Subject: Formation of RATE CONTRACT for “Testing of Drugs(Allopathic)-Part 1” at ESIC
MODEL HOSPITAL, CHANDIGARH valid for two years from the date of finalization.
1. The Medical Superintendent, ESIC MH Chandigarh invites E- Tender under two bid system, from
NABL accredited OR Govt approved Laboratories located in Tricity
(Chandigarh/Mohali/Panchkula) , adjoining cities of Ludhiana, Baddi and, adjacent regions of
the National Capital Territory of Delhi ,Gurugram, Faridabad for formation of ESIC Rate
Contract for Testing of Allopathic Drugs at ESIC MH Chandigarh through e-procurement portal of
ESIC-https://esictenders.eproc.in validfor a period of two years. This can be further extended for
an additional year on same terms & conditions subject to performance review and consent of both
parties.
The Hard copy of following documents in a sealed envelope duly super scribed with e-Tender
ID No.-------and E-Tender enquiry No. -172/U-16/27/1/18/Allopathic drug testing tender/ESIC
MH CHD are to be submitted along with online bid submission:-
1.1 EMD as Specified in the “Instructions to Bidders”.

2.1 It is mandatory for all bidders to have valid Class III B Digital Signature Certificate (both with
signing and encryption component) from any certifying agency as per Information Technology
(IT) Act, 2000 for submitting e-bid at the ESIC e-procurement Portal https://esictenders.eproc.in.

2.2 Bidders should get registered at https://esictenders.eproc.in.
2.3 Final evaluation & finalization of Rate Contract will be based solely on e- bid submitted by the
bidder. It will be the sole responsibility of the bidder to scan and upload clear and legible
documents for assessment, failing which the tender will be liable for rejection.
3. ESIC Model Hospital Chandigarh intends to enter into a Running Rate Contract with Analytical
Testing Laboratories. Laboratories intending to participate in the Rate Contract should ensure
that they fulfill all the eligibility criteria as prescribed under the terms and conditions. (Bidder
should quote only for the items for which they fulfill all the eligibility criteria).
4. The Rate Contract will be governed by the Terms and Conditions enclosed with this Tender Enquiry
and no modifications/alterations are allowed in any case.

I. Instructions to Bidders
5. Signing of the tender
Individuals signing the tender or other documents connected with the bidding process must specify
whether he is signing as:-
i) A sole proprietor of the Laboratory or constituted Attorney of such sole proprietor.
ii) A partner of the Laboratory, if it be in partnership, in which case he must have authority to
refer to arbitration disputes concerning the business of the partnership/agreement or a power
of attorney.
iii) Constituted Attorney of the Laboratory if it is a company.
iv) Authorized signatory of the Laboratory.
N.B.
5.1 In case of Authorized signatory, authorization letter on the letter head of the laboratory duly signed
and stamped by proprietor needs to be submitted.The specimen signature of the authorized signatory
duly signed and stamped by proprietor should also be submitted to ESIC MH Chandigarh along with
the tender.
5.2 In case of (ii) a copy of partnership agreement attested by a Notary Public should be furnished or
affidavit on stamped paper of all the partners admitting execution of the partnership of the general
power of attorney should be furnished.
5.3 In the case of Laboratory run in partnership, where no authority to refer disputes concerning the
business of the partnership has been conferred on any partner, the documents must be signed by every
partner of the Laboratory.
5.4 A person signing the documents in the Bidding process forming part of the contract on behalf of
another shall be deemed to warrant that he has authority to sign the same and, if on enquiry it
appears that the person so signing had no authority to do so, the ESIC MH Chandigarh may
without prejudice to other civil and criminal remedy cancel the contract and hold the signatory
liable for all costs and damages.
5.5 Each and every page of the document uploaded/submitted in the bidding process should be signed and
stamped by the sole proprietor/ partner/ Constituted Attorney or authorized signatory of the
Laboratory.
6. The tender will be rejected if:-
6.1 Laboratory submits conditional tender.
6.2 All the papers are not complete.
6.3 Incorrect/false or misleading information is provided.
7 .The Item quoted will be rejected if more than one type of rates is quoted for one Item.

8.Tender will be under two Bid system as follows :
8.1 Technical bid (Hard Copy)
8.1.1 Technical Bid (Hard Copy) in a single sealed envelope super scribed with the e-Tender ID
No……. and e-Tender enquiry No: 172/U-16/27/1/18/Allopathic drug testing tender/ESIC MH
CHD should be dropped in the tender box kept in Administrative block, ESIC MH CHD on or
before 1.00 P.M. on 01.03.2019 containing:-
(i) EMD as original Demand Draft of Rs.5,000/- (Rupees Five Thousand only) from any
Nationalized Bank/Scheduled Bank in favour of ‘ESIC Fund Account No.1’ payable
at Chandigarh. Tender submitted without EMD will be summarily rejected.
OR
Documents in support of the exemption of EMD. Validity of this document should not
expire during the validity of Tender and during the entire duration of contract if
contract awarded after Technical and Financial bid evaluation.
(ii) Affidavit/Authorization as per clause 5 of Tender Document.
(iii) Affidavit as per Annexure ‘A’.
(iv) Advance pre-receipt affixing revenue stamp along with the full particulars of Bank details in
order to refund the EMD amount of unsuccessful bidders through ECS should be submitted.
Please note that the sealed envelope (as per para 8.1.1) should ONLY contain EMD,
Affidavit/Authorization letter, Annexure ‘A’ and Advance pre-receipt only. Any additional
documents shall be summarily rejected.
8.2 Technical Bid (Online) should contain duly signed & Stamped SCANNED copies of following
documents:-
8.2.1 EMD in original Demand Draft of Rs.5,000/- (Rupees Five Thousand only) from any
Nationalized Bank/Scheduled Bank in favour of ‘ESIC Fund Account No.1’ payable at
Chandigarh. Tender submitted without EMD will be summarily rejected.
OR
Documents in support of the exemption of EMD.Validity of this document should not
expire during the validity of Tender and during the entire duration of contract if
contract awarded after Technical and Financial bid evaluation.
8.2.2 Affidavit/ Authorization as per clause 5 of Tender Document.
8.2.3 Scanned Copies of BLANK tender document, duly signed & Stamped by sole proprietor/ partner/
Constituted Attorney orauthorized signatory of the Laboratory.
(No offer of rates to be uploaded with Technical Bid.)
8.2.4 GST registration certificate.
8.2.5 Valid License for carrying out “Testing Of Drugs & Dressings” issued from Statutory Body,
Authorized by Government of India with Approval under Drugs and Cosmetics Act, 1940 and
Rules, 1945 and amendments therein and should comply with schedule annexed therein.

8.2.6 Valid Accreditation for carrying out “Testing of Drugs” from NABL with scope of accreditation
or valid certificate from Competent authority of being a Government approved laboratory for
drugs testing.
8.2.7 Duly signed &stamped list of Government/Autonomous Health Institutions to which Testing of
Drugs are being provided (on Bidder’s letterhead).
8.2.8 Duly signed & stamped satisfactory performance certificate issued by Competent Authority of at
least One (01) Government/Autonomous Health Institution on the Institute’s letter head of
providing Testing services for the last two consecutive years .
8.2.9 Affidavit of the Laboratory on Non-Judicial stamp paper of Rs.100/-(As per Annexure A)
8.2.10 List of Personnel in QC(Quality Control) department and List of important
equipments/instruments/apparatus in the lab and facilities in the Microbiological section. (As
per Annexure B).
8.2.11 Mandate Form as per Annexure-C.
8.2.12 Copy of undertaking (signed and stamped by tender signing authority) that the quoted items
have not been / are not being tested for any other organization at the rates lower than being
quoted here (As per Annexure D).
8.2.13Financial report indicating the annual turnover in Testing of Drugs/dressings/vaccines etc. of
not less than Rupees Ten Lakhs per year of last three Financial years (i.e. 2015-16, 2016-17,
2017-18) duly attested by Chartered Accountant.
8.2.14 Any Other Supportive Documents.
8.2.15Advance pre-receipt affixing revenue stamp along with the full particulars of Bank details in
order to refund the EMD amount of unsuccessful bidders through ECS should be submitted.
* Incomplete Technical Bids as per checklist at Annexure F shall be summarily rejected.
The Medical Superintendent ,ESIC MH Chandigarh or her designated authority reserves the right
to inspect the facility any time before the opening of contract or any time during the validity of the
contract. Decision of the Medical Superintendent, ESIC MH Chandigarh shall be final in this
regard.
8.3 Price Bid - Online
8.3.1 Price Bid for quoted Items as per Table-I of Annexure-E should be in Rupees (Figures only).
8.3.1.1 Price should be filled only online in Figures on https://esictenders.eproc.in.
8.3.1.2 If the bidder does not want to quote price for any item/drug, that item should not be selected
because the selected item cannot be left blank or quoted NIL/ZERO. If selected item is left blank or quoted
as nil/zero, the bidder stands disqualified for that item.
8.3.1.3The Bidder should upload the Price Bid by giving the Rate of Testing Charges for the “complete
analysis of single sample” of an Item irrespective of methodology used for testing of

drugs.Online Price Bid of only those bidders who are found technically eligible will be
opened.
9. Pre-bid meeting
9.1 Pre-bid meeting will be held at Conference Hall, ESIC Model Hospital, Chandigarh at
2:30 PM on dated: 15.02.2019.
9.2 The objective of Pre-bid meeting is to clarify the tendering process.
10. No bid shall be accepted after the prescribed date and time of bid submission. Proof of postage
and courier shall not be considered as submission of bids.
11. Technical Bid Online will be opened as per schedule at given venue in the presence of
representative(s) of the Laboratories, having an authority letter for representation from the
Laboratories.
If the date of opening of tender is declared a public holiday, the tender shall be opened on the
next working day at the same venue and time.
12. The Medical Superintendent, ESIC MH CHD reserves the right to accept or reject any or all the
tenders at any stage without assigning any reason thereof. TheMedical Superintendent, ESIC
MH Chandigarh also reserves the right to reject any bid which is non- responsive or violating
any of the conditions/specifications without any liability to any loss whatsoever it may cause to
the bidder in the process.
13. Acceptance of tender by competent authority will be communicated by a letter of acceptance
after completion of formalities required for the formal acceptance of the tender & will be
forwarded to the bidder as soon as possible and the instructions contained in the communication
should be acted upon immediately.
14. Withdrawal of bids along with the earnest money will be allowed before the date of opening
of tenders.
15. EMD will be forfeited :-
(i). If bidder withdraws his participation after opening of Bid.
(ii). In case of non acceptance of terms & conditions of tender.
(iii). If successful bidder fails to start the work after award of contract.
(iv). If any false information is furnished by the bidder.

II. Conditions of Contract
1. DEFINITIONS:
In the interpretation of the contract and the general and /or special condition governing it, unless the context
otherwise requires:-
1.1.The term 'Contract’ shall mean the invitation to tender, the instructions to bidder, acceptance of the
tender schedule, particulars hereinafter defined and those general and special conditions that may be
added.
1.2.The term "Contractor" shall mean the person, firm or Company with whom the order for drug testing is
placed and shall deem to include the contractor's successor (approved by the ESIC MH Chandigarh),
representatives, heirs, executors and administrators unless excluded by the contract.
1.3.‘Contract price’ shall mean the price of tests accepted or the prices calculated in accordance with the
prices accepted by or on the behalf of the ESIC MH Chandigarh.
1.4.The term “delivery" shall mean delivery of reports by the dates specified in the acceptance of tender of
drug testing.
1.5.The term "Corporation" shall mean the “Employees State Insurance Corporation”.
1.6.The term ‘Medical Superintendent, ESI Hospital Chandigarh’ in addition also means any other officer
authorized for the time being to execute contract relating to the drug testing on behalf of the ESIC MH
Chandigarh .
1.7.The term "test" shall mean such test or tests as are prescribed by the specification or considered
necessary by the ESIC MH Chandigarh.
2. This rate enquiry is for the purpose of executing Rate Contract for Testing of Drugs (Allopathic) at ESIC
MH Chandigarh.
2.1 The rates accepted by the Medical Superintendent, ESIC MH Chandigarh shall be valid for the complete
period of contract for quantities of drugs that may be tested from time to time.
2.2 The bidder should read carefully the terms and conditions and bidder should quote only for those
items, for which they qualify as per terms & conditions of the Rate Contract and for which they have
valid authorization on the date of the tender, supported by documentary evidence.
2.3 The bidder should quote only one rate for each item Sr.No. without any variation or escalation clause.
Testing charges should be all inclusive of transportation Charges/ Freight charges / any
other charges irrespective of methodology used and exclusive of GST.
2.4GST will be paid to the laboratory upon submission of claim to the ESIC MH Chandigarh
withproof of actual payment of GST.GST will be paid after deduction of TDS on GST as persection 51 of
GST Act.
2.5If the bidder does not want to quote price for any item/drug, that item should not be selected
because the selected item cannot be left blank or quoted NIL/ZERO. If selected item is left blank or quoted
as nil/zero, the bidder stands disqualified for that item.Price bid has to be submitted with exact serial
number and item no as per drug list attached in Annexure G.

3. Validity of Bids
The quotations shall remain open for acceptance for 90 days (Ninety days only) from the date of
publishing of tenders. If required this office may ask for extension of validity of bid for a reasonable
period.
4. Eligibility Criteria for Bidders
Laboratories to be eligible should fulfill the following conditions:-
4.1 The Bidder/Laboratory should be continuously in the business of testing of drugs since
01/04/2015(please attach relevant documentary proof).
4.2 Bidder(s) participating in Tender must have annual turnover of not less than Rs.10,00,000/- (Rupees
Ten lakhs only)per year during last three consecutive Financial years (i.e. 2015-2016, 2016-17,
2017-2018).
4.3 Bidder(s) participating in Tender should not be blacklisted/deregistered by any Govt.
Institution/Autonomous Health Institution during the last three years.
4.4 Bidder(s) participating in Tender should not be convicted by any court of law in any matter on any
grounds as per undertaking.
4.5 Bidder(s) participating in Tender must have Valid License for Testing of Drugs/Dressings/Vaccines
etc., for Items quoted in the Tender, issued from Statutory body with Approval under Drugs and
Cosmetics Act, 1940 and Rules, 1945 and amendments thereinand should comply with schedule
annexed therein.
4.6 Family members of officers/officials working in ESIC cannot take part in this tender enquiry. This
will also apply to officers/officials who leave/retire from the services of ESI Corporation within
01(one) year of date of opening of tender.
4.7 Bidder(s) participating in Tender must have valid Documents in support of Registration of GST/GST
registration certificate.
4.8 Bidder(s) participating in Tender should have valid Accreditation for carrying out “Testing of Drugs”
from NABL with scope of accreditation or valid certificate from Competent authority of being a
Government approved laboratory for drugs testing.
4.9 Bidder(s) participating in Tender should have duly signed & stamped experience certificate by
Competent Authority of at least One (01) Government/Autonomous Health Institution on the
Institute’s letter head of providing Testing services for the last two consecutive years.
Bidders are advised to quote strictly as per eligibility mentioned above. Failure to adhere to the same
shall make the tender liable for rejection.

5. Bid Security (Earnest Money Deposit)
5.1 The bidder shall have to deposit Bid Security/Earnest Money of Rs.5,000/-(Rupees Five thousand
only) in the form of Demand Draft from any Nationalized Bank/Scheduled Bank in favour of
"ESIC fund Account No.1" Payable at Chandigarh failing which the tender will be rejected summarily.
OR
Documents in support of the exemption of EMD. Validity of this document should not
expireduring the validity of Tender and during the entire duration of contract if
contract awarded after Technical and Financial bid evaluation. Scanned copy of the same
is to be uploaded in Technical bid.
5.2 EMD of unsuccessful bidder(s) will be returned back at the earliest without any accrual
ofinterest after finalization of contract.
5.3 EMD of successful bidder will be adjusted towards Security Deposit after finalization
of tender.
6 Security Deposit:-
Successful bidders will be required to deposit as Security Deposit a sum of Rs. 25,000/-
(Rupees Twenty five thousand only) in the form of Demand Draft from any Nationalized
Bank/Scheduled Bank within the Stipulated period as and when informed.
6.1 EMD deposited by the successful bidders shall be adjusted towards the Security. Security Deposit
(i) shall remain valid for sixty days beyond the date of completion of all contractual obligations
(ii) of the agency including statutory obligations. The Security Deposit shall be forfeited if:
1. 6.1.1.Successful bidder fails to comply with any of the terms & conditions of the contract.
2. 6.1.2.Successful bidder is found to be implicated of indulging in any fraudulent practices or
3. is blacklisted any time during the contract.
6.1.3.If the contractor withdraws or amends withoutprior consent or impairs or derogates from
the tender in any respect within the period of validityof ratecontract including extension period.
6.1.4.If it comes to notice that information/ documentsfurnished areincorrect, false, misleading
or forged without prejudice to other right of the ESIC MH Chandigarh.
6.2 Security Deposit of successful bidder will be returned without any interest on receipt of
satisfactoryPerformance report from user departments after the expiry of the contract.

7 Acceptance of the Tender
7.1 The Medical Superintendent reserves the right of accepting/rejecting the whole or any part of the tender
without assigning any reason.
7.2 The ESIC MH Chandigarh shall communicate acceptance of the quotation by a letter. The formal
acceptance of the tender will be forwarded to the successful bidder .
7.3 The instructions contained in the letter should be acted upon immediately by the bidder.
7.4 The bidder, whose tender is accepted will then send Contract Form conveying his acceptance of the
terms and conditions of tender in the prescribed format, on a notarized stamp paper of Rs.100/-to the
Medical Superintendent, ESIC MH Chandigarh.
7.5 The approval of this letter by the Medical Superintendent, ESIC MH Chandigarh will enforce
the contract and will be applicable as per law.
8. The Medical Superintendent, ESIC MH Chandigarh reserves the right to reject any or all
offers including the lowest quotation at any stage without assigning any reasons whatsoever.
9. Laboratories debarred by ESI Corporation for participation in ESI Rate Contract
need not apply.
10. Non submission of any mandatory information in e-Tender will render the bid liable for rejection.
11. Not following all the Terms & Conditions of e-Tender Enquiry, furnishing wrong information and
false documents will make the bidder ineligible and liable to be debarred/blacklisted from
participation in future ESI Rate Contracts for two years along with forfeiture of the Earnest
Money/Performance Security.
12. Bidder will have to furnish documents in support of the information given in the tender.
Original documents shall be submitted for verification as and when required.
13. In case of any attempt for cartelization by bidder(s) with a view to hike up the prices and/ or influence,
pressurize the buyer in any manner with regard to preparation of Rate Contract or any other procedure
related to Testing thereafter, Bid(s) of said bidder(s) may be rejected and the bidder(s) may be
blacklisted for a minimum period of Two Years/any other action deemed fit by competent authority
may be taken.
14. The bidder, if selected, will have to provide Testing facility directly to the ESIC MH Chandigarh.
No further subletting of the contract is permissible at any stage.
15. After the finalization of Rate contract by the Medical Superintendent, ESIC MH Chandigarh Orders for
Testing will be placed by the Deputy Medical Superintendent/Doctor In charge Medical Stores.

16. Samples for Testing will be given on every 15th& 30th day of every month (15th , 28th day of February)
during the currency of the contract in which the exact quantities to be tested on each occasion together.
If the above said dates are declared a public holiday, the bidder will collect samples for Testing on the
next working day at the same venue and time.
17. Samples for Testing against the contract will be accepted as long as these reach the contractor on or
before last date of the currency of the contract. Orders received during the closing days should be
complied within due course, in accordance with the contract, even though in some cases owing to
contract having expired, orders are to be executed after the expiry of the last date of contract.
18. No guarantee can be given as to the maximum number of Orders for testing that may be placed against
this Contract, but the contractor will have to provide Testing Facility as may be ordered during the
currency of the contract.
19. The rate quoted by bidder for Testing of Drugs/Dressings/Vaccines to the Corporation, shall in no event
exceed the lowest price at which the contractor provides the testing facility of identical description to
any other person(s)/ institutions during the said period of agreement. If at any time during the said
period, the contractor reduces the price of such items to any other person(s)/ institutions at a price lower
than the price chargeable under the agreement, he shall forthwith notify such reduction in Testing price
to the Medical Superintendent, ESIC MH Chandigarh and the price payable under the agreement for
such items after the date of its coming into force will be the reduced price. The approved price in Rate
Contract shall stand correspondingly reduced.
20. The price must be quoted F.O.R Destination per unit as shown in the schedule annexed and should be
inclusive of Freight Charges/Transportation Charges etc. irrespective of methodology used but exclusive
of GST. GST at prevailing rate shall be paid to the laboratory upon submission of claim and proof of
GST.
21. On no account should there be delay or refusal by bidder for drug testing. Samples fordrug testing
shall be given to the bidder as per preferencein Rate Contract, to be collected on the same day as
allotted.In case of failure to do so, the sample will be given to next higher bidderas per preference at
the risk and expense of the bidder who failed to collect the sample and the difference of the cost for
testing of drugs will be recovered accordingly.
22. Samples must be collected from Medical Store, ESIC MH Chandigarh, as per schedule and
as and when called for or as desired by competent authority of ESIC at cost and risk of the
Laboratory.
22.1.Samples will be given to authorized representatives of empanelled laboratory in person and reports will
be accepted accordingly.
22.2 Every Test Report should be on stipulated Form 39 in triplicate and should have Sr. No., Description of
Tests, Specifications and Results obtained including protocol of Test applied. In case of non-
pharmacopoeial products, the method of analysis should be mentioned in the report AND PROTOCOL
OF TEST APPLIED TO BE MENTIONED ON EACH REPORT.
22.3.“COMPLIES” or “PASS” or “WITHIN LIMIT” in the result column of the report is treated as
incomplete report ifthe result has some value, the actual value on analysis is to be reported.
Every report must have specific remarks(i.e.) Standard Quality or Not of Standard Quality.
Any ambiguity/cutting will not be accepted.

22.4. In case of failure of a sample, it is mandatory to inform the result immediately to the Medical
SuperintenendentESIC MH Chandigarh or her representative through E-mail. Hard copy of the
report must be sent as per prescribed protocols.
22.5.The test analysis will be carried out as per the pharmacopoeial monographs with the use of
Pharmacopoeial Reference Standards.

24. Penalty Clause
24.1.If the successful bidder fails to provide the testing report within the stipulated period specified against
each drug to be tested, penalty of 5 % of the value of the order calculated at the contract rate per week
will be levied. The maximum penalty for late supply shall not exceed 10 % of the total value of the
order/orders.The cut-off date of submission of testing report shall be counted from the date of collection
of drugs from Medical Store, ESIC MH Chandigarh.If the report of drugs collected is not submitted even
after two weeks then the ESIC MH Chandigarhwill get the drug tested from the next higher bidder and
the difference of cost will be recovered from subsequent bills/security money deposit of the empanelled
laboratory who fails to give report of testing of drugs.
24.2.ESIC MH Chandigarh reserves the right to recover the cost of drug samples from any bidder who fails
to submit the drug testing report irrespective of the preference in Rate Contract.
24.3.Irregular sample collection/delivery of reports or failure to fulfill the terms of contract may entail for
closure of contract and for forfeiture of security deposit.
25. LEGAL
25.1.In case the successful bidder/Lab gives wrong/fraudulent result, which on later stage gets
challenged/gets declared as on “NOT OF STANDARD QUALITY” or otherwise by Government
laboratory or Government recognized laboratory or any other empanelled laboratory, the lab should be
liable to be penalized by forfeiture of performance Security and rate contract is deemed cancelled for a
period of not less than 02 year. Further, if any adverse reaction occurs/reported due to consumption of
such drug-all legal liabilities lies with the empanelled laboratory i.e. the empanelled laboratory will be
responsible for all kinds of damages occurring due to consumption of such drug.
25.2.If the bidder fails to deliver report of drug testing within the stipulated time and later on, drug of that
particular batch is found not of standard quality by any other laboratory and meanwhile any adverse
reaction occurs/reported due to consumption of such drug-all legal liabilities lie with the empanelled
laboratory i.e. the empanelled laboratory will be responsible for all kinds of damages occurring due to
consumption of such drug.
25.3.If the bidder fails to deliver report of drug testing at all and later on drug of that particular batch is
found not of standard quality by any other laboratory and meanwhile any adverse reaction
occurs/reported due to consumption of such drug-all legal liabilities lie with the empanelled laboratory
i.e. the empanelled laboratory will be responsible for all kinds of damages occurring due to consumption
of such drug.
26. List of Government institutes/Autonomous institutes to be provided for which testing services
are being provided by the bidder.
27. The rates should be applicable for Chandigarh(UT) at FOR.

28. Price Bid:-
28.1.Bidder must quote the rates strictly as per the given Format (Table-I) and as per the list of Items
attached with the tender form, mentioning the exact Serial No. and Item No.-

29. Billing & Payment
Bills to be submitted in triplicate duly signed and stamped by 10th of every month to enable timely
payment. Payment for the reports will be made within 4 to 6 weeks (after receipt and acceptance of the
Bill).
30. Subletting of contract:
The Contractor shall not sublet, transfer or assign the contract or any part thereof. In the event of the
contractor contravening this condition Medical Superintendent, ESIC MH Chandigarh will be entitled to
place the contract elsewhere at therisk of the contractors account and the contractor shall be liable for any
loss or damage that ESIC MH Chandigarh may sustain in consequence arising out of such replacing of the
contract.
31. Rate Revision :
Successful bidders shall not be entitled to any rate revision of price for any reason except that
allowed by Government of India or downward revision as mentioned in clause 19.
32.Recovery of sums due:
Whenever any claim for the payment of a sum of money arises out of or under this contract
against the contractor the purchaser shall be entitled to recover such sum by appropriating,
in part or whole from the future bills of the bidder/security deposited by the contractor.
Should this sum not be sufficient to cover the full amount recoverable, the contractor
shall pay to the ESIC MH Chandigarh on demand the remaining balance due.

33. Fraud & Corruption
33.1The bidder, supplier and the contractor shall observe the highest standard of ethics during
the procurement & execution of such contracts in pursuit of this:
33.2Definitions, for the purposes of this provision and the terms set forth are as follow:-
33.2.1. “Corrupt Practice” means the offering, giving, receiving or soliciting directly or indirectly
of anything of value to influence the action of public official in the procurement process or in
contract execution.
33.2.2. “Fraudulent Practice” means a misrepresentation or omission of facts in order to influence a
procurement process or the execution of a contract.
33.2.3. “Collusive Practice” means a scheme or arrangement between two or more bidders, with or
without the knowledge of the purchaser, designed to establish bid prices at artificial, non -
competitive levels;
33.2.4 “Coercive Practices” means harming or threatening to harm, directly or indirectly, person or their
property to influence their participation in the procurement process or affix to execution of a contract.
33.2.5. Will reject a proposal for award, if it is determined that the bidder recommended for award has
directly or through an agent engaged in corrupt, fraudulent, collusive, coercive practices in competing
for contract in question.
34. Arbitration
In the event of any dispute or difference arising under these conditions or any special conditions or
contract or in connection with this contract, except as to any matters the decision on which is specially
provided for by these or special conditions the same shall be referred to the sole arbitration of the
Medical Superintendent, ESIC MH Chandigarh or some other person appointed by her under the
Arbitration Act, 1996 and the rules there under and any statutory Modifications thereof for the time being
in force shall be deemed to apply to the arbitration proceedings under this clause. There shall be no
objection that the arbitrator is a Government/Corporation servant and that he had to deal with matters to
which contract relates or that in the course of his duties as Govt./ Corporation servant he had expressed
views on all or any of the arbitration dispute or differences. The award of the arbitrator shall be final and
binding on both the parties to this contract.
34.1. The venue of the arbitration shall be Chandigarh(UT).
34.2. All the disputes relating to this tender enquiry and Rate Contract shall be subject to the
territorial Jurisdiction of Courts at Chandigarh(UT) only.
34.3. In this clause the expression the Medical Superintendent, ESIC MH Chandigarh means the Medical
Superintendent, ESIC MH Chandigarh for the time being and includes, if there be no Medical
Superintendent, ESIC MH Chandigarh , the officer who is for the time being the Administrative
head of the ESIC MH Chandigarh whether in addition or otherwise.
34.4. For the purpose of the contract including proceedings there under, the Medical Superintendent,
ESIC MH Chandigarh shall be entitled to exercise all the rights and powers for the ESIC MH
Chandigarh.

35. Validity of the Rate Contract is two years from the date of finalization of the contract. Period can
be extended further for a period of one year more as desired by the Medical Superintendent, ESIC
MH Chandigarh with consent of both the parties.
36. Canvassing in any form is strictly prohibited and the bidders who are found canvassing are liable
to have their tenders rejected out-rightly.
37. The bidderat all times should indemnify ESIC Model Hospital, Chandigarh against all
claims, damages or compensation.
38. MSME provisions will be adhered to in this tender as per Government of India guidelines.
39. Force Majeure will be applicable to both the parties.

Government/Autonomous Institutions, duly signed & stamped by the Competent Authorityon their
letterhead of last two consecutive years .

Corruption Act,1988 (including its amendments).

price lower than the price chargeable under the contract, I/we shall forthwith notify such reduction to the
Medical Superintendent, ESIC MH Chandigarh and the price payable under the contract for the Testing
of Drugs, after the date of coming into force of such deduction, shall stand correspondingly reduced.
17. I/We further undertake that in case of any down-ward revision same will be passed on to the ESI
Corporation from the effective date during the currency of the contract and in case of failure to do so
weare liable to be debarred from future ESIC Tenders for a period of two years along with forfeiture of
Performance security.
