Foreword

This booklet gives brief account of the various concession and facilities

which have been extended by Himachal Pradesh Government and the Central

Government to the Freedom Fighters and their dependent , from time to

time. It will enable the Freedom Fighters and their dependents of the State

to know various benefits they are entitled to and avail themselves of the

same. It is hoped that the information contained in this booklet will be

found useful by the Freedom fighter particularly their dependents and for all

those dealing with the matters pertaining to the Freedom Fighters

dependents.

ORDER

The Lieutenant Governor, Himachal Pradesh is pleased to create a

Charitable Fund to provide relief to the persons of Himachal Pradesh domicile or

the families of those persons, who suffered during or on account of the struggle for

the national liberation, and are not in a position to make their both ends meet due to

loss of health by harassment or incarceration, loss of professions or loss of property.

2. The fund, will, for the present, be called the Himachal Pradesh

National Workers Relief Fund and administered by a committee consisting of :-

i) Chief Secretary to Government , Himachal Pradesh.

ii) Finance Secretary to Government, Himachal Pradesh.

iii) Joint Secretary (Home) to Government, Himachal Pradesh.till a detailed scheme for its operation under the Charitable Endoments Act, 1890,

has been finalized.

NOTIFICATION.

It is hereby notified that, on a joint application made by the Chief

Secretary, Finance Secretary and Joint Secretary(Home) to Government of

Himachal Pradesh, in their personal capacity as Administrators of the Himachal

Pradesh National Workers Relief Fund, the Lieut Governor, Himachal Pradesh is

pleased, in exercise of the powers conferred by sub-section(1) of Section 5 of the

Charitable Endowments Act, 1890 (Act No. VI of 1890), to settle the scheme set

forth below for the administration of the property to be vested in the Treasurer of

Charitable Endowments Himachal Pradesh vide Himachal Pradesh Government

Notification No. 10-2/66-GAD-I of even date.

SCHEME FOR THE UTILISATION OF THE HIMACHAL PRADESH

NATIONAL WORKERS RELIEF FUND.

1. Definitions : (a) Beneficiary Unless the context otherwise requires

beneficiary means a person of Himachal Pradesh domicile who is poor, destitute

and needy, and in particular, who has suffered, during or on account of the struggle

for the National liberation, loss of health by harassment or incarceration, loss of

profession or loss of property.

(b) Dependents shall mean the wife and direct descendants of the

beneficiary and any other person who, in the opinion of the Himachal

Pradesh National Workers Relief Board, hereinafter referred to as the State

Board is or was wholly or partly dependent on the beneficiary.

(C) The Fund shall mean the Himachal Pradesh National Workers Relief

Fund.

2. The objects of the scheme are as follows :-

(a) To receive from the Central Govt., H.P. Govt. and other State Govts.

Contributions in the shape of grants to the Fund.

(b) To collect private contributions and donations for the Fund.

(c) To defray all proper costs, charges and expenses.

(d) To do all such other things as are incidental or conducive to the

attainment of objects mentioned above or any of them or to the

carrying out of this scheme.

(e) To apply the corpus and/or income of the Fund for the benefit of the

beneficiaries and their dependents.

3. The Fund shall be administered for the objects aforesaid by a State Board

which will be constituted as specified in A.

4. The quorum at any meeting of the State Board shall consist of 60 per cent of

the members of the Board.

5. The State Board shall be competent to make rules for the conduct of its

business.

6. The Chief Secretary to Government, Himachal Pradesh shall be the Ex-

officio Secretary of the State Board. He shall be responsible for conducting

the business of the State Board and for the day to day administration of the

Fund, in accordance with the policies laid down by the State Board. It shall

be competent for the Secretary of the State Board to delegate all or any of

his functions under this scheme to any other officer of the Himachal

Government.

7. The State Board shall be competent to authorize such other officers/officials

of the Himachal Pradesh Govt. to discharge any of their ministerial

functions.

8. The State Board may, from time to time, constitute and dissolve Advisory

Committee, appoint or remove district conveners for advising them on the

administration of the Fund or any question connected with the

administration thereof.

9. The State Board shall at all times conform and abide by rules framed under

section 13 of the Charitable Endowments Act, 1890.

10. The scheme shall come into operation on the day of requisite vesting order

is notified in the Rajpatra.

ANNEXURE A

CONSTITUTION OF THE STATE BOARD.

1. The State Board shall be known as the Himachal Pradesh National WorkersRelief Board.

2. Composition The State Board shall be constituted as under :-

President Chief Minister, Himachal Pradesh.

Ex Officio Members not To be nominated by the President from

exceeding seven. amongst the Ministers and Deputy Ministers.

Official Members The Chief Secretary to the Govt. of H.P.

Non-officials Members not To be nominated by the President.

3. (i) The term of membership in the case of non-official members will be one

year subject to the general powers of the President of the State Board to remove a

member before the expiry of that term.

(ii) A member will be eligible for renomination on the expiry of his term.

4. The State Board shall meet as often as it may b called by the President, butat least one meeting shall take place in each quarter.

No. GAD(F)1(A)4-2/90-Part-1, Shimla-2, the 8th June, 1994.

On the joint application made to the Government of Himachal Pradesh, the

Governor of Himachal Pradesh, in exercise of the powers vested in him under

Section 21 of the General Clauses Act, 1897, read with sub-section (1) of Section-

5 of the Charitable Endowment Act, 1890 (Act No.VI of 1890), is pleased to

order that the Himachal Pradesh National Workers Relief Fund, subsequently

renamed as the Himachal Pradesh Freedom Fighters Welfare Fund shall

henceforth stand abolished and all properties and funds hitherto belonging to the

said Fund shall vest in the new endowment proposed to be created in the name of

the Himachal Pradesh Freedom Fighters Welfare Fund. The said Fund will be

administered by a committee consisting of:-

(i) Chief Secretary to the Government of Himachal Pradesh.(ii) Finance Secretary to the Government of Himachal Pradesh.(iii) Secretary GAD) to the Government of Himachal Pradesh.(iv) Secretary (Law) to the Government of Himachal Pradesh.

SCHEME FOR THE UTILISATION OF THE

HIMACHAL PRADESH FREEDOM FIGHTERSWELFARE FUND

1. Definitions: (a) Beneficiary Unless the context otherwise

requires beneficiary means a person of Himachal Pradesh domicile

who has suffered during or on account of the struggle for the

National liberation, and is not in a position to make his both ends

meet due to loss of health by harassment or incarceration, loss of

profession or loss of property.

(b) Dependents shall mean the wife and direct descendants of the

beneficiary and any other person, who, in the opinion of the

Himachal Pradesh Freedom Fighters Welfare Board hereinafter

referred to as the State Board, is or was wholly or partly dependent

on the beneficiary.

2. The objects of the Scheme are as follows :-

(a) To received from the Central Government, Himachal Pradesh

Government and other State Governments contributions in the shape

of grants to the Fund.

(b) To collect private contributions and donations for the Fund.

(c) To defray all proper costs, charges and expenses.

(d) To do all such other things as are incidental or conducive to the

attainment of objects mentioned above or any of the or to the

carrying out of this Scheme.

(e) To apply the corpus and/ or income of the Fund for the benefit of the

beneficiaries and their dependents.

3. The Fund shall be administered for the objects aforesaid by a State Board

which will be constituted as specified in Annexure A.

4. The quorum at any meeting of the State Board shall consist of 60 percent to

the members of the Board.

5. The State Board shall be competent to make rules for the conduct of its

business.

6. The Chief Secretary to Government , Himachal Pradesh shall be the Ex-

officio Secretary of the State Board. He shall be responsible for conducting

the business of the State Board and for the day to day administration of the

Fund, in accordance with the policies laid down by the State Board. It shall

be competent for the Secretary of the State Board to delegate all or any of

his functions under this Scheme to any other officer of the Himachal

Pradesh Government.

7. The State Board shall be competent to authorize such other officers/officials

of the Himachal Pradesh Government to discharge any of their ministerial

functions.

8. The State Board may, from time to time, constitute and dissolve Advisory

Committees, appoint or remove district conveners for advising them on the

administration of the Fund or any question connected with the

administration thereof.

9. The State Board shall at all times conform and abide by rules framed under

Section 13 of the Charitable Endowments Act, 1890.

10. The Scheme shall come into operation on the day of the requisite vesting

order in notified in the Rajpatra.

CONSTITUTION OF THE STATE BOARD

1. The State Board shall be known as the Himachal Pradesh Freedom FightersWelfare Board.

2. Composition :- The State Board shall be constituted as under :-(i) President The Chief Minister, Himachal Pradesh.

(ii) Vice-President To be nominated by the President

From amongst Ministers/Deputy Ministers/

Freedom Fighters members.

(iii) Members Members not exceeding 20 (Twenty) to be

nominated by the President.

(iv) Ex-Officio Secretary The Chief Secretary to the Government

of Himachal Pradesh.

3. (i) The term of membership will be one year provided that the President

may remove any member before the expiry of the term.

(ii) A member will be eligible for re-nomination on the expiry of this histerm.

4. The State Board shall meet as often as may called by the President,

but at least two meetings shall take place in each year.

ANNEXURE A

SCHEME FOR THE GRANT OF FINANCIAL ASSISTANCE BY THE

GOVERNMENT OF HIMACHAL PRADESH TO THE FREEDOM FIGHTERS OFHIMACHAL PRADESH

(updated as on 30th

April, 2005)

1. Introduction.In the struggle that was waged in British India and the Indian PrincelyStates with the object of attaining Independence for India as well as for merger of the

erstwhile Princely States within the Indian Union after the 15th August, 1947 till the

date of accession of the States with the Indian Union, numerous national spiritedcitizens suffered at the hands of their Administrators both financially as well as

physically. In order to afford financial assistance to such freedom fighters and on the

recommendations of the Himachal Pradesh Freedom Fighters Welfare Board, theHimachal Pradesh Government has decided that all the eligible freedom fighters or

their spouses who are not receiving Central Government Freedom Fighters Pension

would henceforth be paid Rs. 100/- per month under the new scheme.

2. Operation.This scheme shall come into force from the date of publication in theRajpatra, Himachal Pradesh.

3. Scheme.Financial assistance will be made available to eligible freedom fighters as

under:--

(i) All eligible Freedom Fighters will be paid Rs.100/- per month towards financialassistance under the scheme.

(ii)Spouses of such freedom fighters will also be eligible for this assistance under thescheme provided she/he has not re-married after the death of Freedom Fighter,

and the freedom fighter would have been eligible for this financial assistance hadhe/she been alive.

(iii)In case of the death of a Freedom Fighter his legally wedded spouse shallcontinue to get the same financial assistance under the scheme for her/his lifetime or till she/he remarries [Amended vide Notification No. GAD-(F)6-(F)1-1/88

Dt. 19/02/1996]

Provided that after the death of the Freedom Fighter and the death or

remarriage of his/her spouse, their daughter(s) shall also be eligible to get the

same Samman Rashi till her/their marriage.

Provided further that financial assistance under the scheme will be given

only to (a) bonafide Himachali Freedom Fighters who can submit proof to this

effect through production of a certificate issued by an Executive magistrate notbelow the rank of a Sub-Divisional Magistrate, and

(b) Those Freedom Fighters who have settled outside the State provided they had

participated in the freedom movement in the areas now forming part of Himachal

Pradesh, and are not getting any financial assistance from any other State.

(iv)(iv) Such freedom fighters who are permanent residents of Himachal Pradesh andare in receipt of and shall get pension under the Freedom Fighters Pension

Scheme-1972, later on renamed as Swatantrta Sainik Samman Pension Scheme-

1980 of the Central Government, will be eligible for the grant of Samman Rashi

under the H.P. Swatantrta Sainani Samman Rashi Yojana-1985 from the date ofsubmission of application to the Government. *Clarification*. [Amended vide

Notification No. GAD-(F)6-(F)1-1/88 Dt. 21/06/1997]

4. Eligibility.(i) Only those persons will be eligible for the financial assistance underthis scheme who had undergone imprisonment for a cumulative period of not less

than 2 months, or were externed or remained underground, for a cumulative period of

not less than 2 months for participation in the National Movement before

Independence and/or in movements for merger of the erstwhile Princely States withinthe Indian Union after the 15th August, 1947 till the date of accession of the State

with the Indian Union; as enumerated in Schedule attached.

(ii) Spouses of such persons eligible for financial assistance under clause 4 (I) above,shall also be eligible for this financial assistance under the scheme during their life

time or till their remarriage whichever is earlier.

(i) (iii) Widow of such Freedom Fighters who are permanent residents of HimachalPradesh and are in receipt of and shall get Samman Pension under the CentralGovernment Freedom Fighters Pension Scheme-1972, later on renamed as

Swatantrta Sainik Samman Pension Scheme-1980, after the death of freedom

fighter under the H.P. Swatantrta Sainani Samman Rashi Yojana-1985, shall beeligible for the grant of Samman Rashi from the date of submission of the

application to the Government. [Amended vide Notification No. GAD-(F)6-

(F)1-1/88 Dt. 21/06/1997]

5. Procedure.Persons eligible for financial assistance under this scheme should apply

in the prescribed Performa (Annexure-A) which can be obtained from the Secretary

General Administration Department to the Government of Himachal Pradesh,Shimla-2 or from the Deputy Commissioner/Sub-Divisional Magistrate offices in

Himachal Pradesh. This application supported by an affidavit duly sworn in and

attested by an Executive Magistrate to the Freedom Fighter is not in receipt ofFreedom Fighters Pension or financial assistance from any other State Government is

to be submitted to the Sub-Divisional Magistrate concerned who will verify the

particulars to the best of his ability and then submit the application along with hisobservations to the Deputy Commissioner. The Deputy Commissioner will forward

the application to the State Govt. with the appropriate recommendations. A Sub

Committee of the Himachal Pradesh Freedom Fighters Welfare Board to be

constituted under the order of the President of the Board will consider these cases forthe grant of financial assistance and recommend these cases to the Himachal Pradesh

Freedom Fighters Welfare Board for confirmation and reference to the Government

for sanction of financial assistance.

The applicants will be required to furnish the documents shown against

each category detailed below:--

(a)For Freedom Fighter claiming financial assistance on groundof imprisonment:

Certificate from Jail authorities or the District Magistrate.Where certificates of imprisonment are not available due to the

records being lost, destroyed or being un-obtainable because these

are maintained in areas now forming parts of Pakistan andBangladesh, an affidavit by the applicant about his imprisonment

supported by a certificate from a Freedom Fighter who is getting

Freedom Fighters Pension from the Central Government, specifyingthe period of imprisonment, may be accepted subject to the

satisfaction of the Government.

(b)Those Freedom Fighters who remained underground:Documentary evidence by way of Court/Government Order, where

such documentary evidence is not available, a certificate from aFreedom Fighter who is getting Freedom Fighters Pension from the

Central Government specifying the period the applicant remainedunderground along with an affidavit from the applicant may be

accepted subject to the satisfaction of Government.

(c)Externments:An affidavit with a copy of the order of the externment or any other

documentary evidence. Where such documentary evidence is not

available, a certificate from a Freedom Fighter who is gettingFreedom Fighters Pension from the Central Government specifying

the period of externment of the applicant may be accepted subject to

the satisfaction of the Government.6. Persons gettingPension from Central Government:-

Persons who are getting pension or will be granted pension from

the Central Government under the Freedom Fighters Pension Scheme, 1972

subsequently renamed as Swatantrta Sainik Samman Pension Scheme, 1980 shouldapply in the prescribed Performa as per Annexure-C, which can be obtained from the

Secretary, General Administration Department (Freedom Fighters Section) to the

Government of Himahal Pradesh, Shimla-171002 or from the DeputyCommissioners/Sub Divisional Magistrates/Officers in Himachal Pradesh. On the

receipt of applications from the Freedom Fighters through Deputy Commissioners

concerned, the financial assistance will be provided by the Government. [Inserted
