    Sir,

    This is with reference to your letter no. -ASL/MoEFl20l4-151325 dated29.0I.2015 for amendment of ToR accorded by this Ministry vide letter no. J-i i0i ii i i2l20li-rA.il(r).

    2.0 It is noted that an application was made for grant of ToR on 10'h June, 2014 forexpansion of existing Iron Ore Pelletizing Plant along with other manufacturing facilitiesat Village Phuljhar, District Keonjhar, Odisha, which included a 1.2 MTPA DRI Plantamong other manufacturing facilities. TORs for the proposal were issued on 10thNovember,2014.

    3.0 Further, it was noted that the Industrial Promotion and Investment Corporation ofOdisha Limited (IPICOL) was approached by the PP for single window clearance forland, water, power etc. before proceeding with the preparation of EIA/EMP report.However, it was noted that guidelines had been issued by the Depafiment of Steel &Mines, Government of Odisha vide their Notification No. 6215 dated 8th August, 201 1 onthe expansion of green field and brown field projects, which states that the proposals forsteel making capacity between 0.60 to 1.50 MTPA will be allowed by the State with aprovision of setting up the hybrid system through DRI and hot metal production unitrc-'ute.

    4.0 Therefore, an application has been made for amendment of TORs for revisedconfiguration of proposed expansion. It has been mentioned that, since proposed steelmaking capacity is for 1.2 MTPA, you have changed the project conhguratio4 by

    decreasing the capacity of DRI from 1 .2 to 0.6 MTPA and addition of pig Iron BlastFurnace (0.6 MTPA) and Sinter plant (0.8 MTPA).There will be no change in the landrequirement of 217.254 ha. The water & power requirement will be increased since thereis change in project configuration.

    5.0 The above proposal was considered by the Reconstituted Expert AppraisalCommittee (Industry) in its 35th EAC meeting held during 26th -27th March, 2015. Afterdetailed deliberation, the Committee recommended the amendment of ToRs for therevisedconfigurationbydecreasingthecapacityofDRIfrom1.2to0.6MTPAandaddition of Pig Iron Blast Furnace (0.6 MTPA) and Sinter plant (0.8 MTPA).

    6.0 The Ministry has considered the recommendations of EAC and decided to amendthe ToR letter no. J-1101UL1212013-IA.II(I) dated 10.rr.2014 accordingly.

    under the provision, o"f the EIA Notification, 2006 for the project mentioned above' The

    ToRs to the project was awarded b1' Ministry of Enviroment, Forest and Climate Change

    vide letter No. J-1101 lll12l20I3-iA.II (I) dated 10th November and subsequently anamendment was issued on 7th Julrv 2015 for preparation of EIA/EMP report.

    The project

    proponent vide letter dated 10.09.2015 requeited Ministry to consider the application for

    .*irting 0.6 MTPA pellet plant only at present. rvhich was agreed by the Ministry'

    2.0 The existing Iron ore pellet plant (0.6 million TPA) of M/s Ardent Steel Limited islocated at Village Fh.rl.lhur, Tehsil Telkoi, District Keonjhar. The totai land

    acquired for the

    project is 36.731 ha, *irich is entirely of industrial type. No forestland involved' The entire

    land has been acquired for the project. The topography of the area is flat and reported to lies

    il;;;;; zfii,;i0,.26" to 21"44'10.48" N Latitude and 85025'53'78" to 85'27'49'4t" ELongitude in Survey of India topo sheet No. 73Gl6' at an elevation of 536 m AMSL' The

    Baitarani River purr., near the project area. It has been reported that no water body exist

    around the project and modification/diversion in the existing natural drainage pattern at any

    stage has not been proposed. No national park/wildlife sanctuary/biosphere reserve/tiger

    reserve/elephant reserve etc. are reported to be located in the core and buffer zone of the

    project. rne simitlpal National Park is located at a distance of 68'79 KM from the site' The

    Grate Kiln Technotogy for existing pelletisation plant of 0'6 MTPA capacity has been

    adopted.

    3.0 The targeted production capacity of the Iron Ore Pellet Plant is 0.6 million TPA' Theore for the plant ,.'ould be procurei frotn iocal market. The ore transportation

  • 4.0 The ground r.vater table reported to ranges between 0.79 to 5.6 m below the landsurface during the post-monsoon season and 3.8 to 12.3 m below the land surface during thepre-nronsoon season.

    5.0 The u'ater requirement for the existing plant is 500 m3lday, which is being sourcedfrom ground water. NOC from CGWA has been obtained vide letter No. 21-4(70ySER/eGW.A/_2q0!98_6_ -date4 2!.,08.200-8. The power requirement of the existingproject is 6.0 MW, which is obtained from the Odisha Power Transmission forporationLimited.

    6.0 It has been reporled that a total of 17945 tonnes/annum of waste is being generateddue to the project, out of which 13798 tonnes/annum has been used in Pellet Plant and 4147tonnes/annum has been dumped in the earmarked dump yard. An area of l2.I41ha has beendeveloped as green belt around the project site to attenuate the noise levels and trap the dustgenerated due to the project development activities.

    7.0 It being an existing standalone pelletisation project, Public Hearing is being exemptedas per EIA Notification, 2006 as amended on 14.09.2015.

    8.0 The capital cost of the project is Rs. 133.96 Crores. The capital cost lorenvironmental protection measures is Rs. 850 Lakhs. The annual recuning cost towards theenvironmental protection measures is Rs. 200 Lakhs. The proponent has mentioned that thereislo court case to the proj_ec! or related activity.

    9.0 The matter was considered by the Expert Appraisal Committee (Industry-I) in its 2ndmeeting held on 28th -30'h December, 2015. Afler detailed deliberations, the EAC (l)recommended the project for Environmental Clearance and stipulated Specific Conditionsalong n'rth other environnrental conditions while considering ibr accord of EnvironmentalClearance.

    10.0 The )zfinistrl' of Environment, Forest and Climate Change has considered theapplicatic-rn based on the reconrmendations of the Erperr Appraisal Conrmittee (lndustn'-l)and herebr decided to srant Enr,.ironmental Clearance to the abor e mentioned proposal ofM/s. Ardent Steel Ltd tbr Irtn Ore Peiletizing Plant t0.6 MTPA) under the provision of EI.\Notificatit'in dated 1-l'h Septcnrber. 2006, as amended. subject to strict compliance of thefollo*ins Specific and General conditions:

    A. SPECIFIC CO\DITIO\:

    Periodical medical examination of the workers engaged in the project shall be carriedout and records maintained. For the purpose, a qualified doctor should be appointedand schedule of health examination of the workers should be drawn and followedaccordingly.

    ii. The project proponent shall ensure supply of safe drinking water to thevillages.

  • ll1. The project proponent shall install 24x7 air monitoring devices to monitor airemissions, as provided by the CPCB and submit report to Ministry and its RegionalOffrce.

    Continuous stack monitoring facilities for all the stacks shall be provided andsufficient air pollution control devices viz. Electrostatic precipitator (ESp), baghouse, bag hlters etc. shall be provided to keep the emission levels below SO -gnt-:and installing energy efficient technology.

    The National Ambient Air.Quality Emission Standards issued by the Ministry videG.S.R. No. 826(E) dated 16th November, 2009 shall be follorved.

    Gaseous emission levels including secondarv fugitive emissions from all the sourcesshall be controlled within the latest permissible limits issued by the Ministry videG'S.R. 414(E) dated 3Oth May, 2008 and regularly monitored. Guidelines / Code ofPractice issued by the CPCB shall be followed.

    vii. Vehicular pollution due to transportation of rau.material and finished product shall becontrolled. Proper affangements shall also be made to control dust emissions duringloading and unloading of the raw material and finished product.

    viii. 'Zeto' effluent discharge shall be strictly followed and no wastewater shall bedischarged outside the premises.

    Regular monitoring of influent and effluent surface, sub-surface and ground watershall be ensured and treated wastewater shall meet the norms prescribed by the StatePollution Control Board or described under the E(P) Act whichever are morestringent.

    Proper handling, storage, utilization and disposal of all the solid/hazardous wasteshall be ensured and regular report regarding toxic metal content in the waste materialand its composition, end use of solid/hazardous waste shall be submitted to theMinistry's Regionai office, SPCB and CPCB. The proponent shall submit a copy ofthe agreement with the authorized vendor to the regional office as a part ofcompliance.

    Occupational health surveillance of the workers shall be done on a regular basis andrecords maintained as per the Factories Act and analysis shall be submitted to theregional office of the Ministry.

    xii. A time bound action plan shall be submitted to reduce solid waste generated due tothe project related activities, its proper utilization and disposal.

    Proper utilization of fly ash shall be ensured as per Fly Ash Notification, 1999 andsubsequent amendment in 2003 and 2009. All the fly ash shall be provided to cementand brick manufacturers for fuither utilization and Memorandum of Understanding

  • XIV A Risk and Disaster Management Plan shall be prepared and a copy submitted to the\linistry's Regional Oftlce. SPCB and CPCB within 3 months of issue ofenvironment clearance letter.

    The project proponent shall provide for soiar light system for all common areas, streetlights, villages. parking around project area and maintain the same regularly.

    The project proponent shall provide for LED lights in their offices and residentialareas.

    xvii. Green belt shall be developed at least in33Yo of the total project area with at least 10meter wide green belt on all sides along the periphery of the project area and alongroad sides etc. b,v planting native and broad leaved species in consultation *ith localDFO, local community and as per the CPCB guidelines.

    xviii. At least 2.5% of the total cost of the project shall be earmarked towards the EnterpriseSocial Con-rmitment based on Public Hearing issues, locals need and item-u'ise detailsalong u'ith time bound action plan shall be prepared and submitted to the N4inistr_v'sRegional Office. Implementation of such program shali be ensured b1' constituting aCommittee comprising of the proponent, representatives of village Panchayat andDistrict Administration. Action taken repoft in this regard sha1l be submitted to theMinistry's Regional Office.

    xix. The proponent shall prepare a detailed CSR Plan for every year for the next 5 yearsfor the existing-cum-expansion project, which includes village-wise, sector-wise(Health, Education. Sanitation, Health, Skill Development and infrastructurerequirements such as strengthening of village roads, avenue plantation, etc) activitiesin consultation rr ith the local communities and administration. The CSR Plan willinclude the amount of 2o/o retain annual protits as provided for in Clause i35 of theCompanies Act, 2013 rihich provides for 2on of the average net profits of previous 3years towards CSR activities for life of the project. A separate budget head shall becreated and the annual capital and revenue expenditure on various activities of thePlan shall be submitted as part of the Compliance Report to RO. The details of theCSR Plan shall also be uploaded on the company website and shall also be providedin the Annual Report of the company.

    xx. The Company shall submit within three months their policy towards CorporateEnvironment Responsibility which shall inter-alia address (i) Standard operatingprocess/procedure to being into focus any infringement/deviatiorV violation ofenvironmental or forest norms/conditions, (ii) Hierarchical system or Administrativeorder of the Company to deal with environmental issues and ensuring compliance tothe environmental clearance conditions and (iii) System of reporling of non-compliance/violation environmental norms to the Board of Directors of the companyand/or stakeholders or shareholders.

    xxi. Provision shall be made for the housing of construction labour within the site with allnecessary infrastructure and facilities such as fuel for cooking, mobile toilets, mobile

    STP, Safe drinking water, medical health care, crdche etc. The housing may be in theform of temporary structures to be removed after the completion of the project.

    B. GENERAL CONDITIONS:

    ll.

    The project authorities must strictly adhere to the stipulations made by the OdishaPollution Control Board and the State Government.

    No further expansion or modifications in the plant shall be carried out without priorapproval of the Ministry of Environment, Forests and Climate Change (MoEFCC).

    At least four ambient air quality monitoring stations should be established in thedownward direction as well as where maximum ground level concentration of PMto,PMz.s, SOz and NOx are anticipated in consultation with the SPCB. Data on ambientair quality and stack emission shall be regularly submitted to this Ministry includingits Regional Office at Bhubaneswar and the SPCB/CPCB once in six months.

    Industrial wastewater shall be properly collected. .treated so as to conform to thestandards prescribed under GSR 422 (E) dated 19'h May, 1993 and 31't December,1993 or as amended form time to time. The treated wastewater shall be utilized forplantation purpose.

    The overall noise levels in and around the plant area shall be kept well within thestandards (85 dBA) by providing noise control measures including acoustic hoods,silencers, enclosures etc. on all sources of noise generation. The ambient noise levelsshould conform to the standards prescribed under EPA Rules, 1989 vrz.75 dBA(daytime) and 70 dBA (nighttime).

    Occupational health surveillance of the workers shall be done on a regular basis andrecords maintained as per the Factories Act.

    vii. The company shall develop rain rvater harvesting structures to harvest the rain waterfor utilization in the lean season besides recharging the ground water table.

    viii. The project proponent shall also comply with all the environmental protectionmeasures and safeguards recommended in the EIA/EMP report. Further, the companymust undertake socio-economic development activities in the surrounding villageslike community development programmes, educational programmes, drinking watersupply and health care etc.

    ix. Requisite funds shall be earmarked towards capital cost and recurring cost/annum forenvironment pollution control measures to implement the conditions stipulated by the

    Ministry of Environment, Forest and Climate Change (MoEFCC) as well as the StateGovernment. An implementation schedule for implementing all the conditionsstipulated herein shall be submitted to the Regional Office of the Ministry atBhubaneswar. The funds so provided shall not be diverted for any other purpose. p

  • \ ctrp\ olclearance letter shall be sent by the proponent to concerned Panchayal,ZlIaParishad \,lunicipal Corporatron, Urban Local Body and the local NGO, if any, fromn'ht'rnr suggestions rr'Fresentations, if an1'. were received while processing theproposal. The clearance letter shall also be put on the web site of the company by theproponent.

    The project proponent shall upload the status of compliance of the stipulatedenvironment clearance conditions, including results of monitored data on theirwebsite and shall update the same periodically. It shall simultaneously be sent to theRegional Office of the MOEFCC at Bhubanesr.r,ar. The respective Zonal Office ofCPCB and the SPCB. The criteria pollutant levels namely; PMto, SOz. NOx (ambientlevels as u'e1l as stack emissions) or critical sectoral parameters, indicated lor theprojects shall be monitored and displaved at a convenient location near the nrain careof the compan)' in the public domain.

    The project proponent shall also submit six monthly reporls on the status of thecompliance of the stipulated environmental conditions including results of mor.ritoreddata (both in hard copies as well as by e-mail) to the Regional Office ol \IOEFCC.the respective Zonal Office of CPCB and the SPCB. The Regional Otfice of thisMinistrl at Bhubaneswar / CPCB / SPCB shall monitor the stipulated conditions.

    xiii. The environmental statement for each financial year ending 31" March in Form-V asis mandated to be submitted by the project proponent to the concerned State PollutionControl tsoard as prescribed under the Environment (Protection) Rules, 1986, asamended subsequentl,v. shall also be put on the u'ebsite of the company along withthe status of compliance of environmental conditions and shall also be sent to therespective Regional Ofllce of the MOEFCC at Bhubanesrvar by e-mail.

    xiv. The Project Proponent shali inform the pubhc that the project has been accordedenr,ironmental clearancc b1' the Ministrl' and copies of the clearance letter areavailable with the SPCB and may also be seen at Website of the Ministrv ofEnr-ironment, Forests and Ciimate Change i\loEFCC) at http:/envfor.nic.in. Thisshall be advertised u ithin se\.en days from the date of issue of the clearance letter. atleast in two local ne\\'spapers that are widelr circulated in the region of rrhich oneshall be in the vernacular language of the locality concerned and a copr of the sameshould be foru,arded to the Regional office at Bhubaneswar.

    xv. Project authorities shali inform the Regional Office as well as the Ministry,. the dateoffinancial ciosure and final approval ofthe project by the concerned authorities andthe date of commencing the land development work.

    1 1.0 The Ministry may revoke or suspend the clearance, if implementation of any of theabove conditions is not satisfactory.

    12.0 The Ministry reserves the right to stipulate additional conditions if foundThe Company in a time bound manner shall implement these conditions.
