TOR Policy Advisor – Telecommunications and ICT Location: Port Vila, Vanuatu Type of appointment: fixed term contract Reference number : Commencement: ASAP Duration: 12 months Background and Sector Overview The Republic of Vanuatu Government (RVG), supported by the World Bank and AusAID (the Australian Agency for International Development) is assisting the development of competition in the Vanuatu telecommunications sector. Continuing good policy and sound regulation are key to its success. The Government expects its reforms to greatly improve quality, affordability and access to telecommunication services throughout Vanuatu. In 2007 the Government adopted a procompetitive Telecommunications Policy, renegotiated the previous monopoly of Telecom Vanuatu Ltd and has enacted new telecommunications legislation in 2009 which with the amended preexisting Act (1989) is to reinforce and extend competition in the sector. The new telecommunications legislation provides for the establishment of an independent regulatory body, the Telecommunications and Radiocommunications Regulator, to regulate the sector. The Regulator is able to engage staff and hire consultants and will be doing so to develop the regulatory regime. While regulatory arrangements are to drive and assist national goals, the Government appreciates that underpinning policy and enabling legislation need to be progressively reviewed and developed and as necessary adapted to the developing circumstance to ensure the wanted outcomes. The Ministry of Infrastructure and Public Utilities (MIPU) is seeking a consultant on the wider ICT policy and legislation development to provide advice about ICT policy and legislative framework to ensure that it continues to reflects world best practices, and is suitable for Vanuatu. The Ministry is keen that the Advisor work in close collaboration with itself and Regulator, to strengthen policy capabilities specifically in the area of ICT. This project is to strengthen policy review and development capabilities, and to mentor as appropriate on policy matters and arrangements toward effective and coordinated telecommunications and ICT legislation, that reflects best international practices and is suitable for Vanuatu. TOR Policy Advisor – Telecommunications and ICT

Background and Sector Overview 

The Republic of Vanuatu Government (RVG), supported by the World Bank and AusAID (the Australian Agency for International Development) is assisting the development of competition in the Vanuatu telecommunications sector.  Continuing good policy and sound regulation are key to its success.  The Government expects its reforms to greatly improve quality, affordability and access to telecommunication services throughout Vanuatu.

Scope of Work 

In this, he or she is to: 

Obtain input from current government organisations into their desires for the Vanuatu ICT Policy. Agree priorities and direction. 

Drawing from world trends and best practices as appropriate and working with Ministry staff, propose and draft a policy review and development work plan for the first two years of

operations of the strengthened Ministry, which includes second‐generation policy reforms and technological convergence. 

Deliver the approved national ICT policy for Vanuatu by month 10 of the contract.  

Develop and draft a national ICT policy for consideration by government and prepare a consultation paper for industry, telecommunications operators and the public about the proposed policy development, impacts or legislative change, its arrangements and operation.  

Engage and facilitate consultation on ICT policy development with stakeholders. 

Assist the Ministry in finalising the policy module following the consultation program and provide advice toward conversion of the consulted policy to working legislation. 

Assist in a policy review / development in relation to the in force Telecommunications Acts as a mentoring initiative.  The policy review or development should consider aspects of converged ICT. 

Assist the Government's work on international agreements related to ICT, including possible regional connectivity programs; 

Provide ongoing mentoring, guidance and development to counterpart local staff of the Ministry in regard to ICT policy and developments; 

Provide advice and assistance on development  addressing issues such as spectrum, digitalisation, delivery, content and relationships within the ICT family of capabilities; 

Assist the Ministry to align the residual Telecommunications Act 1989 with the Telecommunications and Radiocommunications Act 30, of 2009 and recommend any required changes to policy or legislation.   

Deliver training so that Ministry staff is equipped to continue the policy role and work program. 

Produce documentation to assist local in‐house future skills transfer for sustaining the policy skills. 

Prepare a report on the completed work for the Director General, MIPU. 

Deliverables, Timing and Level of Effort 

Key deliverables for the assignment are divided into four phases each with 3 months of duration. At the end of each phase the contractor must deliver the noted items and conduct a phase review which includes stakeholder sign off on objectives and approval to proceed to the following phase:  

 

Phase 1 – Months 1‐3  

This phase will be dedicated to information gathering within the Government departments to gain a clear understanding of the Government’s current priorities, strategic direction and current obstacles to achieving these. For each Government department the contractor is to document these along with the major ICT applications being utilized and their function. Research shall include interviews with Government department staff and ministers. 

Background in terms of existing strategy and current Vanuatu Governmental ICT priorities will also be documented. The contractor will familiarize himself/herself with the ICT Policy work that has taken place in the Pacific and the actual follow through of actions to support this Policy.  

The aim during this period is that the contractor documents the Vanuatu Government direction and documents how ICT development can be applied to achieve these.  This work will be completed in close co‐operation with the CIO, and other senior government staff. 

Deliverable:  The contractor shall compile a summary report on month 3 outlining existing Vanuatu Government objectives and strategy for each department, the existing ICT tools and highlighting appropriate requirements for ICT development/tools etc. This report is to be approved by the CIO no later than month 4 of this contract.

Phase 2 – Months 4‐6 This period is dedicated to preparing a draft national ICT policy. Working in consultation with the IT Department and MIPU, the contractor is to draft the policy and document all necessary objectives, priorities and requirements of the national policy document. 

Deliverable: the draft National ICT Policy documented and circulated to CIO and DG MIPU at the end of this phase.  

   Phase 3 – Months 7‐9 The draft ICT policy is to be circulated in this period for input and review. Relevant discussion forums are to be planned and held to engage not only the government but also the private sector and relevant corporations. Amendments and updates to the draft policy are to be made as appropriate. 

Deliverable: at least one each public, industry and government discussion group held to review the draft National ICT Policy. Final policy presented for CIO and MIPU approval. Approvals obtained no later than month 10 of this contract. The final ICT Policy is to be formally presented to Government by month 10 of this contract. 

 Phase 4 – Months 10‐12 A detailed and cohesive action plan is to be prepared and approved by the CIO by month 10. This plan will then be taken to a higher level of detail for timing, resourcing and budget required to deliver at least 5 top priority ICT initiatives in the national ICT policy. From month 10‐12 the contractor will be required to manage the staff who will implement these top 5 priorities and demonstrate that capacity building has taken place and the identified staff are capable and trained to continue to roll out the top 5 initiatives.  

Deliverable: demonstrate that required capacity sharing has taken place. Have counter part staff brief MIPU and CIO on next steps and status of top 5 priorities. 

Timing and Level of Effort 

This project is expected to require the services of a suitable expert for 12 months. During this time the contractor is expected to reside full time in Port Vila, Vanuatu.   

Language 

All material is to be produced and training delivered in English 

Administrative Arrangements 

The contractor selected will be engaged by and contracted to the Ministry of Infrastructure and Public Utilities.  The contractor’s duties will be performed in close co‐operation with the Chief Information Officer (CIO) and he or she will take day to day guidance and direction from the CIO. 

 

Payment will be organised by the Project Manager (within the office of the Regulator) upon certification by the Ministry that the required milestones and works are complete.  Travel, accommodation and expenses arrangements will be negotiated with the Ministry but the standards and procedures of the World Bank will be used as a benchmark.  Terms and conditions for the approval of Travel, accommodation and expenses will be outlined in the contract. 

Charges for work will be on a per day basis with a working day being eight hours. 

Remuneration Details 

The contractor will receive payment for services rendered according to two processes: 

1. 75% of the contractor’s total remuneration will be made based on approved fortnightly/monthly timesheets according to the Government of Vanuatu timesheet payment process. This requires that regular timesheets be approved and submitted for payment.

2. The remaining 25% of the contractor’s remuneration will be dependent on achieving satisfactory stakeholder sign off on each phase report.   

Further details shall be provided in the contract.  

 

Qualifications and Experience 

The Consultant shall be an ICT specialist, of high international repute with relevant international transactional and project experience (minimum 8 years) in the IT sector, particularly in developing countries.   

The consultant will have a good understanding of Policy development and have experience working within Government organisations as well as conducting user needs analysis and have a project management qualification.   

Knowledge and experience of IT sector issues in the South Pacific region and/or other small island economies is highly desirable.   

As the project requires training and skills transfer, the specialist must be competent in preparation of materials in English. 

 

Selection will be based on contractor’s experience and qualifications best suited to this role. Candidates will be rated according to meeting the following criteria: 

Suitable specialist experience and expertise; 

Experience with Pacific Island States and Vanuatu in particular;  

Timing of availability;
