Jon Sullivan addressed the board reporting that the district needs to meet DNR regulations and Mahaska Rural Water has agreed provide improvements, financing for improvements and maintenance on the system. It was moved by Vander Molen seconded by VanWeelden to ac- cept the petition and set July 20, 2015, during the regular board of supervisors meeting, as date to take action on it. Resolution #2015-07-20 APPROPRIATIONS RESOLUTION WHEREAS, It is desired to make appro- priations for each of the different officers and departments for the fiscal year beginning July 1, 2015 in accordance with Section 331.434 sub- section 6, of the Code of Iowa. NOW, THEREFORE, BE IT RESOLVED, by the Board of Supervisors of Mahaska Coun- ty, Iowa as follows: SECTION 1. The amounts itemized by the fund and department or office on the fol- lowing schedule are hereby appropriated from the resources of each fund as itemized, to the department or office listed. SECTION 2. Subject to the provisions of other county procedures and regulations, and applicable state law, the appropriations autho- rized under Section 1 shall constitute authori- zation for the department or officer to make expenditures or incur obligations from the item- ized fund, effective July 1, 2015. SECTION 3. In accordance with section 331.437, Code of Iowa no department or officer shall expend or contract to expend any money or incur any liability, or enter into any contract which by its terms involves the expenditures of money for any purpose in excess of the amounts appropriated pursuant to this resolu- tion. Action tabled to July 20 meet- ing. It was moved by Vander Molen second- ed by VanWeelden to dispose of resident files currently housed at Country Life Health Care according to county records retention policy (Resolution #2015-01-02) approved January 2, 2015. Discussion with Julie Bak, Mid Iowa Behavioral Health Region, regarding letter re- ceived from state DHS office asking for a plan to be submitted by August 1st in meeting re- quirements of the two county region. Resolution #2015-07-22 Resolution to Modify Project STP-S-CO62(8)— 5E-62 in the Mahaska County 2015/2016 5-Year Construction Plan WHEREAS, upon request from the Iowa DOT, project STP-S-CO62(88)—5E-62 is being modified to update the map of the project site and to edit the project location description for the project. The project mileage was edited to match the changes. NOW THEREFORE BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF MA- HASKA COUNTY in accordance with Iowa Code 309.22, initiates and recommends modi- fication of the of the following project STP-S- CO62(88)—5E-62 scheduled for FY2017, for approval by the Iowa Department of Transpor- tation, per Iowa Code section 309.23 and Iowa DOT Instructional Memorandum 2.050. It was moved by Vander Molen seconded by VanWeeleden to approve 4 additional Dis- Resolution# 2015-07-21 WHEREAS, IT IS DESIRED TO AU- THORIZE THE AUDITOR TO PERIODICALLY TRANSFER FUNDS FROM THE GENERAL BASIC FUND AND RURAL SERVICES BA- SIC FUND TO THE SECONDARY ROAD FUND DURING the 2015-2016 budget year, and WHEREAS, said transfer must be in ac- cordance with section 331.432 of the Code of Iowa, NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF MA- HASKA COUNTY, IOWA as follows: Section 1. The total maximum transfer from the General Basic Fund to the Secondary Road Fund for the fiscal year beginning July 1, 2015 shall not exceed the sum of $177,122 and the total maximum transfer from the Rural Ser- vices Basic Fund to the Secondary Road Fund for the fiscal year beginning July 1, 2015 shall not exceed the sum of $1,910,408. Section 2. On the quarterly basis after being notified of the apportionment of current property taxes, state replacement against lev- ied property taxes, mobile home taxes, military services tax credit replacements, or livestock credit replacements to the General Basic or Rural Services Basic Funds, the auditor shall order a transfer from said fund to the Secondary Road Fund. Section 3. The amount of the transfer required by Section 2 shall be equal to the apportionment made under Section 2 to the General Basic or Rural Services Basic Fund, respectively, multiplied by the ratio of said fund total maximum transfer to the Secondary Road Fund, to the sum of said fund’s total current property tax levy, total mobile home taxes, total military service tax credit replacements and to- tal livestock credit replacements. Section 4. Notwithstanding the provisions of sections 2 and 3 of the resolution, total trans- fers shall not exceed the amounts specified in Section 1. Section 5. Notwithstanding the provisions of sections 2 and 3 the amount of any transfer shall not exceed available fund balances in the transferring fund. Section 6. The auditor is directed to cor- rect his/her books when said operating transfers are made and to notify the treasurer and county engineer of the amounts of said transfers. The Mahaska County Board of Supervi-sors met in regular session on the above date at 9:00 a.m. in the third floor conference room of the Mahaska County courthouse. Present were the following board members: Chairman – Mark Doland; Vice chairman – Henry VanWeelden and Member – Mike Vander Molen. It was moved by Vander Molen seconded by VanWeelden to approve the agenda for to-day’s meeting. All present voted aye. Motion carried. It was moved by VanWeelden seconded by Vander Molen to approve the minutes of June 15 & 18. All present voted aye. Motion carried. It was moved by Vander Molen second-ed by VanWeelden to approve the bills for the month of June in total $977,964.16. All present voted aye. Motion carried. It was moved by Vander Molen seconded by VanWeelden to accept the auditor’s and sheriff’s 4th quarter report. All present voted aye. Motion carried. It was moved by Vander Molen seconded by VanWeelden to accept second reading of Ordinance #14 regarding tax increment financ-ing in connection with the NW Urban Renewal Plan. All present voted aye. Motion carried. The board was presented with a petition from property owners in the Lynndana Sanitary Sewer District asking for dissolution of said dis-trict. Jon Sullivan addressed the board reporting that the district needs to meet DNR regulations and Mahaska Rural Water has agreed provide improvements, financing for improvements and maintenance on the system. It was moved by Vander Molen seconded by VanWeelden to ac-cept the petition and set July 20, 2015, during the regular board of supervisors meeting, as date to take action on it. All present voted aye. Motion carried. It was moved by Vander Molen seconded by VanWeelden to approve the following resolu-tion appropriating budgeted funds at 100% for FY 15-16. Resolution #2015-07-20APPROPRIATIONS RESOLUTION

WHEREAS, It is desired to make appro-priations for each of the different officers and departments for the fiscal year beginning July 1, 2015 in accordance with Section 331.434 sub-section 6, of the Code of Iowa. NOW, THEREFORE, BE IT RESOLVED, by the Board of Supervisors of Mahaska Coun-ty, Iowa as follows: SECTION 1. The amounts itemized by the fund and department or office on the fol-lowing schedule are hereby appropriated from the resources of each fund as itemized, to the department or office listed. SECTION 2. Subject to the provisions of other county procedures and regulations, and applicable state law, the appropriations autho-rized under Section 1 shall constitute authori-zation for the department or officer to make expenditures or incur obligations from the item-ized fund, effective July 1, 2015. SECTION 3. In accordance with section 331.437, Code of Iowa no department or officer shall expend or contract to expend any money or incur any liability, or enter into any contract which by its terms involves the expenditures of money for any purpose in excess of the amounts appropriated pursuant to this resolu-tion. SECTION 4. If at any time during the

All present voted aye. Motion carried. Discussion concerning Mahaska County’s participation in Cedar Creek Watershed project. VanWeelden will have county attorney review the agreement. Action tabled to July 20 meet-ing. It was moved by Vander Molen second-ed by VanWeelden to dispose of resident files currently housed at Country Life Health Care according to county records retention policy (Resolution #2015-01-02) approved January 2, 2015. All present voted aye. Motion carried. It was moved by Vander Molen seconded by VanWeelden to direct Supervisor Doland as the Mahaska County Supervisor representative on the stakeholder team for proposed Recre-ation and Early Childhood Facilities. All present voted aye. Motion carried. Discussion with Julie Bak, Mid Iowa Behavioral Health Region, regarding letter re-ceived from state DHS office asking for a plan to be submitted by August 1st in meeting re-quirements of the two county region. A letter in response was sent on July 1st. It was moved by Vander Molen seconded by VanWeelden to approve the following resolu-tion. All present voted aye. Motion carried.

Resolution #2015-07-22Resolution to Modify Project STP-S-CO62(8)—

5E-62 in the Mahaska County 2015/2016 5-Year

Construction Plan WHEREAS, upon request from the Iowa DOT, project STP-S-CO62(88)—5E-62 is being modified to update the map of the project site and to edit the project location description for the project. The project mileage was edited to match the changes. NOW THEREFORE BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF MA-HASKA COUNTY in accordance with Iowa Code 309.22, initiates and recommends modi-fication of the of the following project STP-S-CO62(88)—5E-62 scheduled for FY2017, for approval by the Iowa Department of Transpor-tation, per Iowa Code section 309.23 and Iowa DOT Instructional Memorandum 2.050. The Board of Supervisors of Mahaska County, in lawful session this 6th day of July, 2015 hereby adopts the project modification resolution. Resolution# 2015-07-21 WHEREAS, IT IS DESIRED TO AU-THORIZE THE AUDITOR TO PERIODICALLY TRANSFER FUNDS FROM THE GENERAL BASIC FUND AND RURAL SERVICES BA-SIC FUND TO THE SECONDARY ROAD FUND DURING the 2015-2016 budget year, and WHEREAS, said transfer must be in ac-cordance with section 331.432 of the Code of Iowa, NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF MA-HASKA COUNTY, IOWA as follows: Section 1. The total maximum transfer from the General Basic Fund to the Secondary Road Fund for the fiscal year beginning July 1, 2015 shall not exceed the sum of $177,122 and the total maximum transfer from the Rural Ser-vices Basic Fund to the Secondary Road Fund for the fiscal year beginning July 1, 2015 shall not exceed the sum of $1,910,408. Section 2. On the quarterly basis after being notified of the apportionment of current property taxes, state replacement against lev-ied property taxes, mobile home taxes, military services tax credit replacements, or livestock credit replacements to the General Basic or Rural Services Basic Funds, the auditor shall order a transfer from said fund to the Secondary Road Fund. Section 3. The amount of the transfer required by Section 2 shall be equal to the apportionment made under Section 2 to the General Basic or Rural Services Basic Fund, respectively, multiplied by the ratio of said fund total maximum transfer to the Secondary Road Fund, to the sum of said fund’s total current property tax levy, total mobile home taxes, total military service tax credit replacements and to-tal livestock credit replacements. Section 4. Notwithstanding the provisions of sections 2 and 3 of the resolution, total trans-fers shall not exceed the amounts specified in Section 1. Section 5. Notwithstanding the provisions of sections 2 and 3 the amount of any transfer shall not exceed available fund balances in the transferring fund. Section 6. The auditor is directed to cor-rect his/her books when said operating transfers are made and to notify the treasurer and county engineer of the amounts of said transfers. The Fremont City Council met in regular session Monday August 3, 2015, at 7:00 p.m. with Mayor Edd Elder presiding. Council members present were John VanZante, Max Marlin, James Howrey, Yvonne Evans, and Terrie McElroy. Guest present: None Marlin made a motion to approve the con-sent agenda consisting of the Treasurer’s Re-port, Clerk’s Report, and minutes of meetings from July 7, 2015, Community Center reports and Claims list, seconded by Evans. Ayes: Van-Zante, Marlin, Howrey, McElroy, Evans. No discussion or action was taken in re-gards to fees on property at 307 North Cumber-land. VanZante made a motion to approve Res-olution #524 A resolution transferring ownership of equipment owned by the City of Fremont to the Mahaska County Emergency Management Commission pursuant to Iowa Code Section 29C.9 (2). Evans seconded. Roll Call Vote. Ayes; Evans, McElroy, Marlin, Howrey, Van-Zante. Nays; None. Absent; None. Evans made a motion to approve Reso-lution # 525 An ordinance stating that the City Clerk is hereby directed to publish notice that the Council proposes to adopt as a municipal code the printed, loose-leaf volume of ordinanc-es bearing the designation “City Code of Ordi-nances 2015” and that said municipal code is on file for public inspection at the City Clerks of-fice. Said notice shall state that a public hearing will be held at 7: oo p.m. on September 8, 2015 at which time the Council will hear arguments for or against adopting said code of ordinances as proposed. The property owners have asked if they could put something at the end of the driveway to prevent the trucks from coming on the property. Bruce Caves with Public Works will talk to them as to what they have in mind and what he needs for clearance during snow

removal. VanZante made a motion to approve a building permit for shed at 328 South Pine. Ev-ans seconded. Ayes; Marlin, VanZante, McEl-roy, Howrey, Evans. Mahaska County Board of Supervisorstablished in order to administer this agreement or the Project. MRWS is hereby designated as administrator for the joint and cooperative un-dertaking as required by Section 28E.6, Code of Iowa. Section 3: OWNERSHIP AND OPERA-TION OF SYSTEM. Unless otherwise agreed, plants and systems for providing sanitary sewer services, any and all easements and real es-tate, and all improvements thereto which as acquired, constructed, or installed for the Proj-ect shall become and remain the property of MRWS. Once constructed, it shall be the duty of MRWS to operate and maintain the entire sanitary sewer system, including the collection, treatment and disposal of sewage and liquid waste. Section 4: USE OF SYSTEM. The County agrees to adopt and enforce such ordinances as may be required to regulate the use of the entire sanitary sewer system, including but not limited to the installation and connection of building sewers, the discharge of water and waste into the system, mandatory connections to the system and provide penalties for violation thereof. Section 5: FEES AND CHARGES. As long as this agreement is in effect, MRWS shall establish rates or charges to consumers of the services of the sanitary sewer system sufficient in each year for the payment of the proper and reasonable expenses of the operation and maintenance of the sanitary sewer system and for the payment of principal and interest on any bonds or other obligations issued to pay for ini-tial construction and subsequent improvements to the sanitary sewer system as the same fall due and to provide for the creation of reserves as required by said obligations. Net revenues shall be maintained at a level sufficient to sat-isfy sound operations and borrowing practices.Section 6: NONPAYMENT. The county agrees and authorizes the County Auditor to collect all member charges not paid within sixty days af-ter the due date when submitted by MRWS to the Auditor and shall be collectible in the same manner as taxes. Section 7: DURATION. This agreement shall become effective from and after the date on which it is recorded with the Iowa Secretary of State and County Recorder, and shall con-tinue in effect until terminated in the manner hereinafter provided. Section 8: TIME IS OF THE ESSENCE. Time is of the essence in this contract. Section 9: SEVERABILITY. If any one or more of the provisions of this agreement are declared unconstitutional or contrary to law, the validity of the remainder thereof shall not be thereby affected.

Service THIS AGREEMENT made and excuted on the 20th of July, 2015 by and between Ma-haska Rural Water System (hereinafter referred to as “MRWS”) and the Board of Supervisors of Mahaska County, Iowa (hereinafter referred to as “County”).

WITNESSETH: WHEREAS, MRWS is organized and es-tablished under the provisions of Chapter 331, Code of Iowa, is authorized to erect, maintain and operate plants and systems for sanitary sewer services; and WHEREAS, the County desires to enter into an agreement with MRWS to provide sani-tary services for the residents of the unincorpo-rated area call Lynndana Acres Sewer District.WHEREAS, the parties desire to enter into a joint agreement as authorized by Chapter 28E, Code of Iowa, with respect to the financing, construction, operation and maintenance of such services facilities; and WHEREAS, by Resolutions adopted by the parties hereto, the provisions of this agree-ment have been approved by the members of the Board of Supervisors of the County and the Board of Directors of MRWS, and the execution of this agreement duly authorized. NOW, THEREFORE, IT IS AGREED: Section 1: PURPOSE. The purpose of the agreement is to set forth the terms and con-ditions under which the parties will obtain the necessary funding and do any and all things necessary for the erection, maintenance and operation of plants and systems necessary for sanitary sewer services including the collection, treatment and disposal of sewage and liquid waste (the “Project”). Board will not waive March 15 union ne-gotiation deadline for SEIU Local 199. State DHS office has not responded to letter sent to them in early July regarding Ma-haska and Marion County needing to submit a plan to join an existing contiguous mental health region by August 1. The board scheduled a spe-cial meeting for Wednesday afternoon (7/22) at 1:30 to discuss options. Short term office space for Adult Proba-tion will not be needed. Committee reports: A request will be made to the Board of Health for meeting minutes. Public comments: Alven Meppelink asked questions about the Hazardous Waste disposal item. Tales of the Ancient SportsmanBy Burdell HensleyI’m going through withdrawal

again. It happens every year about this time. There are no high school games to go to and I am climbing the walls. In fact I am bored enough already that I started another 1000 piece puzzle. It is a beautiful moun-tain scene and since we have recent-ly been to Colorado, it seemed to be fitting.

With a little extra time, I have been able to hit the golf course twice in the past week and I hope to be there a little more often this week. I actually played quite well for being a little rusty.

Football practice is underway and it has to be a tough situation for the North Mahaska Warhawks. What a devastating accident that claimed the lives of three Singletary broth-ers. One was a high school football player, another was on the junior high team and the other was still in grade school. The Warhawks will be playing with a heavy heart this season and I hurt for the team, the coaches and especially the family. I just can’t imagine the pain of the loss.

The North Mahaska community

has rallied around the Singletary family and that is no surprise. I know that community and I know that when one hurts they all hurt. There will be an outpouring of mega-size from the community and most likely from neighboring communities as well.

The accident has awakened me to the danger of country roads in the summer. I drive those roads occa-sionally and I will approach those blind intersections with no stop signs with renewed caution.

I was also saddened this week by the passing of Ken Van Hulzen. Ken was a great sportsman and an Oska-loosa Indian through and through. He was a great booster and his pres-ence was appreciated at Oskaloosa events.

The Ancient-ess and I spent three days last week at the Going on Faith travel conference in South Bend, IN. It was a good conference and I picked up a few neat ideas for tours. It was nice to see old friends again and to meet some new friends.

Any time you go to South Bend, you can expect Notre Dame to be a part of the program. This time we had one of our evening meals in the

banquet hall on campus. I was not greatly excited, but I went along.

I must admit that I have two favor-ite football teams. One is the Iowa Hawkeyes and the other is who-ever is playing Notre Dame. I am still hacked off by what happened in 1954. Iowa was playing at No. 1 ranked Notre Dame and Evy’s up and coming Hawkeyes had the Irish down 14-7 late in the game with time running out.

Twice the Irish faked injuries to stop the clock. And the Fainting Irish (that is what Maury White of the Des Moines Register called them) scored in the final minute to tie the game. Evy was livid, Jim Zabel went into orbit and the entire Hawkeye Nation was incensed. “We was robbed”, was the cry of the Hawkeye faithful.

The Iowa State Fair opens this week and I will probably make an appearance. The first thing I do is head to the dairy barn to check out the dairy show. Most of the dairy cattle come from the northeast part of the state and I particularly enjoy seeing the Brown Swiss, Jersey and Guernsey breeds.

I had a beautiful Brown Swiss heifer in my early 4-H years. I nev-

er showed her at the State Fair, but she won everything in the smaller shows. The judges always raved about what a great producer she would be. When she had her first calf, she didn’t have enough milk to feed the calf. I could never get more that a cup of milk from her. Dad said that we couldn’t afford to keep her, so off to market she went. McDon-ald’s had just opened in our area, and I suspect that she may have been a part of the first million burgers.

I will probably stroll through the grounds looking for old friends. I will check out a few of the exhibits and call it a day. It is amazing how quickly the fair can wear me out anymore. It doesn’t take long before I am looking for a bench. The food stands will be off limits. I am still battling blood sugar issues and there is nothing in those stands that I can use.

Once again it is time to see what happened in our yesterdays and I must admit that it was very little. It seemed as if everyone was waiting for football even in the yesterdays.

50 years ago: Aug. 12, 1965- The Osky Connie Mack team was elimi-nated by the Illinois champion, Rock Island team 12-3. A three run home run by Steve Smith accounted for all the Oskaloosa runs. Aug. 16- Win-ners in the Keokuk County Fair Tractor Pull were; Lawrence Hus-band of What Cheer (Class C), Paul Greiner of Keota (Class B) and Fred Charboneau of What Cheer (Class A). Aug. 16- Steve White beat Tim Quarton in a two hole playoff to win the Oskaloosa City Golf title. Aug. 16- Oskaloosa’s Brent Slay won the 440 dash at the National Junior Track Championships in Houston, TX. His time was a personal best of 49.3.

25 years ago: Aug. 13, 1990- Jerry Smith edged Jeff Smith in a one hole playoff to win the Herman Sani In-vitational in Des Moines. Aug. 19- Ruth Stanley won her eighth Elm-hurst Ladies Golf title.
