1. GENERAL INTRODUCTION
1.1. Project Background
1. Medium Cities Development Project was approved by the Prime Minister in Official
Document No. 602/TTg-QHQT dated April 16, 2010. On January 12, 2012, the Credit
Agreement No.5031-VN was signed between the Government of Vietnam and the World Bank.
The project used the World Bank’s IDA fund and counterpart fund from the provincial
budget/state budget.
2. The development objective of the project is to increase access to improved urban
infrastructure services in Lao Cai City, Phu Ly City, and Vinh City in a sustainable and efficient
manner. The MCDP project is implemented in Phu Ly city (Ha Nam province), Lao Cai city (Lao Cai
province) and Vinh city (Nghe An province), consisting of 4 components: (1) Basic infrastructure
upgrade and service improvement; (2) Water supply and sanitation; (3) Urban roads and bridges; (4)
Project management and technical assistance.
3. Implemented from 2012, the project is on the right track to gradually achieve its
development objectives. Components that have been invested under the original project are
promoting a huge economic efficiency and enhancing people's living conditions, creating
motivation for infrastructure development, improving the urban face and gradually bring the city
toward civilized, clean and sustainable development. The total World Bank’s IDA committed
initially was US$210 million. In fact, at this stage, it is only US$182.91 million (down 12.0% due
to the fall in the exchange rate of SDR against the dollar) for 3 cities. Lack of IDA funding due to
declining of SDR exchange rate against the dollar made some important investments of Lao Cai
and Phu Ly impossible to be implemented in the original project that results in risk of affecting
the development objectives of the project. Also, the funding source allocated for the original
project (Lao Cai, Phu Ly were allocated only US$57.5 million), some of the urgent items of Lao
Cai and Phu Ly have not been included in the original project.
4. Like other cities in the country, urbanization is happening rapidly in Phu Ly and Lao Cai.
The rapid growth of urban population causes pressure on infrastructure and improvement of
environmental sanitation. Lao Cai and Phu Ly proposed for additional IDA fund to offset the
deficit of exchange rate and improve the project investment efficiency through investments in
some necessary additional credit loans. Lao Cai and Phu Ly requested the World Bank to provide
additional funding to implement these additional credit loans.

5. Medium Cities Development Project - Phu Ly city Sub-project (original project) was
approved under Decision No.1218/QD-UBND dated October12, 2011 of Ha Nam PPC on the
approval of the Feasibility Study and Procurement plan. Additional items include 04 components
as follows:

Component 1: Basic infrastructure upgrades and service improvement:
(1) Upgrading infrastructure for the residential area in the North Quang Trung ward;
(2) Upgrading infrastructure in Quynh Chan residential group, Lam Ha ward;
(3) Upgrading infrastructure in Duong Am residential group, Lam Ha ward;
(4) Construction of Phu Van kindergarten in Phu Van commune, Phu Ly city;
(5) Upgrading Tran Quoc Toan Primary School, Hai Ba Trung ward.
Component 2: Environmental sanitation improvement:
(1) Upgrading Lam Ha 1 regulation lake, Lam Ha ward (from initial design of project);
(2) Upgrading drainage and technical infrastructure system for Bien Hoa road;
(3) Construction of Chau Giang river southern embankment from Liem Chinh bridge to Cau
Gie- Ninh Binh expressway.
Component 3: Urban roads and bridges:
(1) Upgrading Tran Hung Dao road from Liem Chinh bridge to Cau Gie -Ninh Binh
expressway.
Component 4: Project management and technical assistance: This includes costs of the
services of construction supervision consultant, procurement support, contract management,
environmental and social safeguards monitoring, independent audit and PMU’s operational cost.
2. PURPOSE AND SCOPE OF THE UPDATED RESETTLEMENT PLAN
2.1. The Purpose of the Resettlement Plan
6. The purpose of updating the Resettlement Plan for Phu Ly city subproject - Additional
Finance (AF) item is: (i) reviewing the compliance with the Resettlement area of Liem Chinh
ward and proposed remedial measures, (ii) updated the social impact assessment items of
Upgrading drainage system and technical infrastructure of Bien Hoa road and proposed
mitigation measures.
2.2. Scope of Updated Resettlement Plan
7. This updated Resettlement Plan Report is prepared for the Upgrading of drainage system
and technical infrastructure of Bien Hoa road and Liem Chinh resettlement area to provide
guidelines for implementing activities related to land acquisition and site clearance by the
Project.

2.2.1. Item: Upgrading Drainage and Technical Infrastructure System for Bien Hoa Road
8. Bien Hoa is one of the main roads of Phu Ly city with the length of about 900 m. The start
point is intersecting with the national highway 1ª at Church ramp. The end point intersects with
Le Loi road. The drainage system and technical infrastructure of Bien Hoa road were built over
many different periods so it was degraded. The scope of work includes:
• Installing the surface water and wastewater drainage system (923m long); D=1000-1600;
• Re-surfacing of road and intersections (906 m long);
• Rehabilitation of lighting power system;
• Upgrading sidewalk and greenery system.
9. Construction activities may cause the following impacts mostly related to traffic as
construction operations will occupy one part of road surface, while the other part will be used for
gathering machinery and storage of construction materials during construction. Estimated time to
complete the package: 12 months (February 2020 to February 2021). Construction plan: Divide
into 4 sections with a length of 200-250m (sections from National Highway 1A - Nguyen Van
Troi - Truong Chinh - Le Cong Thanh - Le Loi).
10. Construction method: Bien Hoa road will be divided into 4 sections, each about 200m and
2 sections of sewer lead to the reservoir of Me pumping station. Each section will be
backstepping method 40m / week, including cutting roads, scraping the pavement layer, barrier
work to ensure traffic safety (1 day); Piling of wooden planks, digging foundation pits, bamboo
piles, macadam strips (1 day); Installation work, construction joints (1 day); constructing
manholes (4 days) and filling up ground, removing piles (1 day). A total of 4 construction sites.
The construction area is half of the road, maintaining the status quo of the sidewalk, the other half
of the road serving traffic.

Situation of business households on Bien Hoa street
2.2.2. Item: Liem Chinh Resettlement Site
11. The resettlement site (1.5 ha) consists of 77 land plots, with approximately 70 - 80 m2 of
each. Site clearance for this resettlement site has been mostly completed since 2005 with 80.5%
of the total site area. This resettlement area is identified as a related project, because it is used to
arrange resettlement for households who have to relocate due to land acquisition in the project
items in Liem Chinh ward and Liem Tuyen commune.
12. Up to the time of updating the report, land acquisition, compensation and assistance for
affected households to build the resettlement area has been completed. Therefore, it is necessary
to review and evaluate the compliance with the compensation, support and resettlement policies
according to the project's policies. According to the results of the review of 18 AHs who were
compensated in the period from April to June 2016, all of them were slightly affected and were
fully compensated according to the policies of the Government and Ha Nam province. The
interviewed households are satisfied with the compensation price for the affected assets. There
were no complaints regarding compensation payment and the entire remaining land was handed
over to the project from April to June 2016. However, the review is conducted to ensure
compensation and support to comply with the policy framework and entitlements of affected
households as stipulated in the Project Policy Framework.
3. IMPACT ASSESSMENT AND MITIGATION MEASURES
3.1. Upgrading Drainage and Technical Infrastructure System for Bien Hoa Road
3.1.1. Impact Assessment
13. According to the results of social rapid assessment, upgrading of drainage system and
technical infrastructure of Bien Hoa road will temporarily affect 215 business households along
the road. The environmental and social impacts are as follows:
• Business household: 215 households.

• Business type: Phone/accessories, jewelry, cosmetics, clothes, footwear, grocery, books,
studio, Clinic and health, pharmacy, beauty, Catering, restaurant, game, karaoke,
Furniture, garage, state agencies, banks, hotels.
• The majority of business households here are renting shops with prices from VND
2,000,000 - VND 20,000,000. Business income is estimated from VND 4,000,000 - above
VND 40,000,000 per year.
• Upgraded items do not require permanent land acquisition due to the construction works
within the existing roadbed. Underground public facilities such as power lines,
telecommunication cables, water supply systems and some trees on sidewalks may be
affected.
• The inconvenience to the traffic of local people and people on either side of the road. The
barrier and ditching to install the sewer system will prevent access to the store, affecting
business operations, reducing sales.
• Dust, wastes, landscapes damaged.
• The risk of unsafe traffic when the road surface is narrowed and excavated for
construction.
14. Through consultation and in-depth interviews with business households, they are aware
that the improvement of roads will certainly affect business activities. However, they all think
that the impacts on dust, traffic, reducing the number of customers coming in and out of the store
are acceptable with the mitigation measures proposed by the project. They also expect the project
to be implemented early, constructed and quickly returned so that they will not be affected in the
long term. With the road renovated and clean, they assess that the rent, housing prices in the area
may increase and that is the benefits they feel acceptable.
3.1.2. Mitigation Measures for Household Businesses
(1) For assets, architectural objects, crops and trees: if during the construction process, these
affected properties will be compensated with 100% of the new construction unit price or
repaired by the construction contractors at least is equal to the beginning.
(2) For business activities of households along the two sides of the road: In case the
construction works are obstructed, traffic activities cannot be restored to serve
households' business, the construction period in excess of 1 month, these households
will be provided with temporary impact funding in the course of business. The
support level is calculated based on the evaluation of the specific impact of each
business household, the number of days they cannot do business and the average
income level of the previous business month / year (2019) is confirmed by the tax
authority.

(3) Inform the street household businesses of the construction activities and their potential
impacts such, waste, dust, and noise, traffic, and construction schedule at least 02 weeks
before start of the construction.
(4) Set up construction and traffic warning signs at the construction site.
(5) Provide safe and easy access to the household businesses putting clean and strong thick
wood panels or steel plates over the open ditches.
(6) Do not gather materials and wastes within 20m from household businesses and shops.
(7) Do not use machines generating loud noise and high vibration levels near the businesses.
(8) Spray sufficient water to suppress dust during dry and windy days at least three times a
day at site.
(9) Deploy staff to guide the traffic during construction during transportation, loading and
unloading of construction materials and wastes, and to guard high risk operations.
(10) Ensure successive supply of materials according to construction schedule, and tidy
construction materials and stockpiles every working session.
(11) Cleaning up construction areas at the end of the day, especially construction areas in front
of business shops.
(12) Providing night lighting system with luminously painted fence and night lamp.
(13) Manage the worker force to any avoid the conflict with the local people and traders.
(14) Compensate goods, products damaged by construction activities of the subproject.
3.1.3. Implementation Plan
15. The independent monitoring consultant will carry out a specific assessment of the extent
and duration of impact of each affected business household based on the construction status of
the bidding package and propose implementation of assistance if it is found necessary, expected
in August 2020.
3.2. Liem Chinh Resettlement Site
3.2.1. Impact Level
16. The resettlement site used for site clearance of Phu Ly project is in Me Thuong village,
Liem Chinh ward. The resettlement site has 77 land plots, the average area of each lot is 70-80
m2; the proposed price list of resettlement land plots to be allocated to the affected people is from
VND 3.3 million to 4.5 million/ m2. This resettlement area has been cleared from 2005, until
2011, it was transferred to the resettlement land fund.
17. According to the site clearance compensation plan of the resettlement area item approved
in September 2005, the total number of affected households is 37 households. There are 34 AHs

on land and 3 AHs on crops (cultivating on the land managed by CPC). In June 2016, the City
People's Committee continued to issue a decision approving the compensation plan for 18
affected households (including 1 affected household for residential land and 17 affected
households for architectural objects and trees on the land area). embellishment, illegal land but

this category is 55 households, including 35 AHs permanently going to land and 20 AHs having

18. Total number of affected households is 55 households. There are 5 affected households on
residential land (not relocated), 34 affected households on agricultural land (no household will be
affected by 20% or more). 16 affected households on architectural properties. No vulnerable
households are affected. One affected organization is Liem Chinh Commune People's
Committee.
• Impact of land acquisition: Total acquired land area in 2005 and 2016 was 13,477.1 m2,
including: 8,569.6 m2 agricultural land, 319.5 m2 residential land and 4,588 m2 public
land managed by Liem Chinh Ward People’s Committee.
• Impacts on Structures: There are 16 households affected on structures, of which 5
households are affected on residential land where structures are affected and 11
households are affected on structures built on illegalizable land (managed by the Ward
People’s Committee). Out of 5 households impacted with residential land, one household
is impacted with housing. However, this house is temporary one with asbestos cement
roof. Households are only partially affected on structures, including 173.8 m2 of fence
walls and 129m2 of cement yard, 41 m2 of sheds. In addition, there are some other
affected structures such as drainage pipes, wells, brick gate piers and fence made of B40
mesh.
• Impacts on Trees and Crops: There are 341 fruit trees in various kinds (Dracontomelon
duperreanum, longan, banana, etc.), 112 timber trees. In addition, there are approximately
10,003 m2of crops (rice, vegetables) affected by the project. Total number of households
affected on trees and crops is 55 households.
3.2.2. Review Implementation of Compensation, Support and Resettlement
Compensation plans for 32 households in 2005
19. The plan of compensation for site clearance for 37 affected households was approved
under Decision No. 496 / QD-UB of September 12, 2005, with a total budget of 502,342,932
VND. The compensation unit price was issued in 2004 by the People's Committee of Ha Nam
Province and approved by the people. City clearance council and the investor (Minh Khoi Co.,
Ltd.) paid 32/37 AHs (including 29 AHs on land and 3 AHs on crops). The total acquired land
area is 10,850.1m2 (accounting for 80.5% of the total resettlement area), including 6,953.6 m2 of
agricultural land, 314.5 m2 of residential land and 3,582 m2 of public land managed by the ward
People's Committee. There are 5 affected households on agricultural land (1,616 m2 affected
area) have not yet been compensated.

Compensation plan for 23 households and the remaining 5 households in 2016:
20. According to the compensation plan made in 2016, the total number of affected
households is 23 households, including 5 households whose agricultural land is recovered, one
household has residential land recovered and 17 households are affected on structures and crops
on illegal land but located on the same legal land lot. The total acquired land area is 2,627 m2,
including 1,616 m2 of agricultural land, 5 m2 of residential land and 1,006 m2 of public land
managed by Liem Chinh ward People's Committee.
21. For 5 unpaid households impacted with agricultural land in 2005, the People's Committee
of Phu Ly city issued Decision 1079 / QD-UBND dated April 29, 2016 approving the plan of
compensation and additional adjustment, supporting agricultural land for 5 affected households
on agricultural land without compensation in 2005 with a total budget of 265,093,830 VND.
These households will be compensated 100% for the land area and their assets on the affected
land according to the replacement unit price at the time of compensation and support policies for
households whose agricultural land is acquired. This compensation plan is in accordance with the
resettlement policy framework and approved resettlement plan of MCDP project.
22. On June 21, 2016, the City People's Committee issued Decision 1571 / QD-UBND
approving the compensation plan for 18 affected households (including one affected household
for residential land and 17 affected households for architectural objects and trees on reclaimed
land, illegal land but located in the same parcel of land with legal residential land), with a total
compensation of VND 100,299,164. Unit price applied for compensation is the unit price
approved by Ha Nam People's Committee based on the profitability of the land due to the
absence of agricultural land transactions in the city. As follows.
• Compensation for land: 58,000 VND/m2;
• One-harvest crops on rice land: 9,000 VND/m2 (equivalent to value of 400kg of
rice/360m2 of field land and price unit of rice is 8,100 VND/kg).
• Subsistence allowance: 15,000 VND/m2;
• Job changing and vocational training allowance: 116,000 VND/m2
23. The additional compensation plan for the above 18 households is applied according to the
land price approved by the Provincial People's Committee, in accordance with the resettlement
policy framework of the World Bank's MCDP and OP 4.12 projects, and assets on land apply
the support level of 40%-60% of the replacement value of the property. This option is
different from the resettlement policy framework and resettlement plan of the MCDP project.
Therefore, the City People's Committee agreed to revise the site clearance compensation plan
approved in Decision 1571 / QD-UBND dated June 21, 2016 and conducted additional
compensation and support on properties on land to The above households are entitled to a support

level equal to 100% of the compensation value. The method of implementation includes
reviewing the entire volume of assets that have not met the compensation criteria according to the
Resettlement Policy Framework, the unit price applied is the unit price issued by the Provincial
People's Committee at the time of land acquisition (2016). By calculation, the amount of
compensation, supplementary support for the above 18 households is 77,876,000 VND to
ensure compliance with the project's policy framework.
3.2.3. Payment of Compensation and Hand Over
24. By June 2016, the site clearance of the item Liem Chinh Resettlement Area has been
completed 100%. Technical infrastructure works were completed in the fourth quarter / 2016. 55
AHs will recover agricultural land and assets on the land, without much impact on their daily life
and livelihoods. The evaluation results show that the compensation work in 2005 for 32
households is fully compliant with the regulations of the Government of Vietnam. 80.5% of the
total land area of the resettlement area was paid compensation and was recovered in 2005. The
review results identify 18 AHs who are eligible to receive additional support according to the
project's policy. Support value is calculated based on the compensation and approved unit price.
Value has been updated in the estimate.

3.2.4. Disclosure Information
25. Survey results by questionnaires showed that 18 households answered that they had been
disseminated information about the project (compensation plan, compensation policy,
implementation time, scale of the project...). Among them, 16 households were informed about
the project through meetings held in the village; 2 households learned about the project
information through local government officials.
3.2.5. Detailed Inventory
26. Survey results show that 16 households believe that detailed damage counting is conducted
publicly and transparently; 18 households responded to the results of the detailed and complete
damage tally, the minutes of tally were fully affected by the households. 23 households to make
additional assistance to ensure the compliance with the project’s policies.
3.2.6. Unit price of compensation
27. Survey results show that 12 households are satisfied with the compensation unit price, 6
households think that such compensation unit price is acceptable. Therefore, the households did
not have any questions about compensation and support unit prices but agreed with the project's
compensation and support plan.
3.2.7. Restore Life
28. The survey results show that the main occupation of 55 affected households in Me Thuong
village is small business, handicraft and freelance labor. On the other hand, each household will
only have part of its agricultural land and annual crop land recovered, so land acquisition does
not affect households' livelihoods. In addition, apart from compensation for land and assets on the
land, the AHs receive support to stabilize their lives, support for career change and find jobs, so
all households agree to support households implementing the project.
3.2.8. Complaints and settlement of complaints
29. Through collecting information from households as well as from local authorities and
grassroots levels, there was no record of households' complaints about compensation unit prices,
land clearance plans as well as actual procedures. show; No cases of embezzlement and
violations were detected in the units responsible for implementation and coordination of land
clearance.
3.2.9. Implementation Plan Corrective Operations
30. The review and application of mitigation measures of this item will be implemented
simultaneously at the time of implementing the embankment section of the southern bank of
Chau Giang river, expected in December 2020.

4. SOCIO-ECONOMIC SURVEY RESULTS
4.1. Item: Upgrading Drainage and Technical Infrastructure System for Bien Hoa Road
31. Current situation of Bien Hoa Street has 215 business households with different types of
businesses: phones / accessories, jewelry, cosmetics, clothes, shoes, groceries, books, studios,
clinics and medicine. health, pharmaceuticals, beauty, catering, restaurants, games, karaoke,
furniture, garages, state agencies, banks, hotels. In particular, households trading in cosmetics,
clothing,... accounted for 58%, service shops, accessories, furniture accounted for 34%, other
organizations and businesses accounted for 8%.
32. During construction, part of the road and sidewalk is occupied for construction, parking or
loading / unloading of materials. Such activities may cause or make people feel uncomfortable
when entering stores or businesses, or customers may feel unhygienic when eating and drinking
in dusty areas.
33. Households along the road will be disturbed by dust, noise and vibration, temporarily
reducing accessibility. These impacts can cause affected families to change / modify their daily
activities such as learning (in children), cooking, eating, resting, recreation ... Other, traffic
disturbance and increased traffic risk and local safety or inundation can affect family members'
travel habits.
34. The majority of business households here are renting shops with prices from VND
2,000,000 - VND 20,000,000. Enterprise income is estimated from 4,000,000 VND - over
40,000,000 VND / year. The average income is estimated at 9,000,000 VND / month. The
process of construction interrupting access to the store can affect the number of customers and
their income. The support plan has also been provided with compensation for income loss in the
affected period equivalent to the average monthly net income, at least for 3 months in case the
construction period is prolonged. However, these impacts only occur in a short time, not
continuous and are minimized by the application of appropriate construction methods.
35. Trading components will also benefit greatly through improved infrastructure and
landscaping that facilitate trade.
4.2. Item: Liem Chinh Resettlement Site
36. Consultant surveyed 18 (accounting for 33%) out of 55 AHs in Me Thuong Village of Liem
Chinh Ward. Out of 18 surveyed households, 5 households are impacted with residential land, 10
households are impacted with agricultural land and 3 households are impacted with trees and
structures. Detailed information about AHs as well as compensation, site clearance for
development of resettlement site serving site clearance for the projects in Phu Ly City is provided
below.

37. Of the 18 surveyed HHs, there’s no HHs with members being ethnic minority people, with
average number of HH members being 4.2 persons/HH. Average number of main laborers of
each HH is 2.1 people. The following table provides detailed description about the surveyed

b. Educational level
38. Generally the AHs in the project area have relatively high educational level, with no HHs
illiterate. Educational level of the surveyed HH is presented in detail in the following table:

c. Occupations of AHs
39. Survey results show that of the 18 surveyed HHs, peasant HHs take smallest percentage
(only 5.6%). Business HHs account for highest percentage (61.1%). Public servants account for
16.7%. Other occupations only take a small percentage. HH occupation percentages are shown in
detail in the following table:

5. POLICY FRAMEWORK
5.1. Legal Framework
40. The Update Resettlement Plan (URP) was prepared on the basis of the Resettlement
Policy Framework of the project in the preparation phase of Project Detailed Outline (PDO) and
has been approved by the Prime Minister and Ha Nam PPC. This URP will comply with laws,
circulars, decrees regulating land acquisition, compensation and resettlement in Vietnam, and the
World Bank's policy on involuntary resettlement.
5.1.1. Legal Framework of Government of Vietnam:
41. Currently, a number of policies, such as the Land Law and the regulation policy on
compensation, assistance and resettlement of the Government of Vietnam has been changed as:
- Constitution of the Socialist Republic of Vietnam adopted on November 28, 2013.
- Decree No. 01/2017 / ND-CP dated January 6, 2017 of the Government on amending
decrees on the implementation of the Land Law.
- Decree No. 43/2014/ND-CP dated May 15, 2014 of the GoV on detailing a number of
articles of the Land Law.
- Decree No. 44/2014/ND-CP dated May 15, 2014 of the GoV on land prices.
- Decree No. 47/2014/ND-CP dated May 15, 2014 of the GoV on compensation, assistance
and resettlement upon land acquisition by the State.
- Decree No. 01/2017/ND-CPdated January 06, 2017 of the GoV on amendments to the
decrees on the implementation of the Land LawLand Law No. 45/2013/QH13 dated
November 29, 2013 of the National Assembly on Land (effective on July 1, 2014).
- Circular No.36/2014TT-BTNMT of the MONRE dated 30 June 2014 detailing the
methods for land pricing, adjustment to land price brackets and land price lists, specific
land pricing and provision of consultancy on land
- Circular No.37/2014/TT-BTNMT the MONRE dated June 30, 2014 on compensation,
assistance and resettlement upon land acquisition by the State;
- Circular 33/2017 / TT-BTNMT detailing the Government's Decree No. 01/2017 / ND-CP
dated January 6, 2017 amending and supplementing a number of decrees detailing the
implementation of the land law and amend and supplement a number of articles of
circulars guiding the implementation of the Land Law. (Amend and supplement a number

42. Decisions of Ha Nam provinces relating to compensation, assistance and resettlement in
provincial territory will be also applied specifically:
- Decision No.38/2014/QD-UBND dated September 12, 2014 on issuing regulations on
compensation, assistance and resettlement upon land acquisition by the State in Ha Nam
province.
- Decree No. 06/2016/QD-UBND dated 14th April 2016 issue on supplementing some
contents of compensation, assistance and resettlement when the State acquires land in Ha
Nam province, attached with Decision No. 38/2014/ QD-UBND dated 12nd September
2014 of the provincial People's Committee.
- Decision No.41/2014/QD-UBND issuing on the management of resettlement land.
- Decision No. 36/2017 / QD-UBND dated August 31, 2017 promulgating the Regulation
on quota for land allocation and recognition of land use rights; splitting, consolidating
land plots in Ha Nam province.
- Decision No. 48/2019 / QD-UBND dated December 20, 2019 of Ha Nam Provincial
People's Committee, temporarily stipulating land price list for the period of 2020-2024 in
Ha Nam province.
- Decision No. 50/2019 / QD-UBND dated December 20, 2019 of the People's Committee
of Ha Nam province on compensation prices for houses, architectural objects, other
construction works and relocation of graves when the State recovers land on Ha Nam
province in 2020.

- Decision No.49/2014/QD-UBND dated November 20, 2014 issuing on Compensation
rates for crops, livestock upon land acquisition by the State.
- Decision No. 48/2016 / QD-UBND dated November 21, 2016 on supplementing the unit
price of compensation for plants and animals when the State recovers land in the province
in Decision No. 49/2014 / QD- People's Committee of November 20, 2014 of Ha Nam
People's Committee.
5.1.2. World Bank Policy on Involuntary Resettlement (OP 4.12)
43. The World Bank's Voluntary Resettlement Policy in this URP is not changed from the
Resettlement Plan for the Additional Financing (AF), so the policies applied will be referred to
the approved RP for AF.
5.1.3. Comparison between GoV and WB Approaches
44. Policy differences of the Government of Vietnam on compensation, assistance and
resettlement compared to the World Bank's policy on involuntary resettlement mentioned in the
RP for AF and unchanged in this URP. Therefore, this content is referenced to the RP for AF.
5.2. Principles and Policies for Compensation, Assistance and Resettlement
45. The principles and policies of compensation and resettlement are not changed compared
to the RP for AF, so it will refer to the RP for AF.

6.1. Upgrading Drainage and Technical Infrastructure System for Bien Hoa Road
46. The first community and local government consultation was conducted on 11-12 August
2016 at the People's Committees of Luong Khanh Thien, Minh Khai and Liem Chinh wards; The
second time was held from March 15, 2020 in Minh Khai Ward and Liem Chinh on March 18,
2020 in Luong Khanh Thien Ward before the construction of the project. Consultation results are

6.2. Liem Chinh Resettlement Site
47. Directly interviewing households via field questionnaires in August 2016 showed that
100% of the households responded to their detailed and transparent information about the project
(compensation policy, compensation judgment, execution time,...). About information sources:
16/18 households learned through meetings held at cultural houses, 2/18 households learned
through local authorities. 100% of households are satisfied with the transparency, accuracy and
completeness of detailed tally results. 12/18 households are satisfied with the compensation and
support unit price and 6/18 households think that the unit price is acceptable. 100% of households
have no questions about compensation rates and no complaints have been recorded.

7. ORGANIZATION OF IMPLEMENTATION
48. The organization of the implementation of this updated Resettlement Plan is unchanged
from the RP for AF, therefore, the RP for AF will be referenced.
8. MONITORING AND EVALUATION
8.1. Internal Monitoring
49. Internal monitoring for the implementation of URP is the responsibility of the Project
Management Unit of Phu Ly City, with the support of project consultants, will monitor the
progress of the preparation and implementation of resettlement through regular progress reports
on quarterly basis.
8.2. Independent Monitoring
50. Independent monitoring is conducted by Joint Venture of Construction and
Environmental Engineering., JSC - CEEN and Human Resource Development and Consulting
Co. Ltd. The Independent monitoring organization will report every 6 months on the progress and
give relevant recommendations to solve any issues arising in the process of monitoring.
51. The main monitoring indicators are:
a. Compensation payment and assistance for affected households in accordance with
compensation policy described in RP;
b. Technical assistance, resettlement assistance and allowances;
c. Income restoration and entitlements to allowances;
d. Information disclosure and public consultation;
e. Grievance and Grievance redress procedures, problems to be resolved;
9. IMPLEMENTATION PLAN
52. A plan to implement the compliance with 18 affected households of Liem Tuyen
Resettlement area and 215 temporary affected households of the Upgrading of drainage system
and technical infrastructure of Bien Hoa road as follows.

10. COSTESTIMATE
53. Estimated cost for RP implementation of the project is VND 7,059,451,200 (equivalent to
US$ 303,435). Funds will be allocated from reciprocal capital of the Ha Nam PPC.
