Ferguson Planning is a Chartered Town Planning Consultancy established by Tim Ferguson, MA (Hons), MRTPI (Director & Owner) in 2012. The practice is based in the Scottish Borders with a working remit that covers: Scotland, Northern Ireland and the north of England. A complete Town Planning, Engagement and Design service is provided to public and private sector clients.

The practice brings with it over 15 years of experience in both private and public sector commissions. We have successfully led the management and delivery of numerous complex small and large scale projects across the UK.

TOWN PLANNING GUIDANCEThe main legal procedures for dealing with planning applications (in Scotland) are set through the Town and Country Planning (Scotland) Act 1997, the Planning etc. (Scotland) Act 2006 together with the Town and Country Planning (Development Management Procedure) (Scotland) Regulations 2013 and the Town and Country Planning (Hierarchy of Developments) (Scotland) Regulations 2009. The legal process is then further supported by a raft of Planning Circulars and Planning Advice Notes on matters ranging from Masterplanning to Environmental Impact Assessments.

PLANNING STRATEGY & DEVELOPMENT APPRAISALPrior to the outlay of costs by any client we believe it important to give all clients an open and honest assessment on the prospects of achieving planning permission. This will include identifying constraints and opportunities, applying the planning policy context and advising on the best approach for obtaining planning permission should we deem it worthy of pursuing.

We have been working with Tim over the past couple of years in a variety of commercial projects in Scotland and Northern Ireland. Each project varied in its complexity and scale with some very delicate issues. Ferguson Planning took full control of the planning process, liaising with all the design team, consultants and end users while always keeping us fully up to date of progress.

Tim’s commercial awareness meant that every decision was made with cost in mind so that the project could be delivered within budget. PLANNING APPLICATIONSFilling out a planning application form is a simple process but the management of the wider process and co-ordination of supporting documentation is not always so straight forward. Ferguson Planning has vast experience in the successful management, submission and negotiation of all the relevant planning application types. We often would take the lead role in managing other specialist inputs required; including Architects, Urban Designers, Transport Planners, Environment Consultants, Planning Lawyers.

PLANNING APPEALSWhile we strive to achieve planning permission via the normal application process sometimes it is not always possible. Should this be the case we can advise clients on the prospects of achieving planning permission by way of planning appeal. Should the client wish to proceed with the appeal we can guide and represent the client during the appeal process be that by Written Submission, Hearing, or Public Inquiry.

PROJECT MANAGEMENTFerguson Planning are often asked to assist in bringing project teams together and to lead the overall project management through the planning process. We believe in using consultants that we have worked with in the past and have a strong track record in delivering an excellent service to the client. As project managers we always seek to ensure that all complex development matters are addressed and that we work with local authorities to ensure they have all the necessary information required prior to determination of any planning application.

DEVELOPMENT PLAN REPRESENTATIONSThe planning system seeks pro-active and early engagement on development proposals and asks that, where possible, landowners and developers engage in the consultation process related to Strategic and Local Development Plans. We have vast experience in consulting with Local Authorities and making representations to Development Plans. It is vital that an informed and clear case is put forward for the reallocation of land uses. Engaging in the Development Plan process and achieving a successful outcome can provide greater certainty to the developer on receiving planning permission and can often shorten the time period the Local Authority takes in determining the relevant application.

PUBLIC SECTOR STUDIES & RESEARCHWe have detailed experience in undertaking public sector studies and research. Particularly with regard to town centre regeneration and retail capacity studies.

COMMUNITY ENGAGEMENTPlanning applications that have been categorised as being ‘Major’ (eg. over 2 Ha or 50 houses) require a formal public consultation exercise to be undertaken and which must inform part of the overall planning application package. Ferguson Planning has taken the lead role in many major planning applications and in the running of public consultation events that seeks to provide local communities with greater detail on the proposed development and to answer any questions they may have.

DESCRIPTION

Delivery of planning permission for a 100,000 sq.ft. Sainsbury’s Supermarket as part of a new urban expansion to the south of Ayr.

The project involved providing retail planning strategy advice to the client, undertaking an in-depth Retail Impact Assessment and related negotiations with South Ayrshire Council and their appointed retail consultant.

Further to this we also achieved permission to expand the non-food floorspace, via a Section 42 application, the first to exceed the Local Plan’s 10% non-food floorspace restriction.

DESCRIPTION

Ferguson Planning assisted the landowner in securing a developer to take forward a proposal that would represent one of the largest solar farm developments in Scotland. Ferguson Planning has assisted in coordination of the project team and is currently leading the overall planning process.

The site extends to some 90 acres and would involve the installation of some 76,000 photovoltaic solar arrays, together with associated infrastructure capable of producing a renewable energy output of c. 20 megawatts. This equates to powering in the region of c.7,000 homes per annum.

The site is located opposite the Galashiels Community Recycling Centre on the towns north eastern outskirts with the application soon to be under consideration by Scottish Borders Council.

CAERLEE MILL

DESCRIPTION

Caerlee Mill was one of Scotland’s oldest water powered textile mills and, as such, great thought and effort went into the overall masterplanning of the site and related planning and listed building applications.

We worked closely with the client, architect and Scottish Borders Council in coming up with a proposal that sought to retain the key listed buildings in the form of a ‘Mill Quarter’ but to then clear the remainder of the site to allow the creation of c. 35 new residential dwellings. The intention being that the residential element would assist in cross funding the retained mill buildings.

Planning and listed building permissions were received early in 2015 with site demolition together with wind and water tights works to listed buildings already undertaken. Work on the detailed house design is now well underway.

KATIE SCOTT RACINGClient Scott Family

DESCRIPTION

Ferguson Planning was instructed to try obtain planning permission for a single residential dwelling at Millhaugh Stables. This was to allow Katie Scott, a well respected point to point race horse trainer, to obtain her full race horse jockey licence.

Following the submission of the relevant planning application and business case numerous detailed negotiations were undertaken with ultimately planning permission granted in 2014.

The Scott Family have now completed the dwelling and Katie has obtained her full jockey licence in time for the 2015/16 racing season.

MASTER PLANNING

FORDEL VILLAGE

Location Fordel by Dalkeith

DESCRIPTION

Lead project management and planning role in the masterplanning of a new rural village of the Fordel Services located on the outskirts of Dalkeith.

The commission involved detailed input to the overall design/site layout, co-ordination of project team and ultimately the planning application for the development of 60 new residential dwellings together with a central village green and upgrade of existing site facilities.

Planning permission was received in 2014 with Ferguson Planning also involved in introducing the preferred Housebuilder to the site and who is now looking to develop the site in the very near future.

FORMER CO-OP NGT SITE

Location Selkirk

DESCRIPTION

Ferguson Planning was approached by Oregon Timber Frame to assist in negotiating a successful outcome to their planning application for the redevelopment of the former NGT Warehouse into a timber factory as part of their Headquarter expansion plans.

The development represents an economic investment of some £1.5 million and the creation of 70 new jobs. Following detailed discussions with the Council on a variety of planning matters the proposal was granted in Summer 2015.

Tim established Ferguson Planning back in 2012 following working in the private sector for over thirteen years. Tim has been responsible for the overall growth of the company with varying projects across Scotland, Northern Ireland and North of England.

Tim acts for a wide range of private and public sector clients and in a variety of development sectors ranging from housing and retail/commercial to renewable energy and rural development . He regularly leads multi-disciplinary teams, advises on the best development strategy and has successfully secured many complex projects across the UK.

He is also a volunteer to charities such as PAS and Energise Galashiels and responsible for managing two members of staff who assist greatly in the running of the practice.
