A. Introduction This is your policy wording for the Homechoice Mobile Device Protection Plan. This policy wording explains the Terms and Conditions of the cover provided. Your Insurer is Guardrisk Insurance Company Limited (Guardrisk). Guardrisk is a registered insurance company and a licensed Financial Services Provider. Homechoice (Pty) Ltd, is the Binder Holder who sells and administers this policy on behalf of Guardrisk. B. Benefits In return for your prior payment of the premium, your Insurer will provide cover for the accidental loss, theft or damage of the insured item, as detailed in your policy schedule, occurring during the period of insurance, subject to the terms, conditions and exclusions contained in this policy wording. The Insurer will, at their own discretion, repair or replace the insured item. The Insurer’s maximum liability shall not exceed the replacement value of the insured item. This policy wording, (as amended from time to time), various administrative forms, the policy schedule, application forms, declarations, authorisation and any voice-logged conversations pertaining to this policy and agreement, shall form the basis of this insurance contract. In the event of any difference between this policy wording and that of any other document mentioned above, the provisions of this policy wording shall prevail. Words in italics are explained under the Definitions section of this document. 1. Insured event Handset, tablet and laptop cover Theft, accidental loss and accidental physical damage to handsets and tablets occurring during the period of insurance. Theft and accidental, physical damage only, to laptops occurring during the period of insurance. 2. Benefits In the occurrence of an insured event the Insurer will not pay any benefit in cash, but will choose to either: - repair the insured item; or - replace the insured item. Repairs If the insured item was accidentally damaged and is repairable, the Insurer will pay a reasonable cost for restoring the item to its former condition prior to the insured event. Replacements: The Insurer will determine whether the insured item is irreparably damaged and in such case may choose to: Step 1: Replace the insured item with an item of similar features, value and quality (if the make and model is no longer available on the market or from suppliers); or Step 2: Let you choose an alternative item with the option to pay the shortfall if the value is more than the maximum replacement value (only if Guardrisk cannot replace the insured item with a similar make or model). 3. Limits Guardrisk will pay a maximum of: - 2 claims within a 12-month (twelve) period for handsets or tablets - 2 claims within a 36-month (thirty-six) period for laptops The 12-month (twelve) or 36-month (thirty-six) period shall commence from the inception date and continue for 12 (twelve) or 36 (thirty-six) consecutive months from said date. Each new 12-month (twelve) or 36-month (thirty-six) period shall commence from the expiry of the first 12-month (twelve) or 36-month (thirty-six) period, and this shall be renewed provided that the monthly premium is paid. The benefit per claim will be equal to the insured item’s value on the day of the insured event but will not exceed the maximum replacement value. 4. Period of insurance Cover starts on the inception date as stated on the policy schedule, subject to receipt of the first premium by the Insurer. This policy is valid for 1 (one) calendar month and cover will continue on a month-to- month basis provided payment is up to date. The policy will terminate if the premium is not received by the Insurer. 5. Excess payable You are required to pay an excess for each and every claim. The excess is equal to the current monthly instalment in respect of the insured item. You may elect to pay this excess immediately by a double debit on your next instalment date, or you may choose, to settle this amount in cash. C. Conditions of cover 1. Payment of premiums Premiums are payable monthly in advance and cover is only effective for the month for which the premium was paid. The policy will be inactive from inception if the Insurer does not receive your first premium prior to the inception date (in the first month). From the second month, you will be allowed a period of 30 (thirty) days from the premium due date in which to pay your premium. Where premium was not paid within this period, the policy will automatically terminate from 24h00 (midnight) on the last day of the month for which a premium was actually received. The premium amount must be paid as agreed upon inception of the policy. 2. Changes to policy cover The Insurer may change the policy cover at any time by giving you 30 (thirty) days written notice sent to your last known address. Guardrisk may increase the monthly premium, subject to 30 (thirty) days written notice in advance. Any policy changes you make will be effective from the time and date this was agreed upon. 3. Precaution and prevention of loss You and any other person covered by this policy must take all reasonable steps and precautions to prevent losses, and ensure that the insured item is: - safeguarded while charging or locked away when not in use; - not given or lent to another party without the express written authorisation from the Insurer; - used with protective devices and the operation thereof is adhered to; - not visible whilst driving or in a stationary motor vehicle; - used and maintained in accordance with the manufacturer’s directions; - not immersed in any liquid, powder or soil. 4. Registered numbers The IMEI or serial number on the insured item must match the IMEI or serial number that was recorded on the policy schedule. Handsets and tablets must be registered on a cellular network. 5. Cancellation of your policy You may cancel this policy at any time by giving 30 (thirty) days written notice to the Insurer or the administrator. If you cancel the policy and there is any excess amount due by you, the Insurer will collect the outstanding excess on your next instalment date in terms of your Credit Agreement. 6. Termination of cover This policy will be terminated if: - the insured item no longer belongs to you or a member of your immediate family who is dependent on you and is normally residing with you; - your premium is not received within 30 (thirty) days of the premium due date. 7. Guardrisk’s rights In the event of an insured event the Insurer or their nominee may, without incurring any liability or in any way diminishing their rights: - take or keep possession of any damaged insured item and deal with it in any reasonable manner, provided this condition does not grant you the right to abandon any property to Guardrisk, whether already in their possession or not; - take legal action in your name in respect of any recovery of, or contribution to, a claim. 8. Other insurance If insurance exists with any other insurer(s) covering the same insured item, Guardrisk will only be liable for the calculated portion of the loss not recoverable from such other insurance. 9. No rights to other persons Unless otherwise provided, this policy does not give any rights to any other person. If an extension provides indemnity to another person, it will not give that person the right to claim, which means that you will claim on behalf of the other person. 10. Upgrading or changing the insured item or number It is your duty and your sole responsibility to notify the Binder Holder in writing or telephonically in the event of you changing or upgrading the insured item or changing your cellphone number. 11. Fraud If the Insurer detects any instances of fraud, your benefits will be forfeited and this policy may be cancelled. You may be requested to repay the amounts which we may have settled for previous claims and Guardrisk has the right to recover any losses which we may have suffered as a result of a fraudulent act. 1. Insured eventHandset, tablet and laptop cover

Theft, accidental loss and accidental physical damage to handsets and tablets occurring during the period of insurance.

2. Bene� ts In the occurrence of an insured event the Insurer will not pay any bene� t in cash, but will

choose to either:- repair the insured item; or

- replace the insured item.

Repairs If the insured item was accidentally damaged and is repairable, the Insurer will pay a

reasonable cost for restoring the item to its former condition prior to the insured event.

Replacements: The Insurer will determine whether the insured item is irreparably damaged and in such case may choose to:

3. LimitsGuardrisk will pay a maximum of:

- 2 claims within a 12-month (twelve) period for handsets or tablets - 2 claims within a 36-month (thirty-six) period for laptops

The 12-month (twelve) or 36-month (thirty-six) period shall commence from the inception date and continue for 12 (twelve) or 36 (thirty-six) consecutive months from said date. Each new 12-month (twelve) or 36-month (thirty-six) period shall commence from the expiry of the � rst 12-month (twelve) or 36-month (thirty-six) period, and this shall be renewed provided that the monthly premium is paid.

The bene� t per claim will be equal to the insured item’s value on the day of the insured event but will not exceed the maximum replacement value.

4. Period of insurance Cover starts on the inception date as stated on the policy schedule, subject to receipt

of the � rst premium by the Insurer.

This policy is valid for 1 (one) calendar month and cover will continue on a month-to-month basis provided payment is up to date. The policy will terminate if the premium is not received by the Insurer.

5. Excess payable You are required to pay an excess for each and every claim. The excess is equal to the

C. Conditions of cover1. Payment of premiums Premiums are payable monthly in advance and cover is only e� ective for the month for

The policy will be inactive from inception if the Insurer does not receive your � rst premium prior to the inception date (in the � rst month).

From the second month, you will be allowed a period of 30 (thirty) days from the premium due date in which to pay your premium. Where premium was not paid within this period, the policy will automatically terminate from 24h00 (midnight) on the last day of the month for which a premium was actually received.

The premium amount must be paid as agreed upon inception of the policy.

2. Changes to policy cover The Insurer may change the policy cover at any time by giving you

- fraudulent means or devices used by you to obtain a bene� t; or - if you caused an insured event intentionally; or - if fraudulent information is provided to pay a claim; or - if loss is deliberately exaggerated.

12. Misrepresentation, misdescription or non-disclosure The Insurer may void this policy due to misrepresentation, misdescription or

non-disclosure of material information in respect of a claim or on yourapplication for this policy.

13. Jurisdiction A legal dispute in terms of this policy will be decided on according to the laws of the

Republic of South Africa.

14. 30-day (thirty) policy review period If no claim has been made under this policy or if you earned no right to institute a

claim or receive any bene� t, you may cancel this policy within 30 (thirty) days after the policy documentation was sent by the Insurer.

Guardrisk will void the policy and refund any premiums paid during this 30-day (thirty) review period.

15. Territorial limits This policy only operates within the Republic of South Africa.

D. ExclusionsGuardrisk does not cover

1. Any claim which is not submitted to the Binder Holder within the � rst 30 (thirty) days from the insured event incident;

2. A lost or stolen insured item if not reported to the SAPS within 48 (forty-eight) hours of the insured event incident;

3. Loss of or damage to batteries, chargers (if not stolen, lost or damaged together with the insured item), accessories and modems;

4. Lost laptops;5. Consequential loss;6. Loss or damage which resulted from:- wear and tear, super� cial damage to casings and keypads, depreciation or other

gradual operating causes;- derangement unless accompanied by physical damage otherwise covered by the

Policy;- the hire or loan of the insured item to another person;- claims arising from abuse, misuse or neglect of the insured item;- erasure or corruption of data; - costs recoverable from any party under the terms of any guarantee or warranty (or which would be recoverable but for the act or omission

by you);- change in temperature or humidity, the action of light or climatic or atmospheric

conditions, unless caused by storm, wind, water, hail or snow;- the process of cleaning, dyeing, bleaching, altering, repairing or restoring;- mechanical or electrical breakdown, failure, breakage or derangement;- inherent vice or defects, vermin, insects, termites, mildew, damp, corrosion,

oxidation or rust;- con� scation and � nes by customs or another authority;- theft from an unattended vehicle, unless the vehicle is in a locked garage or the

insured item is completely concealed in a locked vehicle and entry is gained by forcible, violent and visible means;

- a manufacturing defect (which is normally covered by the manufacturer’s warranty) or failure to follow the manufacturer’s instructions or recommendations;

- your dishonesty as a principal member or a member of your immediate family who is dependent on you or is normally residing with you;

- you not being able to use the insured item.

7. General Exception - SASRIA Loss or damage resulting from political or non-political riot, strike or civil

commotion, public disorder, war, invasion, terrorism or public violence or which is insurable by SASRIA (South African Special Risks Insurance Association) is excluded from this cover.

E. How to claimCall 0861 999 635 to claim.

Step 1In the event of a claim, contact the Binder Holder within 30 (thirty) days to report yourclaim. You will be advised of any additional documentation that is required for the claim to be processed.

Step 2

Loss or theft claimsNotify the police and proceed to blacklist any cellular phones or tablets. Once the insured item has been reported, provide the Binder Holder with a copy of the police report, case number and an a� davit.

Repair claimsThe Binder Holder will arrange collection for the damaged insured item.

Step 3Advise the Binder Holder of any other insurance in force which covers the same event. Email or fax all supporting documents to the Binder Holder. Ensure that your policy number or cell number is on all the documents.

Step 4Provide the Binder Holder with all the information and evidence they may require to prove your claim. If this is not done within 90 (ninety) days from submitting your claim, the claim will expire.

F. De� nitionsBinder Holder Homechoice (Reg. No. 1985/002759/07, FSP No. 48448). HC conducts policy changes, claims intimation, administration and queries.

Guardrisk refers to Guardrisk Insurance Company Limited. Guardrisk is a registered insurance company for the purposes of the Short-Term Insurance Act 1998 and a licensed Financial Services Provider (FSP No. 75) for the purposes of the Financial Advisory and Intermediary Services Act 2002.

Insured item is the laptop, tablet or handset which bears the IMEI or serial number as re� ected on the policy schedule. The insured item does not include modems, accessories and additional batteries.

Replacement value is the value Guardrisk will pay per claim which includes a minimum and maximum value. The replacement value was accepted by you at inception and indicated on your policy schedule.

Inception date is the date of accepting the laptop, tablet or handset insurance as determined by the voice recording or application form and indicated on the policy schedule.

You/Your refers to the owner of the policy and accepted by Guardrisk as the insured, including members of the insured’s immediate family who normally stay with the insured.

Policy schedule is the schedule which re� ects your customised cover information such as your personal details, the period of insurance, the premium and the insured item.

Credit Agreement is a loan contract which meets all the criteria for credit agreements as set out in Section 8 of The National Credit Act 34 of 2005 (as amended), and which is entered into between you and Homechoice.

G. Important informationCommission of 20% and a binder fee of 9% of the total monthly premium is payable to Homechoice. All fees are included in the monthly premium.

I. Processing of personal information in terms of The Protection of Personal information Act 4 of 2013Your privacy is of utmost importance to the Administrator and the Insurer. We will take the necessary measures to ensure that any and all information, including Personal Information (as defi ned in the Protection of Personal Information Act 4 of 2013) provided by you or which is collected from you is processed in accordance with the provisions of the Protection of Personal Information Act 4 of 2013 and further, is stored in a safe and secure manner. You hereby agree to give honest, accurate and up-to-date Personal Information and to maintain and update such information when necessary.

You accept that your Personal Information collected by the Administrator and the Insurer may be used for the following reasons:

1. to establish and verify your identity in terms of the Applicable Laws;

2. to enable the Administrator and the Insurer to fulfi l its obligations in terms of this Policy;

3. to enable the Administrator and the Insurer to take the necessary measures to prevent any suspicious or fraudulent activity in terms of the Applicable Laws; and

4. reporting to the relevant Regulatory Authority/Body, in terms of the Applicable Laws.

You acknowledge that any Personal Information supplied to the Administrator and the Insurer in terms of this Policy is provided according to the Applicable Laws.

Unless consented to by yourself, the Administrator and the Insurer will not sell, exchange, transfer, rent or otherwise make available your Personal Information (such as your name, address, email address, telephone or fax number) to any other parties and you indemnify the Administrator and the Insurer from any claims resulting from disclosures made with your consent.

You understand that if the Administrator and the Insurer has utilised your Personal Information contrary to the Applicable Laws, you have the right to lodge a complaint with the Insurer within 10 (ten) days.
