WEREAS, Section 125.01 (j) , Florida Statutes (1981),
provides that the Board of County Commissioners of c at tin County,
Florida may establish programs for flood control; and
WHEREAS, the Federal Emergency Management Agency is
requiring that Martin County enact legally enforceable floodplain
management measures as required by Section 44, Code of Federal
Regulation$ 60.3 (el ; and
kHEREAS, this Board has determined to enact a floodplain
management ordinance ;

14. 'Flood' or "Flooding.' Inundation of land by the overflow - of a watercourse or water body, the accumulation of runoff, or the
rise of qroundwater.
+l+jz 'Flood Insurance Rate Map (FIRM).' An official map of
a community, on which the Federal Insurance Administration has
delineated both the flood hazard zones and the risk premium zones
applicable to the community.
+H+ 16. 'Flood Insurance Study.' The official report provided
by the Federal Insurance Administration. The report contains flood
profiles, as well as the flood hazard boundary-floodway map and the
water surface elevation of the requlatory flood. . -

17. 'Floodway.' The normal channel of a watercourse and the - adjacent land areas that must remain unobstructed to convey the
requlatory flood discharge without raising flood elevations above
specified levels as determined in Section 14-18. For the purposes
of this article, floodway shall include the area designated by the
Federal Emergency Management Agency, as such on the Floodway Map for
Martin ~ o u n T y dated January 5, 1984.
18. 'Impervious Surface." A surface which has been compacted - or covered with a layer of material so that it is highly resistant
to infiltration by water. It includes surfaces such as compacted
sand, lime rock, or clay, as well as most conventionally surfaced
streets, roofs, sidewalks, packing lots and other similar structures.
19. 'Lot.' A parcel of land created by the subdivision of a -- larger parcel.

38. 'Waters." Any and all water on or beneath the surface of - the ground including the water in any watercourse, water body or
water manaqement system, diEEused surface water, water percolating,
standing or flowing beneath the surface of the ground and coastal
waters.
39. "Water Management Facility." A component of a water - manaqement system.
40. 'Water Hanaqement System.' A system of natural or - artifical water bodies, watercourses, or wetlands which store or
convey water.
41. 'Watercourse.' Any natural or artificial channel, ditch, - canal, stream, river, creek, waterwav or wetland through which water
flows in a definite direction, either continuously or
intermitteney, and which has a definite pattern of flow.
42. "Water Body.' Any natural or artificial pond, lake, - . . .- reservoir or other area which ordinarily or intermittently contains
water and which has a discernible shoreline.
43. 'Watershed.' A drainage area or drainage basin - contributing to the flow of water in a receiving body of water.
44. "Wetland." Land that is inundated or saturated by surface - . or groundwater at a frequency and duration sufficient to support,
and that under normal circumstances does support, a prevalence of
veqetat ion typically adapted for life in saturated soil conditions.

Section 14-14. Lands to which this article applies.
(a) This ordinance article shall apply to all areas within the
jurisdiction of Martin County.
( b ) Basis for establishing special zones: The flood hazard
zones, (A1 through A30, AH and V1 through V30), identified by the
Federal Insurance Administration through a scientific and
engineering report entitled 'The Flood Insurance Study of Martin
County" dat=-d December 15, 1980 and as amended on July 5, 1983, with
accompanying flood insurance rate maps dated-m-PY,--P!XfF January
5, 1984, and any revision thereto, are the basis for establishing
special hazard zones. The flood insurance study and the
accompanying F I R M ace incorporated by reference into this ordinance
and.shal1 be on file and open to the public in the office of the - count9 engineer.
(c) The requirements of this article shall be considered to be
minimums. Where the requirements of this article are less strict
than the requirements of any other local, state or federal
regulation, the requi;ements of the other local, state or federal
regulation shall prevail.
Section 14-15. Warning and disclaimer of liability.
The degree of flood protection tequired by this article is
considered reasonable for regulatory purposes and is based on
scientific and engineering considerations. Larger floods can and

will occur on rare occasions. Flood heights may be increased by
man-made or natural causes. This article does not imply that land
outside the flood hazard zones or uses permitted within such areas
will be free from flooding or flood damages. This article shall not
create liability on the part of Martin County or any officer or
employee thereof for any flood damages that result from reliance on
this article or any administrative decision lawfully made thereunder.
ARTICLE 111. REQUIREMENTS FOR FLOOD MANAGEMENT REVIEW

Management Review Requirements.

( a ) The following types of development shall be reviewed before
construction begins to determine if they meet the standards of this
ordinance:
1. Subdivision of land: - 2. Construction or alteration of any building, impervious -
surface, dam, levee, fill, clearing, changing of
grade, excavation or water management facility.
(b) Review will be conducted, as part of existing review
procedures such as review of developments of regional impact,
development plats, rezoning and building permit reviews. Any,
application for any existing county development permit to include,
but not limited to, a building permit, excavation and fill permit,
final site review permit, final multi-family project permit, final
development plat approval and planned unit development final site

plan approval, shall be considered to be an application for permit
in accordance with this article. Such application shall include
sufficient information to show compliance with sections 14-19, 14-20
and 14-21 of this article. All development permits shall contain
the following statement to be signed by the county enqineer, or his
designee, prior to issuance of the permit. "This .project complies
with Chapter 14, Flood Damage Prevention of the Code of Laws and
Ordinances of Martin County.'
Section 14-17. Application for development permit.
(A) The following shall be submitted to the County Engineer for -
use in reviewing the development:
I.-- The name, address and telephone number of the - developer;
2. A legal description of the site and a map showing the - location oc the site;
3 A drawing or map showing existing conditions on the - site hcludinq existing water management facilities,
areas of vegetation, wetlands, impervious surfaces and
dimensions and elevation of all buildings;
4. A drawinq or map showing proposed alterations of the - site (including proposed excavations, dredging;
grading, filling or clearinq, impervious surfaces and
water management facilities) and the locatlon,
dimensions and the elevations of the first finished
floor of all buildinqs to be constructed.

information for use in evaluating the development if it appears
there is significant potential for the development:
1. To be damaged by floodine; - 2. To cause damage as a result of flooding; -

3. To significantly alter the velocity, level, direction, - frequency or quality of surface waters; or,
4. To have a significant adverse impact on a wetland, - watercourse, water body or qroundwaler..
(C) The information listed below may be requested. Due to the
unusual nature of a particular site or proposal, information other
than listed may be needed for an adequate evaluation and may be
requested. Information may be requested in the form of maps,
drawings, graphs, photographs or narrative descriptions, as
appropriate. Developers are urged to meet with the County Engineer
before preparing development plans to discuss the information that
will be required, the availability of flood elevation data,
potential limitations on use of the site, methods of mitigatin2
adverse impacts, the design of an acceptable water management system
and other matters relevant to the interpretation and administration
of this ordinance.

probability of being equalled or exceeded in any qiven

3. A Coastal High Hazard Zone shall encompass areas subject to - hiqh velocity water caused by, but not limited to,
hurricane wave wash. The Coastal Hiqh Hazard Zone includes
those zones designated on the FIRM as Zones V1 through V30
and areas within two hundred (200) feet of the coastal
construction control line.
4. A Floodway shall include the normal channel of a - watercourse and adjacent lands that must remain
unobstr'ucted to convey the regulatory flood discharge
without causing flood elevations to rise along any stretch
of the watercourse above a specified permissible increase -
known as the floodway surcharge. The floodway surcharge
shall be established, considering both existing and
potential development, at a level that avoids an increase
in potential flood damage. In no case, however, may a
floodway surcharge result in any increase in flood levels
within the community during the occurrence of the base
flood discharge. The floodway shall normal.1~ be calculated
assuming equal encroachment on the floodplain from both
sides of the watercourse, unless legally enforceable
flowage easements limiting development riqhts are recorded
for the lands needed for the floodway.
5. The flood Protection Elevation shall be set at the
elevation of the regulatory flood. In Coastal High Hazard
Zones, the Flood Protection Elevation shall be established
with consideration qiven to wind-driven wave action.
( B ) Flood Hazard Zones, Critical Flood Zones, Coastal High
~azard Zones and flood elevation data may be identified through

flood hazard studies and delineated on the FIRM. A copy of the FIRM
and supporting data is attached and incorporated by reference into
this ordinance. As new or better information becomes available,
this ordinance will be amended to incorporate new maps and flood
elevations or other data. Current maps and supporting information
may be inspected at Martin County Engineering Department, 50 Kindred
Street, Stuart, Flor'ida 33495.
(C) Sufficient funds have not been available to map the entire
land area of Martin County and perform the engineering studies
necessary to identify all of the Flood Hazard Zones, Critical Flood
Zones, Coastal High Hazard Zones and Flood Protection Elevations.
Therefore, the standards of this ordinance shall also apply to
development outside of mapped areas if information submitted by the
developer or otherwise available to the County Engineer indicates
the development would' include lands in a Flood Hazard Zone or
Critical Flood Zone as defined above.
(Dl The Shoreline Protection Zone shall include all estuarine
waters within Martin County, including those lands contiguous to
said waters where fringe mangrove communities occur. In order to - . -
maintain the functional integrity of the estuarine shoreline zone
including the mangrove communities, the interior boundary of the
Shoreline Protection Zone is established at a line extending fifty
(50) feet laterally upland from the mean high water (MHW) an-d fifty
(50) feet 1aterally.upland from the landward limit of the shoreline
manqroves. The shoreline manqroves shall include communities which
contain red (Rhizophora mangle), black (Avincennia nitida), white
(Lanquncularia racemosa) and Buttonwood manqroves. Those manqroves
or wetland veqetation communities which are isolated inland and
separated from open water areas by non-wetland vegetation
communities shall be Preserved but shall not be subject to the
restrictions within the Shoreline Protection Zone.
The existence of a narrow band of Australian Pine or other berm
veqetation such as those created by mosquito impoundment dikes shall
not constitute "isolation' as used above. This standard shall not
be interpreted as allowinq destruction of non-mangrove wetlan'ds

12. When it is not technically and economically feasible to - manage runoff on the site of development in a manner that
fully meets the standards of this section, runoff may be
discharged into off-site drainaqe facilities, provided all
of the following conditions are met:

accordance with the requirements of this ordinance:
2. If off-site drainage facilities have been constructed - by Martin County, adequate provision must have been

operating costs. The developer may be required to pay

13. Anchors and pilings for all structures shall be as required 7
by the Martin County Building Code, as adopted by Chapter 6 -
of the Code of Laws and Ordinances of Martin County.
.--Tie-downs and anchors for mobile homes shall be as required
by Section 320.8325, Florida Statutes. Where pilings are
used, lots must be large enough to permit safe access by
steps, constructed in accordance with the requirements of
the Martin County Building Code.
14. All new construction and substantial impro.vements shall be - constructed with materials and utility equipment to
minimize flood damage (as determined by the county

16. There shall be no alteration of mangrove stands or other - shorefront veqetation which would increase potential flood

Although the use of wetlands for storing and purifying
water is encouraged, care should be taken not'to overload
the capacity, thereby harming the wetland and transitional
vegetation. No development activity shall be allowed in a
wetland area unless:
a. The data from the Soils Potential study from the - Martin Soil and water' Conservation District indicates
that the specific soil has characteristics supportive
to the proposed development: and
b. The area no longer functions as a wetland. - Section 14-19(22) is not intended to prohibit development
in areas that no longer function as wetlands, when
'competent evidence' indicates that:
1. Dominant vegetation is no longer comprised' of wetland - types normally found in the specified soil; and
2. The water regime has been permanently altered - artifically or naturally in a manner to preclude its
- associated watershed areas from functioning as
wet lands. - .. .
3. Applicants tor site plan review shall have an - opportunity to so demonstrate that any wetland
designations within the confines of their property no
longer function as wetlands as explained above. The
Martin County Soil and Water Conservation District or
the soil conservationist shall be made a part of the
site plan review process to assist in identifying and
delineating wetlands.
Erosion and sedimentat ion control devices shall be
installed between the disturbed area and water bodies,
watercourses and wetlands beEore grading, cutting or
filling is begun.
Land which has been cleared for development and upon which
construction has not commenced shall be protected from
erosion by appropriate techniques designed to stabilize
soil and reveqetate the area.

Section 14-20. Specific standards.
In all flood hazard zones and coastal high hazard zones
including those zones designed as A1 through A30, AH and V1
through V30 on the FIRM where regulatory flood elevation data
has been provided as set forth in section 14-14 or section
14-23, the following provisions, in addition to the requirements -
of section 14-19, shall be met:
(1) In areas designated A1 through A30, AH or V1 through V30 on - the FIRM, no building permit for a structure (includinq
mobile homes) shall be issued unless the plans show the
elevation of the lowest floor of the structure in relation
to mean sea level.
(a) A mean sea level datum benchmark will be located on - - each proposed site and will remain until a certificate
- of occupancy has been issued. . . .-
(b) Upon the building permit holder's completion of the - lowest floor of any residential structure, the permit
holder shall obtain a written certification from
either a registered professional engineer or
registered professional land surveyor evidenced by his
signature and seal certifyrng that the first floor
meets or exceeds the flood protection elevation
indicated on the FIRM or as specified in secton
33-72(5)(a) of the Martin County Code prioc to the
next scheduled inspection. No further building
inspections shall be made and no certificate of
occupancy shall be issued prioc to compliance with
this provision.
No certificate of occupancy shall. be issued for any
structure until the applicant fucnishes the county
engineer with a certificate by:

1. A reqistered engineer or registered land surveyor - that the lowest floor of the structure meets or

hazards associated with high velocity waters from

construction control line or within the V1 through V30
Zones, whichever is most restrictive: -

Sect ion 14-24. Duties of Martin County Board of County . -
Commissioners.
The Martin County Board of County Commissioners shall have the
following duties in administering this ordinance:
1. Upon appeal by the developer, review decisions of the - County Engineer regarding information re-
conditions of approval, denial of development approval or
enforcement, providing the appeal is filed in writing
within 20 days of the action which is appealed;
2. Issue variances from the standards of this ordinance; - 3. Adopt t,he FIRM. -
Section 14-25. Variances.
1. The Martin County Board of County Commissioners may grant a - variance from the standards of this ordinance if the
following conditions are satisfied:

v i c t i m i z a t i o n of t h e p u b l i c , o r t h e c r e a t i o n of
c o n f l i c t s with o t h e r l o c a l o rd inances .
2. The Mart in County Board of County Commissioners may - cons ide r t h e fo l lowing f a c t o r s i n de t e rmin ing whether an

d, The importance of t he s e r v i c e provided by the proposed
f a c i l i t y t o the community;
e, The n b c e s s i t y t o t h e f a c i l i t y of a w a t e r f r o n t
l o c a t i o n , where a p p l i c a b l e :
f . The a v a i l a b i l i t y of a l t e r n a t i v e l o c a t i o n s , n o t s u b j e c t - t o f l ood inq or e r o s i o n damage, fo r t h e proposed use ;
The c o m p a t i b i l i t y of the proposed use wi th e k i s t i n q
and a n t i c i p a t e d development;

and sediment t r a n s p o r t of the f loodwaters and the
e f f e c t s of wave a c t i o n , i f a p p l i c a b l e , expected a t the
s i t e ; and,
k. The c o s t s of providing governmental s e r v i c e s dur inq - and a f t e r flood cond i t ions including maintenance and
repa i r of publ ic u t i l i t i e s and f a c i l i t i e s such a s
sewer, gas , e l e c t r i c a l and water systems, and s t r e e t s
and bridges;
Only the m i n i m u m var iance necessary to a f fo rd r e l i e f o r
e f f e c t u a t e the purpose of t h i s ordinance w i l l be granted.
Reasonable condi t ions c o n s i s t e n t w i t h the purposes of t h i s
ordinance may be imposed on any var iance. '
4 . No var iance w i l l be qranted allowing a development t h a t - would increase flood damage on o ther proper ty unless
flowage easements have been obtained from the owners of a l l
af-cted proper ty . Variances s h a l l not be issued within
any designated floodway i f any increase i n flood l e v e l s .
during the base flood d i scharqe would r e s u l t .
5 . Any app l ican t to whom a var iance is qranted s h a l l be given - wri t t en no t ice specifying the d i f f e r e n c e between the base
flood e leva t ion and the e l e v a t i o n to 'which the s t r u c t u r e i s
to be b u i l t and s t a t i n q t h a t the c o s t of f lood insurance
w i l l be commensurate w i t h the increased r i s k r e s u l t i n g from
the reduced lowest f loor e leva t ion .
6 . Variances may be issued for the recons t ruc t ion , - r e h a b i l i t a t i o n o r r e s t o r a t i o n of s t r u c t u r e s l i s t e d on the
Natidnal Register of H i s t o r i c Places o r t h e s t a t e inventory
of h i s t o r i c p laces without' redard to the procedures s e t
f o r t h i n t h i s sec t ion .
7_ The County Engineer s h a l l maintain the records of a l l
=peal a c t i o n s and r e p o r t any var iances t o the Federal . .

8. Generally, variances may be issued for new construction and - substantial improvements to be erected on a lot of one-half
(1/2) acre or less in size contiquous to and surrounded by
lots with existing structur'es constructed below the base
flood elevation, providing items (a) through ( i ) have been
fully considered.
Section 14-2'6. Appeal from decision of Board of County
Commissioners.
1. Any person aggrieved by the decision of the Board of County - Commissioners or any taxpayer may appeal such decision to
the circuit court in accordance with gene'ral law.
Sect ion 14-27. Violations.
1. It is a violation of this ordinance to construct any - development specified in Article 111 Section 14-16(a)
without develapment approval or to construct or operate any
development
contrary to the condition of development approval, the
standards set out in Article V, and/or a variance. --
2. The County Engineer shall issue a written notice of - vi6lation to the owner of the property. The notice shall
contain:
a. The name and address of the owner; -
b, The street'address when available or a descrrpfion of
the building or land upon which the violation is
occur r i n s
. c. A statement specifying the natur- - d. A description of the remedial actions necessary to -
bring the development activity into compliance and a
time schedule for completion of such remedial action: - e. A statement of the penalty or penalties that may be -
assessed against the person to whom the notice of
violation is directed;
f. A statement that the County Engineer's determination - of violation may be appealed to the Martin County

notlce of appeal within twenty (20) days of servrce of
. notrce of violatron. 3. The notrce of violation shall be served upon the person(s)
to whom it is drcected either personally, in the manner
provided for personal service of notices-by Lhe court of
local ]urisdiction, or by maillng a copy of the notice of
vrolatron by certrfied mail, postage prepard, return
recerpt requested to such person at hls or her last known
address.
Sectron 14-28. Enforcement. -
1. Any vrolation of this ocdrnance is a publrc nursance and - may be cestrained by injunction or otherwise abated in a
manner provided by law.
2. In addition to or as an alternative to any penalty provided - herern oar by law, any person who violated the provisrons of
this ordinance shall be punished by a frne of not more than
Frve Hundced Dollars ($500) or by imprisonment rn the -
county ]all for a period not to exceed sixty (60) days, or
hy hoth such frne and imprisonment. Such person shall be
gurlty of a separate offense for each day durlnq which the
violation occurs and continues.
3. Any vrolator may be required to restore land to its - undisturbed condition. In the event that restocation is
not undertaken within a reasonable trme after notice, the
Martin County Board of County Cornmissloners may take
necessary corrective action, the cost of which snall become
a lren upon the pcoperty until pard.

Specral acts of the Florida Legislature applicable only to
unincorporated areas of Martin County, County ordinances and County
resolutrons, or parts theceof, in conflict with this ordinance are
