InmyjobasaStaffFirearmsInstruc-tor for the NRA Law Enforcement Divi-sion,Ioftengetquestionsfromstudentsastohowtotaketheirgunswhentheyfly.Ifrequentlyflytoschoollocationswithmyowngunsandgenerallyitisn’tthathardaslongasyouknow,andfollow,therules. Therearethreesetsofrulesandregu-lationsthatyouneedtobefamiliarwith:TSA regulations, the airline regulations,and the laws of the jurisdiction you aretraveling to. Being prepared will makethingseasierforyou. Ifyou’renewatthis,youshouldgotothewebsitesoftheairlineandtheTSAandread what they have to say about trans-porting guns. TSA regulations are actu-allyfairlysimpleandstraightforward.TheCodeofFederalRegulationsTitle49part1544.203requirethatgunsare:

1.Unloaded2.Inalockedhardsidecase3.Declared when you check in at thecounter (you cannot use curbsidecheckinwhencheckingguns).

Flying With GunsIf your gun case is small, like a pis-

tol case, itmay beplaced insideanotherpieceofcheckedluggage,butthecaseit-selfmustbelockedregardlessofwhetheryourluggageislocked.Makesuretheguncase is accessible, because you will havetoopenitwhencheckingin.OntheTSAsite under “Frequently AskedQuestions”itstatesthatTSAlocksareacceptableforgun cases. Due tomy own security con-cerns,Ineverusethemonaguncase,butit’syourchoice.

Ifthecaseislargeitmaybecheckedasaseparatepieceofluggage.TheTSAdoesnotputany limitonthenumberofgunsincheckedluggage,butbearinmindyourairline’sweightlimits.TSAalsostatesthat,“Firearms magazines and ammunitionclipsmustbesecurelyboxedor includedwithin a hard-sided case containing anunloaded firearm.” Gun parts, includingmagazines,arenotallowedinyourcarry-onandmustbeinyourcheckedluggage.

Ammunitionmaybeinthecasewiththegunsorinyourcheckedluggage.Us-ingtheoriginalammoboxisprobablysim-plest,butyoumayuseanothertypeofboxdesignedtocarryammunition.Theusualweightlimitforammunitionis11lbs.

Mostairlineregulationsarefairlysim-ilar,butdon’tassumethatanairlineyou’veneverflownonwill be thesameaseveryother one. If there’s someone directingpassengerswhenyou’relininguptocheckin,IfinditbesttotellthemthenthatI’mchecking guns. Itmaymake a differencewhich lineyouendup in,sinceyouhavetodealwithanactualperson,notjustanautomatedkiosk.

Whenyoucheckintherewillusuallybe a small form to fill out onwhich youstate that the guns are unloaded. Someinclude information such as your name,contactinformation,andwhereyou’refly-ing fromandto.Atone timethefirearmcardwasrequiredtobeontheoutsideofthecase,butitnowgoesinside.

Generally,it’sbesttobepoliteandpa-tientwith airline personnel. Realize thatyoumay bemore familiarwith the rulesthan they are. Rather than get annoyed,look on it as an opportunity to educatethem.Standonyourrightswhenyouneedto,butasmileandakindwordwillhelpsmoothyourpath.

Be aware that different airportsmay have different ways of dealing withcheckedguns.Allowingalittleextratimeforcheckinisalwaysagoodideaifyou’reunfamiliarwiththeairportyou’reusing.

During a recent presentation on LEOSA atthe International Law Enforcement Educa-tors and Trainers Association Conference(ILEETA),Iaddressedthefactthatindividu-als carrying under LEOSA do not qualifyfor thesameexemptionssomestatepermitholders benefit from in terms of carryingconcealedfirearmsinFederalParksandGunFree School Zones (GFSZ). The surprisedlooksandconcernsfromtheaudienceraisedagiantredflag:iftheexpertsouttheredon’tknow this, how many others may be un-knowinglyviolatingthelaw?

While LEOSA affords qualified active andretiredlawenforcementofficerstheprivilegetocarryaconcealedfirearminallfiftystates,the District of Columbia, Puerto Rico, andallotherU.S.possessions(excepttheCanalZone),itdoescontainsomerestrictions.

Explicitlywrittenintothestatuteareseveralareasconsideredoff-limitstothosecarryingunderLEOSA,suchasrestrictions imposedbyprivatepersonsorentitiesontheirprop-ertyandthoseimposedonstateorlocalgov-ernment property, installations, buildingsandparks.Whatisnotincludedinthestat-uteiswhereproblemsmayarise.

Per 18U.S.C. § 930(a)an individual ispro-hibited from possessing or attempting topossessafirearminaFederalfacility,whichisbroadlydefinedinthestatutetoinclude“abuildingorpartthereofownedorleasedbytheFederalGovernment,whereFederalem-ployeesareregularlypresentforthepurposeofperformingtheirofficialduties.”

While thebanonpossession in Federal fa-cilities appears to be well understood andrecognizedbythosecarryingunderLEOSA,theexemptionswhichallowindividualswithastateissuedpermittocarryconcealedfire-armsinFederalparklandsandthroughGF-SZ’sarenot.

The exemptions for these areas (36 C.F.R.§§2.4(e)&(h),18U.S.C.§922(q))allowforindividualscarryingconcealedinaccordancewiththelawsofthestateinwhichthefederalparkorGFSZislocatedtocarryconcealedinthem*;however,an individualcarryingun-derLEOSAiscarryingunderFEDERALLAWandnot inaccordancewith the lawsof thestate they are in. What thismeans is thatyouareNOTexemptedfromcarryingacon-cealedfirearmintheseareasUNLESSyouareonofficialdutyorpossesavalidandqualify-ingstateissuedconcealedcarrypermit.

Don’tthinkthisappliestoyou?Thinkagain.Go check out your local Planning Depart-ment’swebsite or take a quick look at SanFrancisco Planning Department’s GFSZmap (http://www.sf-planning.org/index.aspx?page=2337). Most cities are so ladenwithGFSZ’sthatitisvirtuallyimpossibletotravelanywherewithoutinadvertentlypass-ingthroughoneofthem.

Sowhatdoesthismeanforyou?Whiletherehave been no known prosecutions of indi-viduals violating these laws while carryingunderLEOSA(onemustassumethatprofes-sional courtesy and the lack of knowledgeontheissuehaspreventedthis),youshouldalwaysprotectyourselfbyobtainingastateissuedconcealedcarrypermitinadditiontoyour LEOSA credentials. Most states havereciprocitylawsandagreementswhichallowforvastrecognitionoftheirpermitsthrough-outthecountryandsomeevenallowyoutoapplyasanon-resident.** Bottom line:al-waysbeawareofyoursurroundings,asigno-ranceisnotadefensetothelaw.
