INTRODUCTION

Rationale of Summary Report The Legislature enacted the Employee Housing Act (Act) for the benefit of persons living in privately owned and operated employee housing to assure their health, safety and general welfare, and to provide them a decent living environment. The Act also provides protection for the general public which may be impacted by conditions in and around employee housing. The Department of Housing and Community Development’s (HCD’s) Employee Housing Program (Program) adopts and enforces statewide regulations for the construction, maintenance, use, and occupancy of privately owned and operated employee housing facilities providing housing for five or more employees (typically farmworkers) to assure their health, safety, and general welfare. HCD Program staff oversees the application of state laws, regulations and code enforcement by local enforcement agencies (LEAs) who elect to enforce the provisions of the Act in their jurisdiction. Where LEAs do not enforce the provisions of the Act, HCD acts as the enforcement agency. This report is prepared by the HCD on the statewide Act. This report summarizes enforcement activity statistics for all permittees for which HCD acts as the enforcement agency, as well as information from the permittees and nine LEAs that have assumed enforcement for the Act during the 2015 calendar year. This report is prepared in accordance with Health and Safety Code (HSC) Sections 17031.8 and 17050(f)(1). HCD is required to conduct an annual evaluation and provide a summary of the enforcement of the Act, the building standards published in the California Building Standards Code relating to employee housing, and all regulations adopted pursuant to the Act, by each city, county, or city and county which has assumed responsibility for enforcement. HSC Section 50408 requires this report be submitted to the Governor and to each house of the Legislature on or before December 31 of each year. Employee Housing Program Law and Regulation Information The Act is contained in HSC, Division 13, Part 1, commencing with Section 17000. The Act mandates that HCD promulgate statewide regulations for the maintenance, use, and occupancy of privately owned and/or operated employee housing, comprised of housing accommodations for five or more employees, and five or more agricultural workers in certain rural areas, as defined by HSC Section 17008. HCD’s Program regulations are found within Title 25, California Code of Regulations, Division 1, Chapter 1, Subchapter 3, commencing with Section 600, and preempt any local regulation or ordinance specific to maintenance, use, and occupancy of employee housing subject to the Act. Specific Statewide Information HSC Section 17031.8 requires HCD to summarize specific statewide information regarding the employee housing inspected each year. This report includes 2015 enforcement statistics from HCD and the nine LEAs.

HSC Section 17031.8(c) requires the following information for the report:

1. The number and location of employee housing accommodations, including the number of permits to operate issued for employee housing accommodations (Total Permits to Operate Issued = 639. For more details, see page 6).

2. The number and location of inactive employee housing accommodations (Total

Inactive Facilities = 24. For more details, see page 6). 3. The number and location of employee housing accommodations found operating

without a permit (Total Illegal Facilities Discovered = 17. For more details, see page 6).

4. The number of employees occupying employee housing accommodations with a

permit (Total Number of Employees Housed in Permitted Facilities = 15,356. For more details, see page 6).

5. The number of employees occupying accommodations found to be operating

without a permit (Total Number of Employees Housed in Illegal Facilities = 36. For more details, see page 6).

6. The number and types of inspections and reinspections performed (Total Pre-

Occupancy Inspections = 148; Total Pre-Occupancy Reinspections = 260; Total Occupancy Inspections = 260; Total Occupancy Reinspections = 87; Total Illegal Facility Inspections = 2; Total Illegal Facility Reinspections = 0. For more details, see page 6).

7. A schedule of fees charged, the amount of fees collected for each type of fee

12. The number of staff hours dedicated to the implementation of the Employee

Housing Act, Part 1, commencing with HSC Section 17000 (Total Staff Hours Dedicated = 3,084. For more details, see page 6).

13. The number and location of employee housing receiving an exemption pursuant to

HSC Sections 17031, 17031.3, 17031.4, or 17033 (Facilities Exempted from Permit to Operate = 20. For more details, see page 6).

Violations cited during inspections of employee housing facilities are remedied in the same manner as all other code violations. Although there are differences in the enforcement structure of cities and counties, in most cases the local jurisdiction’s environmental health or building department issues the violation notices and performs follow-up reinspections to ensure corrective measures have been taken. SUMMARY OF ANNUAL LOCAL ENFORCEMENT AGENCY EVALUATIONS HSC Section 17050(f)(1) requires HCD to conduct an annual evaluation of each city, county, or city and county jurisdiction which has assumed responsibility for enforcement of the Act and to summarize the findings. Eight counties and one city have assumed enforcement responsibilities for the Act from the State. All nine LEAs were evaluated for their performance and ability to enforce the Act. During the monitoring conducted by HCD for 2015, staff identified the following LEAs as properly enforcing the employee housing provisions within the HSC: City of Gonzales, Monterey County, Santa Cruz County, San Mateo County, Stanislaus County and Tulare County. HCD identified three LEAs as not properly enforcing the employee housing provisions within the HSC: Napa County, Sacramento County and San Joaquin County. These three agencies shall respond within 30 days and supply an improvement plan that identifies the corrective measures that will be employed in order to successfully carryout the standards published in the California Building Standards Code relating to employee housing and all other applicable rules and regulations found within the Act in accordance with HSC Section 17050(e)(1). The following is a brief summary of deficiencies noted by HCD for each LEA that did not properly enforce the Act: Napa County Division of Environmental Health - The County shall reply to HCD within 30 days of this report with a written plan describing how and when improvements will be made. • Records indicate reinspections were not performed to verify the correction of cited

violations. • The inspector did not have a current copy of the Health and Safety Code or Title 25,

California Code of Regulations during the inspection.

• The inspector did not demonstrate the ability to identify violations during the inspection. The inspector is an Environmental Health Specialist and is not familiar with the requirements of the Building, Electrical, Plumbing or Mechanical Codes.

• The inspection report did not reflect the correct code references for each violation. • HCD’s Application for Permit to Operate Employee Housing Facility form was utilized

without modifications identifying Napa County as the enforcement agency. Sacramento County Environmental Management Department - The County shall reply to HCD within 30 days of this report with a written plan describing how and when improvements will be made. • Records indicate reinspections were not performed to verify the correction of cited

violations. • Records did not provide an accurate description of cited violations. • The inspector did not demonstrate the ability to identify violations during the

inspections and did not exhibit satisfactory knowledge of the Health and Safety Code or Title 25, California Code of Regulations.

San Joaquin County Environmental Health Department - The County shall reply to HCD within 30 days of this report with a written plan describing how and when improvements will be made. • The inspector did not inspect all facilities and equipment for compliance. • The inspector did not demonstrate the ability to identify violations; therefore, did not

exhibit satisfactory knowledge of the Health and Safety Code or Title 25, California Code of Regulations.

• Recreational vehicles do not meet minimum separation requirements.
