(2) inappropriateuseofaphysicalrestraint,isolation,medicationorothermeansthatharmsorislikelytoharmachild;and (3) anunlawfulact,athreatormenacingconductdirectedtowardachildthatresultsormightbeexpectedtoresultinfearoremotionalormentaldistresstoachild. B. “Activityarea”meansspaceforchildren’sactivitieswhererelatedequipmentandmaterialsareaccessibletothechildren. C. “Adult”meansapersonwhohasachronologicalageof18yearsorolder. D. “AIMHIGH”isavoluntaryqualitychildcareimprovementprogramthatisnolongeropentonewregisteredorlicensedchildcareprograms.RecognitionofAIMHIGHwillterminateonDecember31,2017. E. “Assessmentofchildren’sprogress”meanschildren’sprogressisassessedinformallyonacontinuousbasisusingaseriesofbriefanecdotalrecords(descriptionsofthechild’sbehaviororskillsingivensituations).Children’sprogressalsocanbeassessedformallyatleasttwiceayearusingadevelopmentalchecklist(checklistofbehaviorsthatindicatephysical,motor,language,cognitive,socialandemotionaldevelopment/progress). F. “Attended”meansthephysicalpresenceofastaffmemberoreducatorsupervisingchildrenundercare.Merelybeingwithineyesightorhearingofthechildrendoesnotmeettheintentofthisdefinition(SeeSupervision,SubsectionTTT,8.16.2.7NMAC). G. “Capacity”meansthemaximumnumberofchildrenalicensedchildcarefacilitycancareforatanyonetime. H. “Child”meansapersonwhoisunderthechronologicalageof18years. I. “Childcarecenter”meansafacilityrequiredtobelicensedundertheseregulationsthatprovidescare,services,andsupervisionforlessthan24-hoursadaytochildren.Achildcarecenterisinanon-residentialsettingandmeetstheapplicablestateandlocalbuildingandsafetycodes. J. “Childwithadisabilityorspecialneeds”meansachildwithanidentifieddisability,health,ormentalhealthconditionsrequiringearlyintervention,specialeducationservices,orotherspecializedservicesandsupport;orchildrenwithoutidentifiedconditions,butrequiringspecializedservices,supports,ormonitoring. K. “ClassAdeficiency”meansanyabuseorneglectofachildbyafacilityemployeeorvolunteerforwhichthefacilityisresponsible,whichresultsindeathorseriousphysicalorpsychologicalharm;oraviolationorgroupofviolationsofapplicableregulations,whichresultsindeath,seriousphysicalharm,orseriouspsychologicalharmtoachild. L. “ClassBdeficiency”meansanyabuseorneglectofachildbyafacilityemployeeorvolunteerforwhichthefacilityisresponsible;oraviolationorgroupofviolationsofapplicableregulationswhichpresentapotentialriskofinjuryorharmtoanychild. M. “ClassCdeficiency”meansaviolationorgroupofviolationsofapplicableregulationsascitedbysurveyorsfromthelicensingauthoritywhichhavethepotentialtocauseinjuryorharmtoanychildiftheviolationisnotcorrected. N. “Clean”meanstophysicallyremovealldirtandcontamination.

O. “Conditionsofoperation”meansawrittenplanthatappliestoalicensedfacilityandisdevelopedbythelicensingauthoritywhenthelicensingauthoritydeterminesthatprovisionswithintheseregulationshavebeenviolated.Theplanaddressescorrectiveactionsthatthelicenseemusttakewithinaspecifiedtimeframeinordertocomeintocompliancewithlicensingrequirements.Duringthistimeframethelicensingauthoritymayincreaseitslevelofmonitoring. P. “Corehours”meansthedailyhoursofoperationofthechildcarefacility. Q. “Correctiveactionplan”meanstheplansubmittedbythelicenseeaddressinghowandwhenidentifieddeficiencieswillbecorrected. R. “Curriculum”iswhathappenseverydayintheclassroomandontheplayground.Itincludeseveryaspectofthedailyprogram.Curriculumderivesfromtheprogram’smissionstatement,philosophy(which,inturn,isbasedonassumptionsaboutyoungchildren’sdevelopmentandlearning),andprogramgoalsandobjectives.Itincludeshowmaterialsandequipmentareused,activitiesthatchildrenandadultsparticipatein,andinteractionsamongchildrenandbetweenchildrenandadults. S. “Deficiency”meansaviolationoftheseregulations. T. “Directproviderofcare”meansanyindividualwho,asaresultofemploymentorcontractualserviceorvolunteerservicehasdirectcareresponsibilitiesorpotentialunsupervisedphysicalaccesstoanycarerecipientinthesettingstowhichtheseregulationsapply. U. “Director”meansthepersoninchargeoftheday-to-dayoperationandprogramofachildcarecenter. V. “Disinfect”meanstodestroyorinactivatemostgermsonanyinanimateobject,butnotbacterialspores.Mixfourtablespoonsofbleachwithonegallonofcoolwateroruseanenvironmentalprotectionagency(EPA)registereddisinfectant. W. “Drop-in”meansachildwhoattendsachildcarefacilityonanoccasionalorunscheduledbasis. X. “Educator”meansanadultwhodirectlycaresfor,serves,andsuperviseschildreninalicensedchildcarefacility.Educatorsareconsideredstaffmembers. Y. “Environment”meansthattheenvironmentmeetsallrequiredlocal,state,andfederalregulations.Itincludesspace(bothindoorsandoutdoors)withappropriateequipmentandmaterialsthatencouragechildrentoengageinhands-onlearning. Z. “Exploitation”ofachildconsistsoftheactorprocess,performedintentionally,knowingly,orrecklessly,ofusingachild’spropertyforanotherperson’sprofit,advantageorbenefitwithoutlegalentitlementtodoso. DD. “FOCUS”isavoluntarytieredqualityratingandimprovementprogramthatisopentoallregisteredandlicensedchildcareprograms. EE. “Groupchildcarehome”meansahomerequiredtobelicensedpursuanttotheseregulations,whichprovidescare,services,andsupervisionforatleastsevenbutnotmorethan12children.Thelicenseewillresideinthehomeandbetheprimaryeducator. FF. “Groupsize”isthenumberofchildrenassignedtoaneducatororteamofeducatorsoccupyinganindividualclassroomorwell-definedspacewithinalargerroom. GG. “Guidance”meansfosteringachild’sabilitytobecomeself-disciplined.Guidanceshallbeconsistentanddevelopmentallyappropriate. HH. “Home”meansaprivateresidenceanditspremiseslicensedundertheseregulationswherechildrenreceivecare,services,andsupervision.Thelicenseewillresideinthehomeandbetheprimaryeducator. II. “Homelesschildrenandyouth”meansindividualswholackafixed,regular,andadequatenighttimeresidence,whichincludes: (1) Childrenandyouthwhoaretemporarilysharingthehousingofotherpersonsduetolossofhousing,economichardship,orasimilarreason;arelivinginmotels,hotels,trailerparks(excludesmobilehomes),orcampinggroundduetothelackofalternativeadequateaccommodations;arelivinginemergencyortransitionalshelters;areabandonedinhospitals;orareawaitingfostercareplacement; (2) childrenandyouthwhohaveaprimarynighttimeresidencethatisapublicorprivateplacenotdesignedfororordinarilyusedasaregularsleepingaccommodationforhumanbeings; (3) childrenandyouthwhoarelivingincars,parks,publicspaces,abandonedbuildings,substandardhousing,busortrainstations,orsimilarsettings;and (4) migratorychildrenwhoqualifyashomelessforthepurposesofthissubtitlebecausethechildrenarelivingincircumstancesdescribedinParagraphs(1)through(3)ofthissubsection. JJ. “Infant”meansachildagesixweeksto12months. KK. “License”meansadocumentissuedbyCYFDtoachildcarefacilitylicensedandgovernedbytheseregulationsandgrantingthelegalrighttooperateforaspecifiedperiodoftime,nottoexceedoneyear. LL. “Licensee”meanstheperson(s)who,ororganizationwhich,hasownership,leasehold,orsimilarinterestinthechildcarefacilityandinwhosenamethelicenseforthechildcarefacilityhasbeenissuedandwhoislegallyresponsibleforcompliancewiththeseregulations. MM. “Licensingauthority”meansthechildcareservicesbureau-licensingsectionoftheearlychildhoodservicesdivisionoftheNewMexicochildren,youthandfamiliesdepartmentwhichhasbeengrantedtheresponsibilityfortheadministrationandenforcementoftheseregulationsbyauthorityofChildren,YouthandFamiliesDepartmentAct,Section9-2A-1to9-2A-16NMSA1978,asamended. OO. “Nationalaccreditationstatus”meanstheachievementandmaintenanceofaccreditationstatusbyanaccreditingbodythathasbeenapprovedbyCYFD.Todetermineapprovalofnationalaccreditingbodies,thefollowingstandardsareused:forcenterbasedprograms,CYFDusesthe2007nationalassociationfortheeducationofyoungchildren(NAEYC)programstandardsandaccreditationcriteriaaswellasNAEYC’s2007accreditationprocesscriteria;forfamilychildcare,CYFDusestheCYFDfamilychildcareaccreditationstandards;forbeforeandafterschoolcare,CYFDusestheCYFDbeforeandafterschoolaccreditationstandards. 8.16.2.10 LICENSINGAUTHORITY(ADMINISTRATIONANDENFORCEMENTRESPONSIBILITY):Thechildcareservicesbureau,licensingsection,oftheearlychildhoodservicesdivisionoftheNewMexicochildren,youthandfamiliesdepartment,hereaftercalledthelicensingauthority,hasbeengrantedtheresponsibilityfortheadministrationandenforcementoftheseregulationsbyauthorityofChildren,YouthandFamiliesDepartmentAct,Section9-2A-1to9-2A-16,NMSA1978,asamended.

8.16.2.11 LICENSING:
A. TYPESOFLICENSES:
(1) ANNUALLICENSE:Anannuallicenseisissuedforaone-yearperiodtoachildcarefacilitythathasmetallrequirementsoftheseregulations.

(a) 1-starlevelrequiresmeetingandmaintaininglicensingrequirementsatalltimes,exceptfortherequirementsoutlinedinthefollowingitems:Items(i),(ii)and(iii)ofSubparagraph(a)ofParagraph(1)ofSubsectionAof8.16.2.11NMAC.1-starlevelisdesignatedforprogramsnotreceivingchildcaresubsidy.All1-stareducatorsreceivingsubsidyandlicensedatthetimeofpublicationoftheserulesshallhaveuntilJuly1,2012tomeet2-starrequirementsincludedinthefollowingsectionsoftheseregulations:

(f) 5-starlevelisvoluntaryandrequiresmeetingandmaintaininglicensingrequirements,FOCUSlevels3,4and5qualitycriteriaatalltimesandmaintainingCYFDapprovednationalaccreditationstatus.
(2) TEMPORARYLICENSE:Thelicensingauthoritywill,atitsdiscretion,issueatemporarylicensewhenitfindsthechildcarefacilityinpartialcompliancewiththeseregulations.
(a) Atemporarylicensecan,atthediscretionofthelicensingauthority,beissuedforupto120days,duringwhichtimethechildcarefacilitywillcorrectallspecifieddeficiencies.
(b) Thelicensingauthoritywillnotissuemorethantwoconsecutivetemporarylicenses.

(c) Afterasecondtemporarylicensehasbeenissued,anewapplicationandtherequiredapplicationfeemustbesubmittedwithin30daysinordertorenewthelicensefortheremainderofthatoneyearperiod.
(3) AMENDEDLICENSE:Achildcarefacilitywillsubmitanewnotarizedapplicationtothelicensingauthoritybeforemodifyinginformationrequiredtobestatedonthelicense.Examplesofsuchmodificationsincludedates,capacity,directorandnumberofstars.
(a) Achildcarefacilitywillapplytothelicensingauthorityforanamendedlicenseinordertochangethedirector.Thechildcarefacilitymustnotifythelicensingauthoritywithin24hoursafterthechildcarefacilitybecomesawareoftheneedtonameanewdirector,submitanapplication(Fee$20)and,ifnecessary,appointatemporaryactingdirectorwiththeminimumrequirementsofahighschooldiplomaorGEDandthreeyearsofexperience.Thetemporaryactingdirector’sappointmentisvalidfor90days.
(b) Anotarizedapplicationmustbesubmittedforachangeofcapacity(Fee$20).Applicationforanincreaseordecreaseofcapacitywillnotbeapprovednoranamendedlicenseissueduntilanon-sitevisithasbeenmadebythelicensingauthoritytodeterminethatthechildcarefacilitymeetsallapplicablecodesandregulations.Achildcarefacilitymustnotacceptadditionalchildrenorchangethelayoutofthechildcarefacilityuntilthelicensingauthorityhasapprovedandissuedtheamendedlicense.
(c) Achildcarefacilitywillapplytothelicensingauthorityforanamendedlicenseinordertochangethenumberofstars.Anapplicationforadifferentstarlevelwillnotbeapprovednoranamendedlicenseissueduntilon-sitevisitshavebeenmadeandithasbeendeterminedthatthechildcarefacilitymeetsallapplicablecriteria.
(4) PROVISIONAL2-STARLICENSE:Newlylicensedprogramsreceivingchildcaresubsidywillbegivenaprovisional2-starlicenseforuptothreemonths,pendingobservationbythelicensingauthorityoftheinteractionsbetweenteachersandchildrenintheclassrooms.
B. RENEWALOFLICENSE:
(1) Alicenseewillsubmitanotarizedrenewalapplication,indicatingthenumberofstarsrequested,onformsprovidedbythelicensingauthority,alongwiththerequiredfee,atleast30daysbeforeexpirationofthecurrentlicense.CYFD-approvednationallyaccreditedcenters,homesandoutofschooltimeprogramswillsubmitcopiesoftheircurrentaccreditationcertificatesalongwiththeirrenewalapplication.Applicationspostmarkedlessthan30dayspriortotheexpirationdatewillbeconsideredlateanda$25latefeemustbesubmittedwiththerenewalfee.
(2) Alllicensedfacilitiesmustmaintainanoriginalbackgroundcheckeligibilityletterforallcurrentemployeesandapplicablevolunteers,includingasignedstatementannuallybyeachstaffpersoncertifyingthattheywouldorwouldnotbedisqualifiedasadirectproviderofcareunderthe

mostcurrentversionofthebackgroundchecksandemploymenthistoryverificationprovisionspursuantto8.8.3NMAC.Thiswillincludealladultsandteenagechildrenlivinginafamilychildcareorgroupchildcarehomeoperatedinaprivateresidence.Theteenagechild’sguardianshallsigntheannualstatementonbehalfoftheteenagechild.
(3) Uponreceiptofanotarizedrenewalapplication,therequiredfeeandthecompletionofanon-sitesurvey,thelicensingauthoritywillissueanewlicenseeffectivethedayfollowingthedateofexpirationofthecurrentlicense,ifthechildcarefacilityisincompliancewiththeseregulations.
(4) Ifalicenseefailstosubmitanotarizedrenewalapplicationwiththerequiredfeebeforethecurrentlicenseexpires,thelicensingauthoritymayrequiretheagencytoceaseoperationsuntilalllicensingrequirementsarecompleted.
C. POSTINGOFLICENSE:Achildcarefacilitywillpostthelicenseonthelicensedpremisesinanareareadilyvisibletoparents,staffmembers,andvisitors.
D. NON-TRANSFERABLERESTRICTIONSOFLICENSE:Alicenseewillnottransferalicensebyassignmentorotherwisetoanyotherpersonorlocation.Thelicensewillbevoidandthelicenseewillreturnittothelicensingauthoritywhen:
(1) theownerofthechildcarefacilitychanges;
(2) thechildcarefacilitymoves;
(3) thelicenseeofthechildcarefacilitychanges;or
(4) thechildcarefacilitycloses.
E. AUTOMATICEXPIRATIONOFLICENSE:Alicensewillexpireautomaticallyatmidnightontheexpirationdatenotedonthelicenseunlessearliersuspendedorrevoked,or:
(1) onthedayachildcarefacilitycloses;
(2) onthedayachildcarefacilityissold,leased,orotherwisechangesownershiporlicensee;
(3) onthedayachildcarefacilitymoves.
F. ACCREDITEDPROGRAMS:AccreditedprogramsmustmeetandmaintainalllicensingstandardsandtheirCYFD-approvednationalaccreditationwithoutalapseinordertobedesignatedasa5-starfacility.Thelicensingauthoritymay,atitsoption,notifytheprogram’saccreditingbodyoftheprogram’sfailuretomeetandmaintainlicensingstandards.

8.16.2.12 LICENSINGACTIONSANDADMINISTRATIVEAPPEALS:
A. Thelicensingauthoritymayrevoke,suspend,orrestrictalicense,reducestarstatus,denyaninitialorrenewallicenseapplication,imposemonetarysanctionspursuantto7.1.8NMAC,putinplaceconditionsofoperation,imposeothersanctionsorrequirementsagainstalicensee,orreducetoabaselevelofchildcareassistancereimbursementalicenseewhoisinreceiptofahigherthanbaselevelofchildcareassistancereimbursement,foranyofthefollowingreasons:
(1) violationofanyprovisionoftheseregulations,especiallywhenthelicensingauthorityhasreasontobelievethatthehealth,safetyorwelfareofachildisatrisk,orhasreasontobelievethatthelicenseecannotreasonablysafeguardthehealthandsafetyofchildren;
(2) failuretoallowaccesstothelicensedpremisesbyauthorizedrepresentativesofthelicensingauthority;
(3) misrepresentationorfalsificationofanyinformationonanapplicationformoranyotherformorrecordrequiredbythelicensingauthority;
(4) allowinganypersontobeactiveinthechildcarefacilitywhoisorwouldbedisqualifiedasadirectproviderofcareunderthemostcurrentversionofthebackgroundchecksandemploymenthistoryverificationprovisionspursuantto8.8.3NMAC;thiswillincludealladultsandteenagedchildrenlivinginafamilychildcareorgroupchildcarehomeoperatedinaprivateresidencewhetherornottheyareactiveinthechildcareoperation;
(5) failuretotimelyobtainrequiredbackgroundchecks;
(6) failuretoproperlyprotectthehealth,safetyandwelfareofchildrenduetoimpairedhealthorconductorhiringorcontinuingtoemployanypersonwhosehealthorconductimpairstheperson’sabilitytoproperlyprotectthehealth,safety,andwelfareofthechildren;
(7) allowingthenumberofchildreninthechildcarefacilitytoexceeditslicensedcapacity;
(8) substantiatedabuseorneglectofchildrenbyaneducator,staffmember,volunteer,orhouseholdmemberasdeterminedbyCYFDoralawenforcementagency;
(9) failuretocomplywithprovisionsoftheotherrelatedregulationslistedintheseregulations;
(10) discoveryofrepeatviolationsoftheregulationsorfailuretocorrectdeficienciesofsurveyfindingsincurrentorpastcontiguousornoncontiguouslicensureperiods;

(11) discoveryofpriorrevocationsorsuspensionsthatmaybeconsideredwhenreviewingafacility’sapplicationforlicensureorlicenserenewal;
(12) lossofaccreditation,regardlessofreason,willresultinareductioninstarstatus;
(13) possessingorknowinglypermittingnon-prescriptioncontrolledsubstancesorillegaldrugstobepresentorsoldonthepremisesatanytime,regardlessofwhetherchildrenarepresent;
(14) makingfalsestatementsorrepresentationstothelicensingauthoritywiththeintenttodeceive,whichthelicenseeknows,orshouldknowtobefalse;or
(15) backgroundclearancesuspensionordenial.
B. Commencementofachildren,youthandfamiliesdepartmentorlawenforcementinvestigationmaybegroundsforimmediatesuspensionoflicensurependingtheoutcomeoftheinvestigation.Uponreceiptofthefinalresultsoftheinvestigation,thedepartmentmytakesuchfurtheractionasissupportedbytheinvestigationresults.
C. Asuspension,revocation,orconditionsofoperationsimposedpursuanttoPartAofthisSectionmaytakeeffectimmediatelyifinthediscretionofthedepartmentthatthehealth,safetyorwelfareofachildisatrisk,orhasreasontobelievethatthecaregivercannotreasonablysafeguardthehealthandsafetyofchildren.
D. Thechildren,youthandfamiliesdepartmentnotifiesthelicenseeinwritingofanyactiontakenorcontemplatedagainstthelicense/licensee.Thenotificationshallincludethereasonsforthedepartment’saction.
E. Thelicenseemayobtainadministrativereviewofanyactiontakenorcontemplatedagainstthelicense/licensee.
F. Theadministrativereviewshallbeconductedbyahearingofficerappointedbythedepartment’ssecretary.
G. Iftheactionistotakeeffectimmediately,thedepartmentaffordsthelicenseetheopportunityforanadministrativeappealwithinfiveworkingdays.Ifthelicenseissuspendedpendingtheresultsofaninvestigation,thelicenseemayelecttopostponethehearinguntiltheinvestigationhasbeencompleted.
H. Ifaftertheimpositionofanimmediatesuspensionthedepartmenttakesadditionalactionsincludingadditionalsuspension,revocation,orconditionsofoperations,theimmediateactionwillstayineffectuntilthefollowingactiongoesintoeffectoranappealofthefollowingactionisconcludedandtheactioniseitherupheldoroverturned.

I. Ifthecontemplatedactiondoesnottakeimmediateeffect,andthelicenseeisgivenadvancenoticeofthecontemplatedaction,thelicenseeisallowed10workingdaysfromdateofnoticetorequestanadministrativeappeal.
J. IncircumstancesinwhichPublicHealthActNMSA1978SubsectionNofSection24-1-5(2005)mayapply,andinwhichotherprovisionsofthisregulationarenotadequatetoprotectchildrenfromimminentdangerofabuseorneglectwhileinthecareofalicensee,theprovisionsofSubsectionNofSection24-1-5shallapplyasfollows.
(1) Thedepartmentshallconsultwiththeowneroroperatorofthechildcarefacility.
(2) Uponafindingofprobablecause,thedepartmentshallgivetheowneroroperatornoticeofitsintenttosuspendoperationofthechildcarefacilityandprovideanopportunityforahearingtobeheldwithinthreeworkingdays,unlesswaivedbytheowneroroperator.
(3) Withinsevenworkingdaysfromthedayofnotice,thesecretaryshallmakeadecision,and,ifitisdeterminedthatanychildisinimminentdangerofabuseorneglectinthechildcarefacility,thesecretarymaysuspendoperationofthechildcarefacilityforaperiodnotinexcessof15days.
(4) Priortothedateofthehearing,thedepartmentshallmakeareasonableefforttonotifytheparentsofchildreninthechildcarefacilityofthenoticeandopportunityforhearinggiventotheowneroroperator.
(5) Nolaterthantheconclusionofthe15dayperiod,thedepartmentshalldeterminewhetherotheractioniswarrantedunderthisregulation.
(6) NothinginSubsectionJof8.16.2.12NMACshallbeconstruedtorequirelicensurethatisnototherwiserequiredinthisregulation.
K. Thelicensingauthoritymayrequireadirectproviderofcaretoundergoanadditionalbackgroundcheckifinformationshowsanyofthefollowing:
(1) thatthedirectproviderofcarehaspendingchargesforanycriminaloffense;
(2) thatthedirectproviderofcarehasapendingorsubstantiatedCYFDprotectiveservicesorjuvenilejusticeservicereferral;
(3) thatthedirectproviderofcarehasanycriminalhistoryorhistoryofareferraltoCYFDprotectiveservicesorjuvenilejusticeservicesdiscoveredafterthemostrecentbackgroundcheck;or
(4) thatthedirectproviderofcareisthesubjectofanallegationofabuseandneglectinanylicensedfacility.

L. Thereshallbenorighttoadministrativereviewforreductioninstarlevelresultingfromlossof,orfailuretomaintain,nationalaccreditationstatus.Thelicenseeshallbeboundbytherules,regulations,policiesandproceduresimplementedbythenationalaccreditationbodythatgovernsitsaccreditationprocess.
M. Thelicenseeshallnotifythelicensingauthoritywithin48hoursofanyadverseactionbythenationalaccreditationbodyagainstthelicensee’snationalaccreditationstatus,includingbutnotlimitedtoexpiration,suspension,termination,revocation,denial,nonrenewal,lapseorotheractionthatcouldaffectitsnationalaccreditationstatus.Thelicensingauthorityshallreducethestarlevelofaprovidergrantednationalaccreditationstatusbythedepartmenttostarlevel2untilthelicenseeregainsnationalaccreditationstatus,oruntilthefacilitycanbeverifiedatalevelhigherthanstarlevel2.IfaproviderholdingaccreditationfromanaccreditingbodynolongerapprovedbyCYFDfailstomaintaintheserequirements,thiswillresultintheproviderreimbursementrevertingtothebasereimbursementrate.TheprovidermayincreasetheirstarlevelonlybymeetingFOCUScriteriaorbyattainingCYFDapprovednationalaccreditationstatus.Childcaresubsidiesshallbeadjustedtocorrespondwithanyreductionsorincreasestostarlevel.

8.16.2.13 CIVILMONETARYPENALTIES:
A. Thefollowingfactorsshallbeconsideredbythelicensingauthoritywhendeterminingwhethertoimposecivilmonetarypenalties:
(1) deathorseriousinjurytoachild; (2) abuse,neglectorexploitationofachild; (3) regulatoryviolationswhichimmediatelyjeopardizethehealthandsafetyofachild; (4) numerousviolations,whichcombined,jeopardizethehealthandsafetyofachild; (5) repetitiveviolationsofthesamenaturefoundduringtwoormoreconsecutiveon-sitevisitsorsurveysofachildcarefacility; (6) failureofachildcarefacilitytocorrectviolationsfoundduringprevioussurveysorvisits; (7) intentionalmisrepresentationregardingconditionofthefacility; (8) effectofacivilmonetarypenaltyonfinancialviabilityofthefacility;or (9) extenuatingcircumstances,whichallowthelicensingauthoritygreaterdiscretiontoconsiderbothmitigatingandexacerbatingcircumstancesnotspecificallydefined. B. Aninitialbasepenaltyamountisassessedwhenacivilmonetarypenaltyisimposed.Thebasepenaltyamountiscalculatedattherateofthemostseriousdeficiency.Forexample,thebasepenaltyamountisassessedattherateapplicabletoaclassAdeficiencywhenthesurveyorinvestigationresultsincitationofregulatoryviolationscomprisingclassA,classB,andclassCdeficiencies,becausethemostseriousregulatoryviolationistheclassAdeficiency.Thebasepenaltyis

assessedonceforthedeficienciescitedbythelicensingauthorityduringanyparticularsurveyorinvestigation.
C. Thelicensingauthorityhasthediscretiontoimposeaninitialbasepenaltyatanyamountwithintherangeforeachdeficiencylevel.
(1) ClassAdeficiency:notlessthan$500andnotgreaterthan$5,000. (2) ClassBdeficiency:notlessthan$300andnotgreaterthan$3,000. (3) ClassCdeficiency:notlessthan$100andnotgreaterthan$500.[8.16.2.13NMAC-Rp,8.16.2.13NMAC,10/1/16]
8.16.2.14 WAIVERS:
A. 8.16.2.15 VARIANCES-CURRENTLYLICENSEDFACILITIES:
A. Ifachildcarefacilitylicensedonthedatetheseregulationsarepromulgatedprovidestheservicesprescribedbutfailstomeetallbuildingrequirements,thelicensingauthoritywillgrantavariance,providedthatthevariancesgranted: (1) willnotcreateahazardtothehealth,safety,orwelfareofchildrenandstaffmembers;and (2) isforbuildingrequirementsthatcannotbecorrectedwithoutanunreasonableexpensetothechildcarefacility. B. VariancesgrantedwillcontinueinforceaslongasthechildcarefacilitycontinuestoprovideservicespursuanttotheseregulationsandwillnotviolatethecriteriaofSubsectionAofthissection. C. Thelicensingauthoritywillgrantavarianceforthoserequirementscontainedin8.16.2.8NMACrelatedregulationsandcodesifthelicenseeprovideswrittendocumentationfromthe

8.16.2.16 VARIANCES-NEWCHILDCAREFACILITY:Anewchildcarefacilitymaybelocatedinanexistingbuildingoranewlyconstructedbuilding.
A. Ifopenedinanexistingbuilding,thelicensingauthoritymaygrantavarianceforthosebuildingrequirementsthechildcarefacilitycannotmeetprovidedanyvarianceisnotinconflictwithexistingbuildingandfirecodes. B. Anewchildcarefacilityopenedinanewlyconstructedbuildingwillmeetallrequirementsoftheseregulations. C. Thelicensingauthoritywillmakeallvariancesgrantedapermanentpartofthechildcarefacilityfile. D. Thelicensingauthoritymaygrantavarianceforthoserequirementscontainedin8.16.2.8NMACrelatedregulationsandcodesifthelicenseeprovideswrittendocumentationfromtherelevantauthorityidentifiedintheseregulationsthatthelicenseecomplieswiththoserequirementsorhasbeengrantedawaiverorvariancefromthem.[8.16.2.16NMAC-Rp,8.16.2.16NMAC,10/1/16]
8.16.2.17 SURVEYSFORCHILDCAREFACILITIES:
A. Thelicensingauthoritywillconductasurveyatleasttwiceayearineachchildcarefacilityusingtheseregulationsascriteria.Thelicensingauthoritywillconductadditionalsurveysorvisitthechildcarefacilityadditionaltimestoprovidetechnicalassistance,tocheckprogressoncorrectionofdeficienciesfoundonprevioussurveys,ortoinvestigatecomplaints. B. Uponthecompletionofasurvey,thelicensingauthoritywilldiscussthefindingswiththelicenseeortheirrepresentativeandwillprovidethechildcarefacilitywithanofficialwrittenreportofthefindingsandarequestforaplanorplansofcorrection,ifappropriate. C. Thelicensee,director,oroperator,willsubmitwithin10workingdaysafterthedateofthesurvey,acorrectiveactionplantothelicensingauthorityfordeficienciesfoundduringthesurvey.Thecorrectiveactionplanwillbespecificonhowandwhenthechildcarefacilitywillcorrectthedeficiencyordeficiencies. D. Thelicensingauthoritymayacceptthecorrectiveactionplanaswrittenorrequiremodificationsoftheplan. E. Byapplyingforeitheranewlicenseoralicenserenewal,thelicenseegrantsthelicensingauthorityrepresentativetherighttoenterthepremisesandsurveythechildcarefacility,includinginspectionandcopyingofchildcarefacilityrecords,bothwhiletheapplicationisbeingprocessedand,iflicensed,atanytimeduringthelicensureperiod.

F. Thelicensingauthoritymayormaynotannounceasurvey.Atalltimes,apersonwhoisknowledgeableinthedailyoperations,hasaccesstoallrecordsandlockedareas,andcanrepresentthelicenseeordirectorforsurveypurposeswillbepresentinthechildcarefacility.[8.16.2.17NMAC-Rp,8.16.2.17NMAC,10/1/16]
8.16.2.18 COMPLAINTS:
A. Thelicensingauthoritywillprocessanycomplaintregardinganychildcarefacilitylicensedorrequiredtobelicensedundertheseregulations.Theinvestigatoryauthorityofthelicensingauthorityislimitedtomatterspertainingtotheseregulations. B. Alicensingauthorityrepresentativereceivingcomplaintswillaskcomplainantstoidentifythemselvesandprovideallinformationnecessarytodocumentthecomplaint. C. Thelicensingauthoritywillinvestigateanycomplaintinwhichthehealth,safety,orwelfareofachildcouldbeindanger.Thecomplaintwillbereviewedandprioritizedimmediatelyaccordingtothenatureandseverityofthecomplaint.Thelicensingauthorityfollowsestablishedprotocolsandproceduresforprioritizing,tracking,initiatingandreportingofcomplaintsandcomplaintinvestigations.Complaintswillbeinvestigatedinatimelymannerasfollows. (1) Priority1complaints:investigationwillbeinitiatedwithin24hours. (2) Priority2complaints:investigationwillbeinitiatedwithinthreeworkingdays. (3) Priority3complaints:investigationwillbeinitiatedwithinfiveworkingdays. (4) Initiationtimeframesforinvestigationsmaybeshortenedbasedontheseverityandnatureofthecomplaint,buttimeframesmaynotbeextended. D. Thelicenseeshallcooperateingoodfaithwithanyinvestigationbythelicensingauthority.Obstructionofaninvestigationmaysubjectthelicenseetosanctions,uptorevocation. E. Actionbythelicensingauthority: (1) Thelicensingauthoritywillprovideawrittenletterontheresultsoftheinvestigationtoboththelicenseeofthechildcarefacilitythatisthesubjectofthecomplaintandthecomplainant. (2) Ifthelicensingauthorityfindsthecomplaintisunsubstantiated,itwillbesodesignatedandthelicensingauthoritywilltakenofurtheraction. (3) Ifthelicensingauthorityfindsthatacomplaintissubstantiated,itwillmakethecomplaintpartofthelicensingauthority’sfileonthechildcarefacility.Thefollowingadditionalactionswill,atthediscretionofthelicensingauthority,betaken: (a) thelicensingauthoritywillrequirethechildcarefacilitytosubmitandcomplywithawrittencorrectiveactionplan;or (b) thelicensingauthoritywillsanctionthechildcarefacilityadministrativelyincluding,withoutlimitation,suspension,revocation,orrestrictionofalicense;or (c) thelicensingauthoritywillfilecriminalchargesorpursuecivilremedies. F. Thelicensingauthoritywillreportallcasesofsuspectedchildabuseandneglecttobothchildren’sprotectiveservicesandthelocallawenforcementagency.

8.16.2.30 FAMILYCHILDCAREHOMEANDGROUPCHILDCAREHOMEREGULATIONS:APPLICABILITY:Aprivatedwellingrequiredtobelicensedunderregulationsin8.16.2.31NMACthrough8.16.2.38NMACwhichmeetsoneofthefollowingcriteria.
A. Familychildcarehome-Aprivatedwellingrequiredtobelicensedpursuanttotheseregulationswhichprovidescare,services,andsupervisiontoatleastfivebutnomorethansixchildrenforaperiodoflessthan24hoursofanyday.Thelicenseewillresideinthehomeandbetheprimaryeducator.Afamilydaycarehomeintendingtoprovidecareformorethantwobutnottoexceedfourchildrenundertheageoftwomustbespecificallylicensedforthispurpose.

8.16.2.31 LICENSUREREQUIREMENTSFORHOMES:
A. LICENSINGREQUIREMENTS:

(1) APPLICATIONFORM:Anapplicantwillcompleteanapplicationformprovidedbythelicensingauthorityandincludepaymentforthenon-refundableapplicationfee.Applicationswillberejectedunlessallsupportingdocumentsarereceivedwithinsixmonthsofthedateindicatedontheapplication.A45dayextensionwillbegrantedifthelicenseeprovidesdocumentationtothelicensingauthoritythatdocumentsweresubmittedtotheappropriateagenciesinatimelymannerbut,throughnofaultoftheirown,theyhavenotreceivedresponsesfromtheseagencies.
(2) Ahomewillsubmitanewapplicationtothelicensingauthoritybeforechanginganythingrequiredtobestatedonthelicensesuchasdates,capacity,operator,oraddress.
(3) BACKGROUNDCHECK:Inadditiontothebasicrequirementsat8.16.2.19NMACofthegeneralprovisionsanapplicantwillapplyforanationalcriminalrecordscheck.Thelicensingauthoritywillprovideacopyofthemostcurrentversionofthedepartment’sbackgroundcheckandemploymenthistoryverificationprovisions(8.8.3NMAC),regulations,fingerprintinstructions,andformsforrecordinganemploymenthistory.Thelicenseewillberesponsibleforobtainingbackgroundchecksonallstaffmembers,educators,volunteers,andprospectivestaffmembers,educators,volunteers,anypersonwhomayhaveunsupervisedphysicalaccesstochildren,andalladultsresidinginthehomeaspertherequirementsoutlinedinthedepartment’smostcurrentversionofthebackgroundcheckandemploymenthistoryverificationprovisions.Allrequirementsofthecurrentbackgroundcheckandemploymenthistoryverificationprovisionspursuantto8.8.3NMACmustbemetpriortotheissuanceofaninitiallicense.Arequestforabackgroundcheckmustbesubmittedpriortoastaffmember’semployment.Abackgroundcheckmustbeconductedinaccordancewith8.8.3NMACatleastonceeveryfiveyearsonallrequiredindividuals.
(4) ZONINGANDOTHERAPPROVALS:Anapplicantwillhave: (a) currentwrittenzoningapprovalfromtheappropriatecity,countyorstateauthority; (b) currentwrittenapprovalofthestatefiremarshalofficeorotherappropriatecity,countyorstatefire-preventionauthorityifapplicable; (c) currentwrittenapprovalfromtheNewMexicoenvironmentdepartmentorotherenvironmentalhealthauthorityfor:1)Privatewatersupply,ifapplicable;2)Privatewasteorsewagedisposal,ifapplicable;and3)Aswimmingpool,ifapplicable. (5) SCHEDULE:Allapplicationsforanewlicensewillincludeadescriptionofthehome’sproposedactivitiesandschedule. (6) INITIALSURVEY:Thelicensingauthoritywillscheduleasurveyforahomewhenitreceivesacompleteapplicationwithallsupportingdocuments. B. CAPACITYOFAHOME: (1) Thenumberofchildreninahome,eitherintotalorbyage,willnotexceedthecapacitystatedonthelicense. (2) Thelicensingauthoritywillcountallchildreninthecareofthelicensedhome,includingtheeducator’sownchildrenundertheageofsix,inthecapacityofahome,evenifthe

childrenareonafieldtriporotheroutingoutsidethehome.Thelicensedcapacitymustnotbeexceededbythepresenceofschoolagechildren. (3) Ahomemaybelicensedforupto12children. (4) Ahomelicensedasafamilydaycarehomeundertheseregulationsprovidingcareforamaximumcapacityofsixchildrenmaycareforuptofourchildrenundertheageoftwoprovidingasecondeducatorispresentinthehomeandthehomeislicensedtoprovidesuchcare.Ahomelicensedasagroupdaycarehomeundertheseregulationsprovidingcareforamaximumof12childrenmaycareforuptofourchildrenunderagetwoprovidingasecondeducatorispresentinthehomeandthehomeislicensedtoprovidesuchcare. (5) Ahomemusthave35squarefeetofactivityandsleepingspaceperchild,excludingbathrooms,kitchens,hallsandotherbuilt-infixturesandoffsets,withtotalcapacitylimitedtonomorethan12children.Ahomemusthaveatleastonebathroomwithatoiletandsink.Forahomelicensedfornomorethansixchildren,oneactivityroomwillbemeasured.Forahomelicensedfor12children,nomorethantworoomswillbemeasured. (6) Thehomewillhaveanoutdoorplayarea,whichmustbefencedin. C. INCIDENTREPORTINGREQUIREMENTS: (1) Thelicenseewillreporttotheappropriateauthoritiesthefollowingincidents.Aftermakingareporttotheappropriateauthorities,thelicenseeshallnotifythelicensingauthorityoftheincidentgivingrisetoitsreportassoonaspossiblebutnolaterthan24hoursaftertheincidentoccurred.Areportshouldfirstbemadebytelephoneandfollowedwithwrittennotification.Thelicenseeshallreportanyincidentthathasthreatenedorcouldthreatenthehealthandsafetyofchildrenandstaffmembers,suchas,butnotlimitedto: (a) alostormissingchild; (b) aseriousinjury; (c) theabuseorneglectofachild; (d) fire,flood,orothernaturaldisasterthatcreatesstructuraldamagestoahomeorposesahealthhazard; (e) anyoftheillnessesonthecurrentlistofnotifiablediseasesandcommunicablediseasespublishedbytheofficeofepidemiologyoftheNewMexicodepartmentofhealth; (f) anylegalactionagainstahome,householdmember,orstaffmembers; (g) anyincidentthatcouldaffectthebackgroundcheckeligibilityofanyclearedpersonrelatedtothislicense; (h) theuseofphysicalormechanicalrestraints,unlessduetodocumentedemergenciesormedicallydocumentednecessity;or (i) anyknownchangeinaneducator’shealthconditionoruseofmedicationthatimpairshisorherabilitytoprovideforthehealth,safetyorwelfareofchildrenincare. (2) Ahomewillnotifyparentsorguardiansinwritingofanyincident,includingnotifiableillnesses,thathasthreatenedthehealthorsafetyofchildreninthehome.Incidentsinclude,butarenotlimitedto,thoselistedinParagraph(1)ofSubsectionCof8.16.2.31NMAC.

8.16.2.32 ADMINISTRATIVEREQUIREMENTSFORHOMES:
A. ADMINISTRATIVERECORDS:Alicenseewillpostthechildcarehomelicenseinanareareadilyvisibletoparentsandvisitors.Thelicenseewillalsokeeponfile:
(1) alllicenses,certificates,andmostrecentinspectionreportsofallstateandlocalgovernmentagencieswithjurisdictionoverthehome; (2) thecurrentchildcareregulations; (3) theguidancepolicy; (4) thecurrentlistofnotifiablediseasesandcommunicablediseasespublishedbytheofficeofepidemiologyoftheNewMexicodepartmentofhealth;and (5) anuptodateemergencyevacuationanddisasterpreparednessplan,whichshallincludestepsforevacuation,relocation,shelter-in-place,lock-down,communication,reunificationwithparents,individualplansforchildrenwithspecialneedsandchildrenwithchronicmedicalconditions,accommodationsofinfantsandtoddlers,andcontinuityofoperations.Theplanshallbeapprovedannuallybythelicensingauthorityandthedepartmentwillprovideguidanceondevelopingtheseplans. B. MISSION,PHILOSOPHYANDCURRICULUMSTATEMENT:Alllicensedfacilitiesmusthavea: (1) missionstatement; (2) philosophystatement;and (3) curriculumstatement. C. (e) acopyofthechild’sup-to-dateimmunizationrecordorapublichealthdivision-approvedexemptionfromtherequirement.Agraceperiodofamaximumof30dayswillbegrantedforchildreninfostercareorhomelesschildrenandyouth; (f) arecordofanyaccidents,injuriesorillnessesthatrequirefirstaidormedicalattentionandanyobservationsofrecentbruises,bitesorpotentialsignsofabuseorneglect,bothofwhichmustbereportedtoaparentorguardian; (g) writtenauthorizationfromthechild’sparentorguardiantoremoveachildfromthepremisestoparticipateinoff-siteactivities;authorizationmustcontainfieldtripdestination,dateandtimeoffieldtripandexpectedreturntimefromfieldtrip; (h) writtenauthorizationfromthechild’sparentorguardianfortheeducatortoapplysunscreen,insectrepellentand,ifapplicable,diapercreamtothechild; (i) arecordofthetimethechildarrivedandleftthehomeanddatesofattendanceinitialedbyaparent,guardian,orpersonauthorizedtopickupthechild; (j) anenrollmentagreementmustbesignedbyaparentorguardianwithanoutlineoftheservicesandthecostsbeingprovidedbythehome;and (k) asignedacknowledgementthattheparentorguardianhasreadandunderstandstheparenthandbook. (2) EMERGENCYINFORMATION: (a) informationonanyallergiesormedicalconditionssufferedbythechild; (b) thenameandtelephonenumberoftwopeopletocontactinthelocalareainanemergencywhenaparentorguardiancannotbereached;emergencycontactnumbersmustbekeptuptodateatalltimes. (c) thenameandtelephonenumberofaphysicianoremergencymedicalcenterauthorizedbyaparentorguardiantocontactincaseofillnessoremergency; (d) adocumentgivingahomepermissiontotransportthechildinamedicalemergencyandanauthorizationformedicaltreatmentsignedbyaparentorguardian;and (e) ifapplicable,legaldocumentationregardingthechild,includingbutnotlimitedto:restrainingorders,guardianship,powersofattorney,courtorders,andcustodybychildren’sprotectiveservices. E. PERSONNELRECORDS:Ahomewillkeepthefollowingrecordsonfileandmakethemavailabletothelicensingauthority. (1) Documentationofabackgroundcheckandemploymenthistoryverificationforallstaffmembersandalladultslivinginthehome.Abackgroundcheckmustbeconductedatleastonceeveryfiveyearsonallrequiredindividuals. (2) Anannualsignedstatementthatthestaffmemberwouldorwouldnotbedisqualifiedasadirectproviderofcareunderthemostcurrentversionofthebackgroundchecksandemploymenthistoryverificationprovisionspursuantto8.8.3NMAC. (3) Arecordofthetimethesecondeducatorsarrivedatandleftwork,toincludebreaksandlunch.

(4) Awrittenplanforongoingprofessionaldevelopmentforeacheducatorthatisbasedonthesevenareasofcompetency,consistentwiththecareerlattice,andbasedontheindividual’sgoals.Familychildcarehomeswhodonothaveemployeesareexemptedfromthisrequirement. F. PERSONNELANDSTAFFINGREQUIREMENTS: (1) Alicenseewillnotallowanystaffmember,includingthelicensee,oranyotheradultlivinginthehomeinvolvedinanincidentwhichwoulddisqualifythatstaffmemberorotheradultunderthedepartment’smostcurrentversionofthebackgroundcheckandemploymenthistoryverificationprovisionspursuantto8.8.3NMACtocontinuetoworkdirectlyorunsupervisedwithchildrenortoresideinthehome. (2) Allstaffmemberswilldemonstratetheabilitytoperformessentialjobfunctionsthatreasonablyensurethehealth,safetyandwelfareofchildrenincare. (3) Educatorswhoworkdirectlywithchildrenandwhoarecountedinthestaff/childratiosmustbe18yearsofageorolder. (4) Thelicenseeshallbeinthelicensedchildcarehomeduringatleastseventy-fivepercentofthehome’scorehoursofoperation. (5) Substitutes,volunteersandparttimesecondeducatorscountedinthestaff/childratiosshallmeetthesamerequirementsasregularstaffmembers,exceptfortrainingrequirements.Substitutesandparttimesecondeducatorsroutinelyemployedinthehomebutworking

(6) Ahomelicensedtoprovidecareforsixorfewerchildrenwillhaveatleastoneeducatorinthehomeatalltimes.Ahomelicensedtoprovidecareformorethantwochildrenundertheageoftwowillhaveatleasttwoeducatorsinthehomeatalltimes. (7) Ahomelicensedforsevento12childrenwillhaveatleasttwoeducatorsatthehomewhenmorethansixchildrenarepresentorwhenmorethantwochildrenundertheageoftwoarepresent. (8) Childrenwillneverbeleftunattended.Aneducatorwillbewiththechildrenatalltimeswhetheractivitiesareinsideoroutsideofthehome.Educatorswillbeonsite,availableandresponsivetochildrenduringallhoursofoperation. B. STAFFQUALIFICATIONSANDTRAINING: (1) Allneweducatorsregardlessofthenumberofhoursperweekwillcompletethefollowingtrainingwithinthreemonthsoftheirdateofhire.Allcurrenteducatorswillhavethreemonthstocomplywiththefollowingtrainingfromthedatetheseregulationsarepromulgated: (a) preventionandcontrolofinfectiousdiseases(includingimmunization); (b) preventionofsuddeninfantdeathsyndromeanduseofsafesleepingpractices; (c) administrationofmedication,consistentwithstandardsforparentalconsent; (d) preventionofandresponsetoemergenciesduetofoodorotherallergicreactions; (e) buildingandphysicalpremisessafety,includingidentificationofandprotectionfromhazardsthatcancausebodilyinjurysuchaselectricalhazards,bodiesofwater,andvehiculartraffic; (f) preventionofshakenbabysyndromeandabusiveheadtrauma; (g) emergencypreparednessandresponseplanningforemergenciesresultingfromanaturaldisaster,oraman-caused; (h) handlingandstorageofhazardousmaterialsandtheappropriatedisposalofbiocontaminants; (i) precautionsintransportingchildren(ifapplicable); (j) firstaidandcardiopulmonaryresuscitation(CPR)certification;and (k) recognitionandreportingofchildabuseandneglect. (2) Ahomewillkeepatraininglogonfileincludingthedateofthetraining,nameofeducator,hoursearned,subject/competencyarea,sourceoftraining,andtrainingcertificates. (3) Educatorsworkingforahomewillreceiveatleast12documentedhoursoftrainingduringeachyear,includingsixhoursinchildgrowthanddevelopmentandthreehoursinhealth,safety,nutrition,andinfectioncontrol.Thethreeremainingtraininghoursmustbewithinthesevencompetencyareas.Thecompetencyareasare:1)childgrowth,developmentandlearning;2)

health,safety,nutritionandinfectioncontrol;3)familyandcommunitycollaboration;4)developmentallyappropriatecontent;5)learningenvironmentandcurriculumimplementation;6)assessmentofchildrenandprograms;and7)professionalism.AneducatorcannotcountmorethanthreehoursinfirstaidorCPRtrainingtowardthetotalhoursrequired.OnlinefirstaidandCPRtrainingwillnotbeapproved.Forthispurpose,ayearbeginsandendsattheanniversarydateofemployment.TrainingmustbeprovidedbyindividualswhoareregisteredontheNewMexicotrainerregistry.On-linetrainingcoursesshallcountfornomorethaneighthourseachyear.Ifthe45-hourentrylevelcourseoritsequivalentistakenonline,itisexemptfromtheonlinetraininglimitation.Identicaltrainingsshallnotberepeatedforthepurposeofobtainingcredit.The12hoursofannualtrainingwillbewaivedforeducatorsifemployedbyaprogramcurrentlyunderFOCUSconsultation. (4) Infantandtoddlereducatorsmusthaveatleasttwohoursoftrainingininfantandtoddlercarewithinsixmonthsofstartingwork.Thetwohourswillcounttowardthe12-hourrequirementinParagraph(2). (5) Theprimaryeducatorwillcompletethe45-hourentrylevelcourseorapprovedthree-creditearlycareandeducationcourseoranequivalentapprovedbythedepartmentpriortoorwithinsixmonthsofemployment. (6) Ahomemusthavealleducatorscertifiedinfirstaidandcardio-pulmonaryresuscitation(CPR).[8.16.2.33NMAC-Rp,8.16.2.33NMAC,10/01/16]
8.16.2.34 SERVICESANDCAREOFCHILDRENINHOMES:
A. GUIDANCE:
(1) Ahomewillhavewrittenpoliciesandproceduresclearlyoutliningguidancepractices.Care-giverswillgivethisinformationtoallparentsandstaffwhowillsignaformtoacknowledgethattheyhavereadandunderstandthesepoliciesandprocedures. (2) Guidancewillbeconsistentandageappropriate. (3) Guidanceshallbepositiveandincluderedirectionandclearlimitsthatencouragethechild’sabilitytobecomeself-disciplined.Theuseofphysicalormechanicalrestraintsisprohibitedunlessduetodocumentedemergenciesormedicallydocumentednecessity. (4) Ahomewillnotusethefollowingdisciplinarypractices: (a) physicalpunishmentofanytype,includingshaking,biting,hitting,pinchingorputtinganythingonorinachild’smouth; (b) withdrawaloffood,rest,bathroomaccess,oroutdooractivities; (c) abusiveorprofanelanguage,includingyelling; (d) anyformofpublicorprivatehumiliation,includingthreatsofphysicalpunishment;or (e) unsupervisedseparation. B. NAPSORRESTPERIOD:

(1) Ahomewillprovidephysicalcareappropriatetoeachchild’sdevelopmentalneedsthatwillincludeasupervisedrestperiod. (2) Ahomeshallallowchildrenwhodonotsleeptogetupandparticipateinquietactivitiesthatdonotdisturbtheotherchildren. (3) Eachchildwillhaveanindividualbed,cot,ormat. (4) Cribs,cotsormatsshallbespacedatleast30inchesaparttopermiteasyaccessbyadultstoeachchild.Iftheroomusedforsleepingcannotaccommodate30inchesofspacingbetweenchildren,educatorsshallspacechildrenasfaraspossiblefromoneanother.Theremustbeenoughroomtopermiteasyaccesstoallchildrenwithoutmovingcribs,cotsormats.Cotsormatswillhaveanonabsorbent,cleanablesurface.Matswillbeatleastthree-fourthsofaninchthick.Matsandcotsshallbecleanedandlinensmustbelaunderedbeforebeingusedbyanotherchild. (5) Educatorsshallensurethatnothingcoversthefaceorheadofachildaged12monthsoryoungerwhenthechildislaiddowntosleepandwhilethechildissleeping.Educatorsshallnotplaceanythingovertheheadorfaceofachildover12monthsofagewhenthechildislaiddowntosleepandwhilethechildissleeping. (6) Childrenwithdisabilitiesormedicalconditionsthatrequireunusualsleepingarrangementswillhavewrittenauthorizationfromaparentorphysicianjustifyingthesleepingarrangement. (7) Illuminationequivalenttothatcastbyasoftnightlightshallbeoperationalinareasthatareoccupiedbychildrenwhoarenappingorsleeping. (8) Childrenshallbedirectlysupervisedduringnaptime. (9) Allchildrenshallsleepinthelicensedareaofthehome.Nochildrenshallbeallowedtosleepbehindcloseddoors. C. ADDITIONALREQUIREMENTSFORINFANTSANDTODDLERS: (1) Thehomewillprovideacribforeachinfantand,whenappropriate,foratoddler. (2) Cribswillmeetfederalstandardsandbekeptingoodrepair.Ahomewillnotuseplasticbagsorlightweightplasticsheetingtocoveramattressandwillnotusepillowsincribs. (3) Nochildwillbeallowedtosleepinaplaypen,carseat,strollerorswing. (4) Childrenundertheageof12monthsshallbeplacedontheirbackswhensleepingunlessotherwiseauthorizedinwritingbyaphysician. (5) Ahomewillnotadmitanychildundertheageofsixweeksexceptwiththewrittenapprovalofalicensedphysician. (6) Throughouttheday,aneducatorwillgiveeachinfantandtoddlerphysicalcontactandattention.Aneducatorwillhold,talkto,singtoandtakeinsideandoutsidewalkswiththechild.Aneducatorwillrespondimmediatelytoallcriesofinfantsandtothecriesofallchildrenwithintwominutes. (7) Aneducatorwilluseroutineactivitiessuchasnaptime,feeding,diaperingandtoiletingasopportunitiesforlanguagedevelopmentandotherlearning.

(8) Infantsshallnotbeallowedtobeconfinedtooneareaforprolongedperiodsoftimeunlesstheinfantiscontentandresponsive. (9) Ahomewillarrangethesleepingandplayareassothatchildrenintheplayareadonotdisturbsleepingchildren. (10) Infantsshalleitherbeheldorbefedsittingupforbottle-feeding.Infantsunabletositshallalwaysbeheldforbottle-feeding.Infantsandtoddlersshallnotbeplacedinalayingpositionwhiledrinkingbottlesorsippycups.Thecarryingofbottlesandsippycupsbyyoungchildrenthroughoutthedayornightshallnotbepermitted. (11) Eachinfantshallbeallowedtoformandobservehisorherownpatternoffeeding,sleeping,andwakingperiods. (12) Foodservedshallmeetthenutritionalneedsoftheinfantortoddler.Foodsshallbedevelopmentallyappropriateforeachinfantserved. D. DIAPERINGANDTOILETING: (1) Aneducatorwillplantoilettrainingwithaparentsothetoiletroutineisconsistent.Ahomewillnotattempttotoilettrainachildwhoisnotdevelopmentallyready. (2) Ahomewillchangewetandsoileddiapersandclothingpromptly.Staffmemberswillwearnon-porous,singleusegloveswhenchangingadiaperandwashtheirhandsafterchangingadiaper.Foodserviceglovesarenotpermissiblefordiaperchanging. (3) Ahomewillhaveasupplyofdry,cleanclothinganddiaperssufficienttomeettheneedsofthechild.Ahomewilllabeldiapersanddiaperingsuppliesforeachchildandstorethemseparately.Diaperbagswillbeinaccessibletochildren. (4) Aneducatorwillchangeachild’sdiaperonaclean,safe,waterproofsurfaceanddiscardanydisposablecoveranddisinfectthesurfaceaftereachdiaperchange.Soileddiapersshallbestoredinasecurecontainerwithatight-fittinglidtoassureproperhygieneandcontrolofodors. E. ADDITIONALREQUIREMENTSFORCHILDRENWITHSPECIALNEEDS: (1) Childcarefacilitiesareresponsibleforstaffawarenessofcommunityresourcesforfamiliesofchildrenwithdisabilities,includingchildrenundertheageoffiveyearsaswellasthoseofschoolage.Iffamilyorgrouphomeeducatorsbelievethatachildmayhaveadelayordisability,possibleresourcesforreferralandassistanceareprovidedtoparentswhenappropriate.Noreferralforspecialneedsservicestoanoutsideagencywillbemadewithoutaparent’sconsent.FamilyEducationRightandPrivacyAct(FERPA)willberespectedatalltimes. (2) ChildcarefacilitiesareresponsibleforstaffawarenessoftheAmericanswithDisabilitiesAct(ADA)asitrelatestoenrollingandcaringforchildrenwithdisabilities. F. NIGHTCARE:Inadditiontoallotherrequirements,ahomeprovidingnightcarewillhaveaneducatoronsite,physicallyavailableandresponsivetochildrenwhoneedattentionduringthenight. G. PHYSICALENVIRONMENT:
(1) Environmentshallbeorganizedintofunctionalidentifiablelearningareas.Familychildcarehomesthathavededicatedspaceshallhaveatleastfourofthefollowinglearning

(6) Examplesofchildren’sindividuallyexpressedartworkaredisplayedintheenvironmentatthechildren’seyelevel. (7) Floorsurfaceissuitableforactivitiesthatwilloccurineachlearningarea. (8) Fileandstoragespaceisavailableforeducators’materials. H. SOCIAL-EMOTIONALRESPONSIVEENVIRONMENT:
(1) Educatorsremaincalminstressfulsituations. (2) Educatorsareactivelyengagedwithchildren.Educatorstalk,activelylistenandrespondtochildrenappropriatelybyrespondingtochildren'squestionsandacknowledgingtheircomments,concerns,emotionsandfeelings. (3) Educatorshelpchildrencommunicatetheirfeelingsbyprovidingthemwithlanguagetoexpressthemselves. (4) Educatorsmodelappropriatesocialbehaviors,interactionsandempathy.Educatorsrespondtochildrenthatareangry,hurt,orsadinacaringandsensitivemanner.Educatorsmakeappropriatephysicalcontacttocomfortchildrenwhoaredistressed. (9) Full-timechildrenshallhaveaminimumof60minutesofphysicalactivitydaily,preferablyoutside.Parttimechildrenshallhaveaminimumof30minutesofphysicalactivitydaily,preferablyoutside. (10) Equipmentandprogramrequirementsapplyduringallhoursofoperationofthelicensedfacility. J. OUTDOORPLAY: (1) Outdoorplayequipmentusedinchildcarehomesshallbe: (a) intendedforpublic(non-residential)useandinstalledandmaintainedaccordingtothemanufacturer’sinstructions;or (b) ifintendedforresidentialuse,shallbesafeandsecurelyanchored. (2) Ahomewillenclosetheoutdoorplayareawithafenceatleastfourfeethighandwithatleastonelatchedgateavailableforanemergencyexit. (10) Ahomewillsanitizeeatingutensils,dishesandcupsbeforere-usebywashingtheminadishwasherorbycompletingthefollowingsteps:1)washwithsoapywater;2)rinsewithcleanwarmwater;and3)sanitize.

(11) Ahomewillusecleaningmaterialsforthekitchenandfoodpreparationareasonlyinthekitchenandwillstorethematerialsseparatelyfromfood. MEALTIMES: (1) Ahomewillequipdiningareaswithtables,chairs,eatingutensilsanddishesappropriatetotheageofthechildrenserved.Areaswillbesanitizedbeforeandaftereachuse. (1) Childrenandstaffmemberswillwashtheirhandswithsoapandwarmrunningwaterasneeded.Waterbasinsshallnotbeusedasanalternativetorunningwater.Staffandchildrenwillwashtheirhandswheneverhandsarecontaminatedwithbodyfluidsandalways:
(a) afterusingatoilet,assistingachildwithtoiletuse,orchangingadiaper; (b) beforeandaftercaringforasickchild; (c) beforeanyfoodserviceactivity,includingsettingthetable; (d) beforeandaftereatingorfeedingachild;and (e) afterhandlingpetsoranimalsoritemsusedbyanimalssuchaswaterandfoodbowls. (2) Ahomewilllabelwiththechild’snameandstoreseparatelyanyitemusedforanindividualchild’spersonalhygiene. B. FIRSTAIDREQUIREMENTS:
(1) Ahomewillkeepafirst-aidkitandafirst-aidmanualtogetherinthehomeinalocationinaccessibletochildrenandeasilyaccessibletoadults.Thefirstaidkitwillcontain,ataminimum:bandaids,gauzepads,adhesivetape,scissors,soap,non-porousgloves,andathermometer. (2) Ahomewilltreatbloodspillscautiouslyandpromptlydisinfectthearea.Staffmemberswillwearnon-porous,single-usegloveswhenhandlingabloodspill,bloodydiarrhea,bloodynose,oranyotherblood.Ahomewillcleancontaminatedsurfacesfirstwithhotsoapywaterthenwithadisinfectingsolution,whichiseffectiveagainstHIVandhepatitisB. (1) Ahomewillkeepallmedicationsinalockedandidentifiedcontainerinaccessibletochildrenandwillrefrigeratemedicationswhennecessary.Iftherefrigeratorisinaccessibletochildren,medicationsdonotneedtobeinalockedcontainerintherefrigerator. (2) Homeswillgivemedicationonlywithwrittenpermissionfromparentsorguardian,tobeadministeredaccordingtowrittendirectionsfromtheprescribingphysician.Inthecaseofnon-prescriptionmedication,writteninstructionsmustbeprovidedbytheparentorguardian.Forthepurposeofthisrequirement(Paragraph(2)ofSubsectionCof8.16.2.36)only,non-prescriptionmedicationsincludesunscreen,insectrepellentanddiapercreamsorotheroverthecountermedications.Withwrittenauthorizationfromthechild’sparentorguardian,sunscreenandinsectrepellantmaybeshared.Diapercreamshallnotbeshared. (3) Thelicenseewillberesponsibleforgivingmedicationtochildren.Thedesignatedstaffmemberwillensurenon-prescriptionandprescriptionmedicationshavealabelwiththechild’snameandthedatethemedicationwasbroughttothehome.Ahomewillkeepnon-prescriptionandprescriptionmedicationintheoriginalcontainerwithwritteninstructions,includingthenameofmedication,thedosage,andthehoursanddatesthechildshouldreceivethemedicine. (4) Thelicenseewillkeepandsignawrittenrecordofthedosage,dateandtimeachildisgivenmedication.Thisinformationwillbeprovidedtotheparentorguardianwhowillinitial/dateacknowledgmentofinformationreceivedonthedaythemedicationisgiven. (5) Whenthemedicationisnolongerneeded,itshallbereturnedtotheparentsorguardiansordestroyed.Thehomeshallnotadministerexpiredmedication. D. ILLNESSANDNOTIFIABLEDISEASES:
(1) Childrenorstaffmembersabsentduetoanynotifiablediseasewillnotreturntothehomewithoutasignedstatementfromaphysician. (2) Ahomewillseparateandconstantlyobserveachildwhobecomessickatthehomeandpromptlynotifyaparentorguardianofthechild’sillness. (3) Ahomewillsendachildhomewhen: (a) thechild’soraltemperatureis101degreesFahrenheitorgreaterorarmpittemperatureis100.4degreesFahrenheitorgreaterandthechildshowssignsofillnessorbehaviorchanges;or
(b) theeducatorobservessignsofcontagiousdiseaseorsevereillness.

8.16.2.37 TRANSPORTATIONREQUIREMENTSFORHOMES:
A. Whenahomeprovidestransportationtochildren,itisresponsibleforthecareofchildrenfromthetimeofpickuptodeliverytoaresponsibleadult.Allvehiclesusedfortransportationofchildrenwillhaveanoperablefireextinguisher,first-aidkit,first-aidmanual,waterandblanket.

Ahomewilllicenseallvehiclesusedfortransportingchildrenandwillmeetallapplicablestatevehiclelaws.Achildshallbetransportedonlyifthechildisproperlysecuredinachildpassengerrestraintdeviceorbyasafetybeltasfollows. (1) Childrenlessthanoneyearofageshallbeproperlysecuredinarear-facingchildpassengerrestraintdevicethatmeetsfederalstandards,intherearseatofavehiclethatisequippedwitharearseat.Ifthevehicleisnotequippedwitharearseat,thechildmayrideinthefrontseatofthevehicleifthepassenger-sideairbagisdeactivatedorifthevehicleisnotequippedwithadeactivationswitchforthepassenger-sideairbag. (2) Childrenoneyearofagethroughfouryearsofage,regardlessofweight,orchildrenwhoweighfortypounds,regardlessofage,shallbeproperlysecuredinachildpassengerrestraintdevicethatmeetsfederalstandards. (3) Childrenfiveyearsofagethroughsixyearsofage,regardlessofweight,orchildrenwhoweighlessthan60pounds,regardlessofage,shallbeproperlysecuredineitherachildboosterseatoranappropriatechildpassengerrestraintdevicethatmeetsfederalstandards. (4) Childrensevenyearsofagethrough12yearsofageshallbesecuredinachildpassengerrestraintdeviceorbyaseatbelt. C. Vehiclesusedfortransportingchildrenwillbeenclosedandproperlymaintained.Vehiclesshallbecleanedandinspectedinsideandout. D. Ahomewillloadandunloadchildrenatthecurbsideofthevehicleorinaprotectedparkingareaordriveway.Thehomewillensurechildrendonotcrossastreetunsupervisedafterleavingthevehicle. E. Noonewillsmokeinavehicleusedfortransportingchildren. F. Childrenmaybetransportedonlyinvehiclesthathavecurrentregistrationandinsurancecoverage.Alldriversmusthavecurrentdriver’slicenseandcomplywithmotorvehicleandtrafficlaws.PersonswhohavebeenconvictedinthelastsevenyearsofamisdemeanororfelonyDWI/DUIcannottransportchildrenundertheauspicesofalicensedfacility. G. Atleastoneadulttransportingchildrenshallbecurrentlycertifiedincardiopulmonaryresuscitation.[8.16.2.37NMAC-Rp,8.16.2.37NMAC,10/1/16]8.16.2.38 BUILDING,GROUNDANDSAFETYREQUIREMENTSFORHOMES: A. MECHANICALSYSTEMS: (1) Ahomewillmaintaincomfortabletemperatures(68degreesthrough82degreesFahrenheit)inallroomsusedbychildren.Ahomemayuseportablefansifthefansaresecuredandinaccessibletochildrenanddonotpresentanytripping,safetyorfirehazards.Intheeventairtemperatureinahomeexceedsthe82degreesFahrenheitinthesummermonthsbecauseofevaporativecoolertemperaturelimitations,itwillbeverifiedthatcoolingequipmentisfunctioning,isbeingmaintained,andthatsupplementalaideshavebeenemployed,suchas,butnotlimitedto:ceilingfans,portablefans,orportableevaporativecoolers. (2) Ahomewillnotuseunventedheaters,openflameheatersorportableheaters.Ahomewillinstallbarriersortakeotherstepstoensureheatingunits,areinaccessibletochildren.Heatingunitsincludehotwaterpipes,hotwaterbaseboardheatershotterthan110degreesFahrenheit,fireplaces,fireplaceinsertsandwoodstoves. (3) Ahomemustmaintainallheatingandcoolingequipmentsothatitisingoodworkingorder. (4) Ahomewillprovidefreshairandcontrolodorsbyeithermechanicalornaturalventilation.Ifahomeusesawindowforventilation,itwillhaveascreen.Ifadoorisusedforfreshairventilation,itmusthaveascreendoor. (5) Watercomingfromafaucetwillbebelow110degreesFahrenheit.Ahomewillinstallatemperingvalveaheadofalldomesticwater-heaterpiping. (6) Allfoodpreparationareas,sinks,washrooms,laundriesandbathroomswillhavehotandcoldrunningwaterunderpressure. D. I. PETS: (1) Ahomewillinformparentsorguardiansinwritingbeforepetsareinthehome.
