħal fi kwistjonijiet ta’ dritt ċivili (għaliex għar-rekwiżit tal-kunsens, il-liġi tipprova eċċezzjonijiet ċari u kumplessi illi hija biss il-Qorti illi hija adita tikkunsidra) iżda se mai ġalardarba ddeċieda li jidħol f’dawn il-prinċipji xorta waħda kellu jivverifika jekk l-għerq tad-dritt allegat huwiex verament titolu li jeżisti (jiġifieri jekk Fathi Abdelraham huwiex sid ta’ parti mill-komun) imbagħad jara l-liġijiet ta’ dritt ċivili kollha, fuq kollox dawk li qegħdin hemm proprju biex jirregolaw il-materja applikabbli tal-każ.

Għal dawn il-motivi l-appellant umilment jitlob illi din l-Onorabbli Qorti tibdel id-deċiżjoni tat-Tribunal billi tikkonferma dik il-parti tad-deċiżjoni tat-Tribunal li laqgħet il-permess ta’ Reuben Abdilla, fir-rigward tas-sanzjonar tal-penthouse, u tirrevoka dik il-parti tad-deċiżjoni tat-Tribunal fejn laqa’ limitatament l-appell ta’ Fathi Abdelraham, għat-tħassir ta’ dik il-parti tal-permess illi awtorizzat lil Reuben Abdilla jagħmel xogħlijiet u jiżviluppa l-partijiet komuni tal-blokka bl-indirizz Diamond Flats, Triq is-Swieqi, Is-Swieqi u tagħti dawk l-ordnijiet u/jew direzzjonijiet meqjusa opportuni, inkluż allura illi tirrimetti l-atti lit-Tribunal biex jerġa’ jiddeċiedi, inkella billi tikkonferma fis-sħiħ id-deċiżjoni tal-Bord tal-Awtorità tal-Ippjannar tat-30 ta’ Ottubru, 2017.

Billi ngħalqu l-proċeduri bil-miktub fil-kawża quddiem il-Qorti tal-Appell, bejn Abdelraham Fathi vs l-Awtorità tal-Ippjannar u l-kjamat in kawża Reuben Abdilla, il-Qorti ffissat is-smigħ ta’ din il-kawża għal nhar l-Erbgħa, wieħed u għoxrin (21) ta’ Novembru, 2018, fid-9.00 a.m. u differita għas-17 ta’ Jannar, 2019, fid-9.00 a.m.

Għaldaqstant, in vista tas-suespost, jgħid l-intimat għaliex m’għandux dan il-Bord, bid-dispensa tas-smigħ a tenur tal-Artikolu 167 et sequitur tal-Kap. 12 tal-Liġijiet ta’ Malta u tal-Artikolu 16A tal-Kap. 69 tal-Liġijiet ta’ Malta:

on the 14th June, 2018, the applicant Maria Rosaria sive Lucy Brincat in her own name and on behalf of the heirs of Annunzjata and Frans Galea (ID 703640M) requested with respect and confirmed on oath:

The parents of the applicants Annunzjata and Frans Galea granted by title of emphyteusis, published in the acts of Notary Dr Nicola Said dated 7th July, 1981, and which was subsequently converted into a lease to the respondent Joseph Borg, the premises 49, in Triq San Mikiel, Marsa, which agreement is being attached and marked as Doc. A;

The respondent Borg is no longer using the premises above mentioned as his ordinary residence which is the purpose for which the premises were leased to him, and this because he has been absent from Malta for a number of years because he is permanently abroad in a foreign country, that is England, and so the premises are not used as it will proven during the proceedings;

This default is causing prejudice to the applicants, and also this default of the respondent has been recurring for a number of years without a valid reason at law and causing damages to the applicants;

The applicants declare that as far as they know, the respondent does not have any valid defences to the requests of the applicants and so these proceedings have to be heard and decided without proceeding to trial in terms of Article 167 st sequitur of the Code of Organisation and Civil Procedure (Cap. 12 of the Laws of Malta) and in terms of Article 16A of the Reletting of Urban Property Ordinance (Cap. 69 of the Laws of Malta);

The applicants know of these facts personally;

And so these proceedings had to be made.

Thus, in view of the above, the respondent is to declare why this Board, should not hear this case without proceeding to trial in terms of Article 167 et sequitur of Cap. 12 of the Laws of Malta and of Article 16A of Cap. 69 of the Laws of Malta and:

1. Hear these proceedings without proceeding to trial and this in terms of Article 167 et sequitur of the Code of Organisation and Civil Procedure (Cap. 12 of the Laws of Malta) and of Article 16A of the Reletting of Urban Property Ordinance (Cap. 69 of the Laws of Malta);

2. Declares that the lease in favour of the respondent of the premises 49, in Triq San Mikiel, Marsa, today is terminated and the respondent has no other right to remain occupying the premises;


3. Tordna lill-intimat Joseph Borg sabiex fi żmien qasir u perentorju li dan l-Onorabbli Bord jogħġbu jipprefigi, jirrilaxxa l-pussess u jiżgombra mill-fond u jikkonsenja ċ-ċavetta tal-istess fond lir-rikorrenti, u dan prevja kull provediment li dan il-Bord jidhirlu xieraq u opportun;

Nonostante diversi interpellazzjonijiet mill-mittenti għall-ħlas tal-ammont dovut, inti nqast milli tħallas sal-ġurnata tal-preżentata ta’ din l-ittra. Aktar minn hekk ma hemm l-ebda raġuni valida għal din l-inadempjenza u int qatt ma kkontestajt l-ammont dovut.

Dan l-att qiegħed jintbagħat lilek għall-finijiet u l-effetti kollha tal-liġi u fin-nuqqas ta’ pagament jew oppożizzjoni daparti tiegħek fit-termini tal-imsemmi Artikolu 466 tal-Kap. 12 tal-Liġijiet ta’ Malta, il-mittenti jgħaddu biex jesegwixxu dan il-krettu skont il-liġi.

Permezz ta’ digriet mogħti fil-Qorti tal-Maġistrati (Malta) fid-9 ta’ Jannar, 2019, fl-atti tal-ittra uffiċjali numru 4068/18, fl-ismijiet Argus Insurance Agencies Limited noe vs Noel Sciortino, ordnat is-segwenti pubblikazzjoni biex

bill number 101000062461 for the premises 42, Triq San Fidiel, Ħamrun which amounts to €2,640.31.

Despite several solicitations by the applicant company for the payment of the amount due, you remained in default and did not pay till the day of the filing of this judicial letter. In addition, there is no valid reason for your failure to pay and you never contested the amount due.

This act is being sent to you for all the purposes and effects of law and in default of payment or opposition on your part within the time mentioned in Article 466 Cap. 12 of the Laws of Malta, the applicant company shall proceed to enforce this credit according to law.

Il-mittenti jinformawk illi f’każ illi t-terminu lilek mogħti jgħaddi inutilment, huma ma jkollhom ebda alternattiva oħra għajr li jipproċedu ulterjorment fil-konfront tiegħek bil-mezzi kollha li trid il-Liġi.

Tant biex tagħraf tirregola ruħek u biex jiġu evitati spejjeż u proċeduri inutili.

ordered the following publication for the purpose of effecting service on the respondent Noel Sciortino, in terms of Article 187(3) of Cap. 12.

By means of a judicial letter filed in the Court of Magistrates (Malta) against Noel Sciortino (ID 9077M) of El Shaddai, Triq il-Feniċi, Mosta, on the 21st December, 2018, Argus Insurance Agencies Limited (C 597) for and on behalf of the foreign company Argus Insurance Company (Europe) Limited of La Concorde, Triq Abate Rigord, Ta’ Xbiex, and this as subrogated in the rights of its insured Christian Storseth, on the basis of a comprehensive type of policy and at Law, and the same Christian Storseth, whilst reference is made to the car accident that occured on the 27th January, 2017, in the Ħamrun-Marsa Bypass, Ħamrun, between the vehicle with registration number GQZ-696 driven by Noel Sciortino and the vehicle of the interpellant Christian Storseth with registration number CD, solicits you so that within three (3) days you pay the interpellant Christian Storseth the sum of €410 representing the excess payment paid by him to the interpellant company Argus Insurance Agencies Limited as a result of this accident, and you pay the interpellant company Argus Insurance Agencies Limited the sum of €776.79 for all the payments paid to its insured as a result of the said accident, which accident occured solely as a result of your carelessness, negligence, lack of skill and lack of observing the traffic regulations on your part.

The interpellant informs you that in case the time given to you passes uselessly, they will have no alternative but to proceed furtherly against you by all the means permitted by law.

So much so that you may know how to regulate yourself and to avoid useless costs and procedures.

This letter is being made particularly, but not limitedly, for the interruption of the prescription in terms of Cap. 12 and 16 of the Laws of Malta.
