In past columns I’ve tried to raise awareness of resources available to address issues of mental impairment among lawyers and their need for assistance, whether due to issues of aging or the onset of dementia or other mental illness, including anxiety, depression, substance abuse

and addiction—the latter of which plagues our legal community in numbers that far exceed those in the general public. My rumina-tions this month are fueled by the growing trend among law firms to make a conscious effort to embrace “succession planning,” or, as I like to think of it, that most diabolical way of making a 55-year-old feel even worse than when that first AARP card arrived in the mail—at a very “tender age” (under 50).

Those of us born at the tail end of the Baby Boom are watching as our not-so-very-elders are beginning to retire in droves—or worse. The sudden death of Steve Elmendorf, a highly esteemed BAMC member who was a pillar of Linowes & Blocher’s land use practice for decades, dealt our bar a bitter blow. It also caused some of us to ponder our own mortality. According to an Altman Weil sur-vey, some 65% of active, practicing attorneys are over 55. Senior departures from practice, whether by way of planned retirement or sudden illness, disability or death, have law firms considering whether they have properly prepared for the retirement or disabil-ity of their senior lawyers.

The Honorable Gale E. Rasin (Ret.) served Baltimore City admirably for more than twenty years, starting in the District Court for Baltimore City and later in the Circuit Court for Baltimore City. Prior to her judicial career, Judge Rasin was the Director of the Maryland Attorney General’s Office Medicaid Fraud Control Unit. She also enjoyed several years in private practice and served as an Assistant United States Attorney for the District of Maryland and Assistant State’s Attorney for Anne Arundel County. Judge Rasin now brings her skill and experience to The McCammon Group to serve the mediation and arbitration needs of lawyers and litigants throughout Maryland and beyond.

NEW DEADLINE FOR CIVIL TRACK III—JOINT PRETRIAL STATEMENTSEffective September 1, 2016 all civil cases assigned to Track III have an advanced deadline for the filing of the Joint Pretrial Statement. The deadline will now be seventeen (17) days prior to the Pretrial Hearing. The new dead-line will only effect cases filed on or after September 1, 2016 and will

be reflected in both the Schedul-ing Order and the Order for Man-datory Settlement Conference/Pretrial Hearing. If you have any questions regarding this change, please contact Rick Dabbs, DCM Coordinator at 240-777-9358 or [email protected].

process of ordering transcripts, you no longer need to place or-ders through the Court’s Tech-nical Services Department.   To order a transcript, simply go to the Court’s website home page and click on the link on the left hand side to submit a Tran-script Request.  The request will be forwarded to the tran-scription contractor, Deposi-tion Services, Inc., and the con-tractor will provide you with an estimate.  You will work directly with the Deposition Services to place your order.  All deposits and final payments will be paid to the contractor.

In addition, the MSBA makes available these and many more resources for the Maryland lawyer, both through its Law Office Man-agement Assistance program and otherwise. Expect to see

these publications and pro-grams proliferate in the next few years in response to the growing numbers of graying (if only figuratively) attorneys. Help is just a Google search away!

On the county level, I expect these issues to occupy increas-ingly more attention from our Lawyer Assistance Committee, Legal Ethics Committee, Elder

Law Section and Solo & Small Firms Section. Why Legal Ethics? The Montgomery County Circuit and District Court Mental Health Courts are in full operation.

The Circuit Court Mental Health Court accepted its first participant on December 2, 2016. The District Court began reviewing referrals on December 15, 2016. In order to be eli-gible for this program, the candidate must reside in Mont-gomery County, be at least 18 years old, suffer from severe and persistent mental illness, and have an open case in the Montgomery County Circuit or District Court. Referrals can be made by counsel, law enforcement, family, probation/pa-role, and judges. Judges Gary Bair and Patti Mitchell are the primary Circuit and District Court judges (respectively) as-signed to the Mental Health Court program.

TECHLECTICPat HooverCES Vegas Blau — This year’s annual gathering in Nevada’s neon desert for players and products of all things “new” in consumer tech, recently wrapped up a disappointing week, innovation wise. Little to nothing truly new or unique was introduced on the tech front. This year’s big news was all about Samsung, whose ex-ecutives gave a formal apology for its defective and extremely dangerous lithium battery cell phone debacle. If you’ve trav-eled by air in recent months the first thing heard by pilot and crew was the stringent ban of the suspect Samsung phones. On the other hand, this year's CES vendors brought to Vegas an impressive display of the lat-est in VR, drones, robots, wear-ables, connectables, TV's and more. But unlike in years past, nothing at this year's show in-troduced us to anything newly

innovative. No "next big thing" in tech. Maybe next year...

Apple vs. Netflix — Just re-leased by unnamed inside sources, Apple is said to be planning to take on Netflix, Amazon and the other big names that dominate in pro-ducing, distributing and sell-ing original, online streaming content for television. If true, the executives at Netflix have got to be scrambling. Apple has long since set the gold-stan-dard for its unrivaled tenacity and unprecedented success in developing new tech and vastly reshaping old, bringing new, cutting-edge innovation and technology to market. And while the sales of Apple TV have been quite modest

compared to those of iPhone, if true, Apple will have final-ly begun to make good on its promise for the future of Apple TV. When/if Apple decides to go Hollywood - as has Amazon, Netflix, and many others by now - I would expect a conse-quence of tectonic effect with-in the industry; one felt by all and resulting in a much greater choice to consumers.

Trying to decipher some mes-sages can be challenging and require familiarity with Net acronyms du jour: LMO=Leave Me Alone, STS=Smirk to Self, PKS=Painkillers, and my fav, MEH=communicates total in-difference by sender. Net speak is by no means restricted to kids and only younger users. How old is Donald Trump? Not young, that’s for sure but DT is, as we all know, preeminent in the use and number of fol-lowers he holds in his personal account on Twitter - 14o liit text messages. TAKEFIVEA Campaign to Raise Funds for the Bar Foundation Endowment and Generate Enthusiasm for its ProgramsBy the 2016-2017 Montgomery County Leadership Development AcademyThe 2016-2017 Montgomery County Leadership Develop-ment Academy is asking for five minutes of your time to help the Montgomery County Bar Foundation continue the

positive impact it has had on our community.

We, the Leadership Academy fellows, have dedicated our time and focus to raising the principal of the Bar Associa-tion Endowment Fund. Since its inception, the Endowment has supported a number of dy-namic programs. However, the impact of the Bar Foundation Endowment has not yet seen its full potential.

While you may not be famil-iar with everything the Bar Foundation does, you are likely aware of some of the programs the Endowment supports. The Foundation Endowment pro-vides grants to the Montgom-ery County Drug Court and Montgomery County Special Olympics. The Bar Foundation also supports programs such as the Continuing Legal Edu-

cation program, C-IT (Creating a New Tomorrow), the Coun-ty Pro Bono Program, School Mock Trials, the Summer Schol-ars Pipeline Program and Cable TV/Law School for the Public.

The expectation of the Bar Foundation is to be able to support all of these programs with the interest earned on the principal of the Endow-ment. The Bar Foundation only raised $6,898 in donations last fiscal year. The goal of the Leadership Academy campaign is $20,000. Please help us not only meet this goal, but blow it out of the water, so the Bar Foundation can continue to support the quality programs for our community.

By taking five minutes of your time to make a recurring month-ly donation or a one-time pay-ment, you can ensure that these

programs continue to make a difference in the lives of the participants, attorneys, and our community as a whole, and pos-sibly to expand the reach of the Endowment to create new and diverse programs. Look out for Leadership Academy fellows at your next section meeting, bar luncheon, or other bar events; we will be available to speak with you and answer your ques-tions regarding the Bar Founda-tion and all of the good works the Endowment supports.

Each year the New Practitioners Sections holds a volunteer night at MANNA Food Center, the premier food bank in Montgomery Coun-ty. MANNA provides food to 40,000 individuals each year, in-cluding helping distribute food to nearly every social service or-ganization in the County. Your help is needed to  create boxes of non-perishable food items to distribute to clients. Our as-sistance helps MANNA reach those in need. The Section met on Wednesday, January 4, 2017 and discussed planning for its presentation during the Annual Meeting scheduled for May 5, 2017, at the Gaithersburg Hilton.

The title of the presentation is Decoding Social Security Dis-ability: Make Disability Bene-fits Work for your Client

The presenters will be attor-neys Elliott Andalman and Peter Casciano of Andalman & Flynn, P.C.

The presentation will focus on the basic principles of dis-ability benefits law, including substantive rules, procedural issues and strategy concerns.

The speakers will also cover common disability benefits is-sues that arise in other areas of law including family, trusts and estates, personal injury, and even criminal. Finally, they will also discuss other areas of dis-ability benefits beyond Social Security Disability, including Long Term Disability (ERISA), Maryland State Disability and Federal Disability Retirement.

In addition, the Section agreed to participate in the New Prac-titioners Section Fair/Open House. The event will be held in the Executive Office Build-ing Cafeteria on March 21, 2017. The goal of the event is to give some of the bar associa-tion’s newest attorneys and law

students detailed information about the many sections of the Bar Association and what each section offers through-out the year. There will be en-tertainment, food, and drinks. Our section will host a table between 6:00 p.m. to 8:00 p.m. Please plan to attend!

BAIL REFORMAttorneys and judges should both be aware that this issue is receiving substantial attention both from the Maryland Court of Appeals (via potential rules changes) and the Maryland General Assembly. It is highly likely that the landscape of the present cash bail system will change in some way within the next few months, either pursu-ant to rule or statute or both.

YEAR-END REPORTSThe Court Administrator reports that a Caseflow As-sessment Annual Report is available on the Circuit Court website. This report pres-ents information as to the court’s performance in meet-ing state-mandated time stan-dards for case clearance. The DCM Coordinator is pleased to report that only a few cases did not meet these time standards and he will be reviewing these cases.

CIVIL MATTERSAttorneys have not been us-ing the most recent forms. Of-tentimes former forms can be used until you reorder. How-ever some must be used when they are released. The use of former forms is limited. Obso-lete forms are being rejected. An example is that attorneys must use the current garnish-ment forms, rather than prior versions. You should check the State District Court web-site to determine the forms in use.

PRO BONO PROGRAMBy Debbie Craven, Program CoordinatorWhen people earn little income and need assistance, it doesn’t make a difference to them what others in Maryland are earning. With our small staff in place, we continue to try and help as many people in need as possible. But we cannot do it without your professional assistance. The Montgom-ery County Bar Foundation Pro Bono Program continues to seek volunteers – whether experienced or newly barred attorneys – to join our panel. There are many county resi-dents that are in great need of pro bono services. Beginning July 1 through December 31, 2016, we have helped over 1,400 clients through our main office with information and referrals. 853 of those same community residents were advised at our five legal clinics. We need at-torneys to step up and join the dedicated handful of volunteer attorneys that are juggling

their schedules to be present week after week after week; in addition to the pool of attor-neys that take multiple cases, week after week.

The Pro Bono Program pro-vides two ways for county residents to receive free legal services in civil cases – at a le-gal advice clinic or through the client intake line for referral to an attorney volunteer for direct representation. Our le-gal advice clinics offer a very incomparable opportunity to get a glance of the many chal-lenging issues facing so many people within our communi-ty.  Cases referred to attorney volunteers include family law, debt collection, bankruptcy, limited employment, guardian-ship, limited immigration, wills and powers of attorney.

The Pro Bono Program partic-ipates in the Judicare Project for contested custody and com-plex family law cases funded by the Maryland Legal Ser-vices Corporation. Attorneys can seek reimbursement of $80 per hour with a limit of 20 hours per case. Please call for additional details.

Our Family Law Training Sessions known as the Rita Rosenkrantz Family Law Training are currently avail-able via webcast to attorneys for free in exchange for agree-ing to accept a family law case.
