THE ENVIRONENT CODE OF THE PROVINCE OF SARANGANI

ARTICLE I. TITLE OF THE ORDINANCE AND RATIONALE

Section 1. Title of the Ordinance

This ordinance shall be knon as the S(r($-($i Proi$/e E$iro$*e$! Co)e of 2010andshall hereinafter be referred to as the S(r($-($i E$iCo)e!

Section 2. Rationale

The socio"econo#ic de$elop#ent of Saran%ani Pro$ince depends on its sustainableEn$iron#ent and Natural Resources &ENR' #ana%e#ent! The ur%enc( and i#portance ofprotectin%) de$elopin% and sustainabl( #ana%in% the Pro$ince*s ENR assets ill not onl(contribute si%nificantl( in upliftin% the socio"econo#ic condition of Saran%ans but ill alsopro$ide a better en$iron#ental condition for its constituents! +ith better ENR #ana%e#ent)the protection and ad$ance#ent of the ri%ht of the people to a balance and healthful ecolo%(in accord ith the rh(th# and har#on( of nature as %uaranteed in the Constitution of thePhilippines and #andated in the ,ocal Go$ern#ent Code &R!A! -./0' ill trul( be reali1ed!

Saran%ani*s location) assets and people are so #uch linked and intertined ith its ENRassets fro# the upland to the loland and don to the coastal areas! As such) there is aneed to look into hu#an acti$ities) conflictin% de#ands of population %roth) rapid naturalresources utili1ation) urbani1ation) industrial e2pansion) increasin% technolo%ical ad$ancesand the policies associated ith these acti$ities! The interconnectedness of life supports(ste#s re3uires policies that are based on bioph(sical condition of $arious ENR assets toreall( attain) pro$ide and sustain a better en$iron#ent for i#pro$in% the li$es of the peopleof Saran%ani!

Fra%#ented approach to de$elop#ent and en$iron#ental protection #ust be chan%edthrou%h the inte%rated rid%e to reef approach! Therefore) there is an ur%ent need tofor#ulate policies and support en$iron#ental pro%ra#s that are co#prehensi$e) inte%rati$e

and participator( to brin% about chan%e in the a( ENR assets are bein% #ana%ed!Concerted effort backed up ith concrete policies toards the protection of the Pro$ince*sENR assets is reall( a necessit(!Generation of #ore re$enue throu%h le%islation ill pro$ide #ore resources for thei#pro$e#ent of Saran%ani*s ENR assets! It ill allo the pro$ince to raise funds that couldbe used to support the %o$ern#ent*s ENR #ana%e#ent efforts! 4( doin% so) the Pro$incecould better respond to the %roin% de#and for $arious ENR ser$ices fro# the uplands tothe lolands and don to the coastal areas!

Section 4. Guiding Principles

The for#ulation and i#ple#entation of the ENR pro%ra#s of the Pro$ince shall be %uidedb( the folloin% principles6

Section 1&. Air @uality %anage!ent!

The Pro$incial ENRO shall collaborate ith ?ENR"En$iron#ental Bana%e#ent 4ureau&:%6') ?epart#ent of Transportation and Co##unication &OT' and other a%encies in#onitorin% and ensurin% air 3ualit( standards!

Section 1&.1. :!issions fro! Stationary Sources

The Pro$incial ENRO shall collaborate and pro$ide assistance to ?ENR"EB4 in #onitorin%e#issions fro# point sources such as trade) industr() process and fuel"burnin% e3uip#ent orindustrial plant e#ittin% air pollutants) if necessar(!

Section 1&.2. :!issions fro! %otor ehicles

All #otor $ehicles ithin the Pro$ince of Saran%ani shall co#pl( ith the e#ission standardsas prescribed in the Clean Air Act of .555 or R!A! >-;5'! The Pro$incial ENRO shall conductperiodic e#ission testin% of #otor $ehicles in the Pro$ince! Violation of such e#issionstandards shall be penali1ed in accordance ith Section ;. of this Code!

Section 10. Regulation of Aerial Spray!

Aerial spra(in% of banana and other a%ricultural crops shall be done before sunrise!Violators shall be penali1ed under this En$iCode!

The Pro$incial ?isaster Risk Reduction Bana%e#ent Council &PRR%' shall prepareappropriate adaptation) #iti%ation) and contin%enc( #easures to address the i#pacts ofdrou%ht) ater scarcit( crisis and other ad$erse i#pacts of cli#ate chan%e!

As a pre$enti$e #easure in reducin% risks due to natural and other si#ilar cala#ities) the

P?RRBC shall prepare andor facilitate the preparation of ?RR Plan!

Section 21. Protection of Groundater Resources.

The Go$ernor throu%h the Pro$incial ENRO shall also pro$ide assistance to concerned#unicipalities and baran%a(s in the establish#ent of their #onitorin% and e$aluation s(ste#

and stren%thenin% of their enforce#ent capabilit(! The Pro$incial ,e%al Office &P)O' shall beresponsible for the prosecution of cases in$ol$in% ille%all( sourced or transported #inerals!

Section 3. TaB on Sand and Gra#el and other @uarry Resources

The Pro$incial Go$ern#ent shall i#pose the appropriate ta2 on s#all scale #inin%) sandand %ra$el and other 3uarr( resources pursuant to Sec! .7> of RA -./0 and the Pro$incialTa2 Ordinance 900."09!

It shall be unlaful for an( person) corporation) partnership) or %o$ern#ent entit( orinstru#entalit( to e2tract) #ine and dispose of #etallic non"#etallic #inerals ) ordinar(stone) sand and %ra$el) %uano) boulders) pebbles) earth and other 3uarr( #aterials) fro#beds of seas) lakes) ri$ers) strea#s) creeks and other public aters and fro# public andpri$ate lands ithin the territorial :urisdiction of the Pro$ince of Saran%ani unless dul(

authori1ed under a per#itlicense dul( issued b( the Go$ernor as cited under Section9>ofthis Code! Pro$ided) that no per#it shall be issued b( the Go$ernor ithout the priorconsent of the concerned #unicipal and baran%a( san%%unians and area clearance fro#national a%encies!

No e2traction or re#o$al of #aterials shall be alloed in shoreline areas and in otherbanned areas ithin the territorial :urisdiction of Saran%ani 4a( Protected Seascape underPresidential Procla#ation -=/ and 4atas Pa#bansa 9/5!
