WHEREAS the Union and the Employer are desirqus .. of establishing a form of standard collective agreement with respect. to employees engaged in work; within the geographical area defmed herein so as to provide uniform interpretation, application and administration of th~ . relationship established.

IT IS EXPRESSLY AGREED AND DECLARED BY AND BETWEEN THE PARTIES HERETO AS FOLLOWS:

ARTICLE 1- DURATION OF AGREEMENT

1.01 This Agreement shall become effective on the 1st day of February 2013, and shall continue in force from year to year thereafter unless either party shall furnish the other with notice of termination} or proposed revision of this Agreement within ninety (90) days bef9re the 30th day of April, 20 18 or in a like period of any year thereafter. . . · .

ARTICLE 2- RECOGNITION

2.01 The Employer recognizes the Union as the exclusive bargaining agent for all construction labourers in the employ of the Respondent and all employees of the Respondent engaged in the operation of trucks, cranes, shovels, bulldozers and similar equipment and those primarily engaged in the repair and maintenance of same, the installation, adjustments or removal of traffic barriers and traffic barriers and traffic control in the Counties of Chatham/K.ent, Middlesex, Huron, Bruce, Perth, Oxford, Elgin and Lambton. Work in the City of London, excluding the Provincial Highway system shall be performed in accordance with the terms and conditions of the Labourers' Provincial Civil Engineering Agreement. Work in the City ofSamia, excluding the Provincial Highway system shall be performed in accordance with the tenns and conditions of the Labourers' Provincial Civic Engineering Agreement. · ·

2.02 The Employer agrees to employ only members of the Union in good standing and the Union agrees to give the Employer preference in supplying qualified and competent personnel for such work.

ARTICLE 3 ~ UNION SECURITY

3.01 Except for the gravel pit operation, the Employer agrees that whenever he requires additional personnel to perform work covered by this Agreement he shall, Subject to Article 3.05 below, call the Union office for his requirements in the area where the work is to be performed.

3.02 If the Union cannot supply qualified and competent perSODJ;lei within twenty-four (24) hours (excluding Saturdays, SlUldays, and Holidays) the Employer may hire from any source available to him. Any request made after 2p.m. shall not be considered a part of the twenty-four (24) hours for supply. ·

3.03 All personnel hired shall be required to have a clearance c;rrd issued by the Union before they start work, unless o~er arrangements are made with the Union dispatcher. Such clearance card will not be unreasonably withheld.

3.04 All employees working under this Agreement shall beconie members ofthe Union within ten (10) days and maintain their membership in good standing or be replaced. · · ·

3.05 (a) The Employer shall have the prerogative when adding to its working force, to first rehire former regular employees who have · maintained their membership in the Union and have been employed by the Employer during the preceding twenty-four (24) months. Such employees shall be cleared by the Union.

(b) The Employer may request any one of Local 625, 1059 or 1089's unemployed members. Such members must provide a referral slip from the Union before comtp.en~ing employment. · ·

3-.06 Contracting Out

The Employer agrees to maintain the status quo by performing the same portion of the work covered by this agreement with it's employees in the bargaining unit as it has in the past.

The Employer further agrees to hire contractors and sub~ · contractors who are in contractual relations with the union conditional on competitive pricing, capabilities of performing the work and availability. The Employer shall be the sole judge in meeting this criteria. Trucking and grading is not part of this clause.

3.07 The Employer agrees to remove any subcontractor in violation of Section 3.06 upon written notification from the Union Representative.

3.08. (a) The Employer in accordance with Articl~ 3.03 shaU have complete mobility of its regular employees in areas covered by Article 2.0 I

(b) The Employer may request an apprentice from Local 62S, 1059 or 1089's (if available). The Employer agrees to follow .the apprenticeship schedule. of the applicable Local. ..•... : .

(e) Working dues shall be deducted in accordance with this collective agreement and the employer shall remit those working dues to the Local Union having geographic jurisdiction for the work.

ARTICLE 4- MANAGEMENT RIGHTS

4.01 The Union agrees and acknowledges that the Employers have the exclusive right to manage the business, and to exercise such right without restriction, save and except such prerogatives of management may be specifically modified by the terms and conditions of this Agreement.

Without restricting the generality of the foregoing paragraph, it is the exclusive function of the Employer:

(a) To determine qualifications, classify, transfer, hire, direct, promote, lay off, discipline and discharge employees for just cause and to increase or decrease working forces, in accordance with the tenns of this Agreement. · ·

After a reasonable training period, if the worker has acquired the skills required for the position, the wage rate for the classification will be paid while the worker is in that position.

(b) To determine materials to be used, design of the products to be handled, facilities and equipment required, scheduling of work and location of equipment.

4.02 The Employer recognizes that the employee and. the Uni~n . have recourse through the grievance procedure if they feel :tliat. fue · Employer has exercised any of the foregoing rights contrary to th~ ·i~Iins of this Agreement; and further that discipline ·and discharges sha.ii ocly be . exercised for just cause. ·

ARTICLE 5 - GRIEVANCE PROCEDURE

5.01 There shall be an earnest effort on the part of botl1 pam~s t~: this Agreement to settle promptly through the procedure set out herein, any complaints, grievances or disputes arising from the inte!]lrefation, . · application or administration of this Agreement. ·

5.02 It is understood and agreed that an employee does not have a grievance until he has discussed the matter with his foreman. or other supervisory personnel acting in this capacity and given him an opportunity of dealing with the complaint. His decision shall be made known to said employee within forty-eight ( 48) hours.

Grievances properly arising under this Agreement shall be adjusted and settled as follows:

Step 1 - Within ten (l 0) days after the circumstances giving rise to the grievance, the aggrieved employee, with or without a Union Representative, shall present his grievance in writing to the Official of the Employer named by the Employer to handle grievances at this step. If a settlement satisfactory to the Union and the employee concerned . is not reached within five (5) full working days, a grievance may be presented as indicated in Step 2 at any time within five (5) full working days thereafter.

Step 2 - At this step the grievance may be processed as an individual, joint, Employer or Union grievance and shall be presented in writing by a Union Steward or Representative to the Company Official assigned to handle written grievances.

5.03 All grievances to be dealt with under Step 2 above shf!]l be in· .. writing on a form supplied by the Union and signed by the empi~yee having such grievance. · · ·

5.04 The Employer shall designate and name the Official to whorp. a written grievance is submitted at Step 2. · · ·

5.05 Written grievances to be valid shall set out the natur~ of the . grievances; the Article or Articles of the Agreement alleged to have been. violated and the nature of the remedy sought and shall not be subj.ect .to change at later steps except by mutual agreement in writing with .the Employer, or in the case of remedy, by an Arbitration Board. · ·· ·

5.06 In determining the time which is allowed in the various. steps. Saturday, Sunday and Statutory Holidays shall be excluded and any ti~·e limits may be extended by mutual agreement in writing. ·

5.07 If advantage of the provisions of Articles 5 and 6 hereof i.s not taken within the time limits specified therein or as extended in writing as set out above, the grievance shall be deemed to have been abandoned and. may not be reopened. It is understood that Subsection 44( 6) of the Labour Relations Act, as amended from time to time, does not apply.

5.08 Notwithstanding the above, a grievance concerning wages and fringe benefits may be presented within thirty (30) days after the circumstances giving rise to the grievance occurred or originated and further provided that a grievance concerning welfare or pension contributions may be presented within thirty (30) days after the particulars of such grievance should reasonably have become known to a Union Representative. It is understood that Article 5.07 applies to grievance filed under Article 5.08.

ARTICLE 6- ARBITRATION

6.01 The parties to this Agreement agree that any grievance concerning the interpretation or alleged violation ofthis Agreement which has been properly carried through all the steps of the grievance procedure outlined in Article 5, which has not been settled will then be referred to arbitration at the request of either of the parties hereto. The arbitration procedure incorporated in this Agreement shall be based on the use of a sole Arbitrator. ·

6.02 Within five (5) working days of the request by either party fpr arbitration, the party requesting arbitration shall notifY the other p·artj, in writing, of the names of suggested sole Arbitrators. Withiri. f!.ve (5) working days thereafter, the other party shall answer in writing indi"cating agreement of the suggested sole Arbitrators or failing such an agree1'!1ent the names of alternate suggested sole Arbitrators. · · ·

6.03 Should the Union and the Employer fail to agree on a sole Arbitrator within five (5) working days of last notification mentioned above, the Minister of Labour of the Province of Ontario will be asked to. appoint an Arbitrator.

6.04 The decision of the Arbitrator shall be binding on the parties of this Agreement. · · ·

6.05 The Arbitrator shall not have any power to alter or change any of the provisions of this Agreement or to substitute any new provisions for any existing provisions, nor to give any decision inconsistent with the tenns and provisions of this Agreement. · · · ·

6.06 Each of the parties of this Agreement will jointly bear the expenses of the Arbitrator. ·

ARTICLE 7 ~NO STRIKE, NO LOCKOUT

7.01 In view of the grievance and arbitration procedures provided in this Agreement, it is agreed by the Union that there shall be no strike, picketing, slowdown or stoppage of work, either complete or partial and the Employer agrees that during the terms ofthis Agreement, there.shall be no lockout.

ARTICLE 8 ~UNION REPRESENTATION

8.01 The Union Representative, in the course of his duty, shall have access to work areas on which members of the Union are employed. The Union Representative shall make his presence known to the Employer's senior representative or his delegate. In no instances, however, shall he interfere with the progress of the work.

8. 02 It is agreed that the Union may appoint to a maximum of one (1) steward per crew from among employees within the bargaining unit

8.03 Considering the nature of the work to be performed, the Steward shall be one of the last two (2) employees covered under the terms

8.04 The Steward or Stewards, where possible, will be respon~jblt;J for reporting any complai,nts or grievances to the Employers arid to the Union so that these may be dealt with in the proper manner and without undue delay.

ARTICLE 9 - JURISDICTIONAL DISPUTES

9.0 l In case of a jurisdictional dispute which cannot be .. s.~ttJ.ed to the satisfaction of all parties concerned, such dispute shall only be processed as a complaint under Section 99 of the Ontario Labour Reiation~ Act. In the meantime, work will continue as assigned to the L!:t.Jlourers.by the Employer unless. otherwise directed by the Ontario Lal:JOur Re~ations. Board. ·

ARTICLE 10- SAFETY, SANITATION AND SHELTERS

10.01 In cooperation with the Employer's overall program of accident control and prevention, the Steward or any employee shall report to the foreman for immediate investigation, an alleged unsafe condition, unsafe acts or violations of safety regulations for correction, if requiTed.

10.02 Employees shall be provided with adequate protection from falling material and other hazards on the job, in accordance with the appropriate Safety Acts. Adequately heated enclosures or cabs for workers operating equipment shall be provided where reasonably required. Gravel Division employees shall be provided with lunchroom and washroom facilities. Traffic control persons and all other workers wiil be provided with adequate time for washroom and lunch breaks. Acc~ss to washroom facilities will be provided on aU jobs.

10.03 Other than footwear, personal protective equipment such as rain gear, safety glasses, hearing protection, safety vests and other protective apparel as deemed necessary by the Ministry of Labour, required under all conditions or during inclement weather, will be supplied by the Employer. One hundred ($100.00) CSA approved safety boots or clothing allowance shall be given once per year to each Employee who has accumulated twelve (12) months service with the company. Proof of purchase to be supplied by the employee. ·

10.04 The Employer agrees to replace or insure any o~ -~ltooi.s brought on the job at his request for the purpose of maintenance _and .r~pair . of equipment, if an inventory of the tools is given to the Employer, on. employment by the employee, all deletions and additions will be.recc)rded as they occur. This provision only applies to tools that are stol~,n or I~st due to fire. · · . :

10.05 If an employee is injured and receives medical attentj0n by a . qualified physician, he will receive his regular wages and other benefits for the full day if in the opinion of the physician he is unfit to ret.urn ·to. the . regular work or if instructed by his foreman or superintendent, another employee is required to leave the job site with the injured emp~oyee ~o assist him in getting medical attention, he too shall be paid his ·regul!lr wages and other benefits for any lost time incurred. · ··

The Union office and the Employer shall be notified immediately of a lost time accident to an employee.

10.06 Light Duty - Subject to his physician's approval, an employee will return to light duties if available as soon as possible at his. regular wages.

ARTICLE 11- PAYMENT OF WAGES AND LAY OFF

11.01 (a) Wages shall be paid by cash or cheque at the option of the Employer and no later than Friday of each week during the working hours . based on past practice. · ·

(b) Accompanying each payment of wages shall be a stat~ment identifying both the ·

Employer and the employee showing total hours marked "regular" and "overtime," the total earnings, the rate of pay, the amount of each deduction, the purpose thereof, and the net earnings, and the amount of vacation pay.

(c) If the Employer fails to pay an employee(s) the correct amount of hours and where the error is eight (8) hours or more, the Employer shall provide the employee with a new cheque for the missing wages no later than the ne.h."t working day.

11.02 In the case of lay off, all employees shall receive cheques, EI record of employment certificates, by regular mail to his last known address within a maximu111 of five (5) working days following the week of

lay off: Such five (5) working days does not include Saturdays, sunday~ .or . :. holidays. Notwithstanding the above, the Employer will hold all. ·cheque~·· and documents for twenty· four (24) hours so that the_ employees :i:nay pick them up. Notification to, or attempted notification of lay off~ to. a).l employee on a Saturday, Sunday or holiday~ shall not be consiq.ered proper.·· notice unless the employee is working on such days. · · · . ·

_ When laid-off, employees shall be allowed sufficient tilne to . clear up their personal and company property on the job site.

When employees who are laid-off .are not paid up to d~:~.te on the job site and should the Employer fail to send such w~ges · ai;I<:llor employment records as stated above, the Employer shall pay eight (8) hou~s pay at the regular hourly rate for each additional regular working day the employee is required to wait for his pay and records after giving such notice to the Employer and giving him four ( 4) hours to correct. such default. ·

11.03 In the event of a reduction of the working force, the Employer shall first lay off all probationary and student employees, except Traffic Controllers, who have not become members of the Union; secondly. to apply the principle of "last-one-on - first-one-off>' in so far as it is consistent to an efficient working force. This provision does not apply to working foremen. · · ·

I 1. 04 One (1) hour notice, or pay in lieu of notice, shall be given by the Employer when an employee is temporarily laid-off or discharged.

ARTICLE 12- HOURS OF WORK AND OVERTIME

12.01 The normal working hours for all employees shall be fifty­five (55) hours per week. This shall not be construed to be a guarantee as to the hours of work per week. The workweek shall commence on Monday. Hours in excess of fifty-five (55) hours in a week shall be paid at the rate oftime and one·half(11/2).

All work performed on Saturdays shall be paid at one and one-halftimes (1 Vz) times the regular rate.

12.02 No employee will be refused work as a result of working fifty-five (55) hours in a week, provided there is work available. If no work is available, Article 11.03 will apply.

Second Shift- Will commence between 12:00 noon .and 5: 59 p.m. Monday to Friday. Regular rates of pay, plus fifty cents ($0.50) per hour shall be paid. Overtime and wages shall be paid in accorP.ance with Article 12. · · ·

Third Shift - Will commence between 6:00 p.m. and 12:00 midnight Monday to Friday. Regular rates of pay, plus sixty cents ($0.60) per hour shall be paid. Overtime and wages shall be paid in accordance with Article 12. · ·

Shift premiums are not applicable to watchmen.

The Employer will meet with the Union prior to shift work being implemented on any job site.

13.02 (a) Any employee who reports as usual for work under this provision, unless directed not to report the previous day by his Employer, shall receive a minimum oftwo (2) hours pay.

(c) Meal break- No employee will be required to work more than five (5) consecutive hours without a meal break. Work break is.to :be ten (10) minutes duration midway in each half shift or as designat~d by management. Wherever possible this work break must be taken at the workstation. (d) In the event that any employee is called. back for work of an emergency nature after. completion of his regular shift, he shall be guaranteed a minimum of four ( 4) hours pay at the applicable rate~ .

ARTICLE 14 ~TRAVEL TIME AND LIVING ALLOWANCE

14.01 (a) Forty (40) kilometres free zone from Huron's shop, 10785 Pinehurst Line, and from City Hall in London, and from City l:Iall in Sarnia; for Local 625, Local 1059 and Local 1089 Members respectively. (To be known as "HOME BASE" for each Local). ·

(b) From forty (40) kilometres to one-hundred (100) kilometres from HOME BASE, one (1) hours pay per day at the highest skilled employee,s regular hourly rate. When the Employer requires the employee to be out of town, the Employer will provide a living allowance as set out in 14.01 below.

(c) i Beyond one hundred (100) kilometres from HOME BASE, a minimum of seventy-two dollars ($72.00) per day room or the cost of reasonable accommodation. ·

ii Beyond one hundred (100) kilometers from HOME BASE, where the Employer provides a room at the Employer cost, a meal allowance of thirty-six dollars ($36.00) per day.

(d) All kilometers in this Article wjll be calculated by using the most direct automobile route.

(e) Beyond two hundred and fifty (250) kilometres from HOME BASE, when one (1) day off work is allowed per week, the living allowance as set out in Article 14.01(c) will be p_aid for the additional day.

ARTICLE 15- STUDENTS

15.01 When the Employer desires to hire students during the S'?hool vacation period, the Union will give the students clearancel · ··It is understood that the ratio will be one (1) student for every seven (7) regular employees. In the event of lay off, students shall be laid~off :fir~t. Students shall become a member of the Union after one (I) season. and shall pay the initiation fee (fifty [50%] percent of regular initiati(!n fee) and pay Union dues, and will receive wages at the rate of not less than fifty (50%) percent of their classification. Benefit coverage payment shall beat the option of the Employer. It is understood that at the end of. ~e ·school vacation period, the student can be terminated at their Employer's discretion. · ·

ARTICLE 16- UNION DUES CHECK-OFF

16.0 1 The Employer agrees that all regular employees to whom this Agreement applies, shall as a condition of continued employment be and remain members of the Union during the term of this Agreement. Each employee member of the Union and each seasonal and such casual employee liable to pay dues under this Article shall authorize the Employer to deduct Union dues in the amount as may be detennined by the bylaws of the Local Union and also application fees if required and remit such monies deducted to the office of the Local Union not later than the fifteenth (15th) day of the month following that in which the dues were deducted or mutually agreed to otherwise.

ARTICLE 17- WORKING DUES ASSESSMENT

17.01 The Employer shall deduct from each employee for each hour worked, the amounts as stipulated in Appendix A, B and C and submit same to the Local Union by the fifteenth (151

h) day ofthe month following said deductions for working dues, OPDC dues, Organizing and Tri-Fund.

VACATION PAY & STATUTORYHOLIDAYPAY

17.04 Shall be at the rate of eight per cent (8%), to include four per cent (4%) in lieu of statutory holidays. To be paid weekly.

17.05 The Employer will make its best effort to accommodate the employees' vacation requests pending consideration of the time of yecq-, volume of work, circumstances, and nature of request.

ARTICLE18-BEREAVEMENTPAY

18.01 The Employer will grant up to three (3) paid days, if required, based on ten ( 1 0) hours per day, at regular hourly rate, to those employees with three (3) continuous years of employment with the Employer ifdeath occurs while working as follows. · · · ·

Upon notification, the Employer shall grant three (3) ·days leave of absence with pay to attend the funeral of a member of his immediate family. By immediate family it is meant spouse, son, daughter, mother, father. ·

CONTRIBUTIONS

20.0 I Deemed assignment of compensation under the Ern.ploym(mt Standards Amendment Act, 1991. · · ·

The Trustees of the employee benefit plans referred to in this Collective Agreement shall promptly notifY the Union (or Council) of the failure by any Employer to pay any employee benefit contributions reqUired to be made under this Collective Agreement and which are owed under the said plans in order that the Program Administrator of the Employ~e ·Wage Protection Program may deem that there has been an assignment of compensation under the said Program in compliance with the Regulation to the Employment Standards. Amendment Act~ 1991 in relation. to the Employee Wage Protection Program and this Article is for the sole purpo~e of Ont. Reg. 590/91 under the Employment Standards Act. ·

Any Provincial or Federal taxes required to be paid by the Employer on contributions under this Agreement are not included in the . specified amounts set out herein.

20.02 The Employer agrees to deduct an amount, as authorized by the employee and directed by the Local Union, per hour worked on a weekly basis from each employee's weekly gross wages, payable to a Group RRSP as directed in writing by the Union. Such monies shall be remitted to the Local Union by the fifteenth (15th) day of the month following said deduction. The Union may within thlrty (30) days written notice to the Employer, amend the amounts of contributions for pension, welfare or training and deductions for union dues or G.RS.P., Legal, but any such adjustment shall not affect the total wage package.

Effective February 1, 2015 fifty cents ($0.50) per hour earned. Effective February 1, 2016 fifty-five cents ($0.55) per hour earned. These contributions shall be sent directly to the Union Local 1089 by the fifteenth .(15th) day of the month following the previous month.

It is further agreed that the Union will solely trustee the training fund with Union trustees.

The Employer agrees that all welfare and dental, pension and training fund contributions will be made payable on separate cheques to Local 1089 for distribution to the various funds.

1. The parties agree that this Leiter of Understanding fonns part of the Collective Agreement between them. ·

2. The Collective Agreement does not apply to the Repair Shop.

3. Where the Employer is unable, without obtaining additional equipment, to comply with Article 3.06 due to a temporary expansion of its business, the parties shall meet to discuss the same and the Union shall not unreasonably deny the Employer the option of temporarily contracting out work in excess of that permitted by Article 3 .06.

4. The travel hours paid pursuant to Article 14.01 are not to be considered as hours worked for any purpose including for the purposes of Article 12. ·

The exceptions to this understanding are the following:

All work awarded by Public and Private Authorities (the Provin~e of Ontario, County and Municipal Authorities in the .ind!J.Strial, commercial and institutional sector) including all surface. treating, maintenance work, spraying operations, scarifying, pulverizing, calcium treatment, slurry seal, waterproofing, patching, includjng utility cut work and grinding, other than structures, asphalt and concrete work. ·

This Memorandum of Agreement shall be effective from March 20, 2001.

It is expressly agreed that this Memorandum of Agreement shall not be used against the Employer in any proceeding before the Ontario· Labour Relations Board as an admission of associated or related activities under Section 1(4) ofthe Ontario Labour Relations Act and shall not be construed as a Collective Agreement, Bargaining Agreement or as a Voluntary Recognition of the Union, other than for the enforce111ent am;i the applicability of this Memorandum.
