Annexation Agreement Provisions:B2 Unless designed and constructed by others, Miltenberger shall

design and construct the following improvements, at no cost tothe City. The timing and necessity of the improvements shall bedetermined at the time of individual development applications,with the exception of any specific timing requirements notedherein.

B2a Lincoln Avenue (US 287) - construct adjacent portion tomeet City standards for a 6-lane arterial, with the exceptionof sidewalk on the west side.

B2b 14th Street SE (SH 402) - construct from Lincoln Avenue toapproximately one-half mile east of Boise Avenue to meetCity standards for a 4-lane arterial, with the exception ofconstructing any off-site sidewalks. Design and constructionfor the adjacent portion shall be completed prior toissuance of any building permits in the South Village FirstAddition. (Does not mention date for completion of theremainders).

B2c St. Louis Avenue (CR13) - construct the adjacent portion tomeet City standards for a major collector, with theexception of sidewalk on the east side.

B2d 19th Street Southeast - construct from Lincoln Avenue to theeast boundary of the South Village First Addition to meetCity standards for a 2-lane arterial street. Design shall becompleted prior to issuance of any building permits in theSouth Village First Addition. Construction of the portion fromLincoln Avenue to the Internal East-West Collector shall becompleted prior to issuance of any building permits in theSouth Village First Addition.

B2e Internal East-West Collector - construct an east-west streetconnection from 19th Street SE to St. Louis Avenue to meetCity standards for a minor collector street. Design andconstruction shall be completed prior to issuance of anybuilding permits in the South Village First Addition.

B2f Internal Collector to South Boundary - construct anorth-south street connection from 19th Street SE to thesouth boundary of the addition to meet City standards for aminor collector street. Design shall be completed prior toissuance of any building permits in the South Village FirstAddition.

B2g Other improvements - Intersection Improvements and anyother improvements associated with the traffic impacts ofindividual development proposals.

E Annexation Conditions. The following Annexation AgreementConditions shall apply to Miltenberger, Hazen and Atherton.

E3 Future development applications within the South VillageFirst Addition shall fully comply with the City of LovelandTransportation Plan, adopted July 2000, and any updates ineffect at the time of application.

E4 All public transportation improvements within the SouthVillage First Addition shall fully comply with the LarimerCounty Urban Area Street Standards, adopted in January2001, and any updates in effect at the time of application.

E5a Lincoln Avenue (a.k.a. - U.S. Highway 287) - width ofright-of-way east of the section line as determinedby the Colorado Department of Transportation, shallbe dedicated by Miltenberger prior to, orconcurrent with, the first development applicationwithin the South Village First Addition.

E5b 14th Street South-East (a.k.a. - Highway 402) -75-foot width south of the section line, shall bededicated by the annexation map or by separateinstrument with the annexation. Miltenberger shallcomply with this condition at the time of annexationof the Property. Hazen and Atherton shall complywith this condition upon development of theirproperty as defined by the City of Loveland SiteDevelopment Performance Standards andGuidelines adopted by the City in Chapter 18.47 ofthe Loveland Municipal Code.

E5c St. Louis Avenue (a.k.a. - County Road 13C) -40-foot width west of the quarter-section line, shallbe dedicated by Miltenberger by the annexationmap or by separate instrument with the annexation.

E5d 19th Street South-East - 100-foot width from westboundary to the east boundary in approximatealignment with the existing 19th Street SW, shall bededicated by Miltenberger prior to, or concurrentwith, the first development application within SouthVillage First Addition.

E5e East-West Minor Collector Street - 60-foot width from19th Street SE to St. Louis Avenue, shall bededicated by Miltenberger prior to, or concurrentwith, the first development application within theSouth Village First Addition. Alignment shall be suchthat legal access is provided to the Hazen andAtherton properties.

E5f North-South Minor Collector Street - 60-foot widthfrom the future 19th Street South-East to the southboundary of the South Village First Addition shall bededicated by Miltenberger prior to, or concurrentwith, the first development application within theSouth Village First Addition.

E6 If development of the parcel to the south precedesdevelopment of the South Village First Addition,Miltenberger shall dedicate right-of-way to the City, at nocost to the City, for a street connection from the southboundary of the Property to the intersection of LincolnAvenue and 19th Street SE to provide access from thatdevelopment to US 287. (This is the right-of-way referredto in section E.5.f of this Agreement and a portion of theright-of-way referred to in section E.5.d).

E7 If off-site right-of-way are needed for the construction oftransportation facilities required to meet City ordinances,the Owner shall submit documentation satisfactory to theCity Attorney establishing the Owner's unrestricted abilityto acquire sufficient public right-of-way for theconstruction and maintenance of such facilities. TheOwner shall submit such documentation at thepreliminary stage of any site-specific development planprior to public hearings, and then shall submit the actualdeed of dedication, recorded, at the final stage of theproject, prior to City approval. The applicable Ownersagree to acquire and dedicate such right-of-way at nocost to the City. This condition shall apply to Hazen andAtherton at the time of redevelopment of their propertyas defined in the City of Loveland Site DevelopmentPerformance Standards and Guidelines adopted by theCity in Chapter 18.47 of the Loveland Municipal Code.

E8 At such time that Hazen and Atherton propertiesredevelop as defined in the City of Loveland SiteDevelopment Performance Standards and Guidelinesadopted by the City in Chapter 18.47 of the LovelandMunicipal Code, they shall close their access drivewaysfrom 14th Street SE provided that alternative access hasbeen constructed.

E9 Owners shall dedicate a 25-foot wide utility easementadjacent to the right-of-way to be dedicated for 14thStreet SE (a.k.a. - State Highway 402). This easement shallbe dedicated by Miltenberger prior to or concurrent withthe first site specific development plan approved in theSouth Village First Addition. This condition also applies tothe Hazen and Atherton properties, upon theredevelopment of the property as defined in the City ofLoveland Site Development Performance Standards andGuidelines adopted by the City in Chapter 18.47 of theLoveland Municipal Code.
