It's my distinct
pleasure to present to you the Grand Champion Cheerleaders
from Oblong, Illinois. Now, Oblong is not one of the
largest communities in the State of Illinois, but probably
a community with a bunch of the largest hearts and most
giving people in supportive of their school system than
you'll ever find in the State of Illinois, and if the Clerk
would please read the Resolution.''

HOUSE RESOLUTION
WHEREAS, The cheerleaders at Oblong Elementary School are toq
be congratulated for placing in the top 20 junior high squads lastyear and receiving a trophy for having the most creative routine;
and
WHEREAS, In July of 1990, they became Grand Champions in the
Junior High Division at Indiana University in Bloomington,
Indiana; and
WHEREAS, The squad members have been encouraged by their
sponsors, who attended ICF camp aldng with the students and went
to the sessions with them; and
WHEREAS, Community support has been very important to the
cheerleaders; and
WHEREAS, Karen Sweat, cheerleading sponsor, and her assistant:
Donna Henry, have provided leadership and encouragement to the
girls; and
WHEREAS, The cheerleaders are: Shannon Newcomb, a member of
High Honor Roll; Kristi Davis, a member of Flag and Rifle Corps;
Stacy Jennings, a talented softball pitcher; Krissy Neidigh, a

coach of the team introduce them individually to you,
however, I think most apropos that the coach of the
name (sic-team) is Mrs. Sweat, so Mrs. Sweat would like to
introduce her girls to you.''
Sweat: ''Thank you. Thank you. want to mention my helper,
Donna Henry, right here. I don't know if you can see her
for the girls. This is Donna Henry, my helper, and the
girls, this is Shanna Newcomb, Kristi Davis. They're our
two-eighth graders. We have Michelle Smith in the back.
She's a seventh-grader: and Stacy Jennings. This is Kamee
Hoke. She is Martha Waldrop's granddaughter. This is
Kendra Paddick. She's a seventh-grader. This is Krissie
Neidigh, and she's also a seventh-grader: and Niki Murray,
and we also have Erin Glezen who's a sixth-grader and
Michelle Hill who is Pauline Hill's granddaughter, and
she's also a sixth-grader. So welre losing two of our
girls, and we'll have most of them back for another year,
and so we thank you. This is a real honor.ff

weaver: ''For those of you who've been here for a little, a little
while, you may remember we've had some other teams from
Oblong here, a community of 1,800 people. We've sent three
teams to national math and science competition and a team
to the national home economics competition. This is a
small school. It disproves the theory that 'bigger is
better'. These gals will also be honorary Pages today so
tip them biq, please. Thank you very much.''

Black: ''Thank you very much, Mr. Speaker, Ladies and Gentlemen of
the House. It's my distinct pleasure today to introduce to
you the Schlarman High School from Danville, Illinois,
State Champion Cheerleadrrs and State Champion Pom Pon
Squad, and girls if you could come down in front, I'd, I'd
like all the Members of the House to see what the Oblong
cheerleaders will be like when they set a little older.
This is the high school division. This high school
competes against schools about ten times their size, and
they have a verf, very proud tradition. I think CoachHohen can tell you that this is the tsecond or possibly
third time that they've won the State Championship Small
School Division in the Pom Pon Dance Drill Team
Competition, and the cheerleaders also brought home a state
championship trophy this year, again competing against
schools much larger than they. Mr. Clerk, you'd be kind
enough to read the Resolutions, I would be grateful.?

Matijevich: '1Mr. Speaker: Ladies and Gentlemen, rise to opposethe Amendment. Some of you may be aware if you were here
last Session, this is very similar to a Bill where I've
been trying to get property that the State of Illinois and
the Department of Transportation has held for 25 years.
lt's been doin: nothing, and I've been trying to 9et the
property for the City of North Chicago for the purposes of
economic development, to build a corporate corridor, a
linear corporate park. As you know, when you transfer
property from one public body to another, we don't have to
get an appraisal, but 1 did that two years ago, and ! will
truly admit to you that my Second Amendment will convey the
property to the City of North Chicago for $800,000. That
is less than the appraised value, I will admit that, but
it's what the city can afford. It's about $100,000 more
than the State purchased the property 25 years ago, but the
community is in dire straits, the property will never
amount to anything for the State of Illinois, any now, it's
going to sit there. And, is immediately adjacent to
other corporate interests, would very much complement
that area. So, I would urge the membership to defeat this
Amendment and then, to adopt Amendment #2.''

Mconomically develop it, provide for jobs, it's much lessthan we did for Bloomington, what we did for other areas of

Two years ago when Department, DOT, didn't want to go along
with the Bill, my Bill then would be to transfer it to the
Department of Commerce and Community Affairs so that it
develop the property for economic purposes. They thought
was a good idea but they didn't want to get into a
grudge match with another state agency. And, 1 think that
if you got DDA site, they would admit that this is prime
property for economic development.n

transfer? Are they willing to give up the property? They
will oppose no matter what. admit that. They
never give up anything.''
Matijevich: 'fokay. Well, to the Amendment, there's a differenceof opinion here as to whether the State Department of
Transportation still has a use for it, or whether the
community has a use for it. I think you have to weigh
those things out, but the thin: that bothers me here is
that, here is a piece of property that may worth as much as
$4,000,000. Most transfers that I've seen in my time here,
the appraised value more or less establishes a price for
something. Here, a $4,000,000 piece of property for

two to four years. So, this won't only affect Will, it
affects Winnebago. But, for many years here, those of us
that were from counties that were oi the opposite party,
always wanted to be able to hire our own attorney, our own
clerk, our own help, so that, at least, you know, we have
our lines of defense demarcated very well. He's doing the
work of the Republican Party of Winnebago County. They're
going to go to Chief Executive and theyrve owned the County
of Winnebago for 100 years and it's not going to change.

the last several years, we have provided, by legislation,
the private insurance, health insurance plans, and that the
state, through its own welfare department, will provide
preventive mammographyv to women at and over the age of 35,
at regularly scheduled intervals, as per the guidelines set
by the American Cancer Society. There is one group that we
could affect that we haven't and those individuals areF
'
covered by the provisions of House Bill 542. These
individuals are those who are either the dependents or the
employees of self-insured local governments in the state.
And, if we were to pass House Bill 542, we would close that
particular loophole in our existinq coverage of preventive
mammography for women under health insurance plans in the
State of Illinois. The statistics from the medical
community are pretty overwhelming, with respect to the
value of these baseline mammography programs that you can
find out about a breast cancer three years, with the
mammography, three years beiore there would be any other
kind of evidence that might be available to a physician on
an office or other physical examination. The survival
rates, with mammography, are substantially better than they
are without, and as I say this is not a new issue, we have
provided this kind of protection in leqislation before this

figures or tell us what you have, to refute that fiscal
impact of about $8,000,000.''
Currie: ''I would refute the fiscal note, fact, I think that
when they were doing the analysis they misunderstood the
provisions of the Bill. We already provide this coverage
for women and for dependents covered by local government
health insurance that operates on the private market.
think that this fiscal note assumes rather, that all local
governments are self-insured governments for purposes of
health care. fact, the numbers that I've been able to
obtain from the Municipal League suggests that probably
only about l00 local governments in the State of Illinois
are self-insured and thus would be subject to theprovisions of House Bill 542. Of those local governments,
some, I am sure, already provide this kind of preventive
care in their current employee and dependent health
insurance programs. So, believe there was a
misunderstanding when the Fiscal note was drafted. I would
point out, further, Representative, that the savings that

can be expected to local communities, by virtue of
providing adequate preventive care, will be very
substantial. The costs of care and treatment of an
advanced breast cancer are very substantial, not only in
terms of the likely loss oi life of the woman who is its
victim, but also in terms of the' dollars that those health
insurers are going to pay for extensive hospital stays,
extensive chemotherapy, and radiation therapies. So,
would argue that instead of costing any money, passage of
this Bill will save these local communities dollars that
they will not have to spend at the end stages of individual
lives.''

mammographies, or, it may directly, itself, provide the
mammography at a site and location of its own choosing. In
effect, there are some local governments, Cook County is a
good example, that has its own hospitals. If Cook County
wanted to provide this coverage at Cook County Hospital,
the Amendment would permit that as an alternate way of
meeting the requirements of House Bill 542.1'

Why do we have to pre-empt home rule? If the units of
government should be doing it, isn't they who should be
dealing with the employees via collective barqaining?
lsn't it the local taxpayers who should decide this? As
always, we have lots of good ideas down here, lots of
worthy goals, lots of important things to get done.
Invariably, we do not pay for it. This will require the
cities or villages or counties to pay for this. And
really, I suppose that you would have to call this a
mandate, and it's something we should fund. But, we don't
fund these things. We stand up, and we say nice things: we
go home, we tell people we've done the right thing, and we
put it on the backs of taxpayers who largely fund those
local units of government via the property tax, the very
property tax which is the problem in so many parts of this
state. I say vote 'no' or, at the very least, have the#
courage to appropriate what's necessary to pay this, and
don't know that we will have that courage. So, 1'm very
confident in recommending a 'no' vote.''

is not a new concept, and it's critical for saving the
lives of Illinois women. In the past, we have required
coverage, base line mammography coverage, for our own state
employees, for employees who work in the private sector
across the State of Illinois and for clients of our
Department of Public Aid. House Bill 542 closes a loophole
under which, some public employees in this state are
not eligible for this kind of coverage. Let me remind you
that in Illinois we anticipate ,7000 new cases of breast
cancer on an annual basis. We expect that more than 2,000
women a year in Illinois will die of the disease of breast
cancer. We know, competent health authorities tell us that
we can stem that death rate. We can stop in its tracks.
If women, at and over the age of 35# have the opportunity
of preventive mammography. This measure will save lives,
and it will save money. Those local governments that fail
to understand the value of preventive mammography screenin:
are paying through the nose, in the costs of treatment, the
costs oi hospitalization, the costs of surgery, the costs
of death. I urge your support for a sound public health
measure, house Bill 542.%

an HMO that's certified by CMS and this legislation allows

respite care worker shall be trained to supervise and
assist the frail, abused or functionally disabled, impaired
older adult and to support the special needs oi the primary
care giver. Respite care, without a doubt, can be an
alternate to nursing home care. The Department of Aging is
not opposed to this Bill, and, may 1 say it again the
Department of Aging is not opposed to this Bill. The
Alzheimers Association chapters throughout the State of
Illinois are supportive of thisilegislation. And when we
talk about the Bill, when we talk about the finances o!
the Bill, the Bill is budget-neutral, the Bill is
budget-neutral. Respite services can be provided only to
community care eligible clients, and amount of service will
not exceed the current allowable maximum. The average cost
for a person to go to a nursing home is $30,000 plus they
can be on Medicaid, so goes without saying with the
implementation of this particular Bill, vast sums of money
could be saved. People would be more receptive to caring
for their own, and believe that this basically is a
re-election bid for each and every member of this staff.
think the senior citizens and those that are in need are
basically supportive of this concept: and I would submit a

something that might remove a consumer protection, and

Department earlier today, and they wanted to know if 1
could make it permissive, and I said that if the Department
of Public Health had done what was asked of them then we
would not be to this Order of Business and that is trying
to pass a Bill that would set them up as the agency that
would have the responsibilty of making sure that the people
are aware oi the fact that there is food out there for
them, and 1 think that if, by chance: this Bill is passed
then we're talking about healthy babies, healthy senior
citizens, a healthy society and when that happens, al1 of
us benefit, but now the grants are permissive./
Black: ''Would you look at Floor Amendment #l? Lets see if we're
looking at the same language here. As I look at your
Amendment #l, it appears to me that you've deleted
provisions which specifically require the Director of
Public Health to administer this program,
that...furthermore, you say that you 'allow' the director
to make grants rather than say that the director 'shall'
make grants and then put these grants under the program
established by this Act, so if I'm reading this correctly,
it would appear that you are, you have, in fact, taken some
of the mandated aspects of the program out by Floor

is is the action that, any action that's pending. think
that instead of cloggin: the court system, we ought to be
promoting settlement and that legislation like this will
only distract from the settlement of existing litigation in
product liablilty cases. And I think what we ought to do
is encourage settlement and instead of litigating something
al1 the way to the end. that might involve a trade secret
or might involve some process that may be patented by a
manufacturers that the public has no reasonable right to
know. Now if it's something hazardous or a hazardous
condition, that's one thing, but when it comes to a process
that may be a patented process...it gets close to a trade
secret, you run into problems with this Amendment, and I'd

support of this Amendment. You know, this a dramatically
scaled down version of the original Bill. There was a lot
of controversy surrounding the original Bill, and because
of the scaled down version would venture to say that
there's a dramatic decrease in the amount of opposition
among some of the people that have contacted some of the
Members on this Bill. They may still be against, but it
certainly is a dramatic decrease, and it certainly is a
much different...Amendment, much different Bill than used
to be. And I think it's important to note that...we as
Members of the General Assembly are always dealing with
freedom of information and public access to public records.
We have a stake in the appropriateness of keeping court
files open, so the general public knows what's going on in
courts. We don't want to close our court system to the
public because the public has a right to know what's going
on there. I support this good Amendment.'

Johnson: ''Well think the last speaker addressed what we're#
really debating here. We're not debating the underlying
Bill or the merits of that, we're debating Floor Amendment

the concerns that were raised in Judiciary Committee, for
fear that this Bill went too far. So that this Bill

have been applicable to, and limited to one narrow set of
cases, for policy reasons that Representative Matijevich
may address in more detail on Third'Reading. The only
issue now is, 'Are you in favor of an Amendment that limits
the application of the Bill to those narrow set of
circumstances that he's described?' and even those who
might oppose the underlying' concept, I would think, would
be favor of something that...that...limited the scope. So
think it's a good Amendment and 1 hope we vote 'yes'.''
