    INTRODUCTION

    Elections in the State of Wisconsin are conducted at the local level. As amunicipal clerk you are entrusted with the responsibility of ensuring fair,

    accessible, and transparent elections. Our job at the GovernmentAccountability Board (G.A.B.), Elections Division is to provide you with arange of resources to support you in carrying out your duties.

    Many changes have occurred in the way elections are conducted in the Stateof Wisconsin over the past ten years. The changes have not been easy butdue to the dedication, patience, and hard-work of election officials at alllevels of government, we have transitioned well into the new requirements.I believe local election administration in Wisconsin is better than ever andthat is a testament to the efforts of Wisconsins dedicated municipal clerk.

    The Election Administration Manual for Wisconsin Municipal Clerks wasdeveloped to serve as a knowledge base for the array of duties required of municipal clerks. I encourage you to reference this manual frequently and tomake use of the other resources cited throughout the manual. And, asalways, the G.A.B. staff is here to provide answers and advice to assist youin fulfilling your obligations to protect the integrity of elections and ensure

    public confidence in the election process.

Additionally, no person may have hisor her name placed on the ballot for any state or local elective office in Wisconsinif the person has been convicted of a felony in any court in the United States unlessthe person has been pardoned of the conviction (Wis. Con. Art. XIII, 3(3)). Any

    person who falsely signs this statement could be convicted of a violation of 12.13(3)(a), (am), Wis. Stats.

    Ballot Access Procedure

    All candidates, regardless of office sought, must complete ballot access documents.Most candidates are nominated for office through the filing of nomination papers.However, some towns and villages use the caucus procedure to nominatecandidates for town or village office. All candidates, regardless of the nomination

    procedure used, must file two documents:

    1. Campaign Registration Statement (GAB-1) 2. Declaration of Candidacy (GAB-162)

    If a candidate fails to file one or both of these forms with the municipal clerk bythe deadline for filing nomination papers or by 5:00 p.m. on the fifth day after acandidate receives notification of nomination at a caucus, the clerk cannot place

    the candidates name on the ballot.

    Municipal judge candidates also need to submit a Statement of Economic Interests to the Government Accountability Board, Ethics and Accountability Division inorder to meet ballot access requirements. Ballot Access Checklists (GABIS-6, 7)for municipal candidates indicate this requirement and the appropriate filingdeadline. Forms and instructions are available from the GovernmentAccountability Boards website ( http://gab.wi.gov ). Additionally, some municipalities may have an ethics ordinance under 19.59(3)(b), Wis. Stats., requiring a Statement of Economic Interests to be filedwith the local filing officer in order to achieve ballot status. If you are unsurewhether your municipality has an ethics statement requirement, you should check with your municipal attorney. If the statement is not filed by the stated deadline,the candidates name will not appear on the ballot.

    Clerks should make candidate packets available for all prospective municipalcandidates. All ballot access forms and checklists are available on the agencywebsite, or by contacting the Government Accountability Board. Candidate

    Campaign Registration Statement (GAB-1)Candidates may register (file a Campaign Registration Statement (GAB-1)) atanytime, but not later than the deadline for filing nomination papers or not later than 5:00 p.m. on the fifth day after receipt of notification of nomination at acaucus. The Campaign Registration Statement (GAB-1) must be accurate andcomplete.

    Note : Campaign finance law requires a candidate to register as soon as the intentto be a candidate is known. Therefore, a candidate should register before engaging

    in campaign activity and before accepting contributions or making disbursements.

    The following information is required on each section of the CampaignRegistration Statement (GAB-1):

    1. Section 1: Candidate and Candidate Committee Information

    a. The name and address of the candidate.

    2. Section 2: Political Committee Information

    Not applicable to candidates. A referendum committee that has spentmore than $750 is required to register by completing Section 2, 3 and 5.Any other committee that has spent more than $25 dollars for a political

    purpose, is required to register by completing Sections 2, 3 and 5.

    3. Section 3: Committee Information

    A treasurer is required. If there is not a separate treasurer, the candidateis the treasurer.

    4. Section 4: Principal Officers of Committee

    Not required unless there are principal officers and/or custodians of accounts.Note : This section can be used to list persons authorized to fill a vacancyin nomination in the event of the death of the candidate.

    5. Section 5: Depository Information

    Depository information is required.* A separate campaign account isrequired unless the candidate serves as treasurer of the campaign and isexempt* from filing campaign finance reports. In that case, a personalaccount may be used.

    *This section may only be left blank if the clerk has a signed letter fromthe candidate promising that the candidate will not spend any money onthe campaign.

    6. Certification

    Must be signed by the candidate and treasurer (if there is a separatetreasurer).

    7. Exemption

    If the candidate qualifies for exemption* from filing campaign financereports, the appropriate box (This candidate is eligible for exemption)

    must be checked, and the candidate or treasurer must sign.

    *Eligibility for Exemption : Committees may be eligible for an exemptionfrom filing campaign finance reports if campaign finance activity is lowenough to meet all of the following criteria:

    a. The committee anticipates that it will not accept contributions, makedisbursements, or incur loans and other obligations in an aggregateamount exceeding $1,000 in a calendar year; AND

    b. The committee anticipates that it will not accept any contribution or cumulative contributions from a single source (other than thecandidate) exceeding $100 in a calendar year; AND

    c. The candidate or treasurer must sign and date the request for exemption on the campaign registration statement.

    Committees on exemption may receive up to $1,000 in a calendar year, andmay spend up to $1,000 in the same calendar year. The candidates

    contributions do count toward the total receipts of $1,000 or less in acalendar year. The $100 limit on contributions from a single source does notapply to contributions from a candidates personal funds for his or her owncampaign. If the committee exceeds any of these thresholds, the committeeis required to amend its registration statement to come off exemption and

    begin filing campaign finance reports.

    Most candidates in municipal elections will qualify for exemption.Candidates who do not qualify for exemption should be directed to theCampaign Finance Overview Local Candidates , which is available on theagency website . The clerk must provide campaign finance forms upon request.

    Declaration of Candidacy (GAB-162)

    The Declaration of Candidacy (GAB-162 ) may be filed at any time, but not later than the deadline for filing nomination papers or not later than 5:00 p.m. on the

    fifth day after receipt of notification of nomination at a caucus. A person who has been convicted of a felony cannot run for or hold public office unless he or she has been pardoned of the offense. The Declaration of Candidacy (GAB-162) containsa certification that the candidate meets this requirement.

    The following information is required:

    1. The candidates name.

    2. The proper title of the office the candidate is seeking, including anyapplicable seat, branch or district number.

    3. Party affiliation does not apply for municipal (nonpartisan) elections.

    4. The candidates name in the form that the candidate wishes the name toappear on the ballot.

    5. The form must be notarized or signed by a person authorized to administer oaths.

    Nomination Paper Procedure

    All cities and some villages and towns use the nomination paper process.

    1. Nomination Papers for Nonpartisan Office (GAB-169) containing sufficientsignatures for the office sought must be filed, along with the CampaignRegistration Statement (GAB-1) and Declaration of Candidacy (GAB-162),not later than 5:00 p.m. on the first Tuesday in January for the SpringElection (if the first Tuesday in January is a holiday, the deadline is the next

    business day) . 2. Nomination papers may not be circulated before December 1 st in the year

    preceding the Spring Election.

    3. Nomination papers must be filled out correctly. In order to be sufficient, thefollowing information is required for each section.

    a. Candidate Information (top of form): All information concerning thecandidate must be completed in full before circulating this form toobtain signatures of electors, including:

    i. Name of the Candidate as it will appear on the ballot .

    ii. Candidates residence (if a candidate's municipality of residence is different from the municipality used for mailing

    purposes, both must be given) .

    iii. Date of Election .

    iv. Title of Office (must be listed along with any branch, district, or seat number that clearly identifies the office the candidate isseeking) .

    v. Name of jurisdiction or district in which candidate seeks office.

    b. Signatures of Electors: Each signature entry must contain the signersname, complete address including municipality, and the date of signature.

    c. Certification of Circulator (bottom of form): After obtainingsignatures of electors, the circulator must sign and date thecertification, certifying that he or she personally presented thenomination paper to each signer. The circulator's complete address(including municipality of residence) must be listed in thecertification.

    4. Upon receipt of completed nomination papers, the municipal clerk shouldimmediately review the filed papers to determine sufficiency. SeeGovernment Accountability Board Administrative Code, GAB 2.05,available on the agency website, for rules and direction for reviewingnomination papers.

    5. The number of signatures required depends on the office sought. See theBallot Access Checklist for Municipal Candidates (GABIS-7).

    6. The municipal clerk should issue a receipt to the candidate or candidatesagent when nomination papers are filed. A sample Nomination Paper Receipt (GAB-151) is available on the agency website.

    2. If an incumbent candidate fails to file a Notification of Noncandidacy(GAB-163) on time, and does not file the appropriate documents to qualifyfor the ballot on time:

    a. The deadline for filing ballot access documents is extended 72 hoursfor that office.

    b. This means that anyone, except the incumbent, can file the required ballot access documents and sufficient nomination papers within theextension period and qualify for placement on the ballot.

    Filing Officers & Record k eeping

    Municipal clerks serve as the filing officers for the following elected offices:

    Note : Multi-jurisdictional municipal judges file with the county clerk of the largest portion of the jurisdiction served by the judge.

    1. City Clerk: Mayor, City Clerk, Treasurer, Alderperson, any other electedcity offices.

    2. Village Clerk: Village President, Trustee, Clerk, Treasurer, Municipal Judge,any other elected village offices.

    Note : The Milwaukee City Board of Election Commissioners serves as the filingofficer for all City of Milwaukee offices, including school board.

    OTHER REGISTRANTS

    Summary

    Although candidate committees will probably account for the vast majority of campaign finance registrations filed in the office of a municipal clerk, there areseveral types of political groups or committees that may be required to register with the municipal clerk. Political committees that support or oppose municipalcandidates or referenda file with the municipal clerk. As a general rule, a politicalcommittee that accepts contributions, incurs obligations or makes disbursements ina calendar year in an aggregate amount in excess of $25 is required to register.However, a referendum group may accept contributions, incur obligations or makedisbursements in a calendar year in an aggregate amount of $750 beforeregistration is required. 1

    Note : If a political committee is supporting or opposing candidates at several locallevels, they only file campaign finance forms with the county clerk.

    Types of Committees

    1. Political Action Committee (PAC): a committee organized to support or oppose candidates or referenda.

    2. Recall Committee: a committee organized to support or oppose the recall of an elective office holder.

    3. Political Group: a committee organized to support or oppose a referendum.

    4. Independent Committee : a committee organized for the purpose of supporting or opposing the election of candidates, which makesdisbursements without the knowledge or consent of the candidate (or anyagent or authorized committee of the candidate). Independent committeesmust file an Oath of Independent Expenditures (GAB-6).

    5. Individual: a person, other than the candidate or agent of the candidate,supporting or opposing a candidate, who makes disbursements without the

    Registration Requirements for Committees

    Individuals or committees who exceed the $25 threshold (and referendum groupswho exceed the $750 threshold) are required to register by filing a CampaignRegistration Statement (GAB-1) with the filing officer. Committees completesections 2, 3 and 5 of the Campaign Registration Statement (GAB-1). IndependentCommittees and Individuals are also required to file an Oath of IndependentExpenditures (GAB-6).

    Campaign Finance Reporting

    Committees are subject to the same reporting requirements as candidates. Acommittee is required to file campaign finance reports unless the CampaignRegistration Statement (GAB-1) indicates that the committee is eligible for exemption from filing reports (see the Exemption from Filing Campaign FinanceReports section of the Campaign Registration Statement (GAB-1). Also see theCandidates section of this manual for more information on the exemption).

    The municipal clerk is required to send a reminder notice and Campaign FinanceReport (GAB-2L) to the treasurer of each committee required to file campaignfinance reports not later than 14 days before the applicable report deadline. If thetreasurer of the committee is not the candidate, a notice must also be sent to thecandidate.

    Municipal clerks have the responsibility to report campaign finance violations,such as failure to file reports and late filing of reports, to the district attorney under 11.22(4), Wis. Stats.

    County, municipal, and school district clerks are responsible for publishing five basic election notices:

    1. Type A Notice of Election

    Additionally, Wisconsin law requires that meetings of all state and localgovernmental bodies, including governmental subunits, shall be publicly noticed,

    held in places reasonably accessible to members of the public, and shall be open toall citizens at all times unless otherwise expressly provided by law. Election-related meetings such as Board of Canvassers, voting equipment testing, post-election audits, etc., fall under this requirement, and the municipal clerk must

    Type A Notice of Election

    The purpose of this notice is to inform the public and potential candidates of theoffices to be elected and inform voters of the upcoming election. This notice mustinclude the following information:

    For an election at which a referendum is to be held, the Type A Notice mustinclude the following information:

    1. Date of the election

    2. Text of the referendum question

    3. Statement on where to obtain a copy of the resolution directing submissionof the question to the voters .

    Publishing

    1. Spring elections: Municipal clerks publish one Type A notice for municipaloffices on the fourth Tuesday in November before a spring municipalelection.

    If there will be any referenda voted on at the spring primary or election,municipal clerks publish a Type A Notice of Referendum on the fourthTuesday before the spring primary or election.

    2. Fall elections: County clerks publish the Type A notice for state and countyelections and referenda.
