One-day Judicial Colloquium on “Prevention of Human Trafficking” for the
Judicial Officers, Police Officers and Public Prosecutors of Himachal Pradesh.
Large scale human migration is the by-product of industrialization and ever
rising demand of workforce in construction and service sectors. And in this mass
transfer of individuals from one place to another lies the danger of trafficking in
human beings. Trafficking caused by deceit, coercion and intimidation results in gross
human right violations of the victims thereof, as such it should be a serious concern
for the law enforcement agencies. Ironically, trafficking now is no more confined to
labour and sexual exploitation but is also being done for illicit trade of drugs, sale and
purchase of human organs and tissues. Normally, the victims hail from the
marginalized and weaker sections of the society. They are pitted against the organized
criminals. For various reasons, reporting of such cases is very less and much lesser is
the rate of conviction in case, charge sheets happen to be filed in the courts against
the accused.
In order to sensitize the stakeholders, a one-day Colloquium on “Prevention of
Human Trafficking” was held in the Academy on 20th
October, 2019. It was attended
by seventy four participants which included fifty six Judicial Officers viz. District &
Sessions Judges, Senior Civil Judges, Civil Judges, six Police Officers heading Anti-
Human Trafficking Units and twelve Public Prosecutors. In fact, this Colloquium,
second in the series, was held under the aegis of Ministry of Home Affairs (CS
Division), Government of India.
The opening session initiated by Sh. Rakesh Senger, Executive Director
(Programme), Bal Mitra Mandal, Kailash Satyarthi, Children Foundation, highlighted
the work done by Sh. Kailash Satyarthi, a Noble laureate, in the filed of Child Rights
through a documentary depicting dimension, challenges and existing response on
human trafficking.
Sh. Ravi Kant, Advocate, Supreme Court of India and President, „Shakti Vahini‟, an
NGO, apprised the participants about the role of Stakeholders in victim protection,
rescue, care and support. Whereas Ms. Malita Farnadies and Sh. P. K. Bardhan of

Internation Justice Mission, spoke about laws and court practices relating to sexual
and labour exploitation of trafficked persons. A documentary highlighted the
intricacies involved in the prosecution of a person accused of trafficking women and
running a brother in West Bengal.

One-day Conference on “Narcotic Drugs and Psychotropic Substances Act” for
the Special Judges, Superintendents of Police and Public Prosecutors of
Himachal Pradesh.
In spite of its stringent provisions, the Narcotic Drugs and Psychotropic
Substances Act, has not been proved to be an effective measure to check the menace
of drug abuse and drug trafficking. As a matter of fact, the instances of substance
abuse, like „chitta‟ and other synthetic drugs by adolescents in the state are on the rise
so also the interception of narcotics and synthetic drugs by the Police. Persons
involved in illicit trade of drugs, are working as organized criminals. Recently, there
were attacks by drug cartels on police personnel in district Mandi. The drug abuse,
thus, has become a social problem. For the functionaries involved in dispensation of
justice in drugs cases, one day conference on Narcotic Drugs and Psychotropic
Substances Act was held for the Special Judges, Superintendents of Police and Public
Prosecutors of the state. It was attended by thirty eight special judges, seven Police
Officers and sixteen Public Prosecutors.
Why the police machinery is not in a position to control the transit of drugs,
why the investigation is not upto the standard and why such cases end in acquittal,
were the questions which were raised and extensively discussed with reference to
judgments given by the Hon‟ble Supreme Court and High Court, in the first two
sessions chaired by Hon‟ble Shri Justice Anoop Chitkara, Judge, the High Court of

H.P. Whereas the third session was headed by Sh. Diljeet K. Thakur, IGP
(Intelligence). He elaborated the dimensions of drug trafficking prevalent in the state
and discussed the procedural aspects relating to investigation of the drug cases.

Besides this one day conference, the Academy organized „two-day
training programme for the Investigating Officers of the State on Narcotic Drugs and
Psychotropic Substances Act‟ on 18-19 November and 20-21 December, 2019.
During these programmes, the Police Officers were apprised of provision of this Act,
its relationship vis-a-vis Drugs and Cosmetics Act and procedural issues involved in
investigation of drug cases. Forensic aspects were also explained to them by Sh.
Kapil Sharma, Assistant Director (NDPS Division), State F.S.L. Junga. The other
eminent persons who visited Academy during these courses included Dr. J. N.
Barowalia, Former District & Sessions Judge, Sh. Sanjeev Katoch, Joint Director
(Prosecution), Sh. Sandeep Attri, Public Prosecutor, Shimla.
Six days Training Programme on “Sharing of Best Practices” for the Civil Judges
of Odisha.
Himachal Pradesh Judicial Academy organized a six days Training Programme
on “Sharing of Best Practices” for the Civil Judges of Odisha from 1st to 6
th
December, 2019.It was attended by forty Civil Judges. During training, the
participating Officers were taken to Shimla Water Catchment Wild Life Sanctuary and
they were apprised of biodiversity and constitutional duty of citizens to preserve

environment and wildlife. The Officers also visited Model Central Jail Kanda where
they keenly observed rehabilitative measures undertaken by the jail administration
under Project “CARA”. Shimla has a rich cultural and historical heritage and in order
to showcase it, the officers were taken to Indian Institute of Advanced Studies, Chaura
Maidan.
During other sessions, Sh. Virender Singh, Ld. Registrar General, Sh. R. L.
Sood, Senior Advocate, Sh. P. P. Ranta, Member Secretary, State Legal Services
Authority, Sh. Somesh Goyal, Director General of Police (Prison), Dr. Nishtha Jaswal,
Vice Chacellor, H.P. National Law University, Mrs. Sapna Pandey, Additional
Secretary(Law), Sh. Sandeep Dhawal, S.P. (Cyber Crimes), Sh. Mohit Bansal, Central
Project Coordinator, High Court of H.P., visited the Academy and delved upon
different topics ranging from Environmental Laws, Child Delinquency, Cyber Crimes,
Court and Case Management, Computerization of courts, sentencing policies, legal aid
mechanism in the state etc.

Two-day Course on “Use of Video Conferencing Facilities” for Senior Civil
Judges, Civil Judges and Police Officers of the State.
The Academy also conducted a two-day course on use of video conferencing
facilities for the Judicial and Police Officers of the state on 10th
& 11th
August, 2019
which was attended by forty four Senior Civil Judges and Civil Judges besides six
officers of the Police. Sh. Vikas Bhardwaj, Ld. Registrar(Judicial and Protocol
Branch) initiated the first session by presenting a brief overview of the e-Court
project and also discussed technical aspects involved in video conferencing. Sh. Hans
Raj, Additional District & Sessions Judge, who is Master Trainer discussed various
aspects of video conferencing system connecting courts and the prisons. Sh. Barinder
Kumar, Team Leader, Department of Information Technology explained the
procedural aspects involved in video conferencing and conducted a live demo thereof
during the technical session. On the next day, Sh. Vikas Bhardwaj and Sh. Hans Raj
demonstrated how the video conferencing facilities are to be used in court proceedings
by simulating remand procedures, witness examination and also discussed legal
provisions and judgments. Dr. Parvinder Singh Arora, CJM, Shimla addressed the
participants and explained to them as to how management reporting from NJDG and
CIS is to be carried out.

One-day Course on “Juvenile Justice” for the Principal Magistrates of Juvenile
Justice Boards
The Himachal Pradesh Judicial Academy also conducted one-day course on
“Juvenile Justice” for the Principal Magistrates of Juvenile Justice Boards of the state.
It was attended by nine Principal Magistrates. The officers were apprised of various
issues including child abuse and vulnerability, problems of children in conflict with
law, counseling of children and their families etc. The provisions of Juvenile Justice
(Care and Protection of Children) Act, 2015, The Child Labour (Prohibition and
Regulation) Act, The Prohibition of Child Marriage Act were discussed with relevant
case laws. Sh. Sushil Kukreja, Registrar to Lokayukta apprised the participants of
various provisions of protection of children from Sexual Offences Act. Dr. S. N.
Ghosh of Himachal Pradesh University discussed the psychological aspects of child
behavior, delinquency, counseling of children and their families etc.
For others stakeholders of Juvenile Justice System, four one-day courses on
“Juvenile Justice” were held on 8th July, 22 July, 5 August and 19 August 2019 in
which hundred and five persons participated whereas another three-day training
programme for the Chairpersons and Members of Child Welfare Committees and
Members of JJB was conducted by the Academy from 16 to 18 December, 2019.Dr.

Five-day Training Programme on “Criminal Law & Procedure” for the Officers
of Himachal Pradesh Administrative Service.
In collaboration with Himachal Pradesh Institute of Public Administration,
Fairlawns, the Academy organized a five-day course for the officers of Himachal
Pradesh Administrative Service on and w.e.f 16 to 20 September, 2019 in which
twenty two officers participated. The officers were addressed by distinguished and
experienced resource persons of the Academy. During this training course, the officers
were made aware of the constitutional provisions as well as the substantive and
procedural laws, which they have to administer while discharging judicial and quasi
judicial functions. Basic provisions enshrined in The Evidence Act, Indian Penal
Code, Code of Criminal Procedure, Code of Civil Procedure were also discussed and
explained to them. High dignitaries who visited to interact with participating officers
included Hon‟ble Shri Justice A.K. Goel(Retired), Hon‟ble Shri Justice S.S. Thakur
(Retired). Sh. Sushil Kukreja, Sh. Yaswant Singh Chogal, Sh. Prem Pal Ranta, District
and Sessions Judges and Sh. B.L. Soni, Former District and Sessions Judge were other
resource persons who visited the Academy during this training programme. Ms.
Debasweta Banik, IAS, delve on various procedural aspects required to be undertaken
and observed in the conduct of security proceeding.

One-day Training Programme on “Mediation” for the Judicial Officers of H.P.
For the Senior Civil Judges and Civil Judges, a one-day training course on
“Mediation” was organized on 3 November, 2019, by the Academy. Ms. Nirja Bhatia,
Judge-Trainer, MCPC, New Delhi and Sh. Dharmender Rana, Member Secretary,
MCPC, New Delhi explained to the participating Judicial Officers the provisions of
code of civil procedure relating to Alternative Dispute Redressal and delve on
concept of mediation, steps involved in it and the role of referral judges. The course
was attended by forty two Judicial Officers.
Induction Training for newly appointed Additional District & Sessions Judges.
On joining of two newly appointed Additional District & Sessions Judges, the
Academy also commenced an induction course for them.

Induction Training for newly appointed Judicial Officers.
Himachal Pradesh Judicial Academy also conducted Induction Training
Programme for four newly appointed Judicial Officers during the second half of the
year. The Training was imparted in-house by experienced Faculty of the Academy and
other Resource Persons. Field training on different subjects relating to law in out–
campus centers including at IGMC, Revenue, Forensic, Police and Jail Departments
was also given.

Three-day Training Programmes on “Functions and Duties of Panchayati Raj
Institutions” for Master-Trainers and for the officers of the Cooperative Societies
of the State.
In pursuance of the academic calendar, the Academy conducted three-day
courses for thirty Master Trainers of Panchayati Raj Institutions on and w.e.f. 2 July to
4th
July, 2019, and for the officers of Cooperative Societies from 25-27 July, 2019, 23-
25 September, 2019, 21-23 October, 2019 and 14-16 November, 2019. These courses
were attended by ninety four participants. The eminent resource persons who visited
the Academy during these courses included Sh. George, Sh. J. L. Gupta, Sh. B.L.
Soni, Sh. L.R. Sharma Former District & Sessions Judges and Sh. K.S. Daulta, H.A.S.
(Retired).

Two-day Training Programme on “CIS National Core Version 3.1” for the
Ministerial Staff of Lower Judiciary of Himachal Pradesh.
The Himachal Pradesh Judicial Academy organized five Courses on ““CIS
National Core Version 3.1” for the Ministerial Staff of Lower Courts of Himachal
Pradesh on 15-16 July, 2019, 2-3 August, 2019, 2-3 September, 2019, 27-28
September, 2019 and 30 September 2019 & 01 October, 2019. These courses were
attended by ninety participants. The Courses focused on the latest version of Case
Information Software. The main objective of the courses was to highlight the
modifications made in the software deployed in the district courts.

Three-day Training Programme on “Ubuntu-Linux: 16.04/LibreOffice-
Writer/Calc” for the Ministerial Staff of District Courts of Himachal Pradesh.
The Himachal Pradesh Judicial Academy organized six Courses on
““Ubuntu-Linux: 16.04/LibreOffice-Writer/Calc” for the Ministerial Staff of
Subordinate Courts of Himachal Pradesh from 29-31 July, 2019, 21-23 August, 2019,
5-7 September, 2019, 3-5 October, 2019, 25-27 November, 2019 and 26-28 December,
2019. These courses were attended by one hundred seventy seven participants. The
participants were apprised of latest tools and techniques on Ubuntu-Linux
environment to enhance their knowledge of computer system in order to discharge
their duties to save time and increase their efficiency.

ACADEMY NEWS
Hon’ble Mr. Justice V. Ramasubramanian, Chief Justice, High Court of
Himachal Pradesh was elevated as Judge, Supreme Court of India and his
Lordship relinquished the charge of office of the Chief Justice, High Court of
H.P. on 23rd
September, 2019.
Hon’ble Mr. Justice L. Narayana Swamy assumed the charge of office of the
Chief Justice of High Court of Himachal Pradesh on 6th
October, 2019.
The Judicial Academy started to organizing training courses to the Judicial Officers
of other States.
