Liquor Licensing in Scotland

THE STATE OF PLAY NOWLicensing has changed over the course of the last few years. The first new legislation turned licensing onits head in the form of the Licensing (Scotland) Act 2005 and the many regulations which must be readalongside the Act. Then we have the Alcohol etc. (Scotland) Act 2010 and the Criminal Justice and Licensing(Scotland) Act 2010, both of which also have an increasing number of regulations attached to them. Thismeans there are changes almost constantly to licensing and the obligations on operators from display ofalcohol, promotion and ID. If in doubt, take advice on issues. PROMOTIONSPromotions are an area which were dealt with in the originalLicensing (Scotland) Act 2005 but have been changed withthe recent legislation. There are also new mandatoryconditions in place. These are part of the licensingdocumentation and have been sent out by almost all theboards in Scotland so every licence holder should now bedisplaying these. These regulate the promotions which canbe carried out.

Premises can still have drinks promotions but must becareful they do not breach the mandatory conditions. It canbe difficult to give a definitive answer to whether or notspecific promotions are going to be acceptable or not. Eachboard area and their respective Licensing StandardsOfficers can apply slightly different views and interpretationsto promotions so it is better to take advice on these beforegoing ahead.

A “promotion” can be anything that encourages people tobuy alcohol. A ‘promotion’ does not have to be advertisinga specific product or brand. The Guidance for licensingboards which accompanies the new legislation states thateven a sign saying ‘Cold Beer Sold Here’ would beconsidered a promotion. This suggests that any referenceto alcohol can be classed as a ‘promotion’.

Things to think about include discounts and special offers.Alcohol cannot be given away free. Offers such as ‘threefor £10’ are no longer acceptable. A single unit cannot besold for more than a multi-pack price. Multi-buy discountsare still allowed but operators must be very clear and verycareful. The basic rule is that if you sell a productindividually – for example a single 500ml can of lager for offsale premises or a vodka and coke for on sale premises. Ifthree cans or three vodka and coke’s are sold, the price forthe three must be at least three times the price of theindividual drinks. A single vodka and coke is sold at £1therefore three vodkas and coke must be at least £3. Youcan no longer offer: buy one, get one free; three for theprice of two/five for the price of four and so on; cheapestfree; buy six (or another quantity) and get 20% off.

The rule only applies if operators are selling single units ofan individual product. This tends to apply less to on saleoperators as it is rare that they would not sell a single unit,such as a single measure or one vodka and coke. For offsale operators, if the can of beer referred to above is notoffered in their premises as a single can but only as part ofa multi-pack, there is nothing to stop the operator sellingfour 500ml cans for any price they wish.

Off sale premises can have 2 alcohol display areas – onepublic area and a secure area (i.e. an area inaccessible tothe public). In on sales premises, some boards do notrequire off sales areas to be shown. If you operate an onsales premises, but your licence allows you to sell alcoholfor consumption off the premises, you may have to showyour display areas such as behind the bar, wine fridges andsimilar on your plans. Changes to these areas may need avariation application so be very careful and take advicebefore going ahead with proposed changes. Alcohol andother goods can be displayed but there are restrictions onmixing displays of alcohol and non-alcoholic goods. Theseapply only to the public areas – not the secure areas, whichare normally behind a counter or bar. Alcohol, non-alcoholicdrinks or anything which is packaged with alcohol can bedisplayed. Branded, non-alcoholic products in this area maynow be displayed in this area, such as a sporting itemsbearing the logo of a drinks company, or clothing with adrink’s brand name. Newspapers, magazines and otherpublications can also be displayed. No alcohol can bedisplayed outwith the alcohol display areas. Even if thereare cheese and wine or similar packages, these must belocated within the alcohol display area (as agreed in termsof the premises licence). Also worth noting for off sales isthat any free newspaper, magazine or other publicationwhich contains promotion of alcohol, cannot be displayed inthe main store unless the space devoted to alcohol is lessthan 50% of the total space.

Aside from the regulations on the actual promotions, theway they are advertised are also regulated. This includes

not only the wording (and sometimes images) on posters,displays and leaflets but also ‘A boards’ on the street,window graphics and in-store magazines. A windowdisplay for an off sale premises which is outwith its alcoholdisplay area, may not be used for alcohol promotions. If thewindow display is inside the authorised display area,Government guidance states there is no reason why youcannot have an alcohol promotion in the window facing out.

Drinks promotions cannot be run within 200 metres fromthe boundary of the premises. The boundary is shown on thelayout plan which is attached to the premises licence.Anything distributed within the 200 metre zone must not bea “drinks promotion”. The current guidance states thatflyers that contain less than 50% of material promotingalcohol can be distributed. Bus stops and passing buseswere also a concern – how can premises be heldresponsible for promotions which are within 200 metres oftheir premises but are not associated with nor controlled bythe premises. New regulations confirmed that operatorscan only be responsible for promotions which are inconnection with the premises and you have some controlover them.

Even in-store tannoy announcements and radio cannot carryalcohol promotions, unless these can somehow berestricted to being heard only in the alcohol display area. Ifthe store is a dedicated off sales then that may not be suchan issue but for a general convenience store orsupermarket, that is likely to be difficult, if not impossible.

Promotional material is also an issue particularly where it issponsored by drinks companies. If these are for display onlythen there is no difficulty. If they are being linked to alcoholpromotions, they must be displayed in the authorisedalcohol areas only. If these items are for sale and do notconstitute a drinks promotion, they can be displayedanywhere in the premises. Operators must be careful not torun promotions, such as five pints and you get a free hat orball. That would not be acceptable. Instead if there arepromotions being run in conjunction with sports events orother events, such as Christmas, St Patrick’s Day and so on,advice should be taken on how to incorporate thepromotional goods without breaching the conditions.

When applying for a new licence or transfer, the police, LSOand board could always look at the applicant and ‘connectedpersons’. Connected person are people like directors in alimited company, partners in a partnership, trustee in acharity and so on. The Criminal Justice and Licensing(Scotland) Act 2010 introduced a new category called‘interested parties’. A person is an interested party inrelation to licensed premises if the person is not the holderof the premises licence nor the premises manager inrespect of the premises but has an interest in the premises

as an owner or tenant, or has management and control overthe premises or the business carried on in the premises.This definition is very wide and will involve other partiessuch as owners, landlords and similar who were notpreviously considered.

DISPLAY OF LICENCE – DISPLAY AND DOCUMENTSThe licence comes in 2 parts – the summary and the mainlicence.

The summary has to be ‘prominently’ displayed in thepremises. This means it should be able to be seen bymembers of the public who are in the premises at all times.That means it should not be behind a counter or in an office– but should be accessible to the public. It is an offence notto display this properly.

The main licence should not be displayed but should be keptin the premises. The Licensing (Scotland) Act 2005 statesit should be kept under the control of the licence holder orthe premises manager. Again, it is an offence not to be ableto produce the licence when asked for it by the LSO orpolice. To avoid lost licences, a certified copy can bedisplayed and stored in the premises and the original keptin a safe location. Only the Clerk to a board or a solicitorcan certify copy licences at present.

If the principal licence is lost stolen, this is serious and youmust report that to the police. They will give you a referencenumber. To get a new principal premises licence certificate,an application must be made to the relevant licensing board.They are likely to ask for a note of the police referencenumber. Without that reference number, the board mayrefuse to issue you a new licence.

PREMISES MANAGER – TIME SCALES FOR CHANGEIf the designated premises manager resigns, dies or ceasesto act as premises manager for any other reason, therelevant licensing board must be notified within 7 days.That is 7 days – not 7 working days. This is a very tight timescale. If this is missed, premises can be forced to stoptrading until an application to change the premises manageris lodged. As long as the 7 day notification time is met, fromthe date of the change to the premises manager there is a6 week period available in which to lodge an application withthe relevant board to change those details. It does not haveto be granted within 6 weeks, just lodged. The 6 weekcountdown begins on the date the change happens. Forexample, the 6 week period for a change of manager onSaturday 1st January 2011 would expire on Friday 11thFebruary 2011.

If the 7 day deadline is missed, the premises would notproperly be able to trade until the new managerappointment was lodged. This can be deemed to begranted as soon as it is lodged with the relevant board.

If the 6 week deadline is missed, premises would have nodesignated premises manager on the premises licence untilan application to name a new manager is lodged. That maymean the premises have to cease selling alcohol until then.It is important these time scales are met. If there is a change to the name or address of the premiseslicence holder or premises manager, the relevant licensingboard must be notified within 1 month of the change.

OCCASIONAL LICENCES AND EXTENDED HOURS Occasional licenses and extended hours often causedproblems because they could not be obtained at shortnotice. This particularly caused problems for funerals whichcannot generally be booked with any notice. Also for publichalls and other buildings where a function may have beenarranged at less than 4 to 6 weeks notice required by mostboards. Now, where the Licensing Board is satisfied that theapplication requires to be dealt with quickly the occasionallicence can be advertised for less than 21 days to anyperiod of not less than 24 hours. It is up to the Board todetermine how short a period between 24 hours and 21days. Extended hours to allow later opening at the start orend of a day are also given the same reduced periods, thistime between 24 hours and 10 days.

PERSONAL LICENCE APPLICATIONSPersonal licence applications have been made a little more

difficult only because the applicant must sign the applicationand it cannot be signed by a solicitor or agent. On the plusside, this avoids operators or managers signing applicationsfor staff and means all staff are therefore aware of whatinformation has been included in any application forpersonal licence.

LICENSING STANDARD OFFICERSLicensing Standards Officers have more powers introducedby the Criminal Justice and Licensing (Scotland) Act 2010.They now have powers to enter, inspect and seize items.They can take copies of documents or entries in documentsfound on the premises and can seize and remove anysubstances, articles or documents found on the premises.They now also have the power to require any documentwhich is stored in electronic form to be produced in a legibleformat. You are not required to produce a document if youcould refuse to produce that document in any proceedingsin any court on the grounds of confidentiality ofcommunications. You can also refuse to produce it if to doso would incriminate that person, that person’s spouse orcivil partner. Where a LSO seizes any substance, article ordocument, they must leave a notice on the premises statingwhat was seized and explaining why it was seized.

AGE RELATED SALES – AGE VERIFICATION POLICYAge related sales are a big issue for on and off sale alike.Test purchasing has resulted in a number of reviews overthe periods from 2009 when this new law came in to forceand now there are further requirements in the 2010 Actsand their regulations. Premises must operate an ageverification policy. The minimum legal age is still 18 – thishas not changed. Premises must have a policy forchecking they are not selling alcohol to persons under 18.The age verification policy requires that, if anyone servingbelieves a customer may be less than 25 years old, stepsmust be taken to verify the customer’s age. It is essentialthat all staff involved in the sale of alcohol are made awareof this policy. All staff should receive training and regularreminders. Posters and notices in staff areas and in themain shop are useful. Till prompts should be considered.All of this will help if a staff member fails to ask for ID fromsomeone who is clearly under 25 years old and a testpurchase failure is brought to the courts or to the licensingboard’s attention. Detailed records should be kept ofeverything and a refusals book should be in place. If a saleis refused, this should be recorded. It is sensible to recordas much information as possible, such as where ID isrequested and produced. This shows a pattern ofrequesting ID. While that can be a challenge at a busy baror till, the more information the better is the general rule.The policy held by each premises must be in writing and itshould be checked and updated regularly. Acceptable ID is: passport, EU (photographic) drivinglicence; photographic ID card approved by the PASSscheme. No other ID is currently acceptable although theScottish Executive are looking at other countries’ national IDcards and Armed Forces ID and similar. Make sure that staffknow what genuine driving licences and ID cards look like –there are many fake and look alike cards in circulation. Ifthey are in any doubt, they should ask another staff memberfor a second opinion or refuse. Having this policy in place isa mandatory condition of all premises licences and must beadhered to. It is no longer voluntary.

LIABILITY OF OPERATORS/EMPLOYERSYour licence can be revoked or suspended as a result of amistake made by your staff. If a staff member sells alcoholto someone under 18, you, as licence holder, can beprosecuted as well as your employee.

It is not enough that all your staff have 2 hours training,although if they are involved in the service, delivery or saleof alcohol that is a requirement. It is not even enough thatthey are personal licence holders. There have been so manychanges over the last few years (and new regulations arestill expected). The law makes clear that it is yourresponsibility to make sure that your staff are fully up-to-date and made aware of the changes and their obligations.

All of the rules about promotions are conditions of yourlicence. If they are breached, your licence could besuspended or even revoked. It would be recommended tocarry out refresher training for staff at least every sixmonths. If something goes wrong, the more information andtraining records you have the better. You should be able toshow that you have a good system in place to prevent abreach of the law. Training is very important and keepingthat training refreshed and up to date is just as important.Record all training – internal to the premises and thatcarried out by external training providers. Keep clearrecords and make sure these are updated and available forinspection on the premises by police or LSO’s. You are notrequired to do training all by yourself but make sure if youdelegate this to managers that you check it is beingregularly updated and that they are recording the trainingand keeping the records in the premises. Also make surethose doing the training are allowed to under the legislation.For the 2 hours training, the trainer must be a personallicence holder. Even if your staff have been with you a longtime and you trust them, always remember as an operatoryou need to protect your livelihood.

Today the McEwan’s brand of ales are stillmuch loved by Scottish drinkers with McEwans 80/- and McEwan’s Export thetwo most popular premium draught ales in Scotland*. In October 2011McEwan’s was purchased by the UK’s largest independent family-ownedbrewer Wells and Young’s, where it became the largest brand in their portfolio.Although based in Bedford, Wells and Young’s are keen McEwan’s retainsstrong links to its Scottish roots and all draught ale will continue to be brewedin Edinburgh at the Caledonian brewery. The brand’s recent ‘Aye!’ marketingcampaign recognised Scots’ fondness for using ‘aye’ in everyday conversationby adopting the colloquialism as its own message. The brandcontinues to put its weight behindthe No Nonsense races, of whichthere are 90 spread across the UK,including the John Smith’s ScottishBorders National at Keslo.

CALEDONIA BESTTennent’s has put the cat among thepigeons by setting its sights onScotland’s ale crown, launchingCaledonia Best last year - a directcompetitor to Scotland’s top sellingale, Belhaven Best. Caledonia Bestwill donate 5p from every pint soldin the six months following itslaunch, to create a “seed fund” tohelp sustain Scottish brewing andfarming. C&C say that CaledoniaBest is set to have a strongpresence in pubs across Scotlandthroughout 2012, with its ‘strikingbrand identity’.BELHAVEN BEST

Belhaven remains the top selling alein Scotland and continues to alignitself with sports, running a series ofshort and snappy ads either side ofthe STV Sports News. These willcontinue in 2012. The BelhavenBest Scottish Club HandicapChampionship, now in its 13th year,is Scotland’s biggest participationgolf event with over 25,000 peopletaking part every year. BelhavenBest will also support licensees atan outlet level with point of sale kits.

Strathaven Ales was started in late 2005. The brewery itselfis the historic Craigmill Brewery on the River Avon usedpreviously by Heather Ales and restored with the help ofHistoric Scotland. The buildings now house a 10 barrelbrewing plant. A somewhat unique feature of the brewery isa stone-clad brewing kettle of eighteenth century design.The brewery now brews 2 to 3 times a week distributing tothe Central area of Scotland as well as in England. It reported growth in its volumesin the UK on-trade by 10% in 2011, in a category up 7% with, say the company,the managed pub sector driving energy drinks sales. The CGA figures also reported that Red Bull sells 45% more over a year inmanaged pubs than its nearest competitor.Red Bull Racing F1 team won the Constructor Championship titles in 2011, andthe team also produced world champion driver of 2011, Sebastian Vettel.Red Bull also sponsors more than 500 athletes in 97 sports—100 of them inthe U.S. But Red Bull doesn't offer its athletes contracts, just a verbalagreement to ‘support’ them. THE BOTANISTThe Botanist, is a small-batch, artisanal Islay gin that uses nine of the classicgin aromatics – orris root, cassia bark, coriander seed, etc – and augmentthese with a heady harvest of 22 wild, native island botanicals, hand-picked byour expert foraging team from the windswept hills, peat bogs and atlanticshores of the Hebridean island of Islay.This truly seasonal and exotic cocktail is then slow "simmer" distilled in itsunique and cherished lomond pot-still, "ugly betty". Betty prefers to work atlow-pressure and won’t be rushed. So its precious botanicals are slowly andgently coaxed into releasing their complex, signature aromatics.This was a unique project for head distiller, Jim McEwan. MILLER’SOwned and distributed by theReformed Spirits Group, MartinMiller’s gin last year launched itsfirst ever social media-drivencocktail competition called ‘TradeUp’ inviting mixologists to put acontemporary spin on ‘80scocktails. And the Great WigtownFace Off in the Scottish town of thesame name, hosted a taste testbetween Scottish and English gins,with those of Scottish provenancecoming out tops.

GORDON’SThe First Drink campaign forGordon’s gin will continue in 2012,capitalising on the up sellopportunity for licensees, pushing aGordon’s and Tonic as the perfect'first drink' of the evening. RUSSIAN STANDARDRussian Standard vodka is ownedby billionaire banker RoustamTariko. The Russian premium vodkacould get a push in Scotland in2012 now that Whyte & Mackay hastaken over the distribution. The fullhandover happens in January 2012,so there were no details of what themarketing and advertising activitywill entail in 2012 when DRAM wentto press.

SMIRNOFFSmirnoff remains Scotland’s mostpopular vodka. In the year toOctober 2011, Smirnoff’s MATvalue share grew from 65.8% to68.6% in Scotland’s on-trade, andtaking in all its flavoured variants, itwent from 66.1% to 70.2% in thesame period. So it looks as if the£10m budget Smirnoff earmarkedfor promotion of Flavours last year isbeginning to pay off. Smirnoff’sFinish Drinks Initiative, Night LifeExchange Programme, plus its TVand press advertising in support ofboth, will continue in 2012.
