Legislature to establish a Court of Claims by general law, to provide for a judicial
nominating commission for the court, and to provide that Court of Claims judges are

Criminal Justice Data Collection; Citing this act as the “Criminal Diversion Racial and
Ethnic Impact Data Collection Act”; Requiring each law enforcement agency to report to
the Department of Law Enforcement the number of persons arrested and released
without being charged and the race and ethnicity of those persons; requiring each state
attorney to report to the department the number of persons against whom formal
charges were brought and subsequently dismissed and the race and ethnicity of those
persons; requiring each clerk of the circuit court to report to the department the number
of persons admitted into programs for diversion from prosecution and the race and
ethnicity of those persons, etc.
Penalties and Fees; Requiring a certain application to provide the applicant with the
option to fulfill any court-ordered financial obligation associated with a case by enrolling
in a payment plan or by completing community service if ordered by the court; revising
requirements relating to the payment of court-related fines or other monetary penalties,
fees, charges, and costs; authorizing the clerk to refer any application believed to be
fraudulent to the court for review; prohibiting the suspension of a person’s driver license
solely for failure to pay certain financial obligations if the person requests a hearing and
demonstrates specified circumstances to the court, after notice of a penalty and before
the suspension takes place; requiring a court to inquire at the time a certain civil penalty
is ordered whether the person is able to pay it, etc.
Revoking, Suspending, and Withholding Driving Privileges; Repealing provisions relating
to suspension of a driver license and motor vehicle registration of a support obligor who
is delinquent in payment or who has failed to comply with subpoenas or a similar order
to appear or show cause relating to paternity or support proceedings; revising penalties
for a person under a specified age who knowingly possesses a tobacco product or
misrepresents his or her age or military service for the purpose of obtaining any tobacco
product from a person or a vending machine; requiring the Department of Highway
Safety and Motor Vehicles to issue, reinstate, or renew any driver license or driving
privilege without fee which the department has withheld issuance of, suspended, or
revoked pursuant to specified provisions under certain circumstances , etc

Public Assistance Fraud: Revises amount of reward paid by DCF for reporting violation of
public assistance fraud laws; provides for department to hold certain recovered
overpayments in Federal Grants Trust Fund; authorizes department to establish financial
statement reserve; provides for use of reserve funds. Effective Date: July 1, 2018
Human Trafficking; Providing a mandatory minimum term of imprisonment for certain
human trafficking offenses; redefining the term “adult entertainment establishment” to
include businesses that restrict admission to adults which feature a person who engages
in certain activities for observation by a patron; prohibiting the assessment of fees
against victims of human trafficking who seek expungement of certain criminal history
records, etc.
Determining Bail: Specifies purpose of bail; creates presumption for release of arrested
individuals awaiting trial; requires release of individuals if no substantial risk of flight or
harm; authorizes reasonable nonmonetary bail conditions; requires consideration of
certain factors when determining whether to release defendant; removes prohibition of
release on nonmonetary conditions under certain supervision; prohibits court from
granting pretrial release for person charged with dangerous crime; revises list of offenses
that are deemed to be dangerous crimes; specifies that state must show need for pretrial
detention by certain standard of evidence; requires written findings & conclusion.
Effective Date: July 1, 2018
Juvenile Civil Citation and Similar Diversion Programs; Requiring the establishment of
civil citation or similar diversion programs for juveniles; specifying program eligibility,
participation, and implementation requirements, etc. Effective Date: 7/1/2018

specifies purpose of local government fiscal transparency requirements; requires local
governments to post certain voting record information on websites; requires property
appraisers & local governments to post certain property tax information & history on
websites; requires public notices for public hearings & meetings prior to certain increases
of local government tax levies; specifies noticing & advertising requirements; requires
local governments to conduct debt affordability analyses under specified conditions;
provides method for local governments that do not operate website to post certain
required information.
Ethics Reform: Repeals provisions relating to state, state university, & community
college employee lobbyists; prohibits certain public service announcements; prohibits
public officer/agency employee from soliciting specified employment/contractual
relationships; authorizes Commission on Ethics to investigate certain disclosures;
prohibits certain compensated representation for specified period following vacation of
office; deletes provision prohibiting former legislators from acting as lobbyists before
certain entities & persons for specified period following vacation of office; prohibits
certain officers & employees from soliciting employment/contractual relationships from
or negotiating same with certain employers; requires lobbyist to electronically register
with commission; revises lobbyist registration, compensation report, principal
designation cancellation, & investigation requirements. Effective Date: July 1, 2018
Local Government Ethics Reform: Provides that contractual relationships held by
business entities are deemed held by public officers or employees in certain situations;
provides ethics training requirements; prohibits certain governing board members from
voting in official capacity on specified matters; requires certain members of municipality
governing body to file disclosure; provides for future repeal of provisions relating to local
government authority to enact rule or ordinance requiring lobbyists to register with local
government; provides for future repeal of provisions relating to registration & reporting
for lobbying water management districts; requires Commission on Ethics to create Local
Government Lobbyist Registration System; requires lobbyists to register with commission
before lobbying specified governmental entities; provides responsibilities of Governor;

department secretary to appoint senior advocates to advocate for certain seniors, etc.

Involuntary Commitment: Requires APD to provide certain notice of eligibility
determinations; requires court to conduct annual hearings on continued need for
involuntary placement in residential services; provides for participation of guardian or
guardian advocate in placement determinations; requires court to hold competency
hearing within specified timeframe when defendant is competent to proceed; provides
limitation on conditional release for community-based competency training for
defendant who is incompetent to proceed. Effective Date: July 1, 2018
Marriage of Minors; Deleting provisions that allow the issuance of marriage licenses to
minors under 16 years of age in certain circumstances, etc.
Marriage Licenses; Deletes exception for persons under 18 years of age to be issued
