State and Federal actions will affect and be affected by implementationof the LWRP. Under State law and the U.S Coastal Zone Management Act,certain State and Federal actions within or affecting the local waterfrontarea must be "consistent ll or lIconsistent to the maximum extent practicablell

with the enforceable policies and purposes of the LWRP. This consistencyrequirement makes the LWRP a unique, intergovernmental mechanism forsetting policy and making decisions and helps to prevent detrimentalactions from occurring and future options from being needlessly foreclosed.At the same time, the active participation of State and Federal agencies isalso likely to be necessary to implement specific provisions of the LWRP.

The first part of this section identifies the actions and programs ofState and Federal agencies which should be undertaken in a mannerconsistent with the LWRP. This is a generic list of actions and programs,as identified by the NYS Department of State; therefore, some of theactions and programs listed may not be relevant to this LWRP. Pursuant tothe State Waterfront Revitalization and Coastal Resources Act (ExecutiveLaw, Article 42), the Secretary of State individually and separatelynotifies affected State agencies of those agency actions and programs whichare to be undertaken in a manner consistent with approved LWRPs.Similarly, Federal agency actions and programs subject to consistencyrequirements are identified in the manner prescribed by. the U.S. CoastalZone Management Act and its implementing regulations. The lists of Stateand Federal actions and programs included herein are informational only anddo not represent or substitute for the required identification andnotificat.ion procedures. The current official lists of actions subject toState and Federal consistency requirements may be obtained from the NYSDeparement of State.

The second part of this section is a more focused and descriptive listof State and Federal agency actions which are necessary to furtherimplementation of the LWRP. It is recognized that a State or Federalagency's ability to undertake such actions is subj ect to a variety offactors and considerations; that the consistency provisions referred toabove, may not apply; and that the consistency requirements can not be usedto require a State or Federal agency to undertake an action it could notundertake pursuant to other provisions of law. Reference should be made toSection IV and Section V, which also discuss State and Federal assistanceneeded to implement the LWRP.

B. FEDERAL AND STATE ACTIONS AND PROGRAMS NECESSARY TO FURTHER THETOWN OF IRONDEQUOIT'S LWRP

Several of the policies and projects incorporated intoIrondequoit's Waterfront Revitalization Program will be implementedthrough the local actions described in Section V. These localactions consist, for the most part, of the adoption of extensivechanges to the Town's ordinances and zoning map, which willencourage appropriate waterfront development and protect thesensitive environmental features of the shorezone.

There are, however, a number of specific actions which must be takenby either New York State or the Federal Government in order torealize all of the Program's objectives.

T. STATE ACTIONS

a. Office of Parks, Recreation and Historic Preservation

'Ie In conjunction with the Bay opening project,development of public, water-oriented facilitiesincluding: a boat launch, parking lot, and comfortstations.

Creation of a natural, passive park of State-ownedland at the northwest corner of Irondequoit Bay, andlease of a portion of the site for the p.rivate

The TownBoard strongly favors the construction of such acrossing as evidenced from several solutions adoptedby it. indicating the intention and support in favorof the bridge, dating back to 1980.

* If the Route 18 bridge is not replaced, constructionby the State of north-bound ramps connecting theIrondequoit Bay bridge (Route 104) with the SeaBreeze Expressway (Route 590). The Town is stronglyopposed to the design of the ramps as presentlyplanned with southbound traffic exiting at TitusAvenue!Seabreeze Espressway intersection because ofits impact on the residential neighborhoods. Analternate design with wouth sound exit to Ridge RoadEast is preferred by the Town.

In addition, the State should prepare anEnvironmental Impact Statement (E. 1.5.) and hold apublic hearing on the same before taking any action.

* Provision of funds to the Town of Irondequoit withwhich to implement portions of its approved LWRPincluding. but not limited to. funds for mapping newzoning and overlay districts, staff and boardtraining. adoption of water surface use legislationfor Irondequoit Bay, provision of staff support formonitoring LWRP projects and activities.

d. Department of Environmental Conservation

* Implementation and administration of Article 24 ofthe State's Environmental Conservation Law forIrondequoit's wetlands areas.

* Final mapping, adoption, and administration of theState's Section 505 Coastal Erosion Controllegislation.

* After termination of the Newport Road Landfill.inspection of the site to determine its suitabilityfor use as a passive recreation facility.
