APRIL 23, 2019

A. CALL TO ORDER District Manager Armando Silva called the April 23, 2019, Special Board Meeting of the Fontainbleau Lakes Community Development District (the “District”) to order at 6:38 p.m. in the Las Ramblas Clubhouse Conference Room located at 9960 NW 10th Terrace, Miami, Florida 33172. B. PROOF OF PUBLICATION Mr. Silva presented proof of publication that notice of the Special Board Meeting had been published in the Miami Daily Business Review on April 12, 2019, as legally required. C. ESTABLISH A QUORUM Mr. Silva determined that the attendance of Chairperson Timothy Toy, Vice Chairperson Yvette Sanchez Bergamo and Supervisor Luis Gonzalez constituted a quorum and it was in order to proceed with the meeting. Staff in attendance were: District Managers Armando Silva and Nancy Nguyen of Special District Services, Inc.; and General Counsel Scott Cochran of Billing, Cochran, Lyles, Mauro & Ramsey, P.A. Others in attendance were: David Graybill of Affinity Management Services, Doral, Florida; Humberto Jovanovic, Miami, Florida; Carlos Sulbaran, Miami, Florida; Amaya Arenillas, Miami, Florida; and Jenry Henriquez, Miami, Florida. D. CONSIDER APPOINTMENT TO FILL VACANCY: SEAT #4 Mr. Silva stated that there was a vacancy in Seat #4 (4-year term) and asked if there were any interested persons who would like to serve on the Board of Supervisors (the “Board”) of the District. Mr. Humberto Jovanovic, a resident of the District and a citizen of the United States, stated that he would like to serve on the Board. A discussion ensued after which: A motion was made by Mr. Gonzalez, seconded by Mr. Toy and unanimously passed to appoint Humberto Jovanovic to serve the remainder of the unexpired 4-year term of office in Seat #4, which term of office expires in November 2022. Mr. Silva, Notary Public in the State of Florida, administered the Oath of Office to Mr. Jovanovic and reminded the newly appointed Board Member of his duties and responsibilities as a Board Member with emphasis on the Sunshine Law, Financial Disclosure (2018 form 1 must be completed and mailed to the Supervisor of Elections in the County of residency within thirty {30} days of appointment) and the Code of Ethics for Public Officials. E. ADMINISTER OATH OF OFFICE AND REVIEW NEW BOARD MEMBER DUTIES & RESPONSIBILITIES

See above actions taken. F. RE-ELECTION OF OFFICERS (AS REQUIRED) Mr. Silva stated that as a result of the recent changes to the District Board it would be in order to re-elect officers. The following slate of names was provided for election:

• Chairperson – Timothy Toy • Vice Chairperson – Yvette Sanchez-Bergamo • Secretary/Treasurer – Armando Silva • Assistant Secretaries – Luis Gonzalez, Edward Aparicio, Humberto Jovanovic, Neil Kalin and Gloria Perez

A discussion ensued after which: A motion was made by Mr. Toy, seconded by Mr. Gonzalez and unanimously passed to elect the officers as listed and stated above. G. ADDITIONS OR DELETIONS TO THE AGENDA Mr. Silva requested to include the following topic for discussion:

Discussion Regarding Dog Park and Playground for Las Sevillas The Board acknowledged the requests and stated that the aforementioned item would be discussed after agenda item K.5. H. COMMENTS FROM THE PUBLIC FOR ITEMS NOT ON THE AGENDA There were no comments from the public for items not on the agenda. I. APPROVAL OF MINUTES

1. December 18, 2018, Regular Board Meeting

Mr. Silva presented the minutes of the December 18, 2018, Regular Board Meeting. There being no changes or corrections, a motion was made by Ms. Sanchez-Bergamo, seconded by Mr. Gonzalez and passed unanimously approving the minutes of the December 18, 2018, Regular Board Meeting, as presented. J. OLD BUSINESS 1. Update Regarding Playground Solar Lighting Project – Las Ramblas Mr. Silva advised that Arking Solutions had completed the installation of the four (4) solar light poles for the playgrounds within the District and that the permit had been officially closed. Mr. Gonzalez stated that the illumination of the solar lights are dim during the night and do not properly illuminate the playgrounds like regular lights. Mr. Silva stated he would inquire with the contractor regarding this matter and would provide an update at an upcoming meeting.

2. Update Regarding Installation of Traffic Calming Devices Mr. Silva advised that District Field Staff had inquired with several contractors regarding potentially raising the height of the current speed humps to the maximum height of 3”. The consensus around the industry is that placing an extra layer of asphalt on the existing speed humps would not last too long, as the newly poured asphalt would not bond to the existing asphalt as well as it would a surface that was milled. As a result, Mr. Silva provided the following proposals for the removal of thirteen (13) existing speed humps and construction of 13 new speed humps at the same locations and four (4) additional speed humps in new locations.

PE-Services LLC: $11,380 Driveway Maintenance, Inc.: $13,998 Precise Stripes LLC: $19,900

Mr. Silva also clarified that the proposal did not include signage, as the District obtains a better rate on the purchase of signage when compared to the contractors. A discussion ensued after which; A motion was made by Mr. Gonzalez, seconded by Ms. Sanchez-Bergamo and unanimously passed approving the PE-Services LLC proposal for the removal of 13 existing speed humps and construction of 13 new speed humps at the same locations and 4 additional speed humps in new locations for an amount not to exceed $13,000; and further authorizing District Counsel to compose a small project agreement between the District and PE-Services LLC; and further authorizes District Manager to execute the small project agreement on behalf of the District. 3. Discussion Regarding Parking Enforcement and Towing Mr. Silva distributed a copy of the proposed Amended District Parking Rules to the Board Members. The District Parking Rules had been modified by District Counsel to include several items that were presented in the Fontainebleau Lakes Single Family Homes West Homeowners’ Association (the “Las Ramblas Association”) Parking Rules (rules that pertained to District owned property). Mr. Silva stated that the Amendment to the District Parking Rules would have to go through the Florida Statutes Rule Making Procedures, which call for the advertising of a Public Hearing to adopt the rules. Mr. Silva suggested that one entity take charge of the enforcement of the parking rules for cost saving measures and for more efficient enforcement of the rules. District Counsel Scott Cochran provided the Board with a copy of a Parking Enforcement Agreement between the District and the Las Ramblas Association and went over a brief explanation about the document. Members of the District Board who also served on the Las Ramblas Association Board stated they would review the Parking Enforcement Agreement and consider it during the upcoming Las Ramblas Association Board meeting. A discussion ensued after which; A motion was made by Mr. Gonzalez, seconded by Ms. Sanchez-Bergamo and unanimously passed authorizing the District Manager to commence the procedures for rulemaking authority that would amend a rule of the District that would prohibit parking in defined areas in the District (District property); setting the public hearing for June 17, 2019, at 6:30 p.m. in the Las Ramblas Clubhouse Conference Room located at 9960 NW 10th Terrace, Miami, Florida 33172 Another discussion ensued after which;

A motion was made by Mr. Gonzalez, seconded by Mr. Toy and unanimously passed to accept the Parking Enforcement Agreement between the District and the Las Ramblas Association, contingent upon the Las Ramblas Association accepting the Parking Enforcement Agreement; and authorizing District management to execute the Parking Enforcement Agreement on behalf of the District. K. NEW BUSINESS

1. Consider Resolution No. 2019-01 – Adopting a Fiscal Year 2019/2020 Budget Mr. Silva presented Resolution No. 2019-01, entitled:

RESOLUTION NO. 2019-01

A RESOLUTION OF THE BOARD OF SUPERVISORS OF THE FONTAINBLEAU LAKES COMMUNITY DEVELOPMENT DISTRICT APPROVING A PROPOSED BUDGET AND NON-AD VALOREM SPECIAL ASSESSMENTS FOR FISCAL YEAR 2018/2019; AND PROVIDING AN EFFECTIVE DATE.

Mr. Silva read the title into the record and advised that the proposed 2019/2020 fiscal year budget had been balanced with an estimated carryover of $46,250 from the projected fund balance as of September 30, 2018. Mr. Silva reviewed the proposed budget line items and advised that since the overall proposed assessments were not increasing in the fiscal year 2019/2020, letters to residents would not be required. Mr. Silva stated as part of Resolution No. 2019-01, the Board must set a date for the public hearing to adopt the 2019/2020 fiscal year final budget and assessments. A discussion ensued after which; A motion was made by Mr. Gonzalez, seconded by Mr. Toy and unanimously passed approving and adopting Resolution No. 2019-01, as amended, increasing the amount on the line item “Solar Lighting Maintenance” by $5,000; setting the public hearing to adopt the 2019/2020 fiscal year final budget and assessments for July 15, 2019, at 6:30 p.m. in the Las Ramblas Clubhouse Conference Room located at 9960 NW 10th Terrace, Miami, Florida 33172; and further authorizing publication of the budget public hearing, as required by law. 2. Discussion Regarding Installation of Electrical Outlets in Squared Island – Las Sevillas (Association Request) Mr. Silva advised that the Fontainbleau Lakes Courtyard West Condominium Association (the “Las Sevillas Association”) had requested that the District look into installing electrical outlets in the squared island located on the westernmost portion of the Las Sevillas community. Mr. Silva stated that the proposed project might end up costing over $10,000, as the electrical company would have to bore several electrical lines under the road in order to connect an electrical line to the electrical outlets. A discussion ensued after which the Board directed Mr. Silva to gather proposals for the installation of 4 electrical outlets in the squared island so that the Board can determine if the proposed project would be economically feasible. 3. Private Security Services to be included under CDD Mr. Gonzalez stated that he would like for the District Board to consider taking over security service responsibilities in the future because it would present a cost savings for the community, as the District

has a tax exempt status. Mr. Silva stated that he would have to check the District’s ordinance to verify that the District has the ability to fund security services. If so, the District Board would have to consider this concept during the next budget season, as the budget for the current fiscal year cannot be altered. 4. Landscaping Services Review Mr. Gonzalez advised that the landscape maintenance company’s (Pan American Landscaping) performance was improving since the time they first began servicing the District. The District and the Las Ramblas Association will continue to monitor their performance and address any concerns which may come up. 5. Add-On: Discussion Regarding Dog Park and Playground for Las Sevillas Mr. Silva stated that the Las Sevillas Association had requested that the District consider sharing in the cost of installing a dog park and/or a playground in Las Sevillas. Mr. Silva noted that the cost of installing a playground might runt approximately $30,000, which would be a cost that has not been budgeted for by the District. A discussion ensued after which the Board consensus was that a playground would take priority over a dog park and that more information (estimated cost, rendering of playground, location, etc.) be provided at an upcoming meeting. The Board also added that the current budget might not have enough funds to cover the expense this fiscal year, so it might have to be looked into during the next fiscal year, which commences October 1, 2019. L. ADMINISTRATIVE & OPERATIONAL MATTERS 1. Staff Report: As Required There was no Staff Report. M. BOARD MEMBER & STAFF CLOSING COMMENTS Mr. Silva reminded the Board of the importance of completing and mailing to the Supervisor of Elections (“SOE”) within the County of residency their individual 2018 Form 1 Statement of Financial Interests. Mr. Silva advised that the Board Members should receive by mail from the SOE their individual 2018 Form 1 before the end of May. If they do not receive the 2018 Form 1 by the end of the month, they should contact Mr. Silva. N. ADJOURNMENT There being no further business to come before the Board, a motion was made by Mr. Toy, seconded by Ms. Sanchez-Bergamo and passed unanimously to adjourn the Regular Board Meeting at 8:21 p.m.

FONTAINBLEAU LAKES COMMUNITY DEVELOPMENT DISTRICT

RULES

for Parking on District Property

Adopted January 23, 2017 Amended June 17, 2019

1.1 Any vehicle parked in violation of the Fontainbleau Lakes Community Development District (the “District”) Rules for Parking on District Property (“Parking Rules”) as set forth herein may be towed at the vehicle owner’s expense by a towing contractor approved by the District Board of Supervisors, subject to the provisions of applicable ordinances of Miami-Dade County and Florida Statutes. “No Parking” signs shall be installed at the location of towing areas in accordance with the requirements of applicable ordinances of Miami-Dade County and Florida Statutes. All other traffic and parking rules and regulations of Miami-Dade County or the State of Florida, including the requirements of Chapter 316, Florida Statutes, are to be enforced by the Miami-Dade Police Department or approved law enforcement agency having jurisdiction thereof.

1.2 Except as otherwise provided by resolution of the Board of Supervisors, on-street

parking is prohibited twenty-four (24) hours a day, seven (7) days a week on all District streets, roadways, thoroughfares, or rights-of-way and on all other District property.

1.3 Parking within the overflow parking spaces on District property is prohibited from

the hours of 2:00 A.M. through 5:00 A.M., seven (7) days per week. 1.4 Parking is prohibited upon or within all non-paved District property including, but

not limited to, grassed swales and landscaped areas within or adjacent to any District’s right-of-way. This prohibition shall remain in effect twenty-four (24) hours per day, seven (7) days per week.

1.5 No vehicle which cannot operate on its own power shall remain on District right-of-

way or District property for more than twelve (12) hours. 1.6 No commercial vehicle, recreational vehicle, boat, trailer, including but not limited

to boat trailers, house trailers, and trailers of every other type, kind or description, or camper, may be kept on District right-of-way or District property. The term “commercial vehicle” shall not be deemed to include recreational or sport utility vehicles commonly referred to as SUV’s up to 21’5” in length or clean “non-working” vehicles such as pick-up trucks, vans, or cars if they are used by the owner on a daily basis for normal transportation. Notwithstanding any other provision in these Parking Rules to the contrary, the foregoing provisions shall not apply to commercial vehicles or construction vehicles currently being used in connection with the construction, improvement, installation, or repair of District rights-of-way or any other District-owned or District-maintained property or facilities.

1.7 Marked law enforcement or other emergency vehicles are exempt from the Parking

Rules prohibiting on-street parking. Owners/residents who are law enforcement or emergency services officials may not leave their law enforcement or other

emergency vehicles in District parking areas described in Rules 1.1 to 1.5, unless they are performing official duties at that location.

1.8 The enforcement of these Parking Rules may be suspended in whole or in part for

specified periods of time, as determined by the District. 1.9 No vehicle maintenance or repair shall be permitted over or on any portion of the

District road rights-of-way or other District property. 1.10 Anyone operating a motor vehicle upon District road right-of-way shall do so in

accordance with Florida law and posted speed limits and traffic regulations.

1.11 If District property is damaged or in need of repair as a result of violation of these rules, the District will provide an invoice to the property owner who is in violation for the reasonable cost of repair. In the event the invoice remains unpaid, the charges for the repair shall be added to the Operating and Maintenance assessment attributable to the violator’s property within the District on the next ensuing tax bill.
