1. SCOPE

These General Terms and Conditions apply to the international passenger carriage services, between France and Italy, performed by SNCF and its subcontractor, SNCF Voyages Italia Srl, and marketed under the SNCF brand. The list of French and Italian railway stations served is set out in Appendix 5. These General Terms and Conditions are applicable without any reservations to all international passengers travelling on the France - Italy line. They are available to passengers who may either view them on Internet (voyages-sncf.com and sncf.com) or request them at the following addresses: SNCF Voyages Italia BP 90013- 75562 Paris cedex 12, France; or at SNCF Voyages Italia Srl, CP 10143, 20100 Milano, Italy. However, these carriage Terms and Conditions do not apply to the domestic passenger carriage service, carried out solely on the French railway network which remains subject to the Passenger Fares in force.

The French National Railway Company (SNCF) , a public, industrial and commercial company, whose head office is located at: 2, place aux Etoiles, 93200 Saint Denis, France and is registered in the Bobigny Register of Companies under the number: 552.049.447 – VAT Number: 35 552 049 447. SNCF holds a railway company licence and a security certificate in France, enabling it to perform passenger carriage services on the Paris-Modane line between France and Italy. SNCF Voyages Italia Srl, is a sole-shareholder company that is managed and coordinated by SNCF Voyages Development and governed by Italian law, its head office is located in Milan (20154), via Bonnet n°6/B, and it is registered in the Milan Chamber of Commerce and Industry under the no.1908688. SNCF Voyages Italia Srl holds a railway company licence and a security certificate in Italy as well as the authorisations required in order for it to perform passenger carriage services on the Paris-Modane line between France and Italy.

2. CONTRACT OF CARRIAGE AND TICKETS

2.1. DEFINITION OF THE CONTRACT OF CARRIAGE In exchange for the payment in advance of the the price of the journey, SNCF commits to transport passengers holding a valid ticket, and any luggage they may have, to their place of destination under the conditions set out in the contract of carriage For the comfort and safety of all passengers during the journey, only hand-luggage that the passenger can easily carry unaided, without risk for other passengers, and placed in the dedicated spaces is authorised on the train.

The contract of carriage between SNCF and the passenger is governed by: • Regulation (EC) n°1371/2007 of the European Parlia ment and Council of 23 October 2007 concerning the rights and obligations of rail passengers ("PRR"), including

the CIV Uniform Rules in the version of Appendix I of the PRR (Uniform Rules) • the Convention Concerning International Carriage by Rail (COTIF) of 1999 and its Appendix A: "Uniform rules concerning the Contract for International Carriage of

Passengers and Luggage by Rail (CIV); • the General Conditions of Carriage for Rail Passengers (GCC-CIV/PRR); these GCC-CIV/PRR were drawn up through the International Rail Transport Committee

(CIT). Their contents may be viewed in French, English or German on the CIT website: www.cit-rail.org; • these General Terms and Conditions; • the information on the passengers tickets; • D.P.R. no. 753/1980 in Italy (amended by the Legislative Decree no. 35 of 27/01/2010) • the UN Convention for the rights of passengers PMR, 13.12.06, art. 19

Should a conflict arise between the GCC-CIV/PRR and these General Terms and Conditions, the latter shall prevail. If contradictions should arise between different provisions of these General Terms and Conditions, the provision that is more favourable for the passenger shall prevail.

The contract of carriage does not cover transfers between two stations, for example between two stations of a same town, by a means of transport other than rail (bus, tram, underground, etc.) or on foot.

The issuing of one or several tickets, on paper or electronically for E-Tickets and M-Tickets, is evidence of the contract of carriage. Until proved otherwise, tickets on paper testify to the conclusion and contents of the contract of carriage. However, this provision does not apply to E-Tickets and M-Tickets as there are dematerialised.

2.2. TICKETS Only tickets issued by SNCF or its distribution network are valid on-board SNCF trains serving France and Italy. Unless otherwise stated, a ticket is evidence of a contract of carriage. One ticket can also evidence several carriage contracts, if specifically stated. Tickets are transferable if they have not been made out in the passenger's name and as long as the journey has not begun. Passengers are not authorised to trade tickets for commercial gain. Any passenger misusing the system for selling E-Ticket and M-Ticket may subsequently be forbidden to use said system and all elements enabling E-Tickets to be printed at home, under conditions in accordance with applicable laws and in proportion to the misuse in question. The conditions for exchanging and refunding tickets are set out hereafter, in articles 5 and 6 of these General Terms and Conditions. In general, an exchange is considered as terminating the initial contract of carriage and concluding a new contract. Tickets shall be refunded using the same payment method that was chosen for their purchase. Where applicable, tickets shall be refunded as travel vouchers. A ticket entitles the passenger to travel on the train, in the reserved seat, on the date and in the class indicated, and where applicable, to benefit from the services specific to the ticket fare. A ticket may only be used for a journey that shall take place on the date, train and in the comfort class indicated. However, under certain conditions and subject to availability, some fares enable passengers to travel on another France - Italy TGV on the same date and for the same origin-destination route. A passenger may only use one seat. Seats reserved for disabled persons or families with young children must remain available to them. The different types of ticket are the following:

• paper tickets in IATA format ("IATA Paper Ticket"); • e-tickets ("E-Ticket"); • m-tickets ("M-Ticket").

These tickets are issued for the following journeys:

• single; • return with the same route for the outward and return parts of the journey; • round-trips, that is return tickets with different routes for the outward and return parts of the journey. For these tickets, passengers must specify the station to be

considered as the destination of the outwards journey and the stating point of the return journey. Lost or stolen tickets cannot be refunded or replaced in any case whatsoever. Damaged or illegible tickets may be refused. All the elements concerning the journey (such as the service, the class of the car and the references of the service for which the ticket is valid) are indicated on one of the following documents which are available to the passenger:

• the IATA Paper Ticket; • in the case of an E-Ticket ordered with an E-Ticket compatible card (specifically the SNCF loyalty card), the E-Ticket memo which is an extract from the E-Ticket;

passengers are not required to show said memo during their journey (the "E-Ticket Memo"); • in the case of an E-Ticket ordered without an E-Ticket compatible card, the E-Ticket confirmation which is an extract from the E-Ticket; passengers are required to

show said confirmation during ticket inspection (the "E-Ticket Confirmation"); • in the case of an E-Ticket order, the M-Ticket which is an E-Ticket format, it consists in a barcode downloaded onto the passenger's mobile phone through an M-

Ticket compatible application that enables the E-Ticket to be identified.

2.3. SALE OF TICKETS

2.3.1 General Unless otherwise stipulated, tickets may be purchased at the earliest 3 months before the travelling date through the distribution channels set out in Appendix 1. When ordering a ticket, the passenger or the person purchasing said ticket must ensure that the latter was issued according to their specifications, in particular as regards the date, time, origin and destination of the journey as well as the passenger's surname, first name and date of birth when purchasing certain tickets made out in the passenger's name such as E-Tickets and M-Tickets. Passengers cannot claim any discount on the ticket fare once purchased. Passengers may use the following payment methods:

• any payment shall be made in cash having legal tender in France and Italy; by bank or postal cheque in Euro, payable and endorsable in France; or by a French smart bankcard displaying the CB logo, with the exception of cards requiring systematic authorisation (those whose characters or numbers aren't embossed). Only foreign international bankcards with the CB, VISA or Mastercard logo are also accepted.

• Passengers paying by bank or postal cheque (payable and endorsable in France) will be required to show an identity document. • if applicable, any other method indicated by the distributor.

2.3.2 IATA Paper Tickets IATA Paper Tickets are printed on paper with a magnetic stripe that contains all the elements concerning the journey such as the service, the class of the car and the references of the service.

2.3.3. E-Tickets

• Scope : Only certain fares (see the summary table in Section 2, paragraph 2.6), and services (see Appendix 5) are accessible with E-Tickets.

• Ordering E-Tickets : E-Tickets may be booked and paid through the distribution channels listed in Appendix 1.

• E-Ticket Confirmation and Memo : in order to access their train, passengers using E-Tickets must first print their E-Ticket Confirmation in A4 format or the IATA; or if they have registered their E-Ticket-compatible card number while ordering, they must bring said card. In the latter case, an E-Ticket Memo is available to the passenger either in paper or electronic format. E-Tickets are electronic, E-Ticket Confirmations and Memos, which may be printed out when purchasing an E-Ticket, do not constitute tickets but extracts from these.

• Printing the E-Ticket Confirmation : Passengers shall receive their E-Ticket Confirmation by email. Should passengers print their E-Ticket Confirmation themselves, in particular through the websites of SNCF's approved partners, the printed document must comply with the conditions set out in this article. To be valid, the E-Ticket Confirmation must be printed on white A4 paper that is blank on both sides, without any modification of the print size, in landscape format with a laser or ink-jet printer that has a minimum resolution of 300 dpi. The E-Ticket Confirmation can in no case be presented in another form (electronic, screen, etc.). Should an incident occur while printing the E-Ticket Confirmation or if the print quality is poor, the passenger must reprint the ".pdf" file.

• Thus, before ordering any E-Tickets, passengers wishing to print their E-Ticket Confirmations themselves must make sure they have the required software and hardware configuration for this purpose, that is, a computer with an Internet connection, Acrobat Reader installed and a laser or inkjet printer with a minimum resolution of 300 dpi. Before ordering their E-Tickets, passengers must test that their printer can print them correctly. SNCF shall not be held liable for the passenger's inability to print their E-Ticket Confirmation due to the non-compliance with any of the provisions above.

• Printing the E-Ticket Memo: Passengers using an E-Ticket compatible card receive an E-Ticket Memo which is an extract of their E-Ticket, this contains the details of their journey (departure and arrival times, train, car and seat numbers, etc.). Passengers may print their E-Ticket Memo and, in some cases, view it electronically (email, SMS, etc.). During E-Ticket inspection operations, passengers must present their E-Ticket compatible card as they are not required to show their E-Ticket Memo. The E-Ticket Memo may be printed in the same conditions as the E-Ticket Confirmation.

• Specificities and Validity of E-Tickets E-Tickets are made out in the passenger's name, they are personal and cannot be transferred. An E-Ticket is only valid for the indicated train, date, class and route. It may be exchanged and/or refunded according to the exchange and refund terms and conditions set out in this Section 1 of the General Terms and Conditions. Should any of the rules above not be observed, the E-Ticket shall be considered not valid.

• Waiver - Proof

When an E-Ticket fare exceeds 1,500 Euros, the passenger or the person purchasing the E-Ticket expressly agrees that the contract of carriage shall not be an act concluded before a notary or a private agreement, and the proof of the existence of this contract's contents cannot be provided by a witness or by any other means of evidence than the data pertaining thereto stored in SNCF's information system. The passenger or the person purchasing an E-Ticket also waivers (i) the requirement of several original documents to validate the contract of carriage (ii) any claims they may be entitled to make due to absence of several original copies of the contract of carriage . In selling of E-Tickets, these waivers mean, more specifically, that the only original copy of the contract of carriage shall be stored in SNCF's information system.

The E-Ticket stored in SNCF's information system and all data pertaining thereto are prima facie evidence of the conclusion, contents and execution of the contract of carriage. Thus they constitute evidence that is receivable, valid and opposable to the passenger, under the same conditions and with the same probative force as any document drawn up, received or kept on paper.

The integrity and reliability of the information contained in SNCF's information system are ensured through the implementation of numerous technical means such as: securing the audit access to the information system, identification or authentication, the traceability of any modification carried out on tickets stored in the information system and the implementation of technical security devices.

2.3.4. M-Tickets

• Scope of M-Tickets Passengers that have ordered an E-Ticket can choose to receive this as an M-Ticket ("M-Ticket") after downloading a compatible application onto their mobile phone. Thus, the M-Ticket is an E-Ticket format, it consists in a barcode downloaded onto the passenger's mobile phone and enables the identification of the corresponding E-Ticket stored in SNCF's information system. M-Tickets enable passengers to access the train without needing to bring their printed E-Ticket Confirmation with them. • M-Tickets are Compatible :

o with all SNCF distribution channels that offer E-Ticket services or through travel agencies or other SNCF partners that also offer these services, o with all fares and railway services compatible with E-Tickets.

M-Tickets are offered to customers that subscribe to the Voyageur loyalty programme through the SNCF Direct Application. • M-Ticket Terms and Conditions: In order to be entitled to M-Tickets, passengers must:

o have purchased an E-Ticket, o have a Smartphone type GSM mobile phone such as: Iphone, Blackberry or Android or any other similar device or terminal that may be compatible with M-Tickets,

due in particular to the development of new technologies or the distribution systems developed by travel agencies and SNCF's authorised partners, o have a telephone subscription that includes an Internet access, o download the application onto the mobile phone - i.e. the computing program needed to issue the M-Ticket - according to the distribution channels set out below. o The M-Ticket barcode is loaded into the chosen application for each passenger and journey. It is up to passengers to download their M-Tickets successfully, at least

once before the departure of the train, so they may be easily deciphered on-board, without needing to connect to their mobile network. o The following information displays on the screen of the passenger's mobile phone:

o the passenger's surname and first name, o their date of birth; o the date and time of departure, o the route (departure and arrival stations), o the car and seat numbers o the barcode o the Dossier Voyage (travel file) number, o a link to the M-Ticket Terms and Conditions of Use.

When there are several passengers and/or journeys, the application will generate one barcode per journey and per passenger. Only one barcode may be displayed at a time. However, it is possible to navigate between each passenger's barcode. Each displayed barcode indicates: the route, the departure dates/times and the corresponding passenger's surname/first name/date of birth. For each travel file and for the same route on the same train but with different fares if applicable, all the M-Tickets of the passengers shall be loaded into the chosen application on one mobile phone upon identification of the travel file reference. Passengers whose M-Tickets are downloaded onto the same mobile phone must travel together. Passengers must not compromise in any way the integrity of their M-Tickets. Moreover, passengers must have a mobile phone that is in proper working conditions and in particular, they must ensure that the battery is sufficiently charged in order to fulfil all ticket-inspecting and regularisation obligations as set out in section 3 hereafter. Passengers may still print their E-Ticket Confirmation. • Compatible Applications: Depending on the distribution channels, M-Tickets may be combined with additional services.

SNCF Direct is an Application for Smartphones available for all customers that have purchased an E-Ticket. All E-Ticket customers can download their M-Tickets with the SNCF Direct application which is available for free from all OS stores: App Store for Iphone, Android Market for Android and BlackBerry App World for BlackBerry Smartphones. The corresponding terms and conditions are set out in the General Terms and Conditions of Use of the SNCF Direct service.

The terms and conditions for downloading M-Tickets are set out in the General Terms and Conditions of Use of the distribution channels of agencies and authorised partners, in compliance with the provisions set out above.

3. VALIDITY OF TICKETS Tickets may only be used for one journey, to take place on the indicated date, time, train, in the reserved seat and corresponding class. Seat reservation is compulsory on TGV trains between France and Italy. Tickets valid for trains with optional or no reservation cannot be used on TGV trains between France and Italy. In order to access the trains, all passengers must hold a valid ticket, E-Ticket Confirmation or M-Ticket in compliance with the general terms and conditions herein. Contrary to the provisions of article 5.2.5 of the General Conditions of Carriage of CIT's GCC-CIV/PRR, not claiming a reserved seat within a given time frame does not entail the loss of the reservation. When leaving from a station that does not sell tickets (i.e. the stations in Bardonecchia, Oulx/Sestriere, Torino Porta Susa, Vercelli and Novara), passengers boarding a train without having purchased a ticket in advance must speak to the conductor. The latter can sell tickets. In this case, the on-board fare includes surcharges for selling tickets on-board in force on the date of the sale. The list of points of sale located near the stations that do not sell tickets is set out in Appendix 5 herein.

It is up to passengers to check the platform number from which their France-Italy TGV train leaves on the information boards made available by the station manager. SNCF shall not be held liable for managing this information and information boards; these are under the sole responsibility of the station manager concerned.

4. TICKET INSPECTION AND REGULARISATION

4.1 INSPECTION Passengers must hold a valid ticket for the whole duration of their journey and, where appropriate, any document needed to justify their fare. According to the type of ticket purchased, when requested by an agent in charge of inspecting tickets in the trains and stations, passengers must show their ticket, E-Ticket Confirmation or M-Ticket along with any document needed to justify their fare, where applicable. Passengers without a valid ticket or without the documents needed to justify their fare where applicable, shall pay a surcharge in compliance with article 4.2.2, in addition to the price of the journey. Failing this, they may be excluded from the train in compliance with the applicable rules.

When passengers use an E-Ticket or when their chosen fare is subject to the justification of their identity and clear visual identification is not possible, for any reason whatsoever, the agent in charge of controlling tickets shall be entitled to demand that the ticket be regularised based on the maximum fare chargeable for the service provided. Should the passenger refuse to regularise their situation, he/she shall be fined. Passengers holding an E-Ticket must be able to prove their identity. Indeed, E-Tickets are made out in the passenger's name, they are personal and cannot be transferred. At any time; passengers may need to show valid photo identification (identity card, passport or residence card) to any conductor who requests it, in addition to their E-Ticket Confirmation. During ticket inspection, passengers using M-Tickets must show the SNCF conductors, their M-Ticket barcode on the illuminated screen of their mobile phone in a legible way. For smoother operation, it is recommended to increase the brightness of the mobile phone to the maximum while displaying the barcode. If the passenger has an Android phone or Iphone 5, the brightness will automatically increase while the barcode is displayed, and will then readjust according to the phone settings. The barcode is read by SNCF conductors with a special device (Accelio). It is up to passengers to operate their mobile phones. However, SNCF conductors may request the mobile phone to be handed over for inspection purposes in the passenger's presence, and in this case shall be authorised to use said mobile phone to carry out their inspection.

A receipt shall be issued for any fee collection by the conductors. Where appropriate, this receipt may have value of a ticket.

In order to carry out internal analyses of their ticket conditions of sale, the agent in charge of ticket inspection may decide to remove the ticket from the passenger on the train and give them a ticket in a specific format as replacement.

4.2 REGULARISING PASSENGERS IN IRREGULAR SITUATIONS

4.2.1 Irregular Situations

Passengers are in an irregular situation if they are unable to show a valid ticket to a conductor, under the conditions herein and in compliance with the laws applicable in France and in Italy, inside controlled areas or on the trains, and more specifically passengers who:

• cannot show any ticket, E-Ticket Confirmation or M-Ticket; • cannot show any documents to justify their reduced fare; • are travelling with an illegible or forged ticket, E-Ticket Confirmation or M-Ticket; • are travelling with a non-transferable ticket made out in someone else's name;

• are travelling with an E-Ticket, where upon reading of their E-Ticket Confirmation or M-Ticket shows that said E-Ticket has already been inspected on the train or that the passenger is on a train other than to one they booked;

• have not complied with the provisions that govern the use of their ticket by using it beyond the exchange period or on a day other than the booked date indicated; • show an E-Ticket Confirmation or an M-Ticket corresponding to an E-Ticket that has already been exchanged or refunded.

Passengers shall also be in an irregular situation if their ticket: • is made up of several segments of which one or more are missing; • is made out in their name without them being able to prove their identity; • is not valid for the route, date, class or travelling conditions used;

4.2.2 Inspection, Regularisation and Penalty Fares Passengers Self-Reporting to the Conductor (On-Boar d Fare)

Passengers in an irregular situation (as set out in article 4.2.1) who self-report to the conductor by informing the latter of their irregularity before boarding the train or at the latest during the minutes following the departure of the train from the departure station may regularise their situation (on a commercial basis) under the On-Board Fare conditions which include on-board issuing fees.

Reduced fares and fares requiring a prior application do not apply on-board trains.

The On-Board Fare is calculated based on the Flexi + fare with a 10 Euro surcharge (issuing fees) to take into account the additional costs incurred by selling tickets while boarding or on-board. Issuing fees are collected per passenger. For a given route and train, should several fare irregularities be observed for one passenger, the sum of the observed price insufficiencies corresponding to each irregularity shall be collected and only 10 Euros shall be added to this for the issuing fees.

The situation of passengers and that of animals travelling with them are regularised separately. The ticket-issuing fee for domestic animals is of 10 Euros .

Once on the train, the passenger may upgrade subject to the prior agreement of the conductor to whom the passenger must speak to first. Regularisation is based on the Flexi + fare. In all upgrading cases, the amounts collected are exonerated from the issuing fees that apply to On-Board Fares. Passengers Have Not Reported to the Conductor (Insp ection Fare) During ticket inspection, passengers in an irregular situation who have not reported to the conductor under the conditions set out above may regularise their situation through immediately paying a 50 Euro flat rate penalty in addition to any insu fficient payment as a transaction. The insufficient payment is calculated based on the price of the Flexi Plus fare.

The flat rate penalty is collected per passenger. The situation of passengers and that of animals travelling with them are regularised separately. The flat rate penalty collected for domestic animals is of 50 Euros . For a given route and train, should several fare irregularities be observed for one passenger, the sum of the observed payment insufficiencies corresponding to each irregularity shall be collected and only 50 Euros will be added to this for the compensation flat rate.

For infringements unrelated to fares, the inspection fare is also applied (compensation flat rate only).

If the passenger cannot or will not pay the requested amou nt immediately and thus refuses the transaction offered, a penalty notice stating the infringement shall be drawn up by the conductor. The passenger has the legal time-frame to: • pay the amount of the transaction that includes: any payment insufficiency, the flat rate penalty, and administrative fees, in compliance with the provisions of article 529-4 of the French Criminal Procedure Code and the provisions of articles 80-4 to 80-7 of the modified Decree n° 42-730 of 22 March 1942;

• or address a justified objection to SNCF that shall be transferred to the Public Prosecutor.

When controlling the existence and validity of passengers' tickets, conductors, who are approved by the Public Prosecutor and certified, are entitled to record the offender's identity and address. Should the passenger be reluctant to give their personal details, needed in order to establish the ticket stating the infringement, the conductor may request the assistance of a law enforcement officer or agent.

If the offender refuses or is unable to prove their identity, the conductor shall immediately report this to any officer of the Criminal Investigation Department, National Police or Gendarmerie that has territorial competence, who may then request the offender to present themselves immediately on their premises.

If the resolution is not carried out within the legal time frame and in the absence of any objections, the passenger shall be prosecuted in compliance with the provisions of articles 529-3 to 529-5 of the French Criminal Procedure Code.

In any case where a penalty notice has been drawn up, the case shall be investigated electronically through a relational database whose description and operating conditions are set out in Appendix 2 of Section 4.

Moreover, any fraudulent use of a ticket, E-Ticket Confirmation (ticket or E-Ticket Confirmation outdated, forged, counterfeit, made out in somebody else's name or used by someone unable to prove their identity during inspection, etc.) or M-Ticket shall result in its immediate removal and, where appropriate, in legal proceedings.

Administrative fees shall amount to 38 Euros (in a fraudulent situation or when police assistance is needed to verify the person's identity) and 30 Euros (in other cases). If the Infringement is observed on the Italian Terr itory:

The passenger shall have 15 days to pay the amount of the transaction that includes: any payment insufficiency, the flat-rate penalty and administrative fees. If the offender refuses or is unable to prove their identity, the conductor shall request the intervention of the competent authorities and the offender may be requested to get off the train at the next station. Moreover, any fraudulent use of a ticket, E-Ticket Confirmation (ticket or E-Ticket Confirmation outdated, forged, counterfeit, made out in somebody else's name or used by someone unable to prove their identity during inspection, etc.) or a forged M-Ticket shall result in its immediate removal and, where appropriate, in legal proceedings.

The penalty notice stating the infringement calculated based on the inspection fare with an added 50 Euros for administrative fees.

4.3 TERMS OF PAYMENT On the train, any payment shall be made in cash having legal tender in France and in Italy; by bank or postal cheque in Euro, payable and endorsable in France; or by a French smart bankcard displaying the CB logo, with the exception of cards requiring systematic authorisation (those whose characters or numbers aren't embossed). Only foreign international bankcards with the CB, VISA or Mastercard logo are also accepted. Passengers paying by bank or postal cheque (payable and endorsable in France) will be required to show an identity document.

5. EXCHANGE OF TICKETS

5.1 GENERAL TERMS AND CONDITIONS FOR EXCHANGING TICKETS Exchanges consist in a partial or complete modification of the journey. It results in the issuing of a new ticket. Where appropriate, exchanges must be carried out with the distributor that issued the initial ticket.

Special or restrictive conditions may apply to certain fares. Passengers cannot request an exchange for a journey without connections once the journey has already started.

5.2 CALCULATION AND APPLICATION OF PENALTIES Penalties shall be applied depending on the fare purchased as set out in the summary table 2.6 in Section 2. The penalty is calculated based on the total price of the initial journey, including for partial exchange requests. The amount of the penalty is rounded down to the inferior 10 Euro centimes.

Depending on the case, any price difference between the initial ticket and the newly issued ticket is either paid by the passenger or refunded to the passenger; the penalty being respectively added to or subtracted from this.

5.3 TEMPORARY MEASURES The provisions of articles 5.1 and 5.2 of these General Terms and Conditions may be subject to temporary adjustments due to exceptional events as regards the operation of the transport service. Tickets who, due to SNCF, cannot be used, in total or in part, may be exchanged without additional fees or benefit from an extension of their validity for the journey not carried out, according to terms set out by SNCF, that take into account the special circumstances.

6. REFUNDS

6.1 GENERAL TERMS AND CONDITIONS FOR TICKET REFUNDS 6.1.1 Definition of a Refund This is the complete cancellation of a ticket.

6.1.2 Refund Request For tickets that they did not use, passengers must contact the seller with whom they purchased said tickets for a refund. No partial refund shall be granted for passengers that abandon their route once the journey has started. Passengers shall be required to show an identity document for refunding an E-Ticket once the train has left or if the E-Ticket was paid for in cash.

Any ticket whose price is inferior or equal to 4 Euros cannot be refunded. Special or more restrictive conditions may apply to certain reduced price fares. As regards IATA Paper Tickets, only original copies of the tickets may be refunded.

Moreover, as regards, lost or stolen tickets, no refund or copy shall be made in any case whatsoever. However, this provision does not apply to E-Ticket Confirmations, E-Ticket Memos or M-Tickets as these documents are only ticket extracts.

6.2 CALCULATION AND APPLICATION OF PENALTIES For fares authorising it, refunding is possible until the time of departure of the train. Once the train has left, ticket refunds are no longer possible. The refunded percentage depends on to the fare as set out in the summary table 2.6 in Section 2. Tickets purchased with the Mini fare are not refundable. The amount of the refund is rounded down to the inferior 10 Euro centimes. Only tickets costing more than 4 Euros may be refunded. In the case of a cancellation before departure, refunds are no longer possible after 2 months.

6.3 REFUND METHODS Tickets paid by bank card are refunded by re-crediting the bank card that was used for the initial payment.

Tickets costing less than 150 Euros and paid for in cash or cheque by the passenger are refunded in cash. Tickets costing more than 150 Euros and paid for in cash or cheque are refunded by bank transfer.

Tickets paid for in "travel vouchers" are refunded in "travel vouchers".

Except when "travel vouchers" are used, if the passenger purchased their ticket using several of these payment methods, the ticket shall be refunded by bank transfer.

SNCF applies specific refunding conditions for tickets paid for in "holiday vouchers" in compliance with the rules that apply to "holiday vouchers."

6.4 TEMPORARY MEASURES The provisions of articles 6.1 to 6.3 of these General Terms and Conditions may be subject to temporary adjustments due to exceptional events as regards the operation of the transport service. Tickets who, due to SNCF, cannot be used, in total or in part, may be refunded without deductions according to the journey that could not be carried out; the same applies in the case of missed connections due to railway companies, where partial refunds without deductions, may be carried out.

7. COMPENSATION FOR DELAYS As a commercial gesture, passengers subject to a delay of at least 30 minutes while carrying out an international journey with TGV France-Italy are entitled to compensation of their choice:

• either Travel Vouchers equivalent to: o 25% of the price for the journey carried out for delays between 30 minutes and 119 minutes; o 50% of the price for the journey carried out for delays between 120 minutes and 179 minutes; o 75% of the price for the journey carried out for delays of at least 180 minutes.

Travel Vouchers are valid for 1 year and are accepted as payment for SNCF rail transport services (excluding transport in Ile-de-France).

• either in Euros equivalent to: o 25% of the price for the journey carried out for delays of at least 60 minutes; o 50% of the price for the journey carried out for delays between 120 minutes and 179 minutes; o 75% of the price for the journey carried out for delays of at least 180 minutes.

The compensation in Euros can only be paid if the journey costs more than 4 Euros. Compensation terms are indicated on the envelopes available in stations or distributed on-board.

Exceptional situations are subject to a specific procedure. Reminder: if France-Italy TGV passengers benefit from a domestic transport service, carried out exclusively on the French railway network, they are subject to the "Garantie Voyage" (travel guarantee) and the Passenger Fares in force.

8. LIABILITIES

SNCF is liable to passengers for the performance of the transport service on the Paris-Modane section of the French railway network. SNCF and SNCF Voyages Italia Srl are jointly liable to passengers for the performance of the transport service on the Modane-Border section of the French and Italian railway networks. It is stipulated that the liability of SNCF and SNCF Voyages Italia Srl is subject to the provisions of the Uniform Rules concerning the Contract for the International Carriage of Passengers by Rail ("CIV"), of the PRR and the GCC-CIV/PRR.

8.1 LIABILITY IN THE EVENT OF DEATH OR INJURIES The transporter's liability in the event of passenger death and/or injuries is governed by the European regulation 2007-1371 on the rights of rail passengers (PRR) and the CIV Uniform Rules that are integrated into the former, without prejudice to any national laws offering passengers greater compensation for damages suffered. In the event of the passenger's death and/or injuries during the performance of the transport service on the French or Italian railway networks, SNCF and/or SNCF Voyages Italia Srl shall be held liable except in the following cases: a) the accident was caused by circumstances external to the rail operation that SNCF and/or SNCF Voyages Italia Srl could not avoid and which consequences they could not prevent, in spite of having taken all the care required given the particular circumstances of the case; b) the accident was due to the passenger's fault; c) the accident was caused by the behaviour of a third party that SNCF and/or SNCF Voyages Italia Srl could not avoid and which consequences they could not prevent, in spite of having taken the care required given the particular circumstances of the case. Another company using the same railway infrastructure is not considered as being a third party and thus, the right to recourse is not affected. If the accident is caused by the behaviour of a third party and if, in spite of this, SNCF and/or SNCF Voyages Italia Srl are not fully relieved from their liability, they shall answer for the whole within the limitations of the Uniform Rules and/or the national laws applicable, and this, without any prejudice to any remedy they may seek against the third party. Damages owed in the event of the a passenger's death or injuries are set out in the CIV Uniform Rules incorporated in the PRR, as well as in the GCC-CIV/PRR and national laws, should these be more favourable to the passenger. Following exceptional circumstances, should the railway operation be interrupted and the passengers carried by a replacement means of transport (for example by bus), the liability rules herein apply. In the event of a passenger's dearth or injuries during the carriage service, the carrier, who is liable under article 56 § 1 read in conjunction with article 26 § 5 of the CIV, shall pay the passenger or the persons entitled an appropriate advance destined to cover their immediate financial needs. The amount of said advance is set to 21,000 EUR per passenger in the event of death. In the event of injuries, the amount of the advance corresponds to the justified reasonable costs. The latter cannot exceed 21,000 EUR per passenger. The payment of an advance does not constitute an acknowledgement of liabilities and the advance shall be deducted from any damages paid subsequently. The repayment of the advance may be demanded if the prejudice was caused by the fault or negligence of the passenger or if the person that perceived the advance was not entitled to it. As long as this is compatible with the safeguarding of its interests, the carrier who assumes no liability shall provide appropriate support to passengers who request assistance in their damage-seeking actions against third parties (if applicable, transfer documents, consult investigation reports, hand over documents, etc.).

8.2 LIABILITY FOR HAND LUGGAGE AND ANIMALS The liability for luggage and animals under the passenger's custody is governed by the CIV Uniform Rules incorporated in the PRR and the GCC-CIV/PRR.

The limitation of liability under article 34 of the CIV does not apply to mobility equipment used by disabled persons or persons with reduced mobility.

In the event of passengers' death or injuries involving the liability of SNCF and/or SNCF Voyages Italia Srl, the latter shall also both be liable, under the same conditions, for the damage resulting from the total or partial loss or damage caused to objects that the passengers had upon their person or as hand luggage; this also applies to any animals travelling with passengers.

However, SNCF and/or SNCF Voyages Italia Srl shall not be held liable for any damage resulting from the total or partial loss or damage caused to objects, hand luggage and animals in the passenger's custody, in compliance with the contract of carriage, except if the passenger provides evidence that such damage is due to (i) its/their fault and (ii) at a time when it/they acted as carrier(s).

Reparation for the partial or total loss or damage caused to hand luggage, animals and passenger luggage includes: • the sums owed to the passenger pursuant to the Uniform Rules; • where appropriate, any sums owed to the passenger under the liability rules pursuant to the applicable national laws.

SNCF and/or SNCF Voyages Italia Srl shall not be held liable to the passenger for damages due to the passenger's non-compliance with the requirements of Customs and other administrative authorities.

8.3 LIABILITY FOR CANCELLATIONS, DELAYS AND MISSED CONNECTIONS

If the carriage services are not performed or improperly performed by SNCF and/or SNCF VOYAGES ITALIA and entail for the passengers damage resulting form a delay, a missed connexion, or make it impossible for them to resume their journey, or to resume it on the same day due to specific circumstances, SNCF and/or SNCF Voyages Italia Srl shall be held liable.

Damages include: • reasonable accommodation costs as well as the reasonable costs incurred by having to notify persons expecting the passenger; • where appropriate, any sums owed to the passenger as set out by the liability rules pursuant to the applicable national laws.

8.4 PASSENGER OBLIGATIONS 8.4.1. General On France-Italy TGV trains, passengers are subject to the following obligations: a) comply with orders form SNCF and SNCF Voyage Italia personnel, station managers, infrastructure managers as well as comply with Italian legislative and regulatory provisions in force and with any requirements as regards order and security of railway services, in particular the conditions for accessing stations and trains; b) to ensure trains leave on time, present themselves imperatively on the platform and be ready to board the train at the least 2 minutes before the departure time. Past this time frame, access to the train is no longer guaranteed; c) take all necessary precautions and ensure the safety of persons, animals and objects in their custody; d) while waiting for a train on the platform, keep a safe distance from the edge of the platform, materialised by the yellow lines drawn on the platform or defined through station announcements; e) not open the doors, and only get on and off the train once fully stopped in the station. Passengers may only get off the train if the personnel on duty authorises it, by following the instructions given by the latter. It is also forbidden to get on or off moving trains. f) not use the toilets when the train has stopped in a station; g) on-board trains, only use mobile phones in the corridors and car-platforms, and only if the ring-tone is deactivated or turned down in order not to disturb the other passengers; h) only use multimedia devices with earphones in order not to disturb the other passengers; i) refrain from smoking in non-smoking areas, even with the agreement of the other passengers;

j) in the event of a ticket-inspection, pay the conductor the amount requested to regularise their situation; k) pay the amount of the fines owed; l) only use emergency brakes, alarm signals, devices for the emergency opening of doors, fire extinguishers, emergency hammers, glass cutters and any other emergency device installed in the trains and highlighted as such, in the event of serious and imminent danger; m) it is forbidden for any persons to carry out commercial activities on the trains unless expressly authorised by SNCF and/or SNCF Voyage Italia; n) load and unload their bicycles themselves; o) label their luggage; p) in general, warn as quickly as possible the on-board personnel of any abnormal situation or potential threat to the security of the train. Offenders may be excluded from the train without any refund rights. Passengers who represent a threat for the operating security or for other passengers, or that disturb intolerably other passengers may also be excluded from the train without any refund rights for the price of their tickets.

8.4.2. Minors For safety reasons, children under 16 are not authorised to travel alone on-board the SNCF trains subject to these Terms and Conditions. All minor children, whether accompanied or not, shall travel under their parents' responsibility or that of the persons exercising parental authority. It is up to the latter to contact the competent national authorities and ensure that their minor child has all the required documents to authorise them to cross the borders.

8.4.3. Necessary Formalities for Travelling Abroad Certain customs or administrative formalities may need to be carried out before undertaking a train journey to a foreign country. Thus passengers are advised to contact the competent authorities in order to know precisely which customs or administrative procedures must be undertaken with said competent authorities (consulate, embassies or others) in order to satisfy requirements for crossing the border.

8.5 PERSONS WITH REDUCED MOBILITY SNCF and SNCF Voyages Italia commit to implement non-discriminatory rules as regards access for persons with reduced mobility. These ensure access to stations, platforms, rolling devices and other equipment. Station managers provide upon request the necessary assistance for getting on and off the trains, free of charge. Assistance in the train stations is available for persons with reduced mobility who notify it when purchasing their tickets or warn the station before their journey by calling:

• in France: at least 48h before the date of their journey, on +33 (0)890 640 650 (cost of a local phone call according to the rate applied by the operator) or by visitingwww.accessibilite.sncf.com;

• in Italy, for an international journey: at least 48h before the date of their journey, on +39 06 4881726 (Monday to Friday, from 7:00AM to 9:00PM, cost of a local phone call according the rate applied by the operator) or by [email protected] (for the Milan station) [email protected] (for the Turin station)

Past the time frame above, any request for assistance cannot be guaranteed. A special fare has been set up for persons accompanying Persons with Reduced Mobility. On the trains, a place has been specially designed for wheelchairs in 1st class, this is a movable seat, easier to use for disabled persons. The toilets have also been adapted to improve access.

Failing that, persons with reduced mobility commit to travel with the necessary assistance or accompaniment.

8.6 CLAIMS AND COMPLAINTS

8.6.1 Claims in the Event of Passenger Death or Inj uries In the event of a passenger's death or injuries, the person entitled to compensation must address in writing their claims pursuant to the carrier's liability to the carrier who was operating the transport service on the section where the accident occurred, that is (i) SNCF (whose contact details are indicated in article 1 herein) if the accident occurred on the Paris-Modane section of the French railway network and (ii) SNCF and/or SNCF Voyages Italia Srl (whose contact details are indicated in article 1 herein) if the accident occurred on the Modane-border section of the French and Italian railway networks, within twelve months from the moment when said person was informed of the damage.

8.6.2 Other claims Any other claims and complaints must be addressed to:

Legal action pursuant to the carrier's liability in the event of passenger death or injuries may only be brought (i) against SNCF when the latter was operating the transport service on the section where the accident occurred, and (ii) against SNCF and/or SNCF Voyages Italia Srl when the latter was operating the transport service on the section where the accident occurred.

Legal action for the recovery of a sum paid pursuant to the contract of carriage may be brought against SNCF.

Legal action for refunds, compensation for delays and any other legal actions pursuant to the contract of carriage may only be be brought against SNCF.

Legal action pursuant to the provisions of the contract of carriage on the transport of luggage and vehicles is governed by article 56 § 3 of the CIV. Should the person entitled to compensation be able to choose between SNCF and SNCF Voyages Italia Srl, their option right ends as soon as the legal action is brought against one or the other.

8.8.2. Competent Courts Legal actions pursuant to the contract of carriage may only be initiated before the jurisdictions of the member States of the Intergovernmental Organisation for International Carriage by Rail (OTIF) or of the EU State within which the defendant resides permanently or habitually, or has his/her main office or that of the subsidiary or company that concluded the contract of carriage. Actions cannot be initiated in any other jurisdictions.

Within the limitations of the applicable law, legal actions that are not pursuant to the contract of carriage fall under the competence of French courts.

8.8.3 Applicable Law Within the limitations of the applicable laws, French law shall apply. When the national laws of several States are applicable, only the laws of the State in which the right-holder exercises their rights shall apply, including rules concerning conflicts of laws.

9. PERSONAL DATA

In compliance with the legislation for the protection of personal data, when purchasing their tickets, passengers are informed and expressly agree that any and all data given by them when purchasing their tickets to which they agreed, shall be automatically processed by SNCF in order to (i) track the order and in general ensure the proper performance of the carriage service, (i) carry out marketing or statistic studies, (iii) as well as any promotion activities, and to enable SNCF and/or SNCF Voyages Italia Srl to process claims. 1. SETTING PRICES

1.1 CALCULATION OF TICKET PRICES

The total price for a ticket is calculated accordin g to the following elements: • the type of beneficiary(ies) [adult(s), child(ren)] • the number of beneficiaries • the route • the applied fare(s) • the comfort class of the car booked

1.2 INFORMATION ON PRICES Pricing information is available from the sellers (see Appendix1).

2. COMMERCIAL FARES Reservation is compulsory. Reservation is open 3 months before the date of the journey.

2.1. THE OFFER FOR THE GENERAL PUBLIC

• Beneficiaries: Any person may benefit from the Flexi +, Flexi, Standard, Eco and Mini fares. There may be 1, 2 or 3 price levels per fare (see the tables below). Some fares may not be applicable on certain days or with certain trains. For each of trains and seating category concerned, there are only a limited number of seats available with the conditions of the Mini, Eco, Standard and Flexi fares, depending on the availabilities usually observed. For the cheaper price levels, there are less seats available in any given train at the corresponding price. Mini fares are available outside of peak times, and must be booked in advance and up to 14 days before the departure date of the train.

2.2 THE OFFER FOR CHILDREN

• Beneficiaries: Children under 4 may travel for free provided they share a seat with an adult. Children under 12 benefit from a reduced fare (see tables below)

2.3 THE OFFER FOR PASS HOLDERS Passes are valid on this route (see details in the tables below) 2 types of Passes exist, these are both valid upon presentation of the following Passes:

o Type 1 Passes: InterRail Global Pass, Eurail Global Pass, Eurail France-Italy, Eurail Select Pass including France and Italy and France Rail Pass o Type 2 Passes: Eurail Select Pass including France, Eurail France-Benelux Pass, Eurail France-Germany Pass, Eurail France-Spain Pass, Eurail France-

Switzerland Pass, and InterRail France Pass.

2.4 THE OFFER FOR GROUPS • Beneficiaries:

Any group of at least 10 persons (or paying for that number), travelling together (single or return journey) may obtain a preferential Group fare. Specific fares apply for groups of children under 12. On certain trains and on specific days, should there be no seats available with the reduced-price Group fare, groups may obtain a collective ticket without any price reduction.

• Conditions of application of the reduction: Reductions apply for all trains and seat categories, except on certain days. Reductions apply within the limit of seats available with the different fares.

• Minimum payment: The minimum payment is equivalent to the price of 10 tickets with Group fares.

• Ticket validity period: Tickets must be used for the train and on the date indicated on the ticket.

• Request: The request for a collective ticket must reach SNCF at the latest 72 hours before retrieving said ticket. It must include the departure date of the journey, the service, the number and distribution of passengers per age range, the services included, one or several replacement solutions and the contact details of the group's representative.

• Comfort classes: Members of the group may travel in different comfort classes.

• Seat reservation: Seat reservation is compulsory with every train. SNCF processes the case and carries out the reservations. If the organiser applies through the rail station network, and their request is accepted, they shall pay the total amount of their journey immediately. If the organiser contacts the specialised network (Commercial Travel Agencies) the sales advisor shall transfer a "group" sales contract to the customer that indicates the travel conditions with prices and seats guaranteed for the group. This contract indicates the amount to be paid for confirmation. In order to confirm their request and the acceptance of their reservations at the indicated fare(s), travel date(s) and train(s), the customer must send the duly signed contract along with:

o a deposit within 15 calendar days from the date on which the contract was sent by SNCF, for journeys whose departure date is set in 45 days or more. This deposit is equivalent to 20% of the price of the journey.

o the whole amount of the journey price within the time-frame set out in the contract, starting from the date on which the contract was sent by SNCF, for journeys whose departure date is set in less than 45 days.

Should the deposit or total amount not be paid as stipulated in the paragraph above, the contract shall be considered as not having been concluded. The payment of the deposit (or total amount of the journey) along with the signed contract shall entail the customer's acceptance of the contract of carriage provisions without reservations. Should the customer cancel entirely the reservation request, SNCF shall keep the deposit.

o Up to D-90: without additional fees o between D-89 and D-30: deduction of an amount equivalent to 20% of the unit value of each cancelled seat. o between D-29 and D-8: deduction of an amount equivalent to 50% of the unit value of each cancelled seat. o From D-7: deduction of 100%.

D: departure date of the outwards journey. Increase in the number of passengers:

o The number of reservations may be increased subject to seat availability. o The fare granted depends on the availabilities. Failing this, a higher fare shall be applied according to the available seats. o Additional reservations are subject to the payment of a new deposit.

Total cancellation of reservations: SNCF shall keep the deposit as compensation.

• Refunds: Refund requests must be carried out at the latest 8 days before the departure date of the train. Percentages deducted from the amount to be refunded:

o between D-89 and D-30: 20 % per cancelled seat, o between D-29 and D-8: 50% per cancelled seat, o from D-7: deduction of 100%, tickets cannot be refunded.

1. SEAT RESERVATION

Passengers must reserve a seat. Reservation is included in the price of the ticket. Seats reservation enables passengers to choose in advance, when purchasing their tickets, where they wish to sit on the train, depending on seat categories offered on the train concerned and on the possibilities and situations of the seats. Depending on the sales channel, passengers may ask for the seat(s) they wish to reserve. Seats are attributed according to availabilities.

In certain trains, overbooked places "without a guaranteed seat" may be attributed to passengers. Indeed, sometimes trains declared full during reservation have nonetheless a few free seats at the time of departure, insofar as some customers have not turned up in time. The number of overbooked seats available is determined by SNCF according to the number of no-shows usually observed. The ticket issued thus has the indication "seat according to availability" (no seat number attributed). The corresponding fare depends on the comfort class and TGV train on which the journey shall take place. The attribution of an overbooked seat does not guarantee the possibility to occupy a seated place (regular or fold-up seat). Passengers must address the conductor who will undertake to attribute them an available seat.

2. DOGS AND SMALL DOMESTIC ANIMALS TRAVELLING WITH PASSENGERS

2.1. ADMISSION CONDITIONS No animals are normally admitted in cars used for transporting passengers, except for guide and assistance dogs. However , muzzled dogs that are kept on a lead with their owners and cats weighing less than 6 kilos, suitably shut in a pet-carrier no larger than 45 cm x 30 cm x 25 cm are tolerated if the other passengers do not object to their presence. No seats may be reserved for cats and dogs. Each passenger can travel with either 1 dog or 1 pet carrier. Any dog, cat or carrier above the authorised maximum number or size shall incur the payment of a 2nd class ticket with the Flexi+ fare.

2.2 AMOUNT TO BE PAID The amount to be paid is set out in Section 2, point 2.6 The price is calculated by taking into account the distance of the journey, whatever the class. Civilian disabled persons, holding a supporting document indicating a disability rate of at least 80 %, whatever the disability, may travel with a guide or assistance dog that shall travel for free and without a ticket . This provision also applies to invalid war veterans who hold a supporting document.

3. LUGGAGE 3.1 GENERAL During their journey, passengers may carry as hand luggage objects or personal belongings such as clothes, linens, toiletries, books or sports equipment, for travelling purposes. They are authorised to transport these items free of charge, with them, in the cars of the passenger trains. . Objects or belongings which are transported for commercial purposes and those destined to be sold are not admitted; if such transport was observed on-board a France-Italy TGV, the passenger shall have to pay a sum equal to the application of Géodis' General Freight Fare in force on the date of the transport. . The general terms and conditions for the carriage of luggage, applicable to all passengers, whether travelling alone or as a group, are set out in chapter 4. – Luggage - of Section 4. - Carriage-Related Services - of Passenger Fares. For safety reasons, passengers must never obstruct the aisles or compartment doorways with oversized or numerous luggage, in compliance with the modified Decree of 22 March 1942 on the railway police force. Thus the passengers are reminded that:

• group members must carry hand luggage whose packing, closing, size and weight enables it to be carried and stowed in the dedicated spaces of the passenger cars without difficulty, risk of damage or risk for the safety of other passengers,

• trunks and canteens shall not be admitted.

3.2 ACCEPTABLE HAND LUGGAGE On the trains, each piece of luggage must be identifiable as belonging to a passenger. It must be visibly labelled with the surname and first name of the passenger. Any non-identified object is considered as suspicious and may be destroyed by the competent services. Persons that do not satisfy this obligation may be subject to a fine whose amount is set out in the Price Listing, and they shall not be permitted to access the trains. For the comfort and safety of all passengers during the journey, only hand-luggage, stowed in the dedicated spaces, that you can easily carry unaided and without risk for other passengers, their luggage or yourself, shall be authorised on the trains. Accepted hand luggage can be suitcases, travel cases and backpacks, whose packing, closing, size and weight enable them to be carried and stowed in the dedicated spaces of the passenger cars, without difficulty, risk of damage or risk for the safety of other passengers, subject to the prohibitions and limitations of the modified Decree of 22 March 1942 on the Railway Police Force. More specifically, passengers must not obstruct the aisles or compartments doorways with oversized or numerous luggage. The following is also accepted as hand luggage under the same conditions set out above with one object per passenger only:

• bicycles, provided they are folded or the wheels are taken off, and that they are housed in covers no larger than 1.20 m x 0.90 m; specific provisions may however apply for groups;

• skis, folded children's pushchairs; • nautical boards with covers no larger than 1.20 m x 0.90; • manual or electric wheelchairs for persons with reduced mobility who may keep their wheelchairs with them whether they stay in them or not during the journey.

However, when the wheelchair cannot be embarked and/or installed in the passenger car due to its size, or in the event of a group trip, SNCF shall undertake to seek, for each case, any solution for transporting said wheelchair in the best conditions. In this respect, see article 8.5 herein concerning persons with reduced mobility. Loading and unloading luggage is carried out by the passengers and under their sole responsibility. Luggage remains in the sole custody of the passengers, even when these are stowed in the spaces intended for that purpose, located at each end and in the middle of the cars. During their journey, passengers may carry as hand luggage personal objects or belongings such as clothes, linens, toiletries, books or sports equipment, for travelling purposes. They are authorised to transport these free of charge, with them, in the cars of the passenger trains.

Objects or belongings which are transported for commercial purposes and those destined to be sold are not admitted.

Transportation of dangerous goods is governed by the Regulation concerning the International Carriage of Dangerous Goods by Rail (RID – Appendix C to the COTIF) and the CIT publications on the subject (www.cit-rail.org). Only substances and objects in their original packaging and destined for a personal or private use or for the practice of a leisure activity or sport are admitted. It is forbidden to carry arms and munitions on-board.

3.3 CHECKED LUGGAGE No checked-luggage service is offered.

3.4 FOUND OBJECTS Found objects must immediately be reported to the rail personnel. The contents of any hand luggage left without supervision may be inspected by the rail personnel. The latter is authorised to disembark these and destroy them should they themselves or the authorities deem it necessary for operating and passenger safety.

Objects found in stations and on trains are kept, in French railway stations at the found objects desk for two months , except for dangerous and perishable substances. Objects are restituted to their owners upon presentation of an identity document and against the payment of a 9 Euro restitution tax for administrative costs. Objects found and recovered in Italy are kept at the heard office of SNCF VOYAGES ITALIA in MILAN for 2 months (60 days) then transferred to the found objects desk in the Milan town hall. The transfer of these objects is carried out in compliance with the organisation set out in the regulation of the "found objects" desk of the Milan town hall. Objects with no value and perishable goods are not deemed found objects and may be destroyed. Any person able to give a description of the object and justify their identity shall be considered as being the owner of said object and may request its restitution.

From 1st January 1979, a centralised system for processing offences was set up within the railway police force. This automatised system has used a relational database since 1st March 1999, and aims to:

• record and investigate offence cases observed within the railway right-of-way by SNCF-certified agents to initiate legal proceedings; • ensure that each case's procedure is monitored; • add-up the transactional payments incurred in such files and draw conclusions for the next steps to be taken; • edit the documents authorising the legal proceedings or their interruption, to be used by the judicial authorities; • provide internal and external organisations with the necessary information for recovering debts that correspond to the civil prejudice suffered by SNCF due to the

offence.

- Article 2 The data on the penalty notice given to the offender on the French territory is stored in a relational database which makes it possible to cross-access data per offender and/or per penalty notice. This data includes:

• the offender's surname, first name, address, date and place of birth; • the identity document presented; • the type of offence and the place where it occurred; • the amount of the transaction.

Moreover, the database contains administrative information: • payments: amount, date and deposit branch code; • contacts; • intervening third parties; • life cycle phase; • judicial references.

• Travel Agencies of SNCF-authorised partners:
