KATE CAGLE Daily Press Staff Writer Pills promising better sex are at the center of a lawsuit filed against a dozen local liquor store owners as a Los Angeles-area law firm brings a multi-state legal threat to its hometown. The firm is repre- senting a Texas-based supplement company, Outlaw Laboratory, who says mom-and-pop store owners are profiting from products that secretly contain sildenafil, the active ingredient in Viagra. Suddenly, the convenience store owners find themselves deciding between a five-figure settlement or a protracted court battle. “It’s really a shadow pharmacy,” lawyer Robert Tauler said, whose firm, Tauler Smith, LLP, has filed nine lawsuits in four states regarding the pills, listing as many as 18 defen- dants in some cases. “Some people may knowingly understand this is going on and some maybe not.” The large pills are typically dis- played by the register and sold under various brand names including Rhino 8 Platinum 8000, ExtenZone 3000, Love Zen 3000, or Black Mamba Premium, according to court documents. In February, the Food and Drug Administration warned consumers not to purchase or use Rhino 7 Platinum 5000, citing sildenafil as an “undeclared ingredient” that “may lower blood pressure to dan- gerous levels” in people who take nitrates for various conditions, including diabetes, high blood pressure or heart disease. The FDA warned of a growing number of supplements with hidden drugs and chemicals. “These products are typically promoted for sexual enhancement, weight loss, and bodybuilding and are often represented as being ‘all natural,’” the FDA said. Pico NeighborhoodCulmination of Evaluation and Peer Review by the Accrediting Commission for Community and Junior Colleges

The Accrediting Commission for Community and Junior Colleges (ACCJC)—an institu-tional accrediting body recognized by the Council for Higher Education and the U.S.Department of Education—has reaffirmed Santa Monica College’s accreditation. TheACCJC took the action at its meeting June 6-8, 2018, the culmination of an evaluationprocess that lasted roughly two years after SMC went through a rigorous self-evaluation.

“At Santa Monica College, we take great pride in this accomplishment,” said SMCSuperintendent/President Dr. Kathryn E. Jeffery. “This news is an affirmation of the col-lege’s dedication to high standards of achievement. This accreditation ranking bestowsthe best possible outcome—for a full seven-year cycle, the maximum allowed. So whenstudents choose SMC, they know they’re making a great choice!”

Dr. Jeffery noted that a team including SMC Vice President of Academic Affairs Dr.Georgia Lorenz; Dean of Academic Affairs Erica LeBlanc; and Associate Dean of HealthSciences Eve Adler, among others, led the comprehensive college-wide self-evaluationprocess. The ACCJC requires that member institutions participate in an evaluation everyseven years and subsequently, be reviewed by teams of peer evaluators.

Barry Snell, Chair of the SMC Board of Trustees, said: “On behalf of the SMC Board, Iextend gratitude and congratulations to every Santa Monica College employee whose tire-less work is reflected not just in the self-evaluation report and this positive outcome, but,indeed, in SMC’s overall reputation as a leader among the nation’s community colleges.”

Snell added that the accreditation process was “a remarkable effort which called forin-depth analysis and institutional soul-searching, proving how a large and complex insti-tution can come together to work for a common goal: ensuring that students succeed.”

Following the submission of the self-evaluation report in August 2016, the ACCJC senta team of peer evaluators—who are selected for their expertise—for a “site visit” inOctober 2016. The commission notified SMC in February 2017 that accreditation wasbeing “reaffirmed for 18 months on the basis of a comprehensive evaluation”, whichmeant that SMC was deemed to be in substantial compliance. The college received a longlist of commendations—eight in total—which cited praise for the use of online educationplans, creative efforts in student transportation, increasing safety on campus, amongother things. Four recommendations were presented related to institutional policies,practices, and outcomes. College employees set about addressing the recommendations

made, and a follow-up visit took place in April 2018.The final decision of reaffirmation for the rest of the “accreditation cycle”—the next

comprehensive review will take place in fall 2023—was received via a letter from theACCJC dated June 13, which noted that Santa Monica College had met all of the recom-mendations and expressed “appreciation for the diligent work and thoughtful reflectionthat Santa Monica College undertook…”

As of Monday, July 2, the Memorial Park Fitness Room will open three hours earlier.Starting at 9 a.m. Monday – Friday, guests will be able to work out with a variety ofweight and cardio machines as well as free weights. Weekend hours and fees will notchange. Patrons may drop in, or purchase a monthly membership. Guests must be 16years of age or older to use the facility.

“The Memorial Park Fitness Room is an affordable, low key, no fuss gym," said Bradley Albert,Community Recreation Manager. "It has become more popular over the past year and we’rethrilled to be able to extend the hours of the space in order to serve more community members.”

Beginning July 2 the Fitness Room Weekday hours will be from 9 a.m. to 9 p.m.Monday through Friday. On weekends, the Fitness Room will be open from 1p.m. to 7 p.m.on Saturdays and Sundays.

The fees for adult Santa Monica residents will be three dollars for daily admission and$24 for monthly access. For older adults (50+) the fees will be one dollar and fifty-centsdaily and $12 for monthly access.

For non-Santa Monica adult residents, fees will be four dollars daily and $32 formonthly access. The fees for non-resident older individuals (50+) will be two dollars dailyand $16 for monthly access.

owned property. Local restaurant owners havecalled on the Chamber of Commerce and theCalifornia Restaurant Association to helpthem kill the proposal.

The City is the landlord for dozens ofbusinesses on the Pier, at the Airport, theThird Street Promenade and along thebeach, collecting about $4.5 million inannual revenue. Champions for an LPA inthe Council characterize the idea as a goodfaith bargaining agreement between restau-rant owners and unions to prevent strikesthat could impact city revenues.

At the Council’s request, City staff haslooked to similar requirements at major air-ports and school districts in place to avoiddisruptions where reliable food is a vital serv-ice. In advance of the meeting, staff has pre-sented Council with the example of a“default” LPA given to businesses at the SanFrancisco Airport. Under that agreement, therestaurant must provide any labor organiza-tion that asks with a complete list of theiremployees, their addresses, and phone num-bers. In return, the union will not strike,picket or boycott the restaurant. In SFO con-tracts, the employer agrees to voluntarily rec-ognize the outcome of any “card check” voteto unionize without a secret ballot.

Critics say the model allows the unionto coerce employees to vote to unionizesince their ballots are not a secret.Proponents say card checks help level theplaying field in an industry where employ-ers have all the power.

“Given the debate over these trade-offs,this report does not attempt to providedetailed objective analysis of the pros andcons of the Card Check procedure other thanto note that is has been in place for nearly twodecades at SFO - while acknowledging thereare significant differences between the con-cessions at an international airport and thoseembedded in our community at the Pier,SMO, the Third Street Promenade and theSanta Monica beach,” the report said.

Multiple restaurant owners tell the DailyPress LPAs give unions their foot-in-the-door to organize waiters, hosts and kitchenstaff inside their restaurants, potentiallychanging the model for mom-and-pop busi-nesses who have been here for decades.Local businesses already comply with SantaMonica’s Minimum Wage Ordinance, whichwill raise the hourly wage for their workersto $13.25 July 1 and mandate 72 hours ofsick leave for workers at businesses withmore than 25 employees.

“We feel it is unnecessary and unfair forthe city to target small, owner-operatedbusinesses,” said Jim Christel, who has runBack on the Beach Cafe with his partner andhusband, Fred Deni, for thirty years. Thehusband and husband team are tenants ofthe city. They worry an LPA would hurttheir tradition of hiring local teenagers fortheir first jobs and change the way they’vedone business for thirty years.

“We have waiters and waitresses who havebeen here over twenty years. We are a familyand the LPA or the union coming in couldchange that dynamic and create a more corpo-rate type of feeling,” Deni said. “It would cre-ate a barrier in the relationship with our staff.”

Without a history of work stoppages inthe city caused by strikes, some have becomesuspicious of the intention behind the LPAagreement. City leases already contain a pro-vision that prohibits interfering with aworker’s right to unionize.

“Consistent with its past practices, Local11 is using its sway with the City Council toadvance legislation that benefits its own bot-tom line,” said Luka Ladan, a spokesman forthe Center for Union Facts, a conservativenon-profit that has taken aim at the localhotel workers’ union. “It’s widely acknowl-edged that the ‘problem’ an LPA is supposedto solve is not, in fact, a problem in SantaMonica.”

The City Council will meet Tuesday, June26 inside Council Chambers at 1685 MainStreet, and will discuss public items no earli-er than 6:30 p.m.

His firm has sued up and down the sup-ply chain and across state lines. He says it isdifficult to go after the actual manufacturerin most cases, because the pills are typicallymade in China and then sold to individualbrick-and-mortar stores. Pills that wholesalefor $1 are sold at the register for $10, bring-ing in a handsome profit for store owners.Tauler claims he sent multiple warning let-ters before taking the mom-and-pop ownersto court in May.

“The problem is widespread and we’veissued many letters,” Tauler told the DailyPress. “Our goal is to eliminate the productsfrom the marketplace.”

But the owner of Broadway Wine andSpirits says he never received a warning.Instead, about six months ago Joe Greenreceived a letter by certified mail saying hecould settle for $10,000 or face a lawsuit.Green’s distributor, Basc CommunicationsCorp, told him the letter was a scam andencouraged him to keep stocking the pills.An employee for Basc told the Daily Pressthey buy the pills at a warehouse inDowntown Los Angeles and maintain theyare safe and that the lawsuit is a scam.

“The only letter we got was the first onethat said ‘give me ten thousand dollars orwe’re suing you,’” Green said. Green, whohas run the family-owned business with hiswife, Lisa, for the last fifteen years, said theprocess felt like a shakedown. He has pulledthe products from his shelves, which were allmarked “made in the USA” and containedother claims like “100% genuine” and“Manufactured in a FDA-Registered Facility.”

Green said Basc even sent him a letterassuring him the products were legitimate.The lawsuits caught him and other family-run businesses off guard and they are hesitant

to pay the tens-of-thousands of dollars toretain a lawyer. Green says small businessowners rely on the manufacturers and dis-tributors to make sure their products are safe.

“How are we supposed to know? Am Isupposed to go to the FDA ban list every dayand check for products?” Green said.

USC business ethics and product liabilityexpert C. Kerry Fields said California lawallows competitors and customers to suestore owners for false advertising if productscontain secret ingredients. Most liabilityinsurance policies do not cover false adver-tising claims, so store owners should be cau-tious when stocking products that could leadto lawsuits, according to the professor.

“Any goods that are not distributed bylarge, nationally recognized retailers shouldprobably be given a second and third lookbefore they go on the shelves,” Fields said.“There may be a good margin selling thoseproducts but it’s not worth the risk becausethey are representing to the public that theirgoods are safe.”

Fields said the store owners would bewise to settle quickly and then file a reim-bursement claim against the distributor forproviding a faulty product.

“Consumers might sue them as well soit’s best to suppress litigation as quickly aspossible,” Fields said.

The plaintiff in the lawsuits, Texas-basedOutlaw Laboratory, sells a sexual perform-ance product called “TriSteel 8 Hour” thatthey claim is all natural. A customer servicerepresentative for Outlaw told the DailyPress to contact the law firm for all questionsregarding the company and the lawsuits.

Tauler, the lawyer bringing the lawsuits,specializes in supplement litigation and wor-ries the defendants are getting bad legaladvice. He compared ignoring his letters andlawsuit to ignoring a tumor on your neck.

“We want them to know it’s really seriousand what they’re doing is putting people indanger but for some reason, it doesn’t click,”Tauler said.“They have to bear some respon-sibility for what they’re selling.”

Intelligence (AI) is being used to fight cli-mate change and otherwise protect theenvironment?

ARTIFICIAL INTELLIGENCE (AI), DEFINED ASthe capability of machines to imitate intelli-gent human behavior and learn from data, isconsidered by many to be the final frontierof computing. And environmentalists andtech companies are now harnessing thepower of AI to service to the environment.

To wit, Microsoft announced in December2017 that it is expanding its “AI for Earth” pro-gram and committing $50 million over thenext five years to put AI technologies in thehands of individuals and organizations work-ing to solve global environmental challenges,including climate change as well as water, agri-culture and biodiversity issues. Lucas Joppa,Microsoft’s first Chief EnvironmentalScientist, is convinced that AI is now matureenough and the global environmental crisisacute enough to justify the creation of an AIplatform for the planet. “I believe that forevery environmental problem, governments,non-profits, academia and the technologyindustry need to ask two questions: ‘How canAI help solve this?’ and ‘How can we facilitatethe application of AI?’,” Joppa said.

The older, but rapidly growing project,eBird, has been demonstrating the power ofcoupling human observers with AI algo-rithms to provide a source of reliable data forscientists and environmental decision mak-ers. Based out of Cornell University’s Lab ofOrnithology, eBird engages a global networkof bird watchers to identify bird species andreport their observations through the eBirdwebsite or mobile app. Due to the variabilityin the observations the volunteers make, AIfilters observations through collected histor-ical data to improve accuracy. And now with

over 500 million bird observations recordedthrough this global database, Microsoft’sAzure Cloud Computing Program is helpingto allow calculations that used to takeupwards of two to three weeks to now beaccomplished in only hours.

California’s One Concern is utilizing AItechnology to identify and mitigate futurerisk stemming from natural disasters. Lastyear, natural disasters caused a record-breaking $300 million in damage in the U.S.alone. One Concern’s platform can predictthe impacts of climate change-driven events,and disasters such as earthquakes, floods andfires at a high degree of resolution and accu-racy so that communities can better prepareand respond. Damage from an earthquakecan be predicted with 85 percent accuracywithin 15 minutes, and flood damage is pre-dicted days ahead of storms.

Lastly, whale field research is being revo-lutionized by AI and drone technologies.“SnotBot,” which doesn’t exactly soundsophisticated, uses drones which allow avastly different approach to whale research,flying well above the surface of the waterwhere the whales are never touched orapproached closely. Snotbots hover above asurfacing whale and collect the blow (or“snot”) exhaled from its lungs, then returnback to researchers about a half mile away.Blow samples reveal a vast amount of bio-logical data, including stress hormones andenvironmental toxins. Prior to SnotBot, datasamples of wild whales were gathered byshooting sampling darts from crossbowsinto the mammal from a loud boat.

“It’s not just all about Silicon Valley build-ing cool Silicon Valley things,” says Parley’sIan Kerr who managed the SnotBot program.“It’s how AI could actually help us save theplanet and solve scientific mysteries.”

The trans-action was declined causing the subject to become more enraged. The subject punched adisplay case causing it to shatter. The subject exited the store with the security guard fol-lowing him. Downtown Santa MonicaThe Los Angeles County Agency achieves National Committee for Quality Assurance Accreditation for Case Management for Long-Term Services and Supports

WISE & Healthy Aging, a nonprofit organization serving older adults and their familiesand caregivers throughout Los Angeles County, is one of three community-based organ-izations in California earning a three-year, nationally recognized accreditation for coor-dination of long-term support for senior clients.

The National Committee for Quality Assurance, (NCQA) a nonprofit that accredits andcertifies a wide range of health care organizations, launched a pilot program in 2016 tostandardize, measure and improve the quality of care provided to older adults and otherswho need long-term supportive services. WISE & Health Aging joined the program as an“early adopter” and is now among the first organizations in the nation to receive the newaccreditation for Case Management for Long-Term Services and Supports (CM-LTSS).

“The achievement of this accreditation recognizes the dedication of our WISE &Healthy Aging professionals and staff who work tirelessly on behalf of our commu-nity,” said Grace Cheng Braun, president and CEO of WISE & Healthy Aging.“Accreditation is not an end in itself, but a means to an end – supporting olderadults in Los Angeles County as they live as independently as possible and age inplace in their homes.”

Melanie Gironda, MSW, PhD, WISE & Health Aging’s director of CareManagement, said the agency has offered in-home case management for more thanfour decades, but providers of long-term supportive services have always had todesign and implement their own programs, often with no means to objectivelymeasure quality or results.

“The NCQA accreditation process provides a road map for the development of pro-grams and includes standardized measures for evaluating them. These tools are help-ing agencies across the nation improve long-term supportive services in their commu-nities,” she said.

Accreditation is open to agencies with aging and disability resource centers, centersfor independent living and or organizations that coordinate long-term services and sup-ports for people who have difficulty with self-care tasks as a result of aging, chronic ill-ness or disability. These may include help with bathing or cooking, arranging transporta-tion to doctor’s appointments, paying bills or performing other day-to-day activities.Coordination of these services – case management – is vital to supporting people whowant to live independently at home.

NCQA says the fragmented nature of the health care system can be especially chal-lenging for people who need long-term support – and the need for that support is grow-ing as the population ages. Accreditation is designed to help organizations become moreefficient, integrate care better, provide person-centered care and support agencies asthey contract with service providers, health plans and other entities to meet the needsof clients.

“Accreditation improves our standing to contract with health plans and serviceproviders because it signifies that WISE & Healthy Aging can be considered a trustedpartner that meets the highest quality standards and adheres to ‘best practices’ toachieve optimal success,” Cheng Braun said.

Santa Monica College (SMC) presents its annual festival “Celebrate America” — a star-spangled salute to our nation’s independence — on Saturday, June 30. Admission to thepopular entertainment and fireworks spectacular is free.

The celebration – the only one of its kind in Santa Monica – will feature a daz-zling fireworks show by Rialto-based Pyro Spectaculars Entertainment. Live musicincludes performances by the lively Top Shelf Brass Band, the popular DJ DiscoShrine who plays all the hits with a contemporary edge, and a special appearanceby the Santa Monica-based dance group LA Follies. Pico NeighboorhoodSanta Monica College (SMC) is choosen to participate in the 2018-2019 OpenStax Institutional Partnership Program

After undergoing an application process, SMC was chosen as one of nine out of 31institutions to receive individualized consulting from OpenStax—an initiative of RiceUniversity and supported by philanthropic foundations including the Bill & Melinda GatesFoundation, Michelson 20MM Foundation, Google Inc., among others—and join a cohort ofschools advocating widespread use of OER at their schools. The 2016-2017 cohort ofpartner schools saw a 150 percent increase in student use of OER in the 2017-2018 aca-demic year, saving an additional 50,000 students $4.9 million.

“Santa Monica College is committed to providing an accessible, high-quality educationto those seeking better prospects for themselves and their families,” said Dr. Kathryn E.Jeffery, SMC Superintendent/President, “and while the cost of tuition at community col-leges may not be a deterrent, the cost of textbooks can definitely be an obstacle forthose struggling financially. So we are thrilled that OpenStax has provided us with anavenue to ensure that we are providing the greatest possible access to learning materi-als—thereby increasing the likelihood of success for our diverse student body.”

The cost of traditional textbooks—an average of somewhere between $600 and$1,400 per student each year, according to studies by the National Association ofCollege Stores and the College Board—can often put finanical pressure upon stu-dents. Open educational resources, including the free, peer-reviewed textbooksoffered by OpenStax, eliminate cost barriers for students and allow unrestricted,immediate access to learning materials, increasing the likelihood that students willcomplete their courses.

“We’re very excited to be partnering with Santa Monica College on their efforts toincrease student success and faculty academic freedom through the use of OER,” saidNicole Finkbeiner, associate director of institutional relations at OpenStax at RiceUniversity. Finkbeiner will work closely with the selected institutions to develop institu-tion-specific strategic plans to encourage the use of OER on their campuses.

“SMC’s application for the OpenStax Institutional Partner Program stood out due tothe dedication and passionate support from all areas of the college for the OER initia-tive,” she added.

The new restaurant inches closer to thebeach, and thus the tourist bubble in theheart of Santa Monica, with its new locationat 9th and Broadway. It still has a so-called‘taco shack” with a quick service menu fea-turing fish, shrimp, scallop and tofu tacos($4-$5). The restaurant also added chickenand steak after popular demand.

The corner shack also brought back a fanfavorite - the cauliflower tostada ($5.50). In thisinterview, the duo revealed the secret ingredi-ent behind the addictive flavor: fish sauce, giv-ing the tostada a hint of umami flavor.

“You try to do what you can withoutmaking things too weird,” Snukal said.“Sometimes weird is great if it’s just a littlebit. You don’t want a lot of weird. That’s myexperience.”

“Approachable would be the word Iwould use,” Mittleman interjected. “Youmight not know why you’re having that feel-ing of ‘I need to eat more of this.’”

“An older Japanese chef has been teachingme these things,” Snukal said. “His explana-tion was that the only pure form of umamiis breast milk. A baby doesn’t want any otherflavor. It is the most nourishing and warm-ing. If you can capture that feeling, you’rethe best chef in the world.”

Snukal has plenty of room to experi-ment in his new, full-size kitchen, and adinner menu to match. Those who comeafter 4 p.m. can order lobster, albacore,and squash blossom tacos ($6 to $9), sal-ads and plates ranging from red snapper($24) to pig’s head ($65), among otheritems. Many of the dishes would not havebeen possible to cook in the crampedspace of the former location.

“The thing that’s nice is I get to do somestuff that isn’t in the very, very affordablerange,” Snukal said. “I get to use some thingsthat are interesting like live scallops, live lob-ster, anything that super fresh and expensive.

Honestly, I would have gotten people sicktrying to do it without air-conditioning.There were a lot of little things that hinderedforms of expression or creativity that don’texist here, so that’s the fun part.”

While they get used to the new, largerlocation, the duo welcomes feedback fromlocal fans. If you ask for something, chancesare you’ll get a ‘yes’ from Mittleman.

“I came from five-star fine dining hotelswhere you weren’t allowed to say ‘no,’” saidthe former manager of the iconic PoloLounge at the Beverly Hills Hotel. “If some-one said, ‘Do you have this?’ and you didn’thave it, you went to the store and bought itfor them. It’s always ‘yes.’”

Mittleman hopes his fellow SantaMonicans will give Punta Cabras a resound-ing ‘yes’ in return.

Punta Cabras is open seven days a weekfrom 11 a.m. to 10 p.m. (11 p.m. on Fridayand Saturday), with dinner service begin-ning at 4 p.m.

Santa MonicaAnnouncing Roger Kalia as Orchestra Santa Monica’s New Music Director

After a five-month long search and evaluating many fine candidates, Orchestra SantaMonica (OSM) is proud to introduce Roger Kalia as its new Music Director and Conductor.He will be starting his duties with OSM this upcoming 2018-2019 season and is planningseveral concert programs for the community. At present, Kalia is entering his fourth sea-son as Assistant Conductor of the Pacific Symphony and Music Director of the PacificSymphony Youth Orchestra. Kalia also serves as Co-Founder and Music Director of theLake George Music Festival in upstate New York, which was recently featured in theLeague of American Orchestra’s Symphony Magazine as one of the premier summer clas-sical music festivals in the country. Earlier this month he was announced as one of the2018 recipients of The Solti Foundation U.S Career Assistance Award, which is the fore-most organization in the United States dedicated exclusively to helping young conductors.

“I am thrilled to have been named the next Music Director of Orchestra SantaMonica,” says Kalia. “I am looking forward to working with its wonderful musicians andBoard and leading the orchestra into its next chapter. By performing exciting repertoire,both old and new, and creating unique community collaborations, we are going to reachout to a wide-ranging audience and make our concerts the most welcoming and invitingplace for classical music in Santa Monica.”

Three concert dates for OSM’s 2018-2019 season have been confirmed at the MossTheater: Oct 7, 2018; Feb 17, 2019; and May 26, 2019.
