This Cause came on regularly for hearing before the Utah Board of Oil, Gas and
Mining (the "Board") on Vy'ednesday, December 10,2014, at the hour of 9:00 a.m. in the
Auditorium of the Department of Natural Resources, 1594 West North Temple, Salt Lake City,
Utah. The following Board members were present at the December 10, 2014heaÅng: Ruland J.
Gill, Jr., Chairman; Kelly L. Payne; Carl F. Kendell; Chris D. Hansen; Michael R. Brown; Susan S
Davis; and Gordon L. Moon. John Roberts, Associate Director-Oil and Gas; Brad Hill, Oil and
Gas Permitting Manager; Dustin Doucet, Petroleum Engineer; and Clinton Dworshak, Compliance
and Public Outreach Manager, were present for the Division of Oil, Gas and Mining (the
"Division"). The Board was represented by Mike S. Johnson, Assistant Attorney General, and the
Division was represented by Steven F. Alder, Assistant Attorney General. The petitioner, Crescent
Point Energy U.S. Corp. ("Crescent Point") was represented by Thomas W. Clawson of Van Cott,
Bagley, Cornwall & McCarthy; and Ryan'Waller, Crescent Point's Landman; LavtaRoberts,
Crescent Point's Geologist; and Katie Matthews, Crescent Point's Development Engineer, testified
on behalf of the petitioner. The Board recognized Ms. Roberts as an expert geologist and Ms.
Matthews as an expert petroleum engineer for the purposes of this Cause.
The Division expressed its support for granting Crescent Point's Request for Agency
Action filed in this Cause (the "Request") at the hearing. No other person or party filed a response
to the Request and no other person or party appeared at or participated in the hearing.
The Board, having fully considered the testimony adduced and exhibits received into
evidence at the December 10, 2}I4hearing, being fully advised, and good cause appearing, hereby
makes the following findings of fact, conclusions of law, and order in this Cause:
FINDINGS OF FACT
1. Notices of the time, place, and purposes of the Board's regularly scheduled
December 10,2014 hearing were mailed to all interested parties by first-class mail, postage prepaid,
and were duly published in the Salt Lake Tribune, Deseret Morning News, Uintah Basin Standard,
and Vemal Express pursuant to the requirements of Rule R641-106-100, Utah Administrative Code
("U.4.C."). Copies of Crescent Point's Request were mailed to all interested parties pursuant to
Rule R641 - 1 04-1 35, U.A.C.
2. No written responses, protests, or objections to Crescent Point's Request
were filed with or received by the Division or the Board, and no persons or parties appeared at, or
participated in, the December I0,2014 hearing in opposition to Crescent Point's Request in this

matter
3, Crescent Point Energy U.S. Corp. is a Delaware corporation in good
standing, having its principal place of business in Denver, Colorado. Crescent Point is qualified to
and is doing business in Utah.
4. Under that certain Findings of Fact, Conclusions of Law, and Order issued
by the Board on April 8,2014, and entered in Cause No. 131-137 (the "Prior ULT Order"), the
Board approved (and certified for the purposes of a severance tax rate reduction) the ULT
V/aterflood Project as an enhanced and secondary recovery project located in subject Section 36,
Township 3 South, Range I East, U.S.M., including the underground injection of water and a plan
of development and operations in the Unitized Formation (as defined herein) utilizing a 4}-acte
five-spot injection pattem and a well grid utilizing2}-acre spacing.
5. The proposed expanded ULT V/aterflood Project (the "Expanded ULT
V/aterflood Project") embraces the following described lands in the Leland Bench Field, Uintah
County, Utah (the "Subject Lands"):
Township 3 South. Range I East. U.S.M.
Section 34: AllSection 35: AllSection 36: All
(containing 1,923,72 acres, more or less).
6. The formations to be approved by the Board for enhanced and secondary
recovery in the Expanded ULT Waterflood Project are the Green River and Vy'asatch formations,
more particularly defined as follows (the "Unitized Formation"):
The Green River and'Wasatch formations as identified by the logs run onthe crescent Point ULT #12-36-3-lE Well located in the NV/%SW% ofSection 36, Township 3 South, Range I East, U.S'M., Uintah County'utah, with the top of the stratigraphic interval being found at a depth of5]25 feet below the surface (-637'subsea) and the base of the interval

being found at a depth of 7 ,900 feet below the surface (-2,800' subsea) orstratigraphic equivalent thereof.
7, The majority of the minerals in the lands embraced within the Expanded
ULT Waterflood Project are owned in fee by the Utah Land Trust ("ULT") and the remaining
minerals are also owned in fee by other private parties. All of the minerals embraced within the
Expanded ULT Waterflood Project are subject to fee (private) oil and gas leases. There are no
overriding royalty interest owners.
8. Crescent Point owns 100% of the working interest in the Expanded ULT
V/aterflood Project area.
9. The surface of the Subject Lands embraced within the Expanded ULT
'Waterflood Project Area is owned in fee, by private parties.
10. Drilling on the Subject Lands has proceeded under either the Prior ULT
Order, two spacing orders previously entered by the Board (as described herein), or statewide
location and density patterns for the location and siting of wells established by Rule R649-3-2,
U.A.C. Under that certain Findings of Fact, Conclusions of Law, and Order entered on September
26,2007, in Cause No. 142-03, the Board established twelve 80-acre laydown (horizontal) drilling
units comprising all of subject Section 36 and the N% of subject Section 35 for the production of oil
and associated gas and other hydrocarbons from the Lower Green River formation as described in
that order. Under that certain Findings of Fact, Conclusions of Law, and Order Allowing In-fill
Wells entered on August 24,2011, in Cause No. 142-05, the Board modified its previous spacing
order to permit the drilling of an additional (second) well for the production of oil and associated
gas and other hydrocarbons for the Lower Green River formation beneath the spacing/drilling units
encompassing the N% of Section 35 and all of Section 36. (The orders in Causes Nos. 142-03 and
142-05 are collectively referred to herein as the "Prior Spacing Orders".) The Prior ULT Order

vacated the Prior Spacing Orders to the extent they affect subject Section 36. The Prior Spacing
Orders do not allow development of the Subject Lands and minerals in the N% of subject Section 35
on the basis of a well grid utilizing 20-aue spacing as requested by Crescent Point.
1 I . The wells that have been proposed and/or drilled andlor completed in the
acreage embraced within the Expanded ULT 'Waterflood Project area are listed in Attachment "4,"
which is attached hereto and incorporated herein. Attachment "A" also lists the wells located within
one-half mile of the boundary of the Expanded ULT Waterflood Projectarea.
12. Most of the wells described above have produced (or are expected to
produce) oil and gas from the Green River and Wasatch formations.
13. The reservoir underlying the Expanded ULT V/aterflood Project area is a
solution-gas drive reservoir that is normally pressured. As is characteristic of such reservoirs, there
is a relatively rapid loss of reservoir energy as primary production occurs, resulting in a rapid
decline in production and low primary recovery.
14. As ofNovember 1, 20I4,the estimated remaining gross proved developed
producing reseryes for the producing and proposed wells drilled under the Prior Spacing Orders or
on the basis of 4O-acre equivalent spacing within subject Sections 34 and 35 are approximately
2.5498 million barrels of oil and I,274.9 MMCF of gas. If enhanced recovery operations based on a
4}-acre 5-spot injection pattern and a well grid utilizing2}-acre well spacing as outlined in
petitioner's Request and as presented at the December 10, 2014hearing are implemented in subject
Sections 34 and 35, the gross proved developed producing reseryes are estimated to be
approximately 4.3254 million barrels of oil and 2,162.1MMCF of gas.
15. A water flood enhanced and secondary recovery project in the Green River
and'Wasatch formations in Sections 34 and 35 based ona4}-acre 5-spot injection pattern and a well

grid utilizing2}-acre well spacing could increase ultimate recovery by approximately 1.7756
million barrels of oil and 900 MMCF of gas. The net present value of these reseryes is estimated to
be approximately 524,000,000 (before taxes) after accounting for the additional costs associated
with implementing the enhanced and secondary recovery operations. The value of the estimated
additional recovery of oil and gas substantially exceeds the estimated additional cost incident to
conducting enhanced and secondary recovery operations.
16, Crescent Point is the operator of the original ULT Waterflood Project, the
nearby Randlett Waterflood Project, and other water flood projects located in Canada. Crescent
Point is experienced in the operation of water flood projects.
17. Applications for approval of injection wells within the Expanded ULT
V/aterflood Project area as Class II injection wells will be submitted to the Division to be approved
on an administrative basis.
18. Under the proposed enhanced and secondary recovery plan, the average
injection rate will be approximately 200-300 banels of water per day per injection well. The
maximum pressure will vary by well, but will be less than parting pressure as determined by step-
rate tests.
19, The water to be used as the injection medium for the water flood project will
come from producing wells, which will be treated as necessary to render it compatible with the
formation water, and will be transported by truck andlor pipeline to the Expanded ULT Waterflood
Project.
20. Except for the plan of development and operations (and o\,ryners agreement
thereof) for the original ULT Waterflood Project in subject Section 36 as approved by the Board in
the Prior ULT Order, no voluntary agreement as contemplated by Section 40-6-7(l) of the Utah

Code and no plan of development and operation of the pool as contemplated by Section 40-6-7(2) of
the Utah Code exist with respect to the Expanded ULT Waterflood Project Area.
2L One hundred percent of all owners of working interests and in excess of 98
percent of all owners of royalty interests within the proposed expanded proj ect area are agreeable to
the plan of development and enhanced and secondary recovery operations as provided in
petitioner's Request, hearing testimony, and Exhibit Binder, as supplemented, all as introduced,
adduced, and admitted as evidence at the December 10,2014 hearing, and such owners have
expressed in writing their approval of said plan of operations and development.
22. Crescent Point will be the designated operator.
23. The allocation of production for the Expanded ULT Waterflood Project will
be made in accordance with the terms of the Subject Leases and that certain Proceeds Allocation
Agreement as introduced and admitted at the December 10, 2014hearing as the Second Supplement
to Exhibit B, and such allocation is reasonable and acceptable to the Board and the Division.
24. The geology and engineering data for the Expanded ULT V/aterflood
Project, including the materials contained in the Exhibit Binder, as supplemented, all as introduced,
adduced, and admitted at the December I0,2014 hearing, are reasonable and acceptable to the
Board and the Division.
25, The plan of development and operations and the geology and engineering
data for the Expanded ULT Waterflood Project operations, all as introduced, adduced, and admitted
at the December I0,2014 hearing, are reasonable and will satisff the requirements of the Utah
Code, and will accomplish the goals of the enhanced and secondary recovery project.

26. The proposed cooperative development and enhanced and secondary
recovery operations in the Expanded ULT V/aterflood Project arca ate necessary to fulfill the
purposes of Chapter 6 of Title 40 of the Utah Code.
27. The proposed water-injection operations based on a 40-acre five-spot
injection pattem using a well grid utilizing 2}-acre spacing will satisff the purposes of the well
location and siting rules (RulesR649-3-2 and R649-3-3, U.A.C.) with respect to the proposed
operations.
28, Petitioner Crescent Point and the Division's attomey and staff were the only
persons or parties who attended or participated in the December 10, 2014heanng.
29. Section 59-5-102(7) of the Utah Code provides that a 50o/o reduction in the
severance tax rate is imposed upon the incremental production achieved from an enhanced recovery
proj ect. Section 59-5- 1 0 I (7) provides, in pertinent part, that:
"Enhanced recovery project" means: (a) the injection of liquids . . .
directly into a reservoir for the purpose of: (i) augmenting reservoirenergy; (ii) modiffing the properties of the fluids or gases in a reservoir;or (iii) changing the reservoir conditions to increase the recoverable oil,gas, or oil and gas through the joint use of two or more well bores; and(b) a project initially approved by the board as a new or expandedenhanced recovery proj ect on or after January I , 1996 .
Section 59-5-1 0 1 (9) provides that:
"Incremental production" means fhatpart of production, certified by theDivision of Oil, Gas and Mining, which is achieved from an enhancedrecovery project that would not have economically occurred under thereservoir conditions existing before the project and that has beenapproved by the division as incremental production.
30. The enhanced and secondary operations for the ULT Waterflood Project
quali$' as operations of an enhanced recovery project for purposes of Section 59-5-102(7) ofthe

Utah Code.
31. The Division supports granting Crescent Point's Request'
32. The Board voted unanimously (7-0) to approve Crescent Point's Request.
CONCLUSIONS OF LAW
L Due and regular notice of the time, place, and purposes of the Board's
regularly scheduled December 10,2014 hearing was given to all interested parties in the form and
manner and within the time required by law and the Rules and Regulations of the Board. Due and
regular notice of the filing of the Request was given to all interested parties in the form and manner
and within the time required by law and the Rules and Regulations of the Board.
2. The Board has jurisdiction of the parties and subject matter of Crescent
Point's Request pursuant to Sections 40-6-5,40-6-7,40-6-8, and 59-5-102 of the Utah Code and has
the power and authorþ to make and promulgate the order herein set forth.
3. Crescent Point's proposed cooperative development and enhanced and
secondary recovery operations in the Green River and'Wasatch formations as introduced, adduced,
and admitted as evidence at the December 10,2014 hearing, are in the public interest and will
promote conservation, will increase ultimate recovery, will prevent waste, and will protect
correlative rights.
4. Crescent Point's proposed cooperative development and enhanced and
secondary recovery operations for the Expanded ULT Waterflood Project are reasonably necessary
to fulfill the purposes of Chapter 6 of Title 40 of the Utah Code.
5. The proposed water-injection operations based on a 4O-acre five-spot
injection pattern using a well grid utilizing 2}-acre spacing are reasonable and satis$r the purposes
of the well location and siting rules (RulesR649-3-2 and R649-3-3, U.A.C.) with respect to the
proposed operations.

6. The plan of cooperative development and operations, as adduced at the
hearing and as shown in the geology and engineering data contained in the Exhibit Binder, as
supplemented, will accomplish the goals of the Expanded ULT V/aterflood Project.
7. Crescent Point has sustained its burden of proof, demonstrated good cause,
and satisfied all legal requirements for granting the Request.
8. It is necessary andproper under the circumstances to vacate the Prior
Spacing Orders to the extent they affect the Subject Lands in the N% of subject Section 35 to allow
Crescent Point to implement its proposed plan of cooperative development and operations for the
Subject Lands and minerals.
9. Good cause appears to certifr the Expanded ULT Waterflood Project as an
enhanced recovery project for the purposes of Section 59-5-102(7) of the Utah Code.
ORDER
Based upon the Request, the testimony and evidence submitted and entered at the
December 10,2014 hearing, and the findings of fact and conclusions of law as stated above, it is
therefore ordered that:
1. Crescent Point's Request seeking approval of the Expanded ULT
'Waterflood Project is granted.
2. The Green River and Wasatch formations, defined as follows:
The Green River and Wasatch formations as identified by the logs run onthe Crescent Point ULT #12-36-3-lE Well located in the NV/%S'W% ofSection 36, Township 3 South, Range 1 East, U.S.M., Uintah County,rJtah, with the top of the stratigraphic interval being found at a depth of5,725 feet below the surface (-637' subsea) and the base of the intervalbeing found at a depth of 7,900 feet below the surface (-2,800' subsea) orstrati graphic equivalent thereof

underlying the lands in Uintah County, Utah, collectively named the Expanded ULT
'Waterflood Project described as follows:

constitutes a pool for the operation of the Expanded ULT Waterflood Project and the Board
hereby establishes the same as a pool to be operated cooperatively for the continued
operation of all wells thereon. The lands and pool shall be known as the Expanded ULT
V/aterflood Proj ect Area.
3. The cooperative development hereby established shall be known as
the Expanded ULT Waterflood Project.
4. The Green River and V/asatch formations, as defìnedinparagraph2
of this Order, constitute a pool for the operation of a waterflood enhanced and secondary
recovery project, and the Board hereby establishes the same to be operated as a cooperative
pool for enhanced and secondary recovery operations.
5. The plan of development and operations, as introduced and adduced
at the December 10,2014 hearing and as shown in the geology and engineering data
contained in the Exhibit Binder, as supplemented, is hereby approved.
6. Pursuant to Section 40-6-8(4) of the Utah Code, the Proceeds Allocation
Agreement admitted as the Second Supplement to Exhibit B shall be binding upon all owners of
working interest and all owners of lessor's royalty and other leasehold burdens within the Expanded
ULT V/aterflood Project Area as authorized by Utah Code Annotated $$ 40-6-7 and 40-6-8,

because more than 70 percent of those owners have approved in writing the plan for cooperative
development and operations approved and prescribed by the Board and the Division.
7 . The Prior Spacing Orders are hereby vacated to the extent they affect the
Subject Lands.
8. The Expanded ULT Waterflood Project is certif,red as an enhanced recovery
project for purposes of the severance taxrate reduction pursuant to Section 59-5-102(7) of the Utah
Code.
9. The 4O-acre five-spot injection pattern using a well grid utilizing 2}-acre
spacing as approved by this Order satisfies the purposes of the general well location and siting rules,
Rules Pt649-3-2 and R649-3-3, U.A.C., affecting the Subject Lands and formations, and such rules
are suspended to the extent they are inconsistent with the operations approved by this Order.
Subject to Paragraph 11 of this Order and a showing that a well location will protect correlative
rights and prevent waste, the Division is authorizedto approve well locations within the Expanded
ULT V/aterflood Project Area where such locations promote conservation and increase the ultimate
recovery of oil or gas; provided however, no future well shall be located closer than 460 feet from
the boundary of the Expanded ULT Waterflood Project Area without administrative approval of the
Division in accordance with the well exception location requirements of Rule R649-3-3, U.A.C. In
the event that the project area is contracted or terminated, the land not remaining within the project
area shall be once again subject to well location requirements.
10. The underground injection program proposed by Crescent Point in
connection with the enhanced and secondary recovery project is hereby approved.
I 1. This Order does not waive jurisdiction of the Board over the Underground
Injection Control (UIC) program with respect to the injection wells contemplated for the Expanded

ULT V/aterflood Project Area, and expressly directs Crescent Point to comply with all requirements
and procedures of the UIC program administered by the Division.
12. Pursuant to Utah Administrative Code R641 and Utah Code Arm. $ 63-46b-6
to -10 (1953, as amended), the Board has considered and decided this matter as a formal
adjudication.
13. This Findings of Fact, Conclusion of Law and Order ("Order") is based
exclusively on evidence of record in the adjudicative proceeding or on facts offrcially noted, and
constitutes the signed written order stating the Board's decision and the reasons for the decision, all
as required by the Utah Administrative Procedures Act, Utah Code Ann. $ 63-46b-10 and Utah
Administrative Code R64 1 - I 09.

Request Board Reconsideration: As required by Utah Code Ann. $ 63-46b-10(e) to -10(g) (1953, as
amended), the Board hereby notifies all parties in interest that they have the right to seek judicial
review of this hnal Board Order in this formal adjudication by filing a timely appeal with the Utah
Supreme Court within 30 days after the date that this Order is issued. Utah Code Arìn.
$ 63-46b-14(3Xa) and -16 (1953, as amended). As an alternative to seeking immediate judicial
review, and not as a prerequisite to seeking judicial review, the Board also hereby notifies parties
that they may elect to request that the Board reconsider this Order, which constitutes afnal agency
action of the Board, Utah Code Ann. $ 63-46b-13, entitled, "Agency review - Reconsideration,"
states:
(lXa) Within 20 days after the date that an order is issued for whichreview by the agency or by a superior agency under Section63-46b-12 is unavailable, and if the order would otherwise constitutefinal agency action, any party may file a written request forreconsideration with the agency, stating the specif,rc grounds uponwhich relief is requested.

(b) Unless otherwise provided by statute, the filing of the request isnot a prerequisite for seekingjudicial review ofthe order.(2) The request for reconsideration shall be filed with the agency andone copy shall be sent by mail to each party by the person makingthe request.(3)(a) The agency head, or a person designated for that pu{pose,shall issue a written order granting the request or denying the request.(b) Ifthe agency head or the person designated for that purpose doesnot issue an order within 20 days after the filing of the request, therequest for reconsideration shall be considered to be denied.
Id. The Board also hereby notifies the parties that Utah Administrative Code R641-110-100, which
is part of a group of Board rules entitled, "Rehearing and Modification of Existing Orders," states
Any person affected by a final order or decision of the Board mayfile a petition for rehearing. Unless otherwise provided, a petition forrehearing must be hled no later than the 10th day of the monthfollowing the date of signing of the final order or decision for whichthe rehearing is sought. A copy of such petition will be served oneach other parly to th. pro...ding no later than the 15h day ofthatmonth.
Id, See Utah Administrative Code R641-110-200 for the required contents of a petition for
rehearing, If there is any conflict between the deadline in Utah Code Ann $ 63-46b-13 (1953, as
amended) and the deadline in Utah Administrative Code R641-110-100 for moving to rehear this
matter, the Board hereby rules that the later of the two deadlines shall be available to any party
moving to rehear this matter. If the Board later denies a timely petition for rehearing, the parly may
still seek judicial review of the Order by perfecting a timely appeal with the Utah Supreme Court
within 30 days thereafter.
15. The Board retains continuing jurisdiction over all the parties and over the
subject matter of this Cause, except to the extent said jurisdiction may be divested by the filing of a
timely appeal to seek judicial review of this Order by the Utah Supreme Court.
16, For all pulposes, the Chairman's signature on a faxed copy of this Order
shall be deemed the equivalent of a signed original.
